A bill that would allow any non-felon <a href="https://www.dailywire.com/topic/louisiana" target="_blank" rel="noopener">Louisiana</a> resident to concealed carry a gun without a permit has passed both the state House and Senate and is expected to be signed by Governor Jeff Landry (R-LA). 
The Republican-backed proposal, SB 1, passed the House on Wednesday by a 75-28 vote and the Senate 28-10 last week. If signed, Louisiana would be the 28th state to enact a constitutional carry-style law. 
The Louisiana bill <a href="https://legis.la.gov/legis/ViewDocument.aspx?d=1348797">says</a> “that law-abiding persons eighteen years of age and not otherwise prohibited may carry a concealed weapon lawfully without a permit,” removing previous requirements for concealed carry in the state. 
“People are getting raped, murdered, carjacked and assaulted,” <a href="https://abcnews.go.com/US/wireStory/bill-allowing-permitless-concealed-carry-louisiana-heads-governors-107656008" target="_blank" rel="noopener">said</a> Louisiana state Rep. Mike Johnson on Wednesday. “A vote for this bill today gives the citizens of Louisiana the right to defend themselves.”
Republican state Sen. Blake Miguez was the sponsor of the legislation and noted it would take effect on Independence Day if signed.

The proposal was passed after Landry asked the state legislature to pass tougher punishments for crime as well as pass a constitutional carry bill in a special session.
“While criminals carry guns without regard for the law, lawful gun owners are our most law-abiding citizens. Their armed presence helps deter violent crime,” Landry <a href="https://gov.louisiana.gov/index.cfm/newsroom/detail/4425" target="_blank" rel="noopener">said</a>. “It is time Louisiana join 27 other states who have created a constitutional right to carry a firearm without the government’s permission. This body has repeatedly passed it. Now you have a governor who will sign it.”

A constitutional carry bill was <a href="https://apnews.com/article/la-state-wire-gun-politics-laws-government-and-politics-e3d0715cb75456ffcb58391bf2850cb4" target="_blank" rel="noopener">vetoed</a> in June 2021 by then-Governor John Bel Edwards (D-LA) after both the state House and Senate passed the measure overwhelmingly. 
The governor’s office changed hands earlier this year after Landry <a href="https://www.dailywire.com/news/republican-jeff-landry-elected-louisiana-governor-by-huge-margin-flips-state-red" target="_blank" rel="noopener">won</a> over 50% of the vote in Louisiana’s “jungle primary” in October 2023. Since Landry won over 50% of the vote the race did not go on to the general election. 
Landry ran on getting crime under control and improving the economy and public school system. His campaign website blasted “woke” district attorneys for being soft on crime, and he says that as governor, Louisiana would “hold everyone, and I mean everyone, accountable for violent crime.&#8221;

A federal court has blocked a restrictive <a href="https://www.dailywire.com/topic/california" target="_blank" rel="noopener">California</a> law that would have banned carrying guns almost everywhere in public, including at places like churches and playgrounds. 
The 9th Circuit Court of Appeals on Saturday <a href="https://www.cbsnews.com/news/california-law-gun-ban-most-public-places-halted-federal-appeals-court/" target="_blank" rel="noopener">ruled</a> to halt implementation of the law after a previous panel of judges on the court had allowed the law to take effect on December 30. The law would have heavily restricted anyone, even people with permits, from carrying in public. The California Rifle and Pistol Association (CRPA) sued to block the law after Governor Gavin Newsom signed it in September. The court is expected to hear full arguments on the law in April.
“This dangerous decision puts the lives of Californians on the line. We won’t stop working to defend our decades of progress on gun safety in our state,” Newsom’s office <a href="https://www.kron4.com/news/california/new-california-gun-law-on-concealed-carry-blocked-by-judge-once-again/?nxsparam=1" target="_blank" rel="noopener">said</a> of the latest court ruling. 
The law would have banned carrying guns in private businesses, unless the business expressly put up a sign saying that individuals were allowed to carry. Guns would have been banned on public transportation, at public gatherings, in parking areas, in parks and at playgrounds, sports venues, casinos, hospitals and clinics, churches, and banks, <a href="https://www.latimes.com/california/story/2023-12-20/federal-judge-blocks-new-california-law-barring-guns-in-many-public-places">according</a> to the L.A. Times. 
The CRPA <a href="https://crpa.org/news/blogs/breaking-stay-lifted-in-sb-2-case-injunction-back-in-place/" target="_blank" rel="noopener">celebrated</a> the decision from the court, saying that it meant “the conceal carry in sensitive places portion of SB2 is not enforceable!”

