Then-Vice President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden&#8217;s</a> office exchanged tens of thousands of emails with members of his family and their respective firms during the Obama administration, according to new documents released Tuesday from the U.S. National Archives.
A Freedom of Information Act (FOIA) request obtained through America First Legal showed Biden used his vice presidential email account to exchange more than 29,000 emails with his son Hunter, his brother Jim, and their business groups — directly contradicting a previous claim Biden made during his 2020 presidential campaign.
&#8220;These damning numbers further confirm that there was never a wall separating the Office of the Vice President and Hunter Biden&#8217;s business endeavors,&#8221; the non-profit law group led by former senior members of the Trump administration said in an <a href="https://twitter.com/America1stLegal/status/1711764135661244590" target="_blank" rel="noopener">X-post</a>. &#8220;In fact, there was extensive commingling between them.&#8221;
According to court documents posted by the legal group, Biden&#8217;s Office exchanged 19,335 emails with Hunter&#8217;s private equity firm Rosemont Seneca, 4,243 emails with his son, 1,751 emails with Jim Biden, and 3,738 emails with Jim&#8217;s Lion Hall Group consulting firm, which allegedly has ties with the Chinese Communist Party.
In 2019, Biden <a href="https://www.politico.com/story/2019/08/28/biden-brother-business-2020-1476815" target="_blank" rel="noopener">reportedly said</a> he never discussed business matters with his son or brother and pledged there would be &#8220;an absolute wall&#8221; between his administration and personal and private matters.
&#8220;There wasn&#8217;t any hint of scandal at all when we were there,&#8221; Biden said at the time. &#8220;And I will impose the same kind of strict, strict rules. That is why I have never talked with my son or my brother or anyone else in the distant family about their business interests, period.&#8221;
Although it&#8217;s unclear what content is included in the emails since the National Archives said it would take more than 15 months to process the information, all three Biden family members and the firms named in the FOIA request are involved in the GOP-led investigation of an alleged Biden family influence-peddling operation.

The National Archives and Records Administration (NARA) is being sued to turn over approximately 5,400 emails connected to then-Vice President <a href="https://www.dailywire.com/topic/joe-biden">Joe Biden&#8217;s</a> pseudonym accounts to forward government information and business with his son, Hunter Biden, and others.
Southeastern Legal Foundation (SLF) filed a federal lawsuit against the agency on Monday after NARA officials confirmed with other sources that Biden used three personal pseudonym email accounts under the names Robin Ware, Robert L. Peters, and JRB Ware but has since &#8220;dragged its feet and still has not produced a single email,&#8221; the law group said in a <a href="https://www.slfliberty.org/wp-content/uploads/sites/12/2023/08/20230828-SLF-v.-NARA-Press-Release-Final.pdf" target="_blank" rel="noopener">news release</a>.
&#8220;All too often, public officials abuse their power by using it for their personal or political benefit,&#8221; Kimberly Hermann, general counsel for the legal foundation, said. &#8220;When they do, many seek to hide it. The only way to preserve governmental integrity is for NARA to release Biden&#8217;s nearly 5,400 emails to SLF and thus the public. The American public deserves to know what is in them.&#8221;
The group identified thousands of potentially responsive records from NARA after submitting a Freedom of Information Act request in June in its latest effort to investigate allegations that Biden communicated with Hunter regarding his foreign business dealings dating back to 2017.
SLF attorneys first asked the federal agency to release Biden&#8217;s emails in 2021. However, NARA officials reportedly failed to comply, claiming it did not have custody of his records before January 2017 and could only make the emails public in January 2022.
&#8220;Public transparency is the most vital check the citizens have for holding our political class accountable,&#8221; Braden Boucek, litigation director for SLF, said. &#8220;After over a year of trying to work with NARA, its continued unreasonable delays have forced SLF to file this lawsuit.&#8221;
The lawsuit comes after House Republicans began looking into President Biden&#8217;s alleged use of a fake name to mask his identity as they ramp up an investigation into the first family.

The lucrative arrangement has drawn scrutiny by investigators in addition to other foreign business ventures. Joe Biden served as vice president from January 2009 to January 2017.
In particular, Comer said he seeks documents in which the elder Biden allegedly used a pseudonym; his son&#8217;s former business partners Hunter Biden, Eric Schwerin, or Devon Archer are copied; and all drafts of then-Vice President Biden&#8217;s speech delivered to Ukraine&#8217;s parliament in December 2015.
&#8220;The Committee is concerned that foreign nationals have sought access and influence by engaging in lucrative business relationships with high-profile political figures&#8217; immediate family members, including members of the Biden family,&#8221; Comer wrote.
A NARA spokesperson <a href="https://www.dailywire.com/news/comer-seeks-records-of-biden-allegedly-using-pseudonym-as-vice-president" target="_blank" rel="noopener">told</a> The Daily Wire that the agency received the request and will respond in accordance with the requirements of the Presidential Records Act.

