Lawmakers investigating the <a href="https://www.dailywire.com/topic/covid-19" target="_blank" rel="noopener">COVID pandemic</a> have again requested phone call records between <a href="https://www.dailywire.com/news/far-left-teachers-union-boss-randi-weingarten-to-join-council-to-advise-homeland-security" target="_blank" rel="noopener">teacher’s union boss Randi Weingarten</a> and outgoing CDC Director <a href="https://www.dailywire.com/topic/dr-rochelle-walensky" target="_blank" rel="noopener">Rochelle Walensky</a> over concerns of “political interference.” 
Select Subcommittee on the Coronavirus Pandemic Chairman Brad Wenstrup (R-OH) sent a <a href="https://oversight.house.gov/wp-content/uploads/2023/06/2023.06.28-BRW-Letter-to-CDC-Re.-Texts.pdf" target="_blank" rel="noopener">letter</a> to Walensky on Wednesday, just two days before her scheduled departure from the CDC, requesting her phone records and texts with Weingarten, the president of the American Federation of Teachers. 
“During an April hearing with AFT president Weingarten, the Select Subcommittee learned — for the first time — that Ms. Weingarten had a direct telephone line to CDC Director Rochelle Walensky. Preserving all phone calls and text messages between the two officials will ensure accountability for any political interference,” the subcommittee <a href="https://oversight.house.gov/release/wenstrup-calls-for-phone-records-between-cdc-director-rochelle-walensky-and-teachers-union-president-randi-weingarten/" target="_blank" rel="noopener">said</a> in a press release. 
Wenstrup’s letter also accused the Department of Health and Human Services of failing to produce records in a timely manner, and only producing select documents that could be acquired through a freedom of information request. The CDC <a href="https://www.cdc.gov/about/organization/cio.htm#:~:text=CDC%20is%20one%20of%20the,of%20Health%20and%20Human%20Services." target="_blank" rel="noopener">is</a> a “major operating component” of HHS. 
“The Department of Health and Human Services is continuing its pattern of obstructing Congress by apparently only producing documents already made publicly available via the FOIA. As a reminder, FOIA does not apply to Congress,” Wenstrup said in the letter to Walensky. 
Text <a href="https://www.dailywire.com/news/texts-show-teachers-union-working-with-cdc-director-to-keep-schools-closed" target="_blank" rel="noopener">messages previously obtained</a> by the Fairfax Parent’s Association appear to show a close relationship between Weingarten and Walensky and seem to show Weingarten impacting CDC policy on school closure policy. 
Weingarten texted Walensky in February 2021 saying that she had heard a “leak” from The New York Times about what was in the CDC’s upcoming guidance for school re-opening, and expressed concern that it was “at odds with [their] discussion.”

“They are running with a full speed ahead angle” for reopening schools, Weingarten wrote. She said the Times sent her a copy of the internal draft guidance that said, “At any level of community transmission, all schools can provide in-person instruction.”
“Hmmm. Argh,” Walensky wrote to Weingarten. 
Following the texts from Weingarten, the CDC released guidance that was different. It said, “All schools have options to provide in-person instruction.” This guideline allowed school districts to stay closed while still saying they were following CDC guidelines. “Middle and high schools in virtual only instruction unless they can strictly implement all mitigation strategies and have few cases,” the guidance added.
Wenstrup requested call logs and texts between Walensky and Weingarten on the CDC’s director&#8217;s personal and professional phones by July 12.

