U.S. District Judge Jeffrey Cummings is expected to hold a hearing Wednesday that could result in an order forcing federal immigration agents to release the detainees with ankle monitors or other tracking devices, <a href="https://abc7chicago.com/post/ice-chicago-news-judge-considers-releasing-hundreds-arrested-immigration-operation-midway-blitz/18140683/" target="_blank" rel="noopener">according</a> to ABC7.
Immigration advocates at the National Immigrant Justice Center have argued that the feds violated a consent decree in Illinois when they arrested the targets.
Cummings ruled last month that agents violated a previous consent decree when making warrantless arrests in Chicago.
ICE had agreed that when they make a warrantless arrest, they must determine whether there is probable cause leading them to believe the person is in the United States illegally and if they are a flight risk.
The agency has the authority to make warrantless arrests, a standard practice of the agency nationwide that already has some restrictions.
One of the illegal immigrants who could be released is Colombian national Diana Patricia Santillana Galeano, who caused a stir after she fled a traffic stop and ran into a daycare to hide from federal agents in Chicago.

Democratic Illinois Rep. Mike Quigley shared a video of the arrest, falsely accusing ICE of snatching “a preschool teacher without a warrant IN FRONT OF CHILDREN in my district.”
The Department of Homeland Security quickly corrected the record.
“Congressman, you are deliberately misrepresenting the facts,” the agency wrote on X.
“ICE law enforcement did NOT target a daycare and were only at this location because the female illegal alien fled inside,” they added.
Galeano crossed the border in 2023, while her children were smuggled in just last month.
During her arrest, she tried to lie about her identity and denied that she knew the male driver in her car, saying she “just picked him up from a bus stop,” DHS said.

Judge Considers Releasing Hundreds Of Illegal Immigrants Nabbed By ICE In Chicago Raids

The United Kingdom has stopped sharing intelligence with the United States on drug boats in the Caribbean to stay out of major counter-narcotics strikes in the region.
While controlling multiple territories in the Caribbean, the U.K. has long helped the U.S. interdict drug smugglers in the open sea, CNN <a href="https://www.cnn.com/2025/11/11/politics/uk-suspends-caribbean-intelligence-sharing-us">reported</a>. But as the mission becomes more lethal, the U.K. no longer wants to be involved.
The intelligence blackout began over a month ago.
The Department of War has launched more than a dozen strikes on boats, killing 76 people.
Believing that the strikes violated international law, the U.K. started to worry that its intelligence was helping the U.S. locate the vessels before obliterating them.
Trump administration officials have <a href="https://www.facebook.com/DepartmentofWar/videos/4345830319036573/" target="_blank" rel="noopener">defended</a> the strikes, saying the drug traffickers are “operating under the control” of Venezuelan dictator Nicolás Maduro.
Some legal experts, however, have questioned President Donald Trump&#8217;s authority to act on the threats without congressional approval.
Brian Finucane, a former State Department legal adviser, recently told The Daily Wire that “the strikes are not legal” and lack justification.
“The precedent that this administration seems to be invoking are strikes the U.S. has taken over the course of the last 20-plus years in the context of the U.S. war on terror against groups like Al Qaeda and ISIS,” he said. “But those precedents are really irrelevant and a red herring with respect to the strikes we’re seeing in the Caribbean and now the Pacific.”
“For the first time, the U.S. government designated criminal entities, drug trafficking organizations as foreign terrorist organizations,” he explained. “But those assertions seem to be undermined by the U.S. Intelligence community.”
Dr. Nicholas Creel, law professor at Georgia College and State University, believes the strikes are legal, pointing to roughly five out of 30 examples of “instances where we moved first and somebody died” where the president actually received congressional approval.
“What a lot of people lose in this is if we do agree that the president has the authority to respond to attacks, who is it that gets to define an attack is? It has to be the president,” Creel said. “It necessarily cannot be Congress.”
“That’s why we chose this word to give the president the authority to respond to these attacks so it has to be that decides what this attack is. And if you or I think this is not an attack, fine, but we’re not the president.”
He continued: “Pretty much every president since FDR would have to have been said to have acted unconstitutionally in terms of the war powers, which seems a bit odd. If it’s that common a practice, is it really, I mean, just because people are doing it doesn’t mean it’s legal, but at the same time, if everybody is basically doing it? Is it really illegal?”