Comer said the oversight panel wants unrestricted special access under the Presidential Records Act (PRA) to Case Number 2023-0022-F, entitled “Email Messages To and/or From Vice President Biden and Hunter Biden related to Burisma and Ukraine,” which the chairman noted has been published on NARA’s website.
<a href="https://www.dailywire.com/topic/hunter-biden">Burisma Holdings</a> is the Ukrainian energy company that employed Hunter on its board for several years, a lucrative arrangement that has drawn scrutiny by investigators in addition to other foreign business ventures. Joe Biden served as vice president from January 2009 to January 2017.
&#8220;These records have been redacted for public release pursuant to the PRA and FOIA [the Freedom of Information Act]. For example, an email bearing the subject &#8216;Friday Schedule Card,&#8217; is withheld in part under a &#8216;P6&#8217; and &#8216;b(6)&#8217; restrictions, denoting personal information regarding the subject under the PRA and FOIA respectively,&#8221; Comer said.
&#8220;Attached to this email, and made available on the NARA website, is a document that indicates at 9:00 a.m. on May 27, 2016, Vice President Biden took a call with the president of Ukraine, Petro Poroshenko,&#8221; the letter continued. &#8220;It is concerning to the Committee, however, that this document was sent to &#8216;Robert L. Peters&#8217; — a pseudonym the Committee has identified as then Vice President Biden. Additionally, the Committee questions why the then-Vice President’s son, Hunter Biden — and only Hunter Biden — was copied on this email to then-Vice President Biden.&#8221;
Comer asked that NARA provide the requested documents by August 31. He noted that are needed to help Congress work on &#8220;legislative solutions&#8221; for ethics laws and disclosure rules.

For years, Joe Biden claimed to have never spoken to Hunter about his business dealings, but as the oversight panel uncovered more evidence, the White House has taken to saying the elder Biden never did business with his son. Last week, the president <a href="https://www.dailywire.com/news/biden-snarls-at-lousy-question-about-calls-with-sons-business-partners">snapped at</a> a reporter who asked about the calls with Hunter&#8217;s business associates, saying, &#8220;I never talked business with anybody.&#8221;
In a press release, Comer pointed to <a href="https://www.foxnews.com/politics/biden-repeatedly-denied-discussing-business-deals-hunter-evidence-suggests-otherwise">comments Joe Biden made</a> as a presidential candidate in August 2019 in which he said, &#8220;I have never discussed with my son or my brother or anyone else anything having to do with their business, period,&#8221; and &#8220;There will be an absolute wall between the personal and private and the government.&#8221;
But the release noted that Devon Archer, a former business partner of Hunter&#8217;s, recently <a href="https://oversight.house.gov/wp-content/uploads/2023/08/Devon-Archer-Transcript.pdf">testified</a> to the House Oversight Committee that then-Vice President Biden addressed their foreign associates over speaker phone roughly 20 times, dined with &#8220;corrupt foreign oligarchs&#8221; in Washington, D.C., and met with his son’s Chinese business associate for coffee in Beijing.
Though Archer indicated that the conversations stuck to casual topics such as the <a href="https://twitter.com/RNCResearch/status/1686071608417402895" target="_blank" rel="noopener">weather</a> or fishing, the Biden family <a href="https://www.dailywire.com/news/hunter-bidens-former-business-partner-joe-biden-was-the-brand-to-send-signals-to-burisma">&#8220;brand&#8221;</a> went a long way in their ventures and the calls were &#8220;signal enough to be powerful.&#8221;
&#8220;Joe Biden has stated there was ‘an absolute wall’ between his family’s foreign business schemes and his duties as Vice President, but evidence reveals that access was wide open for his family’s influence peddling,&#8221; Comer said in a statement.
&#8220;We already have evidence of then-Vice President Biden speaking, dining, and having coffee with his son’s foreign business associates,&#8221; he added. &#8220;We also know that Hunter Biden and his associates were informed of then-Vice President Biden’s official government duties in countries where they had a financial interest. The National Archives must provide these unredacted records to further our investigation into the Biden family’s corruption.&#8221;
Democrats on the oversight panel have <a href="https://twitter.com/OversightDems/status/1691921908470514014">criticized</a> the congressional investigation into the Bidens, insisting that their GOP colleagues have found no evidence of wrongdoing by President Biden while claiming that the Republicans are trying to &#8220;distract&#8221; from the criminal cases against former President Donald Trump.
Hunter is also facing <a href="https://www.dailywire.com/news/prosecutors-deny-hunter-biden-locked-deal-to-resolve-felony-gun-charge">a criminal inquiry</a> that so far has led to tax evasion and gun charges. After a plea deal fell apart, Attorney General Merrick Garland appointed Delaware&#8217;s U.S. Attorney David Weiss as special counsel, giving the prosecutor broader authority to bring charges in districts outside his own.
Staff memos show the GOP-led oversight panel has identified <a href="https://www.dailywire.com/news/house-oversight-releases-memo-alleging-hunter-biden-received-millions-from-oligarchs">more than $20 million</a> in payments to members of the Biden family from sources in foreign countries — including China, Russia, Ukraine, Romania, and Kazakhstan — through a web of more than 20 companies, raising concerns about the president being susceptible to influence peddling. Republicans have also raised concerns about an FBI document showing an informant&#8217;s claims that the president might have been involved in a <a href="https://www.dailywire.com/news/fbi-biden-bribery-file-released-burisma-head-says-he-was-coerced-into-paying-bidens-10-million">bribery scheme</a> linked to Ukraine and Burisma.
House Speaker Kevin McCarthy (R-CA) said last month that the probe into the Biden family&#8217;s finances is <a href="https://www.dailywire.com/news/speaker-mccarthy-indicates-republicans-are-moving-toward-impeachment-inquiry-of-biden">&#8220;rising to the level&#8221;</a> of an impeachment inquiry. Though McCarthy has yet to commit to the impeachment process, there has been <a href="https://twitter.com/therecount/status/1683919300216643586">some chatter</a> indicating that an inquiry could begin as soon as this fall as the 2024 presidential election cycle heats up.

