A previously deported illegal immigrant is accused of kidnapping and sexually assaulting a 15-year-old girl at an Idaho park, The Daily Wire has learned.
Authorities say 29-year-old Jose Lozano-Flores watched the girl while she was paddle boarding at Freedom Park in Star, Idaho, before grabbing her and forcing her into nearby woods on the evening of July 22.
The illegal immigrant threatened to take the girl to Mexico if she spoke up about the attack, <a href="https://www.facebook.com/Idahonews6/videos/1587136099757616/" target="_blank" rel="noopener">according</a> to Idaho News 6.
The Ada County Sheriff&#8217;s Office and Star Police located and arrested Lozano-Flores the following day at Quinn&#8217;s Pond in Boise, where they found the victim with him inside his vehicle before reuniting her with her family.
The suspect was later taken to the Ada County Jail and charged with felony lewd conduct with a child under 16, felony kidnapping in the first degree, and misdemeanor resisting and obstructing.
Authorities said that the victim didn&#8217;t know Lozano-Flores before he attacked her.
Citing &#8220;the sensitive nature of this case,&#8221; authorities didn&#8217;t provide any additional details about the incident, which was reportedly caught on surveillance video.
The Department of Homeland Security (DHS) is now urging local police to keep Lozano-Flores off the streets by working with Immigration and Customs Enforcement (ICE).
&#8220;This criminal illegal alien is accused of kidnapping and sexually assaulting a teenage girl in Idaho,&#8221; Assistant Homeland Security Secretary Lauren Bis said in a statement shared with The Daily Wire Monday.
&#8220;ICE will work with our partners in Idaho to ensure that he is not released from jail and is never loose in American communities again. When state politicians cooperate with us, we are able to keep criminals out of American neighborhoods,&#8221; Bis added.
Lozano-Flores first entered the United States in 2023, when he crossed the border illegally into New Mexico, DHS said. Border Patrol agents swiftly took him into custody before he agreed to be turned back to Mexico.
The Mexican national then crossed the border illegally for a second time at an unknown date and successfully evaded authorities, according to DHS.

A nonpartisan group launched an effort to have a judge who helped an illegal immigrant evade capture by Immigration and Customs Enforcement (ICE) disbarred, The Daily Wire has learned.
The Center to Advance Security in America (CASA) filed a complaint with the Wisconsin Office of Lawyer Regulation on Monday, formally requesting former Milwaukee County Circuit Court Judge Hannah Dugan&#8217;s disbarment.
A jury found Dugan guilty of felony obstruction in December after she diverted ICE officers while moving an illegal immigrant with a rap sheet through a &#8220;jury door&#8221; away from them in April 2025.
When the agents showed up to the courthouse, Dugan became &#8220;visibly angry&#8221; and called the situation &#8220;absurd,&#8221; authorities said.
She then directed the officers to the chief judge’s chambers before instructing Eduardo Flores-Ruiz, who was charged in Milwaukee with three counts of battery, domestic abuse, and infliction of physical pain or injury, to exit through the “jury door” into a nonpublic area of the courthouse.
The ICE officers later found Flores-Ruiz outside the building before engaging in a foot chase with him. The officers eventually caught up to the illegal immigrant and made the arrest.
In its formal complaint to the Wisconsin Office of Lawyer Regulation, CASA argued that Dugan &#8220;shockingly&#8221; hasn&#8217;t &#8220;been remorseful for her actions.&#8221;
&#8220;Dugan has spoken before media outlets defending her actions, claiming no wrongdoing, and asserting that her internal sense of justice should prevail. Dugan claims that the only reason she is no longer a Judge is because of &#8216;Republicans,'&#8221; Curtis Schube, CASA director of research and policy, wrote to state officials in a letter on Monday.
During her sentencing hearing earlier this month, Dugan said she hopes to return to public service one day, <a href="https://urbanmilwaukee.com/2026/07/08/dugan-sentenced-to-5000-fine-will-appeal-conviction/?utm_source=chatgpt.com" target="_blank" rel="noopener">according</a> to local reports. CASA hopes to ensure she never has the chance to return to the bench.
&#8220;If anything, her desire to return to public service should make the Office of Lawyer Regulation take this action more seriously because her stated intentions seem to demonstrate that she still does not understand the severity of her actions. The Office of Lawyer Regulation should protect the public by disciplining Dugan,&#8221; Schube wrote.
&#8220;Due to the seriousness of the crime for which Dugan was convicted and its relation to her position as a trusted state judge and as a lawyer, the Wisconsin State Bar should impose the harshest possible disciplinary action, including disbarment, on Hannah C. Dugan,&#8221; he added.
Although federal guidelines recommended a sentence between 15 and 21 months in prison in Dugan’s case, she ended up being spared of any prison time. Dugan was instead ordered to pay a $5,000 fine.
Dugan&#8217;s lawyer didn&#8217;t immediately respond to a request for comment.

