With a little more than a week before Inauguration Day, Vance took aim at the Department of Justice (DOJ) under the leadership of Attorney General Merrick Garland during an interview on &#8220;Fox News Sunday&#8221; with anchor Shannon Bream.

&#8220;I think it&#8217;s very simple,&#8221; Vance replied. &#8220;Look, if you protested peacefully on January the 6th, and you&#8217;ve had Merrick Garland&#8217;s Department of Justice treat you like a gang member, you should be pardoned. If you committed violence on that day, obviously you shouldn&#8217;t be pardoned.&#8221;
He also said: &#8220;And there&#8217;s a little bit of a gray area there. But we&#8217;re very much committed to seeing the equal administration of law. And there are a lot of people, we think in the wake of January the 6th, who were prosecuted unfairly. We need to rectify that.&#8221;
More than 1,500 people have been <a href="https://www.dailywire.com/news/biden-still-aggressively-prosecuting-january-6-defendants-as-pardons-loom" target="_blank" rel="noopener">prosecuted</a> in connection to the U.S. Capitol riot four years ago, according to <a href="https://www.justice.gov/usao-dc/47-months-jan-6-attack-us-capitol" target="_blank" rel="noopener">the DOJ</a>. Many of the defendants pleaded guilty or were found guilty, and several hundred of them were sentenced to prison.

The Associated Press <a href="https://www.pbs.org/newshour/politics/heres-where-jan-6-trials-stand-on-the-fourth-anniversary-of-the-capitol-riot" target="_blank" rel="noopener">says</a> hundreds of defendants &#8220;who did not engage in destruction or violence were charged only with misdemeanor offenses for entering the Capitol illegally,&#8221; while others faced more serious charges related to violence or conspiracy.
Trump <a href="https://www.nbcnews.com/politics/donald-trump/trump-interview-meet-press-kristen-welker-election-president-rcna182857" target="_blank" rel="noopener">told</a> NBC News in December that his team was &#8220;looking at&#8221; the prospect of pardoning January 6 defendants on the first day of his second term.  &#8220;Those people have suffered long and hard,&#8221; Trump said. However, Trump also conceded &#8220;there may be some exceptions&#8221; when it comes to dolling out pardons.
Last week, a federal appeals court gave Garland <a href="https://www.cnn.com/2025/01/09/politics/special-counsel-report-smith-trump/index.html" target="_blank" rel="noopener">permission</a> to release <a href="https://www.dailywire.com/news/trump-prosecutor-jack-smith-resigns-from-doj" target="_blank" rel="noopener">now-former</a> special counsel Jack Smith&#8217;s report volume on his 2020 election interference investigation into Trump, though it <a href="https://abcnews.go.com/US/judge-orders-doj-respond-trump-defendants-allegations-smith/story?id=117585664" target="_blank" rel="noopener">remained unclear</a> as of press time whether such a disclosure will ultimately get blocked.

A federal judge in Florida has temporarily blocked the expected release of special counsel <a href="https://www.dailywire.com/topic/jack-smith">Jack Smith</a>&#8216;s final report, a victory for <a href="https://www.dailywire.com/topic/donald-trump">Donald Trump</a> and his allies in the final weeks before the president-elect starts his second White House term.
Smith&#8217;s report must remain undisclosed while the 11th Circuit Court of Appeals considers a challenge from two of Trump&#8217;s former co-defendants in the classified documents case, District Court Judge Aileen Cannon <a href="https://www.documentcloud.org/documents/25480420-cannon-injunction-final-report/" target="_blank" rel="noopener">wrote</a> in an order on Tuesday.
Lawyers for the defendants, Walt Nauta and Carlos De Oliveira, had <a href="https://www.documentcloud.org/documents/25479596-nauta/" target="_blank" rel="noopener">requested</a> a hearing on an emergency motion to argue against the release of certain materials while contending an &#8220;unchecked release&#8221; would result in &#8220;prejudice&#8221; against them.
&#8220;Defendants are strictly precluded from refuting the Report,&#8221; their filing on Monday warned. &#8220;The Final Report is meant to serve as a Government verdict against the Defendants contrary to all criminal justice norms and constitutional guideposts.&#8221;
Cannon, a Trump appointee, <a href="https://www.dailywire.com/news/judge-dismisses-trump-classified-documents-case" target="_blank" rel="noopener">dismissed</a> the <a href="https://www.nbcnews.com/politics/donald-trump/appeals-court-agrees-dismiss-trumps-classified-documents-case-rcna181942" target="_blank" rel="noopener">classified documents</a> case last summer. Smith appealed the decision but dropped the challenge after Trump won the 2024 election. However, the appeal with regard to Nauta and De Oliveira remains active.