The law was <a href="https://www.dailywire.com/news/judge-blocks-californias-repugnant-ban-on-carrying-guns-in-most-public-places" target="_blank" rel="noopener">initially blocked</a> by U.S. District Judge Cormac Carney who called it “sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court.”
“Although the government may have some valid safety concerns, legislation regulating [concealed carry] permitholders — the most responsible of law abiding citizens seeking to exercise their Second Amendment rights — seems an odd and misguided place to focus to address those safety concerns,” Carney, a George W. Bush appointee, said.
“They have been through a vigorous vetting and training process following their application to carry a concealed handgun,” he wrote. “The challenged SB2 provisions unconstitutionally deprive this group of their constitutional right to carry a handgun in public for self-defense.”

The <a href="http://dailywire.com/topic/supreme-court" target="_blank" rel="noopener">Supreme Court</a> permitted a <a href="http://dailywire.com/topic/new-york" target="_blank" rel="noopener">New York</a> law restricting the concealed carry of <a href="http://dailywire.com/topic/guns" target="_blank" rel="noopener">firearms</a> to stay in force as challenges to the statute move through the legal system.
An emergency request from plaintiffs to pause the law was rejected; Justice Samuel Alito wrote a <a href="https://www.documentcloud.org/documents/23569915-22a557-order" target="_blank" rel="noopener">statement</a> endorsed by Justice Clarence Thomas respecting the denial while stressing that the viability of the case was not in question.
“I understand the Court’s denial today to reflect respect for the Second Circuit’s procedures in managing its own docket, rather than expressing any view on the merits of the case,” Alito said. “Applicants should not be deterred by today’s order from again seeking relief if the Second Circuit does not, within a reasonable time, provide an explanation for its stay order or expedite consideration of the appeal.”
The court case follows the Supreme Court <a href="https://www.dailywire.com/news/breaking-scotus-strikes-down-new-york-concealed-carry-restrictions-restrictions" target="_blank" rel="noopener">ruling</a> last summer in a six-to-three decision against longtime restrictions on concealed carry in New York. The state law in question had conditioned the right to a concealed carry permit on “good moral character” and “proper cause.” The Supreme Court majority opinion written by Thomas took issue with the latter condition, which unlawfully forced New Yorkers to demonstrate “a special need for self-defense.”
“We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need,” he contended. “That is not how the First Amendment works when it comes to unpopular speech or the free exercise of religion. It is not how the Sixth Amendment works when it comes to a defendant’s right to confront the witnesses against him. And it is not how the Second Amendment works when it comes to public carry for self-defense.”
More recently, however, officials in New York greenlit the Concealed Carry Improvement Act, which prohibits guns in certain locations, demands gun owners request a property owner’s consent to carry on their premises, and requires a social media review ahead of gun purchases, according to a <a href="https://ag.ny.gov/press-release/2022/attorney-general-james-takes-action-maintain-concealed-carry-gun-laws-and-protect#:~:text=The%20law%20strengthens%20requirements%20for,of%20certain%20gun%20purchases%2C%20and" target="_blank" rel="noopener">statement</a> from the office of New York Attorney General Letitia James. Six residents challenging the law recently <a href="https://www.supremecourt.gov/DocketPDF/22/22A557/250597/20221221121323672_Antonyuk%20Application%20to%20Vacate%20Stay%20FINAL.pdf" target="_blank" rel="noopener">asked</a> the Supreme Court to intervene.
Republican lawmakers say that the Concealed Carry Improvement Act stands in defiance of the Supreme Court’s landmark ruling last year. Rep. Elise Stefanik (R-NY) introduced a <a href="https://stefanik.house.gov/2022/10/stefanik-tenney-introduce-resolution-condemning-new-york-s-concealed-carry-law-as-unconstitutional" target="_blank" rel="noopener">resolution</a> to the House of Representatives condemning the new legislation as a violation of the Second Amendment and encouraging all states to pass laws supporting the right to bear arms.
Several other states and localities controlled by Democratic officials have introduced restrictions on gun ownership in recent years. A law in Oregon <a href="https://www.dailywire.com/news/oregon-judge-freezes-gun-control-law-over-questions-about-fundamental-constitutional-rights" target="_blank" rel="noopener">bans</a> the sale of magazines with a capacity of more than 10 bullets and includes a permit-to-purchase requirement that requires all customers to get a background check and attend gun safety training before acquiring a firearm. An executive order from Philadelphia Mayor Jim Kenney <a href="https://www.dailywire.com/news/judge-blocks-liberal-mayors-gun-ban" target="_blank" rel="noopener">outlawed</a> firearms at city recreational facilities despite state law barring such restrictions. Both measures were challenged in the court system and blocked by judges.
Some 81.4 million Americans own firearms, representing 31.9% of the adult population, according to <a href="https://papers.ssrn.com/sol3/papers.cfm?abstract_id=3887145" target="_blank" rel="noopener">data</a> from the most recent National Firearms Survey. The average gun owner has five firearms, with handguns as the most common type of weapon owned.