<a href="https://www.dailywire.com/topic/dr-rochelle-walensky" target="_blank" rel="noopener">Rochelle Walensky</a>, the director of the <a href="https://www.dailywire.com/topic/cdc" target="_blank" rel="noopener">Centers for Disease Control and Prevention</a>, is slated to leave the <a href="https://www.dailywire.com/topic/health" target="_blank" rel="noopener">public health</a> agency at the end of next month.
The official assumed office on the day President <a href="http://dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Joe Biden</a> was inaugurated and played a central role in the administration’s response to <a href="https://www.dailywire.com/topic/covid" target="_blank" rel="noopener">COVID</a>, which involved the continued nationwide rollout of vaccines and a controversial <a href="https://www.dailywire.com/topic/vaccine-mandate" target="_blank" rel="noopener">requirement</a> that federal workers receive the inoculation. She previously served as chief of the infectious diseases division at Massachusetts General Hospital and a professor at Harvard Medical School.
“The end of the COVID-19 public health emergency marks a tremendous transition for our country, for public health, and in my tenure as CDC Director,” Walensky said in a Friday <a href="https://www.cdc.gov/media/releases/2023/p0505-walensky.html" target="_blank" rel="noopener">statement</a>. “I took on this role, at your request, with the goal of leaving behind the dark days of the pandemic and moving CDC, and public health, forward into a much better and more trusted place.”
Walensky will cease her official duties on June 30. Biden lauded her work at the public health agency in a separate <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2023/05/05/statement-from-president-biden-on-dr-rochelle-walensky/" target="_blank" rel="noopener">statement</a> from the White House.
“As Director of the CDC, she led a complex organization on the frontlines of a once-in-a-generation pandemic with honesty and integrity. She marshalled our finest scientists and public health experts to turn the tide on the urgent crises we’ve faced,” the commander-in-chief said. “Dr. Walensky leaves CDC a stronger institution, better positioned to confront health threats and protect Americans. We have all benefited from her service and dedication to public health, and I wish her the best in her next chapter.”
Beyond the federal vaccine mandate, which was officially <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2023/05/01/the-biden-administration-will-end-covid-19-vaccination-requirements-for-federal-employees-contractors-international-travelers-head-start-educators-and-cms-certified-facilities/" target="_blank" rel="noopener">nixed</a> earlier this week, the Biden administration attempted to impose vaccine requirements on private employers through the Occupational Safety and Health Administration, an emergency order which the Supreme Court <a href="https://www.dailywire.com/news/one-year-after-supreme-court-struck-down-covid-vax-mandate-freedom-flourishes" target="_blank" rel="noopener">overturned</a> last year after The Daily Wire filed a federal lawsuit.
Walensky meanwhile garnered controversy for providing teachers union officials “unprecedented access” to view and shape COVID response guidelines, a privilege that the unions leveraged to implement a “trigger” provision that would cause schools to automatically close should COVID test positivity rates reach certain thresholds, according to a <a href="https://republicans-oversight.house.gov/release/investigation-reveals-bidens-cdc-bypassed-scientific-norms-to-allow-teachers-union-to-re-write-official-guidance/" target="_blank" rel="noopener">report</a> from the House Select Subcommittee on the Coronavirus Crisis.
Kelly Tratner, the senior director for health issues at the American Federation of Teachers, suggested the “trigger” provision to Walensky in an email that she <a href="https://www.dailywire.com/news/biden-administration-gave-teachers-union-unprecedented-access-to-shape-national-covid-19-guidelines-report-says" target="_blank" rel="noopener">forwarded</a> to a fellow CDC administrator. The suggestion was included in a guidance published on the following day.

Walensky <a href="https://www.dailywire.com/news/ben-shapiro-warns-cdc-has-a-bigger-motive-behind-its-shake-up" target="_blank" rel="noopener">admitted</a> last year that the CDC made mistakes in its COVID response and called for a “reset” that would include staffing changes and faster data releases. She contended that the agency should create a “new office to promote equity in healthcare” and develop a “more nimble workforce that can quickly respond to public health crises.”
Critics of the federal response to COVID assert that inconsistent guidance from senior officials eroded trust in the government’s public health agencies. Anthony Fauci, who retired from his longtime role as director of the National Institute of Allergy and Infectious Diseases at the end of last year, earned a special degree of <a href="https://www.dailywire.com/show/fauci-unmasked" target="_blank" rel="noopener">criticism</a> for his various recommendations regarding business closures, face masks, and vaccine boosters.

The <a href="https://www.tuskegee.edu/about-us/centers-of-excellence/bioethics-center/about-the-usphs-syphilis-study" target="_blank" rel="noopener">study</a>, which began in 1932, enlisted more than 600 black men to record the natural progression of syphilis. Throughout the study, however, a number of ethical protocols — namely &#8220;informed consent&#8221; — were ignored, and when penicillin emerged as a treatment for the disease in 1947, it was intentionally withheld from the study participants. The study ended in 1972 after The Associated Press&#8217; Jean Heller exposed the experiment and a review board determined that the entire study had been &#8220;ethically unjustified.&#8221;

Critics quickly responded, most taking issue with the word &#8220;sacrifice&#8221; as if the participants in the study had been given any real information about the potential impact that withholding treatment could have on them and their families.

