Federal authorities have accused another Chinese researcher of smuggling biological materials into the United States, as the FBI cautions American universities about growing threats from the communist nation.
FBI Director Kash Patel announced Friday that Chinese national Youhuang Xiang was arrested for allegedly smuggling genetic material from E. coli bacteria into the United States while working as a researcher at Indiana University. According to court documents, Xiang entered the country in 2023 on an educational exchange visa to secure a postdoctoral position at the school.
“This is yet another example of a researcher from China — given the privilege to work at a U.S. university — who then allegedly chose to take part in a scheme to circumvent U.S. laws and receive biological materials hidden in a package originating from China,” Patel posted on X. “The [FBI] and our CBP partners are committed to enforcing U.S. laws put in place to protect against this global threat to our economy and food supply. If not properly controlled, E. coli and other biological materials could inflict devastating disease to U.S. crops and cause significant financial loss to the U.S. economy.”
Xiang has been charged with conspiracy to commit smuggling, smuggling, and making false statements. He could face up to 20 years in prison and fines totaling hundreds of thousands of dollars if convicted. James Tunick, Xiang&#8217;s lawyer, disputed the allegations.
&#8220;Youhuang Xiang was legally working in the United States on a J-1 visa with a professor from the Biology Department at Indiana University to better wheat crop production in the United States,&#8221; Tunick told The Daily Wire. &#8220;The allegation that Youhuang smuggled E. coli into the United States is completely false and is not even charged by the United States Department of Justice.&#8221;
Xiang, whose <a href="https://biology.indiana.edu/about/research-associates/index.html">bio</a> says he specializes in “recognition specificity in host-pathogen interactions and engineering crop resistance to pathogen,” was first arrested on November 25. Information about the case was unsealed this week. 
In March 2024, Xiang requested that a person in China referred to as “Individual A” ship plasmid DNA from E. coli bacteria to his home in Bloomington, Indiana, according to the indictment. The material was shipped to him shortly after, concealed in a package of clothing items that &#8220;Individual A&#8221; declared included a men&#8217;s vest and women&#8217;s underwear, investigators said. The package allegedly came from Guangzhou Sci Tech Innovation Trading.
More than a year later, on November 23, 2025, Xiang landed in Chicago after returning from a trip to London, where agents with Customs and Border Protection questioned him. During that interview, he allegedly lied to them about the package he had sent to his home and about his ties to the Chinese government. 
Xiang was scheduled to remain at Indiana University through 2027 and was leading a research program focused on genome editing in wheat plants to increase resistance to fungal diseases.
The FBI was made aware of the shipment by CBP as part of an investigation into biological materials being smuggled into the United States from China, which is why he was questioned on November 23. 
“Information provided to the FBI by CBP included information about the history of shipments from China to certain individuals at IU conducting research into wheat pathogen Resistance,” the criminal complaint said. “That information indicated that XIANG was associated with that research and that XIANG received a shipment from China at his residence on March 28, 2024.”

The FBI also thought it was “odd” that Xiang purchased and shipped “women’s underwear from China, and further assessed it as peculiar that a company by the name ‘Guangzhou Sci Tech Innovation Trading’ would sell underwear or clothing,” according to the complaint. 
A <a href="https://www.sciencedirect.com/science/article/pii/S1674205219301625">paper</a> written by Xiang also listed his affiliation with the National Key Laboratory of Plant Molecular Genetics in Shanghai, which raised flags for investigators. 
“I know from my training and experience that the PRC ‘Key Laboratories’ are overseen by the Chinese Government and have a history of concerning actions including technology transfer and theft of intellectual property,” the FBI agent who investigated the case wrote in the criminal complaint. 
Over the last few months, other Chinese researchers at American universities have been arrested for smuggling biological materials into the country. Multiple arrests have been made at the University of Michigan, where <a href="https://www.dailywire.com/news/feds-makes-more-arrests-as-alarming-pattern-of-chinese-smuggling-continues">investigators said</a> that shipments of concealed biological materials related to roundworms were smuggled into the United States. 
President Donald Trump has faced criticism over the presence of Chinese students at American universities. While some critics have called for reducing the number of Chinese nationals admitted to U.S. schools, Trump has argued that their enrollment helps provide funding for American institutions.

Braun, a former U.S. senator who is serving his first term as governor, <a href="https://x.com/GovBraun/status/1999234066680512867?s=20">accused</a> &#8220;a small group&#8221; of Republicans of working with Democrats to stop a new Congressional map that would have likely flipped two more House seats to the GOP in the 2026 midterm elections.
&#8220;I am very disappointed that a small group of misguided State Senators have partnered with Democrats to reject this opportunity to protect Hoosiers with fair maps and to reject the leadership of President Trump,&#8221; Braun said. &#8220;Ultimately, decisions like this carry political consequences. I will be working with the President to challenge these people who do not represent the best interests of Hoosiers.&#8221;
While Braun claimed it was &#8220;a small group&#8221; of Republicans who rejected the redistricting effort, the Congressional map was opposed by the majority of GOP state senators. Braun&#8217;s statement on X was hit with a community note to add that context.
The Daily Wire reached out to Braun&#8217;s office for comment.
The redistricting proposal failed in a 19-31 vote on Thursday, which included 21 of the 40 Republican state senators opposing the Congressional map that aimed to flip two Democratic House seats to Republican control. Senator Sue Glick, who voted against the map, said, &#8220;You have to know Hoosiers, we can’t be bullied.&#8221; Senator Greg Walker argued that the map was &#8220;unconstitutional.&#8221;

