San Jose State University was hit with a Title IX violation by the United States Department of Education after an investigation found that the school&#8217;s women&#8217;s volleyball team kept a male player on its roster from 2022 to 2024.
The university is now saying it&#8217;s &#8220;reviewing&#8221; the Education Department&#8217;s findings.
In a statement to <a href="https://www.foxnews.com/sports/sjsu-responds-trump-admin-probe-found-university-violated-title-ix-trans-volleyball-player">Fox News</a>, San Jose State University said: &#8220;San Jose State, a member of the California State University system, received notification from the federal Department of Education’s Office of Civil Rights regarding its investigation into athletics participation on our past women’s volleyball teams. The Department informed the University of the outcome of its investigation and its findings. The University is in the process of reviewing the Department’s findings and proposed resolution agreement. We remain committed to providing a safe, respectful, and inclusive educational environment for all students while complying with applicable laws and regulations.&#8221;
The statement comes after the Department of Education concluded its investigation into the school on Wednesday.
&#8220;The U.S. Department of Education’s (ED) Office for Civil Rights (OCR) found that San José State University (SJSU) violated Title IX of the Education Amendments of 1972 (Title IX),&#8221; the department said in a statement. &#8220;OCR concluded that SJSU’s policies allowing males to compete in women’s sports and access female-only facilities deny women equal educational opportunities and benefits.&#8221;
Blaire Fleming is a male who played on the women&#8217;s volleyball team at San Jose State. Fleming played both indoor and beach volleyball. Fleming&#8217;s background became news after multiple <a href="https://reduxx.info/exclusive-biological-male-quietly-joined-womens-ncaa-division-i-volleyball-at-san-jose-state-university/">outlets</a> reported SJSU allegedly tried to hide Fleming&#8217;s sex from teammates, coaches, and opponents.
The Office of Civil Rights said that the cover-up forced female athletes on San Jose&#8217;s volleyball team to share locker rooms and hotel rooms with a male.
In addition to the privacy concerns, there were also alarming safety concerns. The investigation alleges that Fleming spiked the ball so hard that it knocked women on the opposing team to the ground. During one season, seven all-women’s teams from other universities forfeited their competitions, accepting a loss rather than competing against a male.
When Fleming&#8217;s sex was made known to Brooke Slusser, the teammate of Fleming filed a lawsuit against the school and the NCAA for not informing her or her teammates that Fleming was a male. An assistant coach was suspended and not re-contracted after she filed a Title IX complaint over the school’s handling of the male player.

Title IX prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. United States Secretary of Education Linda McMahon said she will hold San Jose State accountable.
&#8220;San José State University caused significant harm to female athletes by allowing a male to compete on the women’s volleyball team— and when female athletes spoke out, SJSU retaliated,&#8221; McMahon said.
As a result of the university&#8217;s noncompliance, the Department of Education is requiring a list of <a href="https://www.ed.gov/about/news/press-release/us-department-of-educations-office-civil-rights-finds-san-jose-state-university-violated-title-ix">actions</a> to be taken, including a public statement from SJSU saying the university will adopt biology-based definitions of the words &#8220;male&#8221; and &#8220;female.&#8221;  The school will also acknowledge that the sex of a human, male or female, is unchangeable, and send an apology to players who were on the volleyball and beach volleyball teams with Fleming and any players who refused to compete against Fleming. In the apology, the university has to express sincere regret for placing female athletes in that position.
San Jose State University has 10 days to comply or risk “imminent enforcement action.”
“We will not relent until SJSU is held to account for these abuses and commits to upholding Title IX to protect future athletes from the same indignities,&#8221; Assistant Secretary for Civil Rights Kimberly Richey said.

