During “The Breakfast Club” <a href="https://x.com/charliekirk11/status/1878841065807184015">show</a> on Monday, the radio host said that liberals were being ridiculous for making more out of the sentencing by Judge Juan Merchan in the <a href="https://www.dailywire.com/news/trump-sentenced-to-an-unconditional-discharge-in-hush-money-trial">New York case</a> — related to hush money paid to Stephanie Clifford, a porn actress who goes by the name Stormy Daniels — than they should.

“And what was even more ridiculous was watching liberals celebrate this,” he added. “Like, this is not a win. Who cares if you can call him a convicted felon when you still got to call him president for the next four years? Who cares?”

It comes after <a href="https://www.dailywire.com/news/trump-sentenced-to-an-unconditional-discharge-in-hush-money-trial">Merchan sentenced</a> Trump to an <a href="https://dailycaller.com/2025/01/13/charlamagne-liberals-celebrate-trump-sentence/" target="_blank" rel="noopener">unconditional discharge</a>, meaning that the President-elect would not face jail time, probation, or a fine. However, it does allow those on the left to continue to label the president-elect a convicted felon.
Last May, Trump was found guilty on all charges in the hush money case by a New York jury. He was charged with 34 felony counts of falsifying business records to hide payments that were allegedly sent to Daniels in exchange for her silence on an alleged extramarital affair, as previously <a href="https://www.dailywire.com/news/verdict-trump-found-guilty-on-all-charges-in-hush-money-case">reported</a>. Trump has denied the charges and said that the trial was politically motivated.
Following Merchan’s decision, Trump took to <a href="https://x.com/TrumpDailyPosts/status/1877740110411600156">Truth Social</a> and made it clear that he planned to appeal.
“The real Jury, the American People, have spoken, by Re-Electing me with an overwhelming MANDATE in one of the most consequential Elections in History,” Trump wrote. 
“As the American People have seen, this ‘case’ had no crime, no damages, no proof, no facts, no Law, only a highly conflicted Judge, a star witness who is a disbarred, disgraced, serial perjurer, and criminal Election Interference,” he added. 
“Today’s event was a despicable charade, and now that it is over, we will appeal this Hoax, which has no merit, and restore the trust of Americans in our once great System of Justice. MAKE AMERICA GREAT AGAIN!,” the president-elect continued.

President-elect Donald Trump unloaded on Judge Juan Merchan, criticizing the presiding judge in his New York-based hush money trial after he refused to toss the conviction in the light of the Supreme Court&#8217;s recent decision on presidential immunity.
Trump shared his thoughts in two lengthy posts on his <a href="https://truthsocial.com/@realDonaldTrump/posts/113668931932678096" target="_blank" rel="noopener">Truth Social</a> platform, saying that the judge&#8217;s decision amounted to a violation of the U.S. Constitution and hinting that the intent of the accompanying gag order had been to protect the judge and his family from scrutiny.

Trump kept going in the same vein in a second post, picking up where he left off: &#8220;… I am the only Political Opponent in American History not allowed to defend myself — A despicable First Amendment Violation!&#8221;
He went on to argue that the case Merchan brought had not even been a legitimate case to begin with and listed a number of legal experts — &#8220;including Jonathan Turley, Elie Honig, Andy McCarthy, Alan Dershowitz, Gregg Jarrett, David Rivkin, Elizabeth Price Foley, Katie and Andy Cherkasky, Paul Ingrassia&#8221; — who had argued just that.
&#8220;[It] is a nonexistent case, barred by the Statute of Limitations, and should have never been brought and, through his fraud and misconduct, [Merchan] gave it a semblance of &#8216;life.&#8217; While Deranged Jack Smith was sent packing back to The Hague after losing all of his politically manufactured cases against me, Merchan, who is far worse and even more corrupt than Smith in his fight for my hopeless political opponents, just cannot let go of this charade,&#8221; Trump said. &#8220;Is it because of his conflicts and relations that he keeps breaking the Law? This has to stop! It is time to end the Lawfare once and for all, so we can come together as one Nation and, Make America Great Again.&#8221;
Merchan, in his <a href="https://www.nytimes.com/2024/12/16/nyregion/trump-immunity-criminal-case.html" target="_blank" rel="noopener">41-page decision</a>, agreed with prosecutors who argued that the evidence presented against Trump in that case was strictly related to his personal conduct rather than any official acts.
&#8220;The People’s use of these acts as evidence of the decidedly personal acts of falsifying business records poses no danger of intrusion on the authority and function of the executive branch,&#8221; Merchan wrote.
Trump spokesman Stephen Cheung also responded to the decision, saying that it was &#8220;a direct violation of the Supreme Court’s decision on immunity.&#8221;

