A Christian evangelist&#8217;s battle with a Mississippi city over street preaching took center stage at the Supreme Court on Wednesday as the justices heard arguments that could have far-reaching consequences for Americans who want to defend their constitutional rights in federal court. 
The case <a href="https://www.supremecourt.gov/qp/24-00993qp.pdf">revolves</a> around whether 33-year-old Gabriel Olivier can challenge an ordinance from Brandon, Mississippi, that restricted street preaching in a public park outside of a local amphitheater. Olivier, who was convicted in 2021 of street preaching outside of the designated area, is now attempting to overturn the ordinance on First Amendment grounds. 
“This is a really important case,  for Christians specifically, because I noticed that all around the country, there&#8217;s always an exercise of free speech [that] does not seem to be cracked down on the way that Christians&#8217; free speech is nowadays,” Olivier told The Daily Wire in an interview. 
The city of Brandon argues that Olivier cannot challenge the ordinance in federal court because he has previously been convicted of violating it. Olivier says that he doesn’t want to revisit the 2021 conviction, for which he paid a fine, but wants to protect his right to share his faith in the future. 
During oral arguments on Wednesday, the justices seemed sympathetic to Olivier’s arguments that he should be able to seek relief in federal court despite his previous conviction. Nate Kellum, a lawyer with First Liberty Institute representing Olivier, told The Daily Wire that he was encouraged by the questions he heard from the justices. 
Kellum said that all he wants is for Olivier to have his day in court to argue against the ordinance and make an appeal for his First Amendment rights. 
“Everybody, regardless of their ideology and their belief, deserves their day in court,” Olivier said. “We&#8217;re just asking that people would continue to pray for us.”
The Trump administration is <a href="https://www.justice.gov/crt/media/1414041/dl">supporting</a> Olivier’s petition, as are a number of other conservative organizations. 
The ordinance implemented by Brandon, a suburb east of Jackson, restricts protest activity in the park surrounding the city&#8217;s amphitheater to a designated area when events are being held. 
“What the ordinance does is it puts him in a place where no one can hear him,” Kellum told The Daily Wire. “You can&#8217;t have a conversation.  You can&#8217;t hand out literature. If he preaches, he cannot be heard, and if he held up a sign, no one could read it. And so that seemed to be the whole idea, is that the city wanted to pass a law that separated him from his would-be audience.”

The city and some legacy outlets have attempted to suggest that Olivier shouted rude or inappropriate things during his previous outings at the park. 
“It&#8217;s patently false. And it seems to be an attempt to try to malign Gabe, malign his character,” Kellum said. “But if Gabe or really anyone else would say anything that would amount to fighting words or could be something that could lead to an altercation, there&#8217;s disorderly conduct ordinances.”
Olivier first went to the park in 2019, where he had productive conversations about his faith with others. But when he returned in 2021, the city had passed an ordinance against such evangelism. His passion for street evangelism comes from his own conversion ten years ago when he encountered a street preacher. 
“I see it very clearly as a command in scripture,” he said. “And so I choose to do that and exercise the rights that we have enjoyed here in America. And we would like for an opportunity to continue to fight for those rights to be upheld.”
Todd Butler, the attorney representing Brandon, said in a statement to The Daily Wire: &#8220;The City of Brandon was excited to present its position to the Court. The case before the Supreme Court is not about the constitutionality of the ordinance or religious expression. It is about whether a person who has been found guilty in criminal court may undermine his conviction through a civil tort lawsuit. The importance of this case cannot be overstated as it will impact cities across the country.&#8221;

