An Indiana prison must provide transgender surgery to an inmate convicted of killing a baby, a federal judge ruled last week.
Jonathan C. Richardson, 42, who now identifies as female and goes by Autumn Cordellionè, was <a href="https://www.dailywire.com/news/aclu-demands-gender-surgery-for-trans-identifying-male-who-murdered-baby">convicted</a> in 2001 of fatally strangling his 11-month-old stepdaughter. He is currently serving 55 years behind bars for reckless homicide.
In August of last year, the American Civil Liberties Union <a href="https://www.aclu-in.org/sites/default/files/field_documents/cord-complaint.pdf" target="_blank" rel="noopener">sued</a> the Indiana Department of Corrections on behalf of Cordellioné, demanding the prison system pay for his transgender genital surgery.
An Indiana law that took effect last year prevents taxpayer dollars from going toward transgender surgeries for prison inmates. The ACLU argued the law violates the Constitution&#8217;s ban on &#8220;cruel and unusual punishment&#8221; because the surgery is a &#8220;medical necessity&#8221; for Cordellioné.
Last week, United States District Court Judge Richard Young sided with the ACLU and handed Cordellioné a win.

&#8220;Specifically, Ms. Cordellioné has shown that her gender dysphoria is a serious medical need, and that, despite other treatments Defendant has provided her to treat her gender dysphoria, she requires gender-affirming surgery to prevent a risk of serious bodily and psychological harm,&#8221; the judge wrote in his ruling.
The state corrections department must now take &#8220;all reasonable actions&#8221; to provide Cordellioné with transgender genital surgery.
Indiana&#8217;s Republican attorney general, Todd Rokita, promised to appeal the judge&#8217;s ruling.

Cordellioné also identifies as a Muslim woman and previously <a href="https://reduxx.info/transgender-muslim-inmate-serving-55-year-sentence-for-killing-a-baby-launches-discrimination-lawsuit-after-being-denied-a-hijab/" target="_blank" rel="noopener">sued</a> the Chaplain at his prison after he was allegedly denied a hijab.
Cordellioné&#8217;s baby stepdaughter&#8217;s autopsy showed she had been manually strangled to death while her mother was at work, according to <a href="https://caselaw.findlaw.com/court/in-court-of-appeals/1287327.html" target="_blank" rel="noopener">court documents</a>. He told detectives that he also shook the child “in a rough manner,” the appeal documents said.
At one point while he was incarcerated, Richardson told corrections officers, “Well all I know is I killed the little f***ing bitch.”
Cordellioné began identifying as a female around 2020 while in prison. He was diagnosed with gender dysphoria and has been taking female hormones and a testosterone blocker since then, according to court documents.
He has been able to obtain “panties, make up, and form fitting clothing” in prison, but he continues to experience &#8220;serious depression and anxiety&#8221; caused by his &#8220;recognition that she is a woman trapped in a man’s body,&#8221; documents say.
The ACLU said that trans-identifying men who cannot get transgender genital surgery may try to castrate themselves to &#8220;alleviate their distress.&#8221;
Cordellioné has attempted suicide and engaged in self-harm, the lawsuit claims.
His earliest possible release date is August, 2026.
Trans-identifying male inmates have caused a number of challenges for prisons in recent years.
Cordellioné is far from the first prison inmate to demand sex reassignment surgery. The ACLU has <a href="https://www.nbcnews.com/nbc-out/out-news/federal-court-orders-first-gender-affirming-surgery-trans-prisoner-rcna25377" target="_blank" rel="noopener">sued</a> successfully on behalf of other inmates demanding this procedure.
Other inmates have <a href="https://www.npr.org/2023/06/01/1179301244/minnesota-settlement-lawsuit-transgender-inmate-christina-lusk-prison#:~:text=Pop%20Culture-,Trans%20inmate%20to%20move%20to%20women's%20prison%20after%20settling%20lawsuit,access%20to%20gender%2Daffirming%20care." target="_blank" rel="noopener">demanded</a> <a href="https://www.dailywire.com/news/transgender-triple-murderer-sent-to-womens-prison">successfully</a> to be transferred to women&#8217;s prisons, resulting in them living alongside biologically female inmates. This has sparked <a href="https://www.nbcnewyork.com/investigations/man-posing-as-transgender-woman-raped-female-prisoner-at-rikers-lawsuit-says/5067904/" target="_blank" rel="noopener">lawsuits</a> from women inmates accusing trans-identifying men of sexually abusing and even raping them.

