The revelations of improper conduct involving the International Criminal Court (ICC) continue to grow, with the Wall Street Journal recently breaking a story suggesting that Qatar promised to assist chief prosecutor Karim Khan if he brought charges against Israeli officials. Khan made a sudden rush to issue the indictments just as sexual assault accusations against him were coming to light. Qatar’s role makes the affair about more than one man’s alleged crimes – it is about the dangerousness and lack of accountability of the ICC as an institution.
Qatar is not an ICC member state. But it does host and sponsor Hamas, making its involvement with a prosecutor investigating the Gaza war deeply problematic. This may explain a strange aspect of the ICC’s arrest warrants. In addition to Israeli leaders, the ICC indicted Yahya Sinwar and two other top Hamas leaders in Gaza. It was gross moral equivalence equating Israeli leaders defending their people after the October 7 massacre with the masterminds of that crime.
The Court presented these parallel indictments as proof of its evenhandedness. Yet from the beginning, there was an obvious asymmetry: the Court indicted Israel’s top civilian leader, but ignored Khaled Mashaal and the rest of Hamas’s political leadership. When Israel mooted the warrants on Sinwar and Mohammed Deif by killing them during the Gaza war, Khan did not seek to restore balance by bringing new indictments against Hamas’s top leaders, who happen to be based in Qatar.
As the accusations against Khan began to mount, he argued it was a plot to weaken the Court, hinting at <a href="https://www.wsj.com/world/middle-east/icc-netanyahu-prosecutor-sexual-assault-israel-gaza-d9bedee3">Mossad involvement</a>. That appears to be, like so many charges against Israel, an exercise in projection. Qatar hired investigators in a failed attempt to discredit the employee who made the sexual assault allegations. Khan appears to have been right that there was a foreign intelligence operation surrounding these allegations, just not against him.
Khan specifically tied his warrants against Israeli Prime Minister Benjamin Netanyahu to the charges against him, urging his alleged victim to remain silent because it would undermine pending “Palestinian arrest warrants.” This, along with the emerging role of Qatar, makes it impossible to separate the scandal around Khan from the Court’s Gaza war indictments. Yet the Court has been silent about the Qatar revelations, a marked contrast to its public condemnation of a Trump administration executive order imposing sanctions on ICC officials as interference with its “independent and impartial work.”
The only action that the ICC has taken so far is disciplinary proceedings against Khan himself. The most that can happen is that he loses his job. His accuser never turned to the Dutch police because she said his official immunity would protect him. However, under the ICC’s rules, the judges could waive that immunity if they wished. The Court’s refusal to allow a criminal investigation of Khan, even as the scope of the scandal expands, demonstrates the institution&#8217;s political nature.
At the same time, the Court seems fully intent on proceeding with the Netanyahu prosecution. Such serious prosecutorial misconduct could, at least in the United States, lead to the dismissal of even factually substantiated criminal charges. Here, the evidence does not even show that the alleged crime (purposeful starvation of civilians) even occurred, let alone was committed by the accused. As the dust settles in Gaza, the lack of mass starvation becomes ever more evident.
An American prosecutor would be loath to try a case with such manifest prosecutorial misconduct (notably, senior court officials knew about the allegations against Khan at the time the indictments were made but kept it quiet for six months, when it leaked to the press). But Netanyahu is not facing a jury of his peers, but rather a panel of international judges who likely share the Court’s institutional culture.
Qatar’s involvement shows the ICC to be even more dangerous than its critics thought. The rap against the tribunal has long been that it acts like a global independent counsel – an unaccountable prosecutor with no democratic restraints. But even worse, it now appears that hostile states can coopt it as a political weapon in an ongoing conflict.
This illustrates the need for the Trump administration to take decisive action against the organization. The sanctions the Treasury Department has imposed on individual court officers have inconvenienced them but appear to have done little to fundamentally weaken the organization or change its trajectory. A body politically motivated enough to maintain the Israel warrants in the wake of the growing Khan fiasco will certainly retaliate against Trump and his top officials once they are out of office.
The administration should impose institution-wide sanctions on the tribunal and vigorously enforce them. The ICC recently got some good news as Peter Magyar, Hungary’s prime minister-elect, vowed to rejoin after it had become the first EU country to quit. Magyar prioritized the issue because he is seeking EU funding, and Brussels ties its financial support to adhering to its foreign policy. America must adopt the same tough approach, insisting that countries receiving benefits quit the Court. For Europe, pushing countries to join the ICC is a matter of ideology. For America, pushing back should be seen as a question of national security.

