Parents in Maryland from differing faith backgrounds, including Muslims, Catholics, Protestants, and Orthodox Christians, filed a lawsuit in 2023 after they were denied the right to opt their children out of lessons concerning 20 books on so-called &#8220;inclusivity&#8221; picked by the Montgomery County Board of Education.
After the Fourth Circuit Court of Appeals ruled against the parents, The Becket Fund for Religious Liberty, a non-profit law firm representing the parents, appealed to the Supreme Court. On Friday, the high court agreed to hear the case.
“Cramming down controversial gender ideology on three-year-olds without their parents’ permission is an affront to our nation’s traditions, parental rights, and basic human decency,” Eric Baxter, vice president and senior counsel at Becket, <a href="https://becketfund.org/case/mahmoud-v-taylor/" target="_blank" rel="noopener">said</a> in a statement sent to The Daily Wire. “The Court must make clear: parents, not the state, should be the ones deciding how and when to introduce their children to sensitive issues about gender and sexuality.”

Becket&#8217;s website says the Montgomery County Board of Education announced over 20 new “inclusivity” books for its pre-K through eighth grade classrooms in the fall of 2022. Initially, parents were assured that they would be notified when the books were read and could opt their children out.
However, the school board in March 2023 said their policy changed; parents were no longer going to be notified about the LGBT content nor would they be permitted to opt out their children. One board member even claimed that a parent opting their child out of the content because it “offends your religious rights or your family values or your core beliefs is just telling [your] kid, ‘Here’s another reason to hate another person.'&#8221;
The books in question discuss pride parades, gender transitions, and pronoun preferences for children, according to Becket. One book for three- and four-year-olds asks kids to search for images from a word list that includes “intersex flag,” “[drag] queen,” “underwear,” “leather,” and the name of a celebrated LGBTQ activist and sex worker.

President-elect Donald Trump responded to the <a href="https://www.dailywire.com/news/supreme-court-allows-tiktok-ban-to-take-effect?topStoryPosition=2" target="_blank" rel="noopener">Supreme Court&#8217;s Friday ruling</a> that upholds a ban on Chinese-owned TikTok, saying that he will decide whether to take any executive action &#8220;in the not too distant future.&#8221;
Following the high court&#8217;s ruling, the ban on TikTok will go into effect on Sunday unless the social media platform&#8217;s parent company — Chinese-owned ByteDance — sells TikTok to an American company. The Biden administration <a href="https://www.nbcnews.com/politics/joe-biden/biden-administration-trump-implement-tiktok-ban-rcna188155" target="_blank" rel="noopener">said</a> it will leave the issue for Trump to address as soon as he is sworn in on Monday.
Trump, who has reportedly considered issuing an executive order to allow TikTok to remain available in app stores in the U.S., said in a <a href="https://truthsocial.com/@realDonaldTrump/posts/113844584193010573" target="_blank" rel="noopener">post</a> on Truth Social that the Supreme Court&#8217;s ruling wasn&#8217;t surprising, and added that he would &#8220;review the situation&#8221; before taking any executive action.
&#8220;The Supreme Court decision was expected, and everyone must respect it. My decision on TikTok will be made in the not too distant future, but I must have time to review the situation. Stay tuned!&#8221; Trump wrote.
Enforcement of the law will be the executive branch&#8217;s responsibility, and Trump <a href="https://www.cnn.com/2025/01/17/politics/tiktok-ban-supreme-court/index.html" target="_blank" rel="noopener">told</a> CNN shortly after the ruling was handed down that the decision on TikTok&#8217;s future &#8220;ultimately goes up to me, so you’re going to see what I’m going to do.&#8221;
&#8220;Congress has given me the decision, so I’ll be making the decision,&#8221; he added.
Earlier on Friday, Trump said he spoke to Chinese Communist Party leader Xi Jinping about multiple issues, including TikTok.

“I just spoke to Chairman Xi Jinping of China. The call was a very good one for both China and the U.S.A.,” Trump wrote on Truth Social. “It is my expectation that we will solve many problems together, and starting immediately. We discussed balancing Trade, Fentanyl, TikTok, and many other subjects. President Xi and I will do everything possible to make the World more peaceful and safe!”
Trump has flipped on the TikTok issue between his first and second terms. During his first term, Trump attempted to ban TikTok, but he recently met with TikTok&#8217;s CEO and <a href="https://nypost.com/2024/12/16/us-news/donald-trump-has-warm-spot-in-my-heart-for-tiktok-as-app-store-ban-looms-in-january/" target="_blank" rel="noopener">said</a> he has a &#8220;warm spot&#8221; for the social media giant after it helped energize young Americans who voted for him in the 2024 election.
TikTok &#8220;collects extensive personal information from and about its users,&#8221; the Supreme Court <a href="https://www.cnn.com/2025/01/17/politics/tiktok-ban-supreme-court/index.html" target="_blank" rel="noopener">wrote</a>, adding, that the platform does “not dispute that the government has an important and well-grounded interest in preventing China from collecting the personal data of tens of millions of U.S. TikTok users. Nor could they.&#8221; U.S. lawmakers and the Biden administration raised alarms about the national security threat presented by TikTok, arguing that the communist government could manipulate the platform&#8217;s content in a way that pushes Chinese propaganda on American citizens.
The Supreme Court acknowledged the threat, writing, “Data collection and analysis is a common practice in this digital age. But TikTok’s scale and susceptibility to foreign adversary control, together with the vast swaths of sensitive data the platform collects, justify differential treatment to address the Government’s national security concerns.”

