The <a href="https://www.dailywire.com/topic/environmental-protection-agency-epa" target="_blank" rel="noopener">Environmental Protection Agency (EPA)</a> failed to suitably report billions of dollars in fiscal 2022 spending, the agency&#8217;s inspector general determined, prompting condemnation from GOP lawmakers.
A report <a href="https://www.epaoig.gov/sites/default/files/reports/2024-01/epaoig_20240109-24-p-0014_cert.pdf" target="_blank" rel="noopener">released</a> last week by the independent watchdog said the agency&#8217;s initial reporting to USAspending.gov — the federal government’s &#8220;official public source&#8221; of spending information — was &#8220;not complete or accurate&#8221; because the EPA’s Office of the Chief Financial Officer (OCFO) &#8220;did not follow its information technology configuration management procedures.&#8221;
&#8220;Consequently, necessary changes to the OCFO’s DATA Act Evaluation and Approval Repository, the system that facilitates the Agency’s USAspending.gov reporting, were either unimplemented or incorrectly implemented, and these issues were not identified via configuration audits,&#8221; the report said. &#8220;Additionally, the OCFO lacked procedures to detect errors and to confirm the completeness and accuracy of the data that it reported to USAspending.gov.&#8221;
The inspector general&#8217;s team found award-level obligations — or <a href="https://crsreports.congress.gov/product/pdf/R/R44027" target="_blank" rel="noopener">spending commitments</a> — were underreported by $1.2 billion and award-level outlays — or <a href="https://crsreports.congress.gov/product/pdf/R/R44027" target="_blank" rel="noopener">money actually paid</a> — were underreported by $5.8 billion, meaning that 12.9% of the EPA’s total award-level obligations and 99.9% of the EPA’s total award-level outlays were not reported in fiscal 2022.
Also noted by the watchdog was that the EPA also did not report &#8220;any&#8221; of its Infrastructure Investment and Jobs Act outlays and underreported its COVID pandemic-related outlays.
&#8220;The lack of complete and accurate reporting also led to taxpayers being initially misinformed about the EPA’s spending, and policy-makers who relied on the data may not have been able to effectively track federal spending,&#8221; the report said.
Rep. Cathy McMorris Rodgers (R-WA), who is chairwoman of the House Energy and Commerce Committee, criticized the EPA <a href="https://energycommerce.house.gov/posts/chair-rodgers-epa-s-failure-to-report-7-billion-in-spending-is-another-failure-of-leadership" target="_blank" rel="noopener">in response</a> to the inspector general&#8217;s findings.
“It’s outrageous and unacceptable that the EPA cannot keep track of its spending or inform Congress — and the American people — of how it is using taxpayer dollars. This eye-opening report only further highlights the need for more transparency at the EPA,&#8221; McMorris Rodgers said.
&#8220;It also raises questions about whether the agency is incapable of managing its record-high budget or if the agency is attempting to hide the amount of taxpayer dollars it is spending to advance the administration’s radical rush-to-green agenda,&#8221; she added. &#8220;The Energy and Commerce Committee will continue holding this administration accountable for its actions that are driving up costs across the board and hurting Americans.”
Among the other GOP lawmakers who chided the EPA were Rep. John Joyce (R-PA), who <a href="https://twitter.com/RepJohnJoyce/status/1745581015270068578" target="_blank" rel="noopener">said on X</a>, &#8220;This jarring report is the clearest sign yet that the EPA is unable and unwilling to adequately serve the American people,&#8221; and Rep. Lauren Boehbert (R-CO), <a href="https://twitter.com/RepBoebert/status/1745900056425734622" target="_blank" rel="noopener">who said</a>, &#8220;This is completely unacceptable.&#8221;

As a result of the audit, the inspector general&#8217;s team made a number of recommendations to the EPA for improving its USAspending.gov reporting process. The watchdog said the EPA &#8220;agreed with&#8221; all the suggestions and provided &#8220;acceptable corrective actions&#8221; along with estimated dates for completing those tasks.
&#8220;EPA welcomes and appreciates the Office of the Inspector General’s oversight and recommendations,&#8221; an EPA spokesperson <a href="https://www.foxnews.com/politics/bidens-epa-lost-track-billions-dollars-taxpayer-funds-inspector-general?intcmp=tw_pols" target="_blank" rel="noopener">told Fox News</a>. &#8220;EPA properly accounted for FY 2022 funding, which is validated by [the inspector general&#8217;s fiscal] 2022 clean unmodified audit opinion of EPA’s financial statements. This was an issue transmitting data to USASpending.gov, which has been corrected.&#8221;

