The prosecution dropped the Georgia 2020 election interference case against President Donald Trump on Wednesday, saying it was no longer realistic to continue pursuing it.
In a filing in the Superior Court of Fulton County, Georgia, Prosecuting Attorneys&#8217; Council Director Peter Skandalakis said that he was dropping the case against Trump and his co-defendants “to serve the interests of justice and promote judicial finality.”
The filing brings an end to a lengthy legal saga that included Trump’s iconic mugshot from the Fulton County Jail to the removal of District Attorney Fani Willis from the case over allegations that she improperly appointed her ex-boyfriend as a special prosecutor to investigate it. Skandalakis took over the prosecution after Willis was disqualified, and the state Supreme Court blocked her appeal to have the case returned. 
The presiding judge approved the motion.
&#8220;The case is hereby dismissed in its entirety,&#8221; Fulton County Superior Court Judge Scott McAfee wrote.
Trump celebrated the decision on Truth Social, saying it was the end of another &#8220;witch hunt&#8221; against him.

“As a former elected official who ran as both a Democrat and a Republican and now is the Executive Director of a non-partisan agency, this decision is not guided by a desire to advance an agenda but is based on my beliefs and understanding of the law,” he said. “I begin the process of evaluating this case with a basic truth: It is not illegal to question or challenge election results. Our nation’s foundational principles of free speech and electoral scrutiny are rooted in this very freedom.&#8221;
Skandalakis said he believed the case would be better suited for federal court than for state court. 
“There is no realistic prospect that a sitting President will be compelled to appear in Georgia to stand trial on the allegations in this indictment. Donald J. Trump’s current term as President of the United States of America does not expire until January 20, 2029; by that point, eight years will have elapsed since the phone call at issue,” he wrote. 
He also said that it would be “illogical and unduly burdensome and costly” for Fulton County to try to prosecute Trump’s co-defendants without Trump as well. This includes figures such as Trump’s former chief of staff, Mark Meadows, and Justice Department official Jeffrey Clark.

Fulton County, Georgia, District Attorney Fani Willis cannot continue her criminal prosecution of President Donald Trump and his allies after a ruling from the Georgia Supreme Court on Tuesday.
In a 4-3 decision, the state’s high court declined a request from Willis to review the Georgia Court of Appeals’ ruling that disqualified the Democratic district attorney from prosecuting the 2020 election interference case over the conflict of interest she created when she hired her then-boyfriend, Nathan Wade, as a special prosecutor. The ruling means that the 2020 case against Trump and his allies is dead, unless another prosecutor brings charges, The Hill <a href="https://thehill.com/regulation/court-battles/5505353-willis-disqualification-trump-georgia-case/">reported</a>.
“The Georgia Supreme Court has correctly denied review of the Georgia Court of Appeals decision disqualifying DA Fani Willis and her office as prosecutors in the Fulton County RICO case,” said Steve Sadow, the lead attorney for Trump in Georgia. “Willis’ misconduct during the investigation and prosecution of President Trump was egregious, and she deserved nothing less than disqualification. This proper decision should bring an end to the wrongful political, lawfare persecutions of the President.”
A nonpartisan state agency will now be tasked with finding another prosecutor to determine if the case against Trump can proceed, the Atlanta Journal-Constitution <a href="https://www.ajc.com/politics/2025/09/fani-willis-loses-last-chance-to-stay-at-the-helm-trump-georgia-election-interference-case/">reported</a>. Willis <a href="https://apnews.com/article/fani-willis-appeal-georgia-supreme-court-trump-7be50feee272612484490b53592e7e08">said</a> that she hopes another prosecutor “will have the courage to do what the evidence and the law demand.” If another prosecutor is assigned the case, he could continue pursuing the exact charges that Willis did, choose to pursue some of the charges, or dismiss the case, according to the <a href="https://apnews.com/article/fani-willis-appeal-georgia-supreme-court-trump-7be50feee272612484490b53592e7e08">Associated Press</a>.
In December, the Georgia Court of Appeals ruled that Willis’ actions presented a “rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings.” Wade had little experience prosecuting cases when Willis hired him to lead the Fulton County prosecution of Trump. Willis was accused of paying Wade hundreds of thousands of dollars and vacationing with him multiple times, with Wade paying for some of the trips. Both Willis and Wade testified that Willis reimbursed him for her share of the trip costs.
Willis became a star in the Democratic Party when her office brought 13 charges against Trump after he challenged Georgia’s election results in 2020. In 2023, Trump and 18 others were indicted under Georgia’s anti-racketeering law and accused of engaging in a scheme to overturn Georgia’s 2020 election results that helped push Joe Biden into the White House.
Trump said the charges were another political “witch hunt.” The case brought against Trump by Willis’ office resulted in Trump being forced to pose for a mug shot, which quickly went viral. Trump displayed a <a href="https://www.dailywire.com/news/trump-hangs-mugshot-outside-oval-office-so-bad-a-that-its-surreal">framed</a> picture of the mugshot just outside the Oval Office shortly after he was sworn in for his second term.

Georgia Attorney General Chris Carr said Monday that the state Supreme Court should not take up an appeal from Fulton County District Attorney <a href="https://www.dailywire.com/topic/fani-willis" target="_blank" rel="noopener">Fani Willis</a> to be reinstated to the case against President-elect Donald Trump. 
The Georgia Court of Appeals <a href="https://www.dailywire.com/news/fani-willis-disqualified-from-trump-election-case-what-does-that-mean-for-trump" target="_blank" rel="noopener">disqualified Willis from prosecuting</a> the 2020 election interference case against Trump and more than a dozen co-defendants because of an apparent conflict of interest she created by hiring her then-boyfriend Nathan Wade as a special prosecutor. 
“The Georgia Court of Appeals has ruled that the Fulton County DA created her own conflict and rightfully removed her from the case against President-elect Trump,” Carr said. “‘Lawfare’ has become far too common in American politics and it must end.”
“As such, I would encourage the Georgia Supreme Court to not take her appeal,” he added. “It’s our hope that the DA will now focus taxpayer resources on the successful prosecution of violent criminals in Fulton County.”

