Former FBI Director James Comey asked a federal judge to dismiss the Justice Department’s case against him on Monday, claiming he was the victim of a “vindictive” prosecution.
Comey was charged last month with making false statements to Congress and obstructing a congressional proceeding over his handling of an FBI investigation into Russia. In his <a href="https://storage.courtlistener.com/recap/gov.uscourts.vaed.582135/gov.uscourts.vaed.582135.59.0.pdf">motion</a> to dismiss, he said that he has committed no crimes and is being targeted because of his criticism of President Donald Trump. 
“The government has singled out Mr. Comey for prosecution because of his protected speech and because of President Trump’s personal animus toward Mr. Comey. Such a vindictive and selective prosecution violates the First Amendment, Due Process Clause, and equal protection principles. The proper remedy for this unconstitutional prosecution is dismissal with prejudice,” his legal team wrote. 
The indictment accuses Comey of lying to Congress about authorizing a person identified as “Person 3” to leak information to the media. Person 3 was identified in Comey’s motion to dismiss as his longtime friend and Columbia Law School Professor Daniel Richman. He pleaded not guilty on October 8. 
Comey’s motion to dismiss alleges that the indictment “presents an inaccurate description of the testimony at the heart of this case.” His motion also cited Trump’s Truth Social posts about Comey before and after the indictment, including one on September 25 in which Trump celebrated the charges.

On Sunday, the Justice Department <a href="https://x.com/JerryDunleavy/status/1980268461176533170">took aim</a> at Comey’s defense, arguing that Patrick Fitzgerald, his lead lawyer, may be caught up in a conflict of interest. This is based on reports that Fitzgerald was involved in Comey’s media strategy in the days before Trump fired him. 
“Based on publicly disclosed information, the defendant used current lead defense counsel to improperly disclose classified information,” the DOJ said. “This fact raises a question of conflict and disqualification for current lead defense counsel.”
Fitzgerald has denied that he or Comey ever leaked classified information to the media. 
The complicated case is overseen by the U.S. District Court for the Eastern District of Virginia. A trial date has been set for January 5.

Former FBI Director James Comey will go to trial on January 5, after pleading not guilty to charges tied to his handling of the FBI’s Russia investigation.
Comey appeared Wednesday morning before Judge Michael Nachmanoff in Alexandria, Virginia, for his arraignment in the U.S. District Court for the Eastern District of Virginia. He is charged with making false statements to Congress and obstructing a congressional proceeding.
According to the <a href="https://x.com/JerryDunleavy/status/1971357752443404605">indictment</a>, the charges trace back to Comey’s September 2020 congressional testimony about his handling of the FBI’s probe into Russian meddling in the 2016 election. Prosecutors filed the case just days before the statute of limitations was set to expire on September 30.
The prosecution, led by U.S. Attorney Lindsey Halligan, stated that they expected the trial to last 2-3 days. Nachmanoff set the trial start for January 5 after both sides requested more time. 
“This does not appear to me to be an overly complicated case,” he <a href="https://www.nytimes.com/live/2025/10/08/us/james-comey-arraignment-fbi">said</a>, according to the New York Times. “I’m not going to force you to go to trial in December if both sides don’t feel they can be ready.”

Between now and the trial, Comey’s defense team is expected to file several motions to dismiss the case altogether. 
The indictment says that Comey falsely told a senator that he had not “authorized someone else at the FBI to be an anonymous source in news reports” regarding an FBI investigation into someone identified as “Person 1.” This statement was false, the indictment alleges, because Comey had authorized someone to be an anonymous source for news reports. 
“No one is above the law,” Attorney General Pam Bondi said after the indictment was announced. “Today’s indictment reflects this Department of Justice’s commitment to holding those who abuse positions of power accountable for misleading the American people. We will follow the facts in this case.”

Topline: Tragedy rocked a small town in Michigan after a man targeted a Mormon church on Sunday, opening fire on the congregants and leaving the building ablaze.
The horrific attack on the Church of Jesus Christ of Latter-day Saints in Grand Blanc left the church completely engulfed in flames. Grand Blanc is a small community of about 8,000 people and a suburb of Flint, about 50 miles from Detroit.
The shooting occurred around 10:30 a.m. ET, while the church was in service. Hundreds of people were worshiping when the gunman rammed his truck into the building. He then opened fire on congregants, shooting at least 10 people. At some point, the church was set on fire; officials believe the fire was intentionally set by the suspect, perhaps using an accelerant such as gasoline.

