An appeals court has rejected convicted fraudster Elizabeth Holmes’ bid to remain out of prison while she appeals the convictions against her.
Holmes, the founder and CEO of failed blood-testing company <a href="https://www.dailywire.com/topic/theranos" target="_blank" rel="noopener">Theranos</a>, will have to report to prison, leaving behind her current partner and her two young children, both of whom she had after being charged with fraud. A date has not been set for when Holmes will have to report for prison, the Associated Press reported.
The Ninth Circuit Court of Appeals’ decision comes nearly three weeks after Holmes’ legal team successfully delayed her sentence from her original start date of April 27.
“Ms. Holmes was on bail at the time the motion was filed,” said <a href="https://www.documentcloud.org/documents/23789599-holmes-nineth-circuit-filing" target="_blank" rel="noopener">court documents</a> from the previous decision. “Therefore, that bail automatically remains in effect until the Ninth Circuit has ruled on her motion.”
In an additional Tuesday, U.S. District Judge Edward Davila ordered Holmes to pay $452 million in restitution to those harmed by her crimes. She is being held jointly liable for the amount along with her former boyfriend and Theranos’ ex-president, Ramesh “Sunny” Balwani, who was tried after Holmes but is already imprisoned, according to the Associated Press.
Holmes had previously asked U.S. District Court Judge Edward Davila to allow her to remain free while she appealed the conviction against her, but in <a href="https://www.documentcloud.org/documents/23772578-2023-04-10-order-denying-dckt-1757_0" target="_blank" rel="noopener">a ruling</a> filed in early April, Davila ruled that the part of the conviction Holmes is appealing will probably not be overturned. Holmes is challenging her conviction based on the evidence presented at trial regarding whether Theranos products “worked as promised,” NBC News <a href="https://www.nbcnews.com/business/business-news/elizabeth-holmes-report-to-prison-fraud-conviction-appeal-rcna79105" target="_blank" rel="noopener">reported</a>.
“Whether the jury heard more or less evidence that tended to show the accuracy and reliability of Theranos technology does not diminish the evidence the jury heard of other misrepresentations Ms. Holmes made to investors,” Davila ruled.
Davila noted in his ruling that Holmes’ conviction wasn’t just based on whether her products worked but also related to the company’s finances and her false claims to investors about what her product did.
Davila did say in his ruling that he didn’t believe Holmes was a flight risk, even though federal prosecutors <a href="https://www.dailywire.com/news/theranos-fraudster-elizabeth-holmes-tried-fleeing-the-country-after-conviction-court-filings-reveal" target="_blank" rel="noopener">revealed</a> earlier this year that Holmes and her husband purchased one-way tickets to Mexico in January 2022 – the same month she was convicted. The tickets were canceled only after the defense counsel was notified.

“They’re not playing me,” Holmes told <a href="https://www.nytimes.com/2023/05/07/business/elizabeth-holmes-theranos-interview.html?auth=login-email&amp;login=email&amp;smid=tw-nytimes&amp;smtyp=cur" target="_blank" rel="noopener">The New York Times</a> of Seyfried and others. “They’re playing a character I created.”
Holmes told the publication that she created the persona because “I believed it would be how I would be good at business and taken seriously and not taken as a little girl or a girl who didn’t have good technical ideas. Maybe people picked up on that not being authentic, since it wasn’t,” she said.
The 39-year-old former biotechnology entrepreneur and founder of the blood-testing company <a href="https://dailywire.com/topic/theranos" target="_blank" rel="noopener">Theranos</a> was convicted of fraud in 2022. She is currently out of prison as she appeals her sentence. Holmes was supposed to report for prison on April 27.
Seyfried won an Emmy for her portrayal of Holmes, which included wearing a black turtleneck, red lipstick, and speaking in a deep voice to mimic Holmes. The actress said she wants to play Holmes again in any capacity. “I’m not kidding, a two-hour special. Come on!” Seyfried told Variety in a joint interview with “The Dropout” showrunner Elizabeth Meriwether.