In a fiery floor <a href="https://x.com/Indy_reporter_/status/1999224442237714806">speech</a> before the vote, Republican Majority Floor Leader Chris Garten urged his colleagues to support the new map, arguing, &#8220;Some will say these maps are political. Let me be clear, you&#8217;re damn right they are! Political policy is political. Safe streets are political. Look at Indianapolis. Affordable electricity is political. A drug-free Indiana is political. Peace in the Middle East is political.&#8221;
Following the vote, Trump ripped Senate Pro Tempore Rodric Bray, who voted against the GOP-favored map.
&#8220;He’ll probably lose his next primary, whenever that is. I hope he does, because he’s done a tremendous disservice,&#8221; Trump <a href="https://www.pbs.org/newshour/politics/watch-trump-criticizes-indiana-senate-republicans-rejection-of-redistricting-effort">said</a> of Bray. &#8220;I&#8217;ll certainly support anyone who wants to go against him.&#8221;
Trump told reporters in the Oval Office that he could have done more to support the redistricting effort in Indiana, which would have added two seats for Republicans in next year&#8217;s elections.
&#8220;I won Indiana all three times by a landslide,&#8221; Trump said. &#8220;And I wasn&#8217;t working on it very hard. It would&#8217;ve been nice. I think we would&#8217;ve picked up two seats if we did that.&#8221;
Vice President JD Vance traveled to Indiana in recent months to meet with Governor Braun and help kickstart the redistricting plan, as Trump called on red states to pass new Congressional maps. On Thursday, Vance accused Bray of telling the White House that he wouldn’t fight the redistricting effort “while simultaneously whipping his members against it.” Bray denied the accusations leveled against him by the vice president, saying, “Typically my style is to let people vote like they want. They could come with a yes or come with a no. It’s exactly what I did this time.”
Republican-led states, including Texas, Missouri, and North Carolina, have all passed new Congressional maps that will likely help Republicans, while California voters approved a new map that could help Democrats.

The Republican-led Indiana Senate voted against a proposal backed by President Donald Trump to change the state&#8217;s Congressional map, which would have likely flipped two Democratic seats ahead of the 2026 midterm elections.
The effort to pass a new map failed in a 19-31 vote despite Trump&#8217;s public pressure on Indiana Republicans to follow in the steps of red states such as Texas, Missouri, and North Carolina and give the GOP a better advantage in next year&#8217;s pivotal elections. The Republican-favored proposal passed the Indiana House last week by a <a href="https://www.nbcnews.com/politics/elections/indiana-house-passes-new-republican-drawn-congressional-map-rcna246750">vote</a> of 57-41, but ran into Republican opposition in the state Senate.
On Wednesday, Trump <a href="https://truthsocial.com/@realDonaldTrump/posts/115698333420423237">warned</a> that any Republican who voted against the redistricting proposal would be met with a &#8220;MAGA primary,&#8221; adding, &#8220;If Republicans will not do what is necessary to save our Country, they will eventually lose everything to the Democrats.&#8221;
Last month, Trump blasted Indiana state senators who pushed back on his redistricting calls, saying that he was &#8220;very disappointed in Indiana State Senate Republicans, led by RINO Senators Rod Bray and Greg Goode, for not wanting to redistrict their State, allowing the United States Congress to perhaps gain two more Republican seats.&#8221;

After Indiana Republican Governor Mike Braun called for state lawmakers to reconvene for a special session on redistricting, Bray warned that there wasn&#8217;t enough support among GOP state senators to pass a new map.
&#8220;Over the last several months, Senate Republicans have given very serious and thoughtful consideration to the concept of redrawing our state&#8217;s congressional maps. I&#8217;m announcing there are not enough votes to move that idea forward, and the Senate will not reconvene in December,&#8221; Bray <a href="https://www.indianasenaterepublicans.com/statement-from-senate-president-pro-tem-rodric-bray-regarding-possibility-of-redrawing-indiana-s-congressional-maps">said</a> in a statement on November 14.
Trump said on Wednesday that if the redistricting vote failed, &#8220;Rod Bray and his friends won’t be in Politics for long, and I will do everything within my power to make sure that they will not hurt the Republican Party, and our Country, again.&#8221;
The redistricting effort is just one of several around the country, with the Supreme Court ordering that Texas’ map with five additional Republican-favored districts could go forward. California passed Prop. 50 in November, which would allow five more Democrat-favored districts in the Golden State, and it is facing an ongoing lawsuit from the Justice Department. Florida, Virginia, and Louisiana are among the states with active redistricting battles, but it could end up leading to similar numbers favoring both parties overall, according to Cook Political Report’s Dave Wasserman.
The battle comes amid tight margins in the House ahead of 2026, with Republicans currently holding 220 seats compared with Democrats, who hold 213 seats. Two seats are currently vacant.