According to police, the gunman was killed in a shootout with authorities. At least four people have been confirmed killed, not including the gunman, and multiple others were wounded. Officials have stated that they fear the casualty count will rise due to the fire.
The gunman: The shooter was a 40-year-old man from Burton, Michigan, just a few miles from the church, according to police.
A pickup truck was used to ram through the church. Reports say that the vehicle had two large American flags in the cab. Other reports have said the suspect is an Iraq War veteran.
Authorities said they have targeted the gunman’s home with search warrants and are going through cell phone records to find out more about the motive.
Step back: This comes a month after the deadly shooting that targeted the Annunciation Catholic School in Minnesota.
Washington reacts: President Donald Trump <a href="https://truthsocial.com/@realDonaldTrump/posts/115283020712432544">issued</a> a statement saying that this “appears to be yet another targeted attack on Christians in the United States of America.” He asked that Americans “PRAY for the victims, and their families,” and added, quote, “THIS EPIDEMIC OF VIOLENCE IN OUR COUNTRY MUST END, IMMEDIATELY!”
Attorney General Pam Bondi and FBI Director Kash Patel also responded quickly, confirming that federal agents were on the scene to assist local authorities. Patel <a href="https://michiganadvance.com/2025/09/28/fatal-shooting-and-fire-at-michigan-mormon-church-police-say/?utm_source=chatgpt.com">added</a> that “violence in a place of worship is a cowardly and criminal act.”

Topline: President Trump continues to take his crime crackdown nationwide, announcing plans to deploy troops to Portland to protect ICE facilities. 
President Trump is clearly feeling emboldened to expand his efforts after the successful operation in DC. Now, he is looking for similar results in Portland, Oregon, a city ravaged by crime and violent political riots over the last five years.
Writing on Truth Social on Saturday, the president announced: “At the request of Secretary of Homeland Security, Kristi Noem, I am directing Secretary of War, Pete Hegseth, to provide all necessary Troops to protect War ravaged Portland … I am authorizing Full Force, if necessary.” 
Why Portland? Trump says the city is the epicenter of activity for &#8220;Antifa,&#8221; the far-left political movement that has been linked to riots and violent demonstrations for years now.
Militants have repeatedly laid siege to ICE processing facilities in the city, attacking agents with rocks, fireworks, and smoke grenades, blocking entrances, setting fires, and even doxxing federal agents, posting their home addresses on message boards and flyers around the city, according to the Department of Homeland Security.
In response to that violence in Portland and elsewhere, last week, Trump issued an executive order saying, &#8220;I hereby designate Antifa as a &#8216;domestic terrorist organization.&#8217;” calling it a “militarist, anarchist enterprise that explicitly calls for the overthrow of the United States Government” while using a “campaign of violence and terrorism nationwide to accomplish these goals.” 
Deputy White House Chief of Staff Stephen Miller <a href="https://x.com/Huberton/status/1971953265408725073">said</a> earlier this month: “The Antifa riots, the attacks on ICE officers, the doxxing campaigns, and now the political assassinations. These are not lone, isolated events. This is part of an organized campaign of radical left terrorism. It is structured and sophisticated, well-funded, it is well planned … It is terrorism on our soil.”
Portland pushes back: Flyers were reportedly posted around the city, calling on members to “Squad up. Make travel plans. Bring PPE and your unhinged Portland energy.”
Democratic lawmakers in the city have doubled down on their opposition to Trump — the city’s official website has a permanent banner at the very top that reads “Portland is a sanctuary city.” The site links to an anti-ICE hotline and reassures residents that local law enforcement will not cooperate with federal immigration agents. Over the weekend, Democratic lawmakers from across the city decried Trump’s efforts as authoritarian, saying they had things under control.
Oregon Democratic Governor Tina Kotek <a href="https://x.com/KatieDaviscourt/status/1972054518994190732">said</a> on Saturday: “Portland and the state of Oregon believe in the rule of law, and we can manage our own local public safety needs. There is no insurrection, there is no threat to national security, and there is no need for military troops in our major city. They are not needed here.”
On Sunday, Oregon and Portland filed a joint lawsuit against the Trump administration in an effort to block the deployment of the state’s National Guard. Their suit claimed in part, “Far from promoting public safety, Defendants’ provocative and arbitrary actions threaten to undermine public safety by inciting a public outcry.”

Topline: The FBI placed hundreds of plainclothes agents in the crowd around the U.S. Capitol on January 6, 2021. The years-long refusal by the FBI to acknowledge those 274 agents until now has raised many questions about past bureau leadership.
Trump weighs in: President Trump aired some frustration on his <a href="https://truthsocial.com/@realDonaldTrump/posts/115277207989888806">Truth Social</a> account on Saturday. He wrote, “This is different from what [former FBI Director Christopher Wray] stated, over and over again!” Trump lumped in Wray with former FBI Director James Comey as two officials who “got caught lying.” The president later told <a href="https://www.nbcnews.com/politics/donald-trump/trump-weighs-whether-doj-investigate-former-fbi-director-christopher-w-rcna234225">NBC News</a> that he “would certainly imagine” that Wray is being investigated by the Justice Department.
The new sheriff: FBI Director Kash Patel <a href="https://www.foxnews.com/politics/fbis-patel-clarifies-role-hundreds-agents-jan-6-says-wray-lied-congress">clarified</a> that the plainclothes agents were sent in “against FBI standards” after the riot had started for crowd control, and that “[t]his was the failure of a corrupt leadership that lied to Congress and to the American people about what really happened.”
The hot seat: Wray is facing numerous questions, even from rank-and-file FBI agents who were present at the Capitol on January 6, 2021. An after-action report <a href="https://justthenews.com/accountability/fbi-bombshell-274-agents-sent-capitol-j6-many-later-complained-they-were-political">revealed</a> to Congress last week lists a host of issues that agents have had with FBI leadership. Several agents have expressed concerns that politics had deeply influenced the bureau’s mission over the course of Comey and Wray’s tenures.
Another indictment?: Republican Congressman Andy Biggs of Arizona said Wray “will be held accountable” and pointed to an <a href="https://x.com/RepAndyBiggsAZ/status/1679164288546529281">exchange</a> he had with Wray in 2023:

WRAY: I referred very specifically to undercover agents.
BIGGS: And so are you acknowledging, then, there were undercover agents?
WRAY: As I sit here right now, I do not believe there were undercover agents on scene.</blockquote>
Worth noting: If it comes to an indictment, some have disputed that “plainclothes” is synonymous with “undercover.” Additionally, Wray made it clear that he believed his statements to be true, but stopped short of explicitly stating they were true. This ambiguity underscores that, regardless of the frustration over the FBI, perjury cases are challenging to win convictions in.

Speaker of the House Mike Johnson (R-LA) appeared on CNN’s “State of the Union” with host Jake Tapper on Sunday and defended the recent indictment of former FBI head James Comey.
Tapper pressed Johnson on the indictment, asking if it was proper for a president “to publicly or privately instruct their Attorney General to prosecute a political opponent,” but Johnson pushed back.
“As a constitutional attorney and the Speaker of the House of Representatives, do you believe it&#8217;s acceptable for any president to publicly or privately instruct their attorney general to prosecute a political opponent and go as far as firing a U.S. attorney if they don’t bring charges because they don’t think the case is strong enough?” Tapper asked.
Johnson rebutted Tapper, noting that it wasn’t the president who indicted Comey, but a grand jury of his peers.
“I’m glad you brought up the principle, that is exactly what’s at issue here. James Comey lied to Congress. He took an oath. He said things to Congress that were simply not true. It’s called perjury. A grand jury … a non-partisan, non-biased grand jury that was assembled looked at the charges and they agreed. They voted to bring an indictment of James Comey &#8212; not President Trump, not the DOJ, but a grand jury,” Johnson said. “That’s how our system works. It’s a very important principle for us to apply that everybody has to subscribe to the law — even a former FBI director. And he has lots to answer for.”
Johnson added that there were “many things” over which Comey could have been indicted, but the statutes of limitations ran out.

It was a long time coming.
On Thursday, it was announced that a grand jury had <a href="https://www.dailywire.com/news/morning-brief-comey-charged-ice-shooter-investigated-californias-crime-wave-intensifies?author=Morning+Wire&amp;category=undefined&amp;elementPosition=12&amp;row=3&amp;rowHeadline=Latest+News&amp;rowType=Vertical+Carousel&amp;title=Morning+Brief%3A+Comey+Charged%2C+ICE+Shooter+Investigated+%26+California%E2%80%99s+Crime+Wave+Intensifies">indicted</a> a longtime target of President Trump&#8217;s, former FBI director James Comey.
James Comey has been on President Trump&#8217;s so-called target list for a very long time, going all the way back to when President Trump fired him during his first term. He fired him because James Comey almost certainly bootstrapped into the press the so-called Steele dossier. He promoted the Trump/Russia collusion hoax. He was deeply involved in every aspect of that — up to and including the use of the Steele dossier — in documents that were presented directly to President Trump, which was then used as an excuse by the media to push the Steele dossier, a compendium of lies about President Trump, into public view.
There have been open questions about whether James Comey, over the intervening years in which he testified repeatedly in front of Congress, among others, had actually committed perjury.
It is a very, very, very short indictment, a page and a half maximum. It accuses Comey by stating he “did willfully and knowingly make a materially false, fictitious, and fraudulent statement in a matter within the jurisdiction of the legislative branch of the Government of the United States, by falsely stating to a U.S. Senator during a Senate Judiciary Committee hearing that he, James B. Comey Jr., had not ‘authorized someone else at the FBI to be an anonymous source in news reports’ regarding an FBI investigation concerning” President Trump.
The indictment continues, “That statement was false, because, as James B. Comey Jr. then and there knew, he in fact had authorized PERSON 3 to serve as an anonymous source in news reports regarding an FBI investigation concerning” Trump.
The allegation is that there was a person lower down at the FBI who leaked to the press details involving the investigation into President Trump, and it is suggested that the person was authorized by Comey illegally to do that, and Comey subsequently lied about it. Or, if he had the authority to authorize the leak, he lied about it.
That lie is count one, which is the perjury charge. Count two is obstruction of a congressional proceeding, saying then on that same date, based on that same testimony, Comey did “corruptly endeavor to influence, obstruct, and impede the due and proper exercise of the power of inquiry under which an investigation was being had before the Senate Judiciary Committee by making false and misleading statements before that committee.”