The defendants&#8217; <a href="https://www.documentcloud.org/documents/25479596-nauta/" target="_blank" rel="noopener">filing</a> included a letter from Trump&#8217;s attorneys to Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> requesting he not go along with Smith&#8217;s bid &#8220;to disseminate an extrajudicial &#8216;Final Report&#8217; to perpetuate his false and discredited accusations.&#8221;
Smith, who is <a href="https://www.nytimes.com/2024/11/13/us/politics/jack-smith-special-counsel.html" target="_blank" rel="noopener">reportedly</a> stepping down from the Department of Justice before Trump is inaugurated on January 20, had responded to Nauta and De Oliveira&#8217;s motion by confirming a two-volume &#8220;confidential report&#8221; was being finalized.
The filing from the special counsel <a href="https://x.com/kyledcheney/status/1876599874193604836" target="_blank" rel="noopener">said</a> that one of the volumes pertains to the documents case, and it would not be sent to Garland before 1 p.m. on Tuesday. Smith also said Garland would not release the volume to the public, if at all, before Friday.
POLITICO&#8217;s Kyle Cheney <a href="https://x.com/kyledcheney/status/1876632535515689105" target="_blank" rel="noopener">noted</a> earlier on Tuesday that Trump &#8220;is preparing to formally intervene in the effort to block Jack Smith’s report, his codefendants say. And they’re asking the 11th circuit to send the case back to Cannon so she can rule on it.&#8221;
The second volume may deal with Smith&#8217;s abandoned <a href="https://abcnews.go.com/US/special-counsel-jack-smith-moves-dismiss-election-interference/story?id=116207758" target="_blank" rel="noopener">2020 election subversion</a> case in Washington, D.C. District Judge Tanya Chutkan <a href="https://www.dailywire.com/news/judge-chutkan-dismisses-federal-election-charges-against-trump" target="_blank" rel="noopener">dismissed</a> the charges against Trump after the special counsel filed to drop the matter following the 2024 election.

President Joe Biden is reportedly angry that Attorney General Merrick Garland didn’t prosecute President-elect Donald Trump more aggressively.
Biden reportedly said he wished he had picked someone else for the job, The Washington Post <a href="https://www.washingtonpost.com/politics/2024/12/28/bidens-lonely-battle-to-sell-american-democracy/" target="_blank" rel="noopener">reported</a>, citing the president’s complaints about Garland’s prosecution of Trump.
“In private, Biden has also said he should have picked someone other than Merrick Garland as attorney general, complaining about the Justice Department’s slowness under Garland in prosecuting Trump, and its aggressiveness in prosecuting Biden’s son Hunter, according to people familiar with his comments,” the Post reported.
The Post went on to report that Biden’s chief of staff, Ron Klain, pushed for Garland, claiming that as a federal judge, Garland would be seen as nonpartisan in an era when the Department of Justice was viewed as partisan due to its treatment of Trump during his presidency.
But choosing Garland led many in Biden’s circles to believe the department – which prosecuted Trump, his supporters, and pro-life activists – was too centered.
“Biden was persuaded, and some Democrats believe the decision had devastating results,” the Post reported of Biden’s decision to nominate Garland. “Had the Justice Department moved faster to prosecute Trump for allegedly seeking to overturn the 2020 election and mishandling classified documents, they say, the former president might have faced a politically damaging trial before the election.”
“(Others blame the Supreme Court and a Trump-appointed judge in Florida for repeatedly siding with the former president and delaying the cases; the Justice Department declined to comment),” the Post continued.
Trump, as president, had the power to declassify documents as he saw fit, and the Post ignores in this section that classified documents were found in Biden’s garage. As vice president under Obama, Biden had no power to declassify documents and faced no charges for taking them.
In that same Post article, Biden and his aides said they believed the current president would have won re-election if he had stayed in the race instead of dropping out, The Daily Wire <a href="https://www.dailywire.com/news/biden-reportedly-says-he-wouldve-beaten-trump-in-election-wanted-garland-to-go-after-trump-harder" target="_blank" rel="noopener">reported</a>.
Biden dropped out after a dismal debate performance that showed the American people that his health was declining and he could no longer function as president. Instead of holding a democratic vote to find a new candidate, Biden quickly endorsed his wildly unpopular vice president, Kamala Harris. Harris went on to lose the election badly, winning not even a single swing state.

Biden has also reportedly expressed regret that he chose Merrick Garland to serve as attorney general, since Garland apparently did not prosecute Trump quickly enough to substantially hurt him politically, and the AG supposedly showed &#8220;aggressiveness&#8221; in going after Biden&#8217;s son, Hunter.
&#8220;Biden and some of his aides still believe he should have stayed in the race, despite the rocky debate performance and low poll numbers that prompted Democrats to pressure him to drop out,&#8221; a Washington Post <a href="https://www.washingtonpost.com/politics/2024/12/28/bidens-lonely-battle-to-sell-american-democracy/" target="_blank" rel="noopener">report</a> published Saturday said. &#8220;Biden and these aides have told people in recent days that he could have defeated Trump, according to people familiar with their comments, who spoke on the condition of anonymity to describe private conversations.&#8221;
Biden, who had been showing mental decline for years, shockingly dropped out of the race in July after a dismal debate performance against Trump.