Georgia Republican Governor Brian Kemp echoed Carr’s sentiment.
“Agreed, [Georgia AG]! Georgians deserve safe communities and partisan politics out of our courtrooms,” Kemp<a href="https://x.com/BrianKempGA/status/1873835123936030918"> posted</a> on X. 
Trump lawyer Steve Saddow also <a href="https://x.com/stevesadow/status/1873792007602098421" target="_blank" rel="noopener">agreed</a> with Carr, saying that a lower court had previously “abused its discretion by failing to disqualify Wade AND DA Willis” and that the Appeals Court was simply providing an “appropriate remedy.” 
Willis <a href="https://thehill.com/regulation/court-battles/5060177-georgia-attorney-general-fani-willis-trump-appeal/" target="_blank" rel="noopener">claimed</a> Carr’s statement was motivated by his desire to run for governor. 
“If Mr. Carr cannot separate his ambition to become Governor from his duties as Attorney General, he should resign and focus on being a full-time candidate rather than serving as a constitutional officer sworn to uphold the Constitutions and laws of the United States and Georgia,” she said. 
On December 19, the Georgia Court of Appeals ruled 2-1 to disqualify Willis from the case. 
“While we recognize that an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings,” <a href="https://www.documentcloud.org/documents/25464412-trumpgaappealsopn121924/" target="_blank" rel="noopener">wrote</a> Judge Trenton Brown.
Willis was accused of hiring Wade, who had little experience prosecuting cases, and paying him hundreds of thousands of dollars, which they used to fund lavish vacation trips.

Georgia’s Court of Appeals on Thursday disqualified Fulton County District Attorney Fani Willis from prosecuting President-elect Donald Trump for supposed election interference, throwing the entire case into disarray.
Willis <a href="https://www.dailywire.com/news/its-done-reactions-pour-in-over-latest-bombshell-report-against-fani-willis" target="_blank" rel="noopener">hired her boyfriend, Nathan Wade</a>, to be special prosecutor in the case and allegedly benefited financially from the arrangement.
&#8220;This is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings,” Judge Trenton Brown <a href="https://www.politico.com/news/2024/12/19/fani-willis-is-disqualified-from-prosecuting-trump-election-case-appeals-court-rules-00195323" target="_blank" rel="noopener">wrote</a> in the ruling, which was made by a three-judge panel.
The ruling means Willis can&#8217;t lead the case against Trump in Georgia, but it&#8217;s uncertain how or if the case will continue when it&#8217;s kicked to another prosecutor.

Turley noted that Willis, while &#8220;attempting to bag Trump,&#8221; &#8220;created an absurdly attenuated RICO theory that should not be embraced by the new prosecutor.&#8221;

The professor added that Willis &#8220;spent copious amounts of time and money&#8221; clinging to the Trump case, while &#8220;most prosecutors&#8221; would view continuing it as &#8220;undermining her office and not serving the interests of the public.&#8221;

When Fulton County Superior Court Judge Scott McAffee left the door open for Willis to withdraw, she refused, Turley said, which forced the appeal that ultimately led to her demise &#8212; and possibly the case&#8217;s demise.

Fani Willis Disqualified From Trump Election Case. What Does That Mean For Trump?

Embattled Fulton County District Attorney Fani Willis has been ordered to hand over all records related to her communications with special counsel Jack Smith and the House January 6 Committee after a court granted a motion for default adjustment against her on Tuesday.
Willis is leading a controversial RICO case against now-President-elect Donald Trump and several of his top associates for alleged election interference, which is now on pause.
Fulton County Superior Court Judge Robert McBurney is giving Willis five business days to produce the material, Fox News <a href="https://www.foxnews.com/politics/fani-willis-ordered-give-watchdog-all-communications-special-counsel-jack-smith" target="_blank" rel="noopener">reported</a> Tuesday night. McBurney also said in his ruling that Willis violated Georgia&#8217;s open records act when she failed to respond to nonprofit Judicial Watch&#8217;s lawsuit about the communication.
Willis&#8217; office claimed in March that it did not have any documents on file or communications with Smith or the J6 Committee, Fox noted. However, the claim was untrue, and the office did have such communication.

Currently, it&#8217;s being worked through the courts to determine if Willis and her office can continue to prosecute the case. Wade has already been forced to resign from his position.

Wade billed the Fulton County office for hours of meetings with the White House, the congressional January 6 committee, and other D.C. officials, according to records obtained by the House Judiciary Committee.
On Monday the committee released a <a href="https://judiciary.house.gov/sites/evo-subsites/republicans-judiciary.house.gov/files/evo-media-document/2024-10-15%20Nathan%20Wade%20Deposition_Redacted_Errata.pdf">transcript</a> of an interview with Wade, which was compelled by subpoena, in which he said that Willis was preparing to prosecute Trump even before she took office, and that she put Wade on a “search committee” to find a prosecutor, which ultimately chose him for the job.
On May 23, 2022, Wade billed the Fulton office for eight hours of travel and “Conf with White House Counsel.” Wade said he could not remember who from the White House was involved, or even where the meeting took place. On November 18, 2022, he billed eight hours for “Interview with DC/White House,” but under oath claimed he didn’t remember the meeting and couldn’t even say whether it was online or in-person. Between September 7 and September 9, 2022, Wade billed $6,000 to taxpayers for “Witness Interviews; conf call DC; team meeting,” but couldn’t remember what the D.C. meeting entailed.