That is the entirety of the indictment. It is very specific. It is presumably about one or two lines in his testimony to the Senate Judiciary Committee. The reason it&#8217;s being brought so quickly is because there&#8217;s a five-year statute of limitations on perjury charges. Comey’s testimony was September 30, 2020. It is now September 26, 2025, so we are about to expire on that statute of limitations.
It appears from much of the public information that this isn&#8217;t a particularly well-predicated indictment, and the indictment itself is quite weak and that it&#8217;s unlikely to survive in court.
Many of the things mentioned for the possibility of indictment of Comey are immoral and display ethics much worse than this.
But that&#8217;s not what he&#8217;s being indicted for.
At the end of the day, the indictment that&#8217;s left is pretty simple. Comey either lied about leaking to The New York Times in a tantrum because he was getting fired or he didn&#8217;t.
James Comey has decided to do what no one should ever do when hit with an indictment, which is to go directly on camera and talk. First rule of lawyering: Tell your client to shut the hell up.
But Comey <a href="https://www.politico.com/news/2025/09/25/defiant-comey-video-defense-donald-trump-00581806">publicly stated</a>:

He is simply the worst. Such a self-aggrandizing ridiculous figure.
This person had brought our country to the brink — in terms of the Justice Department, the FBI — for basically a decade, and it turns out he was one of the most ridiculous figures in the history of American public service. Truly a ridiculous figure, not only blowing the Hillary Clinton investigation, but blowing the Donald Trump investigation, manipulating the release, effectively, of the Steele dossier, and then using his perch as the guy who got fired by Donald Trump in order to launch salvos at Donald Trump over and over and over again, while walking through the forest and taking selfies of himself, or walking on the beach and taking pictures of shells on the beach, saying, “86 Donald Trump.”

So don&#8217;t mistake my questions about the indictment, that I somehow believe that James Comey is deserving of tremendous sympathy. I do not think that James Comey is worthy of tremendous sympathy. He was an awful director of the FBI, a joke of a public figure, and his “I&#8217;m standing up to authority. I am the hero standing in the breach” posturing is silly.
He&#8217;s just a silly, silly person. That doesn&#8217;t speak to whether the criminal indictment that is being brought here is weak or strong.
We&#8217;ll see what the underlying evidence looks like on the face of it.
But as far as personal sympathy for James Comey?
The guy is a schmuck.

WASHINGTON—President Donald Trump predicted Friday that “there will be others” indicted following a federal grand jury’s indictment of former FBI Director James Comey.
The jury <a href="https://www.dailywire.com/news/comey-indicted-for-lying-to-congress-no-one-is-above-the-law">indicted Comey</a> on charges of giving false statements and obstruction of a congressional proceeding, prompting liberal media to accuse the president of retaliating against political opponents. On Friday morning, the president gaggled with reporters before boarding Marine One for a trip to the Ryder Cup in New York. He discussed the Comey news and stressed that President Joe Biden’s Justice Department had unfairly targeted him.
“I think there’ll be others,” Trump shared, pressed by a reporter to share who else could be next. “I mean, they’re corrupt. These were corrupt, radical Left Democrats, because Comey, essentially was, he was worse than a Democrat. I would say the Democrats are better than Comey. But no, there’ll be others … that’s my opinion.”
“They weaponized the Justice Department like nobody in history, what they’ve done is terrible,” the president added, saying, “I hope, frankly, there are others, because you can’t let this happen to a country.”
Comey lied, Trump said.
“He didn’t think he’d get caught.”

Asked whether he has concerns that Democrats will target his FBI Director, Kash Patel, after he leaves office, Trump responded: “They did it with me for four years. They went after me. They went after me for four years. And that doesn’t even [include] the four great years that we had in the White House.”
Trump noted that he first began hearing rumors of Russia when he was first elected president.
“I said, What the hell do I have to do with Russia?” he asked. “Nothing. And then it got worse, and worse than some of the fake news picked it up … and they loved it. And we went through a long time with that. And despite that, we had a great first term.”
Trump told Fox News’ Peter Doocy: “This is about justice. Really, it&#8217;s not revenge.”
“It’s also about the fact that you can’t let this go on. They are sick, radical Left people, and they can’t get away with it,” he said. “And Comey. Comey was one of the people. He wasn’t the biggest, but he’s a dirty cop. He’s always been a dirty cop.”
“The only problem is, for him, he didn’t think it’d be caught, and he got caught,” Trump added. “He lied. He lied a lot, but this was a very important thing. This was he could have said ‘maybe’ or ‘I don&#8217;t remember,’ he didn&#8217;t say that. He gave a very specific answer, and then he verified it numerous times, and he got caught. The problem that Comey has is he got caught lying, and he was very strong. It&#8217;s not like, well maybe, or I don&#8217;t remember, he gave a very specific answer, because it was a very powerful question, a very important question, and when he gave the answer.”
“The only problem,” the president said again, “Is he got caught.”
The Comey indictment stemmed from statements the former FBI director made to Congress in September 2020, when he testified on how he handled the federal investigation into Russia’s meddling in the 2016 election. The state of limitations would have expired on Comey’s claims made during that hearing on September 30. He is the first former senior administration official to be indicted in relation to the Russia collusion hoax.