A University of Indiana-Bloomington student was awarded six figures in damages after a jury found the university had discriminated against him based on his sex.
The student, who will be referred to as John Doe, appears to be the first student who has won on Title IX grounds – that is, he was found to be discriminated against specifically because he was a male and not on the grounds that the school breached its contract with him.
In June 2020, John was a student at IU and matched with a woman who will be referred to as Jane Doe on a dating app. On the evening of June 16, 2020, Jane texted John and agreed to come to his house for a date, even after John suggested meeting somewhere else. Jane arrived at John’s house, and the two talked for a bit. They had two glasses of wine, including a glass Jane had poured for each of them.
Just after midnight, Jane received a phone call from a friend asking if she needed a ride home, but she said no. She texted the friend about 40 minutes later to say “looks like I’ll be here a hot minute,” according to court documents reviewed by The Daily Wire.
Jane would later claim that immediately after this, she “blacked out” and didn’t remember anything that happened – and suggested that John had drugged her.
John says in his lawsuit against the university that Jane showed no signs of incapacitation or being blacked out – which is a state of mind where the brain doesn’t form short-term memories, but people in such a state can appear completely coherent. He said Jane started kissing him, and the two went up to his room where they, two math majors, completed complex math problems. The two then laid down in John’s bed and, according to John, Jane initiated sexual contact with him, removing her shirt and bra and initiating kissing.
John said in his lawsuit that he asked to stop, feeling they were moving too fast. He went to the bathroom and returned to find Jane asleep in his bed, so he got into bed next to her and fell asleep as well.
At some point, Jane started receiving calls from her roommate but wouldn’t wake up when John tried to let her know. He said he eventually answered the call and said Jane was asleep and didn’t want to talk. Jane’s roommate told him that she was coming to get Jane.
This roommate later said they found Jane naked in John’s bed and that she appeared “out of it.” With John’s help, the roommate and another friend gathered Jane’s things and left John’s house.
Early the next morning, John texted Jane to say he was “sorry about last night,” referring to the awkwardness of Jane leaving his home. Jane claimed she didn’t know what happened and that her roommate was mad at her. Jane claimed she “did not know how she got that drunk” and told John she was “really sorry,” according to court documents.
The two discussed the events of the previous night and Jane’s level of intoxication. About seven hours after their encounter, Jane texted John, saying, “You do realize you sexually assaulted me, right? I just talked to my roommate and got a much better idea of what happened last night.”
John didn’t respond.
A couple of days later, Jane went to the hospital for a rape test kit and drug test. She then reported John to the police and IU. Police investigated, and no charges were brought, but IU went ahead with its own investigation that didn’t allow John full use of counsel, denied him the ability to cross-examine witnesses, and gave him only a single, time-limited chance to see the evidence against him.
He was found not responsible for drugging Jane – and she never turned over the results of her drug test – but was still found responsible for sexually assaulting her, even by her own admission she only had 2-and-a-half glasses of wine.

John sued the university, and the case went all the way to a jury trial, which ruled in favor of John and awarded him $136,782.60, which, according to his attorney, Jonathan Little, is less than what he paid in legal fees.
Little told The Daily Wire that he typically represents victims but has been taking cases involving false accusations of men on college campuses.
“The process given to these men is just a farce,” he said, noting that the current campus climate at IU and other schools “gives the impression that any young lady can run to Indiana University and cry rape.”
He added that IU spent the trial going over its policies, essentially arguing that it could follow its own policies and not the law set forth under Title IX.
“IU’s hubris lost them this case and I hope that what we did is replicable – I believe that it is – and I hope that other lawyers can look at this and do the same thing,” he told The Daily Wire.
The university did not respond to a Daily Wire inquiry prior to press time.

Authorities say an illegal alien from Honduras who stabbed a 14-year-old girl with what is believed to be a butcher knife and fled the scene has been arrested.
The teenage girl was watching her brother’s baseball game in Lowell, Indiana, on Saturday when she was allegedly stabbed in the hand by a man who authorities say was residing in the country illegally after being previously deported.
Dimas Gabriel Yanez, a 26-year-old Honduran native, was captured by law enforcement in a manhunt that ended on Sunday, a day after the stabbing.

“Investigators have learned Yanez had been deported to Honduras in 2018 and may have been engaged in criminal activity across the United States since returning to the country illegally,” Sheriff Oscar Martinez Jr. said. “The US Department of Homeland Security has been notified of his arrest today.”
Law enforcement also noted that Yanez allegedly attempted to attack the girl’s mother when she tried to intervene.