A federal judge on Tuesday denied an effort by former President <a href="https://www.dailywire.com/topic/donald-trump" target="_blank" rel="noopener">Donald Trump</a> to move his New York criminal case to federal court ahead of sentencing later this month. 
In his <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysd.598311/gov.uscourts.nysd.598311.50.0.pdf" target="_blank" rel="noopener">ruling</a>, U.S. District Judge Alvin Hellerstein said that he had no authority to review any errors made during the state trial and that the Supreme Court’s recent decision on presidential immunity did not impact the New York case. Trump was convicted in May of 34 counts of falsifying business records and is scheduled to be sentenced on September 18. 
“This court does not have jurisdiction to hear Mr. Trump’s arguments concerning the propriety of the New York trial,” Hellerstein, a Bill Clinton appointee, wrote. “Instead, the proper recourse for parties seeking to remedy alleged errors made during a state trial is to pursue a state appeal or, at the highest level, to seek review from the Supreme Court of the United States.” 
The decision comes after lawyers for Trump <a href="https://www.dailywire.com/news/trump-looks-to-move-new-york-criminal-case-to-federal-court-ahead-of-sentencing" target="_blank" rel="noopener">argued</a> last week the case should be removed from Judge Juan Merchan as Trump seeks dismissal based on the Supreme Court&#8217;s recent ruling that presidents have immunity for exercising core constitutional powers. 
Hellerstein, who previously rejected an attempt to remove the case, said the Supreme Court’s decision doesn’t change his decision. 
“My holding of a hush money reimbursement remains true regardless of who has the burden, whether the People or Mr. Trump,” he said. “Nothing in the Supreme Court’s opinion affects my previous conclusion that the hush money payments were private, unofficial acts, outside the bounds of executive authority.”

Trump campaign spokesman Steven Cheung <a href="https://www.foxnews.com/us/judge-denies-trump-request-move-new-york-hush-money-case-federal-court" target="_blank" rel="noopener">said</a> he would continue fighting to move the case. 
&#8220;There should be no sentencing in this Election Interference Witch Hunt. As mandated by the United States Supreme Court, this case, along with all of the other Harris-Biden Hoaxes, should be dismissed,&#8221; he said. &#8220;President Trump and his legal team will continue to fight to move this Hoax into federal court where it should be put out of its misery once and for all.&#8221;
Merchan has placed a gag order on Trump restricting what he can say about the case. In a Truth Social <a href="https://truthsocial.com/@realDonaldTrump/posts/113079100211808222" target="_blank" rel="noopener">post</a> Wednesday morning, Trump called for the order to be removed. 
“I am proud to represent our Failing Nation in fighting the GREATEST POLITICAL WITCH HUNT IN HISTORY,” he said. “REMOVE THE GAG ORDER SO THAT I CAN SHOW HOW CORRUPT OUR COURT SYSTEM IS. PRESIDENTIAL CANDIDATES ARE NOT TO BE GAGGED!”
Trump <a href="https://www.cbsnews.com/news/donald-trump-convicted-prison-sentence-new-york-criminal-trial/" target="_blank" rel="noopener">could</a> face four years in prison and a $5,000 fine for each of the 34 convictions when sentenced. Merchan is set to rule on another motion to dismiss the conviction on September 16.

Legal experts expressed outrage on Wednesday over the instructions Judge Juan Merchan gave to the jury as it began deliberations in former President Donald Trump&#8217;s hush money case.
Former federal prosecutor Andy McCarthy told Fox News that the instructions were not in &#8220;line with the United States Constitution&#8221; and had turned into a &#8220;make-it-up-as-you-go-along&#8221; situation.
&#8220;What’s supposed to happen in a criminal trial is a prosecutor has to prove every element of an offense beyond a reasonable doubt,&#8221; he explained. &#8220;So every crime, which is a creature of some statute, has different elements. One is a mental element and then there are the things that you have to do to commit the crime. So like with bank robbery you have to, you know, take money by force from a financial institution and do it intentionally. And those are the things the prosecutor has to prove beyond a reasonable doubt. What this judge is telling this jury in this kind of make-it-up-as-you-go-along New York state prosecution of federal law is that when they get to the end of the rainbow and we get to the elements of the offense, the jury doesn’t have to be in agreement on what it is exactly that Trump did or what he was trying to commit or conceal when he allegedly falsified his business record.&#8221;
&#8220;So they’re going to give the jury a menu of choices and tell the jury that some of them may believe that this was a criminal objective, some of them may believe something else was, but that they don’t have to be unanimous on that,&#8221; he continued. &#8220;I actually think that’s pretty outrageous. But in this case, I’m not sure it makes the top ten of outrageous.&#8221;
Jonathan Turley, a George Washington University Law School professor, said that the judge &#8220;delivered the coup de grace&#8221; with his instructions to the jury.

