Princeton University and Yale University both saw their percentages of Asian American freshman dip this fall despite the Supreme Court eliminating <a href="https://www.dailywire.com/topic/affirmative-action" target="_blank" rel="noopener">affirmative action</a> in college admissions last year.
At Princeton, the percentage of Asian American freshmen dropped two percentage points from 26% last year to 24% this year.
At Yale, the decline was bigger at six percentage points, from 30% last year to 24% this year.
At both Ive Leagues, the share of black freshmen remained the same &#8212; 9% at Princeton and 14% at Yale.
Last year in June, the Supreme Court ruled against affirmative action in college admissions, declaring race-based admissions at Harvard University and the University of North Carolina unconstitutional and in violation of the Civil Rights Act.
Students for Fair Admissions, the group that sued over affirmative action, had pointed to the high test scores of Asian American and white applicants who were rejected.
The high court&#8217;s decision has had a profound effect on the admissions processes at universities across the country.

At the Massachusetts Institute of Technology, (MIT) the percentage of black students plummeted in the wake of the court&#8217;s decision. The incoming freshman class this fall is only 5% black, down from an average of 13% in recent years, MIT <a href="https://www.dailywire.com/news/mits-share-of-black-students-plummets-after-affirmative-action-struck-down" target="_blank" rel="noopener">said</a> last month.
Amherst College, a historic liberal arts in Massachusetts, also <a href="https://www.bloomberg.com/news/articles/2024-09-04/yale-university-sees-drop-in-share-of-asian-american-freshmen?utm_source=twitter&amp;cmpid=socialflow-twitter-businessweek&amp;utm_content=businessweek&amp;utm_campaign=socialflow-organic&amp;utm_medium=social" target="_blank" rel="noopener">reported</a> that its percentage of black freshman students fell to 9% from 19% this year. Hispanic students also declined to 10% from 14% last year. Meanwhile, the percentage of white and Asian American students increased slightly.
At the same time, universities have scrambled to find other ways to diversify their student bodies.
Yale and Princeton both pointed to more students receiving financial aid. At Yale, more than 58% of students are now getting need-based financial aid.
“I am especially excited that the Class of 2028 includes the greatest representation of first-generation and low-income students on record, and that Yale College now enrolls more veterans than it has in many decades,” <a href="https://news.yale.edu/2024/09/04/new-undergraduates-begin-their-yale-college-journey" target="_blank" rel="noopener">said</a> Jeremiah Quinlan, Yale’s dean of undergraduate admissions and financial aid.
“At Princeton we make big bets on human talent from all sectors of society,” Princeton Provost Jennifer Rexford <a href="https://www.princeton.edu/news/2024/03/29/princeton-trustees-set-2024-25-budget-increasing-spending-undergraduate-financial#:~:text=Between%20fiscal%20years%202022%20and,numbers%20of%20students%20receiving%20support." target="_blank" rel="noopener">said</a>.
Some schools moved away from considering standardized test scores as the argument that standardized testing harms minority students picked up steam. One Ivy League, Columbia University, permanently scrapped its standardized test requirement.
Some schools are also <a href="https://apnews.com/article/supreme-court-affirmative-action-college-admissions-1d37af28939a533551cff45fa577ceb0" target="_blank" rel="noopener">considering</a> requiring more essays for admissions to get a better idea of a student’s background, while others plan to recruit students from minority areas or admit more students transferring from community colleges.
A majority of Americans, 62%, oppose race-based college admissions, <a href="https://www.reuters.com/world/us/most-americans-think-college-admissions-should-not-consider-race-reutersipsos-2023-02-15/" target="_blank" rel="noopener">according</a> to a Reuters poll last year.