Vice President <a href="https://www.dailywire.com/topic/kamala-harris" target="_blank" rel="noopener">Kamala Harris</a> ditched Israeli Prime Minister Benjamin Netanyahu&#8217;s Congressional address in order to speak at the Zeta Phi Beta sorority&#8217;s Grand Boule in Indiana, an event that aides said she had previously planned to attend.
The event was titled, &#8220;Finer Women Amplifying The Extraordinary Power of S.H.E. through 
Legacy, Leadership &amp; Impact,&#8221; and was scheduled to be held July 23-28 at the Indiana Convention Center in Indianapolis.
Despite the event being previously scheduled, critics pointed out the awkward optics of Harris not being present at Netanyahu&#8217;s address — particularly because President Joe Biden was not attending either and because, since Biden officially dropped out of the 2024 presidential race on Sunday, she has since become the Democratic Party&#8217;s presumptive nominee.

While Harris missed Netanyahu&#8217;s address for another event, <a href="https://www.dailywire.com/news/here-are-all-the-lawmakers-skipping-netanyahus-congressional-address" target="_blank" rel="noopener">dozens of members of her party</a> boycotted it intentionally. The man accused of killing two Delphi, Indiana, teenagers back in 2017 has lost his latest bid to remove the trial judge from his case.
Attorneys for Richard Allen, 51, had attempted for a second time to get Special Judge Fran Gull removed from Allen’s upcoming trial, citing bias against the defense. Their latest attempt argued that Gull had violated court policies by failing to rule on two defense motions within the 30-day time frame, the Journal &amp; Courier <a href="https://www.jconline.com/story/news/crime/2024/07/19/delphi-suspect-richard-allen-judge-frances-gull-abigail-williams-liberty-german-odinism-odinists/74474116007/" target="_blank" rel="noopener">reported</a>.
The attorneys argued that due to Gull’s lack of a ruling, the case must be withdrawn from her, and a new special judge must be appointed by the Indiana Supreme Court. Justin Forkner, chief administrative officer of the Indiana Supreme Court, disagreed.
&#8220;However, Mr. Allen is mistaken, and the matter should not be removed from the trial court,&#8221; Forkner ruled on Friday.
Forkner argued that Allen’s attorneys should have filed to remove Gull shortly after the 30-day deadline passed, not several months later, though nothing in the cited Indiana <a href="https://www.in.gov/courts/iocs/files/pubs-trial-court-failure-to-rule-on-motion-and-delay-of-judgments.pdf" target="_blank" rel="noopener">Trial Rule 53.1</a> suggests such a deadline.
In March and April, Allen’s attorneys filed motions seeking hearings to allow the defense to present evidence that law enforcement made false statements in its affidavit that resulted in Allen’s arrest in October 2022.
The refusal to remove the judge is the latest drama in an already contentious legal case. Allen is charged with the kidnapping and murder of 13-year-old Abby Williams and 14-year-old Libby German on a hiking trail in 2017.
In May, Judge Gull <a href="https://www.dailywire.com/news/delphi-judge-declines-to-hold-defense-attorneys-in-contempt-but-calls-them-incompetent" target="_blank" rel="noopener">refused</a> to hold Allen’s defense attorneys, Andrew Baldwin and Bradley Rozzi, in contempt following allegations from Carroll County Prosecutor Nicholas McLeland. Gull did, however, call the defense attorneys “incompetent” during her ruling.
Gull said that McLeland “proved by a preponderance of the evidence that defense counsel was sloppy, negligent and incompetent in their handling of discovery material.” However, she added that the prosecutor failed to prove “beyond a reasonable doubt” that the attorneys were “willful and intentional” in their actions.
But she also agreed with defense attorneys that McLeland failed to show they should be held in contempt because they violated a gag order. McLeland’s evidence of this was a statement the attorneys made before the gag order was put in place.
Judge Gull also previously forced Allen’s defense attorneys to withdraw by threatening to harm their reputations in open court. The attorneys withdrew but filed a petition to represent Allen pro bono. Judge Gull then barred them from representing Allen in any capacity.
The transcript, <a href="https://www.wthr.com/article/news/crime/delphi-girls-murdered/delphi-murders-trial-transcript-released-conversation-richard-allen-attorneys-disqualification-judge-chambers-libby-german-abby-williams-indiana-case/531-2878bbc2-4e2d-429a-b13e-89a0aa72b467" target="_blank" rel="noopener">first obtained by WTHR</a>, shows that the judge planned to remove the two attorneys before she publicly announced their withdrawal.
At the meeting, which included McLeland, the group discussed <a href="https://www.dailywire.com/news/attorneys-for-man-suspected-of-killing-delphi-teens-withdraw-from-case-after-security-breach" target="_blank" rel="noopener">a leak of documents</a> from Baldwin’s office, but Judge Gull stated that was not the only reason she wanted the attorneys removed from representing Allen. Gull said the attorneys “potentially” violated the Rules of Professional Responsibility. She told Baldwin he was “grossly negligent” for sending a sensitive email to a “Brad” who was not Rozzi, and questioned whether the two attorneys had fully cooperated with a gag order she had filed. She also said she had evidence the attorneys “left materials all over a conference-room table, accessible to anyone.”
The defense attorneys have also tried to have Judge Gull removed previously, to no avail. Prior to this trial, the defense attorneys had not been accused of incompetence or contempt.