Dr. Anthony Fauci is the director of the National Institute of Allergy and Infectious Diseases. That means his job &#8212; his one job &#8212; is to handle a severe outbreak of an infectious disease.
But Fauci now <a href="https://www.foxnews.com/politics/fauci-admits-certain-aspects-governments-covid-19-response-botched">reportedly</a> admits he and his team &#8220;botched&#8221; certain aspects of how to handle COVID after it hit the U.S. in March 2020, including his flip-flopping on the efficacy of masks and the lengthy time it took to make rapid tests available nationwide.
&#8220;We didn&#8217;t know masks worked outside of the hospital setting. available nationwide. There was supposedly a shortage of good masks for the people who were taking care of individuals,&#8221; the doctor said in an interview that aired last week at the Texas Tribune Festival, Fox News <a href="https://www.foxnews.com/politics/fauci-admits-certain-aspects-governments-covid-19-response-botched">reports</a>.
And he put the blame on others for rapid tests, saying, &#8220;They did not get the commercial involvement in the tests quickly. They stuck to their own tests,&#8221; he said, not defining just who &#8220;they&#8221; are.
Back in March 2020, Fauci declared, “There’s no reason to be walking around with a mask.”
“When you’re in the middle of an outbreak, wearing a mask might make people feel a little bit better and it might even block a droplet, but it’s not providing the perfect protection that people think that it is,” the doctor said on <a href="https://youtu.be/PRa6t_e7dgI">CBS News</a>.
Then in January 2021, Fauci said wearing two masks is likely more effective than wearing one. “If you have a physical covering with one layer, you put another layer on it, just makes common sense that it likely would be more effective,” he told <a href="https://www.cnbc.com/2021/01/25/dr-fauci-double-mask-during-covid-makes-common-sense-more-effective.html">NBC News</a>.
Fauci also admitted at the festival that he knew the “draconian” COVID policies he advocated for would lead to “collateral negative consequences” for the “economy” and for “schoolchildren.”
But, of course, Fauci had some blame to spread around, citing the “divisiveness” of “social media” for his flip-flopping.
“When you have a divisiveness in society where every time you say something, you have X number of people with social media looking to attack it, that adds to the understandable confusion when you’re dealing with an evolving outbreak,” Fauci <a href="https://www.johnlocke.org/fauci-knew-lockdowns-would-hurt-economy-kids/">said</a>.
“Of course, when you make recommendations, if the primary goal when you’re dealing with a situation where the hospitals were being overrun in New York, intensive care units were being put in hallways, you have to do something that’s rather draconian,” the doctor said.
&#8220;And sometimes when you do draconian things, it has collateral negative consequences, just like when you shut things down, even temporarily, it does have deleterious consequences on the economy, on the schoolchildren. You know that,&#8221; he said.
Fauci, though, said there was a method to the madness.
“If you shut things down just for the sake of it, that’s bad,” he <a href="https://nypost.com/2022/09/21/fauci-admits-he-knew-draconian-lockdowns-would-have-collateral-negative-consequences-on-schoolchildren/">said</a>, adding, “But if you do it with the purpose of being able to regroup so that you can then open up in a more safe way, that’s the best way to do it.”
In the months after the virus first hit, it became clear that children are the least endangered. Last week, the Department of Education said American students had “the largest average score decline in reading since 1990, and the first ever score decline in mathematics,&#8221; Fox News reported.
In his comments, Fauci was saying what other health officials have already said about governments&#8217; response to the pandemic.
Governments &#8220;showed themselves to be untrustworthy and ineffective&#8221; during the pandemic by failing to &#8220;adhere to basic norms of institutional rationality and transparency,&#8221; the Lancet COVID Commission of international experts <a href="https://www.thelancet.com/commissions/covid19">reported</a> last week.
And Dr. Rochelle Walensky, the director of the U.S. Centers for Disease Control and Prevention, last month ordered a full reorganization of the agency, saying its response to COVID &#8220;did not reliably meet expectations.&#8221;