The four largest <a href="https://www.dailywire.com/topic/unions" target="_blank" rel="noopener">government unions</a> have responded to bleeding membership by pushing for “aggressive” legislation to benefit them in order to offset declining influence, according to a new report.
The <a href="https://www.commonwealthfoundation.org/research/state-public-sector-labor-laws/" target="_blank" rel="noopener">report</a>, from the Commonwealth Foundation, found that the American Federation of Teachers (AFT), American Federation of State, County and Municipal Employees (AFSCME), National Education Association (NEA), and Service Employees International Union (SEIU) have lost over 100,000 members since 2022. The losses have been driven in part by the landmark Supreme Court decision in 2018 in Janus vs AFSCME, which said unions cannot collect fees from non-unionized workers.
“What we’re seeing in states across the country is that the leaders of these unions are trying to counter these losses by engaging in aggressive organizing campaigns and aggressive campaigns to change laws,” Andrew Holman, policy analyst at the Commonwealth Foundation, said during a media call on the release of the report on Wednesday. “These losses are costing these unions financially.”
In total since the Janus decision, the four top unions have lost a total of 320,421 members and around $106.8 million in dues.

Holman told The Daily Wire that another factor leading to decline was that &#8220;more and more people are becoming aware of how their dues are being used and what those dollars are being put towards.&#8221;
Unions have historically been solid backers of the Democratic Party and other leftist causes. Back in the 2022 midterm elections, the four largest public sector unions spent $700 million backing Democrats and leftist causes, with 60% of the funds coming from union dues, the Commonwealth Foundation <a href="https://www.dailywire.com/news/gov-unions-spent-over-half-a-billion-dollars-backing-democrats-the-left-during-midterm-elections-report" target="_blank" rel="noopener">previously found</a>.

In response, union executives have pushed for access to employee personal information, tax incentives for union membership dues, and expanding public sector unionization. With personal information of public workers, union executives can have access to non-unionized employees to solicit them for political causes or to join the union.
“The lesson is clear: Government union executives use their power to build immense political machines, control workplaces, and lobby against beneficial fiscal and educational reforms,&#8221; the report said. &#8220;Along the way, these union executives appear more concerned with achieving their organizational and political goals than defending the interests of the workers they represent.”
The full report graded the labor laws of all 50 states on an &#8220;A&#8221; to &#8220;F&#8221; scale.

The report said that unions had particularly gained ground in the states of Illinois, Michigan, and Maryland where pro-union legislation passed. In Illinois, voters passed a constitutional amendment putting a right to collective bargaining into the state constitution while Michigan repealed its right to work status making all unionized workers have to automatically pay dues.
On the contrary, the Commonwealth Foundation praised legislative efforts in Florida, where the legislature passed a new law that requires re-certification of the union if it starts representing fewer than 60% of employees in a bargaining unit.
&#8220;As time passes, new labor laws that protect worker freedom will test legislative efforts to counter government union influence. In Florida, where union influence is already limited, the economy is booming, making it one of the fastest-growing states in the country,&#8221; the report said.

A federal judge on Tuesday denied an effort by former President <a href="https://www.dailywire.com/topic/donald-trump" target="_blank" rel="noopener">Donald Trump</a> to move his New York criminal case to federal court ahead of sentencing later this month. 
In his <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysd.598311/gov.uscourts.nysd.598311.50.0.pdf" target="_blank" rel="noopener">ruling</a>, U.S. District Judge Alvin Hellerstein said that he had no authority to review any errors made during the state trial and that the Supreme Court’s recent decision on presidential immunity did not impact the New York case. Trump was convicted in May of 34 counts of falsifying business records and is scheduled to be sentenced on September 18. 
“This court does not have jurisdiction to hear Mr. Trump’s arguments concerning the propriety of the New York trial,” Hellerstein, a Bill Clinton appointee, wrote. “Instead, the proper recourse for parties seeking to remedy alleged errors made during a state trial is to pursue a state appeal or, at the highest level, to seek review from the Supreme Court of the United States.” 
The decision comes after lawyers for Trump <a href="https://www.dailywire.com/news/trump-looks-to-move-new-york-criminal-case-to-federal-court-ahead-of-sentencing" target="_blank" rel="noopener">argued</a> last week the case should be removed from Judge Juan Merchan as Trump seeks dismissal based on the Supreme Court&#8217;s recent ruling that presidents have immunity for exercising core constitutional powers. 
Hellerstein, who previously rejected an attempt to remove the case, said the Supreme Court’s decision doesn’t change his decision. 
“My holding of a hush money reimbursement remains true regardless of who has the burden, whether the People or Mr. Trump,” he said. “Nothing in the Supreme Court’s opinion affects my previous conclusion that the hush money payments were private, unofficial acts, outside the bounds of executive authority.”