In a startling new development surrounding the International Criminal Court (ICC), a witness statement claims that the Qatari government promised to “look after” prosecutor Karim Khan if he moved forward with arrest warrants against Israeli Prime Minister Benjamin Netanyahu, The Wall Street Journal <a href="https://www.wsj.com/opinion/karim-khan-icc-prosecutor-benjamin-netanyahu-qatar-israel-7b62d474?mod=hp_opin_pos_1">reports</a>.
The accusation, which is supported by audio recordings reviewed by investigators, suggests a potential quid pro quo agreement between the Gulf state and the ICC&#8217;s top prosecutor. According to the witness statement submitted to the FBI, the promise of state protection was made while Khan was reportedly hesitant to issue the warrants.
“I want to issue the warrant, but I’m terrified to do it,” Khan told intermediaries, according to a recorded conversation cited in the report.
“If you do it, then we’ll look after you,” a voice described as linked to the Qatari state responded, according to the recording.
These revelations add to a layer of geopolitical intrigue to the scandal already engulfing Khan, who took a leave of absence in May 2025 following allegations of sexual misconduct involving a subordinate. Khan has denied the accusations and described them as part of an “orchestrated campaign” to discredit him.
Investigators are also examining whether a Qatar-linked intelligence effort sought to discredit Khan&#8217;s accuser, according to the report. The operation, involving London-based firms Highgate and Elicius Intelligence, <a href="https://www.theguardian.com/law/2025/nov/06/qatar-linked-intelligence-operation-targeted-icc-prosecutor-karim-khan-alleged-victim">allegedly sought</a> to find &#8220;links&#8221; between the female accuser and Israeli intelligence.
Documents and recordings indicate the firms investigated whether the victim—a Malaysian Muslim lawyer—had a “Jewish grandmother” or a secret Israeli passport. They even scrutinized her husband’s former employment at a company with a kosher-food subsidiary, speculating that a rabbi associated with the firm could provide “cover employment” for an agent.
The witness statement claims the intelligence operation also targeted Tom Lynch, a senior American ICC official who first reported the assault allegation, and Sen. Lindsey Graham (R-SC). Investigators reportedly attempted to link Lynch to the “Israel political lobby” in Washington.
Khan has denied any knowledge of or involvement in the intelligence operations. His lawyer said Khan never discussed the warrants with Qatari officials prior to the warrants and “was not offered or given (and would not have sought or accepted) any ‘promise’ by any state to ‘look after’ him.”
The Qatari government has dismissed the allegations as &#8220;unfounded.&#8221;
According to the report, individuals involved in the recordings referred to their employer as &#8220;the client country&#8221; or &#8220;Q country,&#8221; with one manager reportedly clarifying: &#8220;No, it’s the state.&#8221;
The controversy comes as the ICC’s governing body has voted to advance disciplinary proceedings against Khan. A United Nations inquiry previously found a “factual basis” for the sexual misconduct claims and allegations of retaliation against staff.
As the Dutch counterterror agency (NCTV) interviews ICC officials who may have been targeted by the spying operation, the cloud over the court’s objectivity continues to darken. Critics argue that if the prosecutor’s legal decisions were influenced by promises of state protection, the integrity of the warrants against Israeli leaders—and the ICC itself—may be permanently compromised.

