A federal judge denied &#8220;QAnon Shaman&#8221; Jacob Chansley&#8217;s motion to vacate his January 6 conviction after withheld security footage showed Capitol Police officers appearing to escort him throughout the building.
Prosecutors <a href="https://www.dailywire.com/news/qanon-shaman-jacob-chansley-has-mind-bending-chat-with-michael-knowles" target="_blank" rel="noopener">charged</a> Chansley with multiple crimes, including civil disorder, obstruction of an official proceeding, and entering and remaining in a restricted building. Chansley pleaded guilty to one felony of obstructing an official proceeding and was sentenced to 41 months in prison in November 2021.
After serving 27 months for his involvement in the Capitol riot, the self-proclaimed &#8220;evolutionary&#8221; had his sentence cut short amid the security footage in question aired by ex-Fox News host Tucker Carlson.
Attorney William Shipley, who is representing the former January 6 prisoner, submitted a bid for the court to withdraw and dismiss the case, saying the footage &#8220;would have been favorable to Mr. Chansley at sentencing,&#8221; according to <a href="https://www.politico.com/news/2023/07/20/judge-rejects-qanon-shamans-bid-to-throw-out-jan-6-sentence-00107370" target="_blank" rel="noopener">POLITICO</a>.
“Our main goal was to simply force the government to explain why video evidence was not timely produced during a period defendants like Jake were being detained in custody,” he said. “We still believe the government has not provided a sufficient justification in that regard.”
But U.S. District Judge Royce Lamberth denied the motion in a <a href="https://ecf.dcd.uscourts.gov/cgi-bin/show_public_doc?2021cr0003-127" target="_blank" rel="noopener">35-page opinion</a>, saying Chansley&#8217;s claims &#8220;are without merit.&#8221;
&#8220;In fact, without Mr. Chansley&#8217;s apparently unequivocal acceptance of responsibility, the Court is confident that he would have received a higher sentence,&#8221; Lamberth wrote.
&#8220;In sum, Mr. Chansley cannot demonstrate that either the absence of certain terms in the plea agreement or the presence of the CCTV footage at sentencing would have resulted in even a &#8216;conceivable[] likelihood of a different result,&#8217; much less a &#8216;substantial&#8217; one,&#8221; he added. &#8220;Therefore, he has not established prejudice.&#8221;
Lamberth also criticized the Capitol security footage aired on Carlson&#8217;s &#8220;ill-advised&#8221; program that day, which he said was &#8220;replete with misstatements and misrepresentations&#8221; about the events on January 6.
&#8220;The Court finds it alarming that the host&#8217;s viewers throughout the nation so readily heeded his command,&#8221; he continued. &#8220;But this Court cannot and will not reject the evidence before it.&#8221;

Carlson <a href="https://www.dailywire.com/news/tucker-carlson-releases-january-6-footage-that-raises-new-questions" target="_blank" rel="noopener">released</a> the footage after House Speaker Kevin McCarthy (R-CA) gave the former primetime Fox News host exclusive access to 40,000 hours of video from that day.
&#8220;Virtually every moment of his time inside the Capitol was caught on tape,&#8221; Carlson said during the segment. &#8220;The tapes show the Capitol police never stopped Jacob Chansley. They helped him. They acted as his tour guides.&#8221;
&#8220;Not one of them even tried to slow him down,&#8221; Carlson continued before suggesting that Chansley &#8220;understood that the Capitol police were his allies.&#8221;
Chansley initially issued an apology after he pleaded guilty to his involvement at the Capitol more than two years ago. After being released from prison early, he recently told the BBC he regrets the plea.

