Three years ago, during a high school girls’ volleyball match, the future I had envisioned for myself completely fell apart.
I <a href="https://www.iwfeatures.com/documentary/payton-mcnabb/" target="_blank" rel="noopener">suffered a severe head and neck injury</a> after a trans-identifying male athlete on the opposing girls’ team sent a volleyball flying directly at my face. I was left partially paralyzed on the right side of my body. The full extent of my injuries forced me to confront the reality that the collegiate athletic career I had been pursuing was no longer possible, and that even basic tasks, such as driving and taking exams, would be significantly more difficult.
At first, I felt hopeless. But then I realized I could use my tragedy — the permanent consequences I must now live with as a result of an unfair policy forcing girls like me to compete against biological males—for good.
And that’s exactly what has happened.
It was an immense honor to attend President Donald Trump’s joint address to Congress on March 4 as a guest of the president and first lady. All I could think about as I listened to the president share my story is how far I’ve come — and how different things could have been.
I never wanted to be a policy advocate or public figure in the fight against gender ideology. All I wanted was to compete and play softball in college. But as President Trump reminded Americans during his address, gender ideology and the officials who enforce it stole that dream from me. And they have no regrets about doing so.
In fact, as I stood to be recognized by President Trump, not a single Democrat on the left side of the aisle applauded or stood in recognition of the hardship I have experienced. I don’t recall even one Democrat so much as looking in my direction. It was hard not to take this as a personal insult. After all, the policies they support — policies that strip women of their right to sex-based spaces and sports teams — cost me personally.
But the Democrats’ stubborn refusal to recognize the consequences of their policies doesn’t just affect me. Senate Democrats in particular made that quite clear this month when they refused to vote in favor of the Protection of Women and Girls in Sports Act, a bill that would bar male athletes from competing against — and potentially injuring — young women.
These Democrats know they are out of step with the American public on this issue—and they just don’t care. For example, when Sen. Jeanne Shaheen, D-NH, was asked earlier this month why she voted against the bill when <a href="https://www.foxnews.com/sports/nyt-poll-finds-majority-democrats-oppose-trans-athletes-womens-sports" target="_blank" rel="noopener">the vast majority</a> of her state’s residents support it, she <a href="https://www.foxnews.com/politics/gops-two-top-dem-senate-targets-justify-blocking-bill-bar-men-from-womens-sports" target="_blank" rel="noopener">insisted</a> the legislation wasn’t important because “it only applies to one person.”
To be clear, even a very conservative estimate <a href="https://thehill.com/homenews/lgbtq/5046662-ncaa-president-transgender-athletes-college-sports/" target="_blank" rel="noopener">places</a> the total number of trans-identifying male athletes competing in women’s sports at far more than just “one person.” But even if Shaheen were right, I am living proof of what can happen when just “one person” is forced to give up her sex-based right to fair and safe competition. Does my experience not matter to Democrats like Shaheen? Do my rights not count?
The fact is, it doesn’t matter how many trans-identifying athletes there are. The correct number of women who should be forced to compete against them is zero. And if congressional Democrats refuse to take our safety seriously, then state legislatures must pick up the slack for them.
After my injury, I was proud to help pass a bill in my home state of North Carolina, House Bill 574, that bans trans-identifying male athletes from playing in women’s sports at both the K-12 and collegiate levels, and I remain committed to helping other states follow suit. There are still 24 states that refuse to act on this issue. That must change.
Those states should keep in mind that the American public, the Trump administration, and, most importantly, common sense, are all on the same side: the side that values and protects women like me. They can either join the fight or stay seated like the Democrats in Congress this month. For their own sake, I hope they choose the former.

