Recently retired Supreme Court Justice Stephen Breyer landed a new job late last week following his 42 years serving as a federal judge.
Breyer is returning to his alma mater, Harvard University, where he has been named the Byrne Professor of Administrative Law and Process at Harvard Law School, effective immediately.
The school said in a statement that Breyer will &#8220;teach seminars and reading groups, continue to write books and produce scholarship, and participate in the intellectual life of the school.&#8221;
John F. Manning, the Morgan and Helen Chu Dean and Professor of Law, called Breyer a &#8220;historic jurist and a world-class legal scholar who also has a distinguished history as a member of this faculty.&#8221;
&#8220;I am thrilled to welcome him home to Harvard Law School,&#8221; Manning added. &#8220;His brilliance, experience, collegiality, openness, and intellectual inquisitiveness will deeply enrich our community and advance our mission of teaching, scholarship, and service.&#8221;
Breyer said in a statement that he was happy to return to the school and he looks forward to teaching and writing.
“Among other things, I will likely try to explain why I believe it important that the next generations of those associated with the law engage in work, and take approaches to law, that help the great American constitutional experiment work effectively for the American people,” he said.
News broke back in January that Breyer would be stepping down from his role on the nation&#8217;s highest court, which subsequently gave Democrat President Joe Biden his first chance to nominate a Supreme Court justice.
Biden wasted no time in creating controversy during his selection process, stating that he would effectively discriminate by making a selection based on sex and race.
“The person I nominate to replace Justice Breyer will be someone with extraordinary qualifications. Character, experience, and integrity,” Biden said at the time. “And they will be the first black woman nominated to the United States Supreme Court.”
Biden nominated Ketanji Brown Jackson to the nation&#8217;s highest court and after surviving her confirmation hearings, she was sworn in last month.
“With a full heart, I accept the solemn responsibility of supporting and defending the Constitution of the United States and administering justice without fear or favor, so help me God,” Jackson <a href="https://www.dailywire.com/news/ketanji-brown-jackson-sworn-in-as-supreme-court-justice">said</a> in a statement. “I am truly grateful to be part of the promise of our great Nation.”
“I extend my sincerest thanks to all of my new colleagues for their warm and gracious welcome,” she continued.

&#8220;It has been my great honor to participate as a judge in the effort to maintain our Constitution and the Rule of Law,&#8221; <a href="https://dailywire.com/news/president-biden-hands-face-mask-to-justice-breyer-internet-freaks-out/">Breyer</a> said in a letter addressed to President Joe Biden.
&#8220;This past January, I wrote to inform you of my intent to retire from regular active service as an Associate Justice of the Supreme Court of the United States, upon the Court rising for its summer recess,&#8221; he wrote.
&#8220;You have nominated and the United States Senate has confirmed the Honorable Ketanji Brown Jackson to succeed me in the office, and I understand that she is prepared to take the prescribed oaths to begin her service as the 116th member of this Court.&#8221;