The Environmental Protection Agency (EPA) confirmed in a statement to The Daily Wire that it is actively investigating Colony Ridge, the massive housing development northeast of Houston that’s become a magnet for illegal immigrants.
The exact nature of the investigation and the potential violations that the federal agency is looking into remain unclear, with the EPA only confirming that it is actively investigating the sprawling land development.
“Due to the active nature of this investigation, the EPA would be unable to provide a comment,” Joe Robledo, an EPA Press Officer for Region 6, which includes Texas and other neighboring states, told The Daily Wire.
The EPA investigation comes on the heels of a <a href="https://www.dailywire.com/news/biden-doj-sues-colony-ridge-for-bait-and-switch-sales-predatory-financing">lawsuit</a> from the Department of Justice (DOJ) and the Consumer Financial Protection Bureau (CFPB) alleging that Colony Ridge engaged in predatory financing practices and bait-and-switch sales.
In addition to the investigation from the EPA and the lawsuit from the DOJ and the CFPB, the New York Post <a href="https://nypost.com/2023/12/29/news/feds-sue-illegal-immigrant-magnet-colony-ridge-developers/">reported</a> that the embattled development is also under investigation by the Internal Revenue Service, the Army Corps of Engineers, and the Texas Commission on Environmental Quality.
The flurry of investigations comes in the wake of two special legislative session calls from Texas Governor Greg Abbott, who called on lawmakers to introduce legislation concerning the development after an <a href="https://www.dailywire.com/news/inside-colony-ridge-the-fastest-growing-development-in-the-u-s-is-a-magnet-for-illegal-immigrants">investigative report</a> from The Daily Wire.

While it is unclear what exactly the EPA investigation pertains to, Colony Ridge, which is estimated to be home to anywhere from 40,000 to 75,000 people, has come under criticism for its water management practices, with one local researcher alleging that the embattled development flouted a wide range of regulations.
Bob Rehak, who writes at <a href="https://reduceflooding.com/">Reduce Flooding</a>, alleged that the development <a href="https://reduceflooding.com/2020/12/10/rivers-of-mud-largest-development-in-liberty-county-openly-flaunts-drainage-regulations/">flouted drainage regulations</a> and did not have nearly enough <a href="https://reduceflooding.com/2023/08/30/as-wildfire-weather-sets-in-fastest-growing-area-in-liberty-county-fails-to-meet-fire-code-requirements/">fire hydrants</a>, with several blocks of the neighborhood having none at all.
Rehak, who has <a href="https://reduceflooding.com/2023/09/20/history-of-heartbreak-a-colony-ridge-chronicle/">extensively documented</a> environmental concerns at the development, also asserted that the water and sewage manager for Colony Ridge dumped <a href="https://reduceflooding.com/2020/06/23/48000-gallons-of-fecal-contamination-found-in-liberty-countys-colony-ridge-ditches-streams-problems-persist/">48,000 gallons</a> of fecal-contaminated water into streams that have the potential to flow into Lake Houston, the <a href="https://www.h-gac.com/getmedia/e90f8870-c9a8-43c0-ada2-81845382d004/watersheds_lake_houston.pdf">primary source of drinking water</a> for Houston, America’s fourth most populous city.
The Texas Commission on Environmental Quality later <a href="https://reduceflooding.com/2020/10/04/tceq-fines-quadvest-for-48000-gallon-sewage-spill-in-colony-ridge/">fined Quadvest</a>, the company serving Colony Ridge, over the dumping of contaminated water.
Meanwhile, the DOJ and CFPB lawsuit also alleges that Colony Ridge took advantage of language barriers to sell unsuspecting customers property that lacked proper electrical and water infrastructure, and that was even located on flood-prone land.
Portions of Colony Ridge even experienced <a href="https://reduceflooding.com/2023/10/07/colony-ridge-karma-area-floods-while-developer-hosts-lawmakers/">flooding</a> as developer William “Trey” Harris hosted lawmakers in an attempt to rehabilitate the company’s image as it faced severe criticism from lawmakers.
Abbott, who received a combined $1.5 million from Colony Ridge developer William “Trey” Harris and his wife, recently signed legislation <a href="https://www.texastribune.org/2023/12/18/texas-governor-abbott-bills-border-wall-illegal-entry-crime-sb3-sb4/">allocating $40 million</a> to the Department of Public Safety to patrol the development.

Environmental Protection Agency Confirms Active Investigation Into Colony Ridge

The <a href="https://www.dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Biden administration</a> is allocating $600 million toward “environmental justice” projects across the U.S. in a move critics say will benefit the president’s political allies. 
According to the Environmental Protection Agency (EPA), the money will be given to grantmakers who will then oversee the distribution of the funds. The EPA <a href="https://www.epa.gov/newsreleases/biden-harris-administration-announces-600m-11-grantmakers-fund-thousands-environmental" target="_blank" rel="noopener">said</a> projects might include programs aimed at “reducing greenhouse gas emissions” and “environmental workforce development.” 
“For too long, however, low-income communities, immigrant communities, Native communities, and communities of color have endured disproportionate levels of air, water, and soil pollution. That is why President Joe Biden and I have put equity at the center of our nation’s largest investment in climate in history,” Vice President Kamala Harris said in a statement. 
Daniel Turner, the founder and executive director of energy worker advocacy organization Power the Future, criticized the announcement, saying that the money was being used for political purposes. 
“It’s Bidenomics by a different name: using a green slush fund to dole out Christmas gifts to his political friends ahead of 2024,” Turner said. “No matter if they are dubbed grantmakers or climate corps, the mission is the same: use taxpayer dollars to build networks of political support. And while Biden sends $600 million to his eco-friends, energy workers are stalled by Washington while families pay more for everything.”