Over two dozen Republican senators are backing an effort from Texas Senator John Cornyn to toughen the punishment for criminals who violently attack enforcement officers, The Daily Wire has learned. 
On Thursday, Cornyn will introduce the “Back the Blue Act” to increase the penalties for murdering or attempting to murder law enforcement while also expanding self-defense rights for police officers. The proposal has significant support from fellow Republicans, with over 31 signing on to co-sponsor.
“Our law enforcement officers bravely risk their lives daily to protect our communities, and anyone who targets them should be met with the full force of the law, including the death penalty,” he told The Daily Wire. “America was built on the principles of law and order, and this legislation sends a clear message that targeted attacks on law enforcement will not be tolerated, dangerous criminals will be held accountable, and our men and women in blue have our full and unwavering support.”
The legislation would create a new federal crime for killing or attempting to kill a federal judge, a federal law enforcement officer, or other federally funded public safety officer. If an officer dies, the murderer would be subject to the death penalty and a mandatory 30 years in prison, according to Cornyn’s office. The proposal would make attempted murder or murder an aggravating factor when considering the death penalty as well. 
Penalties for assaulting federal law enforcement would also increase, as would the punishment for fleeing across state lines to avoid prosecution for attacking law enforcement.  The proposal would also impose time limits on when a federal court can review the state-level conviction of someone who murdered a police officer in the line of duty. 
Law enforcement officers would also be given the ability to carry their firearms into federal facilities and other areas where gun possession is typically restricted, according to Cornyn’s office.

The legislation is backed by major law enforcement organizations like the Fraternal Order of Police, National Association of Police Organizations, Federal Law Enforcement Officers Association, Major County Sheriffs of America, National Narcotic Officers’ Associations’ Coalition, Association of State Criminal Investigative Agencies, and the Sergeants Benevolent Association of the NYPD.
Cornyn’s proposal of the bill comes as he faces a contentious GOP primary challenge from Texas Attorney General Ken Paxton and U.S. Rep. Wesley Hunt.

A suspect tied to the planting of pipe bombs outside of the Republican and Democratic Party headquarters the night before January 6 has been arrested by the FBI, according to multiple reports.
The arrest comes over five years after the incident, which has long puzzled investigators. ABC <a href="https://abcnews.go.com/US/suspect-arrested-jan-6-pipe-bomb-case-sources/story?id=128093323&amp;cid=social_twitter_abcn&amp;utm_social_post_id=614147440&amp;utm_social_handle_id=28785486">reported</a> that the suspect is a Virginia man. The suspect&#8217;s identity has not been released, and it is not clear what charges he may face. The Daily Wire reached out to the FBI for more information.
NBC News <a href="https://www.nbcnews.com/politics/politics-news/suspect-arrested-january-6-dc-pipe-bomb-case-rcna247308">reported</a> that the person in custody was named Brian Cole. The Justice Department is expected to hold a press conference later today on the arrest.
The FBI <a href="https://www.fbi.gov/video-repository/wfo-pipebomb-oct-2025-update-v2.mp4/view">has offered</a> a $500,000 award for any tips that help identify the suspect. Investigators said they believe the suspect to be about 5 feet 7 inches tall. The pipe bombs did not detonate, but the FBI said they could have been deadly. Law enforcement discovered them on January 6.
Rep. Barry Loudermilk (R-GA), the chair of a House January 6 subcommittee, said he wanted a briefing on the arrest. 
&#8220;That would be great if we could, if they were willing to give us more information,&#8221; Loudermilk said. &#8220;But at the same time, you know, the FBI is going to be questioning, and there is an active case that we don’t want to assert anything that they have.&#8221;
Last month, FBI Deputy Director Dan Bongino provided an update on the pipe bomb investigation after criticism over the lack of progress on the case.
&#8220;Despite the multitude of challenges we faced, one of our first initiatives was to aggressively pursue a new strategy to investigate the January 6 pipe bomb, terror attack,&#8221; Bongino said. &#8220;We brought in new personnel to take a look at the case, we flew in police officers and detectives working as TFOs (task force officers) to review FBI work, we conducted multiple internal reviews, held countless in person and SVTC meetings with investigative team members, we dramatically increased investigative resources, and we increased the public award for information in the case to utilize crowd-sourcing leads.&#8221;

