<a href="https://www.dailywire.com/topic/celebrities">Halle Berry</a> is seeking sole custody of her 10-year-old <a href="https://www.dailywire.com/topic/children">son</a>, Maceo.
The Academy Award-winning actress filed court documents alleging that the child’s father, French <a href="https://www.dailywire.com/topic/entertainment">actor</a> Olivier Martinez, is a hindrance to the child’s “best interests.”
Berry is requesting custody “or in the alternative, tie-breaking authority to make all decisions” about her son’s education, health and therapy needs, per legal documents obtained by <a href="https://people.com/halle-berry-seeks-sole-legal-custody-of-son-maceo-from-olivier-martinez-8697075">People</a>. The 58-year-old star claims she &#8220;is not perfect&#8221; but is &#8220;always seeking to prioritize the best interests&#8221; of her son.
The filing mentioned the child’s &#8220;educational challenges&#8221; and other concerns the actress had as she &#8220;fought for tutoring, an educational assessment and finding an environment that was suitable to Maceo’s needs.&#8221;

&#8220;[Martinez&#8217;s] actions and lack of cooperation with respect to Maceo’s psychological and educational needs have been detrimental to Maceo’s health and welfare,&#8221; the filing states. &#8220;Respondent’s refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo’s acting out behaviors to worsen, and caused further damage to Maceo’s and Petitioner’s relationship,&#8221; Fox News <a href="https://www.foxnews.com/entertainment/halle-berry-seeking-sole-custody-son-ex-olivier-martinez-turbulent-detrimental-behavior">reported</a>. 
The document includes Berry’s claims that Martinez has been &#8220;oppositional, unmoving and withheld his consent for years.&#8221;
&#8220;Because of [Martinez]’s opposition to any interventions whatsoever for years and because of [Martinez]’s prioritizing soccer activities over Maceo’s educational and psychological well-being, Maceo’s educational and behavioral challenges worsened, and he continued to fall further behind in school,&#8221; the document states.
Berry claimed Maceo would &#8220;act out&#8221; toward her after &#8220;longer periods of custody&#8221; with his father. She also stated that Martinez said Maceo was &#8220;old enough to make his own decisions.&#8221;

Berry and Martinez finalized their divorce last year following a lengthy court battle. The actress was ordered to pay her ex-husband close to $8,000 monthly for child support in addition to 4.3% on any income she makes over $2 million, per <a href="https://www.foxnews.com/entertainment/halle-berry-seeking-sole-custody-son-ex-olivier-martinez-turbulent-detrimental-behavior">Fox News</a>. Berry also pays for Maceo’s private school tuition, extracurriculars, and health care.
The actress previously went through a messy custody battle with her previous ex-husband, Gabriel Aubry, over their daughter. Their fight turned physical in 2012 when Aubry was <a href="https://www.cbsnews.com/losangeles/news/halle-barrys-ex-arrested-after-fight-with-her-fiance/">arrested</a> following an altercation stemming from him wanting to keep Berry from taking their daughter to France to live with Martinez, who she was dating at the time.