CDC Director <a href="https://www.dailywire.com/topic/dr-rochelle-walensky">Rochelle Walensky</a> admitted earlier this week that her department made mistakes in its response to the COVID pandemic and then called for a “reset” that would include staffing changes and faster data releases, the Associated Press <a href="https://apnews.com/article/covid-science-health-public-rochelle-walensky-843cd83bf1d616846ff455f7f5f0d30d">reported</a>.
Shapiro wasn’t buying that the CDC was serious about taking steps toward meaningful change. “If you actually wanted to shake-up the CDC, what you would do is use a little bit of epistemic humility. You&#8217;d actually look at their system and say, okay, what if we shrank what it is that we say that we can do?” he told his listeners on &#8220;<a href="https://www.dailywire.com/episode/what-won-t-the-left-do-to-stop-trump-the-ben-shapiro-show-ep-1559">The Ben Shapiro Show</a>.”
“But that&#8217;s not what the CDC is doing,” Shapiro explained. “Their argument is they need more power. Their big mistake is that they weren&#8217;t forceful enough during the last pandemic. So when they say shake-up, what they mean is give us more power.&#8221;
Walensky told CBS News that her agency needs to learn from the lessons of the pandemic and “do better.” Among the suggested steps for a CDC shake-up was creating a “new office to promote equity in healthcare” and developing a “more nimble workforce that can quickly respond to public health crises.”
The CDC director said the agency needs “to have a special forces, if you will, to deploy during pandemic times.”
The massive health agency currently has more than 11,000 employees and a $12 billion budget.
Shapiro lambasted the idea that the CDC needs to focus on “equity in health care,” saying the agency has no business promoting equity. He went on to explain that the changes the CDC wants are nothing short of a power grab coming from an agency that already used a large amount of power throughout the course of the pandemic.
“The notion that the CDC was not active enough during this pandemic is pretty insane &#8230; it&#8217;s like the Federal Reserve, the people who botched the response are the same people who are charged with fixing it,&#8221; Shapiro remarked.
The segment concluded with Shapiro reminding listeners that those in control of institutions like the CDC have completely different motives than the American people they are supposed to serve. He suggested that scientific institutions have been compromised by politics, making them ideological stalwarts and turning them away from simply telling the public about its objective findings.
“The institution of science has brought about more progress and prosperity than any institution over the course of the last century, and yet they are continuously undermining themselves with questions of motive and injecting politics and ideology,” Shapiro said.

On Thursday, roughly six weeks after the World Health Organization decided to rename the disease monkeypox after some claimed the name was discriminatory, Fox News’ Tucker Carlson confirmed that his viewers had decided to give the Centers for Disease Control and the American people a new name for the disease.
Carlson made an implicit reference to the manner in which the disease has been largely spread through homosexual behavior in addition to a side reference to “Long COVID” as he pronounced his name for the disease.
“So monkeypox is about the coolest name ever for a disease — &#8216;can’t come tonight, I got the monkey&#8217;— but they are changing the name, ‘cause racism or something,” Carlson asserted.
“Well, for once, we know who they are; we’re not going to allow it,” he declared. “We’re going to change the name this time.”
“We’re going to do it with the public’s help, because democracy is real,” he quipped.
Earlier in the week, Carlson had <a href="https://twitter.com/DailyCaller/status/1552464415219400705">stated</a>, “We like the name monkeypox; it&#8217;s a great name, but as long as they’re going to change the name, we should have some role in naming it. It shouldn&#8217;t be left up to Tony Fauci and Deborah Birx. So what should we call it? Democracy Pox? Schlong COVID, our favorite? Tweet us your suggestions.”
Carlson took a <a href="https://twitter.com/TuckerCarlson/status/1552814471026016257">poll on Twitter</a>. He continued on Thursday, “So we had a vote; there was no ballot harvesting; you can trust our counting, and the new name for monkeypox Is now officially, and we’re declaring it: Schlong COVID.”
Targeting the CDC, he continued, “That won our audience election with about 40% of the vote. So let Rochelle Walensky (director of the Centers for Disease Control) at the CDC know; her number is 1-800-232-4636. Wait for the prompt on ‘monkeypox’ and make your voice heard, cause it’s still a democracy.”

In mid-June, the World Health Organization, apparently responding to over 30 researchers who &#8220;signed a position paper stating there was an &#8216;urgent need&#8217; to change its name given the current outbreak, which has mainly struck gay and bisexual men,&#8221; as the Daily Mail <a href="https://www.dailymail.co.uk/health/article-10918619/World-Health-Organization-rename-monkeypox-scientists-claimed-RACIST.html">reported</a>, <a href="https://dailywire.com/news/world-health-organization-will-rename-monkeypox-because-name-is-discriminatory-stigmatizing-to-africa/">announced</a> the disease would be renamed.
Dr. Tedros Ghebreyesus, WHO Director-General, stated that the organization is &#8220;working with partners and experts from around the world on changing the name of monkeypox virus, its clades, and the disease it causes. &#8230; We will make announcements about the new names as soon as possible.”
On Wednesday, Ghebreyesus implicitly addressed the homosexual community, <a href="https://www.cnn.com/2022/07/27/health/who-monkeypox-msm-sex-partners/index.html">saying</a>:

Biden was speaking to a group assembled at a Washington, D.C. clinic Tuesday when he introduced Dr. Ashish Jha, the White House COVID response coordinator. Except the president did not use that title.