Former President <a href="https://www.dailywire.com/topic/donald-trump" target="_blank" rel="noopener">Donald Trump</a> reportedly ignored in a plan late last year — after his Mar-a-Lago home was raided by the FBI — from one of his top lawyers to defuse the federal criminal investigation into his handling of sensitive U.S. government records.
The Washington Post <a href="https://www.washingtonpost.com/national-security/2023/06/14/trump-indictment-classified-documents-settlement/" target="_blank" rel="noopener">reported</a> that attorney Christopher Kise believed that the U.S. Department of Justice under Attorney General Merrick Garland did not want to charge the former president and that the department would be willing to agree to a settlement in the case if the former president were to return the all the remaining documents.
The report said that Trump was &#8220;not interested&#8221; in the plan after listening to others in his orbit who urged him to take a more &#8220;pugilistic approach.&#8221;
Then-Trump attorney Alex Cannon urged the former president to give the documents back to the National Archives in the fall of 2021 and warned him of the serious legal repercussions that he would face if he did not, the report added.
When the National Archives realized in early 2021 that some of Trump&#8217;s White House records were missing, they reportedly contacted Patrick Philbin, deputy counsel to then-President Trump, for help in retrieving the documents, according to a <a href="https://www.dailywire.com/news/top-lawyer-for-trump-tried-to-turn-over-records-to-national-archives-trump-blocked-him-report" target="_blank" rel="noopener">report</a> last August.
Philbin reportedly tried to help the National Archives retrieve the material, but was reportedly blocked by Trump.
“It’s not theirs, it’s mine,” Trump reportedly <a href="https://www.nytimes.com/2022/08/16/us/politics/trump-cipollone-philbin-interviews-fbi.html" target="_blank" rel="noopener">told</a> several of his advisers.

In response to a Freedom of Information Act (FOIA) request by <a href="https://aflegal.org/america-first-legal-demands-the-national-archives-make-public-bidens-vice-presidential-records-found-at-his-various-homes-and-affiliated-locations/" target="_blank" rel="noopener">America First Legal</a>, a group founded by former Trump administration official Stephen Miller, the National Archives and Records Administration (NARA) said it &#8220;must deny&#8221; the request &#8220;in full for approximately 1,170 pages&#8221; found at the Penn Biden Center.
NARA&#8217;s March 29 letter attributed the rejection to special counsel Robert Hur&#8217;s <a href="https://www.bloomberg.com/news/articles/2023-03-30/biden-classified-documents-probe-gets-help-from-ex-trump-officials?leadSource=uverify%20wall" target="_blank" rel="noopener">ongoing investigation</a> into Biden&#8217;s handling of classified government documents to determine whether anyone broke the law. The letter, signed by Archival Operations Division Director Stephannie Oriabure, offers more clarity about the sheer number of pages investigators may be examining.

In the days before the 2022 election, Biden&#8217;s team said they found about 10 records marked classified while clearing out Biden’s office at the D.C. think tank. Since then, searches by Biden&#8217;s lawyers and the FBI have taken place at Biden’s home in Wilmington, Delaware, his beach house in Rehoboth, Delaware, which have turned up more materials of interest to investigators. NARA also informed Congress its staff <a href="https://www.dailywire.com/news/nine-boxes-of-docs-taken-from-biden-attorneys-office-in-boston" target="_blank" rel="noopener">obtained nine boxes</a> of materials from the Boston office of a personal attorney to Biden that had been moved from the Penn Biden Center.
NARA is tasked with taking custody of presidential and vice presidential records at the end of an administration under the Presidential Records Act. However, the agency said it could not provide any other new information in response to other aspects of America First Legal&#8217;s FOIA request for vice presidential records either because of a lack of physical custody of certain records or because of Hur&#8217;s inquiry.