The university that produced Nathan Hale, one of America&#8217;s earliest and most revered heroes, apparently can’t tell the difference between men and women. 
A civil rights complaint filed Thursday by the watchdog group Defending Education accuses Yale University of violating Title IX and President Donald Trump’s executive order protecting women from radical gender ideology. The <a href="https://defendinged.org/wp-content/uploads/2026/01/Yale-OCR_letterhead_1.22.26.signed.pdf">complaint</a>, first obtained by The Daily Wire, alleges that the historic institution does not take sufficient steps to ensure that women are able to have privacy in their bathrooms without intrusion from gender-confused men.
“Yale University is one of the United States’ most prestigious educational institutions. It also happens to be one of the largest recipients of federal funding of any institution of higher education in the country,&#8221; Defending Education Vice President Sarah Parshall Perry told The Daily Wire. &#8220;But despite its rich history and longstanding prestige, Yale seems content to follow the path of its woke sister ivies in prioritizing gender identity over biological sex, in apparent violation of Title IX of the Education Amendments of 1972.&#8221;
The complaint was filed with the Education Department’s Office for Civil Rights and alleges that the university’s bathroom policies violate Title IX, which bans sex-based discrimination at federally funded institutions. 
Defending Education wants the Education Department to step in and ensure that women have access to their own bathrooms at Yale. 
“Yale’s bathroom policies likely violate Title IX because they provide male and gender-neutral bathrooms on some coed undergraduate dormitory floors without also providing female bathrooms on the same dormitory floors,” the complaint filed by Defending Education Vice President Sarah Parshall Perry says. “Yale has converted many campus bathrooms into ‘gender inclusive’ bathrooms.”
According to a map <a href="https://www.google.com/maps/d/u/0/viewer?ll=41.31882761989977%2C-72.94422212541701&amp;z=13&amp;mid=19iHelKu2YL3A7smpJmerSSuVfD-Ohr4">posted</a> by the university, Yale has dozens of “all gender” bathrooms throughout its sprawling New Haven, Connecticut, campus. Some of these “gender inclusive” bathrooms are located in residential buildings. 
“With bathrooms designated as women’s, men’s, or gender-inclusive, students have the autonomy over their living arrangements and can prioritize roommate choice without worrying about bathroom location,” Yale <a href="https://housing.yale.edu/undergraduate-housing/room-draw/additional-resources">notes</a> on its website. “Students can be assured that a suitable bathroom will be accessible within their college, even if it’s not on their specific floor.”
This appears to indicate that some dormitory floors have male and “all gender” bathrooms, but not female bathrooms. This is confirmed by a “Trans@Yale Survival Guide” <a href="https://web.archive.org/web/20251213175155/https://sites.google.com/yale.edu/transatyalesurvivalguide/survival-guide/bathrooms">that states</a> “most bathrooms throughout Yale&#8217;s housing facilities are gender-neutral and shared amongst students in any given entryway.”
Defending Education said in its complaint that they believe this violates President Donald Trump’s <a href="https://www.whitehouse.gov/presidential-actions/2025/01/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government/">executive order</a> cracking down on transgender ideology and Title IX guidance from the administration. 
The complaint also took issue with Yale’s interpretation of Title IX and its policies toward “gender identity.” For example, Yale’s “Policy Against Discrimination, Harassment, and Sexual Misconduct” <a href="https://oiea.yale.edu/frequently-asked-questions">treats</a> gender-identity as a protected class. Yale’s Title IX office also responds to claims of both “sex- and gender-based discrimination.” According to Defending Education, Title IX should only apply to sex discrimination. 
&#8220;Yale is attempting to have its cake (nearly $900 million in federal funding in fiscal year 2024), and eat it too (by instituting bathroom, harassment, and non-discrimination policies that pick sides on the gender identity debate). Too much federal funding is at stake to ignore malfeasance and bad legal takes like Yale&#8217;s,&#8221; Perry told The Daily Wire.
The Biden administration attempted to include gender-identity as a protected class under Title IX, but was <a href="https://www.dailywire.com/news/breaking-supreme-court-blocks-bidens-title-ix-rules-that-allowed-men-in-womens-sports">rebuffed</a> by the Supreme Court. That came after dozens of Republican-led states challenged the policy.

For some states, getting men out of women&#8217;s sports has more hurdles to clear than a track meet.
Take Colorado, which allows transgender-identifying boys to compete in girls’ sports in the name of protecting people’s “sexual identity.&#8221;
But that could soon change.
Colorado School District 49, located just outside of Colorado Springs, is leading a coalition of seven other districts that are challenging the law. The districts filed suit in May against the Colorado Civil Rights Division, the Colorado Civil Rights Commission, the Colorado Attorney General, and the Colorado High School Activities Association.
Last week, the Colorado High School Activities Association settled with the plaintiffs, a major victory for girls’ sports.
District 49 felt a lawsuit was necessary after it <a href="https://go.boarddocs.com/co/d49/Board.nsf/files/DG6NV961B96D/$file/JBA-%20Preserving%20%20Fairness%20and%20Safety%20in%20Sports%20(1).pdf" target="_blank" rel="noopener">adopted rules</a> last year requiring all school sports teams to be divided by biological sex. District 49 Superintendent Peter Hilts, said he made clear rules on biology for his school district after he noticed more incidents of men trying to compete as women around the country. District 49 filed their lawsuit May 9, 2025, to protect the district from any penalties brought on by Colorado’s sports governing body.
&#8220;I would never want my daughters to compete against a boy; that would be unfair,&#8221; Hilts told The Daily Wire.
The settlement with the association takes the Colorado High School Activities Association out of the lawsuit ongoing in Colorado federal court, and gives the eight districts protection from the association.
The <a href="https://docs.google.com/document/d/1-wCHCb3a08XDl8FkBAtPeOuuccyWn9yv4oL7bUO-_7E/edit?tab=t.0#heading=h.onkuqxh2a5uu" target="_blank" rel="noopener">association&#8217;s bylaws</a> state that &#8220;member schools shall ensure that all students have equal access and opportunities to participate in activities and athletics without unlawful discrimination based on disability, race, creed, color, gender identity, sexual orientation, religion, age, national origin, or ancestry.&#8221;
&#8220;We didn&#8217;t want a state agency to sanction our coaches or our student-athletes for advocating privacy, fairness, and dignity.&#8221;
Hilts says the settlement is a win for common sense.
&#8220;Before the settlement, they would have to self-censor, or worry about what would happen if they spoke out about men competing in women’s sports,” Hilts said. “The association could have taken action against coaches. They could have said coaches and athletes were being unsportsmanlike. They could have banned teams from postseason play, and they could have disqualified athletes from championships.”
The Colorado High School Activities Association told The Daily Wire it has &#8220;has never penalized a school or district for its policies on this issue, nor has it dictated what those policies should be.&#8221;
“At no point before filing this lawsuit did the plaintiffs engage in any dialogue with CHSAA,” a spokesman told The Daily Wire. “No outreach was made to inquire about our policies, our procedures, or the steps we had already taken to support schools navigating these issues.”
“This litigation consumed time and resources without producing any change to how CHSAA operates,” the spokesman continued, adding that “The settlement alters nothing about our policies, our practices, or our authority.”
The lead attorney representing School District 49, Michael Francisco, told The Daily Wire he hopes this settlement will encourage other districts to adopt policies that protect the integrity of sport.
&#8220;To our mind, CHSAA’s decision to settle leaves it to Colorado districts as to whether they want to adopt a policy governing biological sex in sports like the plaintiff districts,&#8221; Francisco said.
Hilts hopes a victory in federal court will result in President Trump’s <a href="https://www.whitehouse.gov/presidential-actions/2025/02/keeping-men-out-of-womens-sports/" target="_blank" rel="noopener">executive order</a> keeping men out of women’s sports being reflected in Colorado’s laws.
&#8220;We observed that under the Trump administration, the interpretation of Title IX created a contrast between state and federal law,” he said. “Colorado law gives precedence to gender identity, but Title IX was designed to give priority to biological sex. We think the state has been overly accommodating of the minority of individuals who want to compete outside their biological sex instead of protecting the thousands of other athletes.”
“We want the state to protect opportunities for all student-athletes,” he added. “Stop threatening and expecting school districts to defy common sense.&#8221;
Hilts said he is confident in the districts&#8217; case against the state to make Colorado a place where every athlete has a fair opportunity to compete.
&#8220;We would celebrate a ruling that the federal interpretation of Title IX is the correct interpretation. Common sense is girls should compete against girls and boys should compete against boys,&#8221; Hilts said.
The plaintiffs were back in federal court Monday to argue against the defendants’ motion to dismiss the case.  A decision on that motion is now pending.