The introduction must have come as news to Dr. Rochelle Walensky, the actual director of the CDC. She was began leading the agency on January 20, 2021. Prior to taking the high-level Biden administration job, Walensky was the top infectious diseases expert at Massachusetts General Hospital and a professor at Harvard Medical School.
Jha, who was named to his current position in April, is also a former Harvard professor.
The response on Twitter came swiftly.
&#8220;According to POTUS, Dr. Jha is “basically running the CDC” these days,&#8221; <a href="https://twitter.com/davidzweig/status/1539732341492416513?s=20&amp;t=Q8I2oPKT3g7-8Vdlt0iF-w">tweeted Fox News contributor Dr. Nicole Saphier</a>. &#8220;If the WH advisor controls the CDC, what role does Dr. Walensky have? Does the CDC have any apolitical leadership anymore? FYI, lowering the facemask negates any effect it may have.&#8221;:

The incident occurred when Biden and first lady Jill Biden visited a Washington, D.C., vaccination clinic where <a href="https://www.dailywire.com/news/biden-boasts-as-infants-as-young-as-six-months-now-cleared-for-covid-vaccines">children from six months to age 5 are now being vaccinated for COVID</a>. Walensky endorsed the new guidelines, although other nations are not vaccinating infants.
“This is a very historic milestone,” Biden said. “The United States is now the first country in the world to offer safe and effective Covid-19 vaccines for children as young as six months old.”
It was not the first time Biden has gotten confused about key members of his administration. In 2020, he <a href="https://www.dailywire.com/news/watch-joe-biden-announces-name-of-his-chosen-hhs-chief">botched Xavier Becerra’s name</a> and title when introducing him as his choice for secretary of the Department of Health and Human Services.
“For Secretary of Health and Education Services, I nominate Xavier Bacheria,” Biden said.

Centers for Disease Control and Prevention (CDC) Director Rochelle Walensky announced Monday that the agency is planning to evaluate the department’s “structures, systems, and processes” following months of unclear messaging during the COVID-19 pandemic.
On Thursday’s episode of The Daily Wire’s “<a href="https://www.dailywire.com/listen">Morning Wire</a>” podcast, Daily Wire reporter Ashe Short joined hosts Georgia Howe and John Bickley to discuss the CDC’s latest move to revamp the agency. 
Short explained that the move could mean a couple different things. “[O]ne could take it as an indication that America really has moved on from COVID-19 and they’re looking to shift gears right now,” she said. “As things return to normal, it sounds like the CDC is taking the opportunity to look back over how it handled the pandemic and look for ways to improve.”
The CDC’s revamp could also indicate that the CDC is aware of the issues the pandemic exposed within the agency. Short commented that “the agency’s reputation and credibility has taken a huge hit over the past couple years. They are very aware of that, so this move is also about shoring up trust and credibility with the American people.”
Walensky stated that the evaluation will look over how the CDC can better and more quickly respond to virus outbreaks, as well as modernizing its data. “At the conclusion of this collective effort, we will develop new systems and processes to deliver our science and program to the American people, along with a plan for how CDC should be structured to facilitate the public health work we do,” Walensky wrote in an email to agency employees, <a href="https://www.msn.com/en-us/news/us/cdc-under-fire-for-covid-response-announces-plans-to-revamp-agency/ar-AAVR9Xe">according</a> to The Washington Post.
The CDC director also mentioned focusing on “health equity,” a term that has controversial political interpretations as Short mentioned on “Morning Wire.” “[In] terms of rooting out partisanship from the agency, it doesn’t look like the review will go that deep,” Short said.
The CDC has also been the center of controversy over its recommendations for closing schools when there wasn’t sufficient data to support such a decision. In August, Walensky also advised Americans to get the COVID-19 booster shots before the Food and Drug Administration (FDA) or CDC had reviewed data on the shots’ effectiveness.
Yet another criticism of the CDC’s attempt to revamp is that these reviews are being conducted by other government officials, not outsiders.
“The review will be conducted by former acting administrator of the Health Resources and Services Administration, Jim Macrae. So, not exactly a government outsider,” Short explained. “They’re also tasking three senior-level CDC officials with gathering feedback. A stronger move would probably be to commission an Inspector General — someone who is paid to be an objective watchdog — that might inspire more confidence in the outcome. As it stands now though, I’m not predicting a real overhaul.”