Trump campaign spokesman Steven Cheung <a href="https://www.foxnews.com/us/judge-denies-trump-request-move-new-york-hush-money-case-federal-court" target="_blank" rel="noopener">said</a> he would continue fighting to move the case. 
&#8220;There should be no sentencing in this Election Interference Witch Hunt. As mandated by the United States Supreme Court, this case, along with all of the other Harris-Biden Hoaxes, should be dismissed,&#8221; he said. &#8220;President Trump and his legal team will continue to fight to move this Hoax into federal court where it should be put out of its misery once and for all.&#8221;
Merchan has placed a gag order on Trump restricting what he can say about the case. In a Truth Social <a href="https://truthsocial.com/@realDonaldTrump/posts/113079100211808222" target="_blank" rel="noopener">post</a> Wednesday morning, Trump called for the order to be removed. 
“I am proud to represent our Failing Nation in fighting the GREATEST POLITICAL WITCH HUNT IN HISTORY,” he said. “REMOVE THE GAG ORDER SO THAT I CAN SHOW HOW CORRUPT OUR COURT SYSTEM IS. PRESIDENTIAL CANDIDATES ARE NOT TO BE GAGGED!”
Trump <a href="https://www.cbsnews.com/news/donald-trump-convicted-prison-sentence-new-york-criminal-trial/" target="_blank" rel="noopener">could</a> face four years in prison and a $5,000 fine for each of the 34 convictions when sentenced. Merchan is set to rule on another motion to dismiss the conviction on September 16.

On Wednesday, the Supreme Court <a href="https://www.nbcnews.com/politics/supreme-court/supreme-court-refuses-revive-bidens-latest-student-loan-debt-relief-pl-rcna167455" target="_blank" rel="noopener">rejected</a> the Biden-Harris administration’s request to get rid of an injunction from an appeals court that put a hold on the administration’s SAVE plan, which would exempt student loan borrowers’ income from their repayment obligation.
In mid-July, the 8th Circuit Court of Appeals put a hold on the Biden-Harris administration’s entire student loan forgiveness program after seven Republican-led states requested that parts of the plan not already on hold be stayed. The SAVE program is <a href="https://budgetmodel.wharton.upenn.edu/issues/2023/7/17/biden-income-driven-repayment-budget-update" target="_blank" rel="noopener">estimated</a> to cost $475 billion over a ten-year period.
Sen. Bill Cassidy (R-LA), ranking member of the Senate Health, Education, Labor, and Pensions (HELP) Committee, <a href="https://www.help.senate.gov/ranking/newsroom/press/ranking-member-cassidy-on-federal-court-blocking-bidens-student-loan-scheme-to-shift-559-billion-in-student-debt-onto-taxpayers-1" target="_blank" rel="noopener">said</a> in response to the appeals court decision, “Just like Biden’s other student loan schemes, this IDR policy does not ‘forgive’ debt. It transfers the burden of $559 billion in debt from those who willingly took it on to Americans who chose to not go to college or already sacrificed to pay off their loans.”
In May, President Biden transferred $7.7 billion more in student debt to taxpayers. “The Supreme Court last year <a href="https://www.nationalreview.com/news/supreme-court-strikes-down-bidens-student-loan-forgiveness-order/" target="_blank" rel="noopener" data-testid="dynamic-link">struck down</a> Biden’s $400 billion student-debt forgiveness plan under the HEROES Act. The president immediately announced <a href="https://www.nationalreview.com/news/not-done-fighting-biden-to-announce-new-actions-following-supreme-court-student-loan-forgiveness-defeat/" target="_blank" rel="noopener" data-testid="dynamic-link">his plan</a> to defy the highest court’s ruling by using the Higher Education Act to wipe out student loan debt,” National Review <a href="https://www.nationalreview.com/news/biden-administration-transfers-another-7-7-billion-in-student-debt-to-taxpayers/" target="_blank" rel="noopener">noted</a> in May.