Former volleyball star Payton McNabb — who was seriously injured by a trans-identifying biologically male opponent in high school — hopes that by speaking out she can aid in preventing further tragedies.
In a new documentary titled “Kill Shot: How Payton McNabb Turned Tragedy Into Triumph” — created by the Independent Women’s Forum — filmmakers share what happened to McNabb when she was 17 after a trans-identifying player spiked a volleyball at her head, knocking her unconscious, the <a href="https://nypost.com/2024/12/17/us-news/female-athlete-permanently-hurt-by-trans-athlete-speaks-out/">New York Post</a> reported.
While the other players on her team finished the game, McNabb was rushed to the hospital with a concussion, a neck injury, and two black eyes.
“If my story can in any way help prevent this from happening to at least just one woman or girl, then it was all worth it,” McNabb told the outlet about the documentary. “It was 100% avoidable, if only my rights as a female athlete had been more important than a man’s feelings.”
“Every single person that fights for truth, people absolutely attack them, but it doesn’t bother me because I know what I’m saying is common sense,” she added. “It’s not about me. I’m in this for women and girls.”

McNabb said that the team knew about the trans-identifying biological male on the other school’s team but were worried about speaking out.
“We never thought we would ever be put in this position to begin with,” the volleyball player said. “I didn’t know one person who agreed with [a trans player competing against us] on my team, but we didn’t know what to do.”
McNabb, who had dreams of playing college softball, ended up being diagnosed with a traumatic brain injury, partial paralysis, a brain bleed, and loss of peripheral vision on her right side, the outlet noted. She also suffers from severe headaches, confusion, and memory loss.

 “I had the hopes and dreams of playing college softball and I had the opportunities too, but my injury set me back, and it didn’t end up working out,” McNabb said. “I was really depressed.”
“I was always at the top of my class. Learning had never been an issue before,” she added. “But I still just can’t comprehend the way that I used to or focus on what I need to learn.”
The documentary also includes interviews with those closest to Payton who have never spoken out, including her parents and her sister.
Pamela McNabb, her mother, told the Post, &#8220;The guilt Payton’s father and I carry is heavy. At the time we weren’t allowed to speak up. We couldn’t say, ‘No, she’s not playing against a boy, it’s dangerous.’”
“I would never, ever let her play today if I knew what I know now,” she added. “Pull your kid. Don’t play. It is not worth what has happened to her to happen to anybody else’s child.”

A trans-identifying male volleyball player will be allowed to continue to play on the San Jose State women&#8217;s team, a judge ruled on Monday, just days before the conference tournament begins.
Federal Judge S. Kato Crews, a Biden appointee, ruled that Blaire Fleming, a man who identifies as a woman, could continue playing after multiple players for other college teams filed a lawsuit seeking to prevent Fleming from competing against women, The New York Times <a href="https://www.nytimes.com/2024/11/25/us/san-jose-state-volleyball-transgender.html" target="_blank" rel="noopener">reported</a>.
&#8220;San José State University will continue to support its student-athletes and reject discrimination in all forms. All San José State University student-athletes are eligible to participate in their sports under NCAA and Mountain West Conference rules,&#8221; the school said in a statement to Outkick. &#8220;We are gratified that the Court rejected an eleventh-hour attempt to change those rules. Our team looks forward to competing in the Mountain West volleyball tournament this week.&#8221;

San Jose State is preparing to compete in the Mountain West Conference tournament on Friday and will <a href="https://themw.com/wvballchamp/" target="_blank" rel="noopener">play</a> the winner of Utah State vs. Boise State, two teams that have forfeited matches against San Jose State over Fleming being allowed to play against women. A win for Fleming and San Jose State on Friday would put the team in the conference championship game on Saturday.
A total of four teams in the Mountain West and a team in another conference <a href="https://www.dailywire.com/news/fourth-university-womens-team-refuses-to-play-against-trans-identifying-male" target="_blank" rel="noopener">forfeited</a> against San Jose State during the regular season, opting to take losses instead of forcing female players to compete against a man. After Utah State and Southern Utah forfeited against San Jose State last month, Utah Republican Gov. Spencer Cox wrote, &#8220;I stand with the students, coaches and leadership at @SUUtbirds and @USUAggies in their decision to forgo their women’s volleyball matches against San Jose State.&#8221;
&#8220;It is essential that we preserve a space for women to compete fairly and safely,&#8221; Cox added. &#8220;Our female athletes are left grappling with this difficult issue because the NCAA has failed in its responsibility to protect female athletes and women’s sports. It’s time for the NCAA to take this seriously and protect our female student athletes.&#8221;