Theranos founder and CEO <a href="https://www.dailywire.com/topic/elizabeth-holmes" target="_blank" rel="noopener">Elizabeth Holmes</a> avoided reporting to prison for at least an extra month on Thursday to serve her 11-year sentence after a court approved her last-minute appeal earlier this week.
Holmes — who ran the fraudulent biotechnology company — was expected to report to Federal Prison Camp at Bryan, Texas, on April 27 after a court convicted her on four counts of fraud last year for defrauding investors into believing she had revolutionized blood testing. Defense attorneys described the federal prison as &#8220;heaven&#8221; compared to others.
&#8220;Ms. Holmes was on bail at the time the motion was filed,&#8221; according to <a href="https://www.documentcloud.org/documents/23789599-holmes-nineth-circuit-filing" target="_blank" rel="noopener">court documents</a>. &#8220;Therefore, that bail automatically remains in effect until the Ninth Circuit has ruled on her motion.&#8221;
Holmes asked U.S. District Court Judge Edward Davila to allow her to remain free while she appealed the conviction, arguing based on the evidence presented during trial.
Davila ruled earlier this month that the part of the conviction Holmes is appealing will probably not be overturned.
Davila did say in his ruling that he didn’t believe Holmes was a flight risk, even though federal prosecutors <a href="https://www.dailywire.com/news/theranos-fraudster-elizabeth-holmes-tried-fleeing-the-country-after-conviction-court-filings-reveal" target="_blank" rel="noopener">revealed</a> earlier this year that Holmes and her husband purchased one-way tickets to Mexico in January 2022 — the same month she was convicted. The tickets were canceled only after the defense counsel was notified.
&#8220;Whether the jury heard more or less evidence that tended to show the accuracy and reliability of Theranos technology does not diminish the evidence the jury heard of other misrepresentations Ms. Holmes made to investors,&#8221; Davila ruled.
As an entrepreneur, Holmes attracted prominent political and business leaders to back her firm — including former Secretary of State George Shultz and former Defense Secretary James Mattis. Holmes also had close ties to the Clinton family and hosted a fundraiser for Hillary Clinton in 2016.

During her trial, Holmes&#8217; legal team argued that &#8220;she was merely a young, naïve, ambitious founder who relied too much on others who gave her bad advice,&#8221; claiming she lacked experience.
Holmes also attempted to accuse her ex-boyfriend and Theranos&#8217; ex-president Ramesh &#8220;Sunny&#8221; Balwani of abuse. Text messages between the two, however, seemed to depict a loving relationship.
The Associated Press <a href="https://apnews.com/article/theranos-sunny-balwani-elizabeth-holmes-prison-237bb4da8af239078729791f3f7a7d6c" target="_blank" rel="noopener">reported</a> that Balwani turned himself in on April 20 in San Pedro, California, after attempting to appeal his 13-year sentence.
Since her court proceedings began, Holmes has given birth to two children with her partner William Evans.
Judge Davila recommended Holmes serve at the prison camp in his filing because &#8220;the Court finds that family visitation enhances rehabilitation.&#8221;
The Department of Justice had requested that the disgraced Theranos founder receive 15 years in prison and pay $800 million in restitution to investors like software magnate Larry Ellison and Walmart founders the Walton family.

<a href="https://www.dailywire.com/topic/elizabeth-holmes" target="_blank" rel="noopener">Elizabeth Holmes</a>, the founder and CEO of failed blood-testing company <a href="https://www.dailywire.com/topic/theranos" target="_blank" rel="noopener">Theranos</a>, will have to report to prison while appealing her <a href="https://www.dailywire.com/topic/fraud" target="_blank" rel="noopener">fraud</a> conviction.
Holmes had asked U.S. District Court Judge Edward Davila to allow her to remain free while she appealed the conviction against her, but in <a href="https://www.documentcloud.org/documents/23772578-2023-04-10-order-denying-dckt-1757_0" target="_blank" rel="noopener">a ruling</a> filed on Monday, Davila ruled that the part of the conviction Holmes is appealing will probably not be overturned. Holmes is challenging her conviction based on the evidence presented at trial regarding whether Theranos products “worked as promised,” NBC News <a href="https://www.nbcnews.com/business/business-news/elizabeth-holmes-report-to-prison-fraud-conviction-appeal-rcna79105" target="_blank" rel="noopener">reported</a>.
“Whether the jury heard more or less evidence that tended to show the accuracy and reliability of Theranos technology does not diminish the evidence the jury heard of other misrepresentations Ms. Holmes made to investors,” Davila ruled.
Davila noted in his ruling that Holmes’ conviction wasn’t just based on whether her products worked but also related to the company’s finances and her false claims to investors about what her product did.