The University of Pennsylvania’s Wharton School <a href="https://budgetmodel.wharton.upenn.edu/issues/2023/7/17/biden-income-driven-repayment-budget-update" target="_blank" rel="noopener">wrote</a> in July 2023:

Smith’s indictment, which comes after the Supreme Court ruled that presidents have broad immunity from prosecution, <a href="https://www.dailywire.com/news/biden-harris-admin-files-reworked-indictment-against-trump" target="_blank" rel="noopener">accuses</a> Trump of two felony counts of obstructing an official proceeding, one felony count of conspiracy to defraud the United States, and one felony count of conspiracy against rights. 
In a post on X, Trump said that the revised indictment amounted to &#8220;election interference&#8221; because mail-in ballots are about to be cast in North Carolina.

Smith’s office said that the indictment had been revised in light of the Supreme Court’s <a href="https://www.dailywire.com/news/supreme-court-rules-trump-has-immunity-for-official-acts-likely-delays-trial-past-election" target="_blank" rel="noopener">decision</a> in Trump v. United States, which said that presidents cannot be prosecuted for exercising core constitutional powers and are entitled to at least presumptive immunity from prosecution for official acts.
“The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the Government’s efforts to respect and implement the Supreme Court’s holdings and remand instructions in Trump v. United States,” the special counsel’s office claimed.
House Speaker Mike Johnson (R-LA) reacted to the news of the revised indictment by saying that the Biden-Harris administration was weaponizing the DOJ.
&#8220;Donald Trump continues to be the most persecuted politician in the history of our country. Today, after getting two of his cases thrown out by the courts, Jack Smith is grasping at straws once again,&#8221; he said. &#8220;Just 70 days before the election, Smith has brought yet another bogus indictment. The <a href="https://www.dailywire.com/topic/supreme-court" target="_blank" rel="noopener">Supreme Court</a> ruled 5-4 on Thursday to allow <a href="https://www.dailywire.com/topic/arizona" target="_blank" rel="noopener">Arizona</a> to require proof of citizenship when people register to vote using the state’s voter registration form. 
The <a href="https://www.supremecourt.gov/orders/courtorders/082224zr_n75p.pdf" target="_blank" rel="noopener">ruling</a> came after the Republican Party asked for an emergency stay from the Supreme Court after a federal judge blocked Arizona from implementing a 2022 voter integrity law. The ruling is only a partial win for Republicans in the battleground state as the court did not allow a part of the law requiring proof of citizenship to vote in federal elections or voting by mail to go into effect. 
The ruling says that the portion relating to federal elections is on hold pending a review from the 9th Circuit Court of Appeals. 
Justices John Roberts, Clarence Thomas, Samuel Alito, Brett Kavanaugh, and Neil Gorsuch voted to allow the proof of citizenship requirements for the state form to take effect. Thomas, Alito, and Gorsuch would have allowed the entire law to take effect. 
Justice Amy Coney Barrett sided with Justices Ketanji Brown Jackson, Sonia Sotomayor, and Elena Kagan in voting to block any implementation of the law. 
Republican Arizona House Speaker Ben Toma <a href="https://www.azcentral.com/story/news/politics/elections/2024/08/22/arizona-voters-proof-citizenship-supreme-court-scotus-decision/74863851007/">called</a> the decision a “step in the right direction.”
&#8220;I look forward to continuing this litigation in the 9th Circuit to vindicate all of Arizona’s common sense voting laws and eventually bringing this case before the Supreme Court for a full merits review,&#8221; he said. 
Republican National Committee Chairman Michael Whatley <a href="https://gop.com/press-release/scotus-halts-non-citizen-voting-in-major-win-for-president-trumps-election-integrity-effort/" target="_blank" rel="noopener">said</a> the ruling was “a major victory for election integrity.”
“While Democrats have worked to undermine basic election safeguards and make it easier for non-citizens to vote, we have fought tooth and nail to preserve citizenship requirements, see the law enforced, and secure our elections,” he said. “The Supreme Court has sided with the RNC, and the American people, to protect the vote in November.”
A statement from the RNC added that it was confident that “documentary proof of citizenship requirements in presidential elections and vote by mail will eventually be upheld.”
The Biden-Harris administration <a href="https://www.nbcnews.com/politics/supreme-court/supreme-court-partly-grants-gop-request-enforce-arizonas-proof-citizen-rcna167192" target="_blank" rel="noopener">challenged</a> the federal voting components of the Arizona law, claiming that it violated the National Voter Registration Act, while other liberal groups challenged the state voter form citizenship requirements. There are reportedly around 40,000 voters in Arizona who have only registered for federal elections, meaning they have not had to provide proof of citizenship.