The plaintiffs in the lawsuit, which includes San Jose State co-captain Brooke Slusser, argue that their Title IX rights are being violated as Fleming is allowed to compete with and against them. The lawsuit also alleges that Fleming was given a scholarship over female athletes. San Jose State assistant coach Melissa Batie-Smoose was suspended after filing her own Title IX complaint against the university alleging it was showing favoritism to Fleming, Fox News <a href="https://www.foxnews.com/sports/trans-volleyball-player-accused-plan-harm-teammate-after-taking-scholarship-from-female-recruit" target="_blank" rel="noopener">reported</a>.

Collegiate <a href="https://www.dailywire.com/topic/volleyball">women’s volleyball</a> players filed multiple lawsuits on Wednesday against the Mountain West Conference over the inclusion of trans-identifying male players in their sport.
A dozen women have cited violations of their First Amendment rights and Title IX protections in response to San Jose State University’s biologically male star player Blaire Fleming’s participation in the MWC, prompting four schools in the conference to forfeit games against SJSU, <a href="https://www.outkick.com/sports/volleyball-players-sue-mountain-west-first-amendment-outkick-exclusive">OutKick</a> reported.
Several of Flemings’ SJSU teammates, like Captain Brooke Slusser and two former Spartans — along with female athletes from four other colleges — are part of the suit against the conference, its commissioner and SJSU officials over the conference&#8217;s adoption of the “Transgender participation policy&#8221; in September after the first school, Boise State, forfeited its game.
The suit said that the policy is “intended to chill protests and other expressive conduct, including boycotts, on a women’s rights issue” of women athletes in the MWC. It also claims that the trans policy was adopted outside the “normal course of MW rules and procedures” and that it was an effort to prevent schools from exercising their First Amendment Rights, the outlet noted.

&#8220;Recently, the MWC, SJSU, and the other Defendants have collectively manipulated MWC rules, diminished sport opportunities for women, spread inaccurate information, used their positions to chill and suppress speech with which they disagree, and punished dozens of female collegiate volleyball student-athletes for taking a public stand for their right to compete in a separate sports category, all in a concerted effort to stamp out debate over women’s rights in sport,&#8221; the <a href="https://nevadasportsnet.com/newsletter-daily/nevada-volleyball-players-among-those-suing-mountain-west-san-jose-state-officials">lawsuit read</a>.
&#8220;The NCAA, Mountain West Conference, and college athletic directors around the country are failing women,&#8221; Bill Bock, lead attorney for the plaintiffs and the pro-woman organization <a href="https://www.iconswomen.com/">Independent Council On Women&#8217;s Sport</a> (ICONS), which is funding and backing the lawsuit, said.
&#8220;Because the administrators don’t have the courage to do their jobs, we have to ask the federal courts to do their jobs for them,&#8221; he added.
The lawsuit requests emergency injunctive relief in advance of the MW women&#8217;s volleyball tournament in Las Vegas, which starts on Nov. 27. It also calls on either disqualifying SJSU and Fleming from competing in the tournament and/or removing the losses from the records of teams who forfeited SJSU games and therefore the wins from SJSU.
Five schools have forfeited playing SJSU in protest of the biologically male star player on the CA team. Suspended <a href="https://www.dailywire.com/topic/san-jose-state">San Jose State University</a> women’s <a href="https://www.dailywire.com/topic/volleyball">volleyball</a> associate head coach <a href="https://sjsuspartans.com/staff/melissa-batie-smoose">Melissa Batie-Smoose</a> said that “safety is being taken away from women” and has continued to speak out against a trans-identifying male, Blaire Fleming, on the team.
&#8220;Safety is being taken away from women,&#8221; Batie-Smoose told Fox News’ “<a href="https://www.foxnews.com/sports/suspended-san-jose-state-coach-embroiled-transgender-controversy-sounds-alarm-womens-sports">America Newsroom</a> on Monday. &#8220;Fair play is taken away from women. We need more and more people to do this and fight this fight because women’s sports, as we know it right now, will be forever changed.&#8221;
Batie-Smoose was suspended indefinitely from her job when she took the side of the women on the team who didn’t want to play with the biological male player, after she filed a Title IX complaint against her school.
In the complaint, the suspended coach alleged that the trans-identifying male player “conspired with an opponent to help the team lose a match and injure teammate <a href="https://www.dailywire.com/news/ncaa-volleyball-player-says-coaches-repeatedly-assigned-her-to-room-with-trans-player-at-his-request">Brooke Slusser</a>,&#8220; who has spoken out about the inclusion of trans players in women’s sports, the <a href="https://nypost.com/2024/11/05/sports/san-jose-state-players-dont-feel-safe-anymore-in-transgender-drama/">New York Post</a> noted.
After the suspension came down on November 2, SJSU released a statement that the associate head coach of the women’s team “is not with the team at this time, and we will not provide further information on this matter,&#8221; <a href="https://www.outkick.com/sports/suspended-sjsu-volleyball-coach-batie-smoose-safety-women">OutKick</a> reported.