Immigration and Customs Enforcement (ICE) agents are being told to prioritize the arrests of Haitian nationals whose Temporary Protected Status (TPS) in the United States is officially coming to an end.
Haitians have been shielded from deportation and allowed to work in the United States without permanent immigration status through the program for over a decade due to turmoil in their home country. Now, with President Donald Trump back in the White House, roughly 300,000 Haitian migrants are set to lose their protected status on Monday.
One ICE source told The Daily Wire that arrests of Haitians are now being viewed as a &#8220;priority&#8221; for the agency.
Part of Trump&#8217;s plan to deport Haitians losing their TPS includes targeting the large Haitian community in Ohio, <a href="https://www.cbsnews.com/news/ice-haitian-migrants-arrest-deport-temporary-protected-status/" target="_blank" rel="noopener">according</a> to CBS News. Springfield is one of the small Ohio towns that became overrun by roughly 20,000 Haitian migrants during the Biden administration.
The town became a focal point of then-candidate Donald Trump&#8217;s pledge to carry out a mass deportation.

On the campaign trail, citing unconfirmed reports that Haitian migrants were stealing and eating residents’ pets, Trump vowed to &#8220;absolutely&#8221; revoke their TPS if re-elected.
Last month, <a href="https://www.dailywire.com/news/how-trumps-big-day-at-scotus-opens-door-for-border-crackdown-deportations">the Supreme Court</a> handed the Trump administration a major victory, opening the door for the termination of TPS for Haitians and Syrians.
The high court rejected claims that the Trump administration&#8217;s decision to end TPS for Haitians had racist motivations.
“Citing statements made by President Trump and former Secretary of Homeland Security Kristi Noem, one set of respondents advances an equal protection claim that Haiti’s TPS designation was terminated because of the racial makeup of that country’s population,” Justice Samuel Alito wrote in the majority opinion.
“But, ironically, one of respondents’ other arguments undermines the equal protection claim by offering a strong, race-neutral explanation for Haiti’s termination: namely, that the current administration, which has terminated every TPS designation that has come up for renewal, simply opposes the TPS program, at least as it has been implemented in the past,” Alito added.
While the Department of Homeland Security (DHS) told CBS News that it &#8220;does not discuss ongoing or future operations,&#8221; it said that TPS has served as a &#8220;de facto amnesty program,&#8221; urging migrants losing their protections to self-deport.
&#8220;What we would say now is it&#8217;s closing time which means you don&#8217;t have to go home, but you can&#8217;t stay here,&#8221; DHS said. &#8220;The good news is it&#8217;s not too late to get a $2,600 check and a free flight home.&#8221;
Many Haitian migrants who will lose their protections will have the opportunity to appear before an immigration judge, who will have to issue a deportation order for ICE to remove them from the country.