If Nixon was more accustomed to television, he wouldn’t have perspired so much, and he would be president when he’d beat Kennedy. I know that sounds silly. But think of the changes taking place. Where do you go? What is true? We have no evidence anymore. I’m not sure how that gets resolved.”

Texas Congressman <a href="https://www.dailywire.com/topic/chip-roy" target="_blank" rel="noopener">Chip Roy</a> demanded Thursday that the FBI and Justice Department preserve all records of its prosecutions of peaceful pro-life protesters across the country.
Roy said in a <a href="https://dw-wp-production.imgix.net/2024/12/2024-12-05-Roy-Biggs-to-Garland-Wray-re-FACE-Act-follow-up.pdf" target="_blank" rel="noopener">letter</a> to FBI Director Christopher Wray and Attorney General Merrick Garland that lawmakers had “serious questions” about the Biden administration’s “weaponization” of the FACE Act, a Clinton-era law that made it a federal crime to block the entrance of an abortion facility. Thursday’s letter, first shared with The Daily Wire, comes after the FBI ignored a <a href="https://www.dailywire.com/news/chip-roy-demands-biden-harris-admin-preserve-records-of-peaceful-pro-lifers-prosecutions" target="_blank" rel="noopener">similar request</a> from Roy in October. 
Roy, the chair of the House Judiciary Committee’s Subcommittee on the Constitution and Limited Government, said that the need to keep records was “imperative” with the outgoing Biden administration and incoming Trump administration. The letter was also signed by Rep. Andy Biggs (R-AZ), the chairman of the Subcommittee on Crime and Federal Surveillance. 
“Congress has a sacred duty to preserve the rights of the American people, including the First Amendment, against any overreach by the Executive Branch,” Roy and Biggs wrote. “As we examine how to best protect Americans’ fundamental freedoms, the Subcommittees must first understand how the DOJ and FBI enforce the FACE Act.”
As written, the FACE Act is meant to protect both churches and crisis pregnancy centers. However, the Biden administration has disproportionately used it to go after pro-lifers despite an increase in targeting of pregnancy centers after Roe v. Wade was overturned. 
“However, since January 2021, the Civil Rights Division has brought a total of 24 FACE Act cases against 55 defendants, with only two of these cases — consisting of five defendants — concerning attacks on pregnancy resource centers,” Roy wrote. “You should construe this preservation notice as an instruction to take all reasonable steps to prevent the destruction or alteration, whether intentionally or negligently, of all documents, communications, and other information, including electronic information and metadata, that are or may be responsive to this congressional inquiry.”

Pro-lifers are imprisoned across the country, including in Washington, D.C.. and <a href="https://www.dailywire.com/news/pro-lifer-spending-thanksgiving-in-prison-grateful-for-opportunity-a-doj-sponsored-mission-trip" target="_blank" rel="noopener">Illinois</a>, after they were successfully prosecuted by the Biden administration under the FACE Act. 
During his time in Congress, Roy has consistently pushed for the FACE Act to be repealed and has introduced legislation to end the law. In a <a href="https://dw-wp-production.imgix.net/2024/10/2024-10-10-Roy-to-Wray-Garland-re-FACE-Act-prosecution-preservation.pdf" target="_blank" rel="noopener">letter</a> first shared with The Daily Wire, Roy called on FBI Director Christopher Wray and Attorney General Merrick Garland to take steps to keep all documentation of their Freedom of Access to Clinic Entrances (FACE) cases. The FACE Act is a Clinton-era law that makes it a federal crime to physically obstruct the entrance to an abortion facility. 
Roy, the chairman of the House Judiciary Committee&#8217;s Subcommittee on the Constitution and Limited Government, has long called for the FACE Act to be repealed because of its disproportionate use against pro-lifers. He told Biden administration officials that he remained &#8220;concerned with the Biden-Harris Administration’s continued weaponization of the Freedom of Access to Clinic Entrances (FACE) Act against pro-life Americans.”
“As the Subcommittee continues to conduct oversight over the Department of Justice’s (DOJ) and Federal Bureau of Investigation’s (FBI) enforcement of the FACE Act, serious questions remain about the disparity in prosecutions between Americans supporting life and the violent attacks on pregnancy resource centers that occurred in the wake of the leak of the draft Supreme Court opinion in Dobbs v. Jackson Women’s Health Organization,” Roy wrote. 
Data <a href="https://dailycaller.com/2024/07/30/joe-biden-department-justice-doj-face-act-pro-life-conspiracy-against-rights/">shows that</a> 97% of all FACE prosecutions since the law&#8217;s inception have been against pro-lifers, even though the law was passed to protect churches and pregnancy centers.