Batie-Smoose said following news of the discipline, &#8220;This is just another form of what San Jose State has been trying to do – silence people that are speaking up for their First Amendment rights and for what&#8217;s right,” the outlet noted.
Slusser later reacted to Batie-Smoose&#8217;s suspension and said the women on the team “aren’t happy and we don’t feel safe anymore,” <a href="https://www.outkick.com/sports/exclusive-brooke-slusser-sjsu-ruined-volleyball-batie-smoose">OutKick</a> reported. “Melissa was that person that we felt like as long as she was there, we had someone that would stand up for us. And now there’s no one there that will.”

“I don’t think the school sees how much they just basically ruined this program by taking Melissa away from us,” she added. “So, who knows what’s to come in the future [with regard] to what our team will do or how we will react from this.”

UNR was initially resistant to canceling its women’s volleyball match after members of UNR’s women’s team refused to play against SJSU and Fleming.
“We, the University of Nevada Reno women’s volleyball team, forfeit against @SJSU and stand united in solidarity with the volleyball teams of Southern Utah University, Boise State University, the University of Wyoming, &amp; Utah State University,” the statement read in part, as previously <a href="https://www.dailywire.com/news/5th-womens-volleyball-team-nixes-game-against-college-with-trans-identifying-star-player">reported</a>.

University of Nevada Reno finally canceled a women’s volleyball match after members refused to play against a team with a trans-identifying male player.
“Due to not having enough players to compete, the University of Nevada women’s volleyball team will not play its scheduled Mountain West Conference match at San José State,” a <a href="https://nevadawolfpack.com/news/2024/10/24/womens-volleyball-statement-from-nevada-athletics-regarding-volleyball.aspx?fbclid=IwZXh0bgNhZW0CMTEAAR2rd7vbzNb7_rj1tGG0XY-MEW1Pp-5Y_ZUZ-I_z6hWW3K0nZwgaPCfzsVQ_aem_2pyx3TNkWGggLgc8iPiU5w">statement</a> from UNR read, ahead of the match on Tuesday, October 29. “Per Mountain West Conference policy, the match will be recorded as a loss for Nevada.&#8221;
The game was originally set to take place on Oct. 26th, but both schools had agreed to move the game to the 29th and to the Spartans&#8217; home “in the best interest of both programs,” after UNR’s women’s team refused to play against SJSU and its trans-identifying male player.
Initially, the UNR women’s volleyball team released a statement making it the fifth school to forfeit a match against the SJSU women’s volleyball team because the star player is a male.