FBI Arrests Suspect In January 6 Pipe Bomb Case

Republican Governor Henry McMaster moved to end race-based government contracting in South Carolina and called for lawmakers to take action to codify his executive actions. 
McMaster signed an <a href="https://governor.sc.gov/sites/governor/files/Documents/Executive-Orders/2025-12-03%20FILED%20Executive%20Order%202025-40%20-%20Prohibiting%20Race-Based%20Discrimination%20in%20Government%20Contracting.pdf">executive order</a> on Wednesday calling for state agencies to stop awarding contracts based on race. Under current state law, each state agency is required to propose a budget that awards 10% of spending to minority-owned businesses. 
“Today, I have ordered state agencies to halt all future spending, procurement or contract decisions that are based on race. The state laws requiring these quotas and racial set-asides are unconstitutional and discriminatory. Business with state government should be awarded based on merit and value to the taxpayer,” McMaster <a href="https://x.com/henrymcmaster/status/1996273026841682158">wrote</a> on X. “Senate President Alexander and House Speaker Smith have agreed to lead the effort to repeal these laws when the General Assembly returns next month.”
South Carolina’s Department of Transportation is also required to hand out a minimum of 5% of its awards for certain contracts to minority-owned businesses. 
In his executive order, McMaster said that the state laws mandating race-based contracting “call for unlawful racial discrimination” and that they are policies that “rest on the false assumption that the solution to perceived historical wrongs is to racially discriminate against individuals in the present.” 
McMaster also said that the policies may violate President Donald Trump’s executive actions taking aim at diversity, equity, and inclusion policies.

South Carolina Senate President Thomas Alexander and House Speaker Murrell Smith, both Republicans, said they would move in January to codify the governor’s actions. 
“We are a nation and a state dedicated to the principle that ‘all men are created equal, endowed by their Creator,’ as reflected in the Constitution’s requirement of equal protection of the laws,” Alexander said. “When existing laws no longer align with that constitutional command, it is our duty to correct them. I am confident my colleagues in the Senate share my belief that state government must reflect equality under the law in all its endeavors and ensure our statutes fully comply with the Constitution.”
South Carolina Congressman Ralph Norman <a href="https://x.com/RalphNorman/status/1996286119034454330">praised</a> McMaster’s action and called for the state legislature to pass a “full DEI ban.”
Amid Trump’s war on DEI at the federal level, some lawmakers have turned to the state level to challenge programs that favor minority businesses. In October, Texas <a href="https://www.dailywire.com/news/unless-youre-white-you-qualify-texas-suspends-business-program-that-excludes-white-males">suspended</a> a statewide program that prioritized non-white male businesses in state contracting. 
This was done through the Historically Underutilized Businesses, which received about 11% of state spending total. The total awards given to the businesses are over $4 billion, including $1.45 billion for women-owned businesses and $1.6 billion for Hispanic-owned businesses.

A leftist federal judge appointed by former President Barack Obama issued an order on Tuesday blocking the Trump administration from cutting funding going toward organizations like Planned Parenthood that end the lives of unborn children. 
U.S. District Judge Indira Talwani <a href="https://www.documentcloud.org/documents/26327752-talwanipppi120225/">ruled</a> that the Department of Health and Human Services cannot cut off Medicaid funding going toward Planned Parenthood. Talwani sided with California and other Democrat-led states that sued to keep Medicaid funding flowing to Planned Parenthood affiliates.
Talwani wrote that HHS failed “to provide clear notice as required by the Spending Clause of the United States Constitution” to the Democrat-led states. Medicaid funding for abortion-promoting entities was cut off for one year by a provision of the GOP-backed “Big, Beautiful Bill.” 
The U.S. Court of Appeals for the First Circuit previously overturned another <a href="https://www.documentcloud.org/documents/26089904-ppfavkennedyca1091125/">decision</a> from Talwani that sided with Planned Parenthood in a suit over the provision. 
Talwani’s decision was met with criticism from pro-life advocates. 
“The Democrats and their radical activist judges are desperately seeking to thwart the will of the people and bail out the Big Abortion industry, led by Planned Parenthood. The One Big Beautiful Bill Act is federal law passed by Congress and signed by the president,” said SBA Pro-Life America President Marjorie Dannenfelser.
“This fight is not over. The pro-life movement will work tirelessly to ensure the Democrats do not prevail and taxpayers are never forced to pay a dime to prop up Big Abortion businesses,” Dannenfelser added.

