With the acquittal of Daniel Penny in Manhattan, it&#8217;s clear that Democrats are going to have some difficulty rounding up political prisoners for the next few years. As that trial demonstrated, they can&#8217;t even sell a BLM narrative to a jury full of liberal women (and a guy wearing a COVID mask). People are more skeptical of race hysteria now, across party lines. They understand when they&#8217;re being manipulated. They care more about facts, instead of whatever the corporate press is saying. And that&#8217;s all very bad news for Democrat prosecutors who are looking to collect a scalp.
But this development is obviously small comfort to the many victims of these prosecutors who are still languishing away in prison, after being convicted in show trials to appease the mob. And of course, maybe the single most prominent of those victims is a man named Derek Chauvin. Chauvin was a police officer in Minneapolis who went to work in May of 2020 with the goal of protecting his community from violent felons — people like George Floyd. He&#8217;s been sentenced to more than two decades in prison because Floyd, who had a recent history of overdoses, died in his custody while high on fatal levels of fentanyl.
The issue of &#8220;causation&#8221; was the single most important issue of the trial — that is, the question of whether Chauvin actually killed Floyd. If Chauvin&#8217;s actions weren&#8217;t a &#8220;substantial factor&#8221; in Floyd&#8217;s death, then under Minnesota law, he&#8217;s innocent. That pretty much sums up the entire case.
But after the trial was over, the jury came out and publicly admitted that they didn&#8217;t really care about this issue at all. &#8220;Causation&#8221; just didn&#8217;t matter to them. They gave an interview with CNN where they explained that, in their view, Chauvin&#8217;s actions didn&#8217;t matter at all. Instead, they determined that Chauvin was guilty because of what he didn&#8217;t do. They didn&#8217;t convict him for murdering Floyd. They didn&#8217;t convict him because his actions caused Floyd&#8217;s death. Instead, they convicted him for failing to &#8220;care&#8221; for George Floyd in some unspecified way.

It&#8217;s an incredible piece of footage. First of all, there&#8217;s no reason for a jury to be looking for a &#8220;light bulb moment&#8221; which allows them to rationalize a guilty verdict — unless they were looking for some pretext to convict Chauvin (which they obviously were). The jury shouldn&#8217;t be trying to find a way to get a conviction. They should be looking at whether the prosecution proved its case beyond a reasonable doubt. And if they find themselves doubting that the prosecution proved its case, they don&#8217;t get to rewrite the law to help the prosecution out.
But in this case, that&#8217;s exactly what the jury did. They ultimately decided to hold Chauvin accountable for things he didn&#8217;t do. He didn&#8217;t respond compassionately enough to George Floyd&#8217;s overdose, or live up to the police department&#8217;s motto, I guess — even though none of those things, even if they were true, would make Chauvin a murderer. The new rule, according to this jury, is that police officers have an obligation to perform CPR on violent suspects the moment they say they can&#8217;t breathe — even though Floyd was claiming that he couldn&#8217;t breathe just a few minutes earlier, when he was resisting arrest and struggling with the officers in the back of a patrol car. And if police officers don&#8217;t administer CPR, and someone dies, then we&#8217;ll just assume that the officer killed them. We&#8217;ll just make that leap of logic, because why not?

But just because the jury didn&#8217;t consider the issue of causation to be relevant, that doesn&#8217;t mean it&#8217;s not relevant. From a legal perspective, on appeal, it&#8217;s still very important. And that&#8217;s why a federal judge in Minnesota named Paul Magnuson, who was appointed by Ronald Reagan, has just issued a ruling that could ultimately lead to a new trial in this case. This is a decision that&#8217;s worth dissecting at length, because it highlights what a farce the trial of Derek Chauvin really was. No matter how corrupt you think this trial was, it was actually a lot worse than that.
The decision came in response to a motion filed by Chauvin&#8217;s new lawyer in federal court. Chauvin&#8217;s legal team is seeking to have his conviction overturned, in part, because his previous lawyer was ineffective — to the point that he denied Chauvin his constitutional right to a fair trial. There are other objections too — including that many of the jurors said they felt threatened by the mob, so Chauvin couldn&#8217;t get a fair trial.  
But there are two central claims in the motion arguing that Chauvin received &#8220;ineffective assistance of counsel.&#8221; The first is that Chauvin&#8217;s lawyer, during the trial, failed to tell Chauvin that a doctor had determined that George Floyd died due to acute heart failure, resulting in pulmonary edema and death. There were indications that Floyd had a heart tumor that could&#8217;ve caused sudden cardiac death, and Chauvin was never told about it — nor was it brought up at trial. 
The second claim is that Chauvin&#8217;s lawyer should have listened to the doctor, and ordered tests on samples that were preserved from George Floyd&#8217;s body. Those tests could have determined whether Floyd died of a type of myocarditis, or some other heart ailment. And now, several years later, the federal judge has finally allowed Chauvin&#8217;s new legal team to conduct those tests. Depending on what they show, they could completely undermine the prosecution&#8217;s argument that Chauvin caused the death of George Floyd. And that, in turn, could lead to the conviction being thrown out — and potentially a new trial, if prosecutors decide to pursue it.
One of the reasons this is such an important ruling is that, in Chauvin&#8217;s trial, there was clear evidence that the prosecution lied about the concentration of fentanyl in George Floyd&#8217;s system when he died. And if this case is tried again, this is going to be a major issue. You might remember that, in the initial autopsy report, the medical examiner determined that Floyd had lethal levels of fentanyl in his system. He said that there were no physical signs of strangulation, and that it looked like a textbook overdose. But shortly afterwards, his assessment changed.

The threats and the political pressure, we&#8217;re supposed to conclude, didn&#8217;t influence the medical examiner. We&#8217;re supposed to pretend that he somehow wasn&#8217;t bothered by the mob that was threatening to destroy the entire city of Minneapolis when he changed his determination about the cause of George Floyd&#8217;s death.
We&#8217;re also supposed to think that Democrats in Minneapolis didn&#8217;t exert any political pressure at all. But as the reporter Liz Collin found, there was even more pressure on the medical examiner than many people realize. 
One <a href="https://pbs.twimg.com/media/GVdBFkjXkAAb3TA?format=jpg&amp;name=medium" target="_blank" rel="noopener">internal memo</a> from a prosecuting attorney in Minneapolis at the time says that on May 26, 2020, a team of six FBI agents met with medical examiner Andrew Baker to discuss his preliminary findings. And then after this meeting, he changed his conclusions. He decides that Floyd&#8217;s death was a homicide caused by neck compression — and that fentanyl wasn&#8217;t the cause.
A new trial would offer Chauvin&#8217;s new defense team an opportunity to pick this claim apart. This is an opportunity that Chauvin&#8217;s first legal team missed completely, during the first trial. Outside of a few accounts on social media — people like &#8220;Data Hazard&#8221; for example — no one has talked about this. But it&#8217;s an incredible oversight by the defense team, and a remarkable act of corruption by the prosecution. And if anything completely blows apart the case against Derek Chauvin, it&#8217;s this.
Here&#8217;s the moment in the trial that I&#8217;m talking about. This is maybe the single most important testimony in the whole case. The prosecution is questioning a forensic toxicologist about the levels of fentanyl in Floyd&#8217;s blood.