Delphi Murder Suspect Loses Latest Bid To Remove Judge From Case

Herb Baumeister has never been convicted of any murders, since he committed suicide before he could be arrested, but the number of human remains found on his property could make him one of America’s most prolific serial killers.
Baumeister was born in Indianapolis, Indiana, on April 7, 1947. Around the time he became an adolescent, he began showing antisocial behavior and was diagnosed with paranoid schizophrenia and antisocial personality disorder, but was never treated for either.
In 1971, he married Julie Saiter and the couple had three children. In May 1988, they purchased a $1 million estate called Fox Hollow Farm, the same year Baumeister founded a successful thrift-store chain in Indianapolis.
Six years after purchasing the farm property, Baumeister’s 13-year-old son Erich brought home a human skull, which he said he had found in the woods on the property, according to a 1996 <a href="https://people.com/archive/while-julie-was-away-vol-46-no-26/" target="_blank" rel="noopener">article</a> from People Magazine. Baumeister told Julie that the bones were from a medical school skeleton that once belonged to his late father, a doctor, but didn’t explain what they were doing on the couple’s property. Days later, the bones were gone, and Julie simply assumed that an animal had taken them.
Julie would later learn that during the summers, when she was away with the couple’s three children, Baumeister would frequent Indianapolis gay bars – from which multiple men would disappear. It started in June 1980, when the body of a 15-year-old boy was found – the first connected to an American serial killer at the time known only as the I-70 Strangler. The boy, Michael Petree, was a male prostitute who spent time at Indianapolis gay bars – the same ones Baumeister would go to.
Ten more bodies wouldn&#8217;t be found until August 1991. Police believed that by then, Baumeister was using Fox Hollow Farm to dispose of the bodies.

In the early 1990s, police were investigating multiple gay men reported missing – who were all of a similar age, height, and weight. In 1994, a man named Tony Harris contacted the Marion County Sheriff’s Department to say he believed a man who frequented the gay bars – who called himself “Brian Smart” – had likely killed his friend Roger Goodlet. Harris based this claim in Smart’s odd interest in Goodlet’s missing person case and his own near-death experience with Smart sometime earlier.
Smart was identified as Baumeister, and investigators asked to search the Fox Hollow home and property. Baumeister and Julie refused the search, but in 1996, the couple had divorced, and Julie had become fearful of her husband’s behavior, so she allowed the search to move forward.
The first search of the Baumeister property turned up the remains of eleven men, and a warrant was issued for Baumeister’s arrest. One of those victims is Roger Goodlet, whose connection to Tony Harris led to police identifying Baumeister as a potential killer.
Before police could arrest him, however, Baumeister fled to Ontario, Canada, and shot himself in the head, leaving behind a suicide note that mentioned his broken marriage and failing business but not the remains. 
On December 4, 2022, a new search of Baumeister’s old farm was conducted, and a new bone was found, along with 20 locations identified as possibly concealing more human remains, WRTV <a href="https://www.wrtv.com/news/local-news/crime/bone-found-during-sunday-search-of-herbert-baumeister-property" target="_blank" rel="noopener">reported</a> at the time.
In May 2024, another search was conducted, and authorities recovered more than 10,000 bone fragments scattered across the 18-acre property, the Indy Star <a href="https://www.indystar.com/story/news/2024/06/05/fox-hollow-farms-victims-identified-alleged-indiana-serial-killer-herbert-baumeister-wesffield/72369859007/" target="_blank" rel="noopener">reported</a>. 
The remains are being analyzed, Hamilton County Coroner Jeff Jellison said, adding that just a tiny fraction of those bone fragments have been identified so far.
&#8220;We have roughly 10,000 bone fragments, and my guess is that we haven&#8217;t gone through 160 of those yet,&#8221; he said, according to the Star. &#8220;We&#8217;ve got a lot of work in front of us, but every day is a step forward.&#8221;
So far, authorities have identified at least 13 unique DNA profiles from remains found on Baumeister’s property, and nine of those have been identified as gay men who went missing in the 1990s. Four other sets of remains have not been identified yet. This number includes those found on the property in the 1996 search.
Two years ago, authorities asked family members whose loved ones went missing in the mid-1980s to mid-1990s to submit DNA samples to be compared to remains found on Baumeister’s property.
In total, that means Baumeister is currently suspected of killing at least 25 people (11 as the I-70 Strangler, and 13 more who were found on his property, plus an additional murder Baumeister was linked to posthumously). With 10,000 bone fragments to identify, that number could increase exponentially.
The world may never know the extent of Baumeister’s crime, and he will never be held accountable for his alleged actions, since he has been dead for 30 years. And because of that, he will always be a “suspected” serial killer.