A federal judge on Thursday struck down a Biden-era rule that expanded federal discrimination protections to encompass gender identity and forced health care providers to perform transgender procedures. 
U.S. District Judge Louis Guirola Jr. <a href="https://www.tn.gov/content/dam/tn/attorneygeneral/documents/pr/2025/pr25-51-opinion.pdf">sided</a> with Tennessee and fourteen other states that sued the Department of Health and Human Services (HHS) over the rule. Guirola said that the HHS overstepped its legal authority by expanding Title IX discrimination protections to gender identity. 
“In the opinion of the Court, Congress only contemplated biological sex when it enacted Title IX in 1972,” the judge wrote. “Therefore, the Court finds that HHS exceeded its authority by implementing regulations redefining sex discrimination and prohibiting gender-identity discrimination.”
The <a href="https://www.federalregister.gov/documents/2024/05/06/2024-08711/nondiscrimination-in-health-programs-and-activities">rule</a> had been put forth by the Biden administration on May 6, 2024. Despite the changeover in administration, the states still worried that the rule could be enforced against them in the future. Lawyers for Trump&#8217;s HHS argued that the states should fear no action from the federal government because of Trump&#8217;s crackdown on transgender ideology. 
Guirola said that since the rule was still in place, the “threat of enforcement and legal action is real&#8221; and that the resolution of the legal questions at the heart of the suit would “provide much-needed clarity.” 
He said that the rule would have blocked state-created health benefit exchanges, recipients of Medicaid and Medicare, and others from denying transgender medical procedures.
“When it enacted Title IX, Congress’s concern was prohibiting sex discrimination in education. It was particularly concerned with inequality that female students experienced. It did not at that time contemplate gender identity, transgender status, or ‘gender-affirming care,’” Guirola wrote.

Tennessee Attorney General Jonathan Skrmetti celebrated the decision from the court. 
“When Biden-era bureaucrats tried to illegally rewrite our laws to force radical gender ideology into every corner of American health care, Tennessee stood strong and stopped them,” Skrmetti said. “This decision restores not just common sense but also constitutional limits on federal overreach, and I am proud of the team of excellent attorneys who fought this through to the finish.”
Skrmetti argued that the rule would have blocked hospitals from maintaining sex-segregated spaces and forced states to subsidize transgender procedures through their Medicaid programs. 
The Republican attorneys general of Mississippi, Alabama, Georgia, Indiana, Kansas, Kentucky, Louisiana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Virginia, and West Virginia all signed on to the suit.
Through a series of executive orders, President Donald Trump has sought to reverse Biden&#8217;s adoption of transgender ideology. As part of that, he ordered a review of all executive actions taken by Biden on the issue.

Three years ago, NCAA swimmer Riley Gaines declared October 10 “XX Day,” an opportunity to celebrate female athletes who refuse to bow to radical left-wing gender ideology. 
This October 10, the XX-XY Athletics Fund announced several new 2025 Courage Wins Champions from a group of young women who hail from two of the most radical states in the nation, Oregon and California.
These female athletes didn’t just talk about fairness in sports. They put their names, reputations, and safety on the line to defend it.
They are high school athletes with no publicists or powerful sponsors backing them up. But despite the mainstream media and other powerful forces opposing them, these athletes stood proudly for the truth.
Jennifer Sey, the founder and CEO of XX-XY Athletics, says that deep personal conviction is contagious. 
“At a time when threats and bullying have escalated to violence, we are more determined than ever to use our voices and to reward those brave enough to use theirs to stand up for truth and biological reality,” Sey told The Daily Wire of the new winners.
“We need more speech, not less,” she added. “So we’re doubling down and awarding more winners than ever.” Sey added that these athletes are fighting “giants” like Nike and California Governor Gavin Newsom from “ground zero of the battle for fairness in sports.”
She went on, “It’s also notable that today is the deadline for Minnesota Governor Tim Walz to honor the sex-based rights of women in his state or cave to ideological bullies’ demands. He’s a coach and he knows the realities of sport. Young athletes like Kendall Kotzmacher are saving the day so high school girls won’t be erased and humiliated in their own sport.”
“By acknowledging and celebrating these brave young women, we hope to encourage more to stand up in defense of women’s sports as well,” Sey concluded.
Oregon is a state where track and field reigns supreme and where Nike, one of the most aggressively “gender progressive” sports brands, is headquartered. This is where five high school girls made a stand that challenged their state’s athletic programs.
Reese Eckard, Maddie Eischen, and Sophia Carpenter refused to compete against a male athlete at the Chehalem Track and Field Classic last spring. They knew it might cost them friends, rankings, and potentially their athletic futures, but they did it anyway.