The EPA-designated grantmakers include a number of different activist groups including the Climate Justice Alliance and Social and Environmental Entrepreneurs (SEE).
The Climate Justice Alliance has a “Free Palestine” section on its <a href="https://climatejusticealliance.org/palestine/" target="_blank" rel="noopener">website</a> because the group says that it wants to “mobilize additional sectors of the climate movement for the fight to free Palestine, and to begin to shift the politics of the mainstream climate movement from carbon fundamentalism to climate justice.”
The organization has also <a href="https://climatejusticealliance.org/stopcopcity/" target="_blank" rel="noopener">campaigned</a> against the construction of a police training facility in Atlanta, saying stopping the construction of <a href="https://www.dailywire.com/news/atlanta-activists-linked-to-fiery-police-protests-charged-with-fraud-money-laundering-police" target="_blank" rel="noopener">“Cop City”</a> was crucial to “the abolition and climate justice movements.”
One of the projects of SEE, an organization based in California, is to reduce the prison population of Kansas City through the “reimagining of public safety.” 
“We are a multiracial, multigenerational organization that centers those impacted by incarceration and policing in order to end the reliance on incarceration and policing and build a safer Kansas City for all,” the organization <a href="https://saveourplanet.org/projects/decarcerate-kc/" target="_blank" rel="noopener">says</a>.

The <a href="https://www.dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Biden administration</a> announced new rules for the oil and gas industry Saturday, requiring it to cut methane emissions by nearly 80% through 2038.
The U.S. committed to the new regulations on the oil and gas industry during the Climate Change Conference (COP28) in Dubai where Vice President Kamala Harris also announced that the U.S. would <a href="https://www.dailywire.com/news/white-house-announces-3-billion-for-green-projects-overseas-including-nearly-500m-for-gender-equity" target="_blank" rel="noopener">spend $3 billion</a> in taxpayer dollars as a pledge to climate and “gender equity” funds.
EPA Administrator Michael Regan and White House National Climate Adviser Ali Zaidi were also in Dubai to announce the new crackdown on methane emissions, saying the rule will help the Biden administration make the “progress we need to make.”
“From mobilizing billions in investment to plug orphaned wells, patch leaky pipes, and reclaim abandoned mines to setting strong standards that will cut pollution from the oil and gas sector, the Biden-Harris Administration is putting the full weight of the federal government into slashing harmful methane pollution,” Zaidi said in a <a href="https://www.epa.gov/newsreleases/biden-harris-administration-finalizes-standards-slash-methane-pollution-combat-climate#:~:text=%E2%80%9CFrom%20mobilizing%20billions%20in%20investment,government%20into%20slashing%20harmful%20methane" target="_blank" rel="noopener">statement</a>.
Under the new rule, the Environmental Protection Agency (EPA) will require oil and gas companies to end routine flaring of natural gas and capture gas instead of burning it, according to <a href="https://www.cnn.com/2023/12/02/climate/cop28-methane-announcement-climate/index.html" target="_blank" rel="noopener">CNN</a>. Flaring is the conventional method oil and gas companies have <a href="https://www.worldbank.org/en/programs/gasflaringreduction/gas-flaring-explained" target="_blank" rel="noopener">used</a> for controlled burning of natural gas since the beginning of oil production around 160 years ago.
The American Petroleum Institute (API) said it supports regulation of methane emissions, but asked the EPA to modify its current plan, <a href="https://www.api.org/news-policy-and-issues/news/2023/02/13/api-urges-epa-to-finalize-its-methane-rule-with-modifications" target="_blank" rel="noopener">saying</a>, “we are concerned the proposed rule as drafted could create barriers to innovation and hamper U.S. energy production, which could lead to higher energy costs.&#8221;
The API also joined the Independent Petroleum Association of America (IPAA) and the American Exploration and Production Council in submitting comments to the EPA in October, warning that rule on methane emissions would “create a potentially significant financial impact” on the oil and gas industry, Just The News <a href="https://justthenews.com/politics-policy/energy/despite-voluntary-gains-methane-reductions-epa-will-impose-more-regulations" target="_blank" rel="noopener">reported</a>.
Industry expert Tom Shepstone told Just The News that while seeking ways to reduce emissions can be good, the Biden administration is pursuing a more radical agenda.