Left-wing bureaucrats at the Environmental Protection Agency (EPA) are working hard to force states to abandon reliable, low-cost, fossil fuel-based energy in favor of unreliable, high-cost, solar, wind, and battery-based power.
The EPA’s latest scheme includes a power grab for the grid by imposing several new regulatory commandments that states must follow under the Clean Power Plan and the Clean Air Act. The intended effect of these regulations is to replace the fossil fuel-fired plants that form the backbone of America’s electric grid with renewable energy sources, such as wind and solar.
I call it Joe Biden’s plan to wreck the grid — a grid which provides the energy needed to charge our iPhones, access the internet, heat and cool our homes, and power our schools, businesses, factories, farms, and hospitals.
This reckless and radical scheme jeopardizes the safety and security of America’s electrical grid and forces all of us to pay far more for the electricity we take for granted.
Indeed, the Indiana Municipal Power Agency — which provides electricity to many rural customers — projects a double-digit rate increase under the Biden administration’s Clean Power Plan 2.0.
The EPA’s pet project to force the grid to go green is also illegal — which is why my office is fighting these regulations in court.
<h4>The Good Neighbor Rule</h4>
The first legal challenge is to the “good neighbor” rule imposed under the Clean Air Act, which requires states to reduce ozone pollution from in-state sources transported downwind into other states. 
Although the EPA establishes national air quality standards, Congress has reserved to the states the authority to determine how those standards will be met — including those relating to states’ “good neighbor” obligations. This dual allocation of responsibility between the federal government and the states reflects the Clean Air Act’s “cooperative federalism” model. 
As the U.S. Supreme Court noted in Union Elec. Co. v. EPA, each state enjoys “wide discretion in formulating its [air pollution] plan.” Biden bureaucrats apparently never got that memo. In 2022, the EPA arbitrarily rejected the good neighbor plans of 23 states, including Indiana’s. To make things worse, instead of allowing states to remedy any alleged deficiencies in their plans, as the Clean Air Act contemplates, the EPA imposed a one-size-fits-all plan on the states. 
In truth, Biden bureaucrats aren’t interested in working with Indiana or any other state. So much for the “cooperative federalism” model; under this Administration, it’s do as you’re told. However, Hoosiers don’t bend the knee to D.C. bureaucrats, which is why my office has joined the attorneys general of Ohio and West Virginia in a legal challenge to the EPA’s “good neighbor” rule.
In addition to the dubious legality of the “good neighbor” rule, the EPA has failed to address where the energy to support the electric grid will come from after fossil fuel-based sources are forced offline.
The company managing the electrical grid for Indiana and other states, PJM, recently <a href="https://www.pjm.com/-/media/library/reports-notices/special-reports/2023/energy-transition-in-pjm-resource-retirements-replacements-and-risks.ashx" target="_blank" rel="noopener">reported</a> that the current pace of new energy sources, such as solar and wind, would be “insufficient” to keep up with expected retirements of fossil-fuel energy sources mandated by the EPA.
The report explains that wind and solar energy sources are “intermittent and limited duration resources”—meaning the sun doesn’t always shine and the wind doesn’t always blow. Thus, for each megawatt of electricity generated by fossil fuels lost under the EPA rule, it will take multiple megawatts of wind and solar energy to replace it.
Don’t be fooled by the Administration’s green energy gas bags touting the alleged superiority of solar and wind power. They may have a role in meeting America’s future power needs, but they are inferior when it comes to producing reliable power.
Joe Biden claims that his energy policies will make electricity more affordable, but Hoosiers know hogwash when they hear it. Great Britain and Germany live under the same mandates the Biden administration pushes here, and people there pay about three times more for electricity than Americans.
Rather than being dissuaded by these facts, Biden bureaucrats are doubling down. The EPA just unveiled the final version of a rule regulating greenhouse gas emissions from power plants. I’m proud that my office, in conjunction with West Virginia, is leading a 25-state strong coalition challenging the new rule—a rehash of the Obama-era “Clean Power Plan” found unlawful by the Supreme Court in West Virginia v. Environmental Protection Agency. Like its predecessor, Clean Power Plan 2.0 would shutter fossil fuel power plants, despite the Court’s rejection of the notion that federal bureaucrats can dictate “how Americans will get their energy.”
Given the advent of new technologies with an unquenchable thirst for electricity, regulations that reduce the power supply can only be called reckless. As demand for power grows and these radical green policies suppress supply, electricity prices will surge — jolting the most vulnerable Hoosiers.
Joe Biden’s energy bureaucrats are fully committed to their radical and reckless agenda to wreck the grid, despite the untold costs to Americans’ security and pocketbooks. That’s why Indiana and our partner states are committed to challenging their actions in court and pulling the plug on their illegal power grab.