The United States announced that it will sanction four judges of the International Criminal Court (ICC) for its &#8220;illegitimate actions” targeting both the United States and Israel.
The move comes after the court investigated American personnel in Afghanistan and issued arrest warrants for Israeli officials, including Prime Minister Benjamin Netanyahu.
“These individuals directly engaged in efforts by the International Criminal Court (ICC) to investigate, arrest, detain, or prosecute nationals of the United States or Israel, without consent from the United States or Israel,” Secretary of State Marco Rubio said in a <a href="https://www.state.gov/releases/office-of-the-spokesperson/2025/06/imposing-sanctions-in-response-to-the-iccs-illegitimate-actions-targeting-the-united-states-and-israel/" target="_blank" rel="noopener">statement</a>.

The judges being sanctioned are Solomy Balungi Bossa of Uganda and Luz del Carmen Ibáñez Carranza of Peru, both serving in the ICC Appeals Division, as well as Reine Adelaide Sophie Alapini Gansou of Benin and Beti Hohler of Slovenia, who serve in the ICC Pre-Trial and Trial Division.
Bossa and Ibanez Carranza ruled to authorize the ICC’s investigation against American personnel in Afghanistan and Alapini Gansou and Hohler ruled to authorize the issuance of the ICC’s arrest warrants targeting Netanyahu and former Minister of Defense Yoav Gallant, according to the State Department.

“The ICC is politicized and falsely claims unfettered discretion to investigate, charge, and prosecute nationals of the United States and our allies,” Rubio added. “This dangerous assertion and abuse of power infringes upon the sovereignty and national security of the United States and our allies, including Israel.”
The sanctions were authorized by President Donald Trump’s <a href="https://www.whitehouse.gov/presidential-actions/2025/02/imposing-sanctions-on-the-international-criminal-court/" target="_blank" rel="noopener">Executive Order 14203</a>, issued in February, which allows sanctions on foreigners engaged in ICC efforts to “impose tangible and significant consequences on those directly engaged in the ICC’s transgressions against the United States and Israel.”

“The United States will take whatever actions we deem necessary to protect our sovereignty, that of Israel, and any other U.S. ally from illegitimate actions by the ICC,” Rubio said.
Rubio concluded with a call for countries that support the ICC to “fight this disgraceful attack” on the United States and Israel, adding that many of the countries’ “freedom was purchased at the price of great American sacrifices.”

The sanctions require that all U.S.-based property and assets belonging to the judges be frozen and reported to the Treasury Department’s Office of Foreign Assets Control. Any businesses or entities that are at least 50% owned by the sanctioned individuals are also blocked under the sanctions.
American citizens will also be prohibited from contributing funds, goods, or services for the benefit of any of the sanctioned individuals.

According to Radio Free Europe, Hungary plans to <a href="https://www.rferl.org/a/hungary-israel-netanyahu-iccc-arrest-warrant/33366535.html">withdraw</a> from the International Criminal Court, potentially making it the first European country to exit the organization, though it&#8217;s yet to be officially confirmed.
The Hungarian government had been considering the move for some time. The formal procedure would involve offering a resolution proposal to the Hungarian Parliament and initiating the withdrawal if the Parliament approves, which could take as long as one year. “According to our source, the text of the draft resolution may soon be posted on the website of the National Assembly,” Szabad Európa <a href="https://www.szabadeuropa.hu/a/tuzson-bence-zart-korben-arrol-beszelt-hogy-magyarorszag-kilep-a-nemzetkozi-bunteto-birosagbol/33362063.html">reported</a>, adding, “We understand that the political decision to withdraw Hungary was actually made weeks ago, but the government was still waiting to see what U.S. President Donald Trump would say about the ICC.”
On February 6, President Donald Trump announced he was imposing sanctions on the ICC, <a href="https://www.whitehouse.gov/presidential-actions/2025/02/imposing-sanctions-on-the-international-criminal-court/">stating</a> that “the International Criminal Court (ICC), as established by the Rome Statute, has engaged in illegitimate and baseless actions targeting America and our close ally Israel. Hungarian conservative Prime Minister Viktor Orban has been a staunch supporter of Israel; he is meeting Israeli Prime Minister Benjamin Netanyahu in Budapest on Wednesday. In November, after the ICC issued the arrest warrant, Orban <a href="https://www.yahoo.com/news/hungarys-orban-invites-israeli-pm-194508337.html">ripped it</a>, calling it “outrageously brazen and cynical,” UPI reported.
“Later today, I will invite the Israeli prime minister, Mr. Netanyahu, to visit Hungary, where I will guarantee him, if he comes, that the judgment of the ICC will have no effect in Hungary, and that we will not follow its terms,” he stated in November. &#8220;There is no choice here, we have to defy this decision.”