It&#8217;s a lot to process, with the graphs and the numbers flying around. But the basic idea is that the expert is telling the jury that they collected post-mortem blood samples from George Floyd, meaning the samples were taken after Floyd died. And they compared these samples to other overdose victims, and DUI suspects, after their deaths. And Floyd&#8217;s levels of fentanyl were well below both of those groups, at the post-mortem stage. The conclusion was that Floyd didn&#8217;t overdose on fentanyl.
The fundamental problem here is that Floyd&#8217;s samples, according to the medical examiner&#8217;s records, were not actually conducted post-mortem, or &#8220;after death.&#8221; They&#8217;re comparing Floyd&#8217;s pre-death samples with other people&#8217;s post-death samples.
To restate: There were samples of blood collected from George Floyd before he died in the hospital, according to the government&#8217;s own documents. He wasn&#8217;t actually pronounced dead until an hour after this incident with Derek Chauvin, when he was in the hospital. And while he was in the hospital, his blood was drawn. As the judge put it in his ruling this week, quote, &#8220;the autopsy report shows that ante-mortem blood was collected.&#8221;  And the prosecutors&#8217; own statements from 2020 confirm that. Another <a href="https://x.com/MrAndyNgo/status/1298403284416249856" target="_blank" rel="noopener">internal memo</a> shows what they said at the time. 
 &#8220;Dr. Andrew Baker &#8230; said he had the final toxicology results from Mr. George Floyd&#8217;s samples &#8230; Those samples are from Mr. Floyd&#8217;s hospital admission and were not acquired at autopsy. [Baker] said that these samples are better for determining actual blood toxicity than samples taken at autopsy,&#8221; the memo said. &#8220;Samples taken at autopsy may have undergone &#8216;post mortem distribution.'&#8221; 
So here we have &#8220;ante-mortem&#8221; samples, or pre-death samples of Floyd&#8217;s blood. That means they were taken before the effects of Floyd&#8217;s death could impact the samples.
And the <a href="https://x.com/fentasyl/status/1825656873019650417" target="_blank" rel="noopener">autopsy report</a> also confirms that Floyd&#8217;s samples are &#8220;ante-mortem.&#8221; 
It reads, &#8220;testing performed on antemortem blood specimens collected 5/25/20 at 9:00 p.m. &#8230; Fentanyl 11 nanograms per milliliter.&#8221; This couldn&#8217;t be any more clear. These are pre-mortem samples, according to the prosecution&#8217;s own records.

Now, you might be asking what&#8217;s the big deal — who cares if Floyd&#8217;s blood was collected before his death, or after it? As it turns out, the distinction is extremely significant. After death, fentanyl concentrations in the bodies of overdose victims are dramatically higher than they are before death. It&#8217;s a difference of up to 900% within eight hours of death. That&#8217;s because when you die, blood stops pumping, so blood concentrations change.
So what the prosecution did, in effect, was compare Floyd&#8217;s fentanyl levels before this massive spike with the fentanyl levels of overdose victims after this massive spike. Of course, Floyd&#8217;s levels were lower. And based on this apples-to-oranges comparison, the prosecutors convinced the jury that Floyd&#8217;s death had nothing to do with fentanyl. 
In other words, when he arrived at the hospital Floyd had a level of fentanyl in his blood that was consistent with an overdose victim, when his pre-mortem blood was tested. In fact, Floyd&#8217;s levels of fentanyl were more than two times the average lethal level that you see in fentanyl overdoses. But the prosecution hid this fact from the jury, by presenting these blood samples as &#8220;post-mortem.&#8221; They compared Floyd&#8217;s numbers with other people who had been dead for several hours. 
It&#8217;s impossible to overstate the significance of this deception. This was the crux of the prosecution&#8217;s entire argument. They hit it again and again, including during closing arguments.

Again, he&#8217;s showing the chart with the false information, presenting the numbers as post-mortem. And then at the end of that clip, the prosecutor claims that Floyd had built up a &#8220;tolerance&#8221; to fentanyl — implying that because he had overdosed before, his body could handle a high concentration of the drug.
But that was never proven at trial, either. We know that George Floyd had used fentanyl several times before. He even overdosed just months before his death, resulting in his hospitalization. But that&#8217;s very different from saying that Floyd was somehow immune to the fatal effects of a fentanyl overdose, which was never demonstrated at trial because it&#8217;s impossible. 
The other major problem here is that the prosecution&#8217;s witness testified that Floyd died on the street, which seems incompatible with the idea that pre-death blood samples were later collected in the hospital

This whole trial was full of incidents like this. There was the fact that Floyd&#8217;s suspected drug dealer wasn&#8217;t prosecuted, which allowed him to take the Fifth and avoid testifying about the drugs in Floyd&#8217;s possession. There was the prosecuting attorney who was allegedly <a href="https://alphanews.org/appeals-court-revises-lawsuit-of-prosecutor-who-objected-to-charging-decisions-in-george-floyd-case/" target="_blank" rel="noopener">threatened</a> with professional consequences for refusing to add charges against Chauvin. There was testimony from Andrew Baker, who admitted under cross-examination that Chauvin&#8217;s knee did not cut off Floyd&#8217;s airway. There was that <a href="https://x.com/gregg_re/status/1715582463915733334" target="_blank" rel="noopener">statement</a> from the judge in the case, saying every case is about &#8220;racial justice.&#8221; There was the fact that the prosecution tried to hide the tape of George Floyd saying &#8220;I can&#8217;t breathe,&#8221; when he was still in the squad car — and Chauvin&#8217;s knee was nowhere near his neck.
In 2024, there would be a chance that a jury would see through all of this corruption, and vote to acquit Derek Chauvin. But in 2021, Chauvin was never going to receive a fair trial. The threat of violence by BLM was too real. Propaganda from corporate media was still believable to millions of Americans, in part because all social media was censored. And Democrats had far too much political power. 
None of that&#8217;s true anymore. That&#8217;s why Daniel Penny was just acquitted. And it&#8217;s why, if he&#8217;s granted the new trial he clearly deserves, Derek Chauvin will be acquitted too.