After endless criticism for mishandling the COVID-19 pandemic, the director of the Centers for Disease Control and Prevention (CDC) announced plans to overhaul the agency.
In announcing the plan, CDC Director Dr. Rochelle Walensky said “it is time to step back and strategically position CDC to support the future of public health,&#8221; The Washington Post <a href="https://www.msn.com/en-us/news/us/cdc-under-fire-for-covid-response-announces-plans-to-revamp-agency/ar-AAVR9Xe">reported</a>.
&#8220;In an agencywide email sent shortly after 1 p.m., Walensky said she has hired a senior federal health official outside of the Atlanta-based agency to conduct a one-month review to &#8216;kick off an evaluation of CDC’s structure, systems, and processes,'&#8221; the outlet added.
&#8220;&#8216;Over the past year, I have heard from many of you that you would like to see CDC build on its rich history and modernize for the world around us,&#8217; she wrote in the email. &#8216;I am grateful for your efforts to lean into the hard work of transforming CDC for the better. I look forward to our collective efforts to position CDC, and the public health community, for greatest success in the future,'&#8221; the paper said.
The CDC has been criticized for its slow initial response to the pandemic, then for confusing guidance on masking, isolation, and quarantine, as well as booster shots. For instance, late last month, the CDC recommended booster shots for those 50 years old and older, while many other experts say they&#8217;re not necessary.
“Today, CDC expanded eligibility for an additional booster dose for certain individuals who may be at higher risk of severe outcomes from COVID-19,&#8221; Walensky <a href="https://www.cdc.gov/media/releases/2022/s0328-covid-19-boosters.html">said</a> on March 29. &#8220;Boosters are safe, and people over the age of 50 can now get an additional booster 4 months after their prior dose to increase their protection further. This is especially important for those 65 and older and those 50 and older with underlying medical conditions that increase their risk for severe disease from COVID-19 as they are the most likely to benefit from receiving an additional booster dose at this time.&#8221;
But some experts said a fourth shot isn&#8217;t necessary, prompting a commentary piece by the Wall Street Journal <a href="https://www.wsj.com/articles/you-likely-dont-need-a-fourth-covid-shot-booster-dose-pfizer-moderna-vaccine-omicron-ba-2-ba2-11648498217">headlined</a>, &#8220;You Likely Don’t Need a Fourth Covid Shot.&#8221; Then the Food and Drug Administration came out and said it will authorize &#8212; but not recommend &#8212; a fourth shot for patients over 50. The CDC, meanwhile, does recommend the second booster, CNBC <a href="https://www.cnbc.com/2022/03/29/fda-authorizes-fourth-pfizer-covid-vaccine-dose-for-people-age-50-and-older-.html">reported</a>.

A group of 17 GOP Congress members, led by Kentucky Republican Rep. Thomas Massie, sued the Centers for Disease Control and Prevention (CDC) Monday, claiming it lacks the legal authority to force people to wear a mask on airplanes.
The lawsuit, Massie et al v. Centers for Disease Control and Prevention, seeks to end the CDC&#8217;s illegal mask mandate for individuals traveling on commercial airlines. The case also includes Dr. Rochelle Walensky, Director of the CDC; and Sherri Berger, CDC Chief of Staff, as defendants.
The Biden administration recently extended the CDC&#8217;s March mask mandate until April 18.
&#8220;The Centers for Disease Control and Prevention does not have the legal authority to force people traveling on commercial airlines to wear masks,&#8221; Massie said in a <a href="https://massie.house.gov/news/email/show.aspx?ID=LJCWZJNIK2RRGWUXXQFTDAJUNI" target="_blank" rel="noopener">statement</a>.

&#8220;Congress never passed a law requiring masks on commercial flights. This lawsuit targets the faceless bureaucrats who are behind the CDC&#8217;s unscientific regulation so that this illegal mask mandate can be brought to a permanent end,&#8221; he added.
The lawsuit includes two primary claims, according to Massie&#8217;s statement. &#8220;First, none of the statutes or regulations cited by the CDC for the authority to mandate that individuals wear masks on commercial airlines, conveyances, and at transportation hubs, permit the CDC to implement or enforce this mandate.&#8221;
In addition, &#8220;even if Congress had granted the CDC the authority to promulgate the mask mandate, the granting of this authority would violate a principle known as the &#8216;non-delegation doctrine.'&#8221;
Kentucky Republican Sen. Rand Paul, who is also a medical doctor, further spoke out against the &#8220;unconstitutional&#8221; mandate in the statement.
&#8220;I’ve been leading the charge in the Senate to end these unscientific, unconstitutional mask mandates, and am proud to continue the fight by joining Rep. Massie on this effort,&#8221; Paul said.
Arizona Republican Rep. Andy Biggs argued the airline mask mandate is &#8220;beyond&#8221; the agency&#8217;s authority.