In honor of the late Katie Abraham, who was killed at the age of 20 by an illegal immigrant drunk driver, the Department of Homeland Security has nabbed multiple illegal immigrants roaming the sanctuary state after being charged with DUIs as part of its mass deportation campaign, the agency told The Daily Wire.
These illegal immigrants found refuge in the sanctuary state of Illinois for years, and now Homeland Security officials are putting a stop to that. For years, the accused illegal immigrants roamed the state with impunity as local authorities let them go free. But the free-for-all has ended.
Last month, the feds nabbed Benito Hernandez Ibarra, a previously deported criminal from Mexico who was convicted of multiple counts of DUI. Chicago authorities let Ibarra free in 2012, ignoring ICE&#8217;s detainer at the time.
Mexican illegal immigrant Javier Castillo Hernandez was also arrested after authorities in Cook County let him off on probation in 2004 after he was driving drunk.
Despite being convicted of aggravated DUI in Chicago nearly a decade ago, Ecuadorian citizen Oscar Sinchi was roaming the streets. The feds arrested him in September.
The Trump administration flooded Illinois with additional ICE officers and Border Patrol agents in September, commencing what they&#8217;ve dubbed &#8220;Operation Midway Blitz.&#8221; The raids were launched to honor Katie Abraham.
“Katie’s death was preventable. She was killed by a man, Julio Cucul Bol, who entered and remained in our country illegally,” Joe Abraham, Katie’s father, said in a statement shared with The Daily Wire. “He was using multiple aliases, exploiting gaps in an overwhelmed and disorganized immigration system. Illinois’ sanctuary law allowed this monster to roam free.&#8221;
&#8220;He should have been removed long before he could take my daughter’s life. It would be unjust and unreasonable to separate my family’s loss from the policies that failed us. We did everything right. We worked hard, obeyed the law, paid our taxes and trusted that government would protect us in return. That trust was broken. Our leaders — from the governor’s office on down — have not treated immigration as a matter of public safety or national security,&#8221; Abraham said.

DHS Launches DUI Crackdown In Illinois In Honor Of Woman Killed By Illegal Immigrant Drunk Driver

The Trump administration has escalated a military campaign in the Caribbean against alleged drug traffickers and could soon target Venezuelan military facilities in the counternarcotics attacks.
The first <a href="https://www.dailywire.com/news/u-s-precision-strikes-on-venezuela-military-could-begin-within-hours?author=Hank+Berrien&amp;category=News&amp;elementPosition=1&amp;row=0&amp;rowType=Vertical+List&amp;title=U.S.+Precision+Strikes+On+Venezuela+Military+Could+Begin+Within+Hours" target="_blank" rel="noopener">strike</a> took out 11 alleged drug traffickers reportedly bound for the United States, setting off an escalation of aggressive military hits on drug boats in the Caribbean. Since then, more than a dozen such strikes have taken place.
Trump administration officials have <a href="https://www.facebook.com/DepartmentofWar/videos/4345830319036573/" target="_blank" rel="noopener">defended</a> the strikes, saying the drug traffickers are &#8220;operating under the control&#8221; of Venezuelan dictator Nicolas Maduro.
Some legal experts, however, have questioned Trump&#8217;s authority to carry out strikes without congressional approval. Trump has also faced questions from lawmakers on both sides of the aisle, leading him to authorize new briefings for Congress, Axios recently <a href="https://www.axios.com/2025/11/03/trump-venezuela-briefings-congress" target="_blank" rel="noopener">reported</a>.
Brian Finucane, a former State Department legal adviser, told The Daily Wire that &#8220;the strikes are not legal&#8221; and lack justification.