The federal judge <a href="https://www.fec.gov/data/receipts/individual-contributions/?contributor_name=Indira+Talwani">donated</a> a total of $1,725 to Democrat politicians and the Democratic Party, including $1,000 to former Sen. John Kerry (D-MA), $350 to Sen. Elizabeth Warren (D-MA), and $100 to Obama. Talwani also gave another $275 to the Democratic National Committee.
Talwani explained on her Senate questionnaire that she also volunteered to knock on doors for Obama in 2008 and volunteered to canvass on behalf of Elizabeth Warren in 2012. 
She has sided against the Trump administration in other rulings, including decisions to revoke Temporary Protected Status for half a million migrants, and a 2019 ruling said Immigration and Customs Enforcement was allowed to arrest illegal aliens on courthouse grounds in the state of Massachusetts.

A 54-year-old man has been arrested after carrying out a self-described “terrorist attack” by throwing Molotov cocktails at security officers outside of a federal building in California that houses Immigration and Customs Enforcement offices, the Justice Department said Tuesday. 
Jose Francisco Jovel was accused by federal investigators of carrying out the attack on Monday at a building in Los Angeles that houses Immigration and Customs Enforcement offices. Investigators say that the attack was motivated by opposition to the Trump administration’s crackdown on illegal immigration. 
“This case exemplifies how misleading and hateful rhetoric against federal law enforcement can and does result in violence,” said First Assistant United States Attorney Bill Essayli. “Irresponsible rhetoric by politicians and activists have real-world consequences. It must stop.”
Jovel, who lives in Koreatown, has been charged with attempted malicious damage of federal property and is expected to appear in federal court on Wednesday.  Essayli said that additional charges may be added. 
On Monday, Jovel rode his bike to the Federal Building located in the Civic Center of downtown Los Angeles hours after lighting his own apartment on fire after being evicted, prosecutors said. He then allegedly threw a Molotov cocktail through a sliding door of an employee entrance to the building before throwing another one into the public door. While the bottles did not catch on fire, investigators say that surveillance footage shows Jovel trying to light one of the devices on fire. 
Jovel was then arrested by federal officers who found five more Molotov cocktails and a lighter in his possession, investigators say. He was also found with knives and was making anti-ICE comments, according to federal law enforcement sources. 
Officers reported hearing Jovel say he was motivated by his anger at the Trump administration’s immigration policies. He allegedly referred to his actions as “a terrorist attack” and told officers, “you’re separating families,” before urging nearby people to “start shooting these” officers. The attack prompted the building&#8217;s lobby to be shut down for the investigation.

If convicted, Jovel will face a minimum of five years in prison and a maximum of 20 years. 
“There can be zero tolerance for any targeting of law enforcement officials – let alone violent acts – and we’re lucky that the devices allegedly thrown by the subject did not physically injure anyone,” said Akil Davis, the Assistant Director in Charge of the FBI’s Los Angeles Field Office. “The FBI’s Joint Terrorism Task Force is dedicated to investigating and holding accountable anyone who conducts targeted attacks against government employees.”
The Department of Homeland Security said that Jovel has a criminal history that includes arrests for attempted murder in 1987, robbery with a firearm in 1991, and molesting a victim under the age of 18 in 2007, Fox 11 <a href="https://www.foxla.com/news/man-arrested-throwing-molotov-cocktails-downtown-la-federal-building?taid=692f616f5c98af00010fe8c3&amp;utm_campaign=trueanthem&amp;utm_medium=trueanthem&amp;utm_source=twitter">reported</a>.

