Brett Favre Attorney Confident HOF QB Has ‘Slam Dunk’ Defamation Case Against Pat McAfee, Shannon Sharpe

The attorney for NFL Hall of Fame quarterback Brett Favre told The Daily Wire’s “Crain and Company” podcast Monday that his client has an open and shut case against two of the biggest names in sports media. 

Eric Herschmann joined the hosts of the sports podcast to discuss Favre’s recent legal challenges stemming from allegations that the former Green Bay Packers star misused state welfare funds to help build a volleyball facility for his alma mater, Southern Miss, where his daughter played volleyball. Herschmann argued that the state, not Favre, was at fault for mishandling millions of dollars and that sports media personalities Shannon Sharpe and Pat McAfee defamed his client when discussing the case. 

“Brett never got any of this money. They’re suing him for $5 million that went from the state agency that’s responsible for welfare funds and ended up in the pocket of another state agency, Southern Miss, and there’s some way they think that’s theft,” Herschmann argued.  

“There may be a problem within Mississippi … but this really has nothing to do with Brett,” the attorney added. Immediately after discovering the funds were taken from the state welfare agency, Favre returned the money, according to Herschmann.

Last September, former Executive Director of the Mississippi Department of Human Services John Davis pleaded guilty to conspiracy and theft relating to the $77 million welfare scandal, which is Mississippi’s largest public corruption case ever, according to CBS. The Department of Justice accused four others of conspiring with Davis but did not name them. Favre has not been charged with any criminal wrongdoing. 

Following allegations that Favre was involved in the scandal, the Hall of Famer was dragged by Sharpe and McAfee. On his Fox Sports show with Skip Bayless, Sharpe referred to Favre as a “sleazeball” and said the quarterback must be “a sorry mofo to steal from the underserved.” Favre claims that McAfee, who hosts his own show on Sirius XM, falsely referred to Favre as a “thief” who stole “from the underprivileged people of Mississippi.”

Favre sued both Sharpe and McAfee along with Mississippi’s state auditor last month for defamation. McAfee responded to the lawsuit on his show on February 27, but Sharpe has yet to comment on the lawsuit publically.

Herschmann told the “Crain and Company” hosts that McAfee has dug a hole for himself by continuing to discuss the scandal, and the attorney believes he has a “slam dunk” case against the media personality.

“Pat McAfee keeps talking about it. In all my years of being an attorney and being a prosecutor previously, I don’t think I’ve ever seen a defendant build a case against himself the way Pat is.”
