United States District Court Judge Steven McAuliffe ruled on Monday that the Bow School District in New Hampshire could continue to eject parents from school sporting events if they wore &#8220;XX&#8221; wristbands supporting biological females in sports.
McAuliffe issued a <a href="https://nhjournal.com/judge-rules-school-can-ban-xx-protests-over-males-in-girls-sports/" target="_blank" rel="noopener">45-page ruling</a> against parents Anthony Foote, Kyle Fellers, Eldon Rash, and Nicole Foote, saying that school athletic events were considered a &#8220;limited public forum&#8221; and therefore the school district could act if it was deemed necessary to &#8220;protect&#8221; students from &#8220;adult speech that can reasonably be seen to target a specific student participating in the event.&#8221;
The protest occurred in September 2024 when the parents learned that their daughters&#8217; soccer team would compete against a team that included a trans-identifying male player, Parker Tirrell, and decided to wear the wristbands in silent protest.
But McAuliffe ruled that the bright pink wristbands would likely be interpreted as &#8220;demeaning and harassing&#8221; and seen as &#8220;directly assaulting&#8221; anyone who happened to identify as transgender.
&#8220;The message generally ascribed to the XX symbol, in a context such as that presented here, can reasonably be understood as directly assaulting those who identify as transgender women. Because gender identities are characteristics of personal identity that are ‘unalterable or otherwise deeply rooted,’ the demeaning of which ‘strikes a person at the core of his being,’ and because Bow school authorities reasonably interpreted the symbols used by plaintiffs, in context, as conveying a demeaning and harassing message, they properly interceded to protect students from injuries likely to be suffered,&#8221; McAuliffe stated.
Anthony Foote told The New Hampshire Journal that he had no intention of backing down from the fight, saying, &#8220;What was our offense? Supporting girls’ sports and defending biological reality? This ruling is a slap in the face to every parent who believes schools should be a place of fairness, not political indoctrination. The judge openly admitted that Pride flags are allowed because they promote ‘inclusion,’ but wristbands defending women’s sports are banned because they might ‘offend’ someone. That’s viewpoint discrimination, plain and simple — and it’s unconstitutional.&#8221;

Three years ago, during a high school girls’ volleyball match, the future I had envisioned for myself completely fell apart.
I <a href="https://www.iwfeatures.com/documentary/payton-mcnabb/" target="_blank" rel="noopener">suffered a severe head and neck injury</a> after a trans-identifying male athlete on the opposing girls’ team sent a volleyball flying directly at my face. I was left partially paralyzed on the right side of my body. The full extent of my injuries forced me to confront the reality that the collegiate athletic career I had been pursuing was no longer possible, and that even basic tasks, such as driving and taking exams, would be significantly more difficult.
At first, I felt hopeless. But then I realized I could use my tragedy — the permanent consequences I must now live with as a result of an unfair policy forcing girls like me to compete against biological males—for good.
And that’s exactly what has happened.
It was an immense honor to attend President Donald Trump’s joint address to Congress on March 4 as a guest of the president and first lady. All I could think about as I listened to the president share my story is how far I’ve come — and how different things could have been.
I never wanted to be a policy advocate or public figure in the fight against gender ideology. All I wanted was to compete and play softball in college. But as President Trump reminded Americans during his address, gender ideology and the officials who enforce it stole that dream from me. And they have no regrets about doing so.
In fact, as I stood to be recognized by President Trump, not a single Democrat on the left side of the aisle applauded or stood in recognition of the hardship I have experienced. I don’t recall even one Democrat so much as looking in my direction. It was hard not to take this as a personal insult. After all, the policies they support — policies that strip women of their right to sex-based spaces and sports teams — cost me personally.
But the Democrats’ stubborn refusal to recognize the consequences of their policies doesn’t just affect me. Senate Democrats in particular made that quite clear this month when they refused to vote in favor of the Protection of Women and Girls in Sports Act, a bill that would bar male athletes from competing against — and potentially injuring — young women.
These Democrats know they are out of step with the American public on this issue—and they just don’t care. For example, when Sen. Jeanne Shaheen, D-NH, was asked earlier this month why she voted against the bill when <a href="https://www.foxnews.com/sports/nyt-poll-finds-majority-democrats-oppose-trans-athletes-womens-sports" target="_blank" rel="noopener">the vast majority</a> of her state’s residents support it, she <a href="https://www.foxnews.com/politics/gops-two-top-dem-senate-targets-justify-blocking-bill-bar-men-from-womens-sports" target="_blank" rel="noopener">insisted</a> the legislation wasn’t important because “it only applies to one person.”
To be clear, even a very conservative estimate <a href="https://thehill.com/homenews/lgbtq/5046662-ncaa-president-transgender-athletes-college-sports/" target="_blank" rel="noopener">places</a> the total number of trans-identifying male athletes competing in women’s sports at far more than just “one person.” But even if Shaheen were right, I am living proof of what can happen when just “one person” is forced to give up her sex-based right to fair and safe competition. Does my experience not matter to Democrats like Shaheen? Do my rights not count?
The fact is, it doesn’t matter how many trans-identifying athletes there are. The correct number of women who should be forced to compete against them is zero. And if congressional Democrats refuse to take our safety seriously, then state legislatures must pick up the slack for them.
After my injury, I was proud to help pass a bill in my home state of North Carolina, House Bill 574, that bans trans-identifying male athletes from playing in women’s sports at both the K-12 and collegiate levels, and I remain committed to helping other states follow suit. There are still 24 states that refuse to act on this issue. That must change.
Those states should keep in mind that the American public, the Trump administration, and, most importantly, common sense, are all on the same side: the side that values and protects women like me. They can either join the fight or stay seated like the Democrats in Congress this month. For their own sake, I hope they choose the former.