Banks sent Homeland Security Secretary Kristi Noem a letter on Wednesday, pushing her to deport the illegal immigrant drivers.
The first in the series of crashes occurred five days before Thanksgiving, when an illegal immigrant with a fraudulent green card allegedly killed a 76-year-old man in a hit-and-run in Bluffton, Indiana, <a href="https://news-banner.com/2025/11/1-dead-3-injured-in-bluffton-crash-driver-arrested-after-fleeing/" target="_blank" rel="noopener">according</a> to local reports. The next day, an intoxicated illegal immigrant driver in Owen County allegedly struck the parents of two young children who were on their way to pick up their kids from their grandparents’ house, <a href="https://fox59.com/news/indycrime/court-docs-man-charged-in-owen-county-crash-had-been-drinking-lacked-drivers-license/" target="_blank" rel="noopener">according</a> to Fox 59.

Days before those collisions, an <a href="https://www.dailywire.com/news/illegal-immigrant-plows-18-wheeler-into-military-humvee-killing-national-guardsman">illegal immigrant</a> from the Republic of Georgia who was given a New York trucking license allegedly caused a multi-car collision that killed an Indiana National Guardsman while behind the wheel of an 18-wheeler.
In October, an illegal immigrant driving a semi-truck collided head-on with a 54-year-old man in Northwest Indiana, who was killed almost instantly, <a href="https://www.fox32chicago.com/news/ice-detainer-placed-on-illinois-truck-driver-after-fatal-indiana-crash-police" target="_blank" rel="noopener">according</a> to Fox 32. The truck driver was using a suspended Illinois Commercial Driver’s License that belonged to a relative.
It was also later revealed that the driver’s trucking companies had received $36,082 in COVID-19 relief loans, <a href="https://www.foxnews.com/us/trucking-company-owned-illegal-immigrant-raked-money-from-taxpayers-before-fatal-crash-records" target="_blank" rel="noopener">according</a> to Fox News.

“These tragedies were entirely preventable,” Banks wrote in the letter. “Every individual who crosses our borders illegally commits a crime. The vast majority of illegal aliens commit further crimes once they are in the United States. Most illegal aliens commit Social Security or document fraud; many steal government benefits, assault our citizens, and terrorize our communities. Many also unlawfully procure driver’s licenses and trucking licenses — or simply drive without them — resulting in fatal accidents. We must deport every one of them.”

Footage has emerged from the moments after former NFL quarterback Mark Sanchez was involved in a stabbing incident in Indianapolis, early Saturday morning.
Sanchez, who suffered serious injuries, was subsequently arrested and charged with battery for his role in the incident.
According to the footage, which was <a href="https://nypost.com/2025/10/06/sports/bloody-mark-sanchez-seen-stumbling-down-indianapolis-sidewalk-after-being-stabbed-in-fight-with-grease-truck-driver/">obtained</a> by the New York Post, Sanchez appears bloodied and stumbling along a sidewalk and clutching the right side of his lower chest.
The former QB reportedly stumbled from an alleyway into a nearby bar, where paramedics were called. He was treated for stab wounds that initially left him in critical condition. By Saturday, it was confirmed by Fox Sports that Sanchez was in stable condition and recovering.
After initial reports indicated Sanchez could be the victim of a random stabbing incident, subsequent reporting revealed that he allegedly punched a 69-year-old truck driver outside of a bar, which led to a bloody escalation. The altercation was apparently sparked over a parking dispute.
Sanchez was arrested and charged in the incident, and is now <a href="https://fox59.com/news/indycrime/former-nfl-qb-mark-sanchez-charged-after-surveillance-video-shows-alleged-fight-in-downtown-indy-alley/">facing</a> misdemeanor criminal charges of Battery Resulting in Injury, Public Intoxication, and Unlawful Entry of a Motor Vehicle.
Witnesses say Sanchez’s behavior was erratic and that he seemed intoxicated prior to the incident. In apparent self-defense, the victim stabbed Sanchez. The truck driver was hospitalized with severe facial wounds, but is now stable, according to a statement from his family.

Indianapolis police initially <a href="https://www.dailywire.com/news/plot-twist-nfl-star-mark-sanchez-charged-with-battery-after-being-stabbed">indicated</a> on Saturday that two men were in a “physical disturbance” in downtown Indianapolis around 12:30 a.m., with one man suffering stab wounds and the other cuts.
Police said in the statement that the fight was “an isolated incident between the two men and not a random act of violence.”
On Saturday afternoon, Fox Sports released a statement confirming that Sanchez was recovering and “in stable condition.” Sanchez currently works as a Fox Sports analyst.
“Mark Sanchez was injured in Indianapolis on Saturday and is currently recovering in the hospital in stable condition,” the statement said. “We are deeply grateful to the medical team for their exceptional care and support. Our thoughts and prayers are with Mark, and we ask that everyone please respect his and his family’s privacy during this time.”