The alleged false statement originated from a congressional hearing held on September 30, 2020. According to the indictment, the moment that prosecutors zeroed in on took place during an exchange between Comey and Sen. Ted Cruz (R-TX):

Comey is expected to surrender for arrest on Friday. He is the first former senior administration official to face charges related to the 2016 Russian collusion hoax, which Comey was on Capitol Hill to testify about for that September 2020 hearing.

Why now? The statute of limitations for lying to Congress is five years. In a few days, Comey would have been out of reach for prosecutors for his 2020 testimony.
Comey’s reaction: The former FBI chief released a video statement Thursday night.
“My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system, and I’m innocent, so let’s have a trial and keep the faith,” Comey said in part.
Trump’s reaction: After the indictment dropped, Trump wrote on <a href="https://truthsocial.com/@realDonaldTrump/posts/115267513846352215">Truth Social</a> that Comey is “One of the worst human beings this Country has ever been exposed to.” He added that Comey “is now at the beginning of being held responsible for his crimes against our Nation.” Early Friday morning, Trump took to his social media platform again, calling Comey a &#8220;bad cop.&#8221;

Topline: We continue to learn more about the shooter who opened fire on an ICE facility in Dallas on Wednesday morning.
The gunman: Joshua Jahn, 29, left a trail of notes behind that he hoped law enforcement would find after he shot and killed himself after the attack. Authorities said his plans were months in the making and that he spent the days leading up to the fatal shooting searching for videos of the Charlie Kirk assassination. He also left a note stating, “Yes, it was just me,” indicating that he acted alone.

Authorities say Jahn wrote that he wanted to inflict “terror” on those federal agents and that he did not want to cause any harm to detainees. Still, ironically, he killed one detainee and critically injured two others.
The ICE agents: Federal officials said that the ICE agents were heroically helping to save the detainees who were shot. One ICE official, Marcos Charles, emphasized that the mainstream media and anti-ICE activists are sharing disinformation that encourages such acts of violence.
He also touched on the use of anti-ICE apps to expose agents’ locations, which Jahn used.
“ Anyone who creates or distributes these apps that is designed to spot track and locate ice officers are well aware of the dangers that they&#8217;re exposing to law enforcement. It&#8217;s a casting call to invite bad actors to attack law enforcement officers,” said Charles. He compared the apps to giving a hitman a target’s location.

Topline: A string of violent “smash-and-grab” robbery schemes in California is drawing renewed attention to the state’s crime issues. Meanwhile, Democratic Gov. Gavin Newsom is ratcheting up language against federal law enforcement. 
One expert says California jewelry stores have been hit by at least 30 robberies of this kind since March. The robbers have racked up millions of dollars worth of merchandise, and often, the suspects involved are juveniles.
Carnage: In the past week, an armed gang of up to <a href="https://nypost.com/2025/09/25/us-news/wild-video-shows-huge-mob-storming-california-jewelry-store-in-1m-raid/">30 people</a> raided a jewelry store outside of San Francisco. They smashed cases with crowbars and pickaxes and stole around $1 million worth of goods. Due to new security measures after a 2023 robbery, the suspects were locked inside – but they used guns and shot their way out of the store.
Authorities have arrested seven suspects so far. They’re all from Oakland and range in age from 17 to 31. Law enforcement believes these are repeat offenders.
Another recent robbery hit a Bay Area shop called Kim Hung Jewelry. A car crashed through the store, and more than a dozen robbers smashed display cases and stole merchandise. The 88-year-old store owner was shoved to the ground, suffered a stroke, and was cut by broken glass. A family friend of the victim told <a href="https://abc7chicago.com/post/san-jose-california-robbery-88-year-old-man-assaulted-during-brazen-smash-grab-jewelry-heist-police-say-video/17780018/">ABC 7</a>, “He is OK; business is not OK. Everyone knows that situation right now. Every business is in danger.”
Newsom’s approach: While President Trump has emphasized the crime problems in some of these Democrat-run cities, Governor Newsom claims that California&#8217;s crime is under control and it’s not an issue. 
Partly in response to Trump, Newsom has focused on federal immigration authorities. On Tuesday night, Newsom generated criticism for how he <a href="https://x.com/BrendonLeslie/status/1970859241121685589">described</a> ICE agents during an appearance on Stephen Colbert’s left-wing late-night show: “I mean, if some guy jumped out of an unmarked car in a van with a mask on, tried to grab me, I mean, by definition, you&#8217;re gonna push back. … These are authoritarian actions by an authoritarian government.”
Over the weekend, Newsom signed a law banning law enforcement, including federal ICE agents, from wearing masks during operations in California. They do this currently to protect their identities, as assaults on ICE agents have <a href="https://www.dailywire.com/news/reprehensible-assaults-on-ice-agents-skyrocket-up-830-over-last-year">jumped 830%</a> compared to a year ago.
DHS Assistant Secretary Tricia McLaughlin called the new law “despicable” and “a flagrant attempt to endanger” federal officers.

