Mom Whose Daughter Was Allegedly Killed By MS-13 Sues Biden Administration For $100 Million

A mother whose daughter was allegedly raped and murdered by a member of the infamously vicious MS-13 gang is suing the Biden administration over her daughter’s death.

Tammy Nobles, the mother of 20-year-old Kayla Hamilton, accused the Biden administration of playing “Russian roulette with our lives” in her lawsuit, which was filed late last week.

The $100 million suit accuses the Department of Homeland Security and the Department of Health and Human Services of failing to stop the teenage El Salvadoran gang member from entering the country.

“Nobody at the border did their job and checked his background,” she told NewsNation.

Hamilton, who had autism, was strangled with a phone cord on July 27, 2022 in her Frederick, Maryland trailer home, according to police.

The 17-year-old illegal immigrant suspect had run away from a holding facility and ended up as Hamilton’s roommate in the trailer home.

“He ends up in this trailer home as a roommate with lovely Kayla, that was leased out by another illegal immigrant,” said Brian Claypool, the family’s attorney.

The suit accuses the Department of Health and Human Services (HHS) of failing by allowing the suspect to be in the holding facility in the first place, failing to verify the suspect’s identity with a phone call, and failing to confirm a verified sponsor for him.

The family’s attorney also said a gang-related tattoo was visible on the teen and should have prevented him from entering the country.

About six months after the murder, authorities finally arrested the suspect after comparing his DNA to material at the crime scene.

He was charged with first-degree murder, rape, and robbery. He is currently being held without bail, and his trial is scheduled to begin on June 28.

He was listed as a member of MS-13, Immigration and Customs Enforcement (ICE)  confirmed.

“We’re bringing this lawsuit because we’re tired of being held hostage in our own country. We’re tired of DHS playing Russian roulette with our lives,” the family’s attorney told NewsNation.

On Thursday, Nobles testified to House lawmakers as part of an impeachment inquiry into Homeland Security Secretary Alejandro Mayorkas.

“For me, this not a political issue, this a safety issue for everyone living in the United States,” she told the House Homeland Security Committee.

“I want everyone to know what’s going on at the border,” Nobles said. “I had no clue what was going on before my daughter was brutally murdered and raped — but I do now.

“All they had to do was make one phone call to El Salvador to know that he was an MS-13 gang member on the list,” she added.