Peaceful pro-life protesters across the country, from Tennessee to Washington, D.C., have received prison time in FACE Act cases. Meanwhile, a growing number of crisis pregnancy centers have been attacked in the wake of the Supreme Court&#8217;s overturning of Roe v. Wade. At least 94 centers have been vandalized since the draft of the decision to overturn Roe leaked in May 2022. 
Roy said that the FBI and Justice Department should take steps to retain all documents, communications, and other information, including electronic information, from past, present, and future prosecutions. 
The Biden-Harris administration has frequently paired FACE Act prosecutions with conspiracy against rights charges, a Reconstruction-era measure that was designed to crack down on the Ku Klux Klan. A conviction on the conspiracy charge could carry a penalty of over 11 years in prison and hundreds of thousands in fines.
Efforts to have the FACE Act struck down are underway. The Thomas More Society has filed several appeals to convictions of pro-lifers that are currently making their way through the courts.
“FACE always was about protecting one thing and that was abortion,” Thomas More Society lawyer Steve  Crampton said last month. “Since the Dobbs decision and the overturn of Roe, abortion is no longer recognized as a federally protected right. So FACE is an act without really a purpose.”

In the wake of two attempts on Donald Trump’s life, government officials are hard at work trying to determine why so many assassins are trying to kill a man government officials want dead. In their fearless pursuit of the truth, the Justice Department this week released a letter from the latest would-be killer in which the gunman offered $150,000 to anyone who would finish Trump off.
In an appearance before the news media, Attorney General Merrick Garland said, “I am absolutely appalled that this vicious criminal would offer so much money for what would be fifteen minutes’ work, twenty tops. It’s a very dangerous precedent. After all, just imagine what someone could buy with that much money! Even if you had to lay out, say, 6K for the sniper rifle, you’d still have enough left to buy almost anything you wanted. And boy oh boy, don’t the girls go for a man who flashes that big green? It’s disgraceful that anyone would think loyal Americans would take money to eliminate an existential threat to Democracy.”
The Attorney General went on to tell the news media, “The DOJ will do everything we can to foil the plans of fanatical Trump hating sociopaths, present company excepted.”

Congress, meanwhile, continues its investigation into the security failures that led to the July attempt on Trump’s life in Butler, Pennsylvania. Democrat Chairman of the Homeland Security Committee Senator Gary Peters told reporters, “We are determined to find out how a sniper got on top of a roof only a hundred yards away from Trump with an absolutely perfect line of sight where it should have been almost impossible for him to miss. I mean, really, anyone but a complete incompetent could have made that shot! In any case, we will not rest until we know which faulty radio or local police officer is to blame for the Secret Service’s failure to do their only job. Since Ronald Rowe Jr. arranged security in Butler, he has been promoted to acting head of the Service, so he more than anyone wants to fix the lapses that allowed the shooter to get in a position where, really, how could he miss? It’s absolutely baffling.”
The committee released on-site transcripts of Secret Service Agents during the Butler attack, revealing several lapses in security. The transcripts read in part:

Even with the government making strenuous efforts to uncover something that sounds remotely like the truth, crazy conspiracy theorists continue to spin outlandish explanations for why a man with no motivational paper trail of any kind and no online presence except encrypted foreign bank accounts would first send a sophisticated drone to scout out a presidential appearance and then place himself in a perfect position to take an expert-level shot, which was only thwarted by the hand of God, even though God’s application to the Secret Service had recently been turned down because he’s a white man.

On one Right-wing platform, for instance, an anonymous silhouette hailed by conservatives as the “most respected schizophrenic in America,” said that history reveals how a cabal of Jews forced Hitler to use precious resources exterminating them so that he would lose World War II, allowing the few surviving Jews to escape to America where they could nuke the Christians in Nagasaki and seize control of our space lasers so that at long last they could use their unbounded power to cluster together in a country the size of a postage stamp where everyone and his uncle can easily vaporize them. These same Jews are the ones who wanted Trump eliminated because he threatened to foil their mass suicide plan by bringing peace to the region.
Some conspiracy theories are more plausible, however. For instance, it is true that the attempts to assassinate Trump were illegal, anti-Democratic, directed at American dissidents and completely incompetent, so they did bear all the hallmarks of a CIA operation.

District Court Judge Aileen Cannon of Florida agreed with defense attorneys who argued Smith&#8217;s appointment as special counsel by Garland in late 2022 was unconstitutional because it did not involve congressional approval.
&#8220;For more than 20 years I was a federal judge. Do I look like someone who would make that basic mistake about the law? I don&#8217;t think so,&#8221; Garland said during an interview with NBC News that aired on Tuesday.