The situation reached a boiling point earlier this month, with reports that the Trump administration could soon target Venezuelan military facilities believed to have a role in the drug trade. The White House and Trump, however, pushed back on claims of an imminent attack.
The Treasury Department <a href="https://home.treasury.gov/news/press-releases/sb0207" target="_blank" rel="noopener">sanctioned</a> Maduro in July, accusing him of leading Venezuela&#8217;s Cartel de los Soles and supporting the Tren de Aragua prison gang and Sinaloa cartel.
Trump <a href="https://home.treasury.gov/news/press-releases/sb0207" target="_blank" rel="noopener">designated</a> Cartel de los Soles and <a href="https://www.state.gov/designation-of-international-cartels" target="_blank" rel="noopener">Tren de Aragua</a> as terrorist organizations after they &#8220;conducted kidnappings, extorted businesses, bribed public officials, authorized its members to attack and kill U.S. law enforcement, and assassinated a Venezuelan opposition figure.&#8221; In August, Trump <a href="https://www.state.gov/nicolas-maduro-moros" target="_blank" rel="noopener">doubled</a> the bounty for Maduro’s capture to $50 million — the largest such reward in U.S. history — and offered $25 million apiece for his cartel lieutenants, including Diosdado Cabello and Defense Minister Vladimir Padrino López.
But the designation doesn&#8217;t afford Trump the authority to hit the alleged drug runners, Ilya Shapiro, senior fellow and director of constitutional studies at the Manhattan Institute, told The Daily Wire.
&#8220;So the distinction between war and crime is what I think is at the heart of this,&#8221; Shapiro said. &#8220;Twenty-five years ago, for the first time, the president invoked the war powers against Al Qaeda, which is a non-state actor and here we also have apparently a non-state actor drug cartels. And so the issue isn&#8217;t the harm caused by the drug cartels &#8230; there&#8217;s a talking point that drug overdose deaths in a single year surpass totaled American deaths in most major wars. But that doesn&#8217;t change crime into war.&#8221;
&#8220;Armed force, I think, is justified when enemy attack political reasons, whether it&#8217;s Al Qaeda or Hamas or someone else like that, but usually the military isn&#8217;t appropriate against criminals, and criminal gangs could be treated as military targets, if and when they act as arms of a hostile war government,&#8221; he said.
Shapiro recognized that military force could be &#8220;appropriate&#8221; if there were evidence proving that the drug trafficking in the Caribbean &#8220;is the Venezuelan government&#8217;s attempt to destabilize or otherwise attack the United States.&#8221;
&#8220;But if they&#8217;re just criminal gangs, looking to make a profit, then I don&#8217;t think it&#8217;s appropriate to use military force,&#8221; he added.
Recognizing he holds a &#8220;minority&#8221; opinion on the issue for believing that Trump has the authority to act alone, Dr. Nicholas Creel, law professor at Georgia College and State University, told The Daily Wire that the president has the authority to act alone when &#8220;emergencies&#8221; occur.
&#8220;I think it&#8217;s pretty clear that he does have the authority to do this,&#8221; said Creel.
While Congress has the authority to declare war, the president has the power to respond to attacks without awaiting a vote or any possible delay. Trump sent the aircraft carrier USS Gerald R. Ford, along with her full strike group, to the region this week, marking the largest concentration of naval assets in the region in decades.
Secretary of War Pete Hegseth also deployed F-35B fighters and MQ-9 Reapers to Puerto Rico, which are capable of destroying clandestine drug labs and airstrips in Venezuelan territory.
Trump recently confirmed that he authorized the CIA to conduct covert actions inside Venezuela. United States military aircraft have also recently buzzed the Venezuelan coast in recent weeks.

Does The President Have The Authority To Strike Venezuelan Drug Boats?