Indiana Attorney General Todd Rokita and 22 other states filed an <a href="https://image.subscription.in.gov/lib/fe2e11747364047b721071/m/1/e5f8c381-d0e3-4279-8119-87188632cab2.pdf">amicus brief</a> on Friday, asking the U.S. Supreme Court to allow a South Carolina school to maintain its policy of separate bathrooms and locker rooms for boys and girls.
The amicus brief notes that the Fourth Circuit has been “mandating policies that deprive schoolchildren of privacy during vulnerable moments. In Grimm v. Gloucester County School Board, a sharply divided panel of the Fourth Circuit required a school to let a girl access a multi-occupancy restroom reserved for the opposite sex because the student, though female, identified as a boy. And the Fourth Circuit has since expanded Grimm, wielding its logic to invalidate regulations on gender-transition procedures and providing for sex-separated sports teams.”

As Judge Niemeyer explained, the Grimm majority disregarded well ‘established principles’ and Title IX’s text to ‘advance[] policy preferences,’” the brief notes. “In United States v. Skrmetti, this Court rejected Grimm’s view that any rule referencing sex-related concepts contains a sex-based classification, even if the rule applies equally to all children. In Department of Education v. Louisiana, this Court let stand injunctions that blocked the federal government from forcing States to adopt the very type of bathroom-access policies that Grimm requires schools to adopt. And, of course, this Court recently granted certiorari to review another Fourth Circuit decision adopting Grimm’s logic. (Jackson v. W. Va. State Bd. of Education.)”
“No child should fear for their safety or privacy when using a bathroom, changing in the locker room, or showering after sports,” Rokita stated. “Forcing schools to mix boys and girls in these types of spaces shouldn’t be allowed or tolerated, and we’re going to continue fighting to stop it.”
“Under the Equal Protection Clause, this should be a simple case,” the amicus brief contends. “The Fourth Circuit agrees that schools can maintain separate bathrooms for boys and girls. It thus follows that schools can enforce policies providing for single-sex bathrooms against students who would prefer to use a bathroom designated for the opposite sex.”
“The Fourth Circuit claims that enforcing such policies against all students offends heightened scrutiny. As this Court’s decision in Skrmetti explains, however, a policy that applies to boys and girls alike does not classify on sex or transgender identity. South Carolina did not draw any impermissible lines when it decided that no one should be able to use a bathroom designated for the opposite sex,” the amicus brief concludes.

Jim Irsay, the longtime owner of the Indianapolis Colts, died on Wednesday afternoon. He was 65.
According to the team, Irsay &#8220;passed away peacefully in his sleep.&#8221; He was one of the most recognized team owners in the NFL, taking over the Colts franchise in 1997 after the death of his father, Robert Irsay.
&#8220;We are devastated to announce our beloved Owner &amp; CEO, Jim Irsay, passed away peacefully in his sleep this afternoon,&#8221; said Colts chief operating officer Pete Ward, according to <a href="https://www.espn.com/nfl/story/_/id/45259729/indianapolis-colts-owner-ceo-jim-irsay-dies-65" target="_blank" rel="noopener">ESPN</a>. &#8220;Jim&#8217;s dedication and passion for the Indianapolis Colts in addition to his generosity, commitment to the community, and most importantly, his love for his family were unsurpassed.&#8221;
No cause of death was provided. Irsay is survived by his three daughters and 10 grandchildren.
After taking over in 1997 and selecting legendary quarterback Peyton Manning in the 1998 draft, Irsay built the Colts into one of the best teams in the NFL, winning the Super Bowl in 2007 and the AFC championship in 2009. Irsay made the difficult decision to release Manning in 2012 after the then-35-year-old star quarterback underwent neck surgery. Manning went on to lead the Denver Broncos to two Super Bowls, winning one of them.
&#8220;I am heartbroken to hear about Jim Irsay&#8217;s passing,&#8221; Manning wrote in a post on Instagram. &#8220;He was an incredibly generous and passionate owner and I will always be indebted to him for giving me my start in the NFL. His love for the Colts and the city of Indy was unmatched. His impact on the players who played for him will not be forgotten. My thoughts and prayers are with his family and everyone in the Colts community. He will be missed. Jim, rest in peace my friend.&#8221;

Along with owning the Colts, Irsay was also known for his philanthropic work and his huge Rock &amp; Roll <a href="https://www.jimirsaycollection.com/about" target="_blank" rel="noopener">collection</a>, which includes instruments and items owned by Bob Dylan, The Beatles, Prince, Jimi Hendrix, and many others. Irsay also purchased the original handwritten scroll of Jack Kerouac&#8217;s &#8220;On the Road&#8221; in 2001. The Colts owner often loaned some of his collection to museums, nonprofits, and other organizations to display or research.
Irsay struggled with prescription drug abuse, an issue that the Colts owner said almost killed him. In 2014, Irsay was arrested on suspicion of driving under the influence and was suspended by the NFL, and then in 2023, he was found unresponsive in his bedroom from a suspected overdose. Shortly after the incident, the team said Irsay was recovering from a &#8220;severe respiratory illness.&#8221; Irsay made few public appearances in the months leading up to his death.
Ownership of the team will likely transfer to his daughters, Carlie Irsay-Gordon, Casey Foyt, and Kalen Jackson. His oldest daughter, Irsay-Gordon, will &#8220;primarily take charge of the football side of the franchise,&#8221; The Indianapolis Star <a href="https://www.indystar.com/story/sports/nfl/colts/2025/05/21/carlie-irsay-gordon-colts-jim-irsay/72274815007/" target="_blank" rel="noopener">reported</a>. Irsay-Gordon previously took over for her father when he was suspended during the 2014 season and during his treatment at rehabilitation centers.