President Joe Biden&#8217;s Department of Justice stepped in this week to try to stop former Minneapolis police officer <a href="https://www.dailywire.com/news/derek-chauvin-stabbed-in-prison-life-saving-measures-administered-report" target="_blank" rel="noopener">Derek Chauvin</a>&#8216;s legal team from an appeal effort.
As highlighted by <a href="https://www.dailywire.com/news/chauvins-legal-team-allowed-avenue-for-appeal-will-examine-george-floyds-heart-tissue" target="_blank" rel="noopener">The Daily Wire</a>, U.S. District Court Judge Paul Magnuson on Monday approved the examination of George Floyd’s heart tissue and bodily fluids, paving a way for an appeal from Chauvin, who was <a href="https://www.dailywire.com/news/derek-chauvin-attorney-talks-u-s-supreme-court-appeal-every-juror-had-a-stake-in-outcome-of-trial" target="_blank" rel="noopener">found guilty</a> in the contentious and highly-publicized case concerning Floyd&#8217;s death.
Now, prosecutors from the U.S. Attorney&#8217;s Office for the District of Minnesota are trying to reverse that ruling, Fox News <a href="https://www.foxnews.com/us/biden-doj-opposes-court-decision-allowing-derek-chauvin-chance-examine-george-floyds-heart" target="_blank" rel="noopener">reported</a>. In a motion filed Tuesday, the state is arguing that Chauvin has &#8220;no legal basis for [his] discovery requests, all of which stem solely from an email he received from an unvetted doctor offering a weaker version of the medical defense than the version that the jury had previously rejected at his state trial.&#8221;
A day earlier, a motion filed by Chauvin’s new defense attorney, Robert Meyers, asked Judge Magnuson to explore samples taken during Floyd’s autopsy on the basis that Chauvin was given “ineffective assistance of counsel” under his last attorney, Eric Nelson.
Meyers noted that Dr. William Schaetzel, a Kansas-based forensic pathologist, told Nelson before conviction that he believed Floyd died from heart failure due to an excessive release of catecholamines, not from Chauvin’s actions, ABC5 <a href="https://kstp.com/kstp-news/local-news/chauvin-appeal-judge-oks-analysis-of-george-floyds-heart-tissue-fluids-in-federal-case/" target="_blank" rel="noopener">reported</a>. However, Nelson never discussed this with Chauvin.
Judge Magnuson agreed, writing in his order, “Nelson provided ineffective assistance of counsel to Mr. Chauvin by failing to consult with him on this issue.&#8221;

In 2023, attorney William Mohrman filed an appeal at the U.S. Supreme Court, arguing, in part, that Chauvin was denied the right to a fair trial. However, the high court <a href="https://www.dailywire.com/news/supreme-court-rejects-derek-chauvin-appeal" target="_blank" rel="noopener">refused</a> to hear the appeal.
“Under the Sixth Amendment of the U. S. Constitution, every criminal defendant is guaranteed a right to a fair trial,” Mohrman told <a href="https://www.dailywire.com/news/supreme-court-rejects-derek-chauvin-appeal" target="_blank" rel="noopener">The Daily Wire</a> at the time. “And part of that fair trial right is not to be tried in a location where the jurors have either been exposed to extensive pre-trial publicity, or there has been such community outrage and the like that the jurors, before they even were impaneled before the trial, would have concluded the defendant’s guilty, or would have been pressured into rendering a guilty verdict.”

“During the questioning, I would say the vast majority — not only the vast majority, probably 75 to 80 percent of the jurors — expressed concerns for their own personal safety as a result of being impaneled on the jury,” he said. “Virtually every juror had obviously heard about the case, knew about the riots, had seen the videos that were taken when George Floyd was arrested; virtually all the jurors have seen that, so it’s difficult in a case like that to impanel the jury where the jurors haven’t formed firm conclusions before the trial even starts.”
Chauvin has also been convicted of a federal civil rights violation, for which he is serving over 20 years concurrently with his state sentence.

Derek Chauvin’s Legal Team Allowed Avenue For Appeal, Will Test George Floyd’s Heart Tissue

When Vice President Kamala Harris announced Tim Walz as her running mate, nearly 9 in 10 Americans said they had no opinion of the largely unknown Minnesota Governor.
Within hours of the selection, the legacy media began the task of explaining to the American people how the man they’d scarcely mentioned on their airwaves was actually one of the country’s preeminent Democratic leaders. Viewers were bombarded with breathless coverage of “<a href="https://www.nytimes.com/2024/08/22/arts/television/tim-walz-dnc.html" target="_blank" rel="noopener">Coach” Walz’s</a> “<a href="https://www.yahoo.com/lifestyle/tim-walz-has-bde-no-not-that-one-the-psychology-behind-big-dad-energy-125956374.html" target="_blank" rel="noopener">Big Dad Energy</a>.” There were also glowing reports of the <a href="https://www.cnbc.com/2024/09/02/harris-walz-minnesota-policy-democrats-election.html" target="_blank" rel="noopener">progressive utopia</a> he’d built for Minnesotans.
Wanting to see the results of Walz’s time in office for myself, I traveled to Minnesota to hear from the people who have lived under his leadership for the past six years.
The first person I spoke with was Liz Collin, a journalist who’s spent decades covering the state. As she walked us through the mostly empty downtown, with boarded up buildings and open drug use, Collin explained how the city has changed under Walz’s tenure, while taking exception to the media portrayal of the governor.

“He’s being sold as this moderate ‘aw-shucks’ guy who will give us some dad jokes. But there’s never been a more radical governor — ever — in Minnesota history,” Collin said.
According to Collin, the turning point for the city — and state — came during the Black Lives Matter riots that engulfed Minneapolis and St. Paul following the death of George Floyd.
Those riots, which ultimately damaged or destroyed more than 1,500 properties and caused $500 million in damage to the Twin Cities, went on for more than three days and nights before Governor Walz finally deployed the National Guard.
In the aftermath, Collin says Walz’s anti-police rhetoric fueled a mass exodus from the state’s police force, most notably in Minneapolis, where hundreds of officers resigned or retired. “You have a police force in Minneapolis that’s down about 40% from where it was at the beginning of May of 2020.”
Now, Collin says, the few remaining officers in the city have been hamstrung with new “progressive” policies curtailing their ability to stop crime. Among other things, police in the city have been restricted from pursuing suspects of non-violent crimes, while another “use of force” policy required officers to contact a supervisor before placing a suspect in handcuffs.
“It’s almost as if police officers have become firefighters. Sort of waiting to put out the fire — whereas before there was proactive policing…and there was a respect and a bit of fear for the cops, but that dynamic has certainly changed.”
From 2019 to 2023, the homicide rate in Minneapolis increased by 50%, while the statewide rate jumped 54%.
According to Minneapolis businessman Greg Urban, those rising crime rates — and the lack of a visible police presence — have had devastating consequences for local businesses.
“Big cities have crime, even the best ones. But you also have the perception of crime and the perception of safety, and when you walk out and see police there is a perception of safety,” Urban told me. “In a large entertainment district, which this once was here in Minneapolis, you need that perception…there’s not that sense of vibrancy that there once was.”