The Trump administration on Tuesday took action against six blue states that it says have failed to comply with requests to produce their voter rolls. 
The Justice Department <a href="https://www.justice.gov/opa/pr/justice-department-sues-six-additional-states-failure-provide-voter-registration-rolls">announced</a> suits against Delaware, Maryland, New Mexico, Rhode Island, Vermont, and Washington for not producing statewide registration lists. Without these lists, the Justice Department said that they cannot certify that the states are maintaining an accurate count of eligible voters. 
&#8220;Accurate voter rolls are the cornerstone of fair and free elections, and too many states have fallen into a pattern of noncompliance with basic voter roll maintenance,&#8221; said Attorney General Pam Bondi. &#8220;The Department of Justice will continue filing proactive election integrity litigation until states comply with basic election safeguards.&#8221;
The suits come amid a push from Republicans nationwide to crack down on non-citizen voting and maintain clean voter registration lists.
The lawsuits say that the states are not acting in accordance with the National Voter Registration Act and the Help America Vote Act, which compel states to maintain accurate voter lists. The attorney general is empowered to enforce those laws and has a right to access the lists under the Civil Rights Act of 1960, the suits say.
&#8220;States that continue to defy federal voting laws interfere with our mission of ensuring that Americans have accurate voter lists as they go to the polls, that every vote counts equally, and that all voters have confidence in election results. At this Department of Justice, we will not stand for this open defiance of federal civil rights laws,” said Assistant Attorney General Harmeet Dhillon.
The <a href="https://www.justice.gov/crt/media/1419811/dl?utm_medium=email&amp;utm_source=govdelivery">lawsuit</a> against Rhode Island says that on September 16 Rhode Island sent a letter to the Justice Department refusing a September 8 request for voter roll information. The letter said that the states “objects to providing” the requested information, according to the suit. This requested information includes driver license information and the last four digits of Social Security numbers used to register for voting.

Rhode Island Attorney General Peter Neronha claimed the suit was an example of Trump weaponizing the Justice Department. 
“We stand with and will defend the secretary, and win, because lawsuits concerning lawful conduct are largely unsuccessful,” he said. “But I’m not surprised that this administration is confused about what it means to behave lawfully.”

Republican Matt Van Epps fended off a challenge from far-Left Democrat Aftyn Behn on Tuesday during a special election for Tennessee’s 7th Congressional District.
With 95% of the vote in, <a href="https://election-night.decisiondeskhq.com/date/2025-12-02">DecisionDeskHQ</a> has called the race for Van Epps 53.9% to 45%. Other outlets followed shortly after.
Van Epps&#8217; victory allows Republicans to breathe a sigh of relief after Democrats surged money and resources into the race, hoping to capitalize on typically low Republican turnout in special elections. A win for Behn in the deep red district would have sent shockwaves throughout the nation. The self-described “radical” community organizer had previously voiced support for burning down police stations and supported transgender surgeries on young children.
The race was scheduled after former Rep. Mark Green announced his resignation earlier this year. Green won the district, which stretches from Tennessee’s borders with Kentucky and Alabama and includes parts of Nashville, by over 20 points.
In recent weeks, money poured into the race as Behn campaigned with Democrat favorites Al Gore and New York Rep. Alexandria Ocasio-Cortez.

Behn had a <a href="https://www.dailywire.com/news/everything-you-need-to-know-for-the-crucial-tennessee-special-house-election?author=Zach+Jewell&amp;category=News&amp;elementPosition=5&amp;row=0&amp;rowType=Vertical+List&amp;title=Everything+You+Need+To+Know+For+The+Crucial+Tennessee+Special+House+Election">fundraising advantage</a> over Van Epps, raising over $1 million between October 1 and November 12 while Van Epps took in $591,000 during that same timeframe. At the same time, the Trump-aligned MAGA Inc spent over $1 million backing Van Epps, while the Democrat-aligned House Majority PAC and Your Community PAC have spent a combined $950,000 supporting Behn.
Behn won a crowded Democratic primary in August despite a history of leftist advocacy out of touch with much of the Volunteer State’s conservative leaning.
She once claimed that <a href="https://x.com/claytravis/status/1993319674352697755?s=42">men can give birth</a>. Behn also said that the murder of six children by a transgender-identifying gunman at the Covenant School in Tennessee made her more sympathetic to “trans communities.” That apparent sympathy <a href="https://www.dailywire.com/news/democrat-aftyn-behn-said-covenant-shooting-made-her-fearful-for-trans-communities">inspired</a> her to “fight the far-right narrative that is being emanated by Matt Walsh and The Daily Wire.”
Behn also <a href="https://www.dailywire.com/news/tennessee-congressional-candidate-backs-trans-procedures-for-kids-campaigns-with-drag-queen">backs</a> transgender procedures on children, draping a trans flag on her back during “Pride” month and writing on social media: “THESE COLORS DON’T BLEED. Remember, you come for my trans community, I come for you.”