The country&#8217;s most prominent appplication stores, run by tech giants Apple and Google, are actively pushing users to download TikTok just days before it will be illegal for them to do so.
As of Friday morning, the Chinese-owned TikTok is listed as the number one &#8220;must-have app&#8221; on Apple&#8217;s App Store, where roughly 118 million iPhone owners in the United States get their apps. The placement remained after a ruling was handed down by the Supreme Court <a href="https://www.dailywire.com/news/supreme-court-allows-tiktok-ban-to-take-effect?topStoryPosition=2" target="_blank" rel="noopener">upholding the ban</a>, which takes effect on Sunday and will immediately make it illegal for app store operators to allow downloads of TikTok as long as it is owned by a Chinese entity.

On Google&#8217;s Play Store, TikTok is also put front and center. The first thing visible when opening it is promotion for an event taking place on TikTok after the impending ban, with a prompt to install the app. It is also the top listed &#8220;sponsored&#8221; app, indicating that Google is being paid to promote it on its homepage.

Neither Apple nor Google respond to a request for comment. It is unclear exactly how decisions are made about what applications are recommended.
NBC News reported this week that TikTok was using its platform to push users to Lemon8, which is owned by the same Chinese parent company, ByteDance.
&#8220;On TikTok, advertisements for Lemon8 appear to have ramped up leading up to the ban,&#8221; NBC reported. &#8220;TikTok has used traditional advertisements on its platform urging users to download it. TikTok has also sent notifications to its users suggesting they download Lemon8.&#8221;
This means that a surge of users in TikTok&#8217;s potential final days will likely boost ByteDance&#8217;s effort to maintain a foothold in the United States, a prospect that has been deemed a national security threat. While the only companies explicitly listed in the legislation are ByteDance and subsidiary TikTok, there is <a href="https://www.cnbc.com/amp/2025/01/15/tiktok-ban-could-ensnare-rednote-lemon8-and-other-chinese-apps.html" target="_blank" rel="noopener">speculation</a> that other ByteDance apps could also end up banned.

President Joe Biden has said he has no plans to enforce the ban, but top Senators have warned Apple and Google to comply with its orders.
&#8220;Penalties for companies like Apple and Google could run as high as $850 billion,&#8221; said Sen. Tom Cotton (R-AR). &#8220;Not sure I’d take a politician’s word if I ran those companies.&#8221;

The Supreme Court ruled on Friday that the TikTok ban passed by Congress could go into effect this weekend, saying it did not violate the First Amendment. 
In an unassigned opinion, the court ruled that Congress was justified in passing the ban because of concerns about the Chinese government using TikTok to harvest the private data of millions of Americans. If China-based ByteDance does not sell the social media platform, the ban will go into effect on Sunday, January 19. 
“There is no doubt that, for more than 170 million Americans, TikTok offers a distinctive and expansive outlet for expression, means of engagement, and source of community,” the court wrote. “But Congress has determined that divestiture is necessary to address its well-supported national security concerns regarding TikTok’s data collection practices and relationship with a foreign adversary.”
While the main opinion was not signed, two concurring opinions were attached from Justice Neil Gorsuch and Justice Sonia Sotomayor.
The court said that those challenging the ban, including a group of TikTok users, did not provide any examples of the law actually curtailing their speech.
&#8220;It is not clear that the Act itself directly regulates protected expressive activity, or conduct with an expressive component. Indeed, the Act does not regulate the creator petitioners at all. And it directly regulates ByteDance Ltd. and TikTok Inc. only through the divestiture requirement,&#8221; the court wrote.

The court added that the regulations imposed by the law, which was signed by President Joe Biden in April, were content neutral.
&#8220;They impose TikTok-specific prohibitions due to a foreign adversary’s control over the platform and make divestiture a prerequisite for the platform’s continued operation in the United States,&#8221; the court wrote. &#8220;The Government also supports the challenged provisions with a content-neutral justification: preventing China from collecting vast amounts of sensitive data from 170 million U. S. TikTok users.&#8221;
The law from Congress says that TikTok will be banned as long as it is owned by the Chinese company ByteDance. If it is sold to an American company, it will no longer be banned. There have been various proposals floated to save TikTok, including from &#8220;Shark Tank&#8221; investor Kevin O’Leary, who has partnered with a group called &#8220;The People&#8217;s Bid for TikTok.&#8221;