Urban, who once owned the popular Greg’s Saloon in the heart of the city, was forced to close his business due to rising crime and oppressive lockdown policies enacted by Governor Walz during the COVID pandemic.
Speaking outside of the now vacant building where his business once operated, Urban recounted fines he was forced to pay for trying to keep his saloon open, and lamented the “COVID snitch line” Walz opened, which allowed Minnesotans to report neighbors and local businesses violating stay at home orders.
“Tim Walz set up a snitch line, to where if you saw a COVID violation you could call in, he would dispatch his COVID police that he had set up. … There’s instances where Tim Walz put people in jail for as much as 90 days for violating one of his orders. He wasn’t messing around with this, he wanted this state locked down so tight, he would use his jails to do that.”
“This part of the city used to be packed,” Urban said, as we walked past another empty building, this one with the words “Black Lives Matter” spray painted on weathered plywood covering broken windows.
Today, rather than customers waiting outside of Greg’s Saloon, the only Minnesotans to be seen on the block are a pair of homeless men, one on his hands and knees digging for cigarette butts in a crack in the sidewalk.
An hour later, I’m three miles south of downtown, standing in a homeless encampment that’s taken over a vacant lot in a middle class residential neighborhood.
Walking up the street, I see three disheveled men slumped against a neighbor’s fence, looking like they might collapse at any moment, as others around them openly pass around needles and lighters.
The night before, neighbors told me paramedics had been on the scene to treat an overdose victim — a now common occurrence in the neighborhood. Days after my visit, I learned a 33-year-old man was gunned down during a fight in the encampment.
I meet Arne — who asked that I not use his last name — the man who owns the once vacant, now full lot, and has been trying unsuccessfully to build a new home there.

Arne says he’s called the police repeatedly asking them to clear out the encampment, but has been told “there’s not much they can do.” Today, he’s come to the property armed with “No Trespassing” signs, hoping it will give law enforcement more power to remove the unwelcome residents.
According to Arne, since Governor Walz took office, police in the city have been rendered helpless in removing squatters and clearing out homeless encampments from private property like his.
As we speak, a half dozen masked individuals emerge from a car parked across the street. They make their way towards where we’re standing and form a line inches away from us, glaring at our crew.
“They’re trying to intimidate us, and that’s what they do,” Arne says. “You don’t get to just intimidate people like that. I talked to a lot of people and they were all too scared to come on camera. I’m not scared. I’m not going to be silenced … I’m speaking up for everyone else who is too scared to speak up.”
Next, I drive a few blocks down the street to the spot of George Floyd’s death — passing the burnt-out shell of what was once the Minneapolis 3rd Precinct Police Headquarters. Four years after the BLM riots that ravaged the city, the four-story building sits empty and boarded up, with bullet holes still visible in its exterior.
Arriving at George Floyd Square, I’m greeted by the charred remains of a gas station that once stood across the street from the convenience store where Floyd died.

“Power To The People” and “Black Power” inscriptions emblazon the walls of the numerous vacant buildings surrounding the memorial to Floyd, which spans half a block.
Thousands of candles, flowers, and other mementos have been arranged on the sidewalk by activists making the pilgrimage to Floyd Square. Every few minutes, a new group of mourners arrives — some with tears in their eyes — pausing for a moment of silence, snapping photos, and lighting candles.
My final stop takes me to ‘Little Mogadishu,’ a portion of East Minneapolis home to roughly 50,000 Somali immigrants – one of the largest concentrations of Somalis anywhere in the Western world.
Little Mogadishu has long been plagued with elevated crime rates and poverty, but in recent years, has become home to one of the largest fraud operations in American history.
During the COVID pandemic, a number of Somali immigrants in Minneapolis operated Feeding Our Future, a fraudulent nonprofit that received more than $250 million from the Minnesota Department of Education’s administration of Federal Child Nutrition Programs.
Rather than providing meals for children, however, the non-profit redirected millions in taxpayer funds to dozens of individuals throughout the city. That money was used to purchase cars and homes – and according to David Gaither, a longtime Minnesota businessman and state legislator, fund terrorism in Somalia.

“The largest single funder of Al-Shabab, the terrorist organization in Somalia, are the Minnesota taxpayers,” Gaither told me.
“The money that is taken in that fraud doesn’t stay here. Millions of dollars per month in cash are sent out the Minneapolis airport…It goes East, and it ends up in people’s hands that will do mischief and bad things to the United States.”
According to Gaither, Governor Walz was warned of fraud in the system, but failed to investigate the phony non-profit before hundreds of millions of dollars had been disbursed.
Now, Walz is being subpoenaed by the House Education and Workforce Committee for records related to the scheme.
As I prepare to leave Minneapolis, I talk with Scott, a lifelong Minnesotan with a message to Americans still curious about Walz.
“He gives the impression that he’s this moderate folksy leader. He is extreme in almost every respect. He fooled a lot of Minnesotans in the last two elections, we can’t let him fool the rest of the country.”

Former President Donald Trump told Fox News host Greg Gutfeld that he’s only ever personally spoken with Governor Tim Walz (D-MN) — the Democratic Party’s vice presidential candidate — one time.
Trump explained during a Wednesday night appearance on “Gutfeld!” that Walz had called him during the George Floyd riots in 2020, asking for help when he found his home surrounded by protesters.

”He said, ‘I think they’re going to attack me,’” Trump continued. “This was during the riots and everything else. They were MAGA people, you know, they like the American flag, all right. And they also like Trump — I said, ‘How do you know?’ … he said, ‘Could you put out a word, like that I&#8217;m your friend?’”
”I don’t even know him,” Trump said then, admitting that he had posted something nice about Walz then anyway just because he didn’t want to see anything bad happen to him.
“And if you look back long ago …” Trump said he had tweeted something about Walz being a good guy. “‘He’s a good man, the governor, he’s on our side,’ I don’t know him but I didn’t want him to get hurt. And everybody put down their flags and they left, and he said it was a miracle. I didn’t want him to get hurt.”
“Scared by the American flag,” Gutfeld joked.
Trump added that he had told Walz they weren’t going to be violent if they were carrying the American flag but that the governor had been nervous anyway.