Judge Ketanji Brown Jackson will replace Breyer, as the justice noted in his letter to the president. She <a href="https://www.washingtonpost.com/lifestyle/2022/05/16/ketanji-brown-jackson-interview/">was interviewed</a> by The Washington Post in mid-May and was asked whether she condemned the <a href="https://www.dailywire.com/news/leftist-activists-demonstrate-outside-justice-alitos-virginia-home">protesting</a> at the justices&#8217; <a href="https://www.dailywire.com/news/pro-abortion-protestors-march-at-justice-amy-coney-barretts-home-with-blood-and-doll-props">homes</a>.
&#8220;I don’t have any comment,&#8221; she responded.
“I can’t answer that,” <a href="https://dailywire.com/news/im-not-a-biologist-supreme-court-nominee-says-she-cant-define-the-word-woman/">Jackson</a> added, asked if leaking the draft opinion “was a good thing or a bad thing.”
Her confirmation to the Court was <a href="https://demandjustice.org/ketanji-brown-jackson/">backed by Demand Justice</a>, an organization that <a href="https://www.dailywire.com/news/smear-campaign-leftist-activists-seek-to-intimidate-justices-control-the-court-experts-say">reportedly has ties</a> to the influential progressive dark money group <a href="https://www.theatlantic.com/politics/archive/2021/11/arabella-advisors-money-democrats/620553/">Arabella Advisors</a>, which advocates for court packing and has repeatedly orchestrated campaigns to sway the justices on high-profile cases.
When the draft Supreme Court opinion overturning Roe v. Wade was leaked in May, Demand Justice Executive Director Brian Fallon praised the unprecedented leak, <a href="https://twitter.com/brianefallon/status/1521377663134453760">saying</a>, “SCOTUS leaks are good. Elite lawyers on both the left and right treating the Court as precious all these years have just been giving cover to an institution that is wholly unaccountable. Rip the veil off.”
“All Democrats need to show the same urgency as the clerk who apparently risked his or her career to sound this alarm,” he <a href="https://twitter.com/brianefallon/status/1521296266264817667">continued</a>. “Those on the inside know best how broken the institution is. We should listen.”
Demand Justice <a href="https://demandjustice.org/demand-justice-launches-breyer-retire-push-on-anniversary-of-stevens-retirement/">launched</a> an April 2021 campaign to pressure Breyer to step down and make way for the first black female Supreme Court justice (Jackson<a href="https://thehill.com/regulation/court-battles/547355-progressive-group-ramps-up-pressure-on-justice-breyer-to-retire?rl=1"> was already considered</a> the top candidate at the time).
Fallon, a former top aide to Senate Majority Leader Schumer (D-NY), <a href="https://thehill.com/regulation/court-battles/547448-biden-will-let-breyer-decide-when-to-retire-aide-says/">insisted</a> in April 2021 that it was “worrisome that Justice Breyer has not said yet that he will step down,&#8221; according to The Hill.
The group’s campaign for Breyer to retire was accompanied by <a href="https://www.politico.com/news/2021/04/14/stephen-breyer-retirement-supreme-court-481197">pressure</a> from Democratic politicians, including <a href="https://www.washingtonpost.com/local/legal-issues/biden-judicial-nominees-supreme-court-breyer/2021/04/23/eb770fec-a2fc-11eb-85fc-06664ff4489d_story.html">Sen. Richard Blumenthal</a> (D-CT) and <a href="https://www.cnn.com/2021/06/14/politics/alexandria-ocasio-cortez-stephen-breyer-scotus/index.html">Rep. Alexandria Ocasio-Cortez</a> (D-NY).
And when Breyer <a href="https://www.dailywire.com/news/highly-unusual-new-development-on-supreme-court-justice-stephen-breyers-retirement-raises-questions">finally announced</a> his retirement in January, Demand Justice’s Supreme Court blog <a href="https://ballsandstrikes.org/scotus/stephen-breyer-retiring-huzzah/">published</a> a piece that credited Breyer’s retirement to being “shamed by your tweets.”

Senate Minority Leader Mitch McConnell shut down a question about whether or not he had enough black women on his staff to effectively help him navigate the process surrounding President Joe Biden&#8217;s imminent <a href="https://dailywire.com/news/ben-carson-slams-bidens-race-based-supreme-court-pledge-as-abominable-identity-politics/">Supreme Court nomination</a>.
The question, which was posed by Latino Rebels correspondent Pablo Manriquez, was highlighted by Forbes in a tweeted video clip on Tuesday afternoon:

&#8220;How many Black women do you have on staff and how are they informing your decision to move forward with the SCOTUS nomination?&#8221; Manriquez asked, adding that he&#8217;d also like to have the same question answered by the other senators who were present at the press conference.
&#8220;How many what?&#8221; McConnell asked. Twice, the Republican leader asked Manriquez to repeat the question, finally suggesting that he remove his mask so that everyone could better hear what he was asking.
&#8220;How many Black women do you have on staff and how are they informing your decision to move forward with the SCOTUS nomination?&#8221; Manriquez removed his mask and asked for the third time.
&#8220;Yeah — Actually, I haven&#8217;t checked. We don&#8217;t have a racial quota in my office. But I&#8217;ve had a number of African American employees, both male and female, over the years in all kinds of different positions, including speechwriter,&#8221; McConnell&#8217;s response was matter-of-fact.
Manriquez appeared to be implying that unless he was being advised by black women, McConnell would not be equipped to navigate the Supreme Court confirmation process of <a href="https://dailywire.com/news/progressives-demand-biden-pick-supreme-court-nominee-based-on-race-and-sex-select-first-black-female-justice/">Biden&#8217;s eventual nominee</a> — whom the president has promised will be a black woman.
The Independent&#8217;s Washington correspondent Eric Michael Garcia responded to critics — who attacked McConnell, claiming he didn&#8217;t know how many black female staffers he had because he <a href="https://twitter.com/BCDreyer/status/1488683584076623877">didn&#8217;t have any</a> — in a series of tweets.
&#8220;It&#8217;s easy to call out Mitch McConnell for his lack of Black women on his staff, but if you follow @Dear_White_Staffers on Instagram, you would know that some of y&#8217;all&#8217;s progressive favs do even worse when it comes to hiring Black women,&#8221; Garcia <a href="https://twitter.com/EricMGarcia/status/1488601732519235590">began</a>.
&#8220;Incidentally, I don&#8217;t know of Black women but I DO know Daniel Cameron, who is Kentucky&#8217;s Attorney General and a Black man, is a former McConnell legal counsel,&#8221; Garcia <a href="https://twitter.com/EricMGarcia/status/1488600792705687560">added</a>.
President Biden is expected to announce a nominee to replace retiring Supreme Court Justice Stephen Breyer — who will step down at the end of the court&#8217;s current session this summer — in the coming weeks, and he has promised several times that he will nominate the first black woman to fill Breyer&#8217;s seat.