“I am so grateful for the support XX-XY Athletics has given me as I speak out for fairness in girls’ sports.   I’ve gained so much courage from the other athletes here in Oregon who are also standing up for equal opportunity. Thank you to XX-XY for empowering me to share the truth. Together, our message becomes even stronger,” Eckard said in a statement. 
Their act of defiance sparked something bigger. When All-American runner Sophia Castañeda, the fastest female sophomore in Oregon history in the 400m, lost to a male athlete and was bullied for speaking up, she joined forces with the others. Together, they filed suit against the Oregon Schools Athletic Association.

And that’s not all. In a now-viral image, Alexa Anderson and Eckard can be seen stepping off the podium after a male competitor was crowned the girls’ state high jump champion. 
“I just didn’t think that it’s fair to biological females to allow and encourage biological males to compete among us, not only for myself and the other girl that stepped down, but the girl who should have been on the podium and the girl who didn’t even get to go to state because she was beaten by a biological male at districts,” Anderson said. 
“It is not about hate or transphobia at all. It’s about protecting women’s rights and their right to fair and equal competition within sports,” she said.
These are high schoolers fighting the same multi-billion-dollar sports industry that silenced adult Olympians. Their courage didn’t just win applause. It earned them the title of 2025 Courage Wins Champions.
Over in California, the ideological capital of this cultural madness, Governor Newsom’s administration is suing the federal government to preserve policies that force girls to compete against biological males. 
At Jurupa Valley High School, three teenage girls, including sisters Alyssa and Madison McPherson and their teammate Hadeel Hazameh, are refusing to play along.

“Standing up for what’s right shows more strength than any win or medal ever could,” Hazameh said of their efforts.
They’ve faced everything from online harassment to physical intimidation to threats against their faith. Still, they joined a lawsuit against their school district and the California Department of Education, demanding what should never have been controversial: that girls deserve their own sports.
“It’s not always easy to speak up, but that’s what makes it so powerful. Taking a stand shows other girls that they can be strong, fearless and true to themselves,” Alyssa McPherson said.
Courage Wins Award winners receive up to $5,000 and a spot in a leadership program designed to help them continue speaking up without being punished financially or socially.
That’s the heart of what Sey and XX-XY Athletics are building: a movement that makes standing for truth possible again.
Previous honorees include Brooke Slusser, Lauren Miller, Payton McNabb, Emmy Salerno, Stephanie Turner, Sia Liilii, and the Lincoln Middle School Five, a group of middle schoolers who took on adults and won.
The girls honored this year didn’t ask to be activists; they were just seeking fair competition. But they were unafraid to call out injustice when they saw it, rather than going away quietly. 
The Goliaths they’re fighting, Nike, Newsom, and every screeching activist with a platform, should take note. Because these brave Davids are the new face of women’s sports.

President Donald Trump on Thursday threatened to strip federal funding from California school districts that defy his administration’s transgender policies.
The Trump administration interprets Title IX as requiring schools to maintain separate bathrooms, locker rooms, and sports teams for males and females, a stance that directly conflicts with California state law allowing students to use facilities and join teams based on gender identity.
“Any California school district that doesn’t adhere to our Transgender policies, will not be funded,” Trump <a href="https://truthsocial.com/@realDonaldTrump/posts/115066339632774609">wrote</a> on Truth Social early Thursday morning. “Thank you for your attention to this matter!”
Trump’s ultimatum comes after the Justice Department <a href="https://www.dailywire.com/news/the-president-means-business-trump-admin-sues-california-over-transgender-athlete-policy">sued</a> California last month for continuing to allow transgender-identifying males to compete in female sports. The suit argued that California was depriving young girls of athletic opportunities. 
“Title IX was enacted over half a century ago to protect women and girls from discrimination. The Justice Department will not stand for policies that deprive girls of their hard-earned athletic trophies and ignore their safety on the field and in private spaces,” said Assistant Attorney General Harmeet Dhillon. “Young women should not have to sacrifice their rights to compete for scholarships, opportunities, and awards on the altar of woke gender ideology.”

The California Department of Education was allocated around $44 billion in federal funding for fiscal year 2025.
Aside from California, other school districts across the country could also lose funding over transgender policies, including multiple districts in Northern Virginia. The Education Department <a href="https://www.ed.gov/about/news/press-release/us-department-of-education-places-five-northern-virginia-school-districts-high-risk-status-and-reimbursement-payment-status-violating-title-ix">said</a> this week that the Alexandria City, Arlington County, Fairfax County, Loudoun County, and Prince William County school districts are all in danger of losing federal funding for violating Title IX. 
“States and school districts cannot openly violate federal law while simultaneously receiving federal funding with no additional scrutiny,” Secretary of Education Linda McMahon said. “The Northern Virginia School Divisions that are choosing to abide by woke gender ideology in place of federal law must now prove they are using every single federal dollar for a legal purpose.”
In February, Trump signed an <a href="https://www.whitehouse.gov/presidential-actions/2025/02/keeping-men-out-of-womens-sports/">executive order</a> saying that “it is the policy of the United States to rescind all funds from educational programs that deprive women and girls of fair athletic opportunities, which results in the endangerment, humiliation, and silencing of women and girls and deprives them of privacy.”