A federal judge in <a href="https://www.dailywire.com/topic/new-york" target="_blank" rel="noopener">New York</a> blocked much of the state&#8217;s restrictive concealed carry law passed earlier this year.
In a lawsuit brought by a group of New York state gun owners, Northern District of New York Judge Glenn T. Suddaby <a href="https://int.nyt.com/data/documenttools/new-york-gun-law-temporary-restraining-order/97cb10daaf586bfc/full.pdf" target="_blank" rel="noopener">ruled</a> Thursday that much of the state&#8217;s &#8220;<a href="https://www.dailywire.com/news/all-of-ny-a-gun-free-zone-controversial-anti-gun-legislation-takes-effect-in-new-york" target="_blank" rel="noopener">Concealed Carry Improvement Act</a>&#8221; violates the Supreme Court&#8217;s orders in <a href="https://www.dailywire.com/news/breaking-scotus-strikes-down-new-york-concealed-carry-restrictions-restrictions" target="_blank" rel="noopener">NY State Rifle and Pistol Association v. Bruen</a>, and by extension, the Second Amendment rights of New Yorkers. Suddaby blocked much of the law from taking effect, but he gave New York state officials three days to appeal the ruling before it takes effect.
First, the ruling struck down the law&#8217;s requirement that a person must have &#8220;good moral character&#8221; to obtain a concealed carry permit. In his opinion, Suddaby blasted the restrictions for severely curtailing New Yorkers&#8217; Second Amendment rights. &#8220;In essence, New York State has replaced its requirement that an applicant show a special need for self-protection with its requirement that the applicant rebut the presumption that he or she is a danger to himself or herself, while retaining (and even expanding) the open-ended discretion afforded to its licensing officers,&#8221; Suddaby wrote in the opinion.
&#8220;Simply stated, instead of moving toward becoming a shall-issue jurisdiction, New York State has further entrenched itself as a shall-not-issue jurisdiction. And, by doing so, it has further reduced a first-class constitutional right to bear arms in public for self-defense&#8230; into a mere request (which is burdened with a presumption of dangerousness and the need to show &#8216;good moral character&#8217;).&#8221;
While it struck down the &#8220;good moral character&#8221; requirement, the decision upheld other requirements to obtain a concealed carry permit. Suddaby upheld the requirement that applicants submit four character references, but struck down other requirements for contact information from the applicant&#8217;s spouse and family, as well as the requirement to disclose all <a href="https://www.dailywire.com/news/new-york-to-screen-gun-applicants-social-media-accounts-in-wake-of-scotus-2a-rebuke" target="_blank" rel="noopener">social media accounts</a>; Suddaby especially pointed out pseudonymous social media accounts, citing the example of pseudonyms used to protect identities in publishing and the press.
He also upheld a provision letting licensing officers procure &#8220;other information&#8221; in license applications, on the grounds that such information is very limited in scope; he also opened the door to revisiting that provision at trial. He also upheld the requirement that applicants receive 18 hours of firearms training. However, he blocked the requirement to meet in-person with a licensing officer before receiving a concealed carry permit.
Suddaby also struck down many of the &#8220;sensitive locations&#8221; where the law bans carrying firearms, writing that state officials &#8220;have simply not met their burden of &#8216;sift[ing] the historical materials for evidence to sustain New York State&#8217;s statute.’”
He upheld bans on carrying a firearm at government buildings, polling places, public areas temporarily restricted by a government entity, schools, and protests and other constitutional assemblies. He also upheld a ban on carrying in places of worship, but made an exception for &#8220;those persons who have been tasked with the duty to keep the peace&#8221; at such places.
However, he blocked the state from banning firearms on public transportation; at amusement parks, entertainment venues, and places where alcohol is served; in Times Square; at health care, behavioral health, or drug dependency care centers; libraries, public playgrounds, public parks, and zoos; child and family services centers and child care centers like daycares; summer camps; centers for the developmentally disabled; addiction centers; mental health centers; disability centers; domestic violence and emergency shelters; and residential properties, except for fenced-in farmland or hunting ground.
Suddaby issued a temporary restraining order blocking the law being enforced pending a hearing later this month for a preliminary injunction; he gave state officials three days to file an appeal with the Second Circuit before the order takes effect.

In a highly politicized move, the Biden administration’s Department of Justice, headed by Attorney General Merrick Garland, criticized the decision by the Supreme Court to invalidate a New York law restricting concealed carry.

Garland scrupulously avoided putting his own name on the criticism. Instead, the Department of Justice released spokeswoman Dena Iverson’s statement as she <a href="https://www.justice.gov/opa/pr/justice-department-statement-supreme-court-ruling-new-york-state-rifle-pistol-association-inc">wrote</a>, “We respectfully disagree with the Court’s conclusion that the Second Amendment forbids New York’s reasonable requirement that individuals seeking to carry a concealed handgun must show that they need to do so for self-defense.”