General Motors is planning to ramp up its production of light-duty trucks in the United States after President Donald Trump <a href="https://www.dailywire.com/news/trump-touts-businesses-coming-back-with-new-plan-for-25-tariffs-on-vehicles" target="_blank" rel="noopener">imposed</a> a 25% tariff on auto imports, Reuters <a href="https://www.reuters.com/business/autos-transportation/gm-increase-us-truck-production-following-trumps-tariffs-2025-04-03/" target="_blank" rel="noopener">reported</a> on Thursday.
In a message sent to employees, GM said it will increase the truck production at its assembly plant in Fort Wayne, Indiana. The auto company based in Detroit said in a statement that it &#8220;will be making operational adjustments at Fort Wayne Assembly, including hiring temporary employees, to support current manufacturing and business needs,&#8221; according to <a href="https://www.detroitnews.com/story/business/autos/general-motors/2025/04/03/gm-increasing-truck-production-fort-wayne-indiana-tariffs-donald-trump/82794018007/" target="_blank" rel="noopener">The Detroit News</a>.
Plant Director Dennys Pimenta told employees that the change could add more overtime days to the schedule for workers, and a company source told Reuters that hundreds of temporary workers could get hired at the plant, which currently employs around 4,150 workers. GM&#8217;s plants in Canada and Mexico that also focus on making light-duty and full-size trucks will not see any changes to production schedules, a source told The Detroit News.
Trump&#8217;s tariff on auto imports kicked in on Thursday after he announced it in the Oval Office last week.
“What we’re going to be doing is a 25% tariff on all cars that are not made in the United States. If they are made in the United States, there is absolutely no tariff,” Trump said.
The tariff will likely affect Canada and Mexico the most as U.S. car manufacturers have outsourced production of their vehicles to each of those countries. Canada&#8217;s second largest export is vehicles, and around 125,000 Canadians work directly in the automotive industry, the Associated Press <a href="https://apnews.com/article/canada-prime-minister-trump-trade-war-autos-d15ae5b0bab873450b86ca524afda3ca" target="_blank" rel="noopener">reported</a>. On Thursday, Canadian Prime Minister Mark Carney vowed to match the United States&#8217; 25% auto tariff.
“We take these measures reluctantly. And we take them in ways that is intended and will cause maximum impact in the United States and minimum impact in Canada,” Carney said.
Trump recently credited tariffs for bringing manufacturing jobs to the United States after South Korean car manufacturer Hyundai announced a $21 billion <a href="https://www.dailywire.com/news/tariffs-very-strongly-work-trump-announces-21-billion-hyundai-investment-in-u-s" target="_blank" rel="noopener">investment</a> in the country over the next four years.
“This investment is a clear demonstration that tariffs very strongly work,” Trump said. “And I hope other things also, but the tariffs are bringing them in at levels that have not been witnessed.”

The Club For Growth is launching two efforts to back school choice measures in Indiana and North Dakota, the organization told The Daily Wire. 
The organization launched the campaign with ads that aired during the Sunday morning political shows. The campaign comes as President Donald Trump has pushed to dismantle the Education Department and put individual states in charge of education.
“School freedom is the defining civil rights issue of the generation and is only continuing to expand across the country,” Club for Growth President David McIntosh told The Daily Wire. “With the additions of Indiana and North Dakota, Club for Growth has now engaged in 10 states working to pass and protect education freedom in 2025.” 
The North Dakota campaign urges lawmakers to pass legislation that would create an education scholarship program for private schools. Currently, multiple proposals are making their way through the statehouse that would provide parents with education vouchers. The House and Senate have passed two different pieces of legislation that create education scholarship programs with significant structural differences. 
“From crops to crude to championships, North Dakota’s hard to top,” the Club for Growth ad says. “But when it comes to choice in education, we’re 48th in the nation. Legislators in Bismarck can change that with new legislation providing education savings accounts for North Dakota kids, giving parents the freedom to choose the right school for their child.” 
That ad will run Monday through Friday on Fox News and conservative radio in Bismarck.

In Indiana, the Club for Growth ad is urging lawmakers to back Governor Mike Braun’s school choice proposal. Braun has proposed making every student in Indiana eligible for education vouchers. 
“Parents are in charge of their own kids&#8217; education,” Braun says in the ad, which will air on Fox in Indianapolis Monday through Friday. “Let&#8217;s put parents in the driver’s seat with universal school choice.”

The Club for Growth backed school choice measures that became law in Tennessee, Wyoming, and Idaho. It is currently backing efforts in multiple other states, including Georgia, Texas, and South Carolina. 
“The status quo forced upon families by teacher union bureaucrats and the public school monopoly is indefensible — we will not stop until every parent has the opportunity to provide their children with the quality education they deserve,” McIntosh said.