“The first drop launched on June 23rd, the anniversary of Title IX. So it&#8217;s a celebration of all that Title IX represents, the opportunity it presented for women and girls across the country,” Sey told The Daily Wire in an exclusive interview. “And it sort of highlights the fact that we need to continue to fight to uphold it. We’re not going backwards.”
Not long before the collection’s June release, the Department of Education ruled that the University of Pennsylvania <a href="https://www.ed.gov/about/news/press-release/us-department-of-education-announces-university-of-pennsylvania-has-entered-resolution-agreement-resolve-its-title-ix-violations#:~:text=This%20action%20follows%20the%20Department's,the%20Trump%20effect%20in%20action.">violated Title IX</a> by allowing a biological male to compete on the women’s swim team, therefore robbing female athletes of records, awards, and their dignity. 
The school was forced to apologize and restore honors to athletes like Gaines. Shortly after, the Supreme Court <a href="https://www.dailywire.com/news/red-states-set-to-defend-womens-sports-at-supreme-court">announced</a> it would hear two landmark cases involving men competing in women&#8217;s sports. Sey said it’s all proof that the cultural tide is turning, and that this collection will help capture that truth.
“The world is shifting under our feet,” she said. “That’s in large part due to Riley’s work.”
Sey has a background in standing up for what’s right. A former elite gymnast and the first whistleblower in her sport to expose abuse, she spent decades at the helm of major brands like Levi’s before founding XX-XY Athletics in 2023 with a singular mission: to stand up for real women.
“I looked around at all the big brands pretending to champion female athletes, and none of them really did. They make money off of it, but behind the scenes, they treat women with astonishing disregard,” she said.
With Be Bold, Sey is hoping to turn that hypocrisy on its head.
The collection wasn’t just inspired by Gaines. It was built with her.
“She was totally involved,” Sey said of the line of fitness apparel. “The red, white, and blue color scheme? That’s all her. The name Be Bold? That’s how she signs her books. We leaned into her favorite pieces and her signature style.”

Gaines’s go-to item is the cropped performance tank, Sey says, stressing that all the pieces both make a statement and support real athletes who need their sportswear to work as hard as they do. These are high-quality items designed for female athletes who have both principles and high standards.
Another standout from the collection is the oversized concert tee, a nod to both Gen Z-approved oversized street style and old-school Americana. The back of the tee features the 37 words of Title IX, a fashionable protest.

And for the non-athletes, there are plenty of options for a more casual look, like a vintage-inspired velour tracksuit straight out of 1972.
“When I was on the national team in the very early 80s, velour tracksuits were our dress sweats that we wore to march out at major international competitions,” Sey recalled. “So we definitely allude to them with some of the styling…we definitely use 1972 as a grounding point.”

This collection isn’t just about Riley, nor is it just a fashion statement. It’s about offering a platform to female athletes who’ve been abandoned by major brands and sports teams too afraid to take a side.
“One of the things we pride ourselves on is we scoop up athletes that no one else will touch. We will platform and empower the female athletes,” Sey said. “So they don&#8217;t feel so alone. Oftentimes they&#8217;re the only ones on their team or in their community [speaking up]. But when they realize there&#8217;s this network of women across the country who are doing the same thing, it&#8217;s incredibly powerful to have that.”

Sey says Gaines will continue working closely with the brand to identify and support more athletes who have the courage to speak up.
“At the end of the day, we&#8217;re all about supporting female athletes. I mean, that&#8217;s what it comes down to,” she said.
XX-XY’s gear isn’t just for show. A runner recently completed the Boston Marathon in under three hours wearing one of their tanks. That same style shows up in the new Be Bold collection, but this time reimagined in patriotic hues.
The idea behind Be Bold is simple but subversive: give everyday Americans an easy way to express support for truth, fairness, and biological reality without having to say a word.

Sey, who’s been targeted by critics and called every name in the book. But she says the backlash isn’t stopping her. 
“Noisy doesn’t mean right,” she said. “You’ve got to screw up your courage and stand by women and girls.”

When asked where she dreams of seeing pieces from the Be Bold collection show up, Sey didn’t hesitate.
“We would love to see someone wear any item atop a podium at an NCAA championship,” she said, “Or walking into the Supreme Court wearing a Title IX tee, that would be amazing, right?”
As the legal battles heat up, broader cultural beliefs continue to influence how this topic is perceived in the general public. Sey says the silent majority is finally starting to speak up. 
“You know, I think this movement for common sense is sort of billed as right-wing by the mainstream media. But the fact is, it&#8217;s not. It&#8217;s a really broad-based coalition. You can&#8217;t have 80% of Americans [agreeing] and have it only be the right. It’s just regular people.”

The Trump administration’s Department of Justice announced on Wednesday that it will sue the state of California for alleged violations of Title IX, in reference to keeping men out of women’s sports.
“Title IX was enacted over half a century ago to protect women and girls from discrimination. The Justice Department will not stand for policies that deprive girls of their hard-earned athletic trophies and ignore their safety on the field and in private spaces,” Assistant Attorney General Harmeet K. Dhillon said in a <a href="https://www.justice.gov/opa/pr/justice-department-sues-california-violating-title-ix-denying-girls-athletic-opportunities">statement</a>. “Young women should not have to sacrifice their rights to compete for scholarships, opportunities, and awards on the altar of woke gender ideology.”