Smith has already <a href="https://www.dailywire.com/news/jack-smith-appeals-dismissal-of-trump-docs-case" target="_blank" rel="noopener">moved to appeal</a> the ruling. The Eleventh Circuit Court of Appeals, located in Atlanta, has<a href="https://abcnews.go.com/US/court-sets-aug-27-deadline-brief-appealing-trump/story?id=112270892#:~:text=Special%20counsel%20Jack%20Smith's%20opening,Appeals%20for%20the%20Eleventh%20Circuit." target="_blank" rel="noopener"> set an August 27 deadline</a> for the special counsel to file an opening briefing.
&#8220;Our position is that it’s constitutional and valid. That&#8217;s why we appealed,&#8221; Garland said. &#8220;I will say that this is the same process of appointing special counsel as was followed in the previous administration.&#8221;
He mentioned special counsels John Durham and Robert Mueller as examples and emphasized the trend stretches back further &#8220;over the decades going back to Watergate and the special prosecutor in that case&#8221; in the 1970s.
&#8220;Til now every single court, including the Supreme Court, that has considered the legality of a special counsel appointment has upheld it,&#8221; Garland said.
Cannon, who was nominated to her position by Trump, said that she was dismissing the case because Smith’s appointment violated the Appointments Clause of the U.S. Constitution.
Cannon <a href="https://www.dailywire.com/news/judge-dismisses-trump-classified-documents-case">wrote</a> that the clause &#8220;is a critical constitutional restriction stemming from the separation of powers, and it gives Congress a considered role in determining the propriety of vesting appointment power for inferior officers.&#8221;
She added, &#8220;The Special Counsel’s position effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers.&#8221;
Trump, who is running another campaign for the presidency while facing multiple criminal matters, had pleaded not guilty to dozens of charges related to willful retention of classified documents and obstruction.
The former president <a href="https://truthsocial.com/@realDonaldTrump/posts/112791026080012056" target="_blank" rel="noopener">responded</a> to Cannon&#8217;s ruling by saying on Truth Social, &#8220;This dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts.”
Trump has contended with three other prosecutions while on the 2024 campaign trail, including a 2020 election case led by Smith in Washington, D.C. He is seeking to <a href="https://www.dailywire.com/news/judge-approves-delay-for-trump-sentencing-after-supreme-court-immunity-ruling" target="_blank" rel="noopener">overturn</a> the <a href="https://www.dailywire.com/news/verdict-trump-found-guilty-on-all-charges-in-hush-money-case" target="_blank" rel="noopener">conviction</a> in a New York hush-money case.

On Thursday, the GOP-led <a href="https://www.dailywire.com/topic/u-s-house-of-representatives" target="_blank" rel="noopener">House</a> shot down an effort to use its rarely-employed inherent contempt power against Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> for refusing to share audio from the classified documents probe against President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>.
Four Republicans and 206 Democrats <a href="https://clerk.house.gov/Votes/2024353" target="_blank" rel="noopener">voted</a> against the <a href="https://www.congress.gov/bill/118th-congress/house-resolution/1344/text" target="_blank" rel="noopener">resolution</a>, which sought to fine Garland $10,000 a day until he stopped defying a subpoena for the tapes, while 204 Republicans and no Democrats supported it. Twelve Republicans and seven Democrats did not vote.
The lawmakers who <a href="https://x.com/ChadPergram/status/1811423920571949233" target="_blank" rel="noopener">broke ranks</a> included Dave Joyce (R-OH), Mike Turner (R-OH), Tom McClintock (R-CA), and John Duarte (R-CA).
Rep. Anna Paulina Luna (R-FL), who introduced the resolution, said she planned to try again in the future. &#8220;Republican bills went down today. We will bring the vote back to the Floor with legislative appropriations when Members are here,&#8221; she <a href="https://x.com/RepLuna/status/1811421210678604049" target="_blank" rel="noopener">said</a> in a post to X.
The congresswoman <a href="https://www.dailywire.com/news/luna-plans-to-call-up-vote-on-empowering-house-sergeant-at-arms-to-detain-garland" target="_blank" rel="noopener">previously floated</a> a resolution to hold Garland in inherent contempt of Congress that would have empowered the <a href="https://www.dailywire.com/topic/u-s-house-of-representatives" target="_blank" rel="noopener">House</a> sergeant-at-arms to detain the Biden Cabinet official until he complied with the subpoenas, but Luna ultimately <a href="https://x.com/realannapaulina/status/1806756081684693072" target="_blank" rel="noopener">opted</a> to go with the fines.

House Republicans subpoenaed Garland for the tapes in a standoff with the Department of Justice, which <a href="https://bentkey.namely.com/users/login" target="_blank" rel="noopener">claimed</a> that sharing the audio with Congress would impede future investigations. Meanwhile, Democrats argued that their GOP colleagues&#8217; actions were tainted by politics.
Lawmakers managed to obtain transcripts of the interviews, but Republicans insisted that they still needed the audio to conduct oversight and pushed forward with regular contempt of Congress proceedings, even after Biden asserted executive privilege over the tapes.
The House voted in June mostly along party lines — with Joyce as the <a href="https://www.dailywire.com/news/sole-republican-to-oppose-garland-contempt-explains-vote" target="_blank" rel="noopener">one GOP defector</a>— to hold Garland in contempt, after which the Judiciary Committee <a href="https://www.dailywire.com/news/house-republicans-sue-for-access-to-audio-tapes-of-biden-classified-documents-probe-interview" target="_blank" rel="noopener">sued</a> Garland on July 1, asking a D.C. federal court to overrule executive privilege assertion and make Garland produce the tapes.
Biden is increasingly facing a crisis of confidence among Democrats after the 81-year-old appeared confused and lost his train of thought during his debate against former President Donald Trump a little more than two weeks ago, but so far has refused to bow out of the race.