Every time a radical, out-of-control federal judge issues an outrageous opinion, you would think things couldn’t get any worse. But then someone like Richard Young comes along.
Young, a Clinton-appointed federal district court judge in Indiana, just ordered the state’s Department of Corrections to provide sex reassignment surgery to a man who wants to masquerade as a woman—a man who is in prison for murdering a baby.
That, shockingly, is what Young did in his <a href="https://www.foxnews.com/politics/trans-inmate-prison-killing-baby-must-get-gender-surgery-earliest-opportunity-judge.print">order</a> in Autumn Cordellione v. Indiana. Lest you be fooled by the name “Autumn” or the fact that Young refers to “Autumn” as “Ms.” and “her” throughout his disgraceful opinion, this criminal’s real name is Jonathan Richardson. He is in prison for strangling his 11-month-old stepdaughter to death in 2001.
Richardson, who the judge refers to in his order as the “individual” or the “incarcerated transgender person,” is being represented by the ACLU in this lawsuit, in which Richardson demands that he be provided with “gender-affirming surgery.” Really, how can anyone justify making contributions to the ACLU when it engages in this type of despicable litigation?
Indiana has already provided this male child killer with “panties, makeup, and form-fitting clothing” while in prison—a place that, if justice is served for this vicious crime, Richardson will never, ever leave. But as Indiana Attorney General Todd Rokita <a href="https://www.foxnews.com/politics/trans-inmate-prison-killing-baby-must-get-gender-surgery-earliest-opportunity-judge.print">says</a>, “Convicted murderers don’t get to demand that taxpayers foot the bill for expensive and controversial sex-change operations. It defies all common sense.”
Au contraire, according to Young. He says that Indiana’s failure to provide Richardson with the surgery necessary to cut off his penis and give him fake breasts violates the Eighth Amendment.
If this wasn’t a real order from a real federal judge, you’d think it was something written for The Babylon Bee or Mad magazine.
The Eighth Amendment prohibits the infliction of “cruel and unusual punishments.” As the Heritage Guide to the Constitution <a href="https://www.heritage.org/constitution/#!/amendments/8/essays/161/cruel-and-unusual-punishment">explains</a>, the amendment was included in order to prevent the type of “torturous punishments” often inflicted by the British Crown, like “pillorying, disemboweling, decapitation, and drawing and quartering.”
Yet for decades, opponents have tried to use the ban on “cruel and unusual punishments” to outlaw the death penalty altogether. The Supreme Court ended that in 1976 in <a href="https://www.oyez.org/cases/1975/74-6257">Gregg v. Georgia</a>, when it held that the death penalty is not a per se violation of the Eighth Amendment.
The court has further held in a series of cases that under the Eighth Amendment, punishments cannot be disproportionate to the offense. But it also held just last year in <a href="https://www.supremecourt.gov/opinions/23pdf/23-175_19m2.pdf">City of Grants Pass v. Johnson</a>, a case illustrating the extremes to which those trying to misuse the Eighth Amendment will go, that public bans on camping in public parks are not “cruel and unusual punishment.” That claim was just as absurd as the ACLU’s claim in the Richardson case.
Young relies on his opinion in the guidelines on “gender dysphoria” issued by the World Professional Association for Transgender Health, as well as some other so-called experts. WPATH’s <a href="https://can-sg.org/2024/06/28/scandalous-suppression-of-research-on-transgender-health/">work</a> and medical opinions have been severely criticized for bias and lack of scientific rigor. It has also been accused of suppressing research that contradicts its opinions.
Young dismissed the opinion of the treating psychologist at Richardson’s prison that Richardson has personality disorders, not “gender dysphoria,” that display “an established pattern of attention-seeking behavior.”
Richardson is certainly getting that attention with Young’s decision that not providing him with gender surgery is “cruel and unusual punishment.” But we shouldn’t be surprised. Young is the same judge who in 2018 struck down an Indiana law that required healthcare providers to report abortion complications to the state health department in <a href="https://www.aclu-in.org/sites/default/files/sea_340_decisoin.pdf">PPINK v. Indiana</a>.
In other words, when the health and lives of real women were endangered by botched abortions performed by incompetent physicians who committed malpractice, Young prevented state health authorities from being able to do anything about it. Young apparently believes in protecting only fake women, not real ones.
As this case demonstrates, it isn’t only the Trump administration that’s dealing with an arrogant, imperial judiciary that ignores the Constitution and the rule of law and acts far outside of its authority. State governments are also on the receiving end of outlandish and bizarre orders like this one.
The Supreme Court recently declined to intervene – at least for now &#8211; in <a href="https://www.supremecourt.gov/opinions/24pdf/24a831_3135.pdf">Department of State v. AIDS Vaccine Advocacy Coalition</a>, in which the Trump administration is dealing with another rogue judge who has ordered the government to distribute $2 billion of taxpayer money without examining the serious defenses raised by the government. In a dissent from the court’s refusal to hear the case, which was joined by Justices Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh, Justice Samuel Alito wrote:
Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) $2 billion? The answer to that question should be an emphatic “No,” but a majority of this Court apparently thinks otherwise. I am stunned.
The taxpayers and residents of Indiana should also be stunned by the actions of Judge Richard Young who used his thus-far-unchecked power to force them to pay for a sex change operation for a child murderer, the worst of the worst.
Stunned indeed.