On April 25, 2023, he spent eight hours on “Zoom conf with investigators in other jurisdictions,” but could not remember anything about it. In all, Wade said he couldn’t remember details 58 times. Wade’s memory was famously faulty in Georgia court as witnesses tried to explain the timeline of Willis hiring her secret boyfriend without contradicting each other.
In the congressional interview, the evasive answers continued. Wade billed 24 hours in April 2022 for “Team meeting; conf with Jan 6th; research legal issues to prep [interview]” and eight hours on November 16, 2022 for “Jan 6 meeting and Atty conf.” Wade denied meeting with any January 6 Committee members or staff, but his questioners pointed out that that Politico had reported that &#8220;Willis&#8217; team met with committee staﬀ in Washington in April 2022. Some of Willis&#8217; top prosecutors attended, including Wade.&#8221; Wade then acknowledged meeting with “individuals associated with the January 6th Committee” — a Democrat-run House committee digging up dirt on Trump — several times, saying they were lawyers whose names he could not remember, and that he did not know who the lawyers’ client was.
In Georgia, where proceedings brought by a Trump co-defendant argued that the prosecution was corrupt, Wade provided written answers under oath saying he did not have a relationship with Willis during his marriage to another woman, before admitting on the witness stand that he did. Willis and Wade testified under oath that their relationship didn&#8217;t begin until 2022, after Willis hired him, but multiple witnesses contradicted that, and cell phone data showed they exchanged <a href="https://www.dailywire.com/news/cellphone-data-contradicts-nathan-wades-testimony-on-relationship-with-fani-willis-report" target="_blank" rel="noopener">12,000 texts</a> in 2021. The judge ultimately ruled that either Willis or Wade must be removed from the Trump prosecution to avoid misconduct, and Wade departed.
Wade’s congressional testimony highlights questions about whether Willis gave him a special prosecutor job knowing he lacked the relevant experience, in order to benefit him as a lover. Though he said the prosecution of a former president was &#8220;unlike anything that has ever happened in American history,&#8221; Wade acknowledged to Congress that he had never even worked for a district attorney&#8217;s office before.
He also said he had never worked on a case involving RICO before spearheading the one that used the law against a former president, so he took classes to learn how after taking the job. “It’s a very complicated legal concept, but the dubbed godfather of RICO, the gentleman who wrote the book… spent hours and hours teaching me RICO, if you will,” he said.
U.S. Marshalls attempting to serve Wade with a subpoena could not locate him for days. Wade claimed he had turned his phone off because he was preparing for a trial, and also because he was on pain medication from hurting his ankle playing basketball.
At the deposition, Wade was represented by two lawyers including former Georgia Gov. Roy Barnes (D). They lawyers said Wade might refuse to answer questions and suggested that there was nothing the House could do about it because contempt proceedings would take place in D.C., whose residents voted 93% against Trump:

Staff: Well, contempt in the House context.
Barnes: You can&#8217;t enforce anything. Do you have a jail?
Staff: We&#8217;re not going to put anyone in jail over this. I mean, the House does have inherent contempt &#8212;
Barnes: The only power you have is by criminal contempt, and you&#8217;re entitled to a jury trial on a criminal contempt.</blockquote>
Wade said that he would not discuss specifics of his prosecution in part because of death threats he said he had received.
<blockquote>A: I was concerned for my own safety to the extent to where I had to wear a bulletproof vest in public. I&#8217;m a licensed gun owner. I had to carry a weapon for my own protection. Somehow my license tag on my car got leaked, and then there were people following me.
Q: Is it possible for you to quantify the number of death threats that you&#8217;ve received, or is it a volume that&#8217;s so big that you couldn&#8217;t even keep track?
A: Oh, my God. I couldn&#8217;t even &#8212; I couldn&#8217;t begin to quantify it. I have no clue how many. A lot.</blockquote>
Willis&#8217;s father previously testified in court that after Willis was elected in the majority-black county, a racist mob gathered around her house at 5 a.m. and shouted the n-word, and someone else painted the n-word on Willis&#8217; home. Public records requests from The Daily Wire found <a href="https://www.dailywire.com/news/police-say-they-have-no-records-to-support-claim-that-mob-of-racist-whites-surrounded-fani-willis-home" target="_blank" rel="noopener">no records</a> to support that.
Wade declined to discuss with Congress how his relationship with Willis affected their work, saying &#8220;So now I&#8217;m getting confused because I didn&#8217;t &#8212; I didn&#8217;t think I was coming here to answer questions about my personal life.&#8221;

Bombshell House Report Reveals Trump Prosecutor Nathan Wade Met With White House

On Monday, the GOP-led House Judiciary Committee released an October 11 letter from Willis stating her office told Wade, who left the RICO case earlier this year after a romance between him and the DA was revealed, about certain restrictions it wanted to place on his closed-door testimony.
Willis wrote that Wade has been informed her office was asserting &#8220;all legal protections and privileges related to information that he possesses about ongoing criminal prosecutions&#8221; and he was &#8220;instructed not to answer any questions that seek to solicit information about his role or underlying evidence&#8221; in the 2020 case.
To Chairman Jim Jordan (R-OH), Willis said, &#8220;I am concerned that your demand for Mr. Wade&#8217;s testimony would force him to improperly divulge confidential information that is protected&#8221; by the DA&#8217;s office. She also raised concerns about Wade being pressed to violate State Bar of Georgia rules governing the conduct of attorneys.