On May 11, Florida GOP senator Marco Rubio <a href="https://www.rubio.senate.gov/public/index.cfm/2022/6/rubio-demands-answers-from-doj-on-danger-to-supreme-court-justices-violence-against-pro-life-organizations">wrote a letter</a> to Biden’s Department of Justice asking them to publicly condemn and investigate the ongoing and unlawful efforts designed to intimidate Supreme Court Justices after the leak of a draft opinion from the U.S. Supreme Court in Dobbs v. Jackson Women’s Health Organization indicated that the court would overturn the infamous Roe v. Wade decision.
Rubio said that Biden’s Department of Justice waited a full month before they responded, replying on the same day a man who allegedly planned to assassinate U.S. Supreme Court Justice Kavanaugh was arrested.
Rubio slammed Biden’s DOJ, writing:

After Governor Kathy Hochul (D-NY) denounced the Supreme Court decision on Thursday eliminating state restrictions on carrying concealed firearms, James Woods ripped her by pointing out one important fact.

“New York’s proper-cause requirement violates the Fourteenth Amendment in that it prevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms,” he concluded.
In early May, on the heels of someone leaking the draft of the Supreme Court decision which would revoke the infamous Roe v. Wade decision, Woods pointed out that the nefarious nature of the leak and disrespect for the Constitution made him wonder exactly how far such advocates would go.

Governor Mike DeWine (R-OH) signed a bill making it legal for state residents to carry a gun without first obtaining a state permit. With his signature, Ohio has become the 23rd state in the nation to enact constitutional carry legislation.
<a href="https://search-prod.lis.state.oh.us/solarapi/v1/general_assembly_134/bills/sb215/EN/05/sb215_05_EN?format=pdf">Senate Bill 215</a> allows anyone over 21, and who is legally eligible to own a firearm, to concealed carry. It also removes the requirement that citizens inform a police officer they are carrying a weapon, although they must disclose the fact if asked. The law takes effect 90 days after its signature.
Advocates say the bill more perfectly respects the Second Amendment right to keep and bear arms as <a href="https://davekopel.org/2A/IP/Trust%20the%20People.pdf">intended</a> by America’s Founding Fathers. “The constitution of the U.S. does not require you to have a permit or license to exercise the rights that are prescribed in the constitution,” <a href="https://dayton247now.com/news/local/gov-dewine-signs-senate-bill-215-allowing-concealed-carry-without-permit">said</a> State Senator Niraj Antani, a co-sponsor of the bill. “Among those rights is the second amendment which is the right to bear arms.”
The new law comes as the state capital, Columbus, became one of a dozen Democrat-controlled cities to set <a href="https://www.dailywire.com/news/twelve-major-cities-with-new-homicide-records-in-2021-all-led-by-democrats">record-breaking homicide numbers</a> in 2021: 204 murders, or one <a href="https://www.nbc4i.com/news/local-news/columbus/interactive-map-explore-columbus-homicides-in-2021-citys-deadliest-year/">every 1.8 days</a>. The city’s homicide rate had already risen by 67% in 2020 — a <a href="https://www.10tv.com/article/news/crime-tracker/columbus-homicide-rate-has-increased-more-than-chicagos-past-two-years/530-37e0702e-99f5-40aa-b1c6-4d801de181e3">higher rate than Chicago</a>.
In response, the number of concealed carry permits obtained by Ohioans surged <a href="https://www.10tv.com/article/news/local/ohio/ohio-concealed-carry-bill-gov-mike-dewine-signs-senate-bill-215/530-031475f7-774d-48d2-b73f-eec586860894">20%</a> last year over 2020, to 202,920, according to the state attorney general. The state already allows the open carry of firearms.
“A person who lives, works and drives through areas that have recently exploded in violence should not have to complete government paperwork, submit to a background check, take a class, and then wait on the government to exercise a right guaranteed by the state of Ohio,” <a href="https://www.nbc4i.com/news/state-news/dewine-tight-lipped-on-his-plans-for-concealed-carry-bill/">said</a> Rob Sexton of the <a href="https://www.buckeyefirearms.org/">Buckeye Firearms Association</a> in January.
Some law enforcement officers, such as Hamilton County Sheriff Charmaine McGuffey, opposed the bill, <a href="https://www.wksu.org/government-politics/2022-03-09/gun-safety-advocates-urge-dewine-to-veto-a-controversial-ohio-gun-bill">saying</a> it would increase gun violence. But a plurality of police officers said that allowing civilians greater ability to carry concealed weapons would “have the most impact” in “preventing large scale shootings in public” in a 2013 <a href="https://crimeresearch.org/wp-content/uploads/2021/03/PoliceOne-Survey-2013.pdf">survey</a>.
Gun rights advocates thanked the governor for making the legislation a reality. &#8220;Gov. DeWine made a campaign promise to Buckeye Firearms Association and to Ohio&#8217;s 4 million gun owners that he would sign a Constitutional Carry bill if it was put on his desk. And he has fulfilled his promise,” <a href="https://www.buckeyefirearms.org/ohio-governor-dewine-signs-bfa-supported-permitless-carry-bill">said</a> Dean Rieck, executive director of Buckeye Firearms Association.
The National Rifle Association <a href="https://www.nraila.org/articles/20220314/ohio-gov-dewine-signs-constitutional-carry">thanked</a> “Gov. DeWine for signing this critical bill that upholds the Second Amendment in Ohio, for the benefit of law-abiding citizens,” as well as “bill sponsor Senator Terry Johnson (R-14), Chairman Shane Wilkin of the House Government Oversight Committee, and all the other lawmakers who sent this bill to Gov. DeWine’s desk.”
DeWine, who is up for reelection this year, had not championed the bill’s passage.
After a mass shooting in Dayton in 2019, DeWine <a href="https://www.cincinnati.com/story/news/politics/2019/08/05/ohio-gov-mike-dewine-proposes-gun-mental-health-changes-after-dayton-shooting/1924536001/">unveiled a series of gun restrictions</a> he would support: The package included so-called “red flag” laws, which would allow judges to seize firearms from individuals deemed a risk to themselves or others, and background checks for <a href="https://www.thecentersquare.com/ohio/dewine-faces-decision-on-permitless-carry-in-ohio/article_6c35ac54-a3b2-11ec-b631-8f207675e828.html">virtually all</a> gun purchases. While he admitted many such measures would not have prevented the shooting, he said, “If we, after tragedy, only confine ourselves to doing those things that would prevent this tragedy, we are missing the real opportunity.”
When asked whether he would sign the state’s constitutional carry bill last Friday, DeWine <a href="https://www.nbc4i.com/news/state-news/dewine-tight-lipped-on-his-plans-for-concealed-carry-bill/">replied</a>, “I’m not gonna say much today other than, the job of the governor is to make tough decisions, and I have decision to make. That’s about all I will say.”