The illegal immigrant who claimed to have been nabbed by Immigration and Customs Enforcement while buying diapers — and whose sob story fueled an anti-ICE hunger strike in a detention center — was actually taken into ICE custody after being arrested for a violent domestic assault, The Daily Wire has learned.
Gabriela Soto claimed that her husband, Martin Soto, 31, of Peru, &#8220;was abducted&#8221; by ICE and that he was &#8220;a loving father, husband, son, church member, worker&#8221; when he was taken to Delaney Hall, an ICE detention facility. Media outlets ran with the story as the hunger strike carried on, leading to weeks of violent riots outside the facility.
But a police report and sources who spoke with The Daily Wire tell a very different story.
Martin Soto &#8220;purposely&#8221; caused &#8220;bodily injury&#8221; to an unnamed female victim &#8220;specifically by using his hands, both opened and closed to strike&#8221; her &#8220;in her face, causing minor scratches and cuts to her face and neck,&#8221; a copy of the police report obtained by the Oversight Project and shared with The Daily Wire reads.
Soto then allegedly &#8220;placed a hand over&#8221; her &#8220;mouth so she could not scream for help,&#8221; according to the report.
After her husband&#8217;s arrest, Gabriela Soto led protests outside Delaney Hall for days in May and June, claiming that the conditions inside were inhumane and that the stress would cause her to miscarry.
&#8220;Martin has committed no harm,&#8221; Gabriela — whose <a href="https://www.gofundme.com/f/migracion-zfvvz" target="_blank" rel="noopener">GoFundMe</a> for her husband that has raised more than $67,000 — wrote in a column last month.
Scott Mechkowski, a visiting fellow for deportation studies at the Oversight Project, told The Daily Wire that her entire story unraveled after a police report surfaced showing that Martin was actually arrested by local police for a domestic assault.
&#8220;The public was told a good man was grabbed by ICE while buying diapers. The record says he was arrested by Kearny police, handed to Hudson County, taken into ICE custody, and detained at Delaney Hall while charged with assaulting the very woman who then made him a headline,&#8221; Mechkowski, who formerly served as the ICE New York field office deputy director, said.
The Daily Wire could not immediately confirm the identity of the assault victim.
&#8220;This is the pattern: a sympathetic claim built to go viral, while the facts sit unread in a file. Delaney Hall was inspected and cleared, its officers branded jailers of the innocent on stories that collapse the moment you check the record. This is one example; there are many,&#8221; he added.
Martin Soto crossed the Arizona border illegally in January 2024 and was processed to be deported immediately under what&#8217;s known as expedited removal, law enforcement sources told The Daily Wire. He was allowed to stay after he presented a fear of returning to his home country and was released from custody by April 2024.
Police in Kearny, New Jersey, arrested Soto on February 1, 2026, for simple assault stemming from a domestic violence incident, according to records obtained by The Daily Wire. ICE officers paid a visit to the Hudson County Correctional Center on February 2, whereupon they swiftly took Soto into custody.
While leading a May protest aimed at blocking ICE vans from driving in and out of the facility, Gabriela <a href="https://www.nj.com/hudson/2026/02/father-picked-up-by-ice-while-buying-diapers-for-his-kids.html?outputType=amp" target="_blank" rel="noopener">told</a> NJ.com that she started the protest &#8220;to close Delaney Hall and free every detainee&#8221; inside the facility, claiming that her husband was being retaliated against for her activism.
“If I have a miscarriage because of this pressure, I will sue them,&#8221; she said. &#8220;I am tired of them controlling the situation. He is in that van. I saw him resisting to get in the van; they forced him in there, two big ass guards. He was handcuffed. They were trying to move him.&#8221;
Media outlets largely embraced Martin and Gabriela Soto as sympathetic figures, accepting without question Gabriela&#8217;s account of Martin&#8217;s arrest. She claimed that she &#8220;suddenly got a phone call from a number listed as &#8216;prison/jail'&#8221; on February 1, &#8220;after Martin stepped out to get diapers for our 11-month-old son.&#8221;
&#8220;My heart dropped,&#8221; she wrote. &#8220;When I answered, I was terrified about what had happened. As soon as the call ended, I raced over to Delaney Hall to get some answers. A guard there told me Martin was in &#8216;good hands&#8217; and once he was processed, he would be able to see me during visiting hours. I was relieved to hear he was safe, but when I started hearing about the conditions inside Delaney — rotten food, medical neglect, and more — I began to doubt the guard’s words.&#8221;
In fact, at that time, her husband was still in local custody after having been arrested in Kearny for the domestic incident. He was only later moved to Delaney Hall, where inmates who claimed to be &#8220;starving&#8221; during their hunger strike were actually purchasing snacks — including sushi and clams — from the commissary, as The Daily Wire <a href="https://www.dailywire.com/news/exclusive-delaney-hall-detainees-on-hunger-strike-are-downing-clams-and-sushi">reported</a>.

Venezuelan illegal immigrant Giovanna Mercedes Moreno Occhipinti, 32, allegedly drove two shooters who opened fire during a December 2024 house party in Chicago and helped them evade law enforcement, according to the Department of Homeland Security (DHS). Three people were killed in the shooting and several others were wounded.