In a May 2022 podcast appearance, Behn said she supported the mailing of abortion pills into Tennessee by outside groups. Medication abortions are illegal under Tennessee law.
“We’ll continue to figure out how to get abortion pills to people. So the organizing does not stop just because Roe is overturned,” Behn said.
Last month, Behn <a href="https://www.dailywire.com/news/music-city-fumble-dem-candidate-said-she-hates-city-she-wants-to-represent-in-congress">went viral</a> for comments she made about her hatred of country music and the city of Nashville.
Van Epps also won a crowded Republican primary after earning an endorsement from President Donald Trump. Trump called into a rally for Van Epps featuring Tennessee GOP heavyweights and held a tele-rally on Monday night for the Republican on the eve of the election.

A coalition of pro-life crisis pregnancy centers won a big victory on Monday against New York Attorney General Letitia James over her targeting of organizations that promote a protocol that can help a mother save her child if she regrets taking an abortion pill.
The U.S. Court of Appeals for the 2nd Circuit <a href="https://adflegal.org/wp-content/uploads/2025/12/nifla-v-james-2025-12-01-appellate-opinion.pdf">affirmed</a> that the coalition has a First Amendment right to speak about the abortion pill reversal protocol, a process that is meant for women who want to counter the effects of taking an abortion-inducing drug. In 2024, James <a href="https://ag.ny.gov/press-release/2024/attorney-general-james-sues-anti-abortion-group-and-11-new-york-crisis-pregnancy">sued</a> 11 faith-based pregnancy centers for their promotion of the protocol, claiming they were spreading false and misleading information.
“Many women regret their abortions, and some change their minds after taking the first abortion drug and want to try to save their unborn babies’ lives. They should be allowed to hear about this option and make that choice,” said Caroline Lindsay, a lawyer for Alliance Defending Freedom who represented the coalition in court.
The protocol is a method <a href="https://lozierinstitute.org/abortion-pill-reversal-a-record-of-safety-and-efficacy/">backed</a> by a coalition of pro-life organizations and involves a woman taking a prescribed dose of bioidentical progesterone to potentially reverse the effects of Mifepristone and save an unborn child if she changes her mind at the last minute about going through with the abortion.
The coalition was composed of the National Institute of Family and Life Advocates, Gianna’s House, and Options Care Center. While James did not sue them over the abortion pill reversal protocol, they argued in court that her actions could infringe on their free speech rights. A district court agreed, granting the coalition an injunction against James. The appeals court on Monday upheld that decision.

“The district court correctly determined that the speech at issue is noncommercial because, based on the uncontroverted evidence in the current record, the speech is religiously and morally motivated, the [National Institute of Family and Life Advocates] plaintiﬀs receive no remuneration or other financial benefit for engaging in it, and, as the NIFLA plaintiﬀs do not provide [Abortion Pill Reversal] themselves, the speech serves only to provide the public with information about [Abortion Pill Reversal] and access to third-party providers that can oﬀer [Abortion Pill Reversal],” the judges wrote.
In May 2024, James <a href="https://www.dailywire.com/news/new-york-crisis-pregnancy-centers-pick-up-legal-victory-against-letitia-james">announced</a> a suit against Heartbeat International and 11 pregnancy center organizations for promoting the abortion pill reversal protocol. James claimed that the organization was “spreading dangerous misinformation by advertising &#8216;abortion reversals&#8217; without any medical and scientific proof.”
Heartbeat International says that the lives of over 7,000 babies have been saved through the abortion pill reversal protocol. On Tuesday, the Supreme Court heard oral arguments on whether a Christian pregnancy center can challenge New Jersey over a wide-ranging subpoena it issued related to the protocol.