WNBA star Caitlin Clark <a href="https://apnews.com/article/ap-female-athlete-of-year-clark-7e5aa066120ee2b1f85b6ab1098b7a8d">won</a> The Associated Press Female Athlete of the Year with 35 total votes, and Olympic gold-winning gymnast Simone Biles came in second, but another nominated <a href="https://www.dailywire.com/topic/female-sports">athlete,</a> who came in third with four votes, is stirring up controversy due to questions about gender. 
Imane Khelif is an Olympic gold medalist <a href="https://www.dailywire.com/topic/boxing">boxer</a> from Algeria who had failed past <a href="https://www.dailywire.com/topic/gender">gender</a> tests — per the IBA — and was later allegedly proven to be a biological male, according to a French journalist who obtained a medical report, as The Daily Wire previously <a href="https://www.dailywire.com/news/tonight-was-my-revenge-female-boxer-wins-title-after-olympics-gender-controversy">reported</a>.
IBA President Umar Kremlev said the boxer has “XY chromosomes.” The boxer was allowed by the IOC (International Olympic Committee) to compete against biological women in the 2024 Paris Olympics.

The Olympics formally cut ties with the IBA, which the IOC now dismisses as “not credible,” and allows boxers to compete based on the gender listed on their passports rather than enforcing any gender-related testing.
Female boxer Angela Carini forfeited her scheduled bout in the Olympics against Khelif in Paris, saying “one punch hurt too much” and that she “had never felt a punch like this.” 
Carini later won the 2024 Italian women’s title for boxing after being forced to fight Khelif at the 2024 Paris Olympics. 
Many social media users reacted to Khelif getting four votes from the AP panel, with one person <a href="https://x.com/pamadkisson/status/1872060965703106606">calling it </a>“disgusting.” 
“That’s not a female. We all know it,” another reply <a href="https://x.com/kateiswell/status/1872058982665474454">said</a>. 
“Khelif still has XY chromosomes. These are facts,” <a href="https://x.com/Bubblebathgirl/status/1872088551762149549">echoed</a> a third.
Talk show host Piers Morgan said in August that Khelif being named the women’s champion in Paris a “travesty.”

Female boxer Angela Carini celebrated taking home the 2024 Italian women&#8217;s title for boxing after being forced to fight in the 2024 Paris Olympics against a competitor with a sex development condition who had failed previous gender tests with the International Boxing Association (IBA). 
The victory for Carini came months after she had to endure being beaten up in the ring by Imane Khelif, an Olympic boxer from Algeria, who had failed past gender tests — per the IBA — and was later allegedly <a href="https://www.dailywire.com/news/french-journalist-claims-medical-report-proves-olympic-boxer-who-took-gold-in-womens-division-a-man">proven to be a biological male</a>, according to a French journalist who obtained a medical report.
After winning the title, the female boxer said, “Tonight was my revenge,” a <a href="https://x.com/oliverbrown_tel/status/1865887087456563426">Telegraph reporter</a> wrote on X. “Some 2024 for Angela Carini. She endured anguish and gross unfairness at the Paris Olympics, forced to withdraw after 46 seconds against an opponent who had failed two sex tests. Four months on, she has just won the Italian title…”
After Carini quit her match against Khelif — who had been allowed to fight in the female boxing category despite the controversy — the Algerian boxer went on to get the gold in the women’s welterweight final boxing match, something many criticized, as <a href="https://www.dailywire.com/news/shame-on-you-all-megyn-kelly-piers-morgan-and-others-react-to-algerian-boxer-getting-gold-after-failing-gender-test">The Daily Wire</a> has previously reported.

