A True ‘Modern Family’: Sofía Vergara Wins Legal Battle To Kill Her Frozen Unborn Babies

What does a true “modern family” look like? ABC says a family built on divorce and remarriage as well as a girl raised by two dads. Others might say a family of one mom, four dads and a donkey. The possibilities are endless. For actress Sofía Vergara, star of the ABC comedy Modern Family, the true “modern family” is creating life with in-vitro fertilization, freezing it, and then killing it upon realizing you did not want them anymore.

According to LifeNews, Sofía Vergara and her ex-fiance have been in a multi-year legal battle over the fate of their two human embryos, whom they named Emma and Isabella, which has now finally come to a close with a federal judge dismissing the case.

“Vergara and ex-fiance Nick Loeb have been fighting for more than two years about the fate of their frozen embryos, who Loeb named Emma and Isabella,” reports LifeNews. “Loeb wants the girls to have a chance to live, while the ‘Modern Family’ actress wants them to remain frozen or be destroyed. The couple had the embryos created several years ago for in vitro fertilization, but the couple later split.”

The two embryos’ futures hang in the balance now that a Louisiana federal judge ruled in Vergara’s favor to dismiss her ex-fiance’s case.

Loeb filed the lawsuit in Louisiana because of the state’s right to live laws, which he hoped would grant a right to life to Emma and Isabella. Though the girls are in the earliest stage of life, they are already human beings who have their own unique DNA.

However, a Louisiana judge recently dismissed Loeb’s case because neither he nor Vergara nor their embryos have personal ties to the state, according to court documents. The embryos were conceived in California, and both Loeb and Vergara live there.

TMZ reports the judge did refer to the embryos as “citizens of California,” indicating their humanity. However, the judge said the case cannot be heard in Louisiana because of a lack of personal jurisdiction.

Loeb filing a custody suit in California would be an uphill battle, given that he already dropped his previous suit against her to pursue custody in Louisiana. That initial suit was dropped after a judge ordered him to reveal the identities of two previous girlfriends who aborted their unborn babies with him, a line he told Catholic commentator Matt C. Abbott that he would not cross.

“Could you imagine if you had moved on with your life, gotten married, had children and kept this a secret from your family – then, all of a sudden, 15 years later, you’re made to reveal your abortion to the world?” he told Abbot. “Maybe your parents never knew; maybe your husband never knew, nor your children.”

Loeb now believes that life begins at conception and does not want the embryos destroyed, and now argues that “Vergara’s parental rights should be terminated and Loeb given full custody of the girls” so he can implant them into a surrogate mother. He claims that Vergara promised him not to destroy the embryos, a verbal agreement that he says will be broken.

“I created these two female embryos with the purpose of taking them to term and not destruction, because I have always dreamed of being a father,” Loeb said in 2015. “I have previously offered to waive any parental or financial responsibilities on the part of my ex. … When a man does want to become a father, and wants to impose no obligations on the other party, he should have that corresponding right.”

Vergara is taking the “act of mercy” stance, claiming the children cannot exist without a loving household.

“A child needs a mother and a loving relationship with parents that get along, that don’t hate each other. …. Kids need parents,” Vergara said.

Once upon a time the words “mother and father” would have been in that sentence, but they have been replaced by the banally-cryptic “parents” — a true modern family indeed.