Comey’s indictment stems from statements the former FBI head made to Congress in September 2020 when he testified regarding his handling of the investigation into Russian meddling in the 2016 presidential election, according to the <a href="https://x.com/JerryDunleavy/status/1971357752443404605">indictment</a>. Comey responded to his indictment in a video on <a href="https://www.youtube.com/watch?v=Lg3-PHvKL3c">Instagram</a>, implying that the president is a tyrant, and claiming in part: &#8220;My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system, and I am innocent.&#8221;
Comey and Trump have publicly feuded for the better part of a decade. Earlier this year, the former FBI director met with Secret Service agents after he posted to his Instagram a photo that many interpreted as a call to kill Trump.
The former FBI chief <a href="https://www.dailywire.com/news/disgraced-former-fbi-chief-deletes-86-47-post-that-got-kash-patels-attention">posted</a> on his Instagram in May a photo of a beach with a number of shells in the shape of “86 47.” The number “86” in some settings is coded language to kill.
Comey later deleted the photo and posted an apology on his social media and said he “assumed” the shells were a political message and that he “didn’t realize some folks associate those numbers with violence.”
Comey has also broadened out his attacks to include the Republican Party at large. In May of this year, Comey <a href="https://www.dailywire.com/news/james-comey-calls-gop-white-supremacist-adjacent">referred</a> to the Republican Party as &#8220;white supremacist adjacent&#8221; during an appearance on MSNBC.

President Donald Trump voiced his displeasure with former FBI Director James Comey on Thursday, telling reporters that Comey was a &#8220;sick person&#8221; who had done &#8220;terrible things at the FBI.&#8221;
Trump&#8217;s remarks, made from the Oval Office alongside Turkish President Recep Tayyip Erdogan, come just hours after news broke that Comey was likely to be indicted in the coming days in relation to his Capitol Hill testimony on his role in investigating Russian meddling in the 2016 presidential election.

News of a <a href="https://www.dailywire.com/news/doj-expected-to-indict-former-fbi-director-james-comey">potential indictment</a> was reported on Wednesday, and MSNBC investigative correspondent Carol Leonnig explained that the reason Justice Department officials were moving ahead was that the statute of limitations was about to run out on the alleged crimes they intended to use to charge him.
“They are arguing that Comey — there is evidence to suggest Comey lied to Congress in his testimony on the Hill in September of 2020,” Leonnig explained. “And for viewers out in the audience who may not be legally as nerdy as me and Ken, I’ll just say that there’s a statute of limitations to charge people with the charge of lying to Congress or perjury, and that’s five years. The five-year statute runs [out] this month.”

Leonnig explained that an indictment had been in the works for some time and appeared to be looming closer due, in part, to a statute of limitations. Any indictment is likely to be tied to his 2020 congressional testimony regarding his handling of the investigation into Russian meddling in the 2016 presidential election.
&#8220;They are arguing that Comey — there is evidence to suggest Comey lied to Congress in his testimony on the Hill in September of 2020,&#8221; Leonnig explained. &#8220;And for viewers out in the audience who may not be legally as nerdy as me and Ken, I&#8217;ll just say that there&#8217;s a statute of limitations to charge people with the charge of lying to Congress or perjury, and that&#8217;s five years. The five-year statute runs this month.&#8221;
CNN brought in former U.S. Attorney Michael Moore to discuss the situation, and he began by insinuating that a Comey indictment would just be more proof that President Donald Trump was punishing his political enemies. He went on to say that getting an indictment would be the easy part, referencing the joke about it being possible to &#8220;indict a ham sandwich.&#8221;
&#8220;Indictment by a grand jury is sort of the lowest bar that a prosecutor can have,&#8221; he said.

Former FBI Director James Comey provoked a wave of mockery after revealing in a recent video that he listens to pop star Taylor Swift while &#8220;cutting the grass&#8221; and, occasionally, to cope with the fact that President Donald Trump still exists.
In a video shared via Substack, Comey first announced that he&#8217;d just recovered from a bout of COVID — &#8220;quite a flashback&#8221; — and complained about the fact that Trump is president before pivoting to talk about a &#8220;truly inspirational public figure.&#8221;
That public figure, of course, was Swift — and Comey, in addition to keeping the pop star&#8217;s music cued up on his headphones, admitted to being part of a family text group solely for Swifties.

