White House Says Biden Will Announce Supreme Court Nominee By Monday, Meets With Three Finalists

President Joe Biden has interviewed three women as potential nominees to be his Supreme Court justice pick, with the White House announcing he will share his decision by Monday.

Biden’s three candidates, who are all black women as he promised to nominate the first black woman to the Supreme Court, include federal judges Ketanji Brown Jackson, J. Michelle Childs, and California Supreme Court Justice Leondra Kruger.

The nominee will replace outgoing Supreme Court Justice Stephen Breyer, who announced he plans to retire later this year.

NBC News reported on Tuesday that Biden “continues to evaluate eminently qualified individuals in the mold of Justice Breyer who have the strongest records, intellect, character, and dedication to the rule of law that anyone could ask for,” according to Deputy White House Press Secretary Andrew Bates.

All three potential nominees are “deserving of bipartisan support,” Bates added.

Biden said during his presidential campaign that he would nominate a black woman to the Supreme Court if he had the opportunity. According to NBC News, his announcement will be revealed on Monday, just ahead of his March 1 State of the Union address.

The decision would also come “by the end of February” as Biden has previously noted regarding his decision.

Congressman Jim Clyburn (D-SC) reportedly held a meeting with Vice President Kamala Harris earlier this month to suggest J. Michelle Childs, a South Carolina judge, for the nomination.

“She is the kind of person who has the sort of experiences that would make her a good addition to the Supreme Court,” Clyburn reportedly said.

Biden’s nomination will then head to the Senate for discussion. Some questions have surrounded the process as New Mexico Democratic Ben Ray Lujan (D-NM) was hospitalized on February 1 after suffering a stroke, according to a statement his office released. His absence currently leaves Democrats at a 49 to 50 disadvantage in the Senate. The Daily Wire reported:

“Early Thursday morning, Senator Lujan began experiencing dizziness and fatigue. He checked himself into Christus St. Vincent Regional Hospital in Santa Fe,” Carlos Sanchez, the senator’s chief of staff, said in an email. “He was then transferred to UNM Hospital in Albuquerque for further evaluation. Senator Lujan was found to have suffered a stroke in the cerebellum, affecting his balance. As part of his treatment plan, he subsequently underwent decompressive surgery to ease swelling.”

“He is currently being cared for at UNM Hospital, resting comfortably, and expected to make a full recovery,” the statement continued. “The Senator’s offices remain open and will continue providing constituent services to all New Mexicans without any interruption. The Senator and his family would like to thank the wonderful doctors and staff at both UNM Hospital and Christus St. Vincent Regional Hospital for their excellent care during this time. Senator Lujan looks forward to getting back to work for the people of New Mexico. At this time, he and his family would appreciate their privacy, and ask for your continued prayers and well wishes.”

The senator expects a full recovery and plans to return to the Senate within the coming weeks, allowing him to participate in the nomination process.

Correction: a previous version of this article said Rep. Jim Clyburn (D-SC) had suggested that Ketanji Brown Jackson should be nominated to the upcoming SCOTUS vacancy. That has been changed to J. Michelle Childs.
