Watch Out, Mr. President, Joe Biden Makes A Strong Case For Holding Off On Supreme Court Nomination

C-SPAN dug into their archives and posted a real gem to their Twitter this morning that will have the Vice President backpedaling like the career politician that he is.

Back in 1992, then-Senator Biden argued that President George H.W. Bush shouldn’t nominate a Supreme Court Justice “in the full throes of an election year.”

Here’s the 2-minute clip of his impassioned plea for Bush not to nominate a justice and for the Senate not to schedule confirmation hearings:

The Democrat from Delaware went on to say, “It is my view that if a Supreme Court Justice resigns tomorrow or within the next several weeks, or resigns at the end of the summer, President Bush should consider following the practice of a majority of his predecessors and not — and not — name a nominee until after the November election is completed.”

Biden added that, “It is my view that if the president goes the way of Fillmore and Johnson, and presses an election-year nomination, the Senate Judiciary Committee should seriously consider not scheduling confirmation hearings on the nomination until after the political campaign season is over. … It would be our pragmatic conclusion that once the political season is underway, and it is, action on a Supreme Court nomination must be put off until after the election campaign is over. That is what is fair to the nominee and essential to the process. Otherwise, it seems to me Mr. President, we will be in deep trouble as an institution.”

President Bush did not make the appointment that year because Justice Byron White delayed his retirement until President Clinton was in office, thus securing the path for Ruth Bader Ginsburg to become the next member of the court.

Hot Air points out that, “this means that the current president, current vice president, current Senate minority leader, and incoming Senate minority leader have all gone on record in the past in favor of obstructing a Supreme Court nominee.”
