Biden Has Made Decision On Who He Will Nominate To Supreme Court, Report Says

Democrat President Joe Biden has reportedly made the decision on who he will nominate to the U.S. Supreme Court to replace retiring Justice Stephen Breyer.

“Biden has reached a decision on his first nominee to the Supreme Court, people familiar with the selection said Thursday, with his historic selection of the first Black woman to serve on the nation’s highest court set to be revealed as soon as Friday,” CNN reported. “But even if the announcement is delayed beyond Friday afternoon, aides said, it will take place no later than Monday, the eve of the State of the Union address.”

Sen. Ted Cruz (R-TX) slammed Biden during a recent interview with The Daily Wire after Biden pledged that race and sex would be factors in who he ultimately decided to nominate to the court. “It’s long overdue, in my view,” Biden said. “I made that commitment during the campaign for president, and I will keep that commitment.”

“When Biden declared that he would only consider an African American female for the Supreme Court, that was wrong,” Cruz told The Daily Wire. “Racial Discrimination is wrong. If anybody else tried to do that with any other job opening, it would be illegal. If a private company advertised a vacancy, and said, ‘only black women need apply, or only Hispanic men need apply, or only white guys need apply,’ that would be illegal.”

An ABC News poll released late last month found that the overwhelming majority of Americans wanted Biden to consider all possible candidates when making the decision of who he would nominate.

“Now, with the chance to do so, just over three-quarters of Americans (76%) want Biden to consider ‘all possible nominees,’” ABC News reported. “Just 23% want him to automatically follow through on his history-making commitment that the White House seems keen on seeing through.”

With only a few days left in February, court watchers are trying to read tea leaves as to the identity of President Joe Biden’s pick for the Supreme Court before his end-of-the-month deadline — and a federal court on Thursday increased the buzz around DC Circuit Judge Ketanji Brown Jackson.

The US Court of Appeals for the District of Columbia Circuit deviated from its typical procedure by issuing an opinion on a Thursday — breaking with its usual schedule of Tuesday and Friday release days. Notably, Jackson — who has interviewed with Biden for the Supreme Court nomination — was in the majority in the 2-1 ruling case.

Some legal experts took the release as a sign that Jackson could be the nominee and that the announcement could come as soon as Friday, especially because a similar scenario played out with now-Justice Brett Kavanaugh.