On the night of Wednesday May 27, 2020, BLM supporters held a racial justice protest at a Target store near the Third Precinct police station in Minneapolis. After they completely ransacked the Target, the mob began surrounding the police station itself. Everyone in the city knew what was about to happen: Either the authorities would defend the police station, or they&#8217;d let it burn.
At 6:23 p.m, the mayor of Minneapolis, Jacob Frey, received an urgent phone call from the chief of police. He preferred to defend the police station, and he told Frey that because the riot was now so large and out of control, the National Guard would be required to do so.
Five minutes later, the mayor&#8217;s spokesman texted several other employees in the mayor&#8217;s office. He wrote: &#8220;Mayor just came out and said the chief wants him to call in the national guard for help at Third Precinct. Mayor appears intent on doing.&#8221; Frey&#8217;s policy director quickly added: &#8220;He called the governor just now.&#8221;
That was a reference to the governor of Minnesota, Tim Walz, who was the only one in the state with the authority to deploy the National Guard. Frey passed along the police chief&#8217;s message. And before midnight, Frey made his own explicit request to Walz for the deployment of the National Guard. 
Keep in mind, Frey is about as far-Left as they come. He&#8217;s the kind of mayor who doesn&#8217;t resist a single opportunity to pander on the basis of identity politics. He would go on a few days later to performatively weep while kneeling at George Floyd’s golden casket. But in this case, letting a police station burn was just too much, even for Frey.
Yet Walz refused to grant Frey&#8217;s request. As the mayor&#8217;s spokesperson texted later in the evening: &#8220;Walz was hesitating.&#8221;
Around 11:00 a.m. the next morning, as reported by the Star Tribune, Frey&#8217;s office put their request for the National Guard in writing, citing injuries to first responders as well as, &#8220;widespread looting and arson.&#8221; Frey wrote that &#8220;the ongoing situation is well-beyond the capability of our police and fire departments to respond.&#8221; 
But Walz hesitated once again. His daughter, a Left-wing activist, posted on social media that the National Guard hadn&#8217;t been deployed, which emboldened the rioters further. By the time the governor finally activated the National Guard at 2:30 p.m., the police station had already been evacuated. Rioters stormed in and lit the building on fire.
The police precinct was the most prominent of the 164 arson attacks that took place in Minneapolis from May 27 to May 30 of 2020. As Tim Walz kept the National Guard away from the city, rioters used Molotov cocktails to indiscriminately torch small business, cars, and government buildings.

All of this has been public knowledge for a while now. Walz himself has called his response to the riots an &#8220;abject failure.&#8221; But that doesn&#8217;t explain why he let Minneapolis burn for several days. For years, Walz&#8217;s defenders have argued that the situation at the police station was somehow ambiguous, or that he was somehow unaware of what was happening all over Minneapolis — even though it was being broadcast live on national television.
But there&#8217;s another explanation that actually makes sense. And it&#8217;s that Walz, like so many other Left-wing elites, welcomed the violence. He wanted Minneapolis and the rest of the country to burn. At a deeply personal level, he enjoyed all the death and destruction. 
That was certainly the view of the First Lady of Minnesota, Gwen Walz. We know that because she admitted it. In an interview, Gwen Walz says she kept her windows open as long as possible during the riots in order to savor the smell of the burning tires. It was a profound moment for her, because no one was burning down anything she owned. She has bodyguards to prevent that sort of thing. So only the plebs suffered. And as they suffered, Gwen Walz did everything but pull out a fiddle. Watch:

She didn&#8217;t call her husband and ask him why he was allowing arson in the street outside her window. She didn&#8217;t display any concern for the people who were losing their businesses and their livelihoods. Instead, she went with the single most psychotic option available, which was to revel in the suffering and destruction of other people.
And apparently, the media was fine with this response. There was no national outcry after this interview. When Melania Trump wore a light-hearted jacket during the fake &#8220;kids in cages&#8221; controversy, it was a five-day news cycle. Imagine if she had done something like this. Imagine if she said she rolled down her window so she could take in the sounds of all the migrant children crying. That&#8217;s effectively what we&#8217;re seeing here.

And we know Tim Walz endorsed this sentiment, for a couple of reasons. It&#8217;s not just that he stalled the deployment of the National Guard, or that he never condemned his wife&#8217;s comments. Walz came out and said directly that the riots were a justifiable reaction to America&#8217;s failure to fully embrace the principles of DEI. So all those businesses had it coming. The people who died during the riots had it coming too. The tens of millions of dollars of property damage in Minnesota was all worth it, according to Tim Walz. Watch:

&#8220;A society that does not put equity and inclusion first will come to this result.&#8221; In other words, if you don&#8217;t fully support DEI, the government will allow mobs to destroy your business and maybe kill you. And you&#8217;ll deserve whatever happens to you.
When I covered the riots in the UK, I made the point that leaders who fail to enforce the law — say, by opening the borders — shouldn&#8217;t be surprised when lawlessness eventually breaks out. That doesn&#8217;t make lawlessness good, but it does make it understandable in that context.
What Tim Walz is saying is very different. He&#8217;s saying that leaders should embrace lawlessness and destruction as a means of compelling people to support his party&#8217;s agenda. He doesn&#8217;t regret violence. He wants more of it. Terror can be an effective motivator in the voting booth. Keep in mind, Tim Walz said all of this while Derek Chauvin was supposedly receiving a &#8220;fair trial&#8221; in his state. That jury knew very well that, unless they found some reason to convict Chauvin, the city would burn again.
This is how things are done in Minneapolis. And by picking Tim Walz over a more moderate option like Josh Shapiro, Kamala Harris has signaled very clearly that she wants the Minneapolis model of governance to go nationwide. This is a model where voters are instructed to endorse Democrats&#8217; ideology, or they&#8217;ll lose everything.
That includes potentially their children. Last year, Walz signed a law that encourages children to flee from their parents in order to obtain puberty blockers, cross-sex hormones and genital surgeries. The law also allows the state to use these procedures as a means to remove children from the custody of their parents.

<blockquote>Tim Walz signed a bill in April 2023 that made his state a sanctuary for child sex-changes, promoting tourism for such radical medical interventions in defiance of states that restrict them. &#8230; Dubbed the Trans Refuge Bill by supporters, the law grants legal protection to children who travel to Minnesota for so-called gender affirming care, including puberty blockers, reconstructive genital surgery, and hormone therapy, as well as the medical practitioners who provide it. &#8230; The law makes seeking gender-transition procedures for minors a factor in some assessments for whether a Minnesota court has jurisdiction to make an initial determination in child-custody cases.</blockquote>
This kind of law is so extreme that even California governor Gavin Newsom vetoed a bill last year which would have required custody courts to consider whether parents are &#8220;affirming&#8221; the gender delusions of their children. But Tim Walz has no problem with tearing apart families on this basis. In fact, he wants these broken families to come to Minnesota. 
In my documentary &#8220;<a href="https://www.dailywire.com/videos/what-is-a-woman" target="_blank" rel="noopener">What is a Woman?</a>&#8221; I spoke to a Canadian father who <a href="https://www.dailywire.com/news/jailed-canadian-father-still-fighting-childs-gender-transition" target="_blank" rel="noopener">lost custody</a> of his child after a hospital began administering cross-sex hormones to his daughter without his consent. At the time it seemed like a story that you&#8217;d only hear about in Canada. Tim Walz now wants to make that the reality in all 50 states.
And because projection is the Democrats&#8217; platform at this point, Tim Walz will accuse conservatives of hating &#8220;freedom&#8221; while he works to rip children away from their parents. This is from his big announcement rally yesterday in Pennsylvania. Watch:

What Walz is counting on is that no one in the media will ask him an adversarial question in the next three months. That&#8217;s really the only explanation for this. He&#8217;s hoping he&#8217;ll get the same treatment from the press as Kamala Harris. And frankly that&#8217;s probably a safe assumption at this point.
There is nothing about Walz&#8217;s tenure as governor that suggests, even remotely, that he would allow people to mind their own business about anything. During COVID, Walz established a Soviet-style &#8220;stay at home&#8221; hotline to allow people to snitch on their neighbors for violating his lockdown rules. Hundreds of people called in to report that they saw people who weren&#8217;t standing six feet apart, or who kept their mask off at a restaurant even though they weren&#8217;t mid-bite. 
Here&#8217;s one of the complaints that was emailed in:

Customers are coming and saying, I&#8217;m bored and need to get out of the house. They buy lottery tickets, a candy bar, a soda etc; those items are not essential. And the traffic flow is the same as it was a month ago. &#8230; The stay at home order is not being followed and needs to be stricter.</blockquote>

This is the kind of antisocial behavior that Tim Walz encouraged just a few years ago in Minnesota. He didn&#8217;t want to send rioters to jail. But he did want to encourage people to rat on their neighbors so that they&#8217;d face hefty fines and potentially a jail sentence for disobeying his lockdown orders, which had no scientific basis whatsoever. And now he&#8217;s going to lecture conservatives about freedom, because he&#8217;s betting that facts don&#8217;t matter anymore. His base wants to hear lies and distortions, so that&#8217;s what he&#8217;ll deliver.
And these are not subtle lies and distortions. At the same rally, Walz invoked the JD Vance &#8220;couch&#8221; meme, which is based on a fake passage from JD Vance&#8217;s book “Hillbilly Elegy” that was uploaded by a random Twitter user a few weeks ago. After watching that clip, and the other ones I&#8217;ve showed, there&#8217;s not really a point in going into any further detail about Walz&#8217;s policies or life story.
Yes, he says he&#8217;s proud of his role in passing Obamacare, which has tripled the average family&#8217;s health insurance premium.
Yes, the very first executive order that Tim Walz signed created something called a &#8220;DEI council&#8221; that would address the problem of &#8220;whiteness.&#8221;
Yes, he was in the military, at least until he abandoned his unit before they deployed to Iraq.
Yes, he wants to give illegals a ladder to climb the border wall, and then he wants to give them driver&#8217;s licenses when they get here. He also supports abortion until the moment of birth and putting tampons in the boy&#8217;s bathroom at school. Oh, and he thinks that one person&#8217;s socialism is another person&#8217;s neighborliness.
But it&#8217;s not even necessary to go into detail about any of that, because they&#8217;re all exactly what you&#8217;d expect from a stock far-Left-wing politician. More to the point, Kamala Harris didn&#8217;t select Tim Walz to govern anything. She selected him because she thought he&#8217;d help him win the election. And she did that because of the belief — pushed by Kamala Harris yesterday, and by the media as well — that Walz is a down-to-earth, blue-collar guy because he knows how to fix a car and likes to hunt.
And this is maybe the most flagrant misrepresentation of all. Blue-collar people aren’t impressed with any of that stuff. That&#8217;s obvious to anyone who&#8217;s grown up around working-class families, or anyone who&#8217;s turned on a television since 2016. Donald Trump is about as non-blue collar as it gets. He probably hasn’t driven a car in 40 years, much less fixed one. He wouldn’t know how to hunt for deer if his life depended on it. But blue-collar voters love him.
That’s because Donald Trump projects an image of someone who loves his country and cares about Americans. Walz, on the other hand, let his middle-class communities burn while his wife enjoyed the smell from the window of their mansion. That is a contrast that Kamala Harris has just embraced.
And if there are still a critical mass of voters in this country who still want to live in America, instead of burning it down, it&#8217;s a decision that will cost Kamala Harris the White House in November.

The wife of Democrat VP-pick Tim Walz said during an interview in 2020 that she kept her windows open for as long as she could so she could smell the burning of tires rioters set on fire during the Minneapolis-area riots in response to the death of George Floyd.
During the 2020 riots, cities like Minneapolis burned, <a href="https://www.dailywire.com/news/riots-looting-that-followed-george-floyds-death-could-cost-2-billion-most-expensive-incident-in-insurance-history" target="_blank" rel="noopener">costing</a> hundreds of millions of dollars in damage. Gov. Walz has been criticized for his slow response to the destruction and violence by the left-wing protesters.
&#8220;We had more sleepless nights during the riots,&#8221; Gwen Walz <a href="https://kstp.com/kstp-news/top-news/minnesota-first-lady-gwen-walz-opens-up-about-covid-19-decisions-aftermath-of-george-floyds-death/" target="_blank" rel="noopener">told</a> an ABC News affiliate back in July 2020. &#8220;I could smell the burning tires, and that was a very real thing. I kept the windows open as long as I could because I felt like that was such a touchstone of what was happening.&#8221;

In the spring of 2020, after people had taken to the streets in Minneapolis, Minnesota Democratic Gov. Tim Walz admitted there was an &#8220;abject failure&#8221; in the response to the rioters who burned businesses and a police precinct.
Walz, now the Democrats&#8217; 2024 vice presidential nominee, said during a press conference addressing the riots, &#8220;Minneapolis and St. Paul are on fire. The fire is still smoldering in our streets. The ashes are symbolic of decades and generations of pain, of anguish unheard,&#8221; PBS <a href="https://www.pbs.org/newshour/nation/watch-live-minnesota-gov-tim-walz-holds-presser-amid-protests-over-george-floyd-death" target="_blank" rel="noopener">reported</a>. He added that he received a call from a state senator who told him that her district was &#8220;on fire, no police, no firefighters, no social control, constituents locked in houses wondering what they were going to do.&#8221;

The governor, who had the authority to activate the National Guard, then shifted the responsibility to city leaders to quell the riots, saying requests for assistance from city leaders &#8220;never came.&#8221; After a Minneapolis police precinct was burning, Walz finally stepped in and took action, according to PBS.
The New York Times <a href="https://www.nytimes.com/2024/08/06/us/tim-walz-george-floyd-criticism.html" target="_blank" rel="noopener">reported</a> that Minneapolis Democratic Mayor Jacob Frey requested assistance from Walz two days after Floyd&#8217;s death as protests turned violent. The Minneapolis police chief also sent a written request to Walz for 600 National Guard troops hours after Frey reached out to the governor. However, it wasn&#8217;t until the next afternoon that the Minnesota governor issued an executive order authorizing the National Guard to be dispatched to Minneapolis.

“Governor Walz had the ability and duty to use force and law enforcement to stop criminal violence, but he did not,” stated a 2020 Minnesota State Senate report on the response to the riots. “Governor Walz was not willing to do what was necessary to stop the rioting right away because he was having a philosophical debate about whether the use of force should be used to stop violence.”
Minneapolis officials <a href="https://www.courthousenews.com/minneapolis-estimates-protest-damages-at-55-million/" target="_blank" rel="noopener">estimated</a> the rioting and looting in 2020 cost the city around $55 million in damages. Rioters set fire to at least 220 buildings following George Floyd&#8217;s death in police custody. Estimates in 2021, a year after the riots, put the total cost of damage to both Minneapolis and St. Paul at <a href="https://www.newsweek.com/businesses-year-after-floyd-1596610" target="_blank" rel="noopener">$500 million</a>, according to the Star Tribune. Many of the businesses damaged in the riots remained closed a year after the unrest.