The trial of Richard Allen, who is accused of killing two Delphi, Indiana, teenagers back in 2017, has been pushed back to October.
Jury selection was scheduled to begin next week, but on Tuesday, Special Judge Fran Gull accepted a defense attorney&#8217;s request to waive Allen’s right to a speedy trial, WTHR <a href="https://www.wthr.com/article/news/crime/delphi-girls-murdered/delphi-murders-hearing-tuesday-length-trial-terms-names-banned-jury-selection-richard-allen-libby-german-abby-williams-indiana/531-065c4277-6461-461d-830a-963d01a043fb" target="_blank" rel="noopener">reported</a>. Allen’s defense attorneys had asked for 15 days to present the case and said if Gull wouldn’t allow that in May, the trial could be moved to a later date.
&#8220;If you can&#8217;t try this case in one month, there&#8217;s something wrong,&#8221; Gull told Allen’s attorneys at the hearing, according to WTHR.
“You don’t know anything about this case,” Allen’s attorney, Brad Rozzi, responded.
The exchange highlighted a contentious relationship between the judge and Allen’s defense attorneys. Gull had previously forced Rozzi and Allen’s other attorney, Andrew Baldwin, to withdraw from the case by threatening to embarrass them in open court. The attorneys took the case to the Indiana Supreme Court and <a href="https://www.dailywire.com/news/new-charges-filed-against-delphi-murder-suspect-original-attorneys-reinstated" target="_blank" rel="noopener">were reinstated</a>, but their request to remove Gull as judge was denied.
At the hearing on Tuesday, Baldwin also introduced a motion again requesting that Gull be removed from the case.
Rozzi argued that it was not practical for the trial to start so soon, with issues like whether the jury will hear Allen’s jailhouse confessions – which the defense contends came under duress – still pending. He suggested that no end date be set for the trial.
&#8220;We&#8217;re not saying we&#8217;re not ready – we&#8217;re just saying we don&#8217;t want you to bookend this,&#8221; Rozzi said multiple times during the hearing.
The new trial will run from October 15 to November 15, Fox 59 <a href="https://fox59.com/indiana-news/richard-allens-trial-in-delphi-murders-case-pushed-back-to-october-defense-withdraws-request-for-speedy-trial/" target="_blank" rel="noopener">reported</a>, and three days of pretrial evidence hearings will take place between May 21 and May 23.
The hearing came just a week after Gull declined to hold Baldwin and Rozzi in contempt but called them “<a href="https://www.dailywire.com/news/delphi-judge-declines-to-hold-defense-attorneys-in-contempt-but-calls-them-incompetent" target="_blank" rel="noopener">incompetent</a>.” Carroll County Prosecutor Nicholas McLeland had accused defense attorneys Andrew Baldwin and Bradley Rozzi of contempt of court due to an evidence leak and allegations they violated a gag order, Fox 59 <a href="https://fox59.com/news/indycrime/judge-finds-delphi-defense-team-sloppy-and-incompetent-but-not-in-contempt/" target="_blank" rel="noopener">reported</a>.

Gull said in her ruling that McLeland “proved by a preponderance of the evidence that defense counsel was sloppy, negligent and incompetent in their handling of discovery material.” However, she added that the prosecutor failed to prove “beyond a reasonable doubt” that the attorneys were “willful and intentional” in their actions.
Gull also agreed with the defense attorneys that they didn’t violate the gag order because it was put in place after they made the remarks McLeland claimed violated it.

As for the evidence leak, that was allegedly perpetrated by a former worker at Baldwin’s law firm, 41-year-old Mitchell Westerman, who <a href="https://www.dailywire.com/news/indiana-man-charged-with-leaking-evidence-related-to-delphi-murder-trial" target="_blank" rel="noopener">was charged</a> with one count of conversion after admitting that he took pictures of crime scene evidence related to the 2017 murders. The evidence leak led Gull to dismissing Baldwin and Rozzi from the case, but the two were <a href="https://www.dailywire.com/news/new-charges-filed-against-delphi-murder-suspect-original-attorneys-reinstated" target="_blank" rel="noopener">reinstated</a> by the Indiana Supreme Court.