On Thursday, President Donald Trump signed an <a href="https://www.whitehouse.gov/presidential-actions/2025/02/imposing-sanctions-on-the-international-criminal-court/" target="_blank" rel="noopener">executive order</a> that imposed sanctions on the International Criminal Court (ICC), stating that the ICC “engaged in illegitimate and baseless actions targeting America and our close ally Israel.”

In November 2017, ICC Chief Prosecutor Fatou Bensouda asked for authorization to investigate alleged crimes by U.S. armed forces in Afghanistan. “Bensouda’s office ‘determined that there is a reasonable basis to believe that members of the Afghan National Security Forces, the US armed forces and the CIA had committed ‘war crimes,’” CNN <a href="https://www.cnn.com/2020/03/05/politics/icc-afghanistan-pompeo/index.html" target="_blank" rel="noopener">noted</a>. In March 2020, the ICC granted permission for the investigation. “This is a truly breathtaking action by an unaccountable political institution masquerading as a legal body,” former Secretary of State Mike Pompeo reacted. The Trump administration <a href="https://www.npr.org/2020/09/02/908896108/trump-administration-sanctions-icc-prosecutor-investigating-alleged-u-s-war-crim" target="_blank" rel="noopener">sanctioned</a> Bensouda and the court&#8217;s head of jurisdiction, Phakiso Mochochoko, in September 2020.
In early January, House Republicans <a href="https://foreignaffairs.house.gov/press-release/house-passes-chairman-masts-bill-to-sanction-international-criminal-court-for-targeting-israel/" target="_blank" rel="noopener">passed</a> the Illegitimate Court Counteraction Act, introduced by House Foreign Affairs Committee Chairman Brian Mast (R-FL) and Rep. Chip Roy (R-TX) to sanction the ICC. “I don’t care if you are a terrorist in a cave or a lawyer at the Hague, if you get in the way of bringing American hostages home, then you will be given no quarter and you damn well shouldn’t expect to be welcomed on American soil with open arms,” Mast stated.
“This is an entity, the international criminal court, that has no jurisdiction over the people of the United States, should have no authority over our people, no authority over the Prime Minister of Israel, yet is extending into the people of Israel’s business in defending their interests against violent attack by Hamas, which we define as a terrorist entity,” Roy added.
In late January, Democrats in the Senate <a href="https://www.cbsnews.com/news/senate-democrats-block-icc-sanctions-bill/" target="_blank" rel="noopener">blocked</a> Republicans from passing a measure sanctioning the ICC; the bill got 54 votes, with all Republicans and Sen. John Fetterman (D-PA) voting for it, but it needed 60 votes to pass.

Forty-five Democrats <a href="https://clerk.house.gov/Votes/20257" target="_blank" rel="noopener">joined</a> 198 Republicans in voting for the Illegitimate Court Counteraction Act. The bill once more heads to the Senate; with the GOP in control, the legislation may actually succeed.

