As I wrote yesterday, the Democrats on the Judiciary Committee made complete fools out of themselves on the first day of Supreme Court confirmation hearings for Judge Neil Gorsuch. From openly lamenting the lost nomination of Judge Merrick Garland to defending the abomination known as the administrative state, Senate Democrats kept displaying their worst arguments and nonsensical views regarding the Constitution of the United States, federal law, and the supremacy of their feelings and their left-wing agenda.
Below are five more gloriously embarrassing moments from Democrats at Tuesday’s hearings:
1. Sen. Dianne Feinstein (D-CA) Failed Miserably In Trying To Outsmart Gorsuch On Heller
To no one’s surprise, Senator Feinstein hates the Second Amendment, and she made that abundantly clear yesterday. She interrogated Judge Gorsuch on his opinion of District of Columbia v. Heller, the landmark Second Amendment case that upheld the individual’s right to keep and bear arms. Justice Antonin Scalia wrote the majority opinion. In her line of questioning, Feinstein attempted to get Gorsuch to say whether he personally agreed with the decision. Gorsuch responded that it was not his responsibility to show whether he liked the law or not. Instead, his role as a judge was to determine what the law was and Heller sets the standard.

2. Sen. Dick Durbin (D-IL) Stepped On A Rake Trying To Pin Gorsuch As A Sexist
The senior Senator from Illinois acted upon his promise to address a debunked letter written by a former student of Judge Gorsuch at University of Colorado Law School that accused Gorsuch of making the argument during his legal ethics class that women often manipulate maternity leave benefits. Durbin’s question attempted to paint Gorsuch as a sexist, and the judge was having none of it. Not only did Gorsuch clarify the situation that he talked about in class, but he also demonstrated his disgust that women get asked inappropriate questions by employers.

3. Sen. Patrick Leahy (D-VT) Tried Too Hard To Get Gorsuch To Discuss Trump’s Travel Ban
Senator Leahy not only smeared the Federalist Society and the Heritage Foundation as “far-right” organizations, but also attempted to get Gorsuch to discuss President Trump’s travel ban that is currently undergoing litigation through the federal courts. Leahy attempted to get Gorsuch to breach judicial independence and to assert his own view of the travel ban in order to question the Gorsuch’s commitment to the First Amendment. Gorsuch did not take the bait, instead emphasizing that the First Amendment protects the free exercise of religion and that he would protect anyone regardless of religious views.

4. Sen. Al Franken (D-MN) Shows He Does Not Understand Administrative Law
The comedian masquerading as a U.S. Senator attempted to pin Judge Gorsuch as cold-hearted for dissenting in a controversial Tenth Circuit Court of Appeals case named TransAm Trucking v. Dept. of Labor. In the case, Gorsuch argued that an administrative body does not possess the constitutional authority to create laws when that power is specifically enumerated to Congress. Franken, who believes that the administrative state should be protected from Steve Bannon, attempted to grill Gorsuch — a Harvard Law School and University of Oxford graduate — on the law.

5. Sen. Elizabeth Warren (D-MA) Tweeted That The FBI Investigation Should Negate Gorsuch’s Confirmation
Sen. Warren is not a part of the Senate Judiciary Committee. However, she sent out a series of unhinged tweets during the confirmation hearings explaining her disgust that Gorsuch is going through the hearing while the FBI is investigating President Trump’s campaign and its supposed connections to Russia.
Neil Gorsuch is up for a lifetime appointment to the Supreme Court from a President whose campaign is under FBI investigation.

By Sen. Warren’s logic, the whole process should be halted while the FBI probes a president she openly despises. This is the same moronic argument that New York Times columnist Charles Blow articulated weeks ago.
The Democrats will continue to make fools of themselves both within the chambers of the Judiciary Committee and on social media when it comes to Judge Gorsuch. It is becoming increasingly clear that the Democrats’ strategy to smear Gorsuch is failing miserably. It was such a failed effort that Democratic National Committee chairman Tom Perez attempted to divert attention away from the Gorsuch hearing to discuss Trump and the FBI investigation.
First, it’s entirely unacceptable for Donald Trump to place a justice on SCOTUS with his presidency under the cloud of an FBI investigation.

Moving the goal posts is the sign that the Democrats have lost this battle. To his credit, President Trump picked the best candidate to replace Justice Scalia.