On Monday, California rejected the resolution agreement from the Trump administration to follow federal law and ban transgender-identifying males from competing athletically with females.
The California Interscholastic Federation (CIF) aligned itself with the California Department of Education (CDE) and refused to sign the resolution agreement. The resolution was proposed on June 25, when the U.S. Department of Education’s Office for Civil Rights (OCR) announced the conclusion of its Title IX investigations into the state for allegations of discrimination against women and girls on the basis of sex.
Federal officials found that California was in clear violation of Title IX.
“As a result of the noncompliance finding, OCR has issued a proposed Resolution Agreement to CDE and CIF to resolve their Title IX violations,” the U.S. Department of Education <a href="https://www.ed.gov/about/news/press-release/us-department-of-education-finds-california-department-of-education-and-california-interscholastic-federation-violation-of-title-ix">said</a> in a press release issued last month. “OCR has offered both entities an opportunity to voluntarily agree to change these unlawful practices within 10 days or risk imminent enforcement action, including referral to the U.S. Department of Justice (DOJ) for proceedings.
In March, California Democratic Governor Gavin Newsom, in a move widely regarded as an attempt to distance himself from his leftist record and position himself for a future presidential run, <a href="https://calmatters.org/politics/2025/03/newsom-transgender-athletes/">claimed</a> on his podcast that he opposed men competing in women&#8217;s sports. When criticisms were made of a high school boy who had won a regional meet, Newsom responded, “I think it’s an issue of fairness. I completely agree with you on that. It is an issue of fairness. It’s deeply unfair. I’m not wrestling with the fairness issue. I totally agree with you.”
The lawsuit filed by the DOJ reportedly cited Newsom’s own words, that biological males competing in women’s sports was “deeply unfair.”
The Justice Department slammed policies that “eviscerate equal athletic opportunities for girls &#8230; they also require girls to share intimate spaces, such as locker rooms, with boys, causing a hostile educational environment that denies girls educational opportunities,” Fox News’s Dana Perino <a href="https://www.foxnews.com/video/6375448094112">reported</a>.
Education Secretary Linda McMahon stated to Perino, “We investigated this; the Office of Civil Rights at the Department of Education investigated. We told Governor Newsom that we’d be investigating these violations. We found California to be in violation of Title IX; we turned it over to the Justice Department, and they announced this morning that they were filing suit against California.&#8221;
“This is something President Trump campaigned on; his ‘Promises made, promises kept,” she said, adding, “It is the law. The president means business with it.”

California Rejects Title IX Plan To Keep Boys Out Of Girls’ Sports: ‘You’ll Be Hearing From Bondi’

A group that ostensibly works to help schools implement Title IX protections is working to circumvent federal law and push radical gender ideology in schools across the country, a watchdog group warns.
The Association of Title IX Administrators (ATIXA) provides consulting, webinars, and certifications for its 19,000 members, who are tasked with implementing the law at schools, universities, and other organizations. But <a href="https://americanparentscoalition.org/the-lookout-atixa-association-of-title-ix-administrators/" target="_blank" rel="noopener">according</a> to the American Parents Coalition, the association is less concerned with protecting women&#8217;s sports and spaces than it is with helping them implement transgender policies.
In one video sold to schools, a representative for the association suggests that schools can implement “enhanced privacy” policies so they don’t have to tell parents if their child wants to use a different name or pronouns. 
 “It’s unacceptable that supposed nonpartisan organizations posing as policy experts are weaponizing Title IX to promote radical gender ideology at the expense of girls. Even worse, they are side-stepping parental rights to do it,” American Parents Coalition Executive Director Alleigh Marré told The Daily Wire. 
This isn&#8217;t the first time the Association of Title IX Administrators has come under fire. Its members have <a href="https://www.dailywire.com/news/go-down-fighting-emails-reveal-school-official-plotting-to-skirt-trump-trans-guidance">been exposed</a> for encouraging ways to get behind President Donald Trump’s executive orders on transgender ideology. 
&#8220;Schools can become members of ATIXA without directly involving parents or the public. This membership allows them to purchase and implement ATIXA materials,” the American Parents Coalition warns in a &#8220;Lookout&#8221; bulletin released Wednesday, noting that the organization provides a job board to its members to help place Title IX coordinators at schools. 
In its alert for parents, the American Parents Coalition highlighted a training <a href="https://www.atixa.org/resources/transgender-issues-pertaining-to-minors-20-minutes-to-trained/">video</a> called “Transgender Issues Pertaining to Minors,&#8221; which Title IX coordinators can purchase for $99. The <a href="https://www.youtube.com/watch?v=atkZl9gRnp0&amp;t=18s">video</a> features a discussion where a presenter says that “a key thing” for “districts to navigate” is when a child comes forward who is “not comfortable” with their parents knowing about changing their gender identity or name. 
“Many districts are choosing to have a policy to allow for enhanced privacy around those particular requests,” the consultant says. 
Other <a href="https://www.ahu.edu/sites/default/files/assets/gender-equity-foundations-for-higher-education.pdf">materials</a> produced by the association include the “Gender Equity Foundations for Higher Education,&#8221; which was used <a href="https://www.ahu.edu/31/training-links-and-information">featured</a> by schools, and was featured on the website of AdventHealth University in Florida. After publication, AdventHealth University removed the ATIXA materials from its website and said that it had not used the materials for training.  
&#8220;While AdventHealth University is a member of the Association of Title IX Administrators, the school does not use the association’s materials in training and the materials are no longer available on its website,&#8221; the university told The Daily Wire.
 The training uses ideologically-loaded words and phrases like “gender fluid” and “sex assigned at birth,” and says that Title IX compliance requires allowing transgender identifying students to “access facilities consistent with their gender identity/expression.”
The training also discusses “support” through legal, medical, and social “gender transitions.” 
The coalition also highlights a presentation given by activist Shane Diamond, called “Supporting and Including Transgender Students in the Classroom and Beyond,” given at the Association of Title IX Administrators annual conference in 2021. Diamond, a woman who identifies as a man, has worked with radical groups like Transgender Legal Defense &amp; Education Fund and the World Professional Association for Transgender Health. She was <a href="https://www.youtube.com/watch?v=SgPlz8GmRZU">featured</a> in a Title IX anniversary video celebrated by the Association of Title IX Administrators in 2022. 
Diamond’s materials, <a href="https://www.loyola.edu/department/title-ix-bias/title-ix/training-materials.html">used</a> by Loyola University in Maryland, discuss “being an ally” to transgender-identifying people and takes aim at states that have adopted laws to keep males out of female sports. 
“The school’s obligation to treat a student consistent with the student’s gender identity or expression does not require notice from the parent or guardian,” Diamond notes in her presentation materials. 
Previous reporting shows Brett Sokolow, the chair of the advisory board for the Association of Title IX Administrators, plotting in writing ways to get around the Trump administration’s crackdown on gender ideology.  
In a January email first <a href="https://www.dailywire.com/news/go-down-fighting-emails-reveal-school-official-plotting-to-skirt-trump-trans-guidance">reported</a> on by The Daily Wire, Sokolow told a Virginia school&#8217;s Title IX coordinator that he didn’t know if her proposal to “skirt” executive action would work, but that it may be worth it to “go down fighting.&#8221; Different emails <a href="https://dailycaller.com/2025/06/16/exclusive-university-consultants-lgbtq-church/">reported</a> on by The Daily Caller also show Sokolow suggesting ways to use religious exemptions to get around Trump’s gender directives. 
“If you could establish and promulgate a LGBTQ+ church that met the standard…the courts would have to tolerate that church’s beliefs, whatever they are,” Sokolow wrote in an email. Federal <a href="https://www.fec.gov/data/receipts/individual-contributions/?contributor_name=Brett+Sokolow">records</a> reveal that he has given thousands of dollars to Democrat political candidates, including Barack Obama and Hillary Clinton.
The American Parents Coalition asked parents to check if schools in their own districts were a part of the Association of Title IX Administrators, and if so, what materials they were using. 
“ATIXA’s quiet infiltration of American education not only flouts parental rights and undermines the safety and protection of girls, but it also flies in the face of President Trump’s recent executive orders,” Marré said. “It’s long past time for ATIXA to be held accountable so that parents can be at peace knowing that school policies protect their daughters and respect their rights as parents.”