At any rate, what — what we’re going to do, as I’ve said before — and I went back and looked at some of the opening statements that I made for justices over the years that, you know, it’s — the Constitution says “advise and consent” — “advice and consent.”  And I’m serious when I say it: that I want the advice of the Senate as well as the consent, if we can arrive on who the nominee should be.
And, you know, it’s — there’s always a renewed national debate every time we nominate — any President nominates a justice, because the Constitution is always evolving slightly in terms of additional rights or curtailing rights, et cetera.  And it’s always an issue.  And there’s several schools of thought in terms of judicial philosophy.  And we’ll see. 
But the fact is that I’m looking for someone who I can — this is not a static issue; it flows back and forth.  What I’m looking for is a candidate with character; with the qualities of a judge, in terms of being courteous to the folks before them and treating people with respect; as well as a judicial philosophy that is more of one that suggests that there are unenumerated rights in the Constitution, and all the amendments mean something, including the Ninth Amendment. 
And — but I intend to take this decision — to make this decision and get it to my colleagues by — by the end of the month.  That’s my hope.
And — and I’m looking forward to their advice in how to proceed and how the hearings will be conducted and the like.

Critics have suggested that by limiting the field of potential nominees to one specific race and one specific gender, Biden has made the selection process both sexist and racist.

&#8220;Supreme Court hearings could also blunt that enthusiasm problem, serving as a reminder to Democrats that elections have consequences and they matter,&#8221; Todd said, adding, &#8220;And getting a Supreme Court nominee confirmed would give Mr. Biden a political win after the disappointments of the last few months over voting rights and Build Back Better.&#8221;
Todd went on to note that replacing Justice Breyer, a fairly reliable liberal vote on most issues, would do little — if anything — to change the overall balance of the court, but that might not matter if he could <a href="https://dailywire.com/news/we-need-to-change-that-biden-team-plans-public-reset-to-rescue-president-from-plummeting-polls/">change the narrative</a> surrounding his administration.
&#8220;Mr. Biden finally has an open field with a real chance to put some points on the board — and at least temporarily change the narrative of his presidency,&#8221; he concluded.
Biden&#8217;s plan to follow through on his promise has been met with criticism from a number who feel that it is both racist and sexist if the president refuses to consider anyone who does not first check the designated demographic boxes of &#8220;black&#8221; and &#8220;female.&#8221;
Others, like &#8220;The View&#8221; host Sunny Hostin, have said that it&#8217;s important for Biden to keep his promise because it would shore up his support among black women voters.

The tweet appeared to be a reference to conservatives who criticized President Joe Biden&#8217;s <a href="https://dailywire.com/news/progressives-demand-biden-pick-supreme-court-nominee-based-on-race-and-sex-select-first-black-female-justice/">promise</a> to nominate the first black woman to the Supreme Court — a promise he reiterated when Justice Stephen Breyer <a href="https://dailywire.com/news/im-an-optimist-justice-breyer-pulls-out-pocket-constitution-says-he-believes-american-experiment-will-prevail/">officially announced</a> his retirement this week.
Following that announcement, a number of people <a href="https://dailywire.com/news/biden-slammed-after-he-commits-to-racial-and-sex-discrimination-in-choosing-supreme-court-justice/">criticized Biden</a>, suggesting that he could have simply quietly chosen black woman who was highly qualified — and that by placing the focus on her race and gender, he had raised the possibility that he was fulfilling a quota rather than choosing based primarily on professional qualifications.
MSNBC&#8217;s tweet appeared to take a position similar to the one taken earlier in the week by Ana Navarro on ABC&#8217;s &#8220;The View&#8221; when she suggested that conservatives engaged in &#8220;identity politics&#8221; when they chose fellow conservatives for certain jobs, arguing that choosing people based on their similar ideological identities was no different than choosing people based on race or gender.
&#8220;All politics is &#8216;identity politics,'&#8221; she said during Friday&#8217;s broadcast of the midday talk show, arguing that everyone — regardless of race, gender or creed — wanted to vote for someone with whom they identified in some way.
&#8220;Why is putting a black woman &#8216;identity politics&#8217; but putting a conservative, who you agree with ideologically, not &#8216;identity politics&#8217;?&#8221; she asked, adding that it was &#8220;hypocritical&#8221; for people to suggest that race and gender were the only factors that influences &#8220;identity politics.&#8221;