A Kentucky court issued a preliminary injunction on the Biden administration’s rewrite of <a href="https://www.dailywire.com/topic/title-ix" target="_blank" rel="noopener">Title IX</a>, putting a temporary stop to it in six states, Kentucky, Tennessee, Virginia, Ohio, West Virginia, and Indiana.
In the district court <a href="https://www.tn.gov/content/dam/tn/attorneygeneral/documents/pr/2024/pr24-50-memo.pdf">conclusion</a> it said the U.S. Department of Education will be restrained from “implementing, enacting, enforcing, or taking any action in any manner to enforce” the new regulations in those six states, <a href="https://www.outkick.com/sports/kentucky-court-stops-joe-biden-title-ix-rules-virginia">Outkick</a> noted. Biden&#8217;s recent rewrite of Title IX includes protection for transgender-identifying people — a policy that was originally enacted in 1972 to protect women and girls.
Tennessee Attorney General Jonathan Skrmetti released a <a href="https://www.tn.gov/attorneygeneral/news/2024/6/17/pr24-50.html">statement</a> about the decision, calling it a “big win.”
“This is a big win for the Constitution and the people of Tennessee,” the statement read. “We fought hard to protect our constitutional separation of powers, which ensures that the people through their elected representatives are the only authority that can make new laws.”

“If the rule we stopped had been allowed to go into effect on August 1 as scheduled, Tennessee schools and universities would have to let boys into girls’ locker rooms and other private spaces,” the statement added. “If the rule went into effect, our schools would have to punish teachers and students who declined to use someone’s preferred pronouns.”
“These are profound changes to the law that the American people never agreed to,” the statement concluded. “This rule was a huge overreach by federal bureaucrats, and the Court was right to stop it.”
Virginia Attorney General Jason Miyares took to <a href="https://x.com/JasonMiyaresVA/status/1802708125746659838">X</a> on Monday, celebrating the injunction on what he called the “unlawful” move by the Biden administration.
“I’m pleased to announce that a court has stopped the Biden Administration&#8217;s unlawful Title IX regulations from going into effect in Virginia,” Miyares wrote. 
“The Biden Administration’s latest power grab would jeopardize half a century of landmark protections for women, violate the First Amendment, and ignore the clear text of the Title IX law passed by Congress,” he added. “The rule should have never been issued in the first place.”
Virginia Republican Governor Glenn <a href="https://x.com/GovernorVA/status/1802716948280586264">Youngkin</a> praised Miyares for leading the charge.
“Virginians saw the rewriting of Title IX for what it was — an attempt to leverage federal tax dollars to impose a harmful agenda on parents and families,” Youngkin wrote. “I applaud<a href="https://x.com/JasonMiyaresVA"> [JasonMiyaresVA</a>] for leading the charge and confronting the Biden administration’s obvious executive overreach.”
Former collegiate swimmer and outspoken activist for female sports Riley Gaines posted about the court’s conclusion and <a href="https://x.com/Riley_Gaines_/status/1802712193646928210">wrote</a>, “Great news! Biden&#8217;s illegal rewrite of Title IX won&#8217;t go into effect in TN, KY, VA, WV, OH, &amp; IN.&#8221;
“A federal court granted an injunction for the Title IX lawsuit filed by mentioned states,” Gaines added. “This is a huge win. The gender ideology house of cards is falling fast.”
The Biden administration’s provision “clarifies that sex discrimination includes discrimination based on sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity.”
The revision will force any K-12 school or higher education institution receiving federal funding to allow boys who identify as girls to use girls’ bathrooms, locker rooms, and housing accommodations, while allowing girls who identify as boys to use boys’ facilities.