In an odd twist last month, the judiciary panel said it asked the U.S. Marshals to help locate Wade after issuing him a subpoena following his failure to appear for a previously-scheduled hearing, according to <a href="https://www.11alive.com/article/news/special-reports/ga-trump-investigation/house-judiciary-committee-wants-nathan-wade-served-with-subpoena/85-f79c2c29-24a3-4c2a-a340-800fa35202cf" target="_blank" rel="noopener">local NBC affiliate 11Alive</a>. Ultimately Wade <a href="https://www.ajc.com/politics/nathan-wade-will-testify-before-the-us-house-judiciary-committee/5N5WUGXD5BFO3L2K2IDB7RNPVA/" target="_blank" rel="noopener">agreed</a> to appear for a hearing, which is set for Tuesday, while his lawyer <a href="https://www.fox5atlanta.com/news/former-fulton-county-prosecutor-nathan-wade-testify-before-house-judiciary-committee" target="_blank" rel="noopener">reportedly bemoaned</a> the &#8220;vitriol and anger&#8221; his client was facing.
The House Judiciary GOP account on X posted a copy of the October 11 letter it received from Willis, as well as one she sent to Wade with directions not to speak about his role in the 2020 election case. &#8220;FANI WILLIS demands NATHAN WADE not answer questions at his deposition tomorrow before the Judiciary Committee,&#8221; the account said. &#8220;What is she trying to hide?&#8221;
Willis and Jordan <a href="https://www.dailywire.com/news/fani-willis-responds-to-jordans-demand-for-docs-after-contempt-threat" target="_blank" rel="noopener">clashed</a> earlier this year over another subpoena from the judiciary panel demanding the district attorney provide records about the potential misuse of federal funds weeks before the worker was fired. Willis rejected suggestions of wrongdoing, but said she was cooperating.
Trump, who is running for the presidency again, has pleaded not guilty in the Georgia case. A challenge over the judge&#8217;s decision that allowed Willis to stay on the case when Wade stepped down helped assure a trial would not start before Election Day like the DA <a href="https://www.cnn.com/2024/03/21/politics/fani-willis-trump-georgia-trial/index.html" target="_blank" rel="noopener">reportedly</a> wanted. Some of the charges have been <a href="https://abcnews.go.com/Politics/georgia-judge-tosses-2-counts-donald-trump-election/story?id=113642911" target="_blank" rel="noopener">tossed</a> <a href="https://www.dailywire.com/news/6-charges-brought-by-fani-willis-against-trump-allies-dismissed" target="_blank" rel="noopener">out</a> at different junctures this year. The former president is also fighting charges in other cases.

Fani Willis Moves To Restrain Former Special Prosecutor’s Testimony Before Congress

A judge in <a href="https://www.dailywire.com/topic/georgia" target="_blank" rel="noopener">Georgia</a> dismissed two criminal charges against former President Donald Trump on Thursday, ruling that prosecutors did not have the authority to bring the charges.
Fulton County Judge Scott McAfee ruled that state prosecutors could not file the charges because a U.S. Supreme Court decision &#8220;preempts the State&#8217;s ability to prosecute perjury and false filings in a federal district court.&#8221;
The decision meant that &#8220;Counts 14, 15, and 27 must be quashed,&#8221; McAfee ruled.
Out of the three counts that were dismissed, two of them were against Trump, including Count 15, Conspiracy to commit filing false documents; and Count 27, Filing false documents.
Trump was not charged with Count 14, Criminal attempt to commit filing false documents, but others in the racketeering case were.
Trump has now defeated five of the original 13 charges he was hit with in District Attorney Fani Willis&#8217; controversial indictment from August 2023.

The other three charges that Trump has beaten includes: Count 5, Solicitation of violation of oath by public officer, Count 28, Solicitation of violation of oath by public officer; and Count 38, Solicitation of violation of oath by public officer.

Georgia Judge Dismisses Two Charges In Election Case Against Trump

The following is an edited transcript of a <a href="https://www.dailywire.com/podcasts/morning-wire/trump-s-new-legal-peril-jack-smith-s-latest-move-9-2-24" target="_blank" rel="noopener">special Labor Day edition of Morning Wire</a>. Daily Wire Editor-in-Chief John Bickley sat down with former federal prosecutor Andy McCarthy to discuss what comes next for Donald Trump in lawsuits filed by Democrat prosecutors.
The &#8220;lawfare&#8221; effort against Donald Trump is not dead yet, as Special Counsel Jack Smith files a revised indictment and multiple appeals loom. While Democrats still hope to take down the former president, Team Trump says they’re confident that the Supreme Court’s presidential immunity ruling has doomed the cases against him.

JOHN: Joining us now to discuss is former federal prosecutor Andy McCarthy. So we’ve had some new developments in the “lawfare” effort against Donald Trump. Special prosecutor Jack Smith has revised and refiled charges against Donald Trump for election interference. Can you tell us what exactly we’ve just witnessed?
ANDY: Well, I think what we&#8217;ve witnessed is probably, from a prosecutor&#8217;s standpoint, the cleanest and most efficient way to deal with the Supreme Court&#8217;s opinion in the immunity case. Remember that when The Court decided the immunity decision on July 1, which held that the president has absolute immunity for core executive actions and, at the very least, presumptive immunity for everything he does within the ambit of his executive power, The Court basically directed the lower Court, which would be Judge Tanya Chutkan in Washington, to do a searching examination of the allegations in the indictment to sort out what allegations are based on or implicate official acts of the presidency and which ones don&#8217;t. Long story short, Smith was supposed to, by this coming Friday, make his submission about what he thought the case would look like going forward. And I think he decided rather than make a submission on Friday, he would simply supersede the indictment on Tuesday. And what he&#8217;s done in superseding the indictment is take out some of the allegations that can&#8217;t stand after the Supreme Court opinion. I should be clear, he hasn&#8217;t taken out any counts, like he hasn&#8217;t taken out any charges, but there are certain aspects of the evidence that can&#8217;t withstand the Supreme Court&#8217;s opinion and had to go, so he pared them down.
JOHN: And that&#8217;s because it relied on evidence connected to Trump&#8217;s official duties, is that correct?
ANDY: Not just his official duties, but his duties at the core of his article to constitutional executive power. What Chief justice Roberts said in the majority opinion was that that — Trump&#8217;s control over his subordinates in the executive branch exercising law enforcement authority, which is a plenary power of the executive branch — is something that Trump has absolute immunity for. So those allegations had to come out of the indictment.