17 GOP Congress Members Sue The CDC To End Air Travel Mask Mandate

Centers for Disease Control and Prevention (CDC) Director Dr. Rochelle Walensky privately told lawmakers recently that the agency has no plans to relax school mask guidance.
Walensky’s private statements were revealed in audio of a closed-door House Energy and Commerce Committee meeting <a href="https://reason.com/2022/02/16/cdc-rochelle-walensky-masks-schools-covid-leaked-audio/">leaked</a> to Reason. The briefing took place virtually on Tuesday and included testimony from Walensky, White House COVID-19 adviser Anthony Fauci, and Assistant Secretary for Preparedness and Response within the U.S. Department of Health and Human Services Dawn O&#8217;Connell.
&#8220;The CDC provides guidance,&#8221; Walensky told lawmakers in the recording. &#8220;Our guidance currently is that masking should happen in all schools right now.&#8221;
The audio also reveals that Walensky “faced criticism—from members in both parties—that the CDC&#8217;s guidance is confusing and out of step with human behavior at this stage of the pandemic,” Reason’s Robby Soave reported.
Rep. Cathy McMorris Rodgers (R-WA), grilled Walensky about the science behind school masking, and brought up how the Arizona study regularly cited by the CDC as supporting continued masks for children was thoroughly critiqued in <a href="https://www.theatlantic.com/science/archive/2021/12/mask-guidelines-cdc-walensky/621035/">an article</a> for The Atlantic.
&#8220;What we see in the U.S. is an outlier as it relates to the mask mandate for our children to go to school,&#8221; McMorris Rodgers told Walensky in the audio, according to Reason. &#8220;[The World Health Organization and UNICEF] have both recommended against masking for kids under the age of five because it&#8217;s going to do more harm than good. For children ages 6 to 11, they think that we should be considering other factors like learning and social development. My question today, my one question, is Dr. Walensky, will you commit to update your guidance by Friday to allow children in person without the burden of masks?&#8221;
Walensky refused to make the commitment, though she did acknowledge the “limitations” of the Arizona study and other studied the CDC has used to continue pushing masks in schools.
&#8220;They all have limitations, and that&#8217;s important to recognize because we are not randomizing schools,&#8221; she said. &#8220;We have to control for whether there are windows, ventilation, and other activities happening outside of these schools. So all of these studies have limitations. But they are for the most part uniformly pointing to that when there&#8217;s a lot of disease out there, the masks are preventing that disease and preventing that transmission and because of that we are able to keep our schools open.&#8221;
Another Republican, Rep. Gary Palmer of Alabama, asked Walensky how the CDC could justify continued mask requirements in schools. Walensky responded by defending the current mask guidance and added that local governments could disregard it.
&#8220;I will also say that guidance is just guidance, and all of these decisions, we&#8217;ve continued to say, have to be made at the local level,&#8221; she said, according to Reason. &#8220;As cases come down dramatically, we have deferred our guidance to the local jurisdictions.&#8221;
Democratic Rep. Anna Eshoo of California also questioned why the CDC wasn’t clearer about the level of caution still needed.
&#8220;You hear the word confusion over and over again,&#8221; said Eshoo. &#8220;But here&#8217;s another one for you: masking. You know where I live in the Bay Area, the peninsula in the heart of Silicon Valley? Schools, cities, towns, counties: you&#8217;re saying one thing, and they&#8217;re doing something else. And this is a highly educated area, too. I trust our public health officials here. So my first question and my second point to you, Dr. Walensky, why do we have to be on two different tracks? Isn&#8217;t there some kind of public health consensus about this?&#8221;
Walensky then started reciting national case and death numbers, but Eshoo cut her off, asking the CDC director to consider various localities when answering.
&#8220;Absolutely,&#8221; said Walensky. &#8220;We know that all of these decisions have to be made at the jurisdictional level. So not only do we report the national data, but we have to report them at the jurisdictional level, because we know that we ask the jurisdictions to look at their local context, to look at their local cases, to look at how their hospitals are doing, to look at their local death rates. And that is exactly what I think is happening across the country in a phased way. Many different policies are rolling out. Some are saying they&#8217;re removing masks. Now some are saying they&#8217;re removing masks at the end of the month. Some say we&#8217;re removing masks at the end of the month, but not yet for schools. And so this is really happening at the jurisdictional level. And what we&#8217;re recommending is that given right now, where we are for cases, that the masks should still stay on.&#8221;
Eshoo then criticized Walensky for suggesting people are checking the CDC website to determine policy based on local COVID-19 numbers.
&#8220;I think that&#8217;s confusing, and I do think that it puts a dent in CDC credibility,&#8221; said Eshoo. &#8220;Credibility is everything in this. Who are you going to pay attention to? So, I mean, it goes to that and I think it&#8217;s troubling. They&#8217;re making it sound as if, you know, all of these local entities, public health directors, whatever, are not paying attention to the CDC. That&#8217;s the way it looks to me. All right? That&#8217;s the way it looks. That&#8217;s the way it sounds. So I don&#8217;t know. What should I tell my constituents? Oh, look at their website. I don&#8217;t think that&#8217;s a good answer, honestly.&#8221;