The man who turned himself in after traveling across the country to kill Supreme Court Justice Brett Kavanaugh found the justice&#8217;s home through media reports on the illegal protests outside Kavanaugh&#8217;s home, court filings show.
Authorities <a href="https://www.dailywire.com/news/police-arrest-armed-man-near-brett-kavanaughs-home-who-allegedly-wanted-to-kill-the-justice-report">arrested</a> 26-year-old Nicholas Roske in 2022 in Kavanaugh&#8217;s Maryland neighborhood, carrying a bag full of weapons and burglary tools, after he called the police on himself. <a href="https://www.documentcloud.org/documents/25476861-roskemts2010325/">Court filings show</a> that Roske described himself as “actively suicidal” and said he wanted to “do something positive before I die” by taking out Kavanaugh before the justice could vote to overturn Roe v. Wade.
He found Kavanaugh&#8217;s neighborhood online, according to court documents. He saw an article with a &#8220;picture of the family&#8217;s house,&#8221; including the house number. It was as simple as that.
&#8220;I was thinking about — I was thinking about killing Brett Kavanaugh and then killing myself,&#8221; he said to the <a href="https://www.documentcloud.org/documents/25476860-roskesuppmts010325/">officers who arrived</a> on the scene, according to January court filings. &#8220;And then I texted my sister that I loved her. And then she called me and she told me not to do it. And then I called 9-1-1-.&#8221;
&#8220;I saw the news and it was upsetting, and I was already suicidal,&#8221; he told detectives later, as he described how he tracked down Kavanaugh&#8217;s home and planned the assassination.  &#8220;And I don&#8217;t know. It was something to — it was like a project I guess&#8230;&#8221;

Roske allegedly flew from California to Dulles International Airport after he found Kavanaugh&#8217;s home using media photographs of protests outside the justice&#8217;s home. Those protests began after POLITICO&#8217;s May 2022 publication of a leaked draft Supreme Court opinion overturning Roe. Radical leftist groups published Supreme Court justices&#8217; addresses online and urged protestors to make the justices uncomfortable in efforts to save Roe.
&#8220;I&#8217;m not sure how I found the street, but there&#8217;s a — I read an article that has a picture of the front of his house on it and it has the street number,&#8221; he said in a transcript included in the court filings. &#8220;And then I cross-referenced it &#8230; I would put the pictures from the press, you know, from various protests, and I compared it to the outside of his house in an app.&#8221;
Federal law bars &#8220;picketing or parading in or near a building or residence that houses a judge, juror, witness, court officer, or United States court with the intent to obstruct, interfere with, or impede the administration of justice.&#8221; Attorney General Merrick Garland acknowledged in 2023 that a violation of that statute is a federal crime, but he has not enforced that law against the protestors, even though Virginia Gov. Glenn Youngkin and then-Maryland Gov. Larry Hogan requested that he do so.
In interviews with officers, Roske <a href="https://storage.courtlistener.com/recap/gov.uscourts.mdd.514255/gov.uscourts.mdd.514255.64.7.pdf">describes</a> how he struggled with serious mental health issues, particularly when his parents went on vacation and he was home alone. He shared that he thought about &#8220;killing pedofiles [sic].&#8221;
&#8220;One of the biggest struggles with my [REDACTED] is having a sense of purpose, a sense that I&#8217;m doing something that matters, so I thought if I could, like, prevent a child from being raped, that would be good. But the more I thought about it, the more I realized that, like, I wouldn&#8217;t actually like do anything because the people that were convicted are already, like, on watch and all that stuff anyway.&#8221;
His alleged plan was to &#8220;break in, shoot him, and then shoot myself.&#8221;
Roske&#8217;s lawyers in several court filings called for the suppression of a &#8220;warrantless search&#8221; of his backpack, suitcase, and &#8220;a locked container in the suitcase&#8221; as well as the &#8220;seizure of these items&#8217; contents.&#8221;
The court filings include photos of the police body camera footage from the night of June 8, 2022, when the officers approached Roske.

It also includes the <a href="https://storage.courtlistener.com/recap/gov.uscourts.mdd.514255/gov.uscourts.mdd.514255.67.2.pdf">transcript</a> of Roske&#8217;s 911 call, made at 1:39 am on June 8, 2022, in which he told the operator that he had come to Maryland from California to kill Kavanaugh.
That call transcript reveals Roske sharing that he has been having &#8220;these thoughts&#8221; for &#8220;a long time&#8221; — apparently referring to his suicidal thoughts. The dispatcher asks him if he&#8217;s thinking of hurting anyone, including himself, and he responds, &#8220;Yes.&#8221; He tells the dispatcher that he brought a firearm with him and that he&#8217;s storing it in a black suitcase.
&#8220;I need psychiatric help,&#8221; he tells the dispatcher when asked if he needs medical attention. The dispatcher walks Roske through the next steps, explaining to him that officers will be arriving soon, and encouraging him to follow the officer&#8217;s directions in order to avoid confrontation.
&#8220;I&#8217;m sitting on the curb,&#8221; Roske told the dispatcher, who asked him, &#8220;Do you have any other weapons with you?&#8221;
&#8220;There are other weapons in the suitcase, but I do not have any in my possession,&#8221; he responded. 
&#8220;What other weapons are in the suitcase?&#8221; the dispatcher questioned. 
&#8220;There is pepper spray,&#8221; he said. &#8220;There is a knife. There are various tools. No other firearms. No explosives, nothing like that.&#8221; 
The dispatcher asked Roske: &#8220;And you said you came from California. Do you know someone down here?&#8221;
&#8220;Brett Kavanaugh,&#8221; Roske responded. 
&#8220;You said red, like that color?&#8221; questioned the dispatcher. 
&#8220;Brett,&#8221; said Roske. 
&#8220;Brett,&#8221; the dispatcher repeated. 
&#8220;The Supreme Court Justice,&#8221; Roske clarified. 
The dispatcher responded. &#8220;Okay. And you came alone?&#8221;
&#8220;Correct,&#8221; the attempted assassin told him. 
&#8220;Okay. And why were you coming there? Just to hurt yourself and him or what was going to happen?&#8221;
&#8220;Correct,&#8221; Roske responded again.
Many on the right <a href="https://www.dailywire.com/news/abortion-supporters-leaked-supreme-court-draft-to-intimidate-the-court-pro-life-advocates-say">have suggested</a> that the draft opinion was leaked by a progressive Supreme Court clerk in an effort to push the court to change its decision. Following the leak, conservative activists and legal experts quickly called for the Supreme Court to release its decision on Dobbs v. Jackson Women’s Health Organization.
In an early May 2022 editorial, the Wall Street Journal editorial board expressed concerns that an “abortion fanatic” might “commit an act of violence” in an effort to subvert the court’s expected decision to overturn Roe.
“One question is how fast the Court should now move to publish its decision in Dobbs v. Jackson Women’s Health Organization,” <a href="https://www.wsj.com/articles/the-supreme-court-leak-on-roe-v-wade-samuel-alito-john-roberts-abortion-draft-opinion-11651605792">the board said</a>. “There’s an argument for getting it out fast to make it a fait accompli.”
“Politico said the Alito draft was circulated in February, so the Justices have had ample time to absorb it and respond,” it continued. “We hate to say this, but some abortion fanatic could decide to commit an act of violence to stop a 5-4 ruling. It’s an awful thought, but we live in fanatical times.”
More than two years later, the Supreme Court has still not identified its leaker. Roske&#8217;s trial will begin June 9, <a href="https://www.politico.com/news/2025/01/03/kavanaugh-alleged-assassination-evidence-00196471">according to POLITICO</a>.