Also included in their statement was the girls&#8217; demand “that our right to safety and fair competition on the court be upheld. We refuse to participate in any match that advances injustice against female athletes.”
Later, the university released its own statement showing it did not support the move by the women’s team, saying that the school was about “providing an inclusive and supportive environment” and claiming that the prior statement was made “independently and without consultation” with the school.

Last week, volleyball captain Sia Liilii promoted a &#8220;Women&#8217;s Sports Are For Women Only&#8221; event to be held on the campus on Saturday, the day of the initially scheduled game, The Las Vegas Review-Journal <a href="https://www.reviewjournal.com/sports/unlv/other-sports/unr-cancels-volleyball-match-amid-transgender-controversy-3196043/amp/">noted</a>.
&#8220;I feel in that meeting that we had where our university told us that we would have to play it,&#8221; Liilii said <a href="https://www.outkick.com/sports/riley-gaines-leads-rally-university-nevadas-captain-sia-liilii-protect-sports-women">after the event</a>. &#8220;I felt like I just had no air, like I was being actively silenced.&#8221;

University of <a href="https://www.dailywire.com/topic/nevada" target="_blank" rel="noopener">Nevada</a>, Reno, is facing backlash over its refusal to support its women’s volleyball team, which had announced it would not be playing against San Jose State University&#8217;s <a href="https://www.dailywire.com/topic/womens-sports" target="_blank" rel="noopener">women&#8217;s team</a> because of its trans-identifying male player.
It started when the UNR women’s volleyball team released a statement that made it the fifth university to forfeit its game against SJSU because the California school’s team’s star player is a male.
“We, the University of Nevada Reno women’s volleyball team, forfeit against @SJSU and stand united in solidarity with the volleyball teams of Southern Utah University, Boise State University, the University of Wyoming, &amp; Utah State University,” the statement read in part, as previously <a href="https://www.dailywire.com/news/5th-womens-volleyball-team-nixes-game-against-college-with-trans-identifying-star-player">reported</a>.
The statement included that the girls demanded “that our right to safety and fair competition on the court be upheld. We refuse to participate in any match that advances injustice against female athletes.”

Later, the university released a statement showing it did not support the move by the women’s team, saying that the school is about “providing an inclusive and supportive environment,” claiming the prior statement was made “independently and without consultation” of the school.

Former collegiate swimmer and outspoken advocate for women’s sports <a href="https://www.dailywire.com/topic/riley-gaines" target="_blank" rel="noopener">Riley Gaines</a> slammed the <a href="https://x.com/Riley_Gaines_/status/1845951765226614965">response</a> by the university, first sharing the statement and then calling it “INSANE.”

Wyoming is the third school to forfeit its game against the team with the trans-identifying male in order to protect its female players from a serious injury, as previously <a href="https://www.dailywire.com/news/boise-state-womens-volleyball-forfeits-game-to-protect-players-from-trans-opponent-report">reported</a>. 
On Friday, the Boise women’s volleyball team announced that it would forfeit its match over the weekend against SJSU, following Southern Utah, which was the first school to refuse to play against SJSU in a non-conference match as part of the Santa Clara Tournament, OutKick <a href="https://www.outkick.com/sports/wyoming-boise-state-southern-utah-san-jose-state-volleyball-blaire-fleming">noted</a>.
“Boise State volleyball will not play its scheduled match at San José State on Saturday, Sept. 28,” the team said in a statement. “Per Mountain West Conference policy, the Conference will record the match as a forfeit and a loss for Boise State.”
On social media, the team received overwhelming support.
“I applaud @BoiseState for working within the spirit of my Executive Order, the Defending Women’s Sports Act,” Governor Brad Little said. “We need to ensure player safety for all of our female athletes and continue the fight for fairness in women’s sports.”

The North Carolina player said she was knocked unconscious with a concussion and a neck injury and spent months recovering. She also missed the rest of her volleyball season.