Conservative legal scholars have argued that Congress should amend the National Voter Registration Act to make clear that states can mandate proof of citizenship for registering to vote using the federal voter registration form. 
 “In fact, given concerns around, and documented instances of non-citizens registering and voting, other states should follow Arizona’s lead and take the commonsense step of requiring proof of citizenship when voters register using a state form,” Heritage Foundation legal scholar Zach Smith <a href="https://www.heritage.org/heritage-election-integrity-expert-other-states-should-follow-arizonas-lead-when-it-comes-proof">said</a> in response to the ruling. 
Republicans have argued that there is a danger of non-citizens voting in American elections, while Democrats and members of the legacy media have maintained that there is no evidence of non-citizen voting. 
Arizona is expected to be one of the key states determining the outcome of the 2024 presidential election.

The percentage of black students at the Massachusetts Institute of Technology (MIT) has plummeted in the wake of the end of affirmative action.
The incoming freshman class this fall is only 5% black, down from an average of 13% in recent years, MIT <a href="https://www.bloomberg.com/news/articles/2024-08-21/mit-reports-drop-in-black-student-enrollment-for-incoming-class?cmpid%3D=socialflow-twitter-billionaires&amp;utm_source=twitter&amp;utm_content=billionaires&amp;utm_campaign=socialflow-organic&amp;utm_medium=social" target="_blank" rel="noopener">said</a> Wednesday.
Hispanic students are also down to 11% from 15%, the school said.
Previously, about 25% of MIT undergraduates were black, Hispanic, Native American, or Pacific Islander, but that number has dropped to 16% for the incoming class.
Meanwhile, Asian American students are up to 47% from 41%, making up nearly half of the entire class of 2028. The percentage of white students stayed about the same at 37%.
Last summer, the Supreme Court declared considering race in admissions unconstitutional in a landmark ruling that targeted the affirmative action admissions programs at Harvard and the University of North Carolina.
Students for Fair Admissions, the group that sued over affirmative action, pointed to the high test scores of Asian-American and white applicants who were rejected.
MIT’s dean of admissions, Stu Schmill, said Wednesday that the school has expanded its recruitment and financial aid initiative to &#8220;further improve access to the Institute for students from all backgrounds.&#8221;
&#8220;Despite these initiatives, and as we expected, there was still a decline in the proportion⁠ of enrolling first-years from historically under-represented racial and ethnic backgrounds⁠,&#8221; the dean said.
&#8220;If MIT cannot find a way⁠ to continue to draw on the full range of human talent and experience in the future, it may threaten the qualitative strength of the MIT education, both by a relative reduction in the educational benefits of diversity and by making our community less attractive to the best students from all backgrounds,&#8221; Schmill <a href="https://mitadmissions.org/blogs/entry/mit-after-sffa/" target="_blank" rel="noopener">wrote</a> in a blog post.
A majority of Americans, 62%, oppose race-based college admissions, <a href="https://www.reuters.com/world/us/most-americans-think-college-admissions-should-not-consider-race-reutersipsos-2023-02-15/" target="_blank" rel="noopener">according</a> to a Reuters poll last year.
Around the time of the court&#8217;s decision, universities scrambled to find other ways to diversify their student bodies.
Some schools moved away from using standardized test scores in the admissions process as the argument that standardized testing harms minority students picked up steam. Previously, a low SAT or ACT score meant automatic elimination at most top-tier schools.
Last year, Columbia University <a href="https://www.dailywire.com/news/universities-scrap-sat-scramble-to-stay-diverse-ahead-of-affirmative-action-ruling" target="_blank" rel="noopener">became</a> the first Ivy League school to permanently scrap its standardized test requirement, allowing hopeful applicants to skip the dreaded SAT and ACT.
Some schools are also <a href="https://apnews.com/article/supreme-court-affirmative-action-college-admissions-1d37af28939a533551cff45fa577ceb0" target="_blank" rel="noopener">considering</a> requiring more essays for admission to get a better idea of a student’s background, while others plan to recruit students from minority areas or admit more students transferring from community colleges.
Back in 1995, the University of California System Board of Regents banned affirmative action so UC <a href="https://edsource.org/2020/dropping-affirmative-action-had-huge-impact-on-californias-public-universities/642437" target="_blank" rel="noopener">adopted</a> roundabout ways of trying to identify minority students, such as through poor neighborhoods and family income.