“I think we make a big mistake when we don&#8217;t recognize that the EPA, the Biden administration, and environmental groups, generally speaking — not all of them but a lot of them — are really about trying to get rid of fossil fuels,” Shepstone said.
Between 2018 and 2022, major oil and gas basins in the U.S. were already <a href="https://www.energyindepth.org/wp-content/uploads/2023/11/Methane-Emissions-Decline-Top-Basins-2018-22.pdf" target="_blank" rel="noopener">reporting</a> large declines in methane emissions, from 18% to 77% decreases. But even with oil and gas companies working to decrease emissions, the Biden administration has now leveled more restrictions on the industry in back-to-back years after <a href="https://www.epa.gov/newsreleases/biden-harris-administration-strengthens-proposal-cut-methane-pollution-protect" target="_blank" rel="noopener">increasing</a> standards last year.

Federal officials have declared Yellowstone River fish too toxic for human consumption after a train derailment that occurred back in June.
The Montana Fish, Wildlife &amp; Parks (MFWP) <a href="https://fwp.mt.gov/homepage/news/2023/sep/0919-state-agencies-issue-consumption-advisory-for-all-fish-species-on-yellowstone-river-near-train-derailment" target="_blank" rel="noopener">issued</a> a consumption advisory on Tuesday afternoon declaring the discovery of polycyclic aromatic hydrocarbons (PAHs) across multiple fish species. MFWP stated that the source of the toxins remains unknown. MFWP advised that no fish from the river be consumed anywhere, even beyond their advisory area.
“Out of an abundance of precaution and unknown conditions in adjacent sections of the river, those with specific concerns may want to avoid consuming all species of fish from the Yellowstone River at any location until more is known on the severity and prevalence of this contamination,” stated MFWP.
The PAHs discovered were naphthalene, 1-methylnaphthalene, 2-methylnaphthalene, and acenaphthylene. The Environmental Protection Agency (EPA) classifies naphthalene, 1-methylnaphthalene, 2-methylnaphthalene, as cancer-causing agents, but doesn’t classify acenaphthylene as cancer-causing.
Apart from cancer, the CDC notes that PAHs have been associated with the <a href="https://www.atsdr.cdc.gov/csem/polycyclic-aromatic-hydrocarbons/health_effects.html" target="_blank" rel="noopener">onset</a> of various pulmonary, gastrointestinal, renal, and dermatological issues.
The consumption advisory affects all fish species in the river spanning from the Indian Fort Fishing Access Site (FAS) near the census-designated place of Reed Point to the Highway 212 bridge in the city of Laurel. That’s roughly 45 miles, longer than the initial MFWP emergency closure enacted over the train derailment back in June. That closure spanned from Reed Point to the city of Columbus, roughly 18 miles.
MFWP explained that the PAHs source was unknown &#8212; despite the train derailment &#8212; due to the natural occurrence of some PAHs in the environment, like shale rock, and the introduction of other common materials like oil, gas, plastics, and pesticides.
In June, 10 cars transporting asphalt liquified petroleum, molten sulfur, and scrap metal <a href="https://response.epa.gov/site/site_profile.aspx?site_id=16083" target="_blank" rel="noopener">fell</a> into the Yellowstone River after the 52-car freight train derailed when the Twin Bridges railroad bridge collapsed. The train’s crew reported no injuries.

The highway bridge parallel to the railroad bridge was closed and demolished in 2021. The bridge passed a safety inspection in May, according to a spokesman for the entity that maintains the bridge, Montana Rail Link (MRL), in a statement to the Associated Press.
MRL <a href="https://www.montanarail.com/2023/06/unified-command-press-release-as-of-1230-june-29/" target="_blank" rel="noopener">reported</a> that the cause of the derailment was unknown. The Federal Railroad Administration hasn’t <a href="https://railroads.dot.gov/elibrary-search?search_api_fulltext=%2522Montana%2520Rail%2520Link%2522&amp;sort_by=field_effective_date&amp;items_per_page=5&amp;field_effective_date%255Bmin%255D&amp;field_effective_date%255Bmax%255D&amp;f%255B0%255D=document_series:14786" target="_blank" rel="noopener">issued</a> a Factual Investigation Report naming a probable cause for the incident.
The EPA <a href="https://response.epa.gov/sites/16083/files/Stillwater%2520MT%2520Derailment%2520Press%2520Release%252020230626.pdf" target="_blank" rel="noopener">noted</a> in its press release immediately following the derailment that asphalt globules were detected downstream and in the body of the river. However, the EPA said that the asphalt waste wasn’t water soluble and wouldn’t affect water quality.
In a site <a href="https://response.epa.gov/sites/16083/files/EPA%2520Stillwater%2520Train%2520Derailment%2520Site%2520Update%252020230815.pdf" target="_blank" rel="noopener">update</a> last month, the EPA said that there were no known threats to public health from the spill. The agency noted that local cleanup crews were only targeting “actionable asphalt material,” or only that which could be removed without causing “significant damage to natural habitat” like sediment and vegetation. As a result, the EPA reported that the crews have been breaking down the material into smaller pieces and covering them with sediment to “aid in the natural breakdown process.”
This practice is part of Phase 1 of the cleanup effort, which <a href="https://response.epa.gov/sites/16083/files/Stillwater%2520MT%2520Derailment%2520Press%2520Release%252020230907.pdf" target="_blank" rel="noopener">began</a> early last month and will last until next spring. Phase 2 is scheduled for next summer.
Per that update, crews collected approximately 231,700 pounds of asphalt out of the estimated 419,400 pounds of asphalt.
Tuesday’s consumption advisory followed another from last month, which more narrowly affected mountain whitefish following the discovery of elevated phenanthrene levels, another PAH. Phenanthrene wasn’t discovered in the more recent sampling that resulted in this week’s sweeping consumption advisory. The EPA doesn’t classify phenanthrene as a cancer-causing agent.