The GOP-led House Judiciary Committee sued Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> on Monday, requesting that a judge order the audio of President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>’s interview with Special Counsel Robert Hur be released. 
Earlier this year, the Biden administration asserted executive privilege to block release of the audio of the two-day interview in which Hur pressed the president over his handling of classified documents. The <a href="https://judiciary.house.gov/sites/evo-subsites/republicans-judiciary.house.gov/files/evo-media-document/Audio%20subpoena%20as-filed%20complaint.pdf?_gl=1*hemqeb*_ga*MTQ5OTU4ODcxNS4xNzE5NDk1MzEz*_ga_1818ZEQW81*MTcxOTg1OTIzMi4xLjEuMTcxOTg1OTIzNC4wLjAuMA.." target="_blank" rel="noopener">lawsuit</a> from the Judiciary Committee says Biden&#8217;s assertion of executive privilege is “frivolous” and the audio of the interviews is important for lawmaker’s inquiry into the Justice Department’s handling of the Biden documents investigation. 
“The Committee thus needs those recordings to assess the Special Counsel’s characterization of the President, which he and White House lawyers have forcefully disputed, and ultimate recommendation that President Biden should not be prosecuted,” the suit says.
Hur recommended no charges for Biden despite the fact he found Biden improperly retained classified documents while out of office, noting his team found that Biden struggled to remember the dates his son died or when he was vice president. 
A jury would view Biden, who is now 81, as “a sympathetic, well-meaning, elderly man with a poor memory,&#8221; Hur&#8217;s report <a href="https://www.dailywire.com/news/special-counsel-biden-has-significantly-limited-memory-didnt-remember-when-he-was-vp-or-when-son-died" target="_blank" rel="noopener">concluded</a>.
The House Judiciary Committee suit asks the U.S. District Court for the District of Columbia to overrule the assertion of executive privilege and make Garland produce the tapes. House lawmakers say the audio will provide important verbal and nonverbal context missing from the transcripts of the interview that have been made available.

&#8220;That verbal and nonverbal context is quite important here because the Special Counsel relied on the way that President Biden presented himself during their interview — ’as a sympathetic, well-meaning, elderly man with a poor memory’ — when ultimately recommending that President Biden should not be prosecuted for unlawfully retaining and disclosing classified information,&#8221; the suit says.
&#8220;The audio recordings, not the cold transcripts, are the best available evidence of how President Biden presented himself during the interview,” the suit adds.

Luna posted a photo to X on Monday showing a hand holding a stack of envelopes and stating that her team was delivering a letter to every other House Republican.
In the letter, which has been <a href="https://x.com/RepLuna/status/1805279017609601368" target="_blank" rel="noopener">shared</a> online, Luna said she plans to call up her resolution to hold Garland in inherent contempt of Congress in &#8220;the next few days.&#8221;
&#8220;The urgency of this situation cannot be overstated,&#8221; Luna wrote in the missive. &#8220;Our ability to legislate effectively and fulfill our constitutional duties is at stake.&#8221;

Speaker Mike Johnson (R-LA) <a href="https://abcnews.go.com/US/wireStory/justice-department-prosecute-garland-contempt-refusal-provide-audio-111134793" target="_blank" rel="noopener">has vowed</a> to take legal action as the next step, but Luna is not waiting around to see whether a court battle will produce results.
Luna&#8217;s <a href="https://luna.house.gov/posts/breaking-rep-luna-introduces-resolution-to-hold-attorney-general-merrick-garland-in-inherent-contempt-of-congress" target="_blank" rel="noopener">resolution</a>, if enacted, could lead to the House sergeant-at-arms <a href="https://www.politico.com/live-updates/2024/05/16/congress/garland-contempt-vote-00158433" target="_blank" rel="noopener">taking Garland into custody</a> if the attorney general continues to defy the subpoenas.
It would be the first time one of the chambers of Congress has used its inherent contempt powers <a href="https://www.washingtonpost.com/news/politics/wp/2018/01/18/congress-ability-to-twist-arms-is-limited-unless-it-wants-to-arrest-bannon-itself/" target="_blank" rel="noopener">to hold</a> someone <a href="https://www.usnews.com/news/national-news/articles/2024-06-11/what-is-contempt-of-congress-and-why-does-it-matter#:~:text=The%20third%20option%20is%20a,1934%20under%20the%20Hoover%20administration." target="_blank" rel="noopener">since 1934</a> during the Hoover administration.
Lawmakers got transcripts of the interviews but Republicans say they need the audio for oversight purposes. Democrats claim their GOP colleagues are motivated by politics.
Fox News reported Garland <a href="https://x.com/ChadPergram/status/1804268648216887592" target="_blank" rel="noopener">reached out</a> to moderate Republicans, pressing them to reject Luna&#8217;s effort. There may be an attempt to table the measure before it gets a final vote.
Rep. Dave Joyce (R-OH) is the <a href="https://www.dailywire.com/news/sole-republican-to-oppose-garland-contempt-explains-vote" target="_blank" rel="noopener">sole member</a> of the House GOP who broke ranks and joined with Democrats in voting against holding Garland in contempt earlier this month.
“As a former prosecutor, I cannot in good conscience support a resolution that would further politicize our judicial system to score political points,” he said in a statement.
Joyce added, &#8220;The American people expect Congress to work for them, solve policy problems, and prioritize good governance. Enough is enough.&#8221;