The &#8220;Big Beautiful Bill&#8221; moved one step closer to passage this weekend as Republican lawmakers push the president’s signature legislation to the finish line. This bill includes the bulk of President Trump’s agenda. Among other things, it will make his first-term tax cuts permanent, eliminate taxes on most tips, overtime pay, and Social Security payouts, increase funding for border security, and remove federal benefits from millions of illegal immigrants.
The House passed its version of the bill back in May, but the Senate has been debating it ever since, with serious fractures emerging, as a few moderate and hardline conservatives held out, debating issues such as Medicaid cuts and deficit spending. But after a number of tweaks and amendments, the &#8220;Big Beautiful Bill&#8221; crossed a major procedural hurdle when the chamber voted 51-49 late Saturday night to advance the bill to the floor for final debates.

GOP leaders say the goal is to hold a final vote as early as Monday, but Democrats are doing everything in their power to stall the process. For example, Senate Minority Leader Chuck Schumer (D-NY) utilized an obscure Senate rule to require clerks to read the entire 940-page bill aloud on the floor, which delayed proceedings by approximately 15 hours. Democrats will also introduce a number of amendments on issues such as tax cuts for the wealthy and protections for Medicaid and food stamp funding — they know those measures will likely fail, but want to put Republicans on the record ahead of the midterms. 
Republicans say Democrats can only stall for so long, and they’re confident the &#8220;Big Beautiful Bill&#8221; will pass — at which point it’ll return to the House for another final vote, and then make its way to the president’s desk. Trump has requested that it be ready by the 4th of July.
Meanwhile, the Trump administration announced that a deal had been reached with Beijing that would allow Chinese rare earth minerals to once again be exported to the United States in exchange for Washington easing a number of tariffs and other restrictions on the communist nation. While the White House has rushed to open up domestic mines in the United States, this process will take time, and China accounts for approximately 70% of global rare earth mineral production.
By contrast, tariff negotiations with Canada appear to have soured. On Friday, President Trump announced that he had terminated discussions with Canada “effective immediately” after it announced plans for a new digital tax that will cost American tech companies billions of dollars. In a Truth Social post, the president called the new tax a “direct and blatant attack on our Country” and vowed to “let Canada know the Tariff that they will be paying to do business with the United States” in the next week. In response, Canada has imposed new quotas on American steel imports and a 50% tariff on any additional steel entering the country.

<h2>SCOTUS Curbs Nationwide Injunctions From Lower Courts</h2>

Topline: The Supreme Court issues another landmark ruling on judicial overreach.
Trump vs. Casa, nominally a case about birthright citizenship ultimately centered on the authority of lower federal courts to issue nationwide, or “universal” injunctions, which block the federal government from implementing a policy across the entire country rather than providing narrow relief to the specific plaintiffs of a case. In a 6-3 decision, the Court ruled that, at least in most cases, lower courts do not have the power to issue such injunctions.
That has massive implications for the implementation of President Trump’s agenda; more than 100 universal injunctions have been issued against the Trump administration – including 40 in his second term – and the <a href="https://www.foxnews.com/politics/five-liberal-courts-tied-trumps-hands-before-scotus-clipped-power">bulk </a>of those have come from judges appointed by Democrats. Trump has argued that these decisions were politically motivated, that allowing any one of hundreds of federal judges to contradict executive policy violated the constitutional separation of powers, and that activists were deliberately filing cases in districts with left-leaning judges to hamstring his administration. After the ruling, President Trump lauded the “amazing decision,” <a href="https://www.dailywire.com/news/supreme-court-sides-with-trump-limits-nationwide-injunctions-in-birthright-citizenship-fight">saying,</a> “This is a very big moment, and it gives power back to people that should have it.”
Casa began as an attempt to challenge Trump’s executive order ending birthright citizenship for the children of illegal aliens. That order is called “Protecting the Meaning and Value of American Citizenship,” and it argues that the Fourteenth Amendment “has always excluded” those who were born in the United States “but not ‘subject to the jurisdiction thereof.’&#8217;’ The most relevant precedent, United States v. Wong Kim Ark in 1898, affirmed that the children of immigrants born on American soil are granted birthright citizenship – generally it has been assumed that that precedent applies to the children of illegal aliens as well, although the Supreme Court has not ruled on that definitively and chose not to in Trump vs. Casa.
In the majority opinion, Justice Amy Coney Barrett wrote that “federal courts do not exercise general oversight of the Executive Branch; they resolve cases and controversies consistent with the authority Congress has given them. When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too.”