Allen’s trial is scheduled to begin on May 13, with prosecutors saying he is the sole killer while the defense claims other people are responsible – namely, members of a cult. The defense attorneys point <a href="https://www.dailywire.com/news/delphi-defense-attorneys-say-newly-obtained-cellphone-data-points-to-other-suspects" target="_blank" rel="noopener">to cellphone evidence</a> suggesting someone else was at the crime scene hours after Allen was said to have committed the murders.
The defense attorneys pointed to members of the cult as alleged suspects, whom The Daily Wire will not be naming since they have not been charged with any crimes. One of these named individuals’ social media posts contained images that mimicked the runes found at the crime scene, even though such images have never been released to the public, according to the defense. The individual allegedly also posted numerous “easter eggs” on social media that pointed to his involvement in the crime, including a recreation of the crime scene involving two women posing as dead with sticks over their bodies, just like the actual crime scene. This same individual also seemingly taunted police on social media, the defense claims.
One further tie to the victims is that this man’s son was allegedly “dating” the young victim, Abby.

Delphi Judge Declines To Hold Defense Attorneys In Contempt, But Calls Them 'Incompetent'

Defense attorneys for the man accused of killing two Delphi, Indiana, teenagers back in 2017 say newly obtained cellphone data suggests someone other than their client committed the crimes.
Richard Allen was charged with kidnapping and murdering 13-year-old Abby Williams and 14-year-old Libby German on a Delphi hiking trail. His defense attorneys say the prosecution’s timeline of the crime no longer points to their client, WTHR <a href="https://www.wthr.com/article/news/crime/delphi-girls-murdered/defense-says-newly-obtained-phone-location-evidence-points-to-other-suspects-not-richard-allen-in-delphi-murders-libby-abby-monon/531-e27956d0-9b67-4ab2-aa3e-c9648ec764d6" target="_blank" rel="noopener">reported</a>.
Defense attorneys Brad Rozzi and Andrew Baldwin wrote in their fourth request to throw out evidence found during a search of Allen’s home that cellphone evidence they obtained on Friday points to another suspect. The cellphone data, according to the attorneys, shows that German’s cellphone was connecting with a cell tower near the hiking trail on February 13, the day the girls were killed, but stopped connecting at 5:44 p.m.
In court records, the defense said police believed &#8220;the information which they were receiving from AT&amp;T indicated that the cellphone was no longer in the area or no longer in working condition.&#8221;
But at 4:33 a.m., the cellphone again made contact with the tower, eight hours before the girls’ bodies were found. This, according to the defense, suggests someone else had to have killed the girls because if the prosecution’s theory is true, the phone never would have moved or made additional contact with the tower.
&#8220;That&#8217;s so important because at this juncture, Richard Allen is the only person charged with these murders,” defense attorney and former deputy prosecutor Katie Jackson-Lindsay told WTHR. “Richard Allen is the only one alleged to have committed the crime at all. He&#8217;s not charged under a theory of conspiracy, and we&#8217;ve not heard of any other even potential suspects.&#8221;
The new timeline comes at the same time defense attorneys are again accusing prosecutors of withholding critical evidence, the Journal &amp; Courier <a href="https://www.jconline.com/story/news/crime/2024/04/30/misconduct-allegations-in-delphi-murder-case-richard-allen-nicholas-mcleland-carroll-county/73511363007/" target="_blank" rel="noopener">reported</a>. Allen’s attorneys called for sanctions against Carroll County Prosecutor Nicholas McLeland, whom they accuse of &#8220;convoluted, disorganized and often untimely discovery dumps.&#8221;

The defense team has claimed to have received critical evidence late or not at all.
And McLeland has lodged <a href="https://www.dailywire.com/news/legal-drama-continues-ahead-of-delphi-murder-suspects-trial" target="_blank" rel="noopener">contempt allegations</a> against the defense attorneys, accusing them of violating a gag order.

Delphi Defense Attorneys Say Newly Obtained Cellphone Data Points To Other Suspects