&#8220;Taylor Swift has grown up with my family and provided us a soundtrack, really, as we&#8217;ve grown ourselves and learned and adapted and dealt with adversity and celebration,&#8221; Comey claimed, going on to add that Swift herself had set an example he tried to follow when he resisted the temptation to engage with bullies on social media.
Comey, who recently caught a wave of backlash for a post that was interpreted by many as wishing death on President Trump, said that Swift inspired him to be less &#8220;like Trump and his followers&#8221; — by which he meant less like the &#8220;mean jerks&#8221; out there — and said that even satirical posts that he found &#8220;funny&#8221; could also be a bit troubling.
&#8220;But I gotta be honest, it also leaves me with a strange feeling at times, because I don&#8217;t want us to become like Trump and his followers. There are far more decent, honest, kind people in America than there are mean jerks. And don&#8217;t get me wrong, we have our jerks, millions of them.&#8221;

A newly declassified document from former Special Counsel John Durham&#8217;s report suggests the Obama-era FBI ignored intelligence that indicated Hillary Clinton&#8217;s campaign or Russian disinformation fueled allegations of collusion between President Donald Trump&#8217;s 2016 campaign and Russia.
The disclosure of the <a href="https://www.grassley.senate.gov/imo/media/doc/declassified_durham_annex_released_by_chairman_grassley.pdf" target="_blank" rel="noopener">annex</a>, which still has some redactions, comes more than two years after Durham completed his investigation and heavily criticized the FBI&#8217;s Crossfire Hurricane probe into alleged links between Trump&#8217;s campaign and Russia. Trump&#8217;s second administration declassified the section as the president and members of his team <a href="https://www.dailywire.com/news/time-to-go-after-people-trump-wants-severe-consequences-for-dems-who-pushed-russia-hoax" target="_blank" rel="noopener">demanded accountability</a> for what they deemed to be a Russia collusion hoax.
One key section of the classified addendum to the Durham Report says the &#8220;FBI was fully alerted to the possibility that at least some of the information it was receiving about the Trump campaign might have its origin either with the Clinton campaign or its supporters, or alternatively, was the product of Russian disinformation. Despite this awareness, the FBI appears to have dismissed the [intelligence information] as not credible without any investigative steps actually having been taken to either corroborate or disprove the allegations.&#8221;
Sen. Chuck Grassley (R-IA), who is chairman of the Judiciary Committee and a lead Russiagate investigator who pushed for the declassification of the annex, released the document on Thursday.
&#8220;Based on the Durham annex, the Obama FBI failed to adequately review and investigate intelligence reports showing the Clinton campaign may have been ginning up the fake Trump-Russia narrative for Clinton&#8217;s political gain, which was ultimately done through the Steele Dossier and other means,&#8221; Grassley said in a statement. &#8220;These intelligence reports and related records, whether true or false, were buried for years. History will show that the Obama and Biden administrations&#8217; law enforcement and intelligence agencies were weaponized against President Trump. This political weaponization has caused critical damage to our institutions and is one of the biggest political scandals and cover-ups in American history. The new Trump administration has a tremendous responsibility to the American people to fix the damage done and do so with maximum speed and transparency.&#8221;