Former President <a href="https://www.dailywire.com/topic/donald-trump" target="_blank" rel="noopener">Donald Trump</a> on Wednseday flipped the script on an ABC reporter who asked him about pardoning January 6 protesters.
Trump appeared in person at the National Association of Black Journalists (NABJ) convention on Wednesday, where his exchanges with ABC News’ Rachel Scott turned heated.
&#8220;You&#8217;ve called yourself the candidate of law and order,&#8221; Scott said, noting that Trump has said he would consider pardoning all January 6 protesters despite police officers getting assaulted that day.

Trump said he would &#8220;absolutely&#8221; pardon the January 6 protesters. &#8220;If they&#8217;re innocent, I would pardon them.&#8221;
&#8220;They&#8217;ve been convicted,&#8221; Scott retorted.
&#8220;Well, they were convicted by a very tough system,&#8221; Trump said.
Trump continued, referencing the 2020 riots that erupted across the country in the wake of George Floyd&#8217;s death.
&#8220;What&#8217;s going to happen to the people in Portland that destroyed that city?&#8221; the former president asked. &#8220;How come the people that tried to burn down Minneapolis, how come the people that took over a large percentage of Seattle, how come nothing happened to them?&#8221;
&#8220;No no no, we&#8217;re talking about federal buildings,&#8221; Trump said as Scott tried to interrupt.
Trump also referenced Ashli Babbitt, the woman who was fatally shot by a Capitol police officer on January 6, noting that &#8220;nobody died that day&#8221; except for Babbitt.
&#8220;But people died in Seattle. Nobody died, but people died in Minneapolis,&#8221; Trump said. &#8220;And nothing happens to those people. But you went after the J6 people with a vengeance.&#8221;
He also asked, &#8220;What about the police that are ushering everybody into the Capitol? Go in, go in, go in. What about that?&#8221;
Trump&#8217;s appearance also started off with a heated exchange as soon as the former president sat down.
Scott said she wanted to address the &#8220;elephant in the room&#8221; and proceeded to list Trump&#8217;s alleged slights against minorities, according to her. She accused him of having dinner with a &#8220;white supremacist&#8221; and &#8220;attacking&#8221; black journalists, among other things.
&#8220;Well, first of all, I don&#8217;t think I&#8217;ve ever been asked a question in such a horrible manner, first question,&#8221; Trump responded. &#8220;You don&#8217;t even say, &#8216;Hello, how are you?&#8217; Are you with ABC? Because I think they&#8217;re a fake news network, a terrible network. And I think it&#8217;s disgraceful that I came here in good spirit. I love the black population of this country. I&#8217;ve done so much for the black population of this country.&#8221;
The former president said he has worked to boost black employment, mentioning the Opportunity Zones program with Senator Tim Scott (R-SC), which was part of Trump&#8217;s tax cuts. The program involved a federal tax incentive for private investment in economically distressed communities.
&#8220;She was very rude,&#8221; Trump said later. &#8220;She didn&#8217;t ask me a question. She gave a statement.&#8221;

Several weeks ago, I saw a news article proclaiming that it’s been four years since the death of George Floyd — and my head snapped. It certainly doesn’t feel like it’s been four years. When George Floyd’s death on a Minneapolis street hit headlines in May 2020, I was busy graduating high school, sans Pomp and Circumstance, and trying to figure out what exactly the future would hold. We were headlong into the COVID-19 lockdowns, and my schedule was, to say the least, very open. The video of Floyd’s death, and the pure unadulterated social rage that followed, served as a catalyst that would change the country forever. Americans were looking for a reason to be mad — and they found one.
The race-obsessive revolution that followed happened in two ways: suddenly and gradually. In the months after Floyd’s death, American cities descended into madness, with looters and vandals doing $1–2 billion worth of damage in the most expensive riot damage tolls in the past half-century. But you can’t riot forever; in many ways, the gradual incursions of America’s race revolution in the institutional space have been even more pernicious and laid the groundwork for a far more complex wave of social racialization.
I’m referring, of course, to DEI: programs for diversity, equity, and inclusions that’ve commandeered billions of dollars from the university to the boardroom and re-ignited fierce debates about the place of race in public life. Shortly after the death of George Floyd, such initiatives were everywhere. You’d be hard pressed to find a company in the Fortune 1000 that wasn’t having to explore the best way to approach the issues of racial and cultural conflict in the workplace: exploration to the tune of <a href="https://fortune.com/2024/02/16/esg-dei-branding-problem-diversity-inclusion-debate/" target="_blank" rel="noopener">$340 billion</a>. Corporate America pledged more than the entire 2024 budget of the Department of Education to treat a disease that they weren’t sure they had.
Yet here we stand, four years later, and times have changed. As a corporate analyst, who’s watched almost a hundred annual meetings and listened to thousands of corporate proposals, I see how the market for diversity officers is <a href="https://www.wsj.com/business/c-suite/chief-diversity-officer-cdo-business-corporations-e110a82f" target="_blank" rel="noopener">drying up</a>. Very few corporate proposals are seeking to form DEI commissions or move the goalposts on diversity — and an increasing number are actually asking companies to audit the legal and reputational risks that such programs have created. What happened? Did the corporate DEI movement simply get stamped out by greedy companies, happy to forego racial progress to make a buck? Or, does the movement itself bear some blame for grounding itself on the rocks?
I’ve interviewed both DEI critics and advocates, trying to find answers. I’ve listened to corporate activists, including at Walmart’s annual meeting last week, discussing how employees of color are still at risk and underprivileged in the workplace. I can sympathize with concerns about prejudice — and no doubt, sympathizing with concerns is how many corporate DEI initiatives began. Yet, the racializing solutions corporations have devised are quickly running up against reality. Just look at the case of Amazon, which recently had to deal with <a href="https://www.usatoday.com/story/money/2024/05/31/dei-backlash-george-floyd-death-anniversary/73899737007/" target="_blank" rel="noopener">multiple lawsuits</a> over its <a href="https://www.aboutamazon.com/news/transportation/two-years-of-empowering-entrepreneurs-with-more-to-come" target="_blank" rel="noopener">diversity grant program</a> (piloted in 2020) that excludes white and Asian entrepreneurs. As the pendulum swings back towards normal, ordinary Americans are waking up and realizing how divorced from reality corporate ‘anti-racist’ solutions are.
I’m reminded of a conversation I had in Grand Rapids last year with a DEI practitioner who said, “DEI isn’t generally seen as ‘company first.’ HR is there to look out for the company and mitigate risk. And DEI can create some risk there.” When pressed, she further noted her discomfort with the fact that “DEI consultants are buying into the corporate and capitalist game.” If DEI practitioners view corporate structures, including the pursuit of fiduciary duty, as a game to be played, and openly admit that their practices create corporate risk… that’s a bit of a poison pill for a corporate department/initiative tasked with providing positive returns to shareholders. DEI’s most ardent advocates and supporters might like to believe that diversity initiatives are part and parcel of increasing brand value. But shareholders don’t seem to agree—and as DEI’s potential to create corporate risk increases, so does the skittishness of the people who rely on brand performance for return.
Four years after the death of George Floyd, America’s rejection of race radicalism is underway, from the Supreme Court to prominent academic institutions (even the faculty of Harvard are <a href="https://www.thecrimson.com/article/2024/6/4/dei-faculty-hiring-stopped/" target="_blank" rel="noopener">doing away</a> with mandatory DEI statements). As economist Glenn Loury told me days after the Court’s overturn of affirmative action, “People said there was going to be a racial reckoning after George Floyd. The real reckoning on race is this.” America’s DEI advocates didn’t fall victim to a series of unfortunate events or any such helpless situation. They walked into the boardroom unseriously, and assumed that the radicalism and real risk that came along with them wouldn’t matter to corporate America. Billions of dollars later, it’s abundantly clear: it mattered.
The corporate DEI movement’s wounds are overwhelmingly self-inflicted, and its eventual demise will be as well. I only wish it hadn’t taken us four years and hundreds of billions of dollars to arrive at this conclusion.