Prosecutors in the upcoming double homicide trial in Delphi, Indiana, are looking to ban the defense from using certain words in front of the jury.
Prosecutors sent a request to Judge Fran Gull seeking to prohibit words such as “Odinism,” “cult,” and “ritual killing,” ABC 6 <a href="https://6abc.com/delphi-murders-prosecutors-want-to-ban-certain-words-during-richard-allen-trial-for-killings-of-libby-german-and-abby-williams/14743960/" target="_blank" rel="noopener">reported</a>. The prosecution argues that using those words could confuse and indoctrinate a jury.
Richard Allen will be on trial for allegedly kidnapping and murdering 13-year-old Abby Williams and 14-year-old Libby German on a Delphi hiking trail in 2017.
The prosecution also wants to ban the names of certain people mentioned throughout court documents of the investigation, including as witnesses, WTHR <a href="https://www.wthr.com/article/news/crime/delphi-girls-murdered/prosecution-wants-certain-terms-banned-defense-team-during-jury-selection-delphi-killings-richard-allen-abby-williams-libby-german-indiana/531-2eedb528-a0a8-43e5-bb8f-8e54cba583a8" target="_blank" rel="noopener">reported</a>. Allen’s attorneys, Brad Rozzi and Andrew Baldwin, have claimed in <a href="https://www.dailywire.com/news/attorneys-for-delphi-murder-suspect-claim-young-teens-were-killed-by-white-nationalist-pagan-group-in-ritual-sacrifice" target="_blank" rel="noopener">court documents</a> that it was actually members of an Odinist cult that killed the teen girls, but that the alternate suspects were dismissed by police without reason.
The defense attorneys pointed to members of the cult as alleged suspects, whom The Daily Wire will not be naming since they have not been charged with any crimes. This individual’s ex-wife also allegedly told police that he and another man in the Odinists had a falling out in February 2017 after conducting a ritual in the woods, near a river. The main alternate suspect lived very near to where the girls’ bodies were found, according to the defense’s filing. This ex-wife also allegedly told police that her ex-husband and “his people” killed the girls because one of their mothers was “mixing” with people who weren’t of the same race.
This individual was also tied to others who allegedly confessed to the crime. One of these individuals allegedly told his sister that he was involved in the crime and included details of the crime scene that were never released to the public. According to the court documents, this man was also questioned but denied involvement. According to a state trooper who dropped him off at his home, this individual allegedly returned to the trooper’s vehicle and asked if he would still be in trouble if his spit was found on one of the victims, saying he could explain it away. This individual also told another one of his sisters that he spit on one of the victims, according to the defense.
This individual and a fourth man provided shaky alibis to police for their whereabouts at the time of the murder, with contradictory stories, Allen’s defense attorneys contend.

Delphi Prosecutors Want To Ban Words, Including 'Odinist' From Upcoming Double Murder Trial

Cameras will not be allowed in the courtroom during the high-profile trial beginning in Delphi, Indiana, next month.
Special Judge Fran Gull ruled this week that audio, video, and electronics will all be banned from the courtroom, Fox 59 <a href="https://fox59.com/news/indycrime/judge-wont-allow-cameras-in-delphi-murders-trial/amp/" target="_blank" rel="noopener">reported</a>. The ruling comes after multiple news agencies filed requests to stream video and/or audio during the trial, which is set to begin on May 13.
The denial comes as the case has drawn national attention for its unusual pre-trial drama, including an attempt to remove original defense attorneys Brad Rozzi and Andrew Baldwin and a counter-attempt by those defense attorneys to replace the judge.
Richard Allen will be on trial for allegedly kidnapping and murdering 13-year-old Abby Williams and 14-year-old Libby German on a Delphi hiking trail in 2017.
Carroll County Prosecutor Nicholas McLeland attempted to hold Rozzi and Baldwin <a href="https://www.dailywire.com/news/legal-drama-continues-ahead-of-delphi-murder-suspects-trial" target="_blank" rel="noopener">in contempt</a> last month. The defense attorneys hired David Hennessy to represent them in the matter, and argued that McLeland accused his clients of violating the court’s order regarding statements about the case. He cited a news release from November 2022 – which was before the court issued a gag order.
Judge Gull had previously forced the defense attorneys to withdraw from the case, and the circumstances surrounding that withdrawal <a href="https://www.dailywire.com/news/indiana-supreme-court-to-hear-arguments-this-week-on-reinstating-delphi-murder-suspects-original-attorneys-removing-judge" target="_blank" rel="noopener">were presented</a> to the Indiana Supreme Court in January.
The attorneys alleged that during a closed-door meeting with Gull, the judge threatened to harm the attorney’s reputation by accusing them of “gross negligence” in open court unless they withdrew from the case. The attorneys withdrew but filed a petition to represent Allen pro bono. Judge Gull then barred them from representing Allen in any capacity.

At the meeting, which included McLeland, the group discussed <a href="https://www.dailywire.com/news/attorneys-for-man-suspected-of-killing-delphi-teens-withdraw-from-case-after-security-breach" target="_blank" rel="noopener">a leak of documents</a> from Baldwin’s office, but Judge Gull stated that was not the only reason she wanted the attorneys removed from representing Allen. Gull said the attorneys “potentially” violated the Rules of Professional Responsibility. She told Baldwin he was “grossly negligent” for sending a sensitive email to a “Brad” who was not Rozzi, and questioned whether the two attorneys had fully cooperated with a gag order she had filed. She also said she had evidence the attorneys “left materials all over a conference-room table, accessible to anyone.”
Following their withdrawal, Rozzi and Baldwin tried to <a href="https://www.dailywire.com/news/new-charges-filed-against-delphi-murder-suspect-original-attorneys-reinstated" target="_blank" rel="noopener">get Judge Gull removed</a> from the case, to no avail.