In 2020, when he served as director of national intelligence, now-CIA Director John Ratcliffe <a href="https://www.dailywire.com/news/breaking-feds-referred-hillary-to-fbi-for-probe-after-allegedly-approving-plan-to-create-trump-russia-scandal-to-distract-from-email-scandal-odni-says" target="_blank" rel="noopener">unveiled</a> documents that showed federal officials referred Clinton to the FBI for investigation after obtaining &#8220;insight&#8221; into a Russian intelligence analysis that alleged she approved a campaign plan to link Trump to Russia&#8217;s hacking operations to distract from the controversy over her unauthorized use of a private email server while serving as secretary of state.
The annex in Durham&#8217;s report says FBI personnel, including then-Deputy Director Andrew McCabe, shared the intelligence regarding the potential Clinton campaign plan with high-ranking career officials at Department of Justice on March 31, 2016, and affirms that &#8220;multiple high-ranking&#8221; U.S. officials were apprised of the situation, including an August 3, 2016, briefing in the White House by CIA Director John Brennan to President Barack Obama, Vice President Joe Biden, Director of National Intelligence James Clapper, FBI Director Comey, among others. It says notes from Brennan show the CIA sent an investigative referral to the FBI in September of 2016 that included the &#8220;purported Clinton campaign plan.&#8221;
One of the most heavily redacted parts of the annex says the CIA prepared a written assessment in 2017 on the &#8220;authenticity and veracity&#8221; of the intelligence described in the referral memo. &#8220;The CIA stated that it did not assess that the above [redacted] memoranda, or [redacted] hacked U.S. communications, to be the product of Russian fabrications,&#8221; it adds.
Durham <a href="https://www.dailywire.com/news/john-durham-affirms-crossfire-hurricane-investigators-kept-in-dark-about-alleged-clinton-plan" target="_blank" rel="noopener">testified</a> to Congress in 2023 that agents on the FBI&#8217;s Crossfire Hurricane team were not made aware of the intelligence, and his report indicated the &#8220;Clinton Plan intelligence&#8221; could have been helpful to them. The report pointed to British ex-spy Christopher Steele&#8217;s <a href="https://www.nytimes.com/2021/12/01/us/trump-russia-investigation-dossier.html" target="_blank" rel="noopener">now-discredited</a> anti-Trump dossier, stemming from research funded by Clinton&#8217;s campaign and the Democratic National Committee, that the FBI was <a href="https://www.washingtonexaminer.com/news/doj-inspector-general-finds-17-significant-errors-or-omissions-in-carter-page-fisa-applications" target="_blank" rel="noopener">found</a> to have improperly used to secure FISA surveillance warrants against onetime Trump campaign adviser Carter Page. It also referenced the unfounded secret <a href="https://www.dailywire.com/news/durham-finds-researcher-felt-threatened-by-schiff-staffer" target="_blank" rel="noopener">backchannel</a> between the Trump Organization and Russia&#8217;s Alfa Bank that Clinton and her team <a href="https://twitter.com/HillaryClinton/status/793250312119263233">promoted</a> in the run-up to the 2016 election.
&#8220;Whether or not the Clinton Plan intelligence was based on reliable or unreliable information, or was ultimately true or false, it should have prompted FBI personnel to immediately undertake an analysis of the information and to act with far greater care and caution when receiving, analyzing, and relying upon materials of partisan origins, such as the Steele Reports and the Alfa Bank allegations,&#8221; Durham&#8217;s report said. &#8220;The FBI also should have disseminated the Clinton Plan intelligence more widely among those responsible for the Crossfire Hurricane investigation so that they could effectively incorporate it into their analysis and decision-making, and their representations to the OI attorneys and, ultimately, the [Foreign Intelligence Surveillance Court].&#8221;
During an <a href="https://www.dailywire.com/news/cia-director-says-classified-docs-will-blow-lid-off-russiagate" target="_blank" rel="noopener">interview</a> on Fox News over the weekend, Ratcliffe told &#8220;Sunday Morning Futures&#8221; host Maria Bartiromo that he had been working to secure the release of a classified section from Durham&#8217;s <a href="https://www.justice.gov/archives/media/1381211/dl" target="_blank" rel="noopener">report</a>.
&#8220;What hasn&#8217;t come out yet and what&#8217;s going to come out is the underlying intelligence that I have spent the last few months making recommendations about final declassification and sent that to the Department of Justice,&#8221; he said. &#8220;That will come out in the John Durham report classified annex. And what that intelligence shows, Maria, is that part of this was a Hillary Clinton plan, but part of it was an FBI plan to be an accelerant to that fake Steele dossier, to those fake Russia collusion claims by pouring oil on the fire, by amplifying the lie and burying the truth of what Hillary Clinton was up to.&#8221;
Ratcliffe went on to explain that &#8220;much of&#8221; the testimony that Clinton, former FBI Director James Comey, and Brennan provided to Durham or Congress in the past five years &#8220;is, frankly, completely inconsistent with what our underlying intelligence that is about to be declassified in the Durham annex, what that reflects.&#8221;
Acknowledging how Attorney General Pam Bondi has a new &#8220;<a href="https://www.dailywire.com/news/justice-department-to-form-strike-force-to-assess-weaponization-of-intel-community" target="_blank" rel="noopener">strike force</a>&#8221; tasked with evaluating the evidence relating the Obama administration&#8217;s efforts to drive the Russia collusion allegations, the CIA director added, &#8220;It is a different Department of Justice, a different FBI, and an opportunity to look at how these people really did conspire to run a hoax, a fraud on the American people and against Donald Trump&#8217;s presidency.&#8221;
Comey <a href="https://www.youtube.com/watch?v=spKHw3IFUVc" target="_blank" rel="noopener">testified</a> before the Senate in 2020, claiming, &#8220;In the main, it was done by the book, it was appropriate, and it was essential that it be done.&#8221; He also conceded there &#8220;were parts of it that were concerning.&#8221;
In an op-ed <a href="https://www.nytimes.com/2025/07/30/opinion/trump-obama-treason-russia-miller.html" target="_blank" rel="noopener">published</a> by The New York Times this week, Brennan and Clapper made a brief mention of Durham as they pushed back on Director of National Intelligence Tulsi Gabbard&#8217;s <a href="https://www.dailywire.com/news/gabbard-obama-launched-years-long-coup-treasonous-conspiracy-against-american-people" target="_blank" rel="noopener">claim</a> that members of the Obama administration waged a &#8220;treasonous conspiracy&#8221; to undermine Trump.
&#8220;The special counsel John Durham, who was appointed during Mr. Trump&#8217;s first term to investigate how the Russia probe was conducted, similarly found no evidence of an Obama administration conspiracy against Mr. Trump,&#8221; they wrote. &#8220;But he affirmed the findings of the special counsel Robert Mueller, who conducted a separate investigation into the allegations, which found ample evidence of Russian interference in the election.&#8221;