The Supreme Court voted 5-4 to reject President-elect <a href="https://www.dailywire.com/topic/donald-trump" target="_blank" rel="noopener">Donald Trump’s</a> request to pause his sentencing hearing related to his New York hush-money case.
Chief Justice John Roberts and Justice Amy Coney Barrett sided with the court’s three liberal justices to reject Trump’s request, according to the <a href="https://apnews.com/article/trump-hush-money-appeal-12f9e883b71d8c37178b0ea32193e8c4" target="_blank" rel="noopener">Associated Press</a>. The majority did not rule on the merits of Trump’s argument, but said that the question could be decided through an appeal.
Justices Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Clarence Thomas voted to delay the sentencing hearing.
Trump responded to the ruling on Thursday evening during a dinner with Republican governors at his Florida resort: “I respect the court’s opinion — I think it was actually a very good opinion for us because you saw what they said, but they invited the appeal and the appeal is on the bigger issue. So, we’ll see how it works out.”
George Washington University law professor Jonathan Turley said the Supreme Court’s ruling was predictable and, despite what the decision would suggest, may ultimately help Trump.
“There is an overriding preference among appellate judges for the finalizing of cases with sentencing so that the entire case can be reviewed,” Turley <a href="https://x.com/JonathanTurley/status/1877516109567463730" target="_blank" rel="noopener">said</a> on X explaining the decision.

“[I]n handing down this sentence, Judge Merchan will give Trump an even greater mandate. The New York case is the rawest form of lawfare and Alvin Bragg is its happiest warrior,” Turley said.
“The whole case can now work its way eventually back to the United States Supreme Court,” he added, suggesting that the court may then overturn the entire case.
Trump’s legal team <a href="https://www.dailywire.com/news/trump-appeals-to-scotus-to-pause-sentencing-in-hush-money-case" target="_blank" rel="noopener">filed</a> a brief with the court on Wednesday asking the court to delay the Friday sentencing hearing, arguing that the sentencing would violate Trump’s presidential immunity.
“[T]he doctrine of sitting-President immunity shields [Trump] from criminal process during the brief but crucial period of Presidential transition, while he engages in the extraordinarily demanding task of preparing to assume the Executive power of the United States,” the filing said.
Trump’s legal team also argued that his conviction should be dismissed as some of the evidence used to convict him on 34 felony charges should not have been allowed in the court, as it constituted official acts he took as president.
“These included, without limitation, statements issued through his official Presidential Twitter account to the American people in 2018, statements to the press in official Presidential media appearances, documentary evidence reflecting official Presidential actions, and testimony of former White House employees regarding official actions taken by President Trump during his first term as President,” the filing said.

SCOTUS Rejects Trump’s Request To Pause Sentencing In Hush-Money Case

President-elect Donald Trump on Wednesday asked the Supreme Court to pause his sentencing in the New York hush money case.
Trump’s sentencing, scheduled for Friday morning, violates the president-elect’s presidential immunity as outlined in a Supreme Court decision in July, according to Trump’s legal team. Allowing the sentencing to move forward would be a “grave injustice and harm to the institution of the Presidency and the operations of the federal government,” Trump’s lawyers wrote.
“President Trump’s legal team filed an emergency petition with the United States Supreme Court, asking the Court to correct the unjust actions by New York courts and stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt,” Trump spokesman Steven Cheung <a href="https://x.com/mrddmia/status/1876992687141745145?s=46&amp;t=o-U3qwC25WnWaylJ0oeG7Q" target="_blank" rel="noopener">said</a>, referring to Manhattan District Attorney Alvin Bragg. “The Supreme Court’s historic decision on Immunity, the Constitution, and established legal precedent mandate that this meritless hoax be immediately dismissed.”
The legal <a href="https://www.supremecourt.gov/DocketPDF/24/24A666/336760/20250107212856360_2025-01-07%20-%20Trump%20v.%20New%20York%20-%20Supreme%20Court%20Stay%20Application.pdf" target="_blank" rel="noopener">filing</a> states that the hush money case and Trump’s conviction on 34 felony counts is on poor legal footing. Part of the evidence used at trial to secure the conviction was based on official acts of the president and should have been shielded from the court.
“These included, without limitation, statements issued through his official Presidential Twitter account to the American people in 2018, statements to the press in official Presidential media appearances, documentary evidence reflecting official Presidential actions, and testimony of former White House employees regarding official actions taken by President Trump during his first term as President,” the filing states.