Tim Ballard, portrayed by actor Jim Caviezel in the movie as a former government agent who left his job to save one girl from sex traffickers in Colombia and ended up <a href="https://www.deseret.com/2014/10/27/20551368/utah-charity-goes-undercover-to-fight-child-sex-trafficking">saving scores more children</a>, <a href="https://www.foxnews.com/video/6330928406112">told Fox News on Monday</a> there is no justification to accuse the movie of being steeped in <a href="https://www.dailywire.com/news/sound-of-freedom-mocked-as-qanon-adjacent-despite-sex-trafficking-being-non-partisan">conspiracy theories associated with QAnon</a>.
&#8220;I can&#8217;t explain, and neither can they,&#8221; Ballard said. &#8220;Every show I&#8217;ve seen, they just like to throw the word out, &#8216;QAnon.&#8217; They make zero connection to the actual story. It&#8217;s very difficult to make that connection when it&#8217;s actually based on a true story.&#8221;

Ballard asked, &#8220;where is the QAnon doctrine being spewed in the film and the script?&#8221;, and argued that he would know best because he was there for these events that can be confirmed by others.
&#8220;This is just some other agenda &#8230; who would want to get the backs or run interference for pedophiles and human traffickers? That&#8217;s the more important question in all this. Why would you want to lie to push an agenda whose goal is to have children be in captivity? It&#8217;s kind of sick,&#8221; he said.

Jacob Anthony Chansley, perhaps best known by the moniker “QAnon Shaman” after storming the U.S. Capitol on January 6, pleaded guilty on Friday to a federal charge of felony obstruction of an official proceeding.
Chansley, 34, emerged as one of the most recognizable participants from the Capitol breach mainly due to his eccentric costume, which included red, white, and blue face paint and a fur headdress with Viking horns. He also carried an American flag attached to a 6-foot wooden pole, topped with a spearhead.
The Department of Justice had previously identified him as “one of the leaders and mascots of QAnon,” which prosecutors described as a group that “preaches debunked and fictitious anti-government conspiracy theories” that a “deep state” was out to take down the Donald Trump administration.
<a href="https://www.nytimes.com/2021/09/03/us/politics/qanon-shaman-capitol-riot-guilty-plea.html">According</a> to The New York Times, “His plea hearing in Federal District Court in Washington on Friday departed from the circuslike atmosphere that has surrounded the case from the start.” The outlet reported, “He did not speak other than to answer yes-or-no procedural questions.”
Chansley accepted a plea deal that reportedly recommends he spend 41 to 51 months in prison, minus time served for the eight months he has been behind bars. He also agreed to pay $2,000 in restitution for damage to the Capitol. Sentencing is set for November 17.
He was initially <a href="https://www.kmov.com/news/qanon-shaman-hires-st-louis-attorney-al-watkins-seeks-par%5b%E2%80%A6%5ds-invitation/article_2008074e-56b7-11eb-91d3-6f9c640ddaf4.html">charged</a> with civil disorder, obstruction of an official proceeding, disorderly conduct in a restricted building, and demonstrating in a Capitol building.
Albert Watkins, Chansley’s attorney, had <a href="https://www.nytimes.com/2021/01/17/nyregion/protesters-blaming-trump-pardon.html">said in January</a> that Trump was partly responsible for inciting supporters to attack the Capitol.
The Times reported, Watkins “said that Mr. Chansley had repudiated the QAnon cult and would like to be known merely as a shaman, not the QAnon shaman,” and:
<blockquote>At a news conference after the hearing, Mr. Watkins told reporters that Mr. Chansley had been under pressure from his family not to plead guilty. His family, Mr. Watkins said, believed that Mr. Trump was going to be reinstated as president and could issue Mr. Chansley a pardon — a baseless theory of the sort once promoted by QAnon that continues to circulate among some Trump supporters.
“It took a lot of courage for a young man who was raised by his mother to say, ‘No,’” Mr. Watkins said.
With Mr. Chansley’s plea, 51 of the roughly 600 people who have been charged in connection with the riot have entered guilty pleas, most for misdemeanor offenses like disorderly conduct. At least another 11 defendants are scheduled to plead guilty by the end of October.</blockquote>
Chansley, also known as Jake Angeli, was taken into custody on January 9 in his home state of Arizona. Federal prosecutors had <a href="https://int.nyt.com/data/documenttools/chansley-government-brief/adbfa4ed28d4d733/full.pdf">cited</a> “Chansley’s own words and actions at the Capitol” as proof of a plot “to capture and assassinate elected officials in the United States Government.” They said he “acted on conspiracy theories” and referenced a “threatening” note he reportedly left on the Senate Chamber dais, where then-Vice President Mike Pence had been presiding just minutes before.
“It’s only a matter of time, justice is coming,” the note read. Chansley said it was not intended to be a threat.
The Washington Post <a href="https://www.washingtonpost.com/local/legal-issues/capitol-riot-arrest-officer-handshake/2021/01/15/0c3dd658-5748-11eb-a08b-f1381ef3d207_story.html">reported</a>, however, that Assistant U.S. Attorney Todd Allison later asked that the line in the court document alleging rioters sought “to capture and assassinate elected officials” be stricken from the record. Allison said at the time that it “may very well be appropriate at a trial” but could “mislead the court by discussing the strength of any specific evidence” related to Chansley’s intentions.