South Dakota Republican Gov. Kristi Noem announced during a speech on Tuesday that she is proposing an end to all state concealed-carry permit fees, including payment of federal background checks. Noem made the remarks during her annual State of the State speech at the state&#8217;s Capitol on Tuesday.

Noem&#8217;s proposal to eliminate fees related to the Second Amendment was part of a larger agenda of tax cuts envisioned during her <a href="https://news.sd.gov/newsitem.aspx?id=28835" target="_blank" rel="noopener">speech</a>.
&#8220;Let’s also eliminate all fees for concealed carry permits in the state. We will pay the costs for federal background checks, as well. It will not cost you a penny to exercise your Second Amendment rights in South Dakota,&#8221; she said.
&#8220;Three years ago, Constitutional Carry was the very first bill that I signed as Governor. We guaranteed the right of our people to keep and bear arms. Together, we will continue to defend this key constitutional liberty,&#8221; Noem added.
The governor also emphasized her focus on limited government in managing the state.
&#8220;I am proud to report that the state of our state is stronger than it has ever been in our 133-year history,&#8221; Noem said in the introduction of her speech. &#8220;This did not happen because of what government did. It happened because of what government did NOT do. And it is because of our people.&#8221;
In addition, the governor&#8217;s speech addressed Noem&#8217;s strong pro-life policies. On January 6, Noem and the Department of Health’s rule blocking telemedicine abortions was approved by the South Dakota Legislature’s Interim Rules Review Committee.
“Chemical abortions are four times as likely to cause a woman getting an abortion to end up in an emergency room – and we have a duty to protect the lives of those women,” Noem said in a <a href="https://news.sd.gov/newsitem.aspx?id=28824" target="_blank" rel="noopener">statement</a>.
“I look forward to the day when the life of every unborn child is protected in South Dakota. Until then, South Dakotans will know that if a mother uses abortion pills to end her unborn child’s life, she will not get those pills from a stranger over the internet,” she added.
Noem recently drew national attention after calling on President Joe Biden to rescind all federal COVID-19 mandates after he said, “There is no federal solution,” to the pandemic.
“After a year, we finally agree @potus. The federal government isn’t the solution. That’s why from the start, SD took a different approach by trusting our citizens to be responsible and make the right decisions for themselves &amp; their families. SD Gov. Noem Proposes End To Conceal Carry Fees: ‘Won’t Cost You A Penny’ To Exercise Second Amendment Rights