Beyond the scope of the FOIA request, some documents that have been uncovered reportedly date back to Biden&#8217;s time as a U.S. senator. Between 25 and 30 classified documents were known to have been found since November, <a href="https://www.cbsnews.com/news/biden-classified-documents-found-timeline/" target="_blank" rel="noopener">a source told CBS News in late January</a>.
Biden’s personal attorneys and the White House have insisted they are cooperating with the National Archives and Justice Department. Still, there is frustration in Congress about a lack of transparency from the Biden administration, even among Democrats. Sen. Mark Warner (D-VA), the chairman of the Intelligence Committee, <a href="https://www.nbcnews.com/politics/congress/top-democrat-gives-grade-biden-administration-classified-documents-rcna77260" target="_blank" rel="noopener">told MSNBC</a> he gives the Biden administration an &#8220;absolute failing grade&#8221; on this front.
Classified documents have also been found in the homes of former President Donald Trump, who is facing an investigation by a separate special counsel, and former Vice President Mike Pence, prompting the National Archives to call on other former presidents and vice presidents to check for such materials.

Shogan locked her <a href="https://www.dailywire.com/topic/twitter" target="_blank" rel="noopener">Twitter</a> account when she was nominated to lead the National Archives and Records Administration, but Hawley obtained several of her posts anyway. Exasperated after she repeatedly refused to answer for her statements, Hawley blasted Shogan for stonewalling.
&#8220;I asked you to provide the public posts that had previously been available on Twitter because the ones that we have were pretty disturbing,&#8221; Hawley began. &#8220;You responded as follows, and I quote, ‘My personal Twitter account is comprised of posts about my mystery novels, events at the White House Historical Association, Pittsburgh sports teams, travels and my dog.&#8217; Is this an accurate statement?&#8221;
First, Hawley called out a post Shogan made in February 2022 complaining about the fact that mask mandates had been lifted for children under the age of five. He then asked if such an overtly political statement was characteristic of her Twitter feed. &#8220;My social media is in my personal capacity,&#8221; Shogan responded.
&#8220;Answer my question, please, because you&#8217;ve testified under oath that you only posted about your dog, and sports teams and novels, and you also said you wouldn&#8217;t give this committee any of your public posts,&#8221; Hawley fired back. But Shogan again refused to own up to the posts. Hawley pressed her again. &#8220;You are under oath before this committee, and I have to say, you have placed this issue squarely in record by repeatedly refusing to answer,&#8221; he said.
Next Hawley pointed out a post that Shogan retweeted calling for an assault weapons ban. He also pointed to a Twitter post she made in 2021 in which she said that Texas Republican Senator Ted Cruz &#8220;ought to stay in his lane and not worry about what&#8217;s going on in Pittsburgh,&#8221; apparently in reference to investigations into the 2020 election. He then pointed to a post from December 2020 wishing that former President Trump would have his vetoes overridden and calling him a &#8220;weak policy president.&#8221; He also pointed to another post on January 5, 2021, claiming Trump would pardon himself for trying to overturn the election.
In another post Hawley pointed out, Shogan replied to a user complaining about religious flags on the grounds of the Library of Congress, and gave advice on how to complain and have the posts taken down. In every case, Shogan simply averted her eyes and repeated that her Twitter account was in her personal capacity.
An exasperated Hawley finally gave up. &#8220;I have to say, I have been here for four years in the Senate,&#8221; he said. &#8220;I have never seen a witness stonewall like this before. Never. And I&#8217;ve seen a lot. This is extraordinary. &#8230; I mean, this is unbelievable, and you want to be the archivist of the United States. You lied to us under oath, you lied to us in your [Questions for the Record], you just lied to me a second ago under oath, and now you&#8217;re sitting here stonewalling, not answering questions about public posts that you&#8217;ve made.&#8221;