‘QAnon Shaman’ Pleads Guilty To Felony In U.S. Capitol Breach

A Virginia county planning commission will vote Wednesday on restrictions that would ban residents from flying American flags larger than six feet by four feet and from displaying more than two flags.
The Planning Commission of Fairfax County, a 1.1 million-person jurisdiction just outside Washington, D.C., is weighing a plan by staff to limit the size of flags that homeowners may fly to 24 square feet, lower the maximum height of flagpoles to 25 feet, and limit the number of flags to two.
Zoning administrator Leslie Johnson <a href="http://video.fairfaxcounty.gov/player/clip/1991?view_id=10&amp;redirect=true">said</a> February 10 that her agency came up with the plan because the county believes that it may not treat the American flag differently from banners displaying political opinions, and rules that allowed large American flags would also allow flags that could be objectionable. “Somebody may want to fly the Confederate flag, the American flag, the QAnon flag,” she said.
Resident Adrienne Whyte told commissioners in a public comment session, “It seems like a solution in search of a problem,” particularly during a pandemic.
Johnson acknowledged that though flags have largely been exempt from zoning regulations, it had seldom been an issue in the past. “I would note we don’t get a lot of complaints on this, we&#8217;ve had a few&#8230; we&#8217;d be remiss if we didn&#8217;t at least look at this and put some kind of <a href="https://www.fairfaxcounty.gov/planning-development/sites/planning-development/files/assets/documents/zmod/flags-pc-presentation.pdf">regulation</a>,” she added.
Resident Bill Denk told the commissioners that to honor his military-vet father, he once flew the flag that adorned his casket. Those flags are five-by-ten and, like the more common five-by-eight flags, would no longer be allowed.
“I do not think any of us would like to envision Fairfax County code compliance officers ripping the American flag from flag poles of individual homeowners because the flag was more than 24 square feet? Or do you?” he asked.
Planning board member Walter Clarke asked, “Since we live in the United States, shouldn’t the United States flag be an exception?”
“If someone&#8217;s national origin is from Australia and they want to fly an Australian or Canadian flag, I don’t know if we can say pick which two flags you want to fly,” Johnson said. “Historically people look at that as an American flag, corporate [city] flag and state flag, but with all of the changes that have occurred&#8230; we felt like we had to make those changes.”
Commissioner Phillip Niedzielski-Eichner said, “I hope to goodness we find a way to exempt our American flag from any suggestion that it&#8217;s comparable to any other flag. I understand the content [neutrality] issue, but particularly in these times where as a country, it’s important that our symbols matter, I hope we don’t make an equivalency between our American flag and all other flags.”
If the planning commission <a href="https://www.fairfaxcounty.gov/planningcommission/sites/planningcommission/files/assets/calendar/2021/3-3-21.pdf">approves</a> the restrictions, they will go to the county board of supervisors for county approval.
Fairfax County has increasingly landed in the national spotlight for controversial decisions, including last month, when it hired low-paid &#8220;classroom monitors&#8221; to watch children in school while some teachers, despite having received the coronavirus vaccine, refused to return to work.