The House vote on Thursday was the second in this Congress in which a bipartisan group of lawmakers passed a bill. A former head of Human Rights Watch (HRW) described dozens of hostages held by <a href="https://www.dailywire.com/topic/hamas" target="_blank" rel="noopener">Hamas</a> as “utter irrelevancies&#8221; on Wednesday.
Kenneth Roth, a visiting professor at Princeton and the former executive director of HRW, accused the Israeli government of giving “diversionary excuses” in response to charges against two top officials by the International Criminal Court (ICC) in The Hague. The ICC charged Prime Minister Benjamin Netanyahu and his former defense minister, Yoav Gallant, of committing war crimes in the war against Hamas in Gaza.
One of the “excuses” cited by Roth is Israel’s mission to rescue roughly 100 hostages taken by Hamas during its October 7, 2023, terror attack.
“The Israeli government responded to the ICC war-crime charges with the usual diversionary excuses – the need to liberate the hostages, Hamas’s use of human shields, Israel’s democracy and self-defense, supposed ICC antisemitism – all utter irrelevancies,” Roth said in a post on X.

In a later post, Roth <a href="https://x.com/KenRoth/status/1861772388171477432" target="_blank" rel="noopener">said</a> that the ICC charges are not about whether Israel’s war is just, but about “HOW [Israel] is waging the war. Nothing justifies war crimes.” But he also <a href="https://x.com/KenRoth/status/1861755302485402057" target="_blank" rel="noopener">called</a> for a ceasefire between Israel and Hamas, and said Israel’s only reason for continuing the war in Gaza was Netanyahu’s “need for a forever war to retain power and avoid prison&#8230;&#8221;
Roth served as the executive director of HRC from 1993 to 2022. He received pushback online for his characterization of the hostages held by Hamas.
“I can think of 101 people, in addition to their families, who might argue that the hostages are not ‘utterly irrelevant’ to IDF operations in Gaza,” Melissa Weiss, executive editor of Jewish Insider, <a href="https://x.com/melissaeweiss/status/1861746703386161202" target="_blank" rel="noopener">wrote</a> on X.
International Legal Forum CEO Arsen Ostrovsky <a href="https://x.com/Ostrov_A/status/1861695529383555391" target="_blank" rel="noopener">called</a> Roth “an absolute heartless monster.”
Adam Cannon, the director of legal at the British tabloid The Sun, <a href="https://x.com/adam_cannon/status/1861711863228047482" target="_blank" rel="noopener">said</a> that Roth’s post showcases the “huge anti Israel bias” as HRC.
Cannon wrote to Roth on X: “Your dismissal of the Hamas atrocities and the hostage they took on Oct 7 just illustrates your total lack of understanding or maybe just abject bias when it comes to this conflict, undermining an organisation which should be at the forefront of helping solve the issues.”

Former Human Rights Watch Exec Dismisses Hostages Of Hamas As ‘Utter Irrelevancies’

An internationally acclaimed British barrister blasted the International Criminal Court after it issued an arrest warrant for Israeli Prime Minister Benjamin Netanyahu.
Natasha Hausdorff, an expert on international law, foreign affairs, and national security policy, recently appeared on Dan Senor&#8217;s Call Me Back podcast.
She noted that the warrant was “principally an allegation of intentional starvation, which included a host of false allegations &#8230; my organization, UK Lawyers for Israel, went through that public summary line by line and in a further submission to the court, and a letter to the prosecutor proved, I should say, line by line, that every phrase of every sentence was, in fact, false.”
Hausdorff explained that when the Rome Statute — the treaty that established the ICC — was drafted, “a particular political agenda started to creep in,” adding that the agenda caused both the United States and Israel to refuse to join the ICC. She further explained the Rome Statute was manipulated so that the presence of Jews in the Biblical lands of Judea and Samaria could be considered a crime.