Former Democratic President <a href="https://www.dailywire.com/topic/jimmy-carter" target="_blank" rel="noopener">Jimmy Carter</a> once found classified government documents at his home that he then turned over to the <a href="https://www.dailywire.com/topic/national-archives" target="_blank" rel="noopener">National Archives,</a> according to a new report.
The mishandling of classified documents is a chronic problem at the highest levels of the U.S. government, one person familiar with the matter told the <a href="https://apnews.com/article/biden-trump-classified-documents-president-33df0355c72e9ae8fa4cb6ead13f6521" target="_blank" rel="noopener">Associated Press</a>. At least several times a year, documents are located where they are not supposed to be and turned over to the National Archives.
On at least one occasion, Carter found sensitive government papers in his home in Georgia, the person told the AP. It is unclear when the discovery was made or when the documents were handed over.
Coincidentally, Carter signed the Presidential Records Act in 1978, though the law did not take effect until he was out of office and former President Ronald Reagan was in the White House. Before the law, presidential records were generally considered to be the president&#8217;s private property, not the government&#8217;s property, according to the AP.
The report about Carter comes after a series of classified document discoveries has hit one sitting president, one former president, and one former vice president in just the past six months. The FBI raided former President Donald Trump’s residence at Mar-a-Lago, his Florida resort, in August to confiscate materials marked classified.
Attorneys for President Joe Biden found classified documents stored in his former office at a think-tank in Washington, D.C., and at the president’s home in Wilmington, Delaware, on four occasions. The FBI found more documents in the president’s Wilmington home when they searched the house on Friday evening.
An attorney for former Vice President Mike Pence <a href="https://www.dailywire.com/news/report-classified-documents-found-at-former-vp-mike-pences-home-in-indiana" target="_blank" rel="noopener">found</a> a batch of classified documents at Pence&#8217;s home in Indiana last week, which Pence promptly turned over to the National Archives, according to his team. The former vice president had his residence searched after the revelations about classified documents connected to Biden went public earlier this month.
Attorney General Merrick Garland has appointed two special counsels to take over Justice Department investigations into Trump and Biden.
The bevy of recent discoveries has forced some Republicans and Democrats into an awkward dance about the leaders of their respective parties, both having kept materials marked classified at their private residences.
“They’re trying to attack former President Trump. Biden was chair of the Foreign Relations Committee” in the Senate, Senate Minority Whip John Thune (R-SD) told <a href="https://www.politico.com/news/2023/01/23/biden-documents-democrats-concern-00079138" target="_blank" rel="noopener">POLITICO</a>. “He should have known better. And they were trying to claim the high ground on this issue when the shoe was on the other foot. And I think it’s a very tough issue for them to have to navigate right now.”
Democrats have maintained that Biden has handled the discovery better than Trump.
“He has done well by cooperating every step of the way, unlike Trump, but he still has documents that I don’t understand why he’d have in his personal possession,” Senate Judiciary Chair Dick Durbin (D-IL) said.

The U.S. House Committee on Oversight and Accountability said Tuesday that the National Archives and Records Administration failed to meet a deadline set by the committee to turn over materials for further investigation of the classified documents found in locations tied to President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>.
&#8220;The National Archives has not produced the requested documents to the Committee at this time,&#8221; a committee spokesperson told <a href="https://www.axios.com/2023/01/25/nara-deadline-house-oversight-committee-biden-docs?utm_campaign=editorial&amp;utm_medium=social&amp;utm_source=twitter" target="_blank" rel="noopener">Axios</a>. &#8220;Chairman Comer&#8217;s request still stands and anticipates moving forward with a transcribed interview with NARA&#8217;s general counsel soon.&#8221;
The committee spokesperson further noted to <a href="https://www.washingtonexaminer.com/news/national-archives-misses-deadline-biden-classified-documents">The Washington Examiner</a> that Republican investigators initially anticipated conducting a transcribed interview with the federal agency, which would provide a timeline and how the classified information was handled.
Republican lawmakers launched the committee earlier this month after classified documents connected with Biden&#8217;s time as vice president were first found by his personal lawyers in his private office at the Penn Biden Center, a think tank in Washington, D.C., just before the midterm elections last year.
Since then, Biden&#8217;s attorneys have located more classified documents at Biden&#8217;s home in Wilmington on three separate occasions: an unspecified number found in his garage on December 20, one in Biden&#8217;s study on January 11, and five more found in the study on January 12.
Rep. James Comer (R-KY), chair of the House Oversight Committee, sent letters addressed to the National Archives and the White House Counsel&#8217;s Office on January 10, in which the committee demanded the material due to &#8220;Biden&#8217;s failure to return highly classified records from his time as vice president.”
Comer said that National Archives &#8220;instigated a public and unprecedented FBI raid at Mar-a-Lago — former President Trump&#8217;s home— to retrieve presidential records.&#8221;
&#8220;[Its] inconsistent treatment of recovering classified records held by former President Trump and President Biden raises questions about political bias at the agency,&#8221; he added, according to <a href="https://www.axios.com/2023/01/10/house-oversight-committee-biden-docs">Axios</a>.
House Speaker Kevin McCarthy (R-CA) questioned a key detail in Biden&#8217;s classified document scandal during an interview Friday with Fox News.
McCarthy asked why Biden had his lawyers move him out of the office.
&#8220;Yes, we are, and you&#8217;re missing one question: They say the attorneys found these documents,&#8221; he <a href="https://www.dailywire.com/news/kevin-mccarthy-questions-key-detail-in-bidens-classified-document-scandal">said</a>. &#8220;Who told the attorneys to look there?&#8221;
&#8220;Somebody else knew the documents were there all along. Otherwise, why would the attorneys even look?&#8221; McCarthy asked. &#8220;Whoever hires lawyers to be movers?&#8221;
Biden responded to the scandal last week by saying that he has &#8220;no regrets&#8221; over his actions and that getting questions about the investigation &#8220;quite frankly bugs&#8221; him.
&#8220;We&#8217;re fully cooperating, looking forward to getting this resolved quickly,&#8221; Biden claimed. &#8220;I think you&#8217;re gonna find there&#8217;s nothing there. I have no regrets. I&#8217;m following what the lawyers have told me they want me to do — that&#8217;s exactly what we&#8217;re doing. There&#8217;s no there, there.&#8221;