The federal government has become far less accommodating to gender ideology since President Trump took office. Earlier this month, the Trump administration renamed June from “Pride Month” to “Title IX Month” — honoring the civil rights law that prohibits sex discrimination in schools. The president also acknowledged the difference between the sexes with several executive orders when he took office — he barred males in women’s sports at schools, and he prohibited schools from allowing kids to use the bathrooms of the opposite gender.
In a major win for women’s sports advocates, the National Collegiate Athletic Association (NCAA) changed its transgender athlete policy to allow only biological females to compete in women’s sports.
Public discourse on the issue has also undergone significant changes. Earlier this month, Olympic gymnast Simone Biles got into an online altercation with Riley Gaines, the college swimmer who was forced to give up her trophy to trans-identifying male competitor Lia Thomas. Biles attacked Gaines over her work trying to keep men out of women’s sports, and she even insulted her, telling Gaines she looked like a man. In response, Biles faced a tremendous amount of backlash – she ultimately apologized to Gaines before deleting her X account altogether.
Even leftist enclaves are under increasing pressure, from within and without, to protect women’s sports. Last week, Maine’s Democratic Governor Janet Mills, who has fought the Trump administration to keep trans-identifying athletes in women’s sports, was <a href="https://x.com/TONYxTWO/status/1936968005952630830">booed</a> by residents of her state when she spoke at the annual Maine Moose Lottery. On Wednesday, the Department of Education stated that it has found California to be in violation of Title IX by allowing males to participate in girls’ sports. Education Secretary Linda McMahon stated that California has 10 days to rectify its violations. This comes after even California Democratic Governor Gavin Newsom admitted on a podcast that males in women’s sports is “deeply unfair.”

The Department of Education’s Office for Civil Rights ruled Wednesday that California violated Title IX by allowing men to compete in women’s sports and use women’s locker rooms.
Secretary of Education Linda McMahon <a href="https://www.ed.gov/about/news/press-release/us-department-of-education-finds-california-department-of-education-and-california-interscholastic-federation-violation-of-title-ix">announced</a> the results of the office’s investigation on Wednesday.
“Although Governor Gavin Newsom admitted months ago it was ‘deeply unfair’ to allow men to compete in women’s sports, both the California Department of Education and the California Interscholastic Federation continued as recently as a few weeks ago to allow men to steal female athletes’ well-deserved accolades and to subject them to the indignity of unfair and unsafe competitions.”
“The Trump administration will relentlessly enforce Title IX protections for women and girls, and our findings today make clear that California has failed to adhere to its obligations under federal law,” McMahon said. “The state must swiftly come into compliance with Title IX or face the consequences that follow,” she added.
<a href="https://www.ed.gov/laws-and-policy/civil-rights-laws/title-ix-and-sex-discrimination">Title IX</a> “prohibits discrimination based on sex in education programs and activities that receive federal financial assistance.”
President Donald Trump signed an <a href="https://www.whitehouse.gov/presidential-actions/2025/02/keeping-men-out-of-womens-sports/">executive order</a> in January to formally recognize only two genders, based on a “fundamental and incontrovertible” reality. Under this framework, male participation in women’s sports counts as sex discrimination under Title IX. 
The following month, Trump signed another executive order to remove funding from states that violate Title IX. 
The California Interscholastic Federation responded in February by <a href="https://www.foxnews.com/sports/california-plans-continue-allowing-trans-athletes-compete-girls-sports-despite-trump-executive-order">declaring</a> it would continue to allow trans athletes to compete alongside women in accordance with state law.
 &#8220;The CIF provides students with the opportunity to belong, connect, and compete in education-based experiences…consistent with the student’s gender identity, irrespective of the gender listed on the student’s records.”
California has 10 days to comply with Title IX and Trump’s executive order, or it will face “imminent enforcement action, including referral to the U.S. Department of Justice (DOJ) for proceedings,” and removal of federal education funds, the Education Department says.
The Office fo Civil Rights has also instructed California to “restore to female athletes all individual records, titles, and awards misappropriated by male athletes competing in female competitions,” and sent a personalized letter of apology to each female athlete affected, “for allowing her educational experience to be marred by sex discrimination.”
The state must also propose a monitoring plan to ensure that it continues to abide by Title IX.
California receives a tremendous amount of federal funding. In 2022, the state <a href="https://usafacts.org/answers/how-much-money-does-the-federal-government-provide-state-and-local-governments/state/california/">received</a> over $161 billion. Residents say they won’t look kindly on Newsom if he puts these funds at risk.
“Without these federal funds, California’s budget crisis would dramatically worsen, and California’s most vulnerable students would stand to lose crucial programs and support,” writes the <a href="https://californiapolicycenter.org/california-accepts-billions-in-federal-funds-for-education-while-defying-federal-law/">California Policy Center</a>. 
“Newsom and the California Department of Education should reassess their priorities and consider what California families want most: a quality education for the next generation.”