On Friday, DHS posted a photo of Moreno Occhipinti standing on a tarmac with the caption: &#8220;Bye bye.&#8221; In the photo, the ex-educator was holding a plastic bag and wearing a sweatsuit with a smirk on her face.
Immediately after the shooting, police found multiple weapons inside Moreno Occhipinti&#8217;s car and arrested her on charges of unlawful use of weapons and weapon offense.
The Cook County State&#8217;s Attorney&#8217;s Office, however, declined to proceed with prosecuting the accused, forcing federal authorities to take matters into their own hands.
Homeland Security Investigations (HSI) agents nabbed Moreno Occhipinti on May 13.
Matthew Scarpino, Homeland Security Investigations Chicago Special Agent in Charge, called Moreno Occhipinti’s crimes &#8220;calculated and deliberate.&#8221;
Moreno Occhipinti entered the United States in October 2021 under a visa waiver program that allowed her to stay in the country until January 2, 2022, according to DHS. The ex-teacher never left.
The alleged shooters, Ricardo Granadillo Padilla and Edward Martinez Cermeno, were previously deported from the United States, DHS said.
Immigration and Customs Enforcement (ICE) has deported roughly 706,000 illegal immigrants since President Donald Trump returned to the White House, and officials have said the pace of the effort is only picking up steam, according to new data DHS provided to The Daily Wire.
“Bed space and detention centers had to be rebuilt and 10,000 agents hired and Congress wouldn’t pass the big beautiful budget bill for the first six months. Everything is finally in place now so I’m optimistic the numbers will only climb higher from here,” Todd Bensman, who left his role as senior adviser to the ICE Office of the Director last month, recently told The Daily Wire.
In recent days, ICE sources have said they&#8217;re facing renewed pressure to increase arrest numbers.
“It’s wearing everyone out,” said one agency source.
“And at the same time, they want big arrests … but those take time to sit and find and wait. No vehicle stops too, which is harder. So they want big arrests and numbers at the same time. It’s hard to do both, not enough time or days to do it,” the source said.

Judges across the country have ordered the release of 65,000 detainees from federal immigration custody, revealing the extent of a massive operation to undermine the Trump administration&#8217;s crackdown on illegal immigration.
White House border czar Tom Homan told Fox News over the weekend that Immigration and Customs Enforcement (ICE) detainees are filing &#8220;a record number of habeas cases&#8221; to get released and that &#8220;radical judges&#8221; are largely granting their petitions.
&#8220;The number&#8217;s around 65,000 people that we arrested that we had to release because of habeas cases out of radical judges. So there&#8217;s a lot we&#8217;re fighting against, more than any other president,&#8221; Homan said.
The surge in habeas petitions comes after the Department of Homeland Security issued a sweeping policy to deny bond hearings to ICE detainees. The policy has led to a slew of legal challenges, leading to conflicting rulings by circuit courts across the country.
When illegal immigrants file habeas petitions to challenge their detention, their cases are moved from the immigration courts to federal district courts, where judges tend to look at their arguments more favorably, experts told The Daily Wire. If they get released, it can buy them years of additional time in the United States, allowing them to apply for immigration status.
&#8220;Partisan activist federal district judges are systematically undoing the expensive, time-consuming work of ICE and releasing thousands of arrestable illegal aliens from lawful detention,&#8221; Todd Bensman, who recently left his role as senior adviser to the ICE Office of the Director, told The Daily Wire.
&#8220;It’s a racket, a scam, and a public safety hazard. Federal district judges have zero jurisdiction over administrative immigration processes. Unfortunately, we’ll have to wait for the Supreme Court to shut down this scam. I can’t say how many of these releases have perpetrated crimes but my fingers are crossed that the Supreme Court moves quickly,&#8221; Bensman said.
U.S. Attorney for the District of Arizona Timothy Courchaine previously told The Daily Wire that federal judges are granting bond in &#8220;most&#8221; such cases, adding that &#8220;we’ve been losing almost all of these.&#8221;
Dan Gividen, a Dallas-based immigration attorney, has shifted his practice from arguing cases before immigration judges to filing habeas petitions in district courts, where he&#8217;s had better success getting his clients released. His office went from filing roughly &#8220;three or four&#8221; habeas petitions on behalf of migrant clients in 2019 to roughly 150 in the last year, 70 of which have been granted, he said.
&#8220;That&#8217;s unheard of previously,&#8221; Gividen said of his success.
&#8220;It&#8217;s good to see the way that it&#8217;s going,&#8221; he said. &#8220;The impact is huge.&#8221;
U.S. attorneys&#8217; offices have become bogged down by the overwhelming caseload, which has forced them to divert criminal prosecutors to handle habeas immigration cases.
“We’ve had to pull criminal prosecutors off of their caseloads and put them into civil [cases],&#8221; Courchaine previously said.
&#8220;We’ve had to shift around criminal prosecutors’ workloads and investigations so they could take this on. Even my criminal chief, who’s in charge of more than 60 federal prosecutors up in Phoenix, Arizona, has had to volunteer to take cases,” he added.