Justice Neil Gorsuch wrote the majority ruling in Kennedy&#8217;s case in June 2023, seven years after the coach began his fight to pray on the field.
“Here, a government entity sought to punish an individual for engaging in a brief, quiet, personal religious observance doubly protected by the Free Exercise and Free Speech Clauses of the First Amendment. And the only meaningful justification the government offered for its reprisal rested on a mistaken view that it had a duty to ferret out and suppress religious observances even as it allows comparable secular speech,” Gorsuch <a href="https://www.foxnews.com/politics/high-school-football-coach-scores-big-win-supreme-court-post-game-prayer">wrote</a>. “The Constitution neither mandates nor tolerates that kind of discrimination.”

Supreme Court Justice Neil Gorsuch highlighted an example from his new book about how having hundreds of thousands of federal laws on the books harms average Americans who have no idea that the laws even exist.
Gorsuch made the remarks about his new book “Over Ruled: The Human Toll of Too Much Law” during an interview on PBS&#8217;s &#8220;Firing Line with Margaret Hoover&#8221; that aired Friday when asked about how the sheer volume of laws &#8220;present a burden on average Americans&#8221;.
&#8220;Well, let’s do the numbers. In just my lifetime, federal law has grown massively,&#8221; he said. &#8220;We’ve seen maybe a doubling in the number of federal criminal offenses on the books. There are so many regulations now carrying criminal consequences that nobody knows how many there are. There are at least 300,000.&#8221;
Gorsuch then delved into a story from his a book about John and Sandra Yates, a married couple who were high school sweethearts that moved to Florida so John could pursue his passion of wanting to be a fisherman.
&#8220;He worked his way up from deckhand to becoming captain of his own crew,&#8221; Gorsuch said. &#8220;And he’s out one day and an agent comes up and says, I would like to measure your fish. I’m not sure they’re all the right size. They had to be at least 20 inches. He spends the whole day measuring thousands of pounds of red grouper and decides 72 are undersized. He says, put them in a crate and I’ll deal with you when you get back to dock.&#8221;
&#8220;A few days later, he does. He measures them again, but this time only 69 are undersized,&#8221; he continued. &#8220;Now John’s expecting a citation or something and if that’s the way it goes, that’ll be fine. But he hears nothing from the government for three years until one day agents surround his house. They charge him with violating the Sarbanes-Oxley Act which was adopted after the Enron financial accounting scandal.&#8221;
&#8220;Now, the statute says if you destroy, intentionally, accounting records, documents, things like that, or other tangible objects, you’re guilty,&#8221; he continued. &#8220;The government’s theory in the case, apparently, was that he intentionally threw overboard 72 red grouper, tangible objects, and replaced them with 69 still undersized fish. Now, John thought that was about the silliest thing he ever heard, but he was found guilty by a jury, appealed and lost, spent Christmas in jail. And he was ready to give up. But Sandra, his wife, said, no, you got to appeal this because this is just wrong. Brought it all the way to the Supreme Court of the United States and won, 5 to 4. Sandra was angry that she didn’t get more votes.&#8221;
Gorsuch noted that a Harvard law professor that he cited in his book estimates that the average American commits three felonies a day because of how many laws exist.