The legal team also argued that legal immunity for sitting presidents covers the transition period between the election and when a president assumes office.
“[T]he doctrine of sitting-President immunity shields [Trump] from criminal process during the brief but crucial period of Presidential transition, while he engages in the extraordinarily demanding task of preparing to assume the Executive power of the United States,” the filing says.d
Supreme Court Justice Sonia Sotomayor ordered Bragg’s office to respond to the Trump team’s filing by 10 a.m. Thursday.
The Trump team made an emergency appeal to the Supreme Court a day after a New York appeals court rejected a similar petition.
In a legal filing to the appeals court, Bragg’s office <a href="https://www.nbcnews.com/politics/donald-trump/trumps-lawyers-ask-new-york-appeals-court-halt-friday-hush-money-sente-rcna186586" target="_blank" rel="noopener">argued</a> that Trump as president-elect “has no viable claim of presidential immunity from ordinary criminal process.” Prosecutors said that Trump “is not yet engaged in any official presidential functions that would be disrupted by the sentencing.”

Trump Appeals To SCOTUS To Pause Sentencing In Hush Money Case

Supreme Court Chief Justice John Roberts issued his <a href="https://www.supremecourt.gov/publicinfo/year-end/2024year-endreport.pdf" target="_blank" rel="noopener">annual report</a> this week, and he attempted to head off the growing tendency among some citizens and politicians to violently interfere with the judicial system&#8217;s independence.
In the last two years, the Supreme Court has made rulings that have angered the political Left, from overturning Roe v. Wade and the Chevron Deference Doctrine to granting President-elect Donald Trump immunity from criminal prosecution for his conduct while in office. The Chevron Deference Doctrine stated that if federal legislation was unclear or left an administrative gap, the courts had to defer to the regulatory agency&#8217;s interpretation if the interpretation was “reasonable,” which allowed Democrats for decades to use executive agencies to circumvent the judicial system and institute leftist regulations.
“It is not in the nature of judicial work to make everyone happy,” Roberts wrote. “Most cases have a winner and a loser. Every Administration suffers defeats in the court system—sometimes in cases with major ramifications for executive or legislative power or other consequential topics. Nevertheless, for the past several decades, the decisions of the courts, popular or not, have been followed, and the Nation has avoided the standoffs that plagued the 1950s and 1960s.”
“As Chief Justice Rehnquist wrote, ‘(a) natural consequence of life tenure should be the ability to benefit from informed criticism from legislators, the bar, academy, and the public.’ Unfortunately, not all actors engage in ‘informed criticism’ or anything resembling it. I feel compelled to address four areas of illegitimate activity that, in my view, do threaten the independence on judges on which the rule of law depends: (1) violence, (2) intimidation, (3) disinformation, and (4) threats to defy lawfully entered judgments.”
Roberts quoted federal marshals who said they had investigated more than 1,000 serious threats against federal judges in the last five years. He mentioned two judges, one in Wisconsin and one in Maryland, who were murdered in their homes in the last two years.
Roberts wrote, “&#8230;disappointed litigants rage at judicial decisions on the Internet, urging readers to send a message to the judge. &#8230; Some of these messages promote violence &#8230;” He also spoke of critics doxing judges, imperiling them by revealing their private information.
Roberts stated that implementing more civic education would be a good antidote for the spread of misinformation about judicial decisions. He spoke of malign foreign actors, saying, “For example, bots distort judicial decisions, using fake or exaggerated narratives to foment discord within our democracy. In other cases, hackers steal information — often confidential and highly sensitive — for nefarious purposes, sometimes for private benefit and other times for the use of state actors themselves.”
“Although Roberts did not mention any of the ‘hostile foreign state actors’ responsible for such disinformation by name, the justices will hear oral arguments next week in a challenge to a federal law that would require social media giant TikTok to shut down in the United States unless its parent company can sell it off by Jan. 19,” Amy Howe of SCOTUSblog <a href="https://www.scotusblog.com/2024/12/in-year-end-report-chief-justice-defends-judiciarys-independence/" target="_blank" rel="noopener">pointed out</a>.
Roberts quoted William Howard Taft, who served as president before serving as Chief Justice of the Supreme Court, saying, “Nothing tends more to render judges careful in their decisions and anxiously solicitous to do exact justice than the consciousness that every act of theirs is to be subject to the intelligent scrutiny of their fellow men, and to their candid criticism.”
“But violence, intimidation, and defiance directed at judges because of their work undermine our Republic, and are wholly unacceptable,” Roberts concluded.