&#8220;He said that there is no need to agree on what occurred,&#8221; he said. &#8220;They can disagree on what the crime was among the three choices. Thus, this means that they could split 4-4-4 and he will still treat them as unanimous.&#8221;
&#8220;After the federal election violation, Merchan says that the second crime is falsifying other documents,&#8221; he said. &#8220;This creates a redundancy with the NY election violation on the falsifying documents. It allows the government to allege the falsification of documents as a felony and then allows such falsification to be also the unlawful means for certain documents. The third is the violation of tax laws.&#8221;
&#8220;So a dead misdemeanor for falsifying business records was zapped back into life by alleging that under NY election law 17-152 it was done to influence the election by the unlawful means of falsification of business records,&#8221; he explained. &#8220;It is so circular as to produce vertigo. So the jury finds some documents were falsified to use the unlawful means of falsifying other documents. That is only one of three possible crimes and the jury does not have to agree on which was the basis for their conviction.&#8221;

Trump filed an appeal on Wednesday with the New York Court of Appeals in an effort to have the gag order placed on him by Judge Juan Merchan struck down. The order prevents the former president from talking about jurors, attorneys, court staff, and the judge’s family, which Trump says violates his First Amendment rights.
&#8220;President Trump has filed a notice to appeal the unconstitutional and un-American gag order imposed by conflicted Judge Juan Merchan in the lawless Manhattan DA case,&#8221; <a href="https://www.newsweek.com/donald-trump-gag-order-appeal-new-york-1901286" target="_blank" rel="noopener">said</a> Steven Cheung, a spokesman for the Trump campaign.
&#8220;The threat to throw the 45th President of the United States and the leading candidate in the 2024 presidential election in jail for exercising his First Amendment rights is a Third World authoritarian tactic typical of crooked Joe Biden and his comrades,&#8221; he added.
Trump has been in court for the last several weeks facing 34 falsification of business records charges and has been so far limited on what he can say about the case. Trump’s appeal follows a decision from a lower appeals court that rejected his effort to have the gag order ended. 
“We find that Justice Merchan properly weighed petitioner’s First Amendment Rights against the court’s historical commitment to ensuring the fair administration of justice in criminal cases, and the right of persons related or tangentially related to the criminal proceedings from being free from threats, intimidation, harassment, and harm,” the appeals court said on Tuesday.
Trump has <a href="https://www.dailywire.com/news/judge-fines-trump-over-comments-on-hush-money-case-issues-threat-of-future-incarceration" target="_blank" rel="noopener">been fined</a> 10 times after Merchan ruled that he violated the gag order, including comments Trump made in an interview where he criticized the jury’s composition, saying that it was mainly composed of Democrats.

You think of it as a — just a purely Democrat area. It’s a very unfair situation, that I can tell you,” Trump said in an <a href="https://americasvoice.news/video/Fl5de625uPnASso/?related=playlist">interview</a> with Real America’s Voice last month.
Merchan, a donor to President Joe Biden’s 2020 presidential campaign, said in his ruling last week that he might have to imprison Trump if the gag order was violated again.

The indictment, brought by Manhattan District Attorney Alvin Bragg, accuses Trump of falsifying internal records held by the Trump Organization to hide the intent of payments made to Michael Cohen, who paid off porn star Stormy Daniels and Playboy model Karen McDougal so the stories of their alleged trysts with Trump would not become public in 2016. Cohen claims the Trump Organization reimbursed him along with bonuses; prosecutors contend that the money was falsely logged as legal expenses.
“They haven’t come close to proving that fraud has taken place,” McCarthy stated. “And it’s — they don’t just have to prove that fraud has taken place, they have to prove that it was fraud that included a specific intent to commit another crime, which we believe is a federal campaign finance crime. It’s astonishing that we don’t — we can’t say that with complete certainty, and that’s supposed to be spelled out in the indictment. But there’s not a scintilla of evidence that Trump was even thinking about federal campaign law, let alone that they conspired to violate it.”
“And I think it’s important to make this distinction: You can make an agreement, which as Jonathan just said, is a legal arrangement, to not disclose, or to try to bury politically embarrassing information; you can absolutely intend to do that,” he continued. “That doesn’t mean that you were even thinking about the federal campaign finance laws, much less willfully violating them beyond a reasonable doubt.  This is what Bragg has to prove here to at least get a conviction, at least as a matter of law. Whether they can sway the jury is another matter.”

He then referred to Cohen&#8217;s testimony: “And the final thing I would say about this is you can put somebody who is even a convicted perjurer on the stand, but generally the agreement that a prosecutor makes to a jury in terms of the commitment that you make in the opening statement and the way you try the case, is that we’re not gonna ask you to convict on the basis of a perjurer’s testimony unless we can show you a document or other testimony or something that corroborates that witness on this disputed point.”
“They are asking this jury, they have to ask this jury, if they’re gonna convict on fraud, to accept this guy’s uncorroborated testimony despite his mountainous credibility problems. That is not something a prosecutor would ordinarily do, which is why I think the prosecutors in my old office, the Southern District of New York, decided not to pursue this case,” he concluded.
