WASHINGTON—Unlike Judge Deborah Boardman, White House Press Secretary Karoline Leavitt has no sympathy for the trans-identifying man who attempted to assassinate Supreme Court Justice Brett Kavanaugh, she told The Daily Wire on Tuesday.
Leavitt was responding to comments made by the Maryland judge, named to the bench by former President Joe Biden, who sentenced Nicholas Roske to only eight years in prison and told him at his sentencing: “I am heartened that this terrible infraction has helped the Roske family … accept their daughter for who she is.”
Roske is a man who identifies as a woman. Ahead of his sentencing, his parents and family argued to the judge that their son should be treated leniently and given an opportunity to “thrive” as a transgender woman, court documents show. Boardman gave Roske eight years in prison, instead of the 30 years that the Justice Department had requested.
Asked about Boardman’s comment, Leavitt argued that political violence must be answered by severe punishment in order to actually deter criminals.
“The transgender maniac who traveled to Justice Kavanaugh’s home to murder him and his family over the draft Dobbs opinion leak doesn’t deserve a single ounce of sympathy,” Leavitt told The Daily Wire on Tuesday.
“This attempted assassin received a ridiculous, lenient sentence by a Biden judge when he should have been sentenced to at least 30 years in prison like the Department of Justice recommended,” she said. “Political violence must be severely punished and deterred, not excused away.”
This sentiment was echoed by the Department of Justice.
Attorney General Pam Bondi told The Daily Wire on September 19 that the attempted assassination was “an attack on the entire judicial system that cannot go unpunished” and her Justice Department attorneys had argued that the court’s sentence “must send the unequivocal, clear, and strong message that attempted violence and threats of violence against members of the judiciary — as well as other public and federal officials — cannot and will not be tolerated, and will be justly and severely condemned.”

They specifically said that the court’s sentence must be significant enough to not only “reflect the harm sought to be inflicted on the judiciary,” but also to send a message that the “consequences for these acts — no fewer than 30 years to life in prison — are not worth the perceived ideological ends.”

On Friday, the Justice Department told The Daily Wire that Bondi intends to appeal Roske’s sentence.
“The attempted assassination of Supreme Court Justice Brett Kavanaugh was a disgusting attack against our entire judicial system by a profoundly disturbed individual,” Bondi said in a statement at the time. “The Department of Justice will be appealing the woefully insufficient sentence imposed by the district court, which does not reflect the horrific facts of this case.”
Roske pleaded guilty to the attempt to kill a United States Supreme Court Justice in April 2025, three years after authorities arrested him in Kavanaugh’s neighborhood, carrying a bag full of weapons and burglary tools.
The Daily Wire’s Luke Rosiak, who was present in the courtroom throughout Roske’s sentencing, reports that Roske has been detained for the past three years since his arrest. With time served and good behavior, Rosiak notes, Roske’s sentencing could mean he may be out of prison in four years.
Boardman gave a speech that was more than an hour, justifying her sentencing, in which she repeatedly referred to Roske as a woman, saying: “Ms. Roske came out to herself as transgender in 2020 but kept it secret. Ms. Roske’s sister came out as gay two years prior but Ms. Roske saw that their parents struggled to reconcile her sexuality with their religious beliefs.”
“Any prison time is punishment for her,” the judge said of Roske, who is a man. “The length doesn’t need to be particularly long … unduly harsh conditions make a difference, too … She will be imprisoned in a male facility even though she is a transgender prisoner, pursuant to an executive order from the president.”
The Biden-appointed judge also specifically criticized President Donald Trump, and argued: “Let’s not hide the fact that President Trump issued an executive order saying transgender inmates would be assigned to prisons with their biological sex.” Roske, Rosiak reports, is a tall man with a deep voice, whose social media posts indicate that he is attracted to women rather than “cis men.”