<a href="https://www.dailywire.com/topic/harvard-university" target="_blank" rel="noopener">Harvard University</a>, which has embroiled itself in controversy with 122 faculty members <a href="https://medium.com/@acfreedomfacstatement/harvard-faculty-response-to-combating-antisemitism-86ca47e87cdf">saying</a> that criticizing the deadly phrase “from the river to the sea, Palestine must be free” is “imprudent” and a former president who refused to condemn anti-Semitic protests and calls for the genocide of Jews, has now <a href="https://www.cnn.com/2024/05/28/business/harvard-core-function/index.html" target="_blank" rel="noopener">decided</a> the university “should not, however, issue official statements about public matters that do not directly affect the university’s core function.”
In April, interim President Alan M. Garber and interim Provost John F. Manning announced the formation of the Institutional Voice Working Group to decide when Harvard as a university “should speak on matters of social and political significance and who should be authorized to speak for the institution as a whole,” the Harvard Gazette <a href="https://news.harvard.edu/gazette/story/2024/05/when-should-harvard-speak-out/?utm_source=SilverpopMailing&amp;utm_medium=email&amp;utm_campaign=5.28.24%20Institutional%20Voice%20(1)" target="_blank" rel="noopener">reported</a>.
The group was co-chaired by Noah Feldman, the Felix Frankfurter Professor of Law at Harvard Law School, and Alison Simmons, the Samuel H. Wolcott Professor of Philosophy.
“The main point of the report is that the University’s leadership can and should speak out on anything relevant to the core function of the University, which is creating an environment suitable for free, open inquiry, teaching, and research,” Feldman stated. “That environment is threatened these days, and we need to defend it. At the same time, the University as an institution should not make official statements on issues outside its core function. Harvard isn’t a government. It shouldn’t have a foreign policy or a domestic policy.”
In January, Claudine Gay, the first black president in Harvard’s history, resigned after plagiarism allegations against her, her <a href="//0923F40A-3A98-4098-9793-691BD90F056C/v" target="_blank" rel="noopener">initial silence</a> when 34 student groups blamed the October 7 Hamas massacre of over 1,200 Israelis solely on Israel, and her reluctance to condemn anti-Semitism when she testified before Congress. She also reportedly put together a task force after the death of George Floyd, with its stated goal being to diminish the number of white men who were visible in campus spaces.

When the furor over Gay broke, eleven of the twelve members of the Harvard Corporation stood by her, writing, “As members of the Harvard Corporation, we today reaffirm our support for President Gay’s continued leadership of Harvard University. Our extensive deliberations affirm our confidence that President Gay is the right leader to help our community heal and to address the very serious societal issues we are facing.”

North Central University in Minneapolis, Minnesota, has offered the scholarship since June 2020, and says on its <a href="https://www.northcentral.edu/george-floyd-scholarship-fund/george-floyd-memorial-scholarship-application/" target="_blank" rel="noopener">website</a> that the memorial scholarship “is a four-year, full-tuition scholarship awarded to one student each year based on two community recommendations and a written essay.”
William Jacobson, a Cornell Law professor who runs the conservative website Legal Insurrection and founded the Equal Protection Project, filed <a href="https://www.scribd.com/document/717276341/Equal-Protection-Project-OCR-complaint-against-North-Central-University" target="_blank" rel="noopener">a complaint</a> with the U.S. Department of Education’s Office for Civil Rights in Chicago, alleging the scholarship violates Title VI of the Civil Rights Act of 1964, which prohibits schools from discriminating based on race.
“The George Floyd Scholarship eligibility requirements are openly racially discriminatory,” Jacobson <a href="https://www.thecollegefix.com/george-floyd-scholarship-violates-civil-rights-law-federal-complaint/" target="_blank" rel="noopener">told </a>The College Fix. “Regardless of the purpose of the racial discrimination, it is wrong and unlawful.”
“NCU needs to come up with a remedial plan to compensate students shut out of the George Floyd Scholarship due to discrimination,” Jacobson added.
In addition to violating the federal Civil Rights Act, the scholarship also violates Minnesota’s Human Rights Act, Jacobson’s complaint alleges.
“Similarly, the [scholarship] defies the civil rights protections of Minnesota’s Human Rights Act, which makes it a criminal offense for an educational institution to limit access to any educational program on the basis of race,” a footnote in the complaint says.
Jacobson also told The College Fix that the Supreme Court’s decision last year on affirmative action should make clear that discriminating based on race is illegal.

“After the Supreme Court’s decision in [Students For Fair Admissions], it is clear that discriminating on the basis of race to achieve diversity is not lawful,” Jacobson told the Fix. “As Chief Justice Roberts wrote in the majority opinion, ‘[e]liminating racial discrimination means eliminating all of it.’”
In Justice Neil Gorsuch’s concurring opinion on the affirmative action ruling, he stated that it doesn’t “matter if the recipient discriminates against an individual member of a protected class with the idea that doing so might favor the interests of that class as a whole or otherwise promote equality at the group level.”
The Supreme Court <a href="https://www.dailywire.com/news/supreme-court-issues-landmark-ruling-on-affirmative-action-at-universities" target="_blank" rel="noopener">ruling</a> was based on allegations that Harvard discriminated against Asian and white students by enrolling students of other races over them, even when the Asian and white students had better test scores.