The beer manufacturer <a href="https://www.epa.gov/newsreleases/anheuser-busch-llc-required-improve-safety-fort-collins-brewery" target="_blank" rel="noopener">will pay</a> $537,000 in fines and implement a “comprehensive safety review” at 11 of the Anheuser-Busch plants that use anhydrous ammonia, according to the EPA. The settlement was in part spurred on by an accident at an Anheuser-Busch facility in 2018 in Fort Collins, <a href="https://www.dailywire.com/topic/colorado" target="_blank" rel="noopener">Colorado</a>, that <a href="https://www.coloradoan.com/story/money/business/2023/06/05/anheuser-busch-fined-for-violating-clean-air-act-fort-collins-budweiser-brewery/70290783007/#:~:text=Anheuser%2DBusch%20has%20agreed%20to,Right%2Dto%2DKnow%20Act.">left two workers</a> injured after an ammonia leak. 
“This settlement with Anheuser-Busch sends a clear message to companies that store hazardous materials like anhydrous ammonia that they have an obligation to follow regulations designed to protect our communities and environment from potentially catastrophic consequences of accidents,” EPA Regional Administrator K.C. Becker said. “Failure to comply with the law puts first responders and members of the surrounding community in harm’s way.” 
Anheuser-Busch facilities in New Hampshire, California, Colorado, Texas, Ohio, Florida, New York, Virginia, Georgia, and Missouri will all undergo comprehensive reviews on their storage of anhydrous ammonia, which is used in the production of beer. 
Facilities in New Hampshire, Colorado, and California were all the subject of an EPA investigation from 2016 to 2019. 
The agency claimed that Anheuser-Busch failed &#8220;to comply with recognized and generally accepted good engineering practices.&#8221;
The settlement comes as Anheuser-Busch has seen several months of financial tumult after partnering with transgender-identifying activist Dylan Mulvaney. According to some reports, Anheuser-Busch has <a href="https://www.dailywire.com/news/anheuser-busch-inbev-market-value-plunges-further-staggering-27-billion-drop-since-mulvaney-fiasco-report" target="_blank" rel="noopener">lost as much as $27 billion</a> in market value since the debut of the Mulvaney partnership.

The company had a $134.55 billion value as of March 31 before it plunged to $107.44 billion by the end of May, according to Dow Jones Market Data Group. The company’s stock plummeted 19.98% from its high in March. That 20% drop enters the zone of a bear market.
In large part, the backlash has been driven by conservative activists, who have encouraged Americans to boycott the popular beverage. 
“We believe there is a subset of American consumers who will not drink a Bud Light for the foreseeable future,” Jared Dinges, beverage analyst at JPMorgan Chase, said last month. “We believe a 12% to 13% volume decline on an annualized basis would be a reasonable assumption.”