Nine and a half hours later, CNN’s Jake Tapper ripped McEnany for her tweet, which he linked to the QAnon fringe conspiracy theory citing an anonymous “former WH colleague of McEnany’s.”

Within the hour, McEnany fired back at Tapper, slamming him for using an anonymous source to try to ascertain what she was driving at in her original tweet.

Within days of former President Trump’s inauguration in January 2017, he reinstated the &#8220;Mexico City Policy&#8221; after Barack Obama had rescinded it in 2009. As explained by the <a href="http://kff.org/global-health-policy/fact-sheet/mexico-city-policy-explainer/">Kaiser Family Foundation</a>, the Mexico City Policy (MCP) &#8220;requires foreign non-governmental organizations (NGOs) to certify that they will not &#8216;perform or actively promote abortion as a method of family planning,&#8217; using funds from any source (including non-U.S. funds), as a condition for receiving U.S. government global family planning assistance.&#8221;
The MCP was put in place by Ronald Reagan in 1984 in Mexico City during the second International Conference on Population. It was reversed by President Clinton in 1993, then reinstated by President Bush in 2001, then reversed once again by President Obama in 2009.
On January 28, 2021, President Biden issued an <a href="https://www.whitehouse.gov/briefing-room/presidential-actions/2021/01/28/memorandum-on-protecting-womens-health-at-home-and-abroad/">executive memorandum</a> which stated simply, “The Presidential Memorandum of January 23, 2017 (The Mexico City Policy), is revoked.”
McEnany has a long history of being staunchly pro-life. In May 2019, she <a href="https://www.facebook.com/permalink.php?story_fbid=2341955575863946&amp;id=182163255176533&amp;comment_id=2367785683280935">slammed</a> the &#8220;inhumane abortion comments of 2020 Democrats,&#8221; citing the pro-abortion stances of Democratic presidential candidates Pete Buttigieg, Bernie Sanders and Amy Klobuchar. &#8220;‪These are vulnerable, fully viable babies!” she said, ripping those who push for &#8220;no abortion restrictions at any stage of pregnancy‬.&#8221;
In June 2020, after the Supreme Court struck down a law in Louisiana requiring abortion providers to have admitting privileges at nearby hospitals, McEnany issued a <a href="https://www.foxnews.com/politics/white-house-rips-supreme-court-ruling-on-louisiana-abortion-clinic-restrictions">statement</a> saying:

The QAnon reference by Tapper was apparently to the fringe conspiracy theory that Democrats are responsible for a pedophilia ring. The leftist publication <a href="https://www.theguardian.com/commentisfree/2020/sep/20/qanon-conspiracy-child-abuse-truth-trump">The Guardian</a> opined in September:

On Thursday, the rioter known as “QAnon Shaman,” who was among those who stormed the U.S. Capitol building on January 6 in Washington, D.C., was transferred from a jail in the nation’s capital to a jail in Virginia after “a federal judge ordered corrections officials to provide the man with organic food.”
Also known as Jacob Chansley, the 33-year-old was arrested three days after insurrectionists stormed the U.S. Capitol building, <a href="https://www.businessinsider.com/q-shaman-qanon-influencer-capitol-siege-washington-dc-protest-riot-2021-1">charged</a> with “knowingly entering or remaining in any restricted building or grounds without lawful authority, and with violent entry and disorderly conduct on Capitol grounds.” He had turned himself in to the <a href="https://www.azcentral.com/story/news/local/arizona-breaking/2021/01/09/jake-angeli-fur-hat-and-horns-arrested-raid-u-s-capitol/6604898002/">FBI field office</a> in Phoenix, Arizona.
On Wednesday, an emergency motion was filed by Albert Watkins, Chansley’s lawyer, <a href="https://thehill.com/regulation/court-battles/537502-capitol-rioter-qanon-shaman-moved-from-dc-jail-to-virginia-for">arguing</a> that Chansley “practices shamanism and believes ‘that non-organic food, which contains unnatural chemicals, would act as an ‘object intrusion’ onto his body and cause serious illness if he were to eat it.’”
“Because of my being a Shamanic practitioner, I only eat traditional food that has been made by God.  This means no GMO’s, herbicides, pesticides, or artificial preservatives or artificial colors,” Chansley <a href="https://www.independent.co.uk/news/world/americas/us-politics/capitol-rioter-qanon-shaman-organic-food-b1797299.html">added</a> in the motion. 
“I have not eaten anything since Monday morning @ approx. 8:15 a.m.  Being w/o food is stressful due to the way it affects my serotonin levels.  As a spiritual man, I don’t mind fasting for a few days, but 5 days is the longest I have ever gone w/o food/fasted for.  I am humbly requesting a few organic canned vegetables, canned tuna (wild caught), or organic canned soups.  If I have to go a week w/o food or longer then so be it.  I will stay committed to my spiritual/religious beliefs even if it means I suffer physically. I will continue to pray through the pain and do my best not to complain.  I simply ask that you understand that the physical effects of not eating organic are harmful to my body &amp; bio-chemistry.”
Chansley continued, claiming that he becomes sick when he strays from his organic diet and that he is willing to suffer for his beliefs.
“I have strayed from my spiritual diet only a few times over the last 8 years with detrimental physical effects,” he wrote. 
“As a spiritual man I am wiling to suffer for my beliefs, hold to my convictions, and the bare weight of their consequences.  I simply ask that an exception plz be made for my special circumstances. the last facility I was @ in Arizona made such an exception for the short duration of my visit there.  I kindly &amp; humbly ask that a brief exception be made in this location as well.  Please Chaplin [sic] as a man of God I ask that you please try to understand my convictions and plead my case to the necessary parties.  Thank you.”
According to Watkins, Chansley has lost 20 pounds since his transfer from Arizona to Washington D.C., having refused to eat the nonorganic food provided, <a href="https://apnews.com/article/capitol-siege-michael-pence-virginia-9a28be7295c76947aaf5b223411c1ddd">going</a> “nine days without eating.” 
“Chansley, who calls himself the ‘QAnon Shaman,’ considers eating organic food to be part of his “shamanic belief system and way of life,” the lawyer said,” reported The Associated Press.
“On Thursday, U.S. District Judge Royce Lamberth said the U.S. Marshals Service told the court that the District of Columbia Department of Corrections had asked for Chansley to be moved because they couldn’t honor the court’s order to feed him organic food,” the report continued.
“The judge said jail officials in nearby Alexandria could accommodate the special diet.”
Chansley, who also goes by Jake Angeli, made his first court appearance in a Phoenix federal courtroom on January 11, appearing telephonically from the quarantine section of a detention facility. According to Melissa Blasius, a reporter with <a href="https://www.abc15.com/news/state/horned-d-c-protester-makes-first-court-appearance-refuses-to-eat-in-detention">ABC15</a>, Chansley’s mother said that he hadn’t “eaten since Friday because the detention facility won’t feed him all organic food.”
“He gets very sick if he doesn&#8217;t eat organic food — literally will get physically sick,” Martha Chansley said, referring to her son as a “patriot” and the “gentlest person I know.”

Capitol Rioter ‘QAnon Shaman’ Moved To Virginia Jail After Requesting An Organic Diet