Nancy Mace (R-SC) spoke this week about how she obtained a concealed carry permit for South Carolina after her home was vandalized, saying, getting a gun was “one of the most empowering things I have done” while saying that she is teaching her children gun safety and adding, “They know how to handle a firearm if they ever are near one.”
On Memorial Day, police informed Mace that her home in Charleston had been vandalized with graffiti and anarchist symbols.” Police are still investigating, but the graffiti is gone now. Statements including ‘F*** you Nancy,&#8221; and ‘all politicians are bastards,’ were scrubbed away by crews the day it happened,” <a href="https://www.foxnews.com/politics/nancy-mace-carrying-gun-threats-vandalism">Fox News</a> reported.
Mace told Maria Bartiromo of <a href="https://www.foxbusiness.com/politics/sc-congresswoman-rep-nancy-mace-carrying-gun-vandalism-home-firearm">Fox Business</a> on Tuesday that she had already obtained a concealed carry permit for South Carolina at the end of 2020 based on threats against her life. She added:

I want to make sure I follow all the laws, but I&#8217;m not going to be put in a position where I can&#8217;t defend myself. And we&#8217;ve seen political violence increasing over the last year to year and a half. “And so for me, wherever I go in South Carolina and I am allowed to carry, I have a firearm on my person, always carrying. And I have to tell you, as a mom, as a single mom, it&#8217;s one of the most empowering things I have done. I&#8217;ve also had an opportunity to teach my kids about gun safety. I think that&#8217;s really important so they&#8217;re not afraid. They know how to handle a firearm if they ever are near one. I think those things are really extremely important,” Mace stated.
Mace told <a href="https://www.foxnews.com/politics/nancy-mace-carrying-gun-threats-vandalism">Fox News</a>, “I now go to the gun range, almost weekly, to practice shooting. … When they show up to your house and physically try to destroy it with graffiti, it’s personal and it’s invasive and it’s violating. … They also spray-painted, ‘No gods, no masters, all politicians are bastards.’”
“It doesn’t feel good that I feel like I have to look across, look behind my shoulder every day. It doesn’t feel safe,” she said. “I carry a gun wherever I go today, wherever I’m allowed to, I do carry.”
“When this happened, it really changed everything for me,” she recalled. “I’m not going to live in fear; I’m not going to be intimidated; and to be able to carry a gun wherever I go, for me as a woman, I think it’s one of the most empowering things that you can do to defend yourself.&#8221;
Mace spoke of the charges from some that she had vandalized her own property: “There was no empathy; there was only ‘Let’s revictimize her,’ and ‘Let’s accuse her of doing the crime herself.’ And I challenge anybody: If I did this, please send the evidence to the FBI and please charge me with a crime. I dare you to, because the evidence just doesn’t exist out there. And it’s crazy to me that’s this is where we are in this country, you’re seeing the downfall of civility on social media because of this.”
“Knowing that he or she has not been caught and there have been no charges pressed, it makes me feel like I have to look over my shoulder everywhere I go,” she said. “Even if I go out for a walk in the morning or in the evening in my own neighborhood, I’m concealed-carrying a gun. I’m absolutely going to talk about it to people and I will try to fund-raise off of it; I’m going to do it again in a few more days. I’m not going to back down.&#8221;
“I think we’ve got to use all the tools that we can to be successful in this country and I feel liberated by the ability to carry a gun now. It’s liberating but also it’s empowering for me to be able to know that I can defend myself no matter what,” she concluded.

‘They Know How To Handle A Firearm’: Nancy Mace Teaches Her Kids, Gets Concealed Carry Permit After Threats

Conceal carry permits are on the rise, increasing 34% over the past four years. The main driver behind the increase? Women and minorities, according to John Lott’s Crime Prevention Research Center.
The Washington Examiner’s Paul Bedard <a href="https://www.washingtonexaminer.com/washington-secrets/women-minorities-rush-to-get-concealed-carry-permits-up-34">reported</a> that so many people are attempting to get the permits that some counties are experiencing long lines due to cutbacks during the coronavirus pandemic. Further, the CPRC found that there are 820,000 more concealed carry permit holders today than there were in 2019, thanks in large part to women and minorities.
“Permits for women and minorities continue to increase at a much faster rate than for either men or whites,” Lott said <a href="https://papers.ssrn.com/sol3/papers.cfm?abstract_id=3703977">a report</a>.
“There were 2.7 million concealed handgun permit holders in 1999, 4.6 million in 2007, 8 million in 2011, 11.1 million in 2014, and now 19.48 million in 2020,” the report said.
Fox News <a href="https://www.foxnews.com/politics/concealed-carry-permits-rise-despite-clampdown-from-some-states-report-finds">added</a> that “among adults in the U.S., 7.6% now hold concealed carry permits, and this does not account for those living in the 16 states that do not require concealed carry permits.”
“This is despite continued restrictions against concealed carry in both California and New York. Taking those large populations out of the equation, the report says, the percentage of adults with concealed carry permits rises to approximately 9.2%,” the outlet added.
Cam Edwards <a href="https://bearingarms.com/cam-e/2020/10/06/rights-hold-delays-licenses-permits/">reported</a> on Bearing Arms about the long wait times some seeking concealed carry permits have faced:
<blockquote>In Allegheny County, Pennsylvania, the Firearms Division of the sheriff’s office is now scheduling appointments in March of 2021 to apply for concealed carry licenses. Even existing concealed carry holders are being told that they can’t renew their licenses any sooner than that, and some of those left twiddling their thumbs for months say something has to give.