JOHN: So where does that leave things now? What are the next steps for this case?
ANDY: The first thing that everybody is most concerned about, and I think rightly so, is — what&#8217;s the impact on the election? We&#8217;re seven weeks from the election where we&#8217;re going to have a new president on January 25. So I think this is really a big nothing. Because what people need to retain as they think about this is that the first thing that Judge Chutkan has to do, no matter when it&#8217;s done, is examine the superseding indictment to determine which allegations get immunity in which don&#8217;t. Whatever she decides about that. Immunity is one of the few issues in federal criminal law that a defendant is allowed to appeal pretrial. So whatever she decides, even if she leans in Jack Smith&#8217;s direction, Trump is going to be able to appeal that to the D.C. Circuit and then ultimately to the Supreme Court. So that issue has to be decided first, and then there are a slew of other issues that would have to be litigated before this case could get anywhere near being able to go to trial. So there&#8217;s no way that happens between now and the end of next January. So then we come to what happens after we have a new president. Obviously, if Trump wins the presidency, I imagine if he gets sworn in at 12:00, by 12:01 Jack Smith will be fired. And they&#8217;ll try at that point to dismiss the case. There may be some complications with that we can talk about. Obviously, it&#8217;s one approach if Trump wins, namely the case goes away or he does his best to make it go away. And then the other question is what happens if Harris wins? You would think, and I think this is probably right, that Harris will just retain Jack Smith and let him carry on and then, however long it takes to try the case or litigate these pre-trial issues, and then ultimately have a trial. He&#8217;ll be able to be back in business doing that. The alternative, which I think would be very sensible – but it would shock me, unfortunately, if Harris did that – would be for Harris to say, “Look this lawfare campaign has run its course. It hasn&#8217;t been good for the country. I&#8217;m supposed to be the candidate who&#8217;s making a pre-clean break from the past…” to the extent that she has appeal. It&#8217;s because she&#8217;s not Trump, she&#8217;s not Biden. And it would be a smart thing, I think, for her to say, “We&#8217;ve looked at the Supreme Court&#8217;s immunity decision, and it&#8217;s a very good decision for the executive branch. We don&#8217;t want to continue with a litigation against a 78-year-old former president that has the potential of cutting back on the executive branch&#8217;s immunity interests.” And if I were her, I would drop the case on that, for that reason — because let&#8217;s face it, the Democrats only ever brought this in order to have an impact on the election. Once the election&#8217;s over, does she really want this headache?

JOHN: I can imagine the blowback from her own party if she did something like that being very severe. Now the picture you&#8217;ve painted here is that there will be immediate appeals from Trump&#8217;s team. If it is allowed to move forward, the appeals process, does this end up in the hands of the Supreme Court again?
ANDY: Yeah, it&#8217;ll end up in the hands of the Supreme Court again. And I think a second issue will end up in the hands of the Supreme Court, which is the question of whether, Jack Smith has been properly appointed under the Constitution. So that&#8217;s another, issue that&#8217;s out there that&#8217;ll have to be resolved pre trial. And I, I think it&#8217;s important to make our listeners understand there&#8217;s a difference between, obviously, immunity and guilt. If the courts were to rule against Trump on at least some of the allegations in Smith&#8217;s indictment, that is to say that those allegations are based on private conduct, not official acts, and the indictment can go forward as a prosecution, that wouldn&#8217;t mean that Trump is guilty. He still has a lot of arguments to make, with respect to the legal validity of the charges that have been filed. And even if that, even if he prevails there, you still have to go to trial and Smith still has to prove the case beyond a reasonable doubt, including proving. Trump&#8217;s intent to commit fraud, which is, it may be harder to do than, than the prosecutor seems to think. So there&#8217;s a lot of rounds to be played here yet.
JOHN: You brought up a key issue, which is whether or not Special Counsel Jack Smith was actually appropriately appointed. Where does that stand now — and where do you see that going?
ANDY: Yeah. Well, it&#8217;s very interesting. So, the Florida case, the Mar-a-Lago documents case, was dismissed by Judge Aileen Cannon in what I thought was a scholarly 93 page opinion. No matter whether you agree with her bottom line or not, it&#8217;s clear that she worked very hard on it and took it very seriously and did I&#8217;d say better than workman-like job on the opinion. But she has found that Smith was not qualified to be special counsel because to be, to wield the kind of power a special counsel has you have to have one of two conditions: Either you have to be appointed by the President and confirmed by the Senate, which Smith was not, or you have to have a position that&#8217;s created by an act of Congress, a statute. Smith, instead, was appointed under Justice Department rules and regulations that were promulgated during the Clinton administration. He also claims that there are a slew of congressional statutes that uphold his appointment but when you parse them carefully, I really don&#8217;t think they do. More important than what I think, Justice Clarence Thomas, in his concurring opinion in the recent immunity case, raised this very issue and went through those statutes and clearly doesn&#8217;t think that Smith is properly appointed. So, instead of doing what I think he should have done — this is Attorney General Garland — which is simply shift Smith, transfer him so that he&#8217;s under the supervision of the Biden appointed U.S. Attorney in South Florida. Then you make this whole issue under the appointments clause of the constitution go away and you could be up and running with that case again in five minutes. Rather than doing that, what he&#8217;s decided to do is appeal to the 11th Circuit, which I think is a peculiar choice because I think there&#8217;s a very good chance they&#8217;re going to lose in the 11th Circuit. In the meantime, the same issue is going to be raised in the Washington case in front of Judge Chutkan. I think in that case, she&#8217;s going to uphold Smith&#8217;s appointment because, regardless of whether she thinks Judge Cannon was right or wrong, Judge Cannon&#8217;s decision does not bind Judge Chutkan. Chutkan has to follow the law of the D.C. Circuit, and a few years back, the D.C. Circuit upheld a challenge on similar grounds to the status of Special Counsel Robert Mueller in connection with the Russia investigation. So, she&#8217;s going to uphold Smith&#8217;s appointment. I think the 11th Circuit, and I think the D.C. Circuit will uphold it as well, I think the 11th Circuit will agree with Judge Cannon that Smith is improperly appointed, which means that will land in the Supreme Court&#8217;s lap too, because when you have a dispute, In the circuits over,  an issue of this importance, the Supreme Court ultimately has to decide it.