WASHINGTON—The parents and family of Nicholas Roske are arguing that their son, the man who attempted to kill Supreme Court Justice Brett Kavanaugh, should be treated leniently and given an opportunity to “thrive” as a transgender woman, court documents show.
In startling letters dated September 19, Roske’s family describes the 29-year-old attempted assassin as “Sophie,” use female pronouns to describe Roske, and pushes for leniency for their family member, who pleaded guilty to the attempt to kill a United States Supreme Court Justice in April 2025, three years after authorities arrested him in Kavanaugh’s neighborhood, carrying a bag full of weapons and burglary tools.
The family pleaded with Judge Deborah Boardman, who was appointed by former President Joe Biden, that “Sophie” needs therapy, relaxation, and the outdoors in order for him to ultimately “thrive.” His sister specifically expresses fears about him being placed in a male prison “with limited access to gender affirming care.”
The Daily Wire <a href="https://www.dailywire.com/news/exclusive-attempted-kavanaugh-assassin-identifies-as-transgender-woman-legal-filings-show">first reported</a> last month that Roske’s legal team told the court he identifies as transgender and would be referred to as “Sophie.” It now appears, based on the family letters, that this is potentially part of its legal strategy.
“Placing Sophie in long term incarceration would stunt her ability to thrive and severely impact her overall life trajectory,” writes Olivia Roske, the gay sister of the attempted assassin. “Sophie needs a balanced life and appropriate support from loving people, not incarceration. Luckily, she has many loved ones eager to show her support, and we need her home in order to fully provide that to her.”
“Sophie has so much to offer the [world],” Roske’s sister insists, “and I ask that you allow her to live that out fully.”

Roske’s family, on the other hand, believes he would do better at home with them. Their repeated references to Roske’s transgender identity indicate that they believe Boardman may be swayed towards a lighter sentence out of compassion for Roske’s gender identity. Over and over, Roske’s father, mother, sister, grandparents, uncle, and friends harken back to his mental health difficulties and suggest that prison life is too hard for Roske to endure as a trans-identifying individual.
In 2023, Boardman <a href="https://thehill.com/homenews/education/4171618-judge-rejects-maryland-parents-motion-to-keep-kids-out-of-lessons-with-lgbtq-books/">notably denied the request</a> of a group of Maryland parents who had asked that Montgomery County Public Schools allow them to opt their kids out of lessons that included LGBTQ books (the Supreme Court ruled this summer that the school system had violated the parents’ rights).

