This week, Greg Abbott, the governor of Texas, signed a law that will allow local police in the state to arrest illegal migrants. The law will also permit state judges to order the removal of these migrants. The Biden administration is going to challenge the law, as you’d expect, because immigration enforcement is generally regarded as the sole responsibility of the federal government. Even though the Biden administration is completely ignoring that responsibility, on purpose, they’re still going to maintain that states like Texas aren’t allowed under the Constitution to do the job for them.
Not to sound too defeatist, but the Biden administration is probably going to win this case. That’s what happens every single time conservatives try to use the legal system to defend this country’s borders. It happened when Donald Trump tried to reverse DACA, which was de facto amnesty for hundreds of thousands of illegal aliens. Even though DACA was just invented on the spot by Barack Obama to help Democrats in an election year, the federal courts determined that the Trump administration wasn’t allowed to get rid of it. Along the same lines, when Arizona passed a law allowing police officers to inspect the immigration status of suspected illegal aliens, the Supreme Court struck that down, too.