Supreme Court justices ranging from conservative Clarence Thomas to liberal Elena Kagan pressed the state of New Jersey on Tuesday about its expansive investigation targeting a Christian pro-life crisis pregnancy center. 
The justices heard arguments about whether a Christian pregnancy center can challenge a wide-ranging subpoena from the New Jersey Attorney General Matthew Platkin that demanded donor information. The case hinges on whether the subpoena had the impact of chilling supporters of  First Choice Women’s Resource Centers and is entitled to relief in federal court. 
During oral arguments on Tuesday, many of the justices appeared skeptical of the arguments made by Sundeep Iyer, a lawyer for the state of New Jersey. 
In one exchange, Justice Thomas pushed Iyer on why the subpoena was issued to First Choice. 
“Did you have complaints that formed the basis of your concern about the fundraising activities here?” Thomas asked.
Iyer responded by saying that they had complaints about crisis pregnancy centers in general, but not specifically First Choice. Thomas then suggested that New Jersey had “no factual basis” for believing that the pregnancy center was deceiving donors and that the subpoena was a “burdensome way to find out whether someone has a confusing website.”

Another key question in the case is whether the subpoena could be considered “chilling” because it had not yet been approved by a court. Justice Kagan, one of the court’s liberals, pushed Iyer on that question. 
“I think here, too, you would make the same argument is that an ordinary person, one of the funders for this organization or for any similar organization, presented with this subpoena, and then told, ‘But don&#8217;t worry, it has to be stamped by a court is not going to take that as very reassuring,’” Kagan said. “Why isn’t that right?”
Other justices, including Brett Kavanaugh, Neil Gorsuch, and John Roberts, were also critical of New Jersey’s interpretation of the subpoena it had issued. 
First Choice has centers in five of New Jersey’s largest cities, including New Brunswick, Newark, Morristown, Montclair, and Jersey City. Services include free pregnancy tests, ultrasounds, and options counseling. They also offer a parenting program that provides essential needs such as baby clothes and diapers. 
“This court has long safeguarded the right of association by protecting the membership and donor list of nonprofit organizations like First Choice,” said Alliance Defending Freedom lawyer Erin Hawley. “Yet the attorney general of New Jersey issued a sweeping subpoena, commanding on pain of contempt that First Choice produce donor names, addresses, and phone numbers, so his office could contact and question them. That violates the right of association.”
Platkin first subpoenaed First Choice in November 2023, asking for ten years of documents related to its promotion of the abortion pill reversal, information they provided to clients and donors, personnel records, and copies of every advertisement the centers had run.

President Donald Trump called the special election for former GOP Rep. Mark Green’s Tennessee seat a “big deal” and said he wants Republicans to surpass his 2024 margins in the district.
Trump made the remarks in a Monday night tele-rally for Matt Van Epps, the Republican candidate running against Democrat Aftyn Behn in Tennessee’s 7th Congressional District. Voters head to the polls on Tuesday to bring an end to a race that has drawn millions in outside spending as Democrats believe they have an opportunity for an upset. 
“This is a big deal, because right now we’re like, three votes up on the radical left, and this would be a wonderful victory for us,” Trump <a href="https://nypost.com/2025/12/01/us-news/trump-calls-tennessee-special-election-a-big-thing-suggests-results-will-reflect-on-him-and-the-gop/">said</a>, according to the New York Post. “It’ll be really a positive sign.” 
Trump won the district by more than twenty percentage points in the 2024 presidential race. 
“If it’s like two points less than that, they’ll say, ‘Oh, that’s terrible. I guess Trump’s losing his magic,&#8217;” Trump said. “I want Matt to do better than me, even.&#8221;

“It is no secret my majority in Congress is razor-thin,” Johnson said. “Every seat matters more than ever, and that’s exactly why we need Matt here in Washington.”
Later in a social media post, Trump <a href="https://x.com/realDonaldTrump/status/1995676855651664182">called</a> for his supporters to surge to the polls.