Rep. Jimmy Gomez (D-CA) is planning to introduce a resolution to expel newly elected representative Marjorie Taylor Greene (R-GA) after a CNN report this week alleged that Greene had &#8220;indicated support for executing prominent Democratic politicians&#8221; before running for Congress.
Since she <a href="https://www.npr.org/2020/08/12/901628541/qanon-supporter-who-made-bigoted-videos-wins-ga-primary-likely-heading-to-congre">won the primary</a> in August, Greene has been sharply <a href="https://www.theatlantic.com/ideas/archive/2021/01/conspiracy-theories-will-doom-republican-party/617707/">criticized</a> by multiple Republican Party elected officials, who have publicly <a href="https://twitter.com/RepKinzinger/status/1354279353404813314">denounced</a> her and expressed &#8220;<a href="https://www.axios.com/captiol-riots-house-republicans-nanc-3a4bfe84-6ea9-4f92-9dd3-5bd5f4fb0de1.html">disgust</a>&#8221; with her past support for the fringe QAnon conspiracy theory. &#8220;Q is a patriot, we know that for sure,&#8221; Greene said in a 2017 video. &#8220;There&#8217;s a once-in-a-lifetime opportunity to take this global cabal of Satan-worshiping pedophiles out, and I think we have the president to do it,&#8221; Greene <a href="https://www.npr.org/2020/08/12/901628541/qanon-supporter-who-made-bigoted-videos-wins-ga-primary-likely-heading-to-congre">said</a>, referring to Trump and the conspiracy theory.
This week, video has emerged of Greene berating a then-high schooler whose high school, Marjory Stoneman Douglas High School in Parkland, Florida, had been shot up, leaving 17 people dead. Greene also appeared to express <a href="https://www.newsweek.com/fact-check-did-marjorie-taylor-greene-perpetuate-parkland-shooting-conspiracy-theory-1564992">support</a> for the baseless conspiracy theory that the shooting was a &#8220;false flag&#8221; event.
Gomez&#8217;s resolution follows the release of a <a href="https://www.cnn.com/2021/01/26/politics/marjorie-taylor-greene-democrats-violence/index.html">report</a> by CNN this week alleging that Greene expressed support for executing prominent Democratic politicians:
<blockquote>In one post, from January 2019, Greene liked a comment that said &#8220;a bullet to the head would be quicker&#8221; to remove House Speaker Nancy Pelosi. In other posts, Greene liked comments about executing FBI agents who, in her eyes, were part of the &#8220;deep state&#8221; working against Trump.
In one Facebook post from April 2018, Greene wrote conspiratorially about the Iran Deal, one of former President Barack Obama&#8217;s signature foreign policy achievements. A commenter asked Greene, &#8220;Now do we get to hang them ?? Meaning H &amp; O ???,&#8221; referring to Obama and Hillary Clinton.
Greene replied, &#8220;Stage is being set. Players are being put in place. We must be patient. This must be done perfectly or liberal judges would let them off.&#8221;</blockquote>
Republican officials have <a href="https://www.axios.com/marjorie-taylor-greene-mccarthy-caustic-comments-2d603058-9588-4cb8-be02-3c066dc70562.html">said</a> this week that they are planning to sit down and have a talk with Greene. House Minority Leader Kevin McCarthy&#8217;s spokesperson Mark Bednar told Axios that the leader has heard about recent controversies involving Greene and plans to address them. &#8220;These comments are deeply disturbing and Leader McCarthy plans to have a conversation with the Congresswoman about them,&#8221; he said.
Gomez announced on Wednesday that he is working to introduce a resolution to expel Greene from Congress &#8220;in light of numerous reports revealing her repeated endorsements of sedition, domestic terrorism, and political violence.&#8221;
“As if it weren’t enough to amplify conspiracy theories that the September 11 attacks were an inside job and the mass shooting at Marjory Stoneman Douglas High School was staged, a string of recent media reports has now confirmed that Congresswoman Marjorie Taylor Greene had previously supported social media posts calling for political violence against the Speaker of the House, members of Congress, and former President Barack Obama,” Gomez <a href="https://gomez.house.gov/news/documentsingle.aspx?DocumentID=2222">said</a> in a statement. “Such advocacy for extremism and sedition not only demands her immediate expulsion from Congress, but it also merits strong and clear condemnation from all of her Republican colleagues, including House Minority Leader Kevin McCarthy and Senate Minority Leader Mitch McConnell.&#8221;