“Bashar Assad, under his regime over the last, call it, you know, 10 to 15 years, there has been something in the order of over 600,000 Syrians slaughtered,” Senor noted. “Talk about a genocide, an orchestrated genocide with the use of chemical weapons and the complete shelling and destruction of whole Syrian towns, largely Sunni Muslim towns and villages, and some two million Syrians who have been displaced; some internally, but most of them externally displaced. You have talked about forced starvations. We can talk about what famines are like in places like North Korea. We can talk about the wave of human rights abuses in countries like Iran. So just take Kim Jong-un, Bashar Assad, and the Supreme Leader of Iran, Khamenei, as the three examples. The ICC has never, not once, I don&#8217;t think, targeted any of those leaders.”
“We are seeing a vicious cycle of the misreporting in the media and the false narratives, the blood libels, ultimately,” Hausdorff stated. “This is the modern blood libel, to accuse Israelis of killing Palestinian children while Jews were accused of killing Christian children in the Middle Ages in pursuit of their blood. This is no different, except that it now has the modern acceptable face of the hatred of the Jewish state. And I think that&#8217;s why it&#8217;s become so pervasive and it&#8217;s so effective at fueling this weaponization of international law against the Jewish state.”
“Members of the ICC have said, ‘We&#8217;re not going to participate. And we&#8217;re not going to comply,’ I think also chips away at the credibility of the institution,” Senor stated. “I know the U. S, with the new administration coming in and the new Congress coming in, are talking about taking some very strong action against the ICC. We could wind up a year from now with the ICC being a shell of itself.”
“All of these legal terms, genocide, apartheid, all of the Arab world is Jew-free,” Hausdorff noted. “And yet, this allegation is directed at Israel, where there is a 20% minority of Arabs that live as equal citizens. I mean, all of this is utterly extraordinary. But, outside of these exchanges that we&#8217;re having, it is becoming the received wisdom. The ICC isn&#8217;t launching this initiative in a vacuum.”

International Law Expert Condemns ICC For Arrest Warrant Targeting Netanyahu

The disgusting, corrupt, and anti-Semitic International Criminal Court (ICC) has issued an arrest warrant for Prime Minister Benjamin Netanyahu of Israel and his former defense minister, Yoav Gallant, accusing them of war crimes and crimes against humanity in Gaza.
In order to suggest a moral equivalence, they issued an arrest warrant for Mohammed Deif — who is dead. He was the military chief of Hamas killed in an airstrike months ago. 
The ICC arrest warrant is ridiculous and disgusting. The claim is that Israel was deliberately attempting to starve the Palestinians.
Let me explain how insane that is.
Israel has shipped in — I kid you not — 900,000 kilotons of food aid into the Gaza Strip. Kilotons, not pounds. Kilotons. We&#8217;re talking about roughly two billion pounds of food aid shipped into the Gaza Strip in the middle of a war in which Hamas, with the help of some civilians, is currently holding Israelis and Americans hostage. 
Now, the ICC has decided it is going to move forward with this arrest warrant. It’s possible this is an attempt by the prosecutor of this case to avoid the fact that he&#8217;s now been hit with a sexual harassment allegation, apparently by members of both sexes. Thus, he may be attempting to misdirect away from that by issuing an arrest warrant.
The ICC arrest warrant doesn&#8217;t apply in many places that don&#8217;t abide by the ICC. For instance, the United States is not a signatory to the International Criminal Court. Why? Because we are aware that it is, in fact, a repository of evil: dictatorial states and their European dupes. As Americans, what we are concerned about is that they would then attempt to arrest, for example, members of the American military who served in Afghanistan or who served in Iraq.
A note: This is something the Trump administration should, indeed, be worried about. If the ICC issues an arrest warrant for any signatory country to the ICC, that signatory country then has a legal duty — under the ICC — to make the arrest. If you think that won&#8217;t be attempted against Donald Trump, you&#8217;re out of your mind.