Comer, who has jurisdiction over the National Archives, told Fox News that the National Archives has provided no information about what is going on with the documents that were discovered.
&#8220;This agency is supposed to do a briefing any time something like this happens. They have not,&#8221; Comer said. &#8220;Not only have they not given us a briefing, even though we&#8217;ve requested one, they haven&#8217;t answered any of our simple requests for information. This is very concerning. We are going to deal with the National Archives as this mess progresses. But right now, we have a lot of concerns who had access to these documents.&#8221;
Comer noted the odd nature of the claim from Biden&#8217;s team that his lawyers were moving him out of his office. &#8220;I mean, no one believes that lawyers are in charge of the moving team,&#8221; Comer said.

NEIL CAVUTO: What do we know? What do you know about these documents? Or just exactly how classified some of them are? We&#8217;re told that a bunch that were found in the president&#8217;s garage in Wilmington had top classification, you know, markings. But you know more than I, maybe. What have you learned?
JAMES COMER (R-KY): Well, unfortunately, I do not know more than you. And that&#8217;s very concerning because I have jurisdiction over the National Archives. This agency is supposed to do a briefing any time something like this happens. They have not. Not only have they not given us a briefing, even though we&#8217;ve requested one, they haven&#8217;t answered any of our simple requests for information. This is very concerning. We are going to deal with the National Archives as this mess progresses. But right now, we have a lot of concerns who had access to these documents. It&#8217;s hard for us to believe, as Joe Biden said, that his team of lawyers were moving boxes around and they discovered it. I mean, no one believes that lawyers are in charge of the moving team. And I wonder, did all the documents end up at the same place initially, like, let&#8217;s say, the Biden Center and then someone at the Biden center took some boxes to the house and were looking through the information at the house. I mean, there are a lot of questions here. Unfortunately, we don&#8217;t have any answers.
NEIL CAVUTO: We do know a little bit about the timeline about how this all became known. As you know, by now, Chairman, Merrick Garland was aware of this back in November. That was before the midterm election. We don&#8217;t know how much of that was relayed to the president, but we knew that he knew back then. So I&#8217;m just wondering what could explain, or are you concerned about the delay in making that known and getting a special counsel appointed much sooner?
JAMES COMER (R-KY): We&#8217;re very concerned. I mean, Joe Biden promised the American people he would have the most transparent administration in history. I could make a strong argument that this is the least transparent administration in history. The only reason we know about those documents today is because of investigative reporting by CBS. Someone leaked to CBS that Joe Biden had these classified documents or we would never know about it and there would never be a special counsel. So this is very concerning. This is another example of a two tier system of justice in America. This is another example of how the current president has been treated versus the former president. And this is why we&#8217;ve created a task force to examine the weaponization of the Department of Justice.
NEIL CAVUTO: You know, Congressman, I am curious as well about Joe Biden and his comments on this to the degree that he didn&#8217;t know about it. Now, that might be the case, might not be the case, but if it is the case, isn&#8217;t that even more problematic? Isn&#8217;t that even more worrisome? The classified documents were in his possession and he didn&#8217;t know it.
JAMES COMER (R-KY): Exactly, Neil. You know, that is the argument for defense that a lot of Democrats in Congress say, well, he didn&#8217;t even know about it. Well, that makes it even worse, because here&#8217;s what we know. And this is — I can tell you this from the investigation into the Biden family influence peddling — this family has a history of receiving lots of anonymous donations from China, whether it be to the Biden Center for Diplomacy, whether it be to Hunter’s shady business dealings, whether it be for Hunter&#8217;s artwork. I mean, there is a pattern here, and this is very concerning. And you may ask, why would China invest so much money in the Bidens? Just look, recently what was discovered with respect to the University of Penn successfully lobbying the FBI to drop the China initiative, which was an investigation into China&#8217;s influence in our university system, stealing our research and development technology. They had the FBI drop this in the Biden administration because they said it was racist. So that alone would be a pretty darn good investment for China. We have to investigate the Biden family for being a national security risk, and the fact that they had classified documents stored improperly, that’s another reason why.
NEIL CAVUTO: You know, I&#8217;m just wondering whether in your investigations, wherever they go, Chairman, whether you want to talk to Robert Hur, the special counsel, who will be involved in this.
JAMES COMER (R-KY): Well, I think it&#8217;s going to depend on what he does. I&#8217;m not a fan of special counsels. I didn&#8217;t think they should have called for a special counsel for Trump. And I don&#8217;t think they should call for one for Biden. But after Merrick Garland called one for Trump, he had to do the same thing for Joe Biden. He had no other options. These special counsels never worked out the way they&#8217;re intended. They never stay within their area of investigation. Merrick Garland said this special counsel with respect to the Biden classified documents would focus solely on the classified documents. I don&#8217;t want them to expand their investigation for the sole purpose of blocking House oversight’s investigation of the Biden family influence peddling.
NEIL CAVUTO: Well, they would do it apart, right? I guess they would do it [apart] … the reason why I asked, sir, is of course, in the case of Donald Trump and the special counsel appointed to look into him also by Merrick Garland, there was an effort to get Jack Smith to speak to various committees — the special counsel in that case — and he refused. I&#8217;m sure it would be the same posture by Robert Hur. So to Americans watching this will unfold, their investigations continue, undeterred, presumably uninterrupted. Yours will go on. I don&#8217;t know what&#8217;s being planned in the Senate. It’s a lot of investigations.
JAMES COMER (R-KY): A lot of investigations. And, you know, it&#8217;s very unfortunate that Congress would have to dedicate any amount of time to investigating whether or not this administration&#8217;s compromised from China. But I think that what&#8217;s been brought out to light in the last few days is the fact that the Biden center for diplomacy was funded almost exclusively from China. And that&#8217;s a concern — when every American, regardless of party affiliation, regardless of ideology, believes that we need to stand up to China, that China is stealing our intellectual property, they&#8217;re stealing our patents, they&#8217;re manipulating their currency, they have human rights abuses, the list goes on and on and on — and yet they continue to take our manufacturing jobs. They continue to, you know, put Americans at risk. And yet this administration is tied into China in every which way imaginable. We have to investigate this because this is a concern. And, you know, the one positive thing about the fact that Biden had these classified documents is it shows that our investigation is justified.