The head of the gun permitting division of the sheriff’s office says that deputies simply can’t keep up with the high demand, especially with the county moving to an appointment-based system in order to limit the number of people inside the sheriff’s office because of COVID-19 mitigation policies.</blockquote>
“I understand people are frustrated, but we’re doing the best we can do right now and we’re aggressively looking for more efficient ways to do it in a safe manner,” Chief Deputy Kevin Kraus <a href="https://www.wtae.com/article/firearms-division-not-taking-appointments-until-march-2021/34276163">told</a> WTAE.
&#8220;We have appointments, one every five minutes,&#8221; he added. &#8220;We&#8217;ve been open the last three weekends on Saturday and Sunday and like I said, we&#8217;re aggressively seeking out options to find a solution to this and service as many people as we can.&#8221;
Lott’s report also noted that “Seventeen states no longer provide data on all the people who are legally carrying a concealed handgun because people in those states no longer need a permit to carry.”
Other highlights from the report, as noted by Bedard:

<li>Alabama has the highest concealed carry rate at 28.5%.</li>
<li>Indiana is second with 18.7%.</li>
<li>Five states now have over 1 million permit holders.</li>
<li>As the number of permits have gone up, violent crime has decreased slightly.</li>

Women, Minorities Leading Increase In Conceal Carry Permits

On February 4, Alabama state Representative Proncey Robertson (R-District 7) introduced H.B. 39, which pertains to the issuance of “carry permits,” and to the creation of a “standardized statewide process to issue concealed carry permits for terms of 1 year, 5 years, or permit holder&#8217;s lifetime.”
The bill was read and “referred to the House of Representatives committee on Public Safety and Homeland Security,” according to <a href="https://legiscan.com/AL/bill/HB39/2020">LegiScan</a>.
“Under current law, concealed carry permits are issued by the sheriffs of each county. Each sheriff may have different fees, forms, and processes for the issuance of a concealed carry permit,” the synopsis of the bill reads. “Further, each county may maintain separate databases of individuals authorized to carry a pistol in a vehicle or concealed on or about his or her person within this state.”
The synopsis continues, proposing a standardized, statewide process instead:
<blockquote>This bill would standardize a process by which concealed carry permits may be issued statewide and would create a state concealed carry permit information system by which relevant data may be maintained and provided to law enforcement. This bill would also integrate into that state information system existing data relating to concealed carry permits issued by county sheriffs.</blockquote>
Later, the <a href="http://alisondb.legislature.state.al.us/ALISON/SearchableInstruments/2020RS/PrintFiles/HB39-int.pdf">text of the bill</a> goes into more detail:
<blockquote>Upon receiving notice from a sheriff of an approved application for a concealed carry permit, the Alabama State Law Enforcement Agency shall immediately enter the information into the state concealed carry permit information system and ensure that a concealed carry permit endorsement is viewable by law enforcement officers and other authorized persons through the individual&#8217;s driver license&#8230;</blockquote>
Further, it details how one’s license could be revoked under the proposed system:
<blockquote>Upon receiving notice of a denial of an application for a concealed carry permit or a court disposition which would prohibit that individual from purchasing or possessing a pistol or firearm under state or federal law or render that individual ineligible for a permit based upon the factors provided in paragraph [a] of subsection (b), the Alabama State Law Enforcement Agency shall enter the information into the state concealed carry permit information system and ensure that a &#8220;Concealed Carry Prohibited&#8221; restriction is viewable by law enforcement officers and other authorized persons through an individual&#8217;s driver license.</blockquote>
On Thursday, the National Rifle Association’s Institute for Legislative Action (NRA-ILA) <a href="https://www.nraila.org/articles/20200220/alabama-senate-committee-hearing-on-lifetime-carry-permit-bill">stated in a release</a> pertaining to a <a href="http://alisondb.legislature.state.al.us/ALISON/SearchableInstruments/2020RS/PrintFiles/SB47-int.pdf">parallel bill</a> in Alabama’s state Senate, “contact committee members and ask them to support S.B. 47.”
Despite the NRA-ILA’s seeming endorsement of the legislation, Alabama gun rights organization BamaCarry has a different perspective.
Speaking with Fox affiliate <a href="https://www.wbrc.com/2020/02/22/state-lawmaker-proposes-statewide-database-gun-permit-holders/">WBRC</a>, BamaCarry president Eddie Fulmer said: “They need to back off of trying to regulate people who lawfully carry weapons.”
After stating that “permit holders in Alabama are some of the most law-abiding citizens there are,” Fulmer added, “What they are worried about here is a very insignificant amount of people when it comes to revoking a permit.”
The Daily Wire reached out to Rep. Proncey Robertson, and he answered several questions pertaining to the proposed law.