“Sophie has had to face many challenges but remains positive, hopeful,” writes Roske’s mother, in a letter promising over and over to help and affirm her son in his transgender identity should he be allowed out of prison. “I have seen evidence of this during her incarceration. She is persevering. Over the past three years she has matured, reflecting on what happened and how to never have it happen again.”
Roske’s father argues that during the COVID-19 pandemic, Roske grew fearful of getting the virus or giving it to others, as well as “anxious about what COVID meant for the future,” since he had been accepted to get his master’s and possibly a doctorate in philosophy on the East Coast. Roske then moved to Seattle, where he lived for several months without a job before moving home and beginning to substitute teach. Shortly thereafter, when the school year ended, Roske then flew from California to Maryland to attempt to assassinate Kavanaugh.
“She does better with structure,” wrote Roske’s father. “Clear rules and a schedule will be given when she comes back to live with us. I think she would benefit from some assistance with developing organization and life skills. We will also work on teaching her how to do her own planning and organizing.”
Roske’s family describes him as smart and curious from a young age, an individual who excelled academically and loved philosophical conversations. Roske was an Eagle Scout, they shared, and was very active in the Boy Scouts. He was also homeschooled, his uncle wrote, but went to public school for high school, “isolating her from many of the friend groups that had already been formed,” and causing him to struggle to make friends, “leaving her marginalized.”
Roske’s uncle writes that his nephew deeply struggled with mental health: “She exhibited many of the signs of a troubled young adult. She had difficulties finding meaningful purpose, both personally and professionally, spending many hours isolated at home on the computer, withdrawn from life&#8217;s daily tasks.”
“Sophie is too smart for her own good,” writes his grandmother. “Frustration follows her around &#8230; I think she was trying to find herself and couldn’t find a place to fit in. Hopefully she is finding her way. She has a [lot] to offer.”
While Roske’s mother, father, grandmother, grandfather, and uncle all refer to him as “Sophie,” his cousin Daniel, his other uncle, Timothy, and his aunt Tjjohn refer to him as “Nicholas/Sophie,” and use the pronoun “they” to refer to his cousin, rather than “she” — perhaps an indication that they might not be as bought into Roske’s transgender identification as the rest of the family. Roske’s cousin insists that what Roske did “was a mistake” and asks that the court “look at the contents of this and the other letters written on Nicholas/Sophie’s behalf and determine a fair sentencing.”
Roske’s aunt Tjjohn specifically notes: “Nicholas/Sophie has always had a sense of what they believe to be right and wrong. The incident of the Uvalde [school] shooting and the overturning of Roe v. Wade upset them. Yes, they had a plan and intended to enact that plan. However, at some point, their conscience kicked in and had the wherewithal to call their sister.”
September DOJ filings show that Roske “meticulously researched, planned, and attempted to assassinate at least one — but had a stated target of three — sitting judges of the United States Supreme Court” with the “explicit objective” of “single-handedly” altering “the Constitutional order for ideological ends.” He conducted internet searches for the homes of the four Justices, purchased a Glock 17 pistol, ammunition, a rail-mounted tactical light with a laser sight, tactical gloves, non-slip grip socks, cable ties, pepper spray, a lock-pick set, a screwdriver, and a wrecking bar.
“My mental health is too poor for me to fear death,” he wrote on Discord on March 18, 2022, to another user, according to the DOJ filing. “But prison sounds worse. To be monitored to the point where you can’t even kill yourself. So if I did kill someone I would definitely try to get away with it.”
<a href="https://www.documentcloud.org/documents/25476861-roskemts2010325/" target="_blank" rel="noopener">Court filings show</a> that Roske described himself as “actively suicidal” and said he wanted to “do something positive before I die” by taking out Kavanaugh before the justice could vote to overturn Roe v. Wade. He found Kavanaugh’s neighborhood online after he saw an article with a “picture of the family’s house,” including the house number, because far-left activists had posted the addresses of the justices online in an attempt to intimidate them into preserving Roe.
In May 2022, POLITICO published a leaked draft Supreme Court opinion showing that the court was poised to overturn Roe, the landmark 1973 Supreme Court decision establishing a constitutional right to an abortion. That leak prompted Roske’s journey from California to Maryland.
“When I saw the leaked draft, it made me upset and then it made me want to — I don’t know,” he told authorities. “I was under the delusion that I could make the world a better place by killing him.”

The man who allegedly told police he sought to kill <a href="https://www.dailywire.com/topic/supreme-court">Supreme Court</a> Justice Brett Kavanaugh has been indicted for attempted murder, the <a href="https://www.dailywire.com/topic/department-of-justice">Department of Justice</a> (DOJ) said Wednesday.
Twenty-six-year-old Nicholas John Roske of California was indicted Wednesday on federal charges of attempting to murder a Supreme Court justice, the <a href="https://www.justice.gov/usao-md/pr/california-man-facing-federal-indictment-maryland-attempted-murder-supreme-court-justice">DOJ said in a press release</a>, noting that his initial appearance has not yet been scheduled.
Individuals charged by indictment are presumed innocent until proven guilty, the release said, noting that an indictment is not a finding of guilt.
&#8220;According to the one-count indictment and other court documents, on June 8, 2022, Roske intended to kill an Associate Justice of the Supreme Court,&#8221; the release said. &#8220;Court documents alleges that Roske traveled from California to Maryland, intending to kill the Supreme Court Justice, arriving at the residence of a current Justice of the Supreme Court in the early morning hours of June 8, 2022.&#8221;