Authorities in Greenfield, Indiana, <a href="https://www.facebook.com/photo?fbid=1340155121593047&amp;set=pcb.1340155424926350" target="_blank" rel="noopener">received</a> an alert around 6 a.m. on June 27 about a stolen cargo load reported in Pennsylvania that was believed to be inside a semi-truck on a nearby interstate and spotted the vehicle on a Flock camera. Police caught Deepak Kumar, 31, who hails from India, with the stolen load consisting of 10 pallets of toxic tungsten oxide powder weighing nearly 40,000 pounds.
The chemical is used for armor-piercing rounds, ceramics, lasers, optical products, and high-tech windows, <a href="https://www.yourcentralvalley.com/news/crime/trucker-caught-stolen-tungsten-powder/" target="_blank" rel="noopener">according</a> to KSEE.
Kumar, who was living in Fresno, handed officers a California commercial driver&#8217;s license, an invalid work visa, and a fraudulent New York license, according to the local news outlet.
The shipment was reportedly scheduled for pickup on June 24, but was delayed one day. The company alerted authorities after they lost contact with the driver on June 26.
The shipment was bound for Mitsubishi Materials Corporation in Japan.
While executing a search warrant on the truck, officers &#8220;confirmed the stolen cargo was present in the trailer,&#8221; police <a href="https://www.greenfieldreporter.com/2026/06/28/greenfield-police-recover-nearly-3-million-of-stolen-cargo-arrest-truck-driver/">said</a>. The stolen cargo was subsequently handed over to a representative of Mitsubishi Materials Corporation.
ICE lodged a detainer with the Bradford County Prison, asking authorities to turn Kumar over to federal immigration authorities rather than release him.
The Indian national snuck past border authorities at an unknown time when he entered the United States, the Department of Homeland Security (DHS) told The Daily Wire. He also has previous arrests for fraud, swindling, identity theft, forgery, and larceny.
Kumar is currently in ICE custody in California. It&#8217;s not clear if local authorities complied with the detainer.
The Trump administration has instituted a massive crackdown on states issuing commercial driver&#8217;s licenses to illegal immigrants after a series of fatal crashes. Federal officials have tagged California as one of the worst offenders.
Then-acting ICE Director Todd Lyons warned last year of<a href="https://www.dailywire.com/news/ice-warns-of-potential-terrorist-attack-after-catching-dozens-of-illegal-immigrant-trucker-drivers"> the potential for a terrorist attack</a> with so many unqualified foreign truckers hauling heavy machinery on American roads.
“We don’t know what they’re carrying across state lines in an 18-wheeler, terrorists will stop at nothing to harm the United States, and it is well within the realm of possibility that some of these trucks … could be carrying toxic chemicals, bombs, or God knows what,” Lyons said.