Federal authorities nabbed an illegal immigrant with a lengthy rap sheet believed to be connected to a shooting targeting Border Patrol agents in Chicago over the weekend.
The suspect, whose name has yet to be released publicly, hails from Mexico and has previous convictions for aggravated unlawful use of a weapon/vehicle, felony possession of a weapon, and illegal entry, the Department of Homeland Security said Monday.
Border Patrol Commander Gregory Bovino told Fox News that &#8220;it&#8217;s possible&#8221; there are more suspects on the run.
&#8220;This individual should&#8217;ve never been walking the streets of Chicago. This is what you get with a JB Pritzker or a Mayor Johnson and that crazy rhetoric. This individual should not have been in this country,&#8221; Bovino said of the latest arrest.
The illegal immigrant must remain detained, per the Laken Riley Act. The suspect also has pending charges for allegedly assaulting officers.
Border Patrol agents <a href="https://www.dailywire.com/news/the-violence-must-end-man-opens-fire-on-border-patrol-agents-in-chicago-chaos-erupts">were shot at</a> on Saturday while conducting mass deportation operations in the Little Village neighborhood, which is largely populated with immigrants.
“Today, U.S. Border Patrol was conducting immigration enforcement operations near 26th Street and Kedzie Avenue in Chicago, Illinois, when an unknown male driving a black Jeep fired shots at agents and fled the scene,” the DHS posted to X on Saturday afternoon.
DHS said an “unknown number of agitators also threw a paint can and bricks at Border Patrol’s vehicles,” adding that the Chicago Police Department “was called for assistance and cleared the scene.”
“The shooter and vehicle remain at large, and this is a dynamic situation,” the post continued.
Footage from the scene showed chaos erupting in the streets as demonstrators shouted profanities at officers and filmed them.
DHS said on X Monday that the attack &#8220;is not isolated,&#8221; adding that it &#8220;reflects a growing and dangerous trend of violence and obstruction.&#8221;
&#8220;Over the past two months, we’ve seen an increase in assaults and obstruction targeting federal law enforcement during operations. These confrontations highlight the dangers our agents face daily and the escalating aggression toward law enforcement,&#8221; the agency wrote.

Feds Nab Illegal Immigrant Tied To Shooting Of Border Agents In Chicago

After the Trump administration publicly shamed sanctuary cities and states, some have chosen to reverse course and work with Immigration and Customs Enforcement.
The Trump administration officially removed Nevada from its list of sanctuary jurisdictions in <a href="https://nevadacurrent.com/2025/09/26/nevada-first-state-to-be-removed-from-list-of-sanctuary-jurisdictions/">September</a> after eleven sheriffs in the Silver State recommitted to helping the feds, Homeland Security Secretary Kristi Noem wrote on X Monday.
Law enforcement agencies in sanctuary cities traditionally ignore ICE requests to hand over illegal immigrant criminals from jails, instead letting them go free. They are also barred from assisting with ICE arrests more generally.
But Republican Nevada Gov. Joe Lombardo previously blamed the state&#8217;s Democratic attorney general for making attempts &#8220;to implement sanctuary policies.&#8221; Lombardo insisted that the state has &#8220;never been a sanctuary state, and never will be&#8221; one.
Lombardo&#8217;s office asked the Trump administration to clarify the designation, according to an August statement.
In addition to recommitting their support for the feds, Nevada pledged to use FEMA funds to assist ICE and upgrade local jail cells designated for federal detainees. The state National Guard will also support ICE operations.

“When others cower, real leaders step up,” Noem wrote of Nevada’s policy reversal.
“I applaud the Nevada Sheriffs’ &amp; Chiefs’ Association and Governor @JosephMLombardo for their commitment to working with @ICEgov to protect American citizens from dangerous criminal illegal aliens,” she said, adding, “Because of their efforts, Nevada has been removed from the Trump Administration’s sanctuary jurisdiction list. I encourage every leader across our nation to follow their example so that all Americans can live in peace and safety.”
Last month, the Department of Justice removed Baltimore County from the list after the previously-designated sanctuary authorities signed an agreement with ICE.
“Despite restrictions from state leadership, Baltimore County has shown a willingness to cooperate with federal immigration enforcement. This is a small step toward restoring public safety and we appreciate the county’s commitment to updating its policies,” Associate Attorney General Stanley Woodward said in a <a href="https://www.justice.gov/opa/pr/justice-department-announces-removal-baltimore-county-sanctuary-jurisdiction-list-following">statement</a> at the time.
The Trump administration rolled out the list of sanctuary states, cities, and counties in August, threatening possible legal action against them for refusing to work with ICE.
“Sanctuary policies impede law enforcement and put American citizens at risk by design,” said Attorney General Pamela Bondi. “The Department of Justice will continue bringing litigation against sanctuary jurisdictions and work closely with the Department of Homeland Security to eradicate these harmful policies around the country.”