The <a href="https://www.dailywire.com/topic/supreme-court" target="_blank" rel="noopener">Supreme Court</a> on Thursday slashed the Environmental Protection Agency&#8217;s (EPA) regulatory control over water bodies in a win for conservative critics who argued the agency wielded too much power.
The court ruled that the 1972 Clean Water Act, which allows the EPA to regulate wetlands, only applies to wetlands that are obviously connected to larger regulated water bodies.
The case arose from a situation of an Idaho couple, Michael and Chantell Sackett, who wanted to build a home on land that the EPA considered a protected wetland.
The EPA argued the &#8220;wetlands&#8221; on the Sacketts&#8217; property should be classified as &#8220;waters of the United States&#8221; because they were near a ditch that fed into a creek, which fed into Priest Lake, according to court documents.
In the court&#8217;s <a href="https://www.supremecourt.gov/opinions/22pdf/21-454_4g15.pdf" target="_blank" rel="noopener">opinion</a>, Justice Samuel Alito wrote that a protected wetland must have a &#8220;continuous surface connection&#8221; to a larger body of water. An underground connection that is not obvious does not give the EPA regulatory power, the court ruled.
&#8220;In sum, we hold that the [Clean Water Act] extends to only those &#8216;wetlands with a continuous surface connection to bodies that are ‘waters of the United States’ in their own right,&#8217; so that they are &#8216;indistinguishable&#8217; from those waters,&#8221; Alito wrote.
The Clean Water Act is meant to allow the EPA to regulate pollution in &#8220;waters of the United States,&#8221; but it does not define &#8220;waters of the United States,&#8221; which allowed the EPA leeway on the definition.
The previous standard was <a href="https://www.pbs.org/newshour/politics/supreme-court-strips-federal-protections-from-some-wetlands-boosts-property-rights#" target="_blank" rel="noopener">determined</a> by former Justice Anthony Kennedy, who ruled that wetlands had to have a &#8220;significant nexus&#8221; to a nearby regulated body of water.

Thursday&#8217;s ruling overturns a federal appeals court ruling, which ruled <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2021/08/16/19-35469.pdf" target="_blank" rel="noopener">in favor</a> of the EPA in 2021.
Justice Elena Kagan, considered to be one of the court&#8217;s more liberal justices, concurred with the judgment, but criticized the court for appointing &#8220;itself as the national decision-maker on environmental policy.&#8221;
&#8220;Because that is not how I think our Government should work — more, because it is not how the Constitution thinks our Government should work — I respectfully concur in the judgment only,&#8221; she wrote in a concurring opinion.
In 2017, Rep. John Duarte (R-CA) <a href="https://dailycaller.com/2017/08/14/obama-is-gone-but-not-his-administrations-crusade-to-crush-a-farmer/" target="_blank" rel="noopener">paid</a> $1.1 million in civil penalties for plowing 22 acres of his farm that the government deemed wetlands near the Sacramento River.
&#8220;They’re going after us because we didn’t get a permit to plow, even though the Clean Water Act says no permit is needed and indeed no permit has ever been required or issued to a wheat farmer ever before; and we didn’t avoid some small wet spots in our field, even though they’re similar to many others commonly farmed through by farmers all over the US (and those seasonal wetlands are still present on our property, as they were before our plowing),&#8221; Duarte <a href="https://dailycaller.com/2017/08/14/obama-is-gone-but-not-his-administrations-crusade-to-crush-a-farmer/" target="_blank" rel="noopener">wrote</a> in an op-ed at the time.

The new <a href="https://www.epa.gov/system/files/documents/2023-05/FRL-8536-02-OAR%20111EGU%20NPRM%2020230504_Admin.pdf" target="_blank" rel="noopener">regulations</a> unveiled on Thursday morning would seek to avoid 617 million metric tons of total carbon dioxide emissions through 2042, equal to the emissions produced by half of the nation’s cars, as well as reduce the amount of particulate matter released into the atmosphere. The proposed limits would “require ambitious reductions in carbon pollution based on proven and cost-effective control technologies” at coal and natural gas plants, which account for 60% of power generation in the nation, according to <a href="https://www.eia.gov/tools/faqs/faq.php?id=427&amp;t=3" target="_blank" rel="noopener">data</a> from the Energy Information Administration.
“By proposing new standards for fossil fuel-fired power plants, EPA is delivering on its mission to reduce harmful pollution that threatens people’s health and wellbeing,” EPA Administrator Michael Regan said in a <a href="https://www.epa.gov/newsreleases/epa-proposes-new-carbon-pollution-standards-fossil-fuel-fired-power-plants-tackle" target="_blank" rel="noopener">press release</a>. “EPA’s proposal relies on proven, readily available technologies to limit carbon pollution and seizes the momentum already underway in the power sector to move toward a cleaner future. Alongside historic investment taking place across America in clean energy manufacturing and deployment, these proposals will help deliver tremendous benefits to the American people, cutting climate pollution and other harmful pollutants, protecting people’s health, and driving American innovation.”
The release claimed that the new regulations would produce “climate and public health benefits” worth $85 billion over the next two decades, as well as prevent premature deaths and hospital visits as a result of decreased particulate matter emissions. The new rules had been widely expected for weeks before their public release.
Jason Isaac, a director at the Texas Public Policy Foundation, told The Daily Wire that the new regulations are “far-reaching” and will inevitably raise power costs for households.
“Carbon capture technologies are so expensive that the result will be the sudden retirement of reliable generation, and there will be nothing to replace it,” Isaac said. “This is a prime example of an unelected executive agency run amok, with a single-minded agenda of eliminating fossil fuels and controlling how we produce and consume energy regardless of the costs or consequences, all while doing nothing to mitigate a changing climate.”
The new emissions standards come months after the Supreme Court <a href="https://www.dailywire.com/news/supreme-court-rules-against-bidens-epa-says-agency-does-not-have-authority-to-regulate-carbon-dioxide-emissions" target="_blank" rel="noopener">ruled</a> in West Virginia v. EPA that federal agencies cannot assert “highly consequential power beyond what Congress could reasonably be understood to have granted.” Steve Milloy, a senior legal fellow at the Energy and Environmental Legal Institute, told The Daily Wire that the regulations have “no chance of withstanding” scrutiny from the Supreme Court but noted that a ruling might not come for many years, thereby allowing “much damage” to the power grid.