‘Reel In Your Interns’: MSNBC Slammed For Tweet Openly Attacking Conservatives

During Thursday’s briefing, White House Press Secretary Jen Psaki was <a href="https://www.whitehouse.gov/briefing-room/press-briefings/2022/01/27/press-briefing-by-press-secretary-jen-psaki-january-27-2022/">asked</a> by a reporter about President Joe Biden’s pledge to nominate a black woman to the Supreme Court as Justice Stephen Breyer has announced his upcoming retirement.
After noting that some conservative commentators are calling Biden’s pledge a kind of “reverse racism” and “virtue signaling,” the reporter asked: “What do you say to people who are saying that that is, you know, an inappropriate way to set out prerequisites for who he’s going to choose?”
Psaki responded, first saying that a black woman having never been nominated “shows a deficiency of the past selection processes.”
She then pivoted to whataboutism, pointing to President Ronald Reagan’s <a href="https://www.archives.gov/legislative/features/oconnor.html">promise</a> to nominate a woman to the Supreme Court in 1980, quoting from his September 1981 <a href="https://www.reaganlibrary.gov/archives/speech/statement-senate-confirmation-sandra-day-oconnor-associate-justice-supreme-court">statement</a> upon the Senate confirmation of Sandra Day O’Connor:
<blockquote>…when he nominated Sandra Day O’Connor he said, “Judge O’Connor’s confirmation symbolizes the richness of opportunity that still abides in America — opportunity that permits persons of any sex, age, or [any] race, from every section and every walk of life to aspire and achieve in a manner never before even dreamed about in human history.”</blockquote>
Lastly, Psaki claimed that Biden has nominated “the highest number of black women to serve on the circuit court and the appellate court,” and that “he has also nominated … the highest level of Ivy League nominees.”
“He has nominated a broad sway of extremely qualified, experienced, and … credentialed nominees, and done that by also making them incredibly diverse,” Psaki concluded.
Regarding the whataboutism, legal scholar Jonathan Turley <a href="https://www.foxnews.com/opinion/biden-supreme-court-reagan-trump-jonathan-turley">wrote</a> in a recent op-ed that the comparison between Reagan and Biden isn’t even apt:
<blockquote>Various commentators insisted that Biden did exactly what Reagan did in 1980 when he pledged to appoint a woman to the Court. The comparison, however, shows the opposite. Reagan did not exclude anyone other than women in being considered while making clear that he wanted to give one of his vacancies to a female candidate.</blockquote>
Turley added: “Reagan never pledged to only consider women and in fact considered non-female candidates. One of the leading contenders was considered Judge Lawrence Pierce, an African American trial court judge.”

I’d also note, if you look at the president’s own record, not only has he nominated the most — the highest number of black women to serve on the circuit court and the appellate court, but he has also nominated, across the board, the highest level of Ivy League nominees, right? He has — he has qual- — he has nominated a broad sway of extremely qualified, experienced, and credential nominees — credentialed nominees, and done that by also making them incredibly diverse.
And so the president’s view is that it is long past time to have a black woman on the Supreme Court, and that it, again, reflects challenges or deficiencies in the past processes.</blockquote>

Psaki Uses Whataboutism To Justify Biden’s Pledge To Only Consider A Black Woman For SCOTUS