The Jasper County, Indiana, Sheriff&#8217;s Office released dashcam footage on Thursday showing last month&#8217;s traffic stop where a man pardoned by President Donald Trump was <a href="https://www.dailywire.com/news/man-who-received-j6-pardon-shot-and-killed-during-traffic-stop" target="_blank" rel="noopener">shot and killed</a> during an altercation with a deputy.
Matthew Huttle of Hobart, Indiana — who benefited from Trump&#8217;s sweeping January 6 Capitol riot pardons — allegedly resisted arrest after being pulled over on January 26. Huttle, who was stopped on State Road 14 for driving 70 mph in a 55 mph zone, told the deputy, &#8220;I just want to let you know that I&#8217;m a January 6th defendant,&#8221; according to body cam footage, the Indianapolis Star <a href="https://www.indystar.com/story/news/crime/2025/02/27/body-cam-footage-jan-6-defendants-traffic-stop-shooting-death-released-matthew-huttle-jasper-county/80731312007/#body-cam-matthew-huttle" target="_blank" rel="noopener">reported</a>.
&#8220;What do you mean?&#8221; the deputy asked.
&#8220;I stormed the Capitol. I&#8217;m waiting on my pardon,&#8221; Huttle replied, adding, &#8220;Yeah, and I can&#8217;t really afford to get into any trouble right now.&#8221;
He then admitted to driving without a license. Informed that his felony offense requires that the officer transport him to jail, Huttle said, &#8220;I can&#8217;t do it. No, I can&#8217;t go to jail for this, sir.&#8221;
The bodycam footage appears to have been taken down by YouTube. Dashcam <a href="https://www.youtube.com/watch?v=v-B64wlUUOs" target="_blank" rel="noopener">footage</a> of the incident is still on the platform and shows Huttle sprinting to the driver&#8217;s side door and reaching into the vehicle.

The Clinton County, Indiana, Prosecutor’s Office reviewed the case and said that the deputy chased Huttle before a struggle ensued. After jumping into the car, Huttle allegedly raised a gun and said, &#8220;I&#8217;m shooting myself.&#8221; The prosecutor&#8217;s office <a href="https://www.in.gov/sheriffs/jasper/files/Jasper-County-OIS-Final-Report.pdf" target="_blank" rel="noopener">concluded</a> that the officer &#8220;was legally justified in using deadly force to defend himself.&#8221;
&#8220;Believing that Huttle posed a deadly threat, the Deputy fired multiple shots, striking Huttle. The Deputy then retreated to his vehicle and awaited backup. Lifesaving measures were attempted, but Huttle was pronounced deceased at the scene,&#8221; the prosecutor&#8217;s office said.
During the traffic stop, Huttle &#8220;was found to be a Habitual Traffic Violator,&#8221; a felony under Indiana law, according to the prosecutor&#8217;s office. The 42-year-old Indiana man previously spent time behind bars for a driving offense.
Shortly after being released from jail for his previous offense, Huttle attended the rally at the Capitol in Washington, D.C., on January 6, 2021. He later pled guilty to entering a restricted building after being inside the U.S. Capitol for 16 minutes. Huttle&#8217;s defense attorney, Andrew Hemmer, said that his client was “not a true believer in any political cause” but was only at the Trump rally that day “because he thought it would be a historic moment and he had nothing better to do after getting out of jail.”

In the past nine years, there have been three presidential elections, 6 congressional elections, and 35 different iPhone models.
Yet, in that same amount of time, one former Purdue University student has been stuck in limbo, unable to end a nightmare that began all those years ago.
<h3>The Allegations</h3>
During the fall semester of 2015, a male student whom The Daily Wire will refer to as John Doe began dating a female student referred to in court documents as Jane Doe. The relationship was okay for a while, but on December 13, 2015, Jane threatened to commit suicide in front of John by standing on the ledge of a parking garage after throwing objects around her dorm room and crying while saying she hated life. After this incident, according to John’s eventual lawsuit against Purdue reviewed by The Daily Wire, all sexual activity between the two ceased.
In early January 2016, John reported Jane’s suicide attempt to Purdue, and shortly after, she began to pull away from the relationship and the two went their separate ways. Four months later, and only after Purdue’s highly marketed Sexual Assault Awareness Month events, Jane accused John of sexually assaulting her during their relationship.
John received notice of the accusations on April 11, 2016. Jane claimed she awoke one night to John groping her. She told him it was not okay. John told her at some point before that incident that he digitally penetrated her while she was sleeping. He said he felt bad about the first incident but proceeded to the second incident anyway. Jane became upset at John over these incidents and left his room. John had also gone through her underwear in her laundry, and had once chased her down the hall, joking about tasing her. After they had broken up, he also continued to go to her room unannounced. She claimed John had a temper he couldn’t control as well.
John vehemently denies Jane’s allegations, stating in his lawsuit that he responded to the allegations by informing Purdue that he never groped her in her sleep in November 2015, but that in mid-December of that year, after her suicide attempt, she slept on a futon in his dorm room while he slept on the floor. At some point in the night, John accidentally touched her knee and she began freaking out before leaving the room. John also said he never had any sexual contact with her while she was asleep, and therefore never told her that he did. He added that he never went through her laundry but sometimes did her laundry for her and never threatened to tase Jane. He also noted that the two never formally broke up, they simply began seeing each other less, and that he merely went to her room to return an item. At that time, she told him not to go to her room, so he didn’t.
John provided evidence that Jane continued to shower him with affection even after these alleged incidents, demonstrating behavior not in line with someone who had been sexually assaulted. She continued to text with John over the holidays, wished him a Happy Christmas Eve, and sent him a package of homemade cookies for his family. She also invited him to her room at the beginning of the spring 2016 semester.