In that same document, prosecutors noted that Holmes “continues to show no remorse to her victims.”

Judge Davila has <a href="https://www.dailywire.com/news/judge-recommends-prison-with-no-walls-bars-or-fences-for-elizabeth-holmes" target="_blank" rel="noopener">previously recommended</a> Holmes serve her sentence at Federal Prison Camp in Bryan, Texas, a minimum-security federal prison. Criminal defense attorney Alan Ellis <a href="https://www.bloomberg.com/news/articles/2022-11-23/elizabeth-holmes-judge-proposes-texas-prison-camp-family-visits?srnd=premium-europe" target="_blank" rel="noopener">told</a> Bloomberg in November 2022 that Holmes would have “no walls, no bars, no fences” at that particular prison, calling the facility “heaven.”
“No one wants to get … kicked out because compared to other places in the prison system, this place is heaven,” Ellis said. “If you have to go, it’s a good place to go.”
Holmes is expected to report to the prison on April 27.

Former <a href="http://dailywire.com/topic/theranos" target="_blank" rel="noopener">Theranos</a> CEO <a href="https://www.dailywire.com/topic/elizabeth-holmes" target="_blank" rel="noopener">Elizabeth Holmes</a> attempted to flee the country after she was found guilty on multiple charges last year, attorneys said Thursday.
The disgraced biotechnology entrepreneur was <a href="https://www.dailywire.com/news/elizabeth-holmes-found-guilty-on-four-counts-of-defrauding-theranos-investors" target="_blank" rel="noopener">convicted</a> on four counts of wire fraud in early January 2022 and was <a href="https://www.dailywire.com/news/breaking-elizabeth-holmes-disgraced-media-darling-behind-theranos-fraud-sentenced-to-11-years-in-prison" target="_blank" rel="noopener">sentenced</a> to 11 years in prison in November. Federal prosecutors revealed in a <a href="https://s3.documentcloud.org/documents/23581015/us-v-holmes-gov-opp-motion-for-release-pending-appeal.pdf" target="_blank" rel="noopener">court document</a> responding to a request from Holmes for release pending appeal that she “booked an international flight to Mexico” in January 2022 without scheduling a return trip and only canceled the purchase after the defense counsel was notified.
“The government anticipates Defendant will note in reply that she did not in fact leave the country as scheduled,” the document added, “but it is difficult to know with certainty what Defendant would have done had the government not intervened.”
The document said that William “Billy” Evans, who married Holmes in 2019, allegedly departed the country “on the scheduled date with a one-way ticket and did not return until approximately six weeks later, returning from a different continent.” Officials asserted that Holmes “continues to show no remorse to her victims” and is currently seeking to “loosen the restrictions placed on her region of travel based upon vague references to her partner’s work commitments.” She was also granted a lenient amount of time to begin her prison sentence because she and Evans, an heir to a sizable hospitality fortune, are expecting their second child.
“Defendant, however, cannot meet the stringent standard for release pending appeal mandated by Congress. There are not two systems of justice, one for the wealthy and one for the poor, there is one criminal justice system in this country. And under that system, the time has come for Elizabeth Holmes to answer for her crimes committed nearly a decade ago,” the document continued.
Holmes deceived investors into believing that her company’s portable blood analyzer could conduct comprehensive medical tests with mere drops of blood. Her collapsed empire once secured a $9 billion valuation, and she was previously touted by Forbes as the world’s youngest self-made female billionaire.
The Stanford University dropout managed to attract several prominent political and business leaders to back her firm, including former Secretary of State George Shultz and former Defense Secretary James Mattis. She also had close ties to the Clinton family and hosted a fundraiser for Democratic presidential nominee Hillary Clinton in 2016.
Production delays in Theranos machines led the company to <a href="https://www.dailywire.com/news/how-did-elizabeth-holmes-build-her-fraudulent-biomedical-empire" target="_blank" rel="noopener">secretly use</a> traditional blood testing machines manufactured by Siemens and other established firms to complete tests for their partners. In the absence of a functioning device, Holmes still convinced board members, prospective investors, and journalists that her company’s product had been finished.
Ramesh “Sunny” Balwani, the former business and romantic partner of Holmes, has been sentenced to nearly 13 years in prison. Ramesh “Sunny” Balwani, 58, the former president of the fraudulent biotech company Theranos, was sentenced to nearly 13 years in prison on Wednesday for fraud.
Prosecutors originally recommended Balwani receive at least 15 years in prison, which would be a longer sentence than what Elizabeth Holmes, the founder and face of Theranos, received in October, NBC News <a href="https://www.nbcnews.com/business/business-news/former-theranos-executive-sunny-balwani-sentenced-fraud-conviction-rcna60512">reported</a>.
Theranos rose to fame on promises of quick and easy blood tests for hundreds of conditions based on just a drop of blood. The company raised millions of dollars from high-profile donors including Bill Gates and Henry Kissinger. Though the company was lauded by the Obama administration, with then-Vice President Joe Biden touring the company as part of a publicity stunt, a series of investigative articles from The Wall Street Journal’s John Carreyrou revealed the company was lying about its underlying technology.
While Holmes was the face of the company, hailed in the media for being a female tech entrepreneur, Balwani oversaw the company’s labs and ensured faulty test results would be ignored.