The following is an edited transcript of an interview between Daily Wire editor-in-chief John Bickley and Texas Congressman Dan Crenshaw (R-TX) on a <a href="https://www.dailywire.com/podcasts/morning-wire/dan-crenshaw-s-crusade-against-ideological-persecution-saturday-extra" target="_blank" rel="noopener">Saturday Extra edition of Morning Wire</a>.
The Biden administration’s prosecution of a Texas doctor who blew the whistle on transgender procedures being conducted on children in the state has sparked accusations of political and ideological persecution. We spoke with U.S. congressman from the state of Texas, Republican Dan Crenshaw, about what actions he and his colleagues are taking on the issue of child transgender medical procedures and what they say is the weaponization of the federal government.
JOHN: Joining us now is Republican Congressman Dan Crenshaw of Texas. Congressman, thank you for coming on. Let&#8217;s start with the prosecution of <a href="https://www.dailywire.com/news/a-doctor-blew-the-whistle-on-his-hospitals-transgender-clinic-now-the-feds-are-trying-to-ruin-his-life" target="_blank" rel="noopener">Dr. Eithan Haim</a>. He worked at the Texas Children&#8217;s Hospital in your district. He&#8217;s <a href="https://www.dailywire.com/news/how-the-doctor-at-the-center-of-latest-texas-childrens-hospital-scandal-built-an-alliance-with-transgender-activists?topStoryPosition=1" target="_blank" rel="noopener">being prosecuted</a> after blowing the whistle on the hospital because it was continuing to perform transgender procedures on children, even after the Texas AG said that practice is dangerous. You believe this is a political prosecution. Why?
DAN: Well, I believe it&#8217;s political because it&#8217;s unusual for the DOJ and HHS to bring somebody up on criminal charges for HIPAA violations. And if you look at what they&#8217;re really charging him with, it&#8217;s a stretch to say it&#8217;s even a HIPAA violation. So they&#8217;re charging him for unlawful access to the database, but of course he has access to that database, to patient data. He did not release any personal information on those patients. He anonymized any data he released. So you have to squint really hard to see this as a HIPAA violation and to justify federal agents arresting him for doing this. This is the kind of thing where you might think Texas Children&#8217;s might have a civil case against him for it, and they would go to the courts as such, and there might be a fine involved, right? That&#8217;s what you would normally expect from this. But these are criminal charges being brought against him for accessing a database that he has perfectly lawful access to. Of course it&#8217;s political because this is such a politicized topic. This is the topic of affirmative transgender care on minors. It&#8217;s pretty contentious, I&#8217;ve noticed, because I&#8217;ve introduced legislation in the Congress and watched even my most moderate, reasonable Democrats throw their hands up like crazy people and argue with me that it should be okay to do a double mastectomy on a 12-year-old girl just because she thinks she&#8217;s a boy. So, hyper-politicized.
JOHN: We&#8217;ve seen the Biden administration prioritize this issue in a way that we&#8217;ve never seen another administration do. What do Republicans need to do if they want to counter the Democrat agenda on this?
DAN: Conservatives need to fight back against it. Now, in Texas, shortly after this whistleblower blew the whistle on Texas Children&#8217;s Hospital, Texas passed SB14, which prohibits this practice entirely. Then, there was no question. After that, I think it can be said that all the hospitals in Texas stopped doing these procedures because it was made in law. Prior to that – and what Dr. Haim was referencing when he blew the whistle – was an opinion from the Attorney General. So the Attorney General issued an opinion, which is a fairly normal thing to do, saying, look, we&#8217;ve looked into this, our interpretation of the laws based on child abuse laws says that you cannot do this practice. So, hospitals are taking a risk at that point if they move forward because they could be prosecuted by the Attorney General because he&#8217;s made it clear what the interpretation is of that law. And then again, shortly afterwards the law was made extremely clear: You cannot do this in Texas.
JOHN: Then we have the Title IX changes, which do directly address gender identity and make this something for all publicly funded educational programs.
DAN: Yes, I have a new daughter now, she&#8217;s nine-months-old and God help the people who try to put a boy in whatever sport she wants to play. There&#8217;s not enough wrath for them. We have to fight this and the public is on our side — the public is on our side on all of these issues. We saw a Washington Post survey some time ago that asked the public, ”Do you support puberty blockers or hormone therapy for minors for a gender transition?” They didn&#8217;t even ask about surgeries, by the way – just asked about those two things. 70% said no. This practice of affirmative gender care is being rolled back in Europe. They&#8217;re seeing how the data just doesn&#8217;t add up. The recent systematic review by Dr. Cass from the U.K. really was the final nail in the coffin on this practice. After reviewing all of the data and all of the studies and all of the methodology behind each study, it showed that this practice just doesn&#8217;t come with any benefits, but it does come with enormous risks. And that&#8217;s a really big problem. These are huge long-term physiological changes, and if we can&#8217;t even point to any benefits from doing them – well, then we&#8217;ve got a problem on our hands.