An illegal immigrant with a criminal past is accused of killing three people in a hit-and-run crash in Salisbury, North Carolina, on Saturday evening, The Daily Wire has learned.
Javiel Pena Sola, who hails from El Salvador, allegedly struck the victims&#8217; vehicle before attempting to flee the scene, authorities said. A police K-9 unit was able to track Sola down and take him into custody.
Two of the victims were pronounced dead at the scene, while the third succumbed to injuries after being airlifted from the crash site.
Quindel Woods, whose home is near the crash site, described the chilling moment he heard screaming when the crash occurred.
&#8220;They pulled the man out and as they pulled him out, he started screaming,&#8221; Woods said.
Authorities found Sola&#8217;s car in a nearby creek, <a href="https://www.wsoctv.com/news/local/started-screaming-more-charges-expected-salisbury-crash-that-killed-3/FS2TVJZQGFGTNKK6TDTF2P7EDI/" target="_blank" rel="noopener">according</a> to WSOC-TV.
Sola, 42, claimed that he snuck across the Arizona border in 2002, the Department of Homeland Security told The Daily Wire.
The illegal immigrant went on to receive convictions for reckless endangerment, failure to stop after an accident involving damage to attended vehicle, and driving without a license in Maryland in 2015, according to DHS. He also had a prior arrest for escaping from custody.
Authorities in Baltimore handed Sola to Immigration and Customs Enforcement (ICE) after his jailbreak in March 2016, DHS said. The Obama administration released him from a federal immigration detention center two months later.
The reason for his past release from ICE detention is unclear.
ICE lodged a detainer Wednesday with local authorities in North Carolina, asking them to transfer Sola to federal immigration authorities if he is released from local custody.
“This criminal illegal alien from El Salvador is facing felony charges after a hit-and-run that killed three people in North Carolina,” Assistant Homeland Security Secretary Lauren Bis said in a statement Wednesday.
“His criminal history includes prior convictions in 2015 for hit-and-run, reckless endangerment, and driving without a license. Although ICE had arrested him in 2016, the Obama Administration RELEASED him into American communities. These deaths were 100% preventable. Open borders and sanctuary policies have deadly consequences,&#8221; Bis said.
Sola now faces three counts of felony hit-and-run involving serious injury or death. More charges are expected in the case, WSOC-TV reported.
The names of the victims have yet to be released to the public as authorities ensure proper notification to their families.

An illegal immigrant with a rap sheet is accused of murdering an elderly veteran outside his Utah home.
Army and Air Force veteran James Randell “Randy” Witten, 71, was hanging up decorations on his porch in Davis County, Utah, in May when Axel Eduardo Chavez-Marroquin, 24, allegedly drove up and fatally shot him from behind, <a href="https://www.ksl.com/article/51596068/newly-unsealed-charges-say-west-point-veterans-doorbell-camera-recorded-the-murder" target="_blank" rel="noopener">according</a> to local news outlet KSL.
The accused &#8220;leapt out of the front passenger seat and moved towards James, firing approximately 10 rounds and killing James from behind,&#8221; KSL reported, citing charging documents. Chavez-Marroquin then returned to his car and sped away.
Police received reports of a car with something orange covering its license plate driving &#8220;erratically&#8221; nearby shortly after the shooting, the local outlet reported. One witness reported seeing a passenger tossing donuts, a beanie, a bandana, and gloves out of the vehicle.

Surveillance footage showed a passenger exiting the vehicle and ripping off the orange tape concealing the license plate before the car headed into Las Vegas hours after the shooting, according to KSL.
Authorities in Nevada located the vehicle on June 16 with Chavez-Marroquin inside and arrested the illegal immigrant. He was transferred to the Davis County Jail in Utah on June 29.
Chavez-Marroquin, who hails from El Salvador, crossed the California border illegally in 2021 before the Biden administration released him into the country, <a href="https://www.dhs.gov/news/2026/07/20/ice-lodges-arrest-detainer-criminal-illegal-alien-arrested-murdering-veteran-utah" target="_blank" rel="noopener">according</a> to the Department of Homeland Security (DHS).
The illegal immigrant received a conviction for domestic violence in Santa Ana, California, in 2024, DHS said. Authorities also arrested him for domestic violence in Laguna Niguel, California, in 2025.
In both cases, Immigration and Customs Enforcement (ICE) lodged detainers with authorities in California, who released him from custody under local sanctuary policies, according to DHS.
Chavez-Marroquin arrived in West Point, Utah, from Nevada just eight hours before the shooting and left immediately after carrying out the attack, authorities said.
ICE has lodged a detainer seeking Chavez-Marroquin&#8217;s arrest for the third time following his latest crime, the agency said Monday.
In his latest case, prosecutors have argued that he&#8217;s a flight risk given his ties to El Salvador and his status as a fugitive from California, where he was on probation, according to KSL.
“This monster is charged with murdering a 71-year-old Army and Air Force veteran in Utah. California sanctuary politicians RELEASED this criminal from jail TWICE after arrests for domestic violence. Following his release, he went on to commit this heinous murder,” Assistant Homeland Security Secretary Lauren Bis said in a statement.
“This illegal alien should’ve never been allowed on our streets, and James Witten should still be alive today. ICE is now asking officials in Utah to commit to not releasing this criminal from jail and to work with ICE so that we can remove him from our country. Reckless sanctuary policies in states like California are putting American lives at risk,&#8221; Bis added.
The suspect is charged with murder with a dangerous weapons enhancement, discharge of a firearm causing serious injury, obstruction of justice, and dangerous weapon conduct by a restricted person, according to KSL.