Wednesday’s announcement by Supreme Court Justice Stephen Breyer that he would be retiring at the end of the court’s current session has raised the obvious question of how contentious the battle over his replacement will be.
One thing is almost certain to be true: No matter who is nominated by President Joe Biden, there will be no 87-9 favorable vote – the tally when Breyer was nominated by Bill Clinton in 1994. Though there were occasional exceptions in the decade prior to Breyer, his vote totals were not unusual in that era. Antonin Scalia was approved 98-0, Anthony Kennedy 97-0, and Ruther Bader Ginsburg 96-3. However, no Supreme Court nomination since Breyer’s has received fewer than 22 negative votes, the number against Chief Justice John Roberts in 2005.
That was the year Democratic Senator Chuck Schumer (now majority leader) urged that senators should vote explicitly on the basis of candidates’ ideology rather than simply their qualifications. In reality, ideology had been the primary driving factor behind the rejection of Robert Bork’s nomination in 1987 and the tough, though ultimately successful, fight over Clarence Thomas’ nomination in 1991, but most opposing senators had attempted to preserve the fiction that judicial temperament or scandals were behind their “no” votes. Schumer opened the door to unabashed ideological and partisan warfare, and subsequent votes on Supreme Court nominations have shown it.
Since Roberts’ confirmation, there have been 42 votes against Samuel Alito, 31 and 37 against justices Sotomayor and Kagan, 45 against Neil Gorsuch, and 48 against both Brett Kavanaugh and Amy Coney Barrett. This does not count the case of Merrick Garland, whose nomination was entirely stymied. It is highly likely in the current atmosphere that the next nominee will wind up with a closely divided, nearly party-line vote.
However, there are close votes, and then there are deeply contentious confirmation fights. Clarence Thomas and Samuel Alito had the same number of negative votes, but Thomas’ confirmation fight was much more bitter. Likewise, Kavanaugh and Barrett both had 48 votes against them at the end of the day, but Barrett moved through her confirmation process with an ease Kavanaugh had to envy.
There are a few metrics that analysts will be tempted to use to predict how contentious the fight might become, but none of them are very satisfactory.
Perhaps, some might say, the fact that this is an election year will crank up the contention. There is a logic to this, insofar as senators will be looking to score political points and may be less likely to smooth the way for a nominee. However, many will also be looking to strengthen their personal reelection prospects or to advance their party’s chance of maintaining or attaining a majority. How the confirmation debate will fit into those goals will depend on who Biden nominates and how the public reacts. Kavanaugh and Barrett were both nominated in an election year, as was Garland. But Bork and Thomas were not.
The argument might also be made that this nomination will be less contentious than some others because Biden, a Democrat, will be nominating a replacement for Breyer, who was also the nominee of a Democratic president and one who has hewed pretty consistently to a liberal line. In defense of this proposition, one can point to particularly bitter fights over Bork, who was perceived to represent a shift to the right from his swing-vote predecessor; Thomas, who replaced liberal stalwart Thurgood Marshall; and Kavanaugh, who was appointed to replace swing-vote Kennedy. Garland’s nomination was tanked because a Republican Senate was unwilling to replace the conservative Scalia with an Obama appointee, especially so close to a presidential election.
However, here, too, there are counterexamples. Barrett, who was perceived to be a strong conservative, was nominated to replace feminist heroine Ruth Bader Ginsburg. The vote was very close, but the temperature was significantly lower than in some other cases. For her part, Ginsburg, with her 96-3 confirmation, shifted the court significantly to the left by replacing Byron White, a Kennedy appointee but one who had dissented in Roe v. Wade and otherwise frequently took a conservative stance.
Others might suggest that the age of the nominee makes a difference. The younger the nominee, the longer he or she will be on the bench if confirmed; the longer his or her projected tenure, the higher the stakes. At the time, some pointed to Clarence Thomas’ young age as an explanation for the harsh campaign that ultimately developed against him. But Bork and Garland, the two nominees who were actually stopped by the Senate, were quite a bit older than Thomas.
So how can we tell if Biden’s Supreme Court nomination is going to provoke a bitter fight, as opposed to just a close vote, which is likely in any case? The short answer is that it may not be possible to predict at this point. There are no hard and fast rules. It will depend on the strengths and weaknesses of the candidate, and on how quickly Joe Manchin and Kyrsten Sinema pledge their votes to the nominee. If they are locked in early, Republican opposition may become pro-forma, even if it is unanimous or nearly unanimous. If either senator lingers, though, the opposition may smell blood in the water, and the confirmation battle could get ugly. The one thing none of the confirmation battles of the last three decades have had? A 50-50 Senate.

Will The Battle To Replace Breyer Be Bitter, Or Just Close?