This is why the United States is not a signatory to the ICC. This used to be a bipartisan understanding, as the U.S. knew the ICC is a trash organization that manipulates the very idea of international law — which doesn&#8217;t exist in the first place — in order to militarize and weaponize against the opponents of some of the world&#8217;s worst regimes. 
The proof is in the pudding. They&#8217;re not just doing this against Netanyahu. They&#8217;re also doing this against Yoav Gallant, his former defense secretary, who was basically fired by Netanyahu and became a sort of opposition figure for a while.
Both Argentina and Hungary have said they&#8217;re not going to abide by the ICC warrants. The ICC is now signaling it may revoke the arrest warrant for Netanyahu and Galant if there is, what they call, a “credible investigation” into charges of genocide and famine in the Gaza Strip by people inside Israel, which figures.
It figures because inside Israel, there are people who are actually allied with organizations like the ICC. The deep state is present in an enormous number of jurisdictions across the globe, whether it be the deep state in Brazil currently targeting Jair Bolsonaro or the deep state in Israel targeting Netanyahu.
There are career appointees in a wide variety of administrative agencies across the world who are directly opposed to the elected governments of these particular places and will use their power in order to stifle the agenda of those particular elected governments.

The incoming Trump administration has already said they&#8217;re going to take severe measures against the ICC.
The fact that Hamas is celebrating the ICC decision says all anyone needs to know about the International Criminal Court. The ICC is clearly so moral. They are so decent. 
In the International Court of Justice, another U.N. agency, South Africa — a place of tremendous human rights violations — brought a case against Israel for genocide. They did so almost certainly because Iran was paying them.
All these international institutions have been completely weaponized.
It will happen to President Trump. I would bet that at some point, the ICC, at the behest of some corrupt state, will bring some sort of prosecution against Donald Trump and will then try to get the Europeans on the hook to arrest Trump if he were to arrive. Frankly, that would be the best thing that ever happened because no European country is going to arrest the sitting president of the United States.
All of this shows why this institution should be dismantled wholesale.

The International Criminal Court (ICC) issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former defense minister Yoav Gallant, and officials of the terror group Hamas on Thursday.
The court issued warrants for leaders of Hamas over the October 7, 2023, terror attack on Israel that sparked the war in Gaza. Hamas’ remaining leaders have reportedly <a href="https://www.timesofisrael.com/hamas-officials-booted-by-qatar-last-week-now-hosted-in-turkey-diplomat-says/">sought</a> refuge in Turkey, a NATO member, after being forced out of Qatar following the election of President-elect Donald Trump.
The ICC, which has long been accused of harboring bias against Israel, accused the Israelis of “crimes against humanity and war crimes” in Israel’s prosecution of its war against Hamas in the Gaza Strip, according to the ICC’s <a href="https://www.icc-cpi.int/news/situation-state-palestine-icc-pre-trial-chamber-i-rejects-state-israels-challenges">announcement</a> of the warrants.
Netanyahu and Gallant “bear criminal responsibility for the war crime of starvation as a method of warfare,” the court claimed. “The Chamber found that there are reasonable grounds to believe that the lack of food, water, electricity and fuel, and specific medical supplies, created conditions of life calculated to bring about the destruction of part of the civilian population in Gaza.”
The accusations drew sharp rebukes and allegations of anti-Semitism from American and Israeli officials. Netanyahu’s office <a href="https://www.nytimes.com/live/2024/11/21/world/israel-netanyahu-hamas-gaza/90430a85-1aae-5a64-be09-ff51f4cad860?smid=url-share" target="_blank" rel="noopener">called</a> the charges against him and Gallant “absurd and false.” 
“Prime Minister Benjamin Netanyahu will not surrender to the pressures,” his office said in a statement. “He will not recoil or withdraw until all of the war’s goals — that were set at the start of the battle — are achieved.”
Defense Minister Israel Katz, who recently replaced Gallant in the role, posted a statement to X ripping the court’s decision as “shameful” and “a moral disgrace, entirely tainted by antisemitism.”