McNabb was responding to a clip of Rep. Pramila Jayapal, (D-WA) tearfully claiming that trans-identifying people are not &#8220;doing anything to harm you&#8221; during a heated clash with Republicans at a committee hearing.
&#8220;Why are you doing this? It is a tiny portion of people across the country that identify as trans, and not a single one of them is doing anything to harm you or your family,&#8221; Jayapal asked during Thursday&#8217;s House Judiciary Committee hearing on the Protection of Women in Olympic and Amateur Sports Act.
Jayapal has a son who identifies as a transgender female.
&#8220;It is appropriate for us to have emotional responses about our children,&#8221; the congresswoman said.

Three trans-identifying players on Seneca and two on Centennial were on the court for the entire game, and Seneca ended up taking the victory, Rebel News reported.
Multiple other outlets, including <a href="https://nypost.com/2024/02/07/news/video-allegedly-showing-five-trans-players-playing-in-womens-volleyball-game-sparks-outrage/" target="_blank" rel="noopener">The New York Post</a>, <a href="https://www.foxnews.com/sports/canadian-womens-college-volleyball-game-features-at-least-2-trans-athletes" target="_blank" rel="noopener">Fox News</a>, and <a href="https://www.theblaze.com/news/5-men-womens-volleyball-game" target="_blank" rel="noopener">The Blaze,</a> also reported on the Canadian volleyball match dominated by men who identify as women.
Menzies said he attended the volleyball game after getting a tip from a female volleyball “insider” who was concerned that “the situation is so dire that it is no longer safe for biological women to compete.” Rebel News reported that the source alleged that there had been two recent head injuries to female players caused by trans-identifying men competing in the Ontario Colleges Athletic Association (OCAA), the league that includes Seneca and Centennial.

Last week, the OCAA <a href="https://www.ocaa.com/sports/general/2023-24/releases/02022024ocaafaq" target="_blank" rel="noopener">published</a> a fact sheet that included answering questions on trans-identifying athletes, saying that it “is aware that participation of transgender student-athletes has recently received public attention.”
The fact sheet directs readers to the OCAA’s <a href="https://www.ccaa.ca/safe_sport/CCAA_Transgender_CADP_Guidance_Document.pdf" target="_blank" rel="noopener">transgender policy</a>, which states: “Student-athletes may compete on the sport team that corresponds with either their sex assigned at birth or their gender identity, provided that at all times student-athletes are in compliance with the Canadian Anti-Doping Program.”
The OCAA fact sheet added, “Any policies that would prohibit the participation of transgender student-athletes within the OCAA would be a violation of the Ontario Human Rights Code.”
Throughout Rebel News’ attempt to report on the volleyball game, Menzies said he and his crew were confronted by facility staff and security guards who said he could stay and watch but couldn’t record the event. After the game, the reporter asked Centennial coach Andrew Mallory why he allowed male players to compete on his team. Mallory responded, “I’m not.”

Seneca, the team that reportedly has three trans-identifying players, currently leads the <a href="https://www.ocaa.com/sports/wvball/index" target="_blank" rel="noopener">standings</a> in the OCAA’s East division with a 17-1 record.
The Ontario collegiate volleyball game is the latest in a string of stories about trans-identifying men <a href="https://www.dailywire.com/news/here-are-the-men-who-have-dominated-womens-sports" target="_blank" rel="noopener">dominating women’s sports</a> just in the past few weeks. Last month, Hailey Davidson, a man who identifies as a woman, <a href="https://www.dailywire.com/news/trans-identifying-golfer-wins-womens-tournament-inches-closer-to-spot-on-lpga-qualifier" target="_blank" rel="noopener">placed first</a> in the NXXT women’s golf tournament in Florida, inching himself closer to an LPGA qualifying tour. Trans-identifying track athlete Sadie Schreiner also <a href="https://katv.com/news/nation-world/transgender-runner-breaks-two-womens-records-for-new-york-college-sparking-debate-rochester-institute-of-technology-track-and-field-sprint-athlete-sports-ncaa-lgbt" target="_blank" rel="noopener">made headlines</a> last month after setting two new records for the Rochester Institute of Technology. Schreiner also received the Liberty League Women&#8217;s Track &amp; Field Performer of the Week award.