If Roske is convicted, he faces a maximum sentence of life in prison for attempting to assassinate a United States justice. The DOJ release notes that actual sentences for federal crimes are usually less than the maximum penalty.
&#8220;The indictment includes a forfeiture allegation seeking the forfeiture of a firearm, two magazines loaded with 10 rounds each of 9mm ammunition; 17 rounds of ammunition contained in a plastic bag, a black speed loader, and additional items allegedly intended to be used in the commission of the crime,&#8221; the release said.
A DOJ <a href="https://s3.documentcloud.org/documents/22056069/roskenicholas.pdf">affidavit details</a> how Roske allegedly traveled to Kavanaugh’s home armed with weapons and burglary tools with the intent to kill the justice and prevent him from ruling on <a href="https://www.dailywire.com/topic/second-amendment">Second Amendment</a> and abortion cases.
“On June 8, 2022, at approximately 1:05 a.m., two United States Deputy Marshals saw an individual dressed in black clothing and carrying a backpack and a suitcase, get out of a taxicab that had stopped in front of the Montgomery County, Maryland, residence of a current Justice of the United States Supreme Court,” the affidavit said.
Roske looked at the two U.S. Marshals standing by their parked cars and then walked down the street, according to the affidavit.
The Montgomery County Emergency Communications Center then received a call from an individual who identified himself as Nicholas John Roske. He said he had suicidal thoughts, had a gun in his suitcase, and had come from California to kill “a specific United States Supreme Court Justice.”
Police were dispatched to the justice’s home, where they encountered Roske still on the phone with the Montgomery County Emergency Communications Center. The officers took Roske into custody “without incident.”
“An inventory search of the seized suitcase and backpack revealed a black tactical chest rig and tactical knife, a Glock 17 pistol with two magazines and ammunition, paper spray, zip ties, a hammer, screwdriver, nail punch, crow bar, pistol light, duct tape, hiking boots with padding on the outside of the soles, and other items,” the affidavit said.
Roske told authorities that he was upset about the “leak of a recent Supreme Court draft decision regarding the right to abortion as well as the recent school shooting in Uvalde, Texas.” He indicated that “he believed the Justice that he intended to kill would side with Second Amendment decisions that would loosen gun control laws.”
“Roske stated that he began thinking about how to give his life a purpose and decided that he would kill the Supreme Court Justice after finding the Justice’s Montgomery County address on the Internet,” the affidavit said. “Roske further indicated that he had purchased the Glock pistol and other items for the purpose of breaking into the Justice’s residence and killing the Justice as well as himself.”

The man who says he sought to kill <a href="https://www.dailywire.com/topic/brett-kavanaugh">Supreme Court Justice Brett Kavanaugh</a> contacted his sister on his way to the justice&#8217;s home, officials say — and that conversation may have swayed him from his original murderous plan.
“The suspect arrived by taxi and observed the U.S. marshals, and he turned around to contemplate his next move,” Montgomery County Police Chief Marcus Jones said, <a href="https://www.msn.com/en-us/news/us/man-accused-in-kavanaugh-plot-texted-sister-before-surrender-police-say/ar-AAYpVlb">according to The Washington Post</a>. “This is when he texted his sister and told her of his intentions, and she convinced him to call 911, which he did.”
Twenty-six-year-old <a href="https://www.dailywire.com/topic/nicholas-roske">Nicholas Roske</a> told authorities that he flew from California with the intent to kill the justice. He took a taxi to Kavanaugh&#8217;s Chevy Chase, Maryland home in the middle of the night on Wednesday. He was walking down the streets of Kavanaugh&#8217;s neighborhood when he called 911 and ultimately surrendered to authorities.
Investigators have shown great interest in exactly why Roske made the 911 call, The Post reported, suggesting that Roske&#8217;s sister may have played a pivotal role in stopping the 26-year-old&#8217;s plan to break into the Kavanaugh home and kill the justice.
It is not immediately clear what Roske and his sister texted about or how long they communicated, according to the publication. About 33 minutes passed between Roske seeing two deputy U.S. marshals near Kavanaugh&#8217;s home and Roske calling 911, court records and Montgomery County 911 recordings reviewed by MSN indicate.

“We believe the presence of the deputies assigned outside of Justice Kavanaugh’s home served as the deterrent in this incident,&#8221; Drew J. Wade, chief of the Office of Public Affairs for the U.S. Marshals Service, said. &#8220;While the deputies did not witness anything that would have resulted in an enforcement action, their vigilance and posture averted a potential violent act against the Justice.”