In addition, John provided Purdue with evidence that it was Jane who had the temper and tried to project that onto John. She often contemplated running away and not returning to the school as well. John also provided a list of more than 30 names to substantiate his reputation, since Jane attacked his character and credibility in her allegations.
Purdue’s policy did not allow John to review the investigator’s prepared report, nor was he provided a hearing to determine the credibility of Jane’s claims. John maintains in his lawsuit that his “ability to defend himself was severely and unfairly prejudiced.”
Instead of a hearing, a three-person panel reviewed John’s case. Jane never appeared before the panel and instead provided a statement written by Purdue’s Title IX coordinator. In that statement, Jane only requested that John be removed from Purdue’s Navy ROTC program, of which they were both members. Jane’s new boyfriend at the time was also a member. Jane stated that she didn’t fear John on campus and merely wanted him out of the ROTC.
Without any evidence corroborating Jane’s claims, John was suspended from Purdue and had to leave the Navy ROTC program. He appealed the decision, but was denied without adequate explanation, so he filed a lawsuit against the university as many students have done in the past decade.
<h3>The Lawsuit</h3>
John dreamed of becoming a Navy SEAL officer, but says he can’t get a federal job with this on his record. His Title IX case is the longest ongoing case of its kind, with the closest similar case lasting seven years and ending in a disappointing motion to dismiss for the wrongly accused student.
“Purdue&#8217;s wrongful suspension of me closed all federal &amp; military employment opportunities because I was employed with the Navy through their ROTC program at the time of the suspension, which forced me to ‘resign’ with the Navy after my school suspension was finalized,” John told The Daily Wire in an email.
“Expungement of my school disciplinary file would give me an opportunity to fix my [Department of Defense] record, which currently makes me look bad due to the circumstances and thus limits my employment opportunities. For reference, I was a 4.0 GPA varsity athlete when I graduated high school, and double majoring with a minor while employed with the Navy ROTC at Purdue. My longtime dream was to become a Navy SEAL officer. The derailment of my life by Purdue was severe, to say the least.”
The case has persisted due the slow nature of the justice system, numerous filings and responses from both parties, and appeals to higher courts. The case even landed on the desk of Judge Amy Coney Barrett before she was nominated for the Supreme Court. Barrett, who was with the Seventh Circuit Court of Appeals in 2019, upheld John’s claims that Purdue violated his due process and Title IX rights. Title IX prohibits discrimination based on sex, and accused students have said they are discriminated against as males when they are falsely accused and a school takes no steps to protect them.
When the case was sent back to a lower court, a judge dismissed John’s due process claim. John is trying to get the court to reinstate that claim and has had the judge who dismissed it replaced. The next stage of this case is a trial on the Title IX claim alone, which could result in what John ultimately wants: This whole thing to be expunged from his record.
After nine years of litigation, John’s family has spent more than $350,000 on legal bills, draining their savings and 401ks. He is currently working to set up a fundraiser to continue fighting Purdue’s persecution.

<h3>Purdue’s Response</h3>
In a statement to The Daily Wire, Purdue University chief spokesperson Erin Murphy said the school rejected John’s assertions of unfairness toward him.
“Most of [John’s] claims were dismissed long ago,” Murphy said, referring to the multiple claims students include in lawsuits hoping at least one will be accepted.
“His single remaining claim has been ready for trial for years. [John] insists on going to trial, but his lawyers have caused delays. Some of his lawyers quit his case in June 2023 after the last settlement conference,” Murphy continued. “[John] has publicly criticized those former lawyers. His remaining lawyer has filed repeated demands for a different judge, which were rejected by multiple courts, including the United States Supreme Court. His remaining lawyer has also required trial postponements for personal reasons that are shown in the court record.”
Those “delays” refer to John and his attorney attempting to get a new judge assigned to the case due to allegations of unfairness and a pro-Purdue bias. There is a new judge overseeing the case, as the previous judge was promoted by the Biden administration.
John’s attorneys did not quit on him, and the “public criticism” Murphy refers to is a testimonial on his attorney’s website saying that the attorney left his previous law firm “after partners at the firm tried to strong-arm” John’s case from him.
Finally, the “personal reasons” Murphy alludes to at the end of her statement refers to the attorney’s cancer diagnosis. John’s attorney has been battling cancer while fighting for his client.
