Boston DA Offers To Investigate Sex Assault Allegations Against Justin Fairfax, Who Responds With Legal Threat

While most Democrats have moved on from the problems surrounding Democrat leadership in Virginia, a potential investigation into Lt. Gov. Justin Fairfax could force the issue back onto their radar.

Suffolk District Attorney Rachael Rollins told The Boston Globe that she sent an email to attorneys for Vanessa Tyson, the woman who claimed Fairfax sexually assaulted her at the Democratic National Convention in Boston in 2004.

“We will help in any way we can if she chooses to come forward,” Rollins told the Globe. “We would offer any number of services starting from getting them in touch with counselors all the way, if they were so inclined, to seek prosecution.”

Rollins did not tell the Globe whether Tyson’s attorneys responded and did not provide a copy of the email due to privacy concerns.

Tyson first came forward with her allegation shortly before Fairfax was inaugurated. She told her story to The Washington Post, which investigated her claims and decided not to publish. After Virginia Gov. Ralph Northam, a Democrat, was discovered to have worn blackface or a KKK robe while in medical school, and it appeared as though Fairfax may have to take over the governorship, Tyson wrote about her experience on Facebook.

“A person close to Tyson’s legal team said the letter did not require a response but emphasized Tyson has said she will cooperate with any investigation,” the Globe reported.

Fairfax spokeswoman Lauren Burke told the paper the lieutenant governor did not sexually assault Tyson or anyone else (a second accuser also came forward after Tyson’s allegation made it into the mainstream media). She also said Fairfax would cooperate with any investigation, as he had previously called for one himself. Fairfax had asked the FBI to investigate the claims.

If Tyson did file a police report, Burke said, Fairfax might file a counter complaint, alleging Tyson made a false accusation.

“In that event, the lieutenant governor will explore all options with regard to filing his own criminal complaint in response to the filing of a false criminal complaint against him.”

Tyson claims she met Fairfax at the Democratic convention in 2004 and felt comfortable enough with him to go to his hotel room while he picked up some documents. There, she says, he started kissing her, which was consensual, but he then forced her to perform oral sex on him.

Tyson says she never spoke to Fairfax after this encounter. Fairfax says she kept in touch with him for months after.

Meredith Watson recently accused Fairfax of raping her in college while they were Duke University undergraduates. Fairfax has adamantly denied both women’s’ claims.

Many Democrats have called on Fairfax to resign, but over the past week have not continued pressure on him to do so. These Democrats also demanded Northam resign initially, but have since abandoned that pressure as well, after Virginia Attorney General Mark Herring, also a Democrat, admitted that he, too, dressed in blackface in college. If all three politicians were to resign, the Republican House Speaker would move up to governor, something Democrats obviously don’t want.