Chief Justice Issues Warning: Do Not Threaten The Judicial System With Violence

As we prepare to enter the new year, we’re taking you back to some of The Daily Wire’s best reporting from 2024. <a href="https://www.dailywire.com/news/completely-unjustified-medical-journal-retracts-major-studies-critical-of-abortion-pill-ahead-of-supreme-court-clash" target="_blank" rel="noopener">This article</a> was originally published on February 5. 
Major scientific studies on the potential harm of abortion pills were retracted by their publisher, just weeks before the Supreme Court heard arguments on the availability of such drugs.
Three studies, including two on the potential harms of the abortion pill just, were retracted by Sage Publishing, an independent academic publishing company. The <a href="https://journals.sagepub.com/doi/10.1177/23333928231216699">retraction notice</a> states that an independent review of the studies was conducted due to a single reader’s complaint that the studies included misleading data and that the authors were affiliated with a pro-life organization, the Charlotte Lozier Institute, presenting a conflict of interest.
The authors of the studies say the retractions are a politically motivated effort to discredit research that was cited in U.S. District Judge Matthew Kacsmaryk’s April 2023 decision to suspend approval of mifepristone, the drug used in roughly half of all abortions in the United States. The Supreme Court is set to hear arguments in March on the legality of restricting the abortion pill based on Kacsmaryk’s ruling, proceedings that will certainly be impacted by the retractions.
Dr. James Studnicki, a listed author on all three studies in question, told The Daily Wire that the retractions were “completely unjustified” and that the retractions were meant to discredit scientific research that challenged the pro-abortion bias engrained in academia.
Studnicki, who trained at Johns Hopkins University and has spent decades conducting scientific research, said that he and his fellow researchers were targeted “because of the visibility of our work, because of the fact that our work was having such an influence on the discussion about abortion that was occurring in the states and in the courts at the highest levels.”
One of the now-retracted <a href="https://journals.sagepub.com/doi/full/10.1177/23333928211053965">studies</a>, published November 9, 2021, found that the rate of emergency room visits following chemical abortions had spiked 500% from 2002-2015, according to Medicaid claims data. Another one of the studies, published May 20, 2022, <a href="https://journals.sagepub.com/doi/full/10.1177/23333928221103107">analyzed the likelihood</a> of recurring emergency room visits for women who did not disclose to doctors that they had a chemical abortion.
These two studies were <a href="https://storage.courtlistener.com/recap/gov.uscourts.txnd.370067/gov.uscourts.txnd.370067.137.0_19.pdf">cited</a> in Kacsmaryk’s <a href="https://www.dailywire.com/news/federal-judge-in-texas-suspends-fda-approval-of-abortion-pill-used-in-up-to-half-of-abortions">decision</a> to suspend FDA approval of mifepristone.
Additionally, the testimony of Dr. Ingrid Skop, who was an author on all three of the articles, was cited multiple times in an August <a href="https://s3.documentcloud.org/documents/23911247/5th-circuit-ruling-on-mifepristone-access.pdf">decision</a> from the Fifth Circuit Court of Appeals where the <a href="https://www.dailywire.com/news/federal-appeals-court-makes-decision-on-the-mailing-of-abortion-pills">court said</a> that chemical abortion drug mifepristone should not be distributed through the mail or prescribed via telemedicine.
Studnicki added that the retractions were emblematic of the politicization of science, pointing to stances on transgender and climate issues widely held by the academic establishment. He said that proponents of abortion were deeply threatened by the overturning of Roe v. Wade and were now pushing to banish any research suggesting dangers with abortion out of the academy.
“I think Dobbs really accelerated this, I think there’s a sense of desperation among those in the abortion industry,” he told The Daily Wire ahead of the retraction, which was expected. “They’ve always had the literature to themselves. All of the major health associations are pro-abortion, most of the journals are pro-abortion, all the academic departments in the universities are pro-abortion.”
In previous correspondence with the authors, Sage pushed back against allegations of political bias, saying that issues identified in the articles were based on independent review by “subject experts” and methodological issues with the articles.
Sage declined to comment on the retraction, but directed The Daily Wire to an <a href="https://perspectivesblog.sagepub.com/blog/note-from-sage-on-retractions-in-health-services-research-and-managerial-epidemiology" target="_blank" rel="noopener">explanation</a> of its decision.
No issues were raised with any of the studies until April 2023, the same month of Kacsmaryk’s decision, when pharmaceutical sciences professor and abortion supporter Chris Adkins <a href="https://www.newsfromthestates.com/article/study-cited-texas-judge-abortion-pill-case-under-investigation" target="_blank" rel="noopener">complained</a> to Sage about the article claiming that the study showing an increase in rate of emergency room visits was full of “dishonest science” and “grossly misleading.”
The researchers were not informed of any issues with the articles until June 28, 2023, when they were informed of the complaint from the reader. They responded to the concerns on July 13, and an expression of concern was placed on the article dated July 25.
After months of back and forth with the journal, on November 13, Sage told the researchers that they would be retracting the three studies. The next day, Studnicki was kicked off the editorial board of the Health Services Research and Managerial Epidemiology journal, months before the retractions actually took place.
“In light of the decision to retract three research articles where you are an author, I believe that your term as an editorial board member must now come to an end. As the Editor, I appreciated your contributions to the journal,” Dr. Gregory Garrison wrote to Studnicki in an email viewed by The Daily Wire.
This message came after Garrison <a href="https://journals.sagepub.com/doi/full/10.1177/23333928221083061">had</a> previously highlighted Studnicki’s research in question in an editorial for Sage in March 2022.
On November 16, the researchers sent a letter to Sage requesting more time to respond to the retraction notice, saying that the retractions were “procedurally improper” and suggesting that the real reason for the retractions was to undermine their research ahead of the Supreme Court’s consideration of mifepristone.
“Your decision also reflects a regrettable pattern of using scientific publications as a sword against unpopular findings—regardless of their objectivity. This further undermines the public’s confidence in scientific bodies and does a disservice to your mission to ‘advance knowledge,’” the letter from the authors said.
Days after missing the initial retraction deadline, Sage responded on November 21 to the researchers giving them until November 29 to respond and denying any suggestion that the retractions were politically motivated.
“Sage rejects as spurious your insinuation that the timing of the Retraction Notice was in anyway related to a Supreme Court case,” Sage wrote in a letter viewed by The Daily Wire. “The retraction of the three articles is solely based on the results of the investigation, which was completed in good faith and which Sage had a responsibility to undertake as a COPE [Committee on Publication Ethics] member and to fulfill its responsibility as publisher of the journal. Sage’s primary goal and obligation is, as it has been for over 50 years, to maintain the highest integrity of the academic publishing process. Any suggestion that politics enters into this mission is without basis and is highly insulting.”
Sage claimed that one of the reasons for the retractions was that the researchers did not disclose conflicts of interests. The journal claimed that they were deceived by the CLI researchers and that they did not disclose “blatant conflicts.”
Studnicki, however, said that they had made clear that their work was funded by the Charlotte Lozier Institute and that they had detailed numerous times their affiliations. The institute is the research arm of the Susan B. Anthony Pro-Life America group. Both articles cited by Kacsmaryk state at the bottom, “This work was supported by the Charlotte Lozier Institute.”
Tessa Longbons, another author on the studies, said that Sage was demonstrating a double-standard with the conflict of interests claim, pointing to numerous studies published with Sage Journals where authors affiliated with pro-abortion groups did not disclose conflicts of interests.
For example, in one <a href="https://journals.sagepub.com/doi/full/10.1258/JRSM.2012.12K080">article</a> published by Sage advocating for mifepristone access, no competing interests were declared despite the fact that the lead author is an abortion proponent and the other authors were members of an academic center that <a href="https://bixbycenter.ucsf.edu/news/bixby-research-confirms-abortion-safe-procedure">promotes</a> abortion. No conflict of interests were declared in another <a href="https://journals.sagepub.com/doi/full/10.2217/WHE.10.70">article</a> from Sage Journals written by a researcher with the openly pro-abortion Guttmacher Institute.
In its letter to the researchers, Sage said that the assertion that they hold pro-life and pro-abortion authors to a different standard was “baseless and needlessly provocative.”
The researchers responded by again pointing out the apparent double standard.
“[If] Sage now purports to have always required ideological disclosures, Sage itself has not maintained that standard it seeks now to impose on us,” the authors said. “Despite Sage’s dismissal of this point as ‘unsupported,’ a cursory search clearly demonstrates that Sage journals have published dozens of articles on abortion access and safety by researchers affiliated with organizations with very public and open positions on abortion.”
Another issue that Sage took with the studies, according to its correspondence with the authors, was that a reviewer on the article was affiliated with the Charlotte Lozier Institute. Studnicki, however, said that SAGE selects reviewers and the articles went through a double -blind process, meaning that the authors did not know who was reviewing the article and the reviewers did not know whose work they were reviewing.
“We did not select the reviewer at issue, and the reviewer’s identity is still unknown to us. In fact, this reviewer may not have been a CLI associate scholar at the time of his/her review. Likewise, because Sage practices double-blind peer review, the reviewer was equally unaware of our identities when evaluating our work,” the researchers told Sage.
Sage took issue with some of the methodological decisions made by Studnicki and other researchers. It criticized the November 2021 study because it used emergency room visits to measure complications from abortions. Using Medicaid data, the researchers had tracked emergency room visits for women who had confirmed abortions within 30 days of the visit. The researchers broke down the visits into categories, including abortion-related visits.
Some critics said an adverse reaction to an abortion should only be counted if the visit involves surgery or hospitalization, but Studnicki disagrees.
&#8220;I think that if a woman has an abortion and she starts to bleed or she starts to have serious pain or she sees some sort of discharge that is indicative of an infection, she goes to an emergency room, I think that is a serious adverse event and a complication,” he said.
Studnicki said that none of the issues raised by Sage invalidate the research. He said the concerns are just a matter of researchers deciding to measure things in different ways, and not a matter of faulty data.
Despite the retractions, Studnicki said that he and his fellow researchers will continue to produce quality work, saying that it was a badge of honor to be targeted by pro-abortion advocates.
“This is the greatest testimony to the strength of our science that one could possibly hope for. We are doing all the right things. We intend to continue to do the right things, but it’s probably going to be harder to get things published because they are trying to tarnish our reputation,” he said.