‘A Big Deal’: Trump Calls On Tennessee Republicans To Surge To The Polls

FRANKLIN, Tenn. — “The reputation of our state is on the line,” said Tennessee Republican senator Bill Hagerty as he addressed several hundred Republican voters gathered Monday morning to rally support for congressional candidate Matt Van Epps one day before a crucial special election.
The temperatures outside were chilly, but the mood of Republican officials inside the rally was confident yet urgent. Most said they believed that Van Epps would win the race for Tennessee’s 7th Congressional District, but that the margins could be closer than what would typically be expected in the Republican favorable district. Van Epps is facing off against state Democrat Representative Aftyn Behn, a far-Left candidate who supports transgender procedures on kids and wants to roll back Tennessee’s pro-life protections.
Democrats have poured millions into the race, capitalizing on their wins last month and hoping for low Republican turnout in the rural areas of the district and high turnout in parts of Nashville. Former congressman Mark Green won the district by over 20 points during the 2024 election before later announcing his resignation.
“It’s all going to come down to the numbers, and my friends, the Democrats have seen an opportunity. They’re counting on us to slide into December 2 having enjoyed Thanksgiving and not thinking that this seat is at risk,” Hagerty said. “The message that we can send from here in Tennessee has to be loud and clear. Not only is Tennessee a red state, Tennessee seven is a red district, and the reputation of our state is on the line.”
Hagerty said he believed that Van Epps would be OK, but that Tennessee voters had a chance to put a stop to Democrat confidence after racking up wins in Virginia and New Jersey.
The rally was held at the barn of American businessman and billionaire Willis Johnson in rural Williamson County with the backdrop of Johnson’s classic car collection on display. Inside the rally were a who’s who of Volunteer State Republicans, including Governor Bill Lee, Senator Marsha Blackburn, Rep. John Rose, Rep. Andy Ogles, Rep. Tim Burchett, state Senate Majority Leader Jack Johnson, and state GOP Chair Scott Golden.
&#8220;We are going to win this because we are going to have a coalition that gets out and we&#8217;re going to win decisively,&#8221; Van Epps told the crowd, promising to fight for America First policies if elected to office.
Van Epps won a crowded Republican primary in August after being endorsed by President Donald Trump. A number of Van Epps&#8217; primary opponents, including Reps. Gino Bulso and Jody Barrett, were in attendance and gave Van Epps their full-throated support.
Republican National Committee Chair Joe Gruters also spoke, as did House Speaker Mike Johnson (R-LA), who flew in from Washington, D.C., Monday morning. To much cheering, Johnson called President Donald Trump, who addressed the crowd on speaker phone.

Trump said that he heard the “crowd is incredible” and that he wanted to be there in person, but that the Secret Service said it would be difficult on such short notice.
“I love Tennessee, one of my all-time favorite places. Tennessee, I guess, loves me because we won by the biggest margins anybody has ever won by,” Trump said. &#8220; But if you can go Matt Van Epps, he&#8217;s a winner, he&#8217;s going to be great. Don&#8217;t let this stuff fool you.”
Trump also ripped into Behn for <a href="https://www.dailywire.com/news/music-city-fumble-dem-candidate-said-she-hates-city-she-wants-to-represent-in-congress">previously saying</a> that she hates country music. “How the hell can you elect a person like that?” Trump asked.
Several Republican officials said that they expected Van Epps to win by about 7-10% of the vote. State Senator Joey Hensley told The Daily Wire he thought he would win by 8-10% of the vote, while Williamson County GOP Chair Steve Hickey said he believed the margin would be about 7%. Congressman John Rose told The Daily Wire he thought Van Epps would finish strong.
Multiple local attendees who spoke with The Daily Wire said that they worried that a sense of complacency had set in across the district because the seat went so strongly Republican in the past. Attendee Matt said that he couldn’t believe how close the polls indicated the race would be and said he was confused why Green resigned his seat. Chad, who said he had voted early, said he was worried that Republican turnout would be low.
Other Republicans said the result would hinge on turnout. “The game is tied and it will be decided what we do tomorrow,” Golden said.
