Hunter Biden, the son of the president, pleaded not guilty on Tuesday to a trio of felony gun charges at a federal courthouse in Wilmington, Delaware.

“Mr. Biden pleads not guilty,” Biden’s lawyer Abbe Lowell said, according to NBC News.

A federal grand jury indicted Biden, 53, last month on counts related to his purchase of a Colt Cobra 38SPL revolver while he was a drug addict in October 2018.

Biden faces a maximum of 25 years in prison and up to $750,000 in fines if convicted.

After Biden pleaded not guilty, the judge explained the terms of his release, which reportedly included: supervision by a U.S. probation officer in the Central District of California, seeking employment, and not using drugs or alcohol.

As a next step in the case, the deadline for pretrial motions was set for November 3.

Lowell, in comments last month, suggested that a statute under which Biden was charged may be unconstitutional and predicted the case would be dismissed before trial.

The first son is being prosecuted after a plea deal with Delaware’s U.S. Attorney David Weiss collapsed over the summer following a judge raising concerns about immunity.

Attorney General Merrick Garland granted Weiss special counsel status in August, giving the U.S. attorney broader authority to bring charges outside of his own district.

Biden could still face other charges including tax evasion counts that were part of the plea agreement that fell apart.

Republicans in Congress have been looking into the years-long criminal investigation, spurred by whistleblowers alleging that the endeavor has been slow-walked or faced roadblocks by uncooperative U.S. attorneys in places such as Washington, D.C., and California, before Weiss was given special counsel powers.

Department of Justice leaders have pushed back against claims of politicization. During testimony before the House Judiciary Committee last month, Garland insisted that Weiss always had latitude to bring any charges he saw fit, but the attorney general acknowledged other U.S. attorneys could refuse to partner with Weiss.

House Republicans recently announced an impeachment inquiry into President Joe Biden over allegations of corruption. A scope memo listed the criminal probe into Hunter Biden as one area of interest. The White House has dismissed the impeachment inquiry as being “based on lies.”