JOHN: Indeed. I want to talk about some actions you&#8217;ve taken related to this. First, you sent a letter to Attorney General Merrick Garland and Health and Human Services Secretary Javier Becerra, demanding all documents regarding the prosecution of Haim. In the letter, you say the prosecutor did not even review the evidence before considering him a target. Is that true?
DAN: That&#8217;s true, as far as we know. That&#8217;s from Dr. Haim&#8217;s lawyers and I don&#8217;t think they would make that claim if they didn&#8217;t have some sort of proof. Again, showing how politicized this is. I mean, they see a case like this and they say, “Let&#8217;s go, let&#8217;s go! Boom, boom, boom.” And they start shooting in the air and hooping and hollering and driving off into the sunset. That&#8217;s yet another reason we think this is politicized. This kind of thing should not be done lightly.
JOHN: Do you expect AG Garland to actually cooperate? He&#8217;s been pretty uncooperative so far with Congress. Do you feel like he&#8217;s going to stonewall again?
DAN: Absolutely. I don&#8217;t expect real answers to this. They&#8217;re going to come back and claim — if they even bother to respond— that it&#8217;s an active investigation and that they can&#8217;t possibly share records or any information about it. I have another piece of legislation, which I think would be quite helpful in this. I&#8217;ve been urging the Speaker to take it up because it&#8217;s already passed out of our committee on energy, and my legislation would actually prohibit funding the children&#8217;s hospitals around the nation, specifically for Graduate Medical Education (GME), which basically funds their residencies. It&#8217;s a federal program that helps fund residencies and hospitals. A good program we all like, but I don&#8217;t think you should have access to that kind of federal money if you are engaging in child abuse and bullying parents into “transitioning” their kids. So, again, the public is well behind us on this. I want to have that debate on the floor and get that moving.
JOHN: And that would block funds from going to that program if you did that, if you promoted transgender treatments and procedures for children.
DAN: Right. Your access to that federal money would be contingent on whether or not you perform those kinds of procedures.
JOHN: Final question: We&#8217;ve seen quite a few seemingly political prosecutions by government agencies, against Donald Trump and many of his attorneys — John Eastman, Rudy Giuliani — and even peaceful pro-life objectors. What do you make of what Jim Jordan calls a “weaponized” government?
DAN: Well, look we even created a subcommittee on Jordan&#8217;s Judiciary Committee to deal with this called the Weaponization of Government Select Committee. Obviously it&#8217;s something we take seriously as Republicans, and we&#8217;re not crazy. I&#8217;m the first to call out my own side when people are overreacting or going down some rabbit holes they shouldn&#8217;t go down. But this isn&#8217;t really one of them. There is a list of these prosecutions and they are out of the ordinary. We obviously just talked about this one, which is just simply out of the ordinary. Anything wildly out of the ordinary in the court of law should be looked at with some skepticism and you should note that there might be political bias there. The charges against Trump – I still haven&#8217;t heard one real good lawyer actually come out and say, “No, these are actually real charges, somebody else might get charged with this kind of thing.” Nobody has said that. Everybody knows they&#8217;re bogus. And the list goes on and on, and it&#8217;s ironic because the Democrats are constantly wringing their hands and clutching their pearls — that were probably donated to them by rich people in Hollywood. And they&#8217;re constantly wringing their hands about the “threats to democracy.” Well, one of the greatest threats to democracy is the upending of the sanctity of our judicial system. And if you don&#8217;t believe you can get a fair shot in a court of law, you do start to lose your democracy. That&#8217;s a huge part of our social contract, of our nation&#8217;s fabric that holds us together. This idea that there&#8217;s due process, that if you make the right arguments and you show the right evidence that you can prevail. If that turns out not to be the case, you&#8217;ve got a very, very serious problem on your hands, just from a basic civics perspective.
JOHN: A very troubling prospect, no doubt. Congressman, thank you so much for joining us.