Robertson first noted how information pertaining to gun licenses in the state of Alabama is quite disparate: “Most people may not even realize this, but the concealed carry permit process in the state of Alabama is done in 67 different counties, by 67 different sheriffs. The 67 different processes and 67 different databases or local systems that hold your information – some of them, very insecure to say the least – they’re just on a standalone server under the front desk, for instance.”
The lawmaker added: “When an officer stops you in one end of the state and you have a permit from the other end of the state, he has very little confidence that that permit is valid, or that the Sheriff used the same background process or even maintained the records correctly.”
Robertson said that his proposed H.B. 39 would “standardize” all these various processes under the Alabama Law Enforcement Agency (ALEA) or the Alabama Criminal Justice Information Center (ACJIC), giving law enforcement the ability to access it.
As for the accountability of law enforcement as it pertains to information searching, Robertson stated: “As a police officer, if I want access to that information, I am passworded into it, and you would know what I looked at, every key stroke, what I obtained, what I learned, what I did with it, and I have to have a law enforcement purpose for accessing that information.”
In response to BamaCarry president Eddie Fulmer’s comments, Robertson said: “I have no interest in regulating people who carry legally. What the system would do is it would begin to keep records of those who are prohibited to carry firearms.”
He added:
<blockquote>If we just do away with the permits in the state of Alabama, you still have to have one if you&#8217;re going to cross the state lines. So, this is just a way to secure that information. Number two, currently ACJIC and the National Crime Information Center (NCIC), it keeps arrest records, but that is much different than conviction records or disposition records.</blockquote>
Robertson then noted that if he, as a police officer, were to stop someone he didn’t know personally, who had a history of arrests for “robbery or domestic violence, something what would prevent them from carrying a concealed weapon or obtaining a concealed weapons permit,” NCIC or state records can tell him if they had been arrested, but not if they were convicted, which, he said, “is what I need in order to make an arrest.”
According to Robertson, H.B. 39 would connect the courts to the permit database. “The day that the court convicts you, they would enter into the system that you are now prohibited, and it would revoke your permit if you have one in the system,” he stated.
When probed as to how his bill isn’t a centralized firearm registry, Robertson replied: “It has nothing to do with your gun. I&#8217;m not registering your guns. It never asks you one single question about your gun.”
He continued:
<blockquote>It&#8217;s about your concealed carry permit. It&#8217;s you coming in, taking a background check that says you&#8217;re not someone convicted of anything that would prohibit you, and it says it&#8217;s your license to carry concealed. They never ask you what gun you have or own or possess.</blockquote>
Robertson said that nothing in H.B. 39 requires new information from citizens, rather, it would simply standardize and centralize the current data from all the numerous hubs in which they currently reside.
The lawmaker also made sure to state that “the ATF, every time you purchase a gun, they do a background check at the gun dealer. They collect the make, model, and serial number of the gun you bought, and your name, address, and all your personal information.”
<blockquote>The federal government and the state of Alabama already has that information. This has nothing to do with your guns. This is just about, do you have the right to carry concealed, have you been convicted of something that would prohibit you from carrying a concealed weapon – and that&#8217;s any violent crime, it&#8217;s domestic violence, and it&#8217;s being ruled by a probate judge with a mental defect and involuntarily committed.</blockquote>
Lastly, Robertson explained why he believes Constitutional Carry or Permitless Carry isn’t an option in Alabama as things currently stand:
<blockquote>If you do that, here&#8217;s what happens – because many of these other states that have done it have very good record-keeping systems of criminal convictions, so an officer can look when he stops someone, and tell what they have been convicted of. In Alabama, we do not have that record keeping on the bad guys. That&#8217;s what I&#8217;m trying to do with this bill.
Right now in Alabama, if we went Permitless Carry, I could literally stop someone who is a convicted felon carrying a gun, and I have no way to prove that he is a felon carrying a gun there on the side of the road. So, I would have to let him drive away or walk away with that gun.</blockquote>
“That&#8217;s what people don&#8217;t understand about the way the system works currently,” Robertson added. “We do not have a good enough records management system of convictions in the state of Alabama to go with Constitutional Carry.”
“H.B. 39 requires the courts to report any conviction, misdemeanor, or felony that would make you a prohibited person to carry a firearm. So this improves things for the citizens, it improves the safety for our officers, and it begins to organize this so if there was ever a dream of going to Constitutional Carry in the state of Alabama, the first thing that we have to do is begin to maintain proper criminal conviction records,” Robertson concluded.