Top Republicans have attributed the attack to incendiary rhetoric from Democratic politicians. Republican Texas Sen. Ted Cruz warned last week: “The Biden admin encouraged protests outside of justices’ homes. Schumer threatened: ‘You have released the whirlwind &amp; you will pay the price!’ Now a would-be assassin went to the home of a Supreme Court Justice.”
The arrest comes after several weeks of angry protests at the Supreme Court and at the homes of conservative justices in the wake of the leak of a draft decision that would overturn Roe v. Wade. Pro-abortion protesters and some Democratic lawmakers have deemed the court as “illegitimate” in anticipation of the ruling in  <a href="https://www.law.cornell.edu/supct/cert/19-1392">Dobbs v. Jackson Women’s Health Organization</a>.

Senate Majority Leader <a href="https://www.dailywire.com/topic/chuck-schumer">Chuck Schumer</a> (D-NY), who two years ago pointedly warned Supreme Court Justice <a href="https://www.dailywire.com/topic/brett-kavanaugh">Brett Kavanaugh</a> he would &#8220;pay the price&#8221; if he ruled against abortion, remains silent hours after an alleged assassin said Wednesday that he had tried to kill the justice.
In the middle of the night Wednesday, police arrested 26-year-old Nicholas John Roske carrying a bag full of weapons and burglary tools. Roske told police he planned to kill Kavanaugh in an attempt to prevent him ruling on abortion and Second Amendment cases.
His arrest put Schumer&#8217;s warning in chilling relief, prompting <a href="https://www.dailywire.com/news/cruz-top-republicans-blame-kavanaughs-would-be-assassin-on-democrats-incendiary-rhetoric-on-roe">Republicans to accuse</a> Schumer and activists of endangering the justices through &#8220;incendiary rhetoric on Roe.&#8221;
“I want to tell you, Gorsuch,” Schumer threatened the justices in March 2020, “and I want to tell you, Kavanaugh. You have released the whirlwind, and you will pay the price. You won’t know what hit you if you go forward with these awful decisions.&#8221;
Judicial Crisis Network&#8217;s Carrie Severino called his comment &#8220;a call to action.&#8221;
“Senate Democrats, led by Senator Schumer, have waged a campaign for years to undermine and intimidate the Court,&#8221; she told The Daily Wire on Wednesday evening. &#8220;Schumer’s outrageous threat to Justices Gorsuch and Kavanaugh—on the steps of the Court after the June Medical decision no less—was a call to action.”
Mark Paoletta, the former general counsel for the Office of Management &amp; Budget under President Donald Trump who worked on Justice Clarence Thomas’ confirmation, argued that Schumer&#8217;s comments were &#8220;chilling and criminally reckless.&#8221;
&#8220;The Dobbs leak was an outgrowth of this despicable threat,&#8221; he told The Daily Wire on Wednesday evening. &#8220;Do anything at all costs to stop the overturning of Roe v. Wade.&#8221;
Schumer was speaking in reference to the Supreme Court case June Medical Services v. Russo, an abortion case in which the court <a href="https://dailycaller.com/2020/06/29/scotus-strikes-down-louisiana-abortion-restrictions/">ultimately ruled</a> with abortion advocates. His threats prompted a rare rebuke from Chief Justice John Roberts, who <a href="https://dailycaller.com/2020/03/04/supreme-court-john-roberts-chuck-schumer-dangerous-threatening-abortion/?page=9">called</a> the remarks both &#8220;inappropriate&#8221; and &#8220;dangerous.”
The senate majority leader did not respond to requests for comment from The Daily Wire. In early May, he said that <a href="https://twitter.com/cspan/status/1524098988827418628">he supports</a> protesting outside the justices’ homes &#8220;if protests are peaceful.&#8221;
As of Wednesday evening, Schumer and many major top Democrats had not weighed in on or condemned the would-be assassin.
Not all — Nancy Pelosi’s Deputy Chief of Staff Drew Hammill told The Daily Wire late Wednesday afternoon that the Speaker of the House &#8220;believes that violence against public officials has no place in civilized society&#8221; and that Pelosi &#8220;condemns this abhorrent criminal act.”
And though President Joe Biden did not issue a statement himself, his deputy press secretary <a href="https://www.dailywire.com/news/white-house-condemns-violence-following-arrest-of-armed-man-near-kavanaughs-house">told The Daily Wire on Wednesday morning</a> that Biden &#8220;condemns the actions of this individual in the strongest terms, and is grateful to law enforcement for quickly taking him into custody.&#8221;
Pressed to provide a statement from Biden himself, White House Assistant Press Secretary Alexandra LaManna told The Daily Wire on Wednesday evening, “Violence and destruction of property have no place in our country under any circumstances, and the President denounces this action.&#8221;
&#8220;We should all agree that actions like this are completely unacceptable regardless of our politics,&#8221; she added.
Since the infamous leak of the draft Roe v. Wade decision, pro-abortion activists have escalated both rhetoric and protesting surrounding the issue: a slew of pro-life clinics and pregnancy centers have been firebombed, vandalized, or attacked, protestors make weekly visits to loudly demonstrate at the homes of the Supreme Court justices, and swelling crowds have protested outside of the Supreme Court itself.
These crowds <a href="https://twitter.com/MaryMargOlohan/status/1523823694023380994?ref_src=twsrc%5Etfw">have a message</a>: &#8220;abort the court.&#8221; That&#8217;s a sentiment <a href="https://www.dailywire.com/news/smear-campaign-leftist-activists-seek-to-intimidate-justices-control-the-court-experts-say">pushed for years</a> by Demand Justice, a progressive group backed by dark money mother-ship Arabella Advisers, in a years-long campaign to intimidate, threaten, and smear the reputations of Supreme Court justices, conservative-leaning experts have told The Daily Wire.
&#8220;If we don&#8217;t get it, tear it down,&#8221; protestors chanted into the wee hours of the night outside the Supreme Court following the leak. &#8220;Lets make a deal,&#8221; <a href="https://twitter.com/MaryMargOlohan/status/1521462443658129408/photo/3">read a female protestor&#8217;s sign</a>, held high above her head with a hanger. &#8220;For every woman who dies from this, one of you goes too.&#8221;
&#8220;Why is Schumer silent now?&#8221; Paoletta questioned. &#8220;Because he is beholden to the hard Left, and he won’t cross them. And he wants to burn down the Court because the Justices won’t obey him on abortion.&#8221;