Supreme Court Justice Neil Gorsuch Highlights How Too Many Laws Hurt Average People

The Supreme Court, in a 5-4 opinion posted late Friday, has blocked the Biden Administration’s Title IX rules that would force schools that receive public funding to allow trans-identifying males into girls’ bathrooms, locker rooms, and sports.
The rules went into effect on August 1 for all but 26 states plus hundreds of additional schools, and expanded the definition of “sex” to include “sexual orientation and gender identity.” Title IX was originally implemented in 1972 and prohibited schools receiving public funding from discriminating against students based on sex.
In a 12-page <a href="https://www.supremecourt.gov/opinions/23pdf/24a78_f2ah.pdf" target="_blank" rel="noopener">ruling</a>, the Supreme Court granted a temporary stay of the guidelines by siding with multiple other lower courts, which ruled against the Biden administration’s attempts to sever the sexual orientation and gender identity portions of the new rules from the guidelines as a whole, and allow the rest of the rewritten rules to go into effect. While the focus has been on transgender issues, the remaining rule changes eviscerate due process protections for students accused of sexual assault, protections that had been put into place under the Trump administration.
SCOTUS agreed with the lower courts, writing that “the new definition of sex discrimination is intertwined with and affects many other provisions of the  new rule,” meaning it couldn’t be severed from the rest of the guidelines.
Justices Sotomayor, Kagan, Jackson, and Gorsuch – a Trump appointee – dissented.

The block is only temporary as the legal system works slowly, and the Biden administration is appealing decisions in the lower courts.
On August 1, the day the new rules were supposed to go into effect, former President Donald Trump <a href="https://www.dailywire.com/news/trump-promises-to-ban-men-from-womens-sports-end-bidens-title-ix-rewrite-on-day-one" target="_blank" rel="noopener">promised</a> he would repeal the Biden administration’s rules on “day one” of his administration.
Trump posted on Truth Social: “I WILL KEEP MEN OUT OF WOMEN’S SPORTS!” and told radio hosts Clay Travis and Buck Sexton that he would do so on the first day of his administration.
“President Trump just pledged to all of us on @clayandbuck that men will not be allowed to compete against women in sports when he is elected president,” Travis said on X. “He promises to take care of it on day one and end Kamala and Biden’s new Title IX policies allowing this to happen.”

Twenty-six states previously blocked the Biden administration’s rules, with U.S. District Judge Terry Doughty, a Trump appointee, <a href="https://www.dailywire.com/news/judge-blocks-bidens-transgender-title-ix-rules-in-4-states" target="_blank" rel="noopener">calling</a> the new rules an “abuse of power” and a “threat to democracy.”
“Title IX was written and intended to protect biological women from discrimination,” Doughty <a href="https://storage.courtlistener.com/recap/gov.uscourts.lawd.205659/gov.uscourts.lawd.205659.53.0.pdf" target="_blank" rel="noopener">wrote</a>. “Such purpose makes it difficult to sincerely argue that, at the time of enactment, ‘discrimination on the basis of sex’ included gender identity, sex stereotypes, sexual orientation, or sex characteristics. Enacting the changes in the Final Rule would subvert the original purpose of Title IX: protecting biological females from discrimination.”
Other judges ruled similarly.
In his ruling, U.S. District Judge John Broomes, another Trump appointee, included <a href="https://www.scag.gov/media/pskl4phx/ks-v-u-s-dept-of-education-list-of-schools-enjoined.pdf" target="_blank" rel="noopener">a massive list</a> of K-12 schools and universities across the country where the rules would also be blocked. That list came from schools attended by children of the defendants in that lawsuit, Moms for Liberty, and members of the Young America’s Foundation.