“Mr. Balwani knew that Theranos was not generating, and would not generate, any meaningful revenue by being honest with people,” said U.S. Attorney Jeff Schenk, according to NBC. “So he chose a different path.”
At her trial, Holmes argued that she was simply a young, naïve, and ambitious woman who relied on the wrong people to get her company started. When Holmes actually testified, however, she presented herself the way she had done to investors when Theranos was still operating — as an expert about her company and its technology.
Holmes also tried to blame Balwani for abuse, as the two were romantic partners while operating Theranos. Text messages between the two, however, <a href="https://www.dailywire.com/news/texts-between-theranos-founder-elizabeth-holmes-and-ex-boyfriend-cast-doubt-on-her-abuse-claims">showed a loving relationship,</a> although Balwani had a reputation for treating employees poorly.
In his documentary, “The Inventor,” filmmaker Alex Gibney revealed that while Balwani was considered a tyrant to those who worked for him, he was deferential to Holmes and always appeared supportive of her.
Other texts show Holmes and Balwani apparently discussing how to undermine the claims from two Theranos whistleblowers — Tyler Shultz and Erika Cheung. The two also discussed how they would respond to reporting from Carreyrou, who months later published a damning article showing that Theranos’ machines could not perform the blood tests they claimed. Carreyrou’s reporting revealed that Theranos was lying about its capabilities and using traditional blood analyzers to run most of its blood tests.
Balwani <a href="https://www.dailywire.com/news/former-theranos-president-points-fingers-back-at-elizabeth-holmes-during-fraud-trial">pointed the finger</a> back at Holmes at trial, saying that she founded and built Theranos and thus carried most of the blame.

A California judge recommended that disgraced biotech entrepreneur and media darling <a href="https://www.dailywire.com/topic/elizabeth-holmes" target="_blank" rel="noopener">Elizabeth Holmes</a>, who was sentenced to 11 years in prison earlier this month, serve her time in a minimum-security federal prison camp.
Holmes — who ran the fraudulent biotechnology company Theranos — received 135 months in prison after defrauding investors into believing she had revolutionized blood testing.
Judge Edward Davila of the Northern District of California recommended she serve her sentence at Federal Prison Camp in Bryan, Texas, which defense attorneys described as “heaven” compared to other prisons.
Criminal defense attorney Alan Ellis told <a href="https://www.bloomberg.com/news/articles/2022-11-23/elizabeth-holmes-judge-proposes-texas-prison-camp-family-visits?srnd=premium-europe" target="_blank" rel="noopener">Bloomberg</a> that if Holmes serves her sentence at the facility, she will face “no walls, no bars, no fences.”

Located about 100 miles northwest of Houston, the prison camp sits on 37 acres of Texas land with about 900 non-violent female inmates serving time for various frauds in dormitory-style housing with a low staff-to-inmate ratio. While serving her time, Holmes has access to games, sports, physical fitness, table games, hobby crafts, music programs, intramural activities, social and cultural organizations, and movies, according to the prison’s <a href="https://www.bop.gov/locations/institutions/bry/BRY_aohandbook.pdf" target="_blank" rel="noopener">handbook</a>.
Holmes, who has a 1-year-old son and is currently pregnant with her second child with her partner William Evans, was convicted on four counts of wire fraud in January following a months-long trial.