Supreme Court Justice Sonia Sotomayor claimed last week that 100,000 children were in &#8220;serious condition&#8221; with COVID-19 — the real number is closer to 5000 — and the hosts of ABC&#8217;s &#8220;The View&#8221; shrugged it off: &#8220;It happens.&#8221;
Sotomayor made the erroneous statement during oral arguments on President Joe Biden&#8217;s vaccine mandates — both for health care workers and for corporations with more than 100 employees:
&#8220;We have hospitals that are almost at full capacity with people severely ill on ventilators. We have over 100,000 children, which we&#8217;ve never had before, in serious condition, many on ventilators,&#8221; she said.
Critics quickly <a href="https://www.foxnews.com/media/washington-post-sotomayor-false-covid-claim-100kchildren-serious-condition">refuted the claim</a> — The Washington Post called it &#8220;wildly incorrect,&#8221; citing data from the U.S. government suggesting that pediatric hospitalizations were around 5000, including observation beds. By all accounts, Sotomayor&#8217;s numbers were off — by upwards of 95,000 — but the hosts of &#8220;The View&#8221; argued that the real problem was that not enough people had gotten vaccinated yet.
&#8220;Well, first I just want to re-frame this a little bit about Justice Sotomayor,&#8221; Sunny Hostin began. &#8220;Well, you know, she may not be accurate for current hospitalizations in children she’s correct that we have more children in the hospital now more than ever before, and it’s certainly reflects the current cases in children, right now, we have 82,843 children sick with COVID. More than a 1,000 children have died from the virus. In addition, about 7.8 million children have caught COVID since the pandemic started, and so those are just the numbers and so, while fewer than 83,000 kids have been hospitalized with the virus we have kids sick with COVID more than we ever have before so that’s a real thing and those are real numbers.&#8221;

Hostin went on to say that she wasn&#8217;t ready to adopt the CDC&#8217;s new, relaxed guidance reducing the recommended isolation time from ten days to five and no longer requiring a negative test.
&#8220;I don’t believe that, I think that after five days if you’re not testing you can certainly still be infectious and you can certainly still spread the virus the other people, and I have to wonder, Whoopi, I mean, is it a business decision that was made? Is it that there’s a staff shortage? Is it that there&#8217;s a shortage of essential workers? And they just need people to get back to work because there are so many unvaccinated people? &#8230; I think people just need to get with the program and get vaccinated.&#8221;
&#8220;I want to say, you know, about Sotomayor — Justice Sotomayor, Sonia Sotomayor — I think she made a mistake in her numbers, she’s not the first Supreme Court justice to make a mistake nor will she be the last, it happens,&#8221; cohost <a href="https://dailywire.com/news/he-was-sexually-harassing-himself-cnns-navarro-defends-toobin-offers-unique-take-on-him-masturbating-during-zoom-call/">Ana Navarro</a> added, noting that the number that had really stood out to her was one given by Education Secretary Miguel Cardona. &#8220;He said there were 140,000 school age children at that time who have lost at least one parent to COVID, there are children who are in terrible conditions right now, going through grief because of what COVID has cost our children and the way to get to herd immunity is for all of us to get vaccinated.&#8221;