House Oversight Chairman On Biden’s Document Scandal: National Archives Won’t Disclose What Was Found

A second set of classified documents was found at President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>&#8216;s home in Delaware, according to <a href="https://www.dailywire.com/topic/white-house" target="_blank" rel="noopener">White House</a> counsel.
Richard Sauber, special counsel to the president, said in a statement that a review of Biden&#8217;s known offices, quarters, and other spaces turned up a second set of classified documents, these located at the president&#8217;s home in Wilmington, Delaware, according to <a href="https://www.nytimes.com/2023/01/12/us/biden-documents.html" target="_blank" rel="noopener">The New York Times</a>. The review was prompted by the discovery of 10 classified documents at Biden&#8217;s private office at a think tank in Washington, D.C., in November.
“During the review, the lawyers discovered among personal and political papers a small number of additional Obama-Biden administration records with classified markings,” Sauber said. “All but one of these documents were found in storage space in the President’s Wilmington residence garage. One document consisting of one page was discovered among stored materials in an adjacent room.”
Sauber&#8217;s statement did not say when the additional documents were found. Nor did he indicate what classification level the documents were marked as or what information is contained within them.
Sauber said that another home owned by Biden in Rehoboth Beach, Delaware, was also searched as part of the document hunt. No classified documents were found there, however.
The review <a href="https://www.dailywire.com/news/review-of-biden-spaces-turns-up-second-batch-of-classified-docs-report" target="_blank" rel="noopener">began</a> sometime after Biden&#8217;s personal attorney found 10 classified documents stashed in an envelope in the president&#8217;s private office at the Penn Biden Center for Diplomacy and Global Engagement in Washington. The attorney discovered the envelope on November 2, though the discovery was not made public until earlier this week. The documents were immediately turned over to the National Archives for storage, Sauber said on Monday.
The Department of Justice (DOJ) is reviewing Biden&#8217;s handling of classified documents after the discovery of the envelope in November. Sauber has said the White House is cooperating with the DOJ and National Archives.
“The discovery of these documents was made by the President’s attorneys,” Sauber said. “The documents were not the subject of any previous request or inquiry by the Archives. Since that discovery, the President’s personal attorneys have cooperated with the Archives and the Department of Justice in a process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives.”