The suspect accused of detonating an incendiary device outside New York City&#8217;s federal immigration office has been identified by multiple news outlets as 43-year-old military veteran Andrew Arrabaca, who was said to be carrying a sign reading &#8220;ICE off our streets&#8221; during Monday&#8217;s attack.
Authorities said Arrabaca poured &#8220;what is believed to be gasoline&#8221; on the ground outside 26 Federal Plaza before placing fireworks on top of it and igniting the device. The &#8220;incendiary device&#8221; caused &#8220;a little fire,&#8221; FBI New York field office Assistant Director in Charge James Barnacle Jr. said.
&#8220;At approximately 8:20 AM, an anti-ICE rioter launched fireworks outside of 26 Federal Plaza, grazing a bystander and poured what is believed to be gasoline on the stairs of the entrance of the building and set it on fire,&#8221; the Department of Homeland Security (DHS) <a href="https://x.com/DHSgov/status/2079251017133154456">said</a> in a statement Monday.
“Officers quickly recovered the individual’s bag, which contained what appeared to be two pellet guns and a manifesto,&#8221; the agency said.
At the time, the suspect was seen pushing a cart with a sign on it reading, &#8220;ICE off our streets.&#8221; He was also carrying two axes, a hammer, a machete, and multiple knives.
&#8220;When he was being arrested, he yelled derogatory terms to ICE, used bad words, obviously. He is an anti-American, anti-government extremist. We know that from what he said, we know that from what he has said post-arrest, and we know that from his actions that he tried to take today,&#8221; Barnacle said.
The New York Post <a href="https://nypost.com/2026/07/20/us-news/terrorism-task-force-probes-armed-loon-who-set-off-incendiary-device-outside-nyc-fed-hq/" target="_blank" rel="noopener">reported</a> that the suspect is a former U.S. Army and National Guardsman from Poughkeepsie.
Two federal employees and civilian sustained minor injuries in the attack and were treated and released, Barnacle said.
A Federal Protective Service officer &#8220;swiftly tackled and detained&#8221; the suspect, &#8220;sustaining minor injuries,&#8221; according to DHS.
The Jacob K. Javits Federal Office Building houses ICE&#8217;s New York field office and an immigration court. During the Trump administration, the building has become a hotbed for anti-ICE protests.
The FBI New York Joint Terrorism Task Force is investigating the incident, the bureau said.

A man believed to be an anti-ICE activist armed with two airsoft rifles deployed an incendiary device outside 26 Federal Plaza in New York City on Monday morning, prompting a swift response from federal and local law enforcement.
At least two people were injured in the incident after the suspect &#8220;menaced&#8221; bystanders with the airsoft rifles, MS NOW <a href="https://www.cnbc.com/2026/07/20/new-york-nyc-fbi-incendiary-device.html">reported</a>. Five law enforcement sources told MS NOW that the suspect appeared to be an anti-ICE radical.
Video <a href="https://x.com/BillMelugin_/status/2079203258724471267?s=20">footage</a> showed a plume of smoke rising near the building&#8217;s entrance as law enforcement officers, including ICE agents and FBI personnel, rushed out with guns drawn. Federal Protective Service officers apprehended the suspect on scene. The sidewalk was shut down, and the building was evacuated as authorities responded.
According to the FBI, the incident occurred around 8:30 a.m. ET, Fox News <a href="https://x.com/BillMelugin_/status/2079203258724471267?s=20">reported</a>.
&#8220;This morning an individual deployed an incendiary device outside of 26 Federal Plaza. The individual has been taken into custody and the FBI New York Joint Terrorism Task Force is investigating the incident,&#8221; the FBI said.
FBI Director Kash Patel <a href="https://x.com/FBIDirectorKash/status/2079219684717596752">added</a> that &#8220;two minor injuries reported thus far.&#8221;
Sources told MS NOW that the incendiary device was fireworks that were placed in a shopping cart and then doused in accelerant and lit on fire.
The New York Police Department told Fox News that a firearm was found in relation to the event, though officials could not confirm whether it was recovered from the suspect. It&#8217;s unclear if the firearm found by authorities is different from the airsoft rifles the suspect reportedly had on him.
The building at <a href="https://www.ice.gov/field-office/new-york-city-field-office">26 Federal Plaza</a> houses the ICE New York City Field Office on the 9th Floor as well as a federal immigration court. The ICE office oversees Enforcement and Removal Operations and Homeland Security Investigations across the five boroughs of New York City and several surrounding counties, including Dutchess, Nassau, Putnam, Suffolk, Sullivan, Orange, Rockland, Ulster, and Westchester.
This incident comes amid a broader trend of heightened concerns regarding threats to ICE operations. The Department of Homeland Security has previously reported a significant rise in vehicle attacks against ICE officers, noting a <a href="https://dallasexpress.com/national/dhs-warns-sanctuary-rhetoric-linked-to-surge-in-ice-vehicle-attacks/">3,300% increase</a> in such incidents during a recent period compared to the prior year.