The forthcoming regulations, which are widely reported to be scheduled for publication on Thursday, would demand that power plants considerably reduce their carbon emissions by 2040, a rule that would force plants to use expensive carbon capture technology or switch to alternative fuel sources. Skeptics of the move are concerned that the policy would decrease energy reliability and artificially increase electricity costs for households.
Manchin, who is widely considered a centrist in the narrowly Democratic Senate and has frequently criticized Biden administration environmental policies, said in a <a href="https://www.manchin.senate.gov/newsroom/press-releases/manchin-to-oppose-every-epa-nominee" target="_blank" rel="noopener">statement</a> that he would refuse to vote for any future EPA nominees until the expected regulations are nixed.
“This administration is determined to advance its radical climate agenda and has made it clear they are hellbent on doing everything in their power to regulate coal and gas-fueled power plants out of existence, no matter the cost to energy security and reliability,” the lawmaker said. “This piles on top of a broader regulatory agenda being rolled out designed to kill the fossil industry by a thousand cuts.”
Manchin contended that the forthcoming crackdown would “impact nearly all fossil-fueled power plants” in the United States “without an adequate plan to replace the lost baseload generation.” Natural gas and coal are respectively responsible for generating 40% and 20% of electricity in the country, according to <a href="https://www.eia.gov/tools/faqs/faq.php?id=427&amp;t=3" target="_blank" rel="noopener">data</a> from the Energy Information Administration. The state of West Virginia, where Manchin is expected to compete for a third full term in the Senate, is meanwhile the fourth largest energy producer in the nation, according to more <a href="https://www.eia.gov/state/index.php?sid=WV" target="_blank" rel="noopener">data</a> from the agency.
“I fear that this administration’s commitment to their extreme ideology overshadows their responsibility to ensure long-lasting energy and economic security,” Manchin added.
The Biden administration has indeed <a href="https://www.whitehouse.gov/climate/" target="_blank" rel="noopener">established</a> a “whole-of-government effort” to reduce carbon emissions in the public and private sectors. Beyond the introduction of additional EPA rules that would aim to <a href="https://www.dailywire.com/news/biden-admin-unveils-proposal-for-landmark-nationwide-crackdown-on-gas-cars" target="_blank" rel="noopener">increase</a> nationwide adoption of electric cars, Energy Secretary Jennifer Granholm voiced support for a policy which would transition the military to exclusively rely upon electric vehicles by the year 2030. In a statement Tuesday, Manchin blasted the EPA&#8217;s radical regulations plan intended to boost EV sales beginning in 2030 and accelerating in 2032. Manchin said the EPA&#8217;s ambitious goal of ensuring that 67% of new cars sold will be all-electric was market manipulation and a &#8220;Trojan horse&#8221; to increase America&#8217;s reliance on China for critical minerals. He urged Congress to overturn the rules.

“The EPA is lying to Americans with false claims about how their manipulation of the market to boost EVs will help American energy security,&#8221; <a href="https://www.manchin.senate.gov/newsroom/press-releases/manchin-statement-on-epas-radical-vehicle-emissions-standards" target="_blank" rel="noopener">Manchin</a> said. &#8220;In reality, this is a Trojan horse. To meet these timelines will mean strengthening our reliance on minerals and technologies controlled by the Chinese. Earlier this month, the administration rolled out a <a href="https://www.dailywire.com/news/biden-admin-to-propose-rules-to-drastically-increase-ev-sales-crack-down-on-tailpipe-emissions-report" target="_blank" rel="noopener">proposed</a> regulations package meant to drastically increase electric vehicle sales, as The Daily Wire reported. The rules would aim to make sure that EVs make up fully two-thirds of all new cars on the market by 2032. The radical new regulations would represent a quantum leap in EV sales; electric cars made up just 5.8% of all new vehicles sold.
Last week, the administration rolled out new regulations for <a href="https://www.dailywire.com/news/biden-admin-unveils-proposal-for-landmark-nationwide-crackdown-on-gas-cars" target="_blank" rel="noopener">tailpipe emissions</a> meant to facilitate the transition. The “more stringent” standards released by the agency would <a href="https://www.epa.gov/system/files/documents/2023-04/lmdv-multi-pollutant-emissions-my-2027-nprm-2023-04.pdf" target="_blank" rel="noopener">induce</a> a 56% decrease in greenhouse gas emissions for light-duty vehicles as well as a 44% decrease for medium-duty vehicles, while similar standards were <a href="https://www.epa.gov/system/files/documents/2023-04/hd-ghg-veh-phase-3-nprm-2023-04.pdf" target="_blank" rel="noopener">introduced</a> for heavy-duty vehicles.