President Joe Biden wrapped up his joint appearance Thursday alongside retiring Supreme Court Justice Stephen Breyer by announcing that he was not going to take any questions and handing a folded face mask to Breyer.
Biden and <a href="https://dailywire.com/news/im-an-optimist-justice-breyer-pulls-out-pocket-constitution-says-he-believes-american-experiment-will-prevail/">Breyer</a> appeared together to formally announce the latter&#8217;s intent to retire at the end of the Supreme Court&#8217;s current session — news that was <a href="https://dailywire.com/news/highly-unusual-new-development-on-supreme-court-justice-stephen-breyers-retirement-raises-questions/">leaked on Wednesday</a> — and <a href="https://dailywire.com/news/biden-slammed-after-he-commits-to-racial-and-sex-discrimination-in-choosing-supreme-court-justice/">Biden</a> used the opportunity to also announce his plan to follow through on his campaign promise to nominate the first black woman to the high court.
After giving Breyer a chance to speak, Biden wrapped up the event by saying that he did not feel it would be &#8220;appropriate&#8221; to take questions with the justice present.
&#8220;Thank you all so very very much for being here,&#8221; he said, adding, &#8220;I&#8217;m not going to take any questions because I think it&#8217;s inappropriate to take questions with the justice here, he&#8217;s still sitting on the bench and —&#8221;
Biden paused then and turned, handing what appeared to be a folded white face mask to Breyer. The justice, who was wearing a mask at the time, quietly put it in his pants pocket as Biden turned back to the mic. &#8220;And you&#8217;ll have plenty of opportunities to get me later today and through the rest of the week and next week too, thank you very much.&#8221;

Critics quickly mocked Biden, asking how it was following the &#8220;science&#8221; to give what many assumed was his own used mask to Breyer.

But a careful review of video from the beginning of the event suggests that the mask Biden handed off might not have been his own. The president entered the room and walked straight to the lectern, where he removed his black face mask and began to speak. The mask he handed to Breyer later was white and may have been left there by the justice when he gave his remarks.

&#8220;The senior liberal Supreme Court Justice Stephen Breyer will be officially announcing his retirement, and yesterday the White House reiterated Biden’s wish to nominate the first black female justice to fill the vacancy,&#8221; Goldberg began, noting that some had referred to Biden&#8217;s plan to limit his potential nominees by race and gender as &#8220;affirmative action.&#8221;
&#8220;In the 233 years that we have had 115 Supreme Court justices, 111 of them have been white, including three women who have been white. The first black person on the Supreme Court was 1967, Thurgood Marshall,&#8221; Goldberg continued, arguing that it was time for a black woman to sit on the Court.
&#8220;It&#8217;s not exactly overkill,&#8221; co-host <a href="https://dailywire.com/news/joy-behar-its-time-to-tweak-1st-and-2nd-amendments-because-founding-fathers-didnt-have-ar-15s-and-twitter/">Joy Behar</a> agreed.
&#8220;Keeping his promise to the community is very important, and the other thing is, you know, it’s not like there’s a dearth of African American women that aren’t capable and really qualified for this job,&#8221; co-host Sunny Hostin added, noting that Biden was slipping in polls and a move like that could shore up some support especially among black women voters.
&#8220;Considering the uneven kind of court we have right now, it’s so important that this is happening in a time where we can get another liberal, and of course, the representation more than anything, you pointed out, first black woman. There’s only been two black men. Those numbers are a little shocking,&#8221; co-host Sara Haines weighed in then, and Hostin interrupted.
&#8220;One doesn’t really represent the black community,&#8221; she said, taking a veiled jab at Justice Thomas.
&#8220;Oh, Clarence,&#8221; Behar replied.
The panel went on to complain about the number of white men who had been elevated to the federal bench during former President Donald Trump&#8217;s tenure, arguing that President Biden had made a commitment to a more diverse slate of nominees and appeared to be following through on that promise.
The conversation turned toward praise for Breyer stepping down while Biden had time to nominate another liberal justice. &#8220;Isn’t it refreshing that someone like him would give up his lucrative and prestigious job for the country? How unusual it is that these days?&#8221; Behar asked.
As the segment wrapped, Behar turned on Justice Thomas again, adding, &#8220;Clarence Thomas, a black guy, a black man, a justice, okay, I’ll give it to him, he’s a smart guy, but he is to the right of Atilla the Hun, this guy, and they put him in there thinking, oh, a black man will go against voting rights which is what he does.&#8221;
&#8220;It’s terribly disrespectful to appoint someone like Clarence Thomas with his philosophies to the seat of Thurgood Marshall, a Civil Rights activist,&#8221; Hostin complained.