The <a href="https://www.dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Biden administration</a> said Friday that it would cancel another $4.28 billion in <a href="https://www.dailywire.com/topic/student-loans" target="_blank" rel="noopener">student loan</a> debt for nearly 55,000 people, bringing the total amount of student debt forgiven by the administration to around $180 billion. 
The Department of Education <a href="https://www.ed.gov/about/news/press-release/biden-harris-administration-approves-additional-428-billion-student-debt-relief-nearly-55000-public-service-workers-0" target="_blank" rel="noopener">announced</a> that it was canceling the debt of 54,900 borrowers through the Public Service Loan Forgiveness (PSLF) Program. Although the Supreme Court <a href="https://www.dailywire.com/news/supreme-court-delivers-defeat-to-biden-admin-on-student-loan-forgiveness" target="_blank" rel="noopener">struck down</a> President Joe Biden&#8217;s broad student loan cancellation program last year, Biden has continued to cancel chunks of student loan debt through other programs. 
“Four years ago, the Biden-Harris Administration made a pledge to America’s teachers, service members, nurses, first responders, and other public servants that we would fix the broken Public Service Loan Forgiveness Program, and I’m proud to say that we delivered,” said Secretary of Education Miguel Cardona. 
The loan cancellation is the latest last minute leftist policy move from Biden as he approaches the final days of his administration. Biden is also <a href="https://www.dailywire.com/news/exclusive-biden-races-to-sell-off-border-wall-parts-before-trump-takes-office" target="_blank" rel="noopener">racing</a> to sell off border wall materials and move them away from the southern border and <a href="https://www.dailywire.com/news/feds-look-to-hire-up-to-1200-new-dei-bureaucrats-before-trump-takes-office" target="_blank" rel="noopener">looking</a> to hire up to 1,200 employees to work in diversity, equity, and inclusion positions.
The PSLF Program allows borrowers working in education, public health, law enforcement, and emergency response to have their debt canceled after making 120 monthly payments.

