President Trump fired former FBI deputy director Andrew McCabe after a lengthy battle of wills. And more than once he’s called McCabe a liar, as he did in April: “DOJ just issued the McCabe report – which is a total disaster. He LIED! LIED! LIED!”
Now, McCabe wants immunity before he’ll talk to anyone about . . . anything.
McCabe has requested the Senate Judiciary Committee promise not to use his testimony to prosecute him after he appears before an upcoming congressional panel that will look into how senior officials at the FBI and Justice Department handled the investigation of Hillary Clinton’s private email server, according to a letter obtained by CNN.
“Under the terms of such a grant of use immunity, no testimony or other information provided by Mr. McCabe could be used against him in a criminal case,” wrote Michael Bromwich, a lawyer for McCabe, to Senate Judiciary Chairman Chuck Grassley, who has requested McCabe testify next week.
Grassley, an Iowa Republican, has quietly requested that several former officials appear in front of the Judiciary Committee to discuss the long-awaited internal Justice Department report, which sources say will detail a series of missteps surrounding the Justice Department and FBI’s investigation into Clinton’s handling of classified information while secretary of state.
“We hereby request that the Judiciary Committee authorize a grant of use immunity to Mr. McCabe,” to ensure “no testimony or other information provided by Mr. McCabe could be used against him in any criminal case,” Bromwich wrote in his letter.
“If this Committee is unwilling or unable to obtain such an order [of immunity], then Mr. McCabe will have no choice but to invoke his Fifth Amendment privilege against self-incrimination,” Bromwich added.
But McCabe’s lawyer also said his client is “eager” to testify before the committee.
Fox News senior judicial analyst Judge Andrew Napolitano said the request is “very, very unusual.”
“I have to tell you, it’s unheard of for the number two person at the FBI saying, ‘You want me to testify? Give me immunity,'” Napolitano said on “Fox & Friends First” on Wednesday.