The <a href="https://www.dailywire.com/topic/environmental-protection-agency-epa" target="_blank" rel="noopener">Environmental Protection Agency</a> proposed new <a href="http://dailywire.com/topic/cars" target="_blank" rel="noopener">vehicle</a> emissions standards on Wednesday that would aim to increase adoption of <a href="http://dailywire.com/topic/electric-vehicles" target="_blank" rel="noopener">electric cars</a> and battle <a href="http://dailywire.com/topic/climate-change" target="_blank" rel="noopener">climate change</a>.
The “more stringent” standards released by the agency would <a href="https://www.epa.gov/system/files/documents/2023-04/lmdv-multi-pollutant-emissions-my-2027-nprm-2023-04.pdf" target="_blank" rel="noopener">induce</a> a 56% decrease in greenhouse gas emissions for light-duty vehicles as well as a 44% decrease for medium-duty vehicles, while similar standards were <a href="https://www.epa.gov/system/files/documents/2023-04/hd-ghg-veh-phase-3-nprm-2023-04.pdf" target="_blank" rel="noopener">introduced</a> for heavy-duty vehicles. The regulations would seek to change market conditions such that electric vehicles constitute two-thirds of new sales for light-duty vehicles and nearly half of new sales for medium-duty vehicles by 2032.
“By proposing the most ambitious pollution standards ever for cars and trucks, we are delivering on the Biden-Harris administration’s promise to protect people and the planet, securing critical reductions in dangerous air and climate pollution and ensuring significant economic benefits like lower fuel and maintenance costs for families,” EPA Administrator Michael Regan said in a <a href="https://www.epa.gov/newsreleases/biden-harris-administration-proposes-strongest-ever-pollution-standards-cars-and" target="_blank" rel="noopener">press release</a>. “These ambitious standards are readily achievable thanks to President Biden’s Investing in America agenda, which is already driving historic progress to build more American-made electric cars and secure America’s global competitiveness.”
The proposals follow aggressive regulations and legislative packages from the White House over the past two years in favor of electric vehicles and an overall transition toward renewable energy. The Biden administration, which has <a href="https://www.whitehouse.gov/climate/" target="_blank" rel="noopener">established</a> a “whole-of-government effort” to reduce carbon emissions and incentivize renewables, has also introduced new emissions <a href="https://www.dailywire.com/news/climate-alarmists-senator-tim-scott-blasts-energy-department-over-new-power-standards-for-certain-homes" target="_blank" rel="noopener">rules</a> for gas stoves, air conditioners, and mobile homes.

“With this new set of proposals, the Biden administration is setting out to use the power of government as a weapon to remove from the market the gas-powered trucks and cars that everyday consumers rely on, in favor of the kinds of cars that are most popular in liberal bastions,” Alliance for Consumers Executive Director O. H. Skinner said in comments provided to The Daily Wire. “Everyday consumers deserve better. The federal government shouldn&#8217;t be forcing progressive lifestyle choices on consumers. Biden and his activist allies think that they have found a way to force companies and consumers to comply with a progressive worldview without consequence or public scrutiny, and we are saying enough is enough.&#8221;
The ambitious proposals come shortly after a <a href="https://www.dailywire.com/news/only-20-of-americans-very-likely-to-buy-electric-for-their-next-car-even-as-some-states-want-100-adoption" target="_blank" rel="noopener">poll</a> from the Associated Press and the National Opinion Research Center revealed that only 19% of Americans said they are “extremely likely” or “very likely” to select an electric vehicle for their next car purchase. Dominant reasons for hesitance toward electric cars were prohibitively high costs, a lack of charging stations, personal preference for gas vehicles, concerns with charging times, and a lack of confidence in current battery technology.
The concerns regarding electric vehicles could present obstacles to the successful rollout of the EPA regulations and similar moves from states attempting to encourage universal adoption of the nascent technology. California Air Resources Board officials issued <a href="https://www.dailywire.com/news/california-expected-to-ban-sale-of-new-gas-cars" target="_blank" rel="noopener">rules</a> last year requiring 35% of new vehicles to be zero-emission by 2026, a standard that will rise to a 68% benchmark by 2030 and a 100% benchmark by 2035. States such as Massachusetts, Washington, and Virginia have <a href="https://www.dailywire.com/news/two-more-states-follow-californias-ban-on-new-gas-cars" target="_blank" rel="noopener">passed</a> laws conforming their states to the standards.