Earlier this month, 23 Republican attorneys general sent a <a href="https://ago.mo.gov/wp-content/uploads/2024-12-2-Student-Loan-NPRM-Interested-States-Comment-Letter.pdf" target="_blank" rel="noopener">letter</a> to Cardona warning the administration about another proposed<a href="https://www.federalregister.gov/documents/2024/04/17/2024-07726/student-debt-relief-for-the-william-d-ford-federal-direct-loan-program-direct-loans-the-federal"> rule</a> that would expand the Secretary of Education’s authority to “waive” debts to the department. 
“Everyone from the Supreme Court, to President Joe Biden, to former Speaker of the House Nancy Pelosi has publicly acknowledged that you do not have the authority to forgive debt except in the limited ways Congress clearly outlined. You must adhere to these warnings and follow the law,” the attorney generals wrote on December 3. 
In June 2023, the Supreme Court struck down Biden’s attempt to use the COVID-era HEROES Act to unilaterally forgive federally subsidized loans. 
“The Secretary asserts that the HEROES Act grants him the authority to cancel $430 billion of student loan principal. It does not,” the court majority wrote in a 6-3 opinion. “We hold today that the Act allows the Secretary to ‘waive or modify’ existing statutory or regulatory provisions applicable to financial assistance programs under the Education Act, not to rewrite that statute from the ground up.”

Supreme Court Justice Ketanji Brown Jackson performed this weekend in Broadway&#8217;s queer rendition of the Shakespeare classic &#8220;Romeo and Juliet,&#8221; which features a non-binary character.
On Saturday night, the liberal justice performed in &#8220;&amp; Juliet,&#8221; a jukebox musical that created a special one-night role just for Jackson.
Jackson, 54, can be seen prancing around the stage in her costume, a light blue corset over a lacy tunic paired with light wash jeans with cargo pockets.
A video of Jackson&#8217;s performance shows her excitedly saying a line from the play —&#8221;Yay! I think what I like about it is that I am having a very strongly negative reaction to it,&#8221; she says on stage.
One of the characters is May, Juliet&#8217;s non-binary friend who ends up marrying a man.

In her memoir, &#8220;Lovely One,&#8221; released in September, Jackson said she has wanted to perform on Broadway as a Supreme Court justice since applying to Harvard in the late 1980s.
“I, a Miami girl from a modest background with an unabashed love of theatre, dreamed of one day ascending to the highest court in the land—and I had said so in one of my supplemental application essays. I expressed that I wished to attend Harvard as I believed it might help me &#8216;to fulfill my fantasy of becoming the first Black, female Supreme Court justice to appear on a Broadway stage,&#8217;” she wrote in her book.

Jackson also said that she took drama class with Matt Damon at Harvard and that her professor once praised her more than Damon for a scene they did together.
&#8220;I was like, &#8216;Oh my god, I was better than Matt Damon in a scene,'&#8221; Jackson told CBS.
The Broadway show &#8220;&amp; Juliet&#8221; is a modern take on the Shakespeare play that explores what could have happened next if Juliet had not ended her life over Romeo.
In one scene, the character Francois is about to marry to Juliet when he changes his mind and confesses his feelings for Juliet&#8217;s non-binary friend May. He starts singing &#8220;It&#8217;s Gonna Be Me&#8221; — apparently a reference to the Internet meme making fun of Justin Timberlake&#8217;s pronunciation of &#8220;me&#8221; in that song.
Jackson stayed to talk with audience members at the Stephen Sondheim Theatre after the show.
&#8220;I think that it means that anything is possible,&#8221; Jackson said of her performance Saturday night.
The Supreme Court currently has several weighty cases on its plate.
One case deals with whether states should be allowed to ban puberty blockers for children with gender dysphoria.