JOHN: Sounds like a big mess, and two conflicting, sort of paradoxical moments there. To put a button on the lawfare campaigns against Trump, we&#8217;ve got the Atlanta case, we&#8217;ve also got the hush money case that&#8217;s being appealed. Just in sort of summary fashion, where do we stand with those two cases?
ANDY: Well, the Atlanta case is a clown show. I mean, at the moment it&#8217;s in complete suspense because you&#8217;ll also have immunity litigation in that connection. But before you can even get to that, there&#8217;s a big litigation under state law regarding whether Fani Willis, the prosecutor, has to be disqualified from the case. The lower Court has already disqualified the prosecutor-boyfriend that was involved in the case. And that decision, I don&#8217;t think made a lot of sense because it seemed to me that you could make an argument that both of them should go or neither of them should go, but having one go and the other stay doesn&#8217;t make much sense to me. So the Georgia Court, the Appellate Court, is going to hear arguments in that case, but not until December. So we&#8217;re a long way even from deciding the disqualification issue, and then they&#8217;ll have to figure out all the immunity stuff. So I think that case isn&#8217;t going anywhere. And if Willis ultimately gets removed, it could get transferred to another prosecutor who decides to drop the whole thing, which would be the best outcome, I think. As far as the Manhattan case, Trump is scheduled to be sentenced on September 18 on the 34 counts on which he was convicted at trial during the spring. But that case has now been complicated by the immunity issue as well, because I think, quite recklessly, the prosecutors introduced during the trial evidence of Trump&#8217;s official acts. I think it was foolish of them to do that because they didn&#8217;t need that evidence to prove the charges in the case but they did it anyway, even though they knew the Supreme Court was considering this very issue. So the problem they have is that they have this evidence in the case and the Supreme Court has said that the immunity evidence shouldn&#8217;t have come into the case. Trump did object. So right now the schedule is Judge Juan Merchan is supposed to decide the immunity issue on his schedule on September 16 and then Trump is supposed to get sentenced September 18. But the problem Merchan has is Trump has a right to appeal the immunity ruling. So even if Merchan rules against him as everyone expects, he should be able to appeal that to the Appellate Courts in New York and ultimately to the Supreme Court. And even the District Attorney Alvin Bragg has conceded that Trump has appellate rights and therefore has suggested or agreed with Trump that the sentencing should be postponed. As we are speaking today, Judge Merchan has not yet postponed the sentence, but I think he really is going to have to.

One of the benefits of our whole federal system, at least in theory, is that it provides some insulation from bad government. If your state is being run into the ground by incompetent politicians, then you can just move to another state. And if a local politician is doing a terrible job, then at least he&#8217;s not wrecking the rest of the country. The damage is contained. 
That&#8217;s the idea, anyway. And there are about a million reasons why that&#8217;s not true anymore. Exhibit A is the series of ongoing and deeply embarrassing disasters that are unfolding at the moment in Atlanta, Georgia and its surrounding metro area. There&#8217;s no other way to say this: Because the principles of federalism are no longer really operative, Atlanta&#8217;s dysfunction poses a direct threat to the entire country. You can&#8217;t get away from it simply by fleeing the state of Georgia. It&#8217;s all encompassing.
We&#8217;re now all very familiar with the catastrophe that is Fulton County, Georgia&#8217;s attempt to prosecute Donald Trump on RICO charges. The lead prosecutor, Fani Willis, saw the trial as an opportunity to promote her boyfriend and shower him with taxpayer money, then she apparently lied about it to the court. She also tried to play the sassy woman when she testified about this conflict of interest, which somehow managed to lower public confidence in her office even further. That&#8217;s all well-documented.
On top of that, just this week, former Georgia Senator Kelly Loeffler asked why Fulton County officials are reportedly attempting to <a href="https://x.com/KLoeffler/status/1806059124477632788" target="_blank" rel="noopener">destroy</a> 2020 election ballots before they can be inspected. This comes after the Georgia Election Board <a href="https://georgiarecorder.com/2024/05/07/georgia-oversight-panel-ruminates-on-2020-election-hiccups-as-2024-showdowns-loom/" target="_blank" rel="noopener">voted</a> to reprimand Fulton County — and appoint an independent poll monitor for the upcoming election — because of irregularities in the way the county counted ballots in 2020. 
That decision came after testimony like this, where it emerged that hundreds of thousands of &#8220;ballot images&#8221; are apparently missing in Georgia:

Again, this might be mildly amusing if the impact of all this incompetence were confined to Georgia. But it&#8217;s not. Counting ballots affects national politics. Jailing a presidential candidate affects national politics. So the infestation of incompetent morons in the government of the state of Georgia is, unfortunately, a concern of everyone living in this country. Somehow, the most inept people imaginable are running things in Georgia. It&#8217;s important to figure out how exactly that happened, so we can stop it from getting even worse, if that&#8217;s even possible at this point.
That brings me to the very curious case of a woman who — until recently — was the <a href="https://www.fox5atlanta.com/news/rookie-probate-judge-could-make-be-highest-paid-judge-in-douglas-co" target="_blank" rel="noopener">highest paid</a> judge in Douglas County: a Democrat by the name of Christina Peterson. Peterson was making somewhere north of $100,000 a year, according to some reports. She became a probate judge in Douglas County, which is right next to Fulton County, back in 2020 after winning a contested primary and running unopposed in a general election. To be clear, Peterson wasn&#8217;t handling the most high-stakes cases in Atlanta. She dealt with things like marriage licenses.
But even so — you&#8217;d hope that a relatively highly paid judge in a metro area like Atlanta would be well-qualified, professional, and competent. At the very least, you might think she&#8217;d have some capacity to control herself in public. But last week, it became clear to everyone that Peterson lacks every single one of those characteristics. She apparently got into a fight outside a nightclub and hit a police officer, and it was all recorded on the officer&#8217;s body camera. Watch:

Try to imagine arriving here in a time machine from 30 years ago and watching that video. You would assume that the woman in the video is an unemployed welfare recipient. When you found out that this is the kind of person who becomes a judge in the year 2024, you would be shocked. And then you’d get back in your time machine, go back to your own time, and do everything in your power to warn the public about the cursed future you’re heading into. But nobody would believe you. The sad reality is that voters in Douglas County picked this candidate as the best one in a competitive primary. And then, throughout her several years in office, no one decided she was unqualified in any way. 
That all finally changed this week, when the Supreme Court of Georgia removed Christina Peterson from the bench. But they didn&#8217;t remove her because she hit a police officer in that body camera footage. They removed her because of more than four dozen ethics complaints that, in the words of the court, demonstrated her &#8220;flagrant disregard for the law, court rules, and judicial conduct rules.” 
And this is quite a rap sheet we&#8217;re talking about here. The most egregious incident took place in August 2021. I&#8217;m going to describe it in some detail, because it&#8217;s actually hard to believe that such a low-level judge would engage in such obvious, flagrant misconduct. And the fact that this woman did engage in this conduct — and held onto her job for several years — tells us a lot about how the &#8220;justice system&#8221; works in Atlanta, and nationwide.

According to the Georgia Supreme Court, a naturalized U.S. citizen who was born in Thailand filed a petition to amend her marriage-license application. She wanted to correct the name she had listed as her father&#8217;s name on the form. Basically, five years earlier, she had originally listed her uncle&#8217;s name because her father wasn&#8217;t involved in her life at the time. And now she wanted to fix that, because &#8220;she was completing emigration documents for her mother and believed she should correct the application so that it would not be inconsistent with her birth certificate.&#8221; To support this application, this petitioner &#8220;attached a copy of her birth certificate, which had been translated from Thai into English.&#8221; There was even a note on the copy that it was a translation, as opposed to an official document.
Hearing all of this, you might conclude that this is not exactly the court case of the century. But in response to this filing, Christina Peterson went to war. She wasn&#8217;t going to let this marriage-license application (from five years ago) get amended without a fight. So she summoned this woman to her court. She didn&#8217;t advise her of her right to have a lawyer or anything. She just demanded that this woman show up. And when the woman showed up, Christina Peterson told her that the copy of the birth certificate was, “fictitious,” “fraudulent,” and “forged.&#8221; She declared that the petitioner was in &#8220;blatant disregard for the laws of the State of Georgia&#8221; and sentenced her to the maximum possible punishment for contempt — 20 days in jail. This is a criminal offense. But, in the alternative, the judge allowed this petitioner the option of serving two days in jail and paying a $500 fine. That&#8217;s ultimately what the woman had to do. She couldn&#8217;t alert her children or arrange childcare services or anything. She just went straight to jail.
Anyway, the ethics panel in Georgia looked into this. They concluded that nothing Christina Peterson did made any sense. They said that the judge “predetermined” that the petitioner committed criminal contempt; &#8220;issued the notice of the hearing without informing the petitioner that the criminal contempt matter would be adjudicated; ambushed the petitioner at the hearing by alleging that she had committed a crime; summarily found the petitioner guilty and sentenced her; and then lied about her actions in her testimony before the Panel.&#8221;
There are a bunch of other violations in addition to this one. For instance, the panel found that the judge let a wedding party into the courthouse &#8220;without ensuring that the party underwent security screening by sheriff&#8217;s deputies.&#8221; And then she tried to cover it up. According to the Georgia Supreme Court, she, &#8220;falsely testified that after the division commander [of the courthouse] told her not to take the wedding party into the courthouse, the sheriff overrode that directive and granted her permission to enter the courthouse to perform the wedding ceremony.&#8221;
There was another incident in which a sheriff&#8217;s deputy who was supposed to escort the judge to the courtroom in May of 2021 didn&#8217;t get there on time. So the judge &#8220;pushed the panic button under her desk,&#8221; which is reserved for emergencies. Then the police swarmed into her office and she pretended to not understand what the panic button was for. And there are dozens of other instances like this. 
They&#8217;re all comical examples of the most petty corruption imaginable — seemingly just for the sake of being petty and corrupt. It&#8217;s not even clear how this judge would personally gain from any of these abuses of power. Even the smallest amount of power can go to a person’s head, after all. I once worked for an assistant manager at a pizza restaurant whose 16 dollar an hour management position had turned him into a power mad tyrant. And now we have a lot of those kinds of people wearing judges robes, working in congress, etc.
This whole story tells us something about how easy it is for useless and corrupt halfwits to infest local governments — which matters for the rest of the country, as I outlined earlier. And incidents like this aren&#8217;t confined to Georgia. 
A couple of years ago in Ohio, a judge named Tracie Hunter had to be dragged out of court after her conviction on corruption charges was upheld. Watch:

Tracie Hunter was another elected judge. In fact, she was the first woman judge *and* the first black judge ever to serve on Hamilton County&#8217;s Juvenile Court. She broke two glass ceilings at once, only to end up like this. 
But don&#8217;t get too sentimental, because there&#8217;s a lot more where that came from. In fact, just this week, there was another unceremonious fall for yet another pathbreaking black civil servant. I&#8217;m talking of course about Jamaal Bowman, who famously pretended not to understand how fire alarms work so that he could delay a House vote. Bowman just lost his primary, as you might have heard. According to Alexandria Ocasio-Cortez, who wrote a <a href="https://x.com/AOC/status/1805996713053696331">teary-eyed tweet</a> to mark the occasion, Bowman was, &#8220;Elected as the 1st Black Congressman for NY-16.&#8221;
Now, that&#8217;s not true, as it turns out. New York&#8217;s 16th Congressional District has had several other black representatives in its history. But more to the point, this was how Bowman and AOC tried to turn out the vote at a rally just before Bowman&#8217;s election defeat. This was a rally that wasn&#8217;t even in his district, by the way. Watch:

Watching that, you can understand why the school that Bowman &#8220;led&#8221; for a decade is doing about as well as LeBron James&#8217; school. They have reading and math proficiency scores hovering below 30%. In any event, AOC and Bowman are prancing around like they see themselves as superstars. And fortunately for them, those videos are shot at a pretty close angle. But if you take a few steps back, this is what the rally actually looked like:

No one&#8217;s even there. It&#8217;s a completely dead rally. And indeed, the reason no one was there is that Jamaal Bowman is very unpopular. But somehow, instead of making any effort to win over voters, both Bowman and AOC decided that the best course of action was just to run around on stage and scream.
At the local level, all over the country, we are ruled by people like this. These are people who make a mockery out of politics and the judicial system. They have no regard for any of it. They don&#8217;t even realize how absurd they look to everyone else because they&#8217;re not capable of shame. And yet somehow, at one point or another, all of these people I&#8217;ve mentioned managed to win competitive elections. And they&#8217;ve parlayed those wins, in some cases, into national influence. That&#8217;s why fleeing their jurisdictions isn&#8217;t enough anymore. Instead we must mock them at every opportunity and point out their corruption whenever possible. That worked, to an extent, with Jamaal Bowman. Now there&#8217;s a lot more imbeciles who need to meet the same fate.

Fulton County, Georgia, District Attorney Fani Willis is upset with people mispronouncing her name, claiming that &#8220;idiots&#8221; purposefully call her &#8220;fanny&#8221; because it &#8220;reminds them of a woman&#8217;s rear.&#8221; Willis&#8217; first name is pronounced &#8220;FAH&#8217;-nee.&#8221;
The Democratic DA, who has charged former President Donald Trump with RICO crimes, spoke to a crowd of supporters on Thursday at a black church outside of Atlanta and tied the mispronunciation of her name to attacks on black women, whom she says are &#8220;oversexualized,&#8221; POLITICO <a href="https://www.politico.com/news/2024/06/13/fani-willis-calls-out-critics-00163326" target="_blank" rel="noopener">reported</a>.
“I live the experience of a black woman who is attacked and oversexualized,” Willis said. “See, I’m so tired of hearing these idiots call my name as ‘fanny’ in a way to attempt to humiliate me because, like silly school boys, the name reminds them of a woman’s rear, of her behind.”

Willis has been scrutinized for allegedly showing favoritism to her former lover Nathan Wade, whom she appointed as special prosecutor in her Trump election interference case. Judge Scott McAfee said the district attorney acted with a “tremendous lapse in judgment,” and he found an appearance of “impropriety,” but added that the defendants had “failed to meet their burden” of proving a conflict of interest based on Willis and Wade’s romantic relationship.

Wade resigned as special prosecutor after the judge ruled that either he or Willis had to leave the case against Trump. A Georgia appellate court is set to hear a challenge to McAfee&#8217;s ruling that allowed Willis to continue on the case. Willis has maintained strong support from Democrat voters as she <a href="https://www.dailywire.com/news/fani-willis-easily-wins-democratic-primary-election" target="_blank" rel="noopener">cruised</a> to a victory in the primary election last month, taking 87% of the vote.

Former Donald Trump prosecutor Nathan Wade got up and left a live interview with CNN this week when he was asked about when his relationship began with Fulton County District Attorney <a href="https://www.dailywire.com/topic/fani-willis" target="_blank" rel="noopener">Fani Willis</a>.
Wade resigned from his position in the Georgia election interference case against former President Donald Trump back in March after it was revealed that he and Willis were engaged in a relationship.
His resignation came after Judge Scott McAfee ruled that either Wade or Willis had to exit the case for the prosecution to continue. Willis faced possible disqualification from her case against Trump over allegations that she had misused taxpayer dollars and showed favoritism to Wade.
When asked by CNN&#8217;s Kaitlan Collins what his relationship is currently like with Willis, Wade responded: &#8220;Just as outlined earlier, we are great friends. We speak regularly. The conversation has changed, though. Whereas before, we were &#8212; our conversations were about this case, you can &#8212; I&#8217;m sure you can imagine and appreciate the amount of time that it takes that you have to pour into a case trying &#8212; a case of this magnitude, trying to prosecute those defendants. But our conversations have shifted to, &#8216;How are you? How are you handling the threats that are coming your way? Are you being safe?&#8217; And democracy will &#8212; the case will live on kind of thing.&#8221;
Collins then asked him to clarify when his &#8220;romantic relationship&#8221; started with Willis.
&#8220;Yes, so we get into &#8212; there&#8217;s been this effort to say that, OK, these exact dates are at issue and these exact dates are &#8212; I&#8217;m getting &#8212; I&#8217;m getting signaled here,&#8221; he said.
Wade&#8217;s team came over and took the microphone off of him and huddled him in the corner of the room and spoke to him for some time before he came back and finished the interview.
