Biden Issues Memo Delaying Deportation Of Palestinians in U.S.

On Wednesday, President Joe Biden issued a memorandum “directing the deferral of removal of certain Palestinians who are present in the United States” for 18 months.

Biden’s order would give Palestinians “a temporary safe haven,” White House national security adviser Jake Sullivan said, according to The New York Post. He noted that the order will encompass “most Palestinians in the United States,” adding, “Those convicted of felonies or who are otherwise deemed to pose a public safety threat are not eligible for deferred enforced departure. Anyone who voluntarily returns to the Palestinian territories would lose any such protections.”

Exceptions to the directive include: Palestinians who have voluntarily returned to the Palestinian territories after Wednesday, those who have not “continuously resided in the United States” since Wednesday, those “inadmissible under section 212(a)(3) of the Immigration and Nationality Act (INA) (8 U.S.C. 1182(a)(3)) or deportable under section 237(a)(4) of the INA (8 U.S.C. 1227(a)(4)),” those “convicted of any felony or two or more misdemeanors committed in the United States, or who meet any of the criteria set forth in section 208(b)(2)(A) of the INA (8 U.S.C. 1158(b)(2)(A)),” those who are subject to extradition, those “whose presence in the United States the Secretary of Homeland Security has determined is not in the interest of the United States or presents a danger to public safety,” and those “whose presence in the United States the Secretary of State has reasonable grounds to believe would have potentially serious adverse foreign policy consequences for the United States.”

In addition, Biden directed Secretary of Homeland Security Alejandro Mayorkas to “authorize employment for noncitizens whose removal has been deferred, as provided by this memorandum, for the duration of such deferral, and to consider suspending regulatory requirements with respect to F-1 nonimmigrant students who are Palestinians as the Secretary of Homeland Security determines to be appropriate.”

Last November, Democrats in the House and Senate sent Biden a letter urging him to “authorize Deferred Enforced Departure (DED) for Palestinians present in the United States.”

Meanwhile, Biden has undermined Israel in a number of ways; he has called Israel’s military operation against Hamas “over the top”; signed an executive order targeting Israeli civilians; in a meeting with Jordan’s King Abdullah, Biden — who quoted Hamas’ casualty figures — insisted that Israel’s military operation in Rafah “should not proceed without a credible plan” before Israel continued and rescued two hostages; watched as Abdullah lied and claimed “the vast majority of Muslim worshippers are not being allowed to enter Al-Aqsa Mosque,” and said to Abdullah that the status quo at the Temple Mount, which is under Arab control, should continue, thus denying Jews open access to the holiest place in Judaism.