In the U.S., Democratic Sen. Incoming Senate Majority Leader Senator John Thune (R-SD) told current Senate Majority Leader Senator Chuck Schumer (D-NY) that he should warn the International Criminal Court (ICC) that it could be hit with sanctions if it issues arrest warrants against Israeli officials — or Thune would make it a top priority for the incoming Senate.
“If the ICC and its prosecutor do not reverse their outrageous and unlawful actions to pursue legislation, as the House has already done on a bipartisan basis, the Senate should immediately pass sanctions legislation, as the House has already done on a bipartisan basis,” Thune wrote. “If Majority Leader Schumer does not act, the Senate Republican majority will stand with our key ally Israel and make this – and other supportive legislation – a top priority in the next Congress.”

The House passed a bill last June to impose sanctions on officials at the International Criminal Court after ICC prosecutors equated Israeli Prime Minister Benjamin Netanyahu and Israeli Defense Minister to Hamas terrorist leaders Yahya Sinwar, Mohammed Deif, and Ismail Haniyeh, asking for arrest warrants for all five on grounds of war crimes and crimes against humanity. The ICC accused Netanyahu and Gallant of “systematically depriving civilians in Gaza of ‘objects indispensable to human survival,’” Reuters <a href="https://www.reuters.com/world/middle-east/what-war-crimes-are-israel-hamas-accused-one-year-2024-10-01/" target="_blank" rel="noopener">reported,</a> adding, “Israel is not a member of the ICC and does not recognize its jurisdiction.”
President Joe Biden’s advisers said he was “strongly opposed” to the bill.
By October 23, House Speaker Mike Johnson (R-LA), tired of Schumer stalling on the issue, <a href="https://jewishinsider.com/2024/10/house-speaker-pressures-schumer-to-bring-up-legislation-sanctioning-the-icc/" target="_blank" rel="noopener">wrote</a> to Schumer, “In a bipartisan vote, the House passed H.R.8282, The Illegitimate Court Counteraction Act, to sanction employees of the ICC. President Biden condemned the ICC, and you yourself called the ICC’s decision ‘reprehensible’ and promised to negotiate on a sanctions package. Unfortunately, after five months, neither your statements nor those from the Biden-Harris White House have materialized into action.”
As far as the accusations against Israel from the ICC, there have been repeated reports of Hamas stealing humanitarian aid that Israel has let through to Gaza.  In May, State Department spokesman Matthew Miller stated, “The convoys from the Jordanian military that brought the aid in unloaded the aid in Gaza. It was then picked up by a humanitarian implementer for distribution inside Gaza. That aid was intercepted and diverted by Hamas on the ground in Gaza.” “The supplies were the first to be shipped from Jordan to the Palestinian enclave through a newly reopened border crossing authorized by Israel,” The Washington Times <a href="https://www.washingtontimes.com/news/2024/may/3/us-says-hamas-stole-aid-gaza-sent-through-newly-op/" target="_blank" rel="noopener">noted</a>.

In September, the Jerusalem Post <a href="https://www.jpost.com/tags/hamas" target="_blank" rel="noopener">reported</a>, “Hamas terrorists have confiscated so much humanitarian aid that the terror group is struggling to find space in warehouses to store all of it, according to intercepted communications between Hamas operatives that were played during an episode of N12&#8217;s ‘Ulpan Shishi’ on Friday.”
Earlier this month, the New York Post <a href="https://nypost.com/2024/10/10/world-news/hamas-steals-humanitarian-aid-trucks-from-gaza-strip/" target="_blank" rel="noopener">reported,</a> “Hamas terrorists were captured on video taking control of 47 of 100 aid trucks entering the Gaza Strip on Tuesday.
“We let all those trucks come in, and Hamas’s strategy is to steal, hoard and gouge. That’s what they do,” Netanyahu said in September. “They steal the food. They charge exorbitant prices from the Gazans. And that’s how they continue, [or] they hope to continue, to survive. And we have to take that away from them.”