Armed Man Triggers Terrorism Investigation Outside ICE Office

Homeland Security Secretary Markwayne Mullin won&#8217;t say whether he briefed President Donald Trump before briefly pausing Immigration and Customs Enforcement (ICE) traffic stops in the wake of two recent fatal shootings.
During a Friday briefing on the department&#8217;s efforts to clean up the voter rolls of noncitizens, Daily Wire White House Correspondent Mary Margaret Olohan asked Mullin to clarify if he informed Trump before suspending ICE traffic stops.
&#8220;The president and I are very close. I was texting with him this morning,&#8221; Mullin said. &#8220;There&#8217;s no daylight between us and the enforcement. In fact, we have ramped up our enforcement in our arresting illegals.&#8221;
Mullin then redirected the conversation to arrest and deportation data.
&#8220;Our arrests are up, we&#8217;re hitting single-day records every single day, but what we’ve done is I’ve turned down the temperature of the stove to try to get it correct without boiling over,&#8221; he said.
The decision to pause vehicle stops followed two recent fatal shootings of migrants by ICE officers trying to pull over vehicles in Houston and Biddeford, Maine. In the Houston case, ICE said Mexican illegal immigrant Lorenzo Salgado Araujo &#8220;attempted to evade arrest&#8221; and &#8220;rammed&#8221; an ICE vehicle before he &#8220;weaponized his vehicle in an attempt to run over an ICE law enforcement officer resulting in our officer firing his weapon in self-defense.&#8221;
In the Biddeford shooting, which occurred last week, an ICE officer fatally shot a Colombian man who “attempted to flee the scene” of a traffic stop, the agency said.
The morning after vehicle stops were paused, Trump posted on Truth Social that he opposed the change and viewed it as capitulating to criminals and anti-ICE Democrats.
“The Open Border Policy of Sleepy Joe Biden allowed 25,000,000 people to pour into our Country, unchecked and unvetted,” the president said. “Many were Criminals, and we have to get them out. In order to do this, we must be strong, tough, and smart, and we CANNOT give up one of I.C.E.’s most important and effective Crime Fighting tools, THE TRAFFIC STOP! Once we do, we are playing right into the criminal’s hands.”
“The Radical Left Dumocrats would like to see this done, but it won’t happen on my watch. I.C.E., be judicious, fair and smart, and go back and do your very important job,” he said. “Keep those Crime Stat Records coming! Remember, you are loved and respected in America.”
ICE sources also questioned whether Mullin informed Trump before enacting the pause.
“Not sure how they don’t consult Trump about this before they send out guidance to every field office,” one agency source said.
White House border czar Tom Homan on Tuesday credited Mullin with deciding to cease the tactic, emphasizing that it was a &#8220;temporary&#8221; measure, not &#8220;a policy change.&#8221;
ICE officers across the country received orders to resume vehicle stops on Thursday, with some new changes, including a requirement that at least one agent on the team have a body camera, sources said. There is concern within ICE that not all officers have received body cameras, making it impossible to resume traffic stops in some parts of the country.
White House Press Secretary Karoline Leavitt addressed the concerns during her Thursday briefing, saying all ICE body cameras will be distributed within the next 60 days.
“It’s been a slower rollout than we would have hoped, but that’s because [of] the Democrats’ decision to shut down DHS for several weeks. So, we expect to fully execute on the promise of body cams to all field offices across the country very soon,” she said.