Other Democratic lawmakers have repeatedly called for increased protesting following the draft opinion leak, though none have apparently issued so strong a threat as Schumer&#8217;s. Their language calls for increased action, ordering activists to &#8220;fight like hell&#8221; and to protest in the streets.
“Protect abortion rights by any means necessary,&#8221; <a href="https://twitter.com/CoriBush/status/1521468078755876867">said</a> Rep. Cori Bush (D-MO). Democratic Washington Rep. Pramila Jayapal <a href="https://twitter.com/RepJayapal/status/1521318714188120064?s=20&amp;t=g595UDeb824fvmDt0Vct5Q">called</a> for &#8220;people&#8221; to &#8220;take to the streets across the country.&#8221; Democratic New York Sen. Kristen Gillibrand <a href="https://twitter.com/SenGillibrand/status/1521514323784437760">ordered</a> activists to &#8220;fight like hell to preserve our fundamental human rights.&#8221;
“Let’s be clear: this is not final and the far-right Supreme Court majority will not have the last word,&#8221; <a href="https://twitter.com/TammyDuckworth/status/1521325251422003200">tweeted</a> Sen. Tammy Duckworth (D-IL) following the leak. &#8220;The American people will. Tonight, it’s important we get loud, organize and demand action from the Senate. Retweet if you agree it’s time to protect Roe v. Wade NOW.”
Duckworth, who has not weighed in on the would-be Kavanaugh assassin and did not immediately respond to a request for comment from The Daily Wire, <a href="https://twitter.com/SenDuckworth/status/1534645889205211136">accused</a> Republicans of trying to jail women seeking abortions in a Wednesday afternoon tweet.
Leftist media and commentators have also escalated rhetoric: &#8220;1000% of the blame and rage needs to be rocket-launched at the Republican zealots who made this possible,&#8221; claimed Huffington Post Contributor Bob Cesca. &#8220;Blaming other liberals isn&#8217;t going to change a damn thing and will only confuse the matter. Decide today, right now, what you plan to do about it.”