On the latest “<a href="https://www.dailywire.com/show/sunday-special" target="_blank" rel="noopener">Sunday Special</a>” episode, Daily Wire Editor Emeritus Ben Shapiro talked with Supreme Court Justice Neil Gorsuch, who warned that the proliferation of complex laws and regulations is threatening Americans&#8217; freedoms and undermining trust in government institutions.
Gorsuch told Shapiro that the U.S. Code has doubled in length since 1980, with Congress adding 2-3 million new words to federal laws annually. He noted that federal agencies have also been prolific, with conservative estimates putting the number of federal crimes buried in regulations at 300,000.
“And, of course, that&#8217;s just the tip of the iceberg. Our federal agencies have been busy, too. There are so many federal crimes now buried in those regulations adopted by agencies, not necessarily by Congress, that nobody knows how many there are,” he said.

Gorsuch emphasized the human toll of regulatory overreach, citing examples like a magician who had to obtain a federal license for his rabbit and create a 28-page disaster preparedness plan. He argued that excessive regulation undermines trust in government institutions and disproportionately impacts ordinary Americans trying to comply with complex laws.
“Most people have no idea what the law actually is,” Gorsuch added. “You can hire a lawyer and if you&#8217;re rich enough, then maybe you&#8217;re able to navigate the laws. If you&#8217;re not rich, then you&#8217;re probably screwed, depending on how tightly regulated any particular segment is.” 
The justice expressed hope for bipartisan solutions, highlighting state-level efforts to eliminate unnecessary regulations. He pointed to the deregulation of the airline industry in the 1970s as an example of successful reform at the federal level. Gorsuch also stressed the importance of civic education, stating that &#8220;a third of Americans can&#8217;t name the three branches of government, let alone why we have them.&#8221;
Shapiro chimed in, stating, “When you look at sort of the history of the development of this giant bureaucracy, the amount of rulemaking you trace this this dramatic increase to sort of the latter half of the 20th century. But its roots lie in Wilsonian administrative state theories. And really that comes from German progressivism.” 
“The original checks and balances of the Constitution were largely designed to prevent things from getting done in the absence of a large-scale approval of the things, the American public really had to be nearly unanimous in a lot of ways in order to get big things done,” Shapiro added. “And by the time we got to the early 20th century, Woodrow Wilson famously — and Teddy Roosevelt too — really believed that now the federal government had become unworkable; it just was not able to get the things done that it needed to get done. And so the idea was governance from above by experts who could thwart the checks and balances that were creating such obstruction.” 
The discussion between the Daily Wire host and Justice Gorsuch highlights growing concerns about regulatory overreach and its impact on everyday Americans. Gorsuch’s warnings come at a time of heightened debate over the proper role and scope of government regulation.
At the federal level, Gorsuch noted that both Republican and Democratic administrations have undertaken deregulatory initiatives in recent years. The Supreme Court has shown a willingness to reconsider longstanding doctrines that give agencies broad latitude in interpreting and enforcing regulations. In June, the high court, with the help of Gorsuch, <a href="https://www.dailywire.com/news/massive-conservative-win-supreme-court-overrules-chevron-deference" target="_blank" rel="noopener">overturned</a> the &#8220;Chevron deference&#8221; doctrine, which had required courts to defer to agencies&#8217; reasonable interpretations of ambiguous statutes.