A personal attorney for Biden discovered 10 classified documents in the president&#8217;s private office at the Penn Biden Center for Diplomacy and Global Engagement in Washington in November. Those documents have since been turned over to the National Archives. The initial incident prompted Biden aides to begin searching the president’s other known spaces for additional documents, however, according to <a href="https://www.nbcnews.com/politics/white-house/biden-aides-find-second-batch-classified-documents-new-location-rcna65371" target="_blank" rel="noopener">NBC News</a>.
It is unclear where the additional documents were found, when they were found, and if the search for additional documents is still ongoing. It is also unclear what classification level the documents were marked as or what information is contained within them, according to NBC.
After the original batch of classified documents was found in November, Biden aides began sifting through boxes of documents from the Biden&#8217;s stint as vice president to locate other documents that should have been turned over to the National Archives.

The <a href="https://www.dailywire.com/topic/national-archives" target="_blank" rel="noopener">National Archives and Records Administration</a> (NARA) intends to release hundreds of emails referencing <a href="https://www.dailywire.com/topic/hunter-biden" target="_blank" rel="noopener">Hunter Biden</a> and his foreign business deals unless stopped by the <a href="https://www.dailywire.com/topic/white-house" target="_blank" rel="noopener">White House</a>.
NARA executive Susan Donius sent a <a href="https://www.archives.gov/files/foia/pra-notifications/pdf/bidenvp/rn-labvp-2023-022.pdf">letter</a> to the White House late last month warning that the records agency is preparing to release emails in response to an open records request unless the White House intervenes. The emails are from 2014 when President Joe Biden served as vice president to former President Barack Obama.
Both men’s respective legal teams have been notified and given 60 days to assert privilege over any of the information slated to be released in accordance with the Presidential Records Act, according to <a href="https://www.businessinsider.com/biden-white-house-archives-privilege-foia-hunter-burisma-ukraine-emails-2022-12" target="_blank" rel="noopener">Insider</a>, which first reported the existence of the <a href="https://www.archives.gov/files/foia/pra-notifications/pdf/bidenvp/rn-labvp-2023-022.pdf" target="_blank" rel="noopener">NARA letter</a>.
The letter references a slate of Freedom of Information Act (FOIA) requests. One of those requests focused on records related to the president’s son Hunter and brother James and their foreign business dealings. NARA is preparing to release 185 emails in whole and 75 others with redactions in response to the request.
“The Biden Vice Presidential records to be opened are email messages from May 2014 to December 2014 that include the company name ‘Burisma,’” a summary of the FOIA request says.
“Several of the email messages are press inquiries regarding the announcement of Hunter Biden joining the board of directors of Ukrainian energy company Burisma Holdings Limited in May 2014 and the Office of Vice President’s responses to those inquiries. There are also email messages containing news articles compiled by White House staff which include articles referencing Hunter Biden and his role with Burisma,” it continued.
Hunter Biden joined the board of Burisma in 2014 despite lacking any experience in the energy sector. He made as much as $83,333 a month for the role. His role at the company set off speculation that Burisma brought on the Biden scion to gain influence with the Obama administration. At the time, then-Vice President Biden was heading the Obama administration’s Ukraine policy.
Hunter Biden <a href="https://www.vice.com/en/article/a35y9k/hunter-biden-admits-his-last-name-has-opened-basically-every-door-for-him" target="_blank" rel="noopener">said</a> in a 2019 interview that being a member of the Biden family has likely allowed him to take advantage of many opportunities he would not have had otherwise. He later <a href="https://www.foxnews.com/politics/biden-wouldnt-take-burisma-job-again-insists-it-wasnt-unethical" target="_blank" rel="noopener">claimed</a> in his 2021 memoir “Beautiful Things” that he did nothing wrong in taking the job with Burisma, but the trouble it has caused for his family, especially his father, was not worth the pay.
“Did I make a mistake by taking a seat on the board of a Ukrainian gas company? No. Did I display a lack of judgment? No. Would I do it again? No. I did nothing unethical,” he wrote.
President Biden has repeatedly claimed that he never spoke with his son about Hunter’s foreign business dealings. That claim was seemingly contradicted in June by the <a href="https://www.dailywire.com/news/joe-biden-spoke-with-hunter-about-dealings-with-chinese-oil-tycoon-voicemail-reveals" target="_blank" rel="noopener">release</a> of a 2018 voicemail found on Hunter’s abandoned laptop.
“Hey pal, it’s dad. It’s 8:15 on Wednesday night. If you get a chance just give me a call,” President Biden, then out of office, told Hunter in the recorded message. “Nothing urgent. I just wanted to talk to you. I thought the article released online, it’s going to be printed tomorrow in the Times, was good. I think you’re clear. And anyway if you get a chance give me a call, I love you.”
The voicemail references an article from The New York Times on dealings Hunter had with a Chinese businessman, Ye Jianming, the chairman of the Chinese energy giant CEFC.
