Nashville City Council members denied that the United States is facing an invasion from illegal aliens and instead blamed Europeans for their “invasion” of America in 1492 amid an ongoing battle over the city’s response to illegal immigration.
The comment came in a <a href="https://www.instagram.com/p/DKNErrHOehh/?ref=pamphleteer.co">letter</a> from the Nashville city council&#8217;s Immigrant Caucus, which slammed fellow council member David Benton after he spoke alongside Rep. Andy Ogles (R-TN) as the congressman called for an investigation into Nashville Democratic Mayor Freddie O’Connell, who condemned raids by Immigration and Customs Enforcement (ICE) in Music City.
The Caucus, which is chaired by council member Terry Vo, accused Benton of pushing “racist propaganda” and turned its ire to “European colonizers.”
“We remind him, and the public, that the only true ‘invasion’ of this land occurred in 1492 with the arrival of European colonizers,” the statement reads as it addresses Benton in an apparent reference to Christopher Columbus. “To weaponize the concept of invasion against immigrant communities is both historically ignorant and morally reprehensible.”
The letter falsely claimed that the illegal aliens captured by ICE &#8220;are not criminals,&#8221; and even called illegal aliens the “backbone of this city and this nation.”

Beyond unlawfully entering the United States, which is itself a crime, many of the illegal aliens captured by ICE have been convicted of additional offenses. The Supreme Court ruled on Friday that the Trump administration can revoke protected status for more than 500,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela from deportations.
The unsigned decision was not a final ruling on the case, but it will allow the Trump administration to continue its mass deportation efforts as an appeal of the president&#8217;s order plays out in the courts, The New York Times <a href="https://www.nytimes.com/2025/05/30/us/politics/trump-immigration-supreme-court.html" target="_blank" rel="noopener">reported</a>. Justices Ketanji Brown Jackson and Sonia Sotomayor signed onto a written dissent, arguing that the court&#8217;s decision would have “the devastating consequences of allowing the government to precipitously upend the lives and livelihoods of nearly half a million noncitizens while their legal claims are pending.&#8221;
The ruling centers on former President Joe Biden&#8217;s humanitarian parole program that allowed migrants from certain countries facing instability to enter the United States and quickly receive work authorization. On day one in office, President Donald Trump signed an executive order calling for the end of the migrant parole program, and the Department of Homeland Security responded by moving to terminate the program in March, Reuters <a href="https://www.reuters.com/world/us/trump-revokes-legal-status-530000-cubans-haitians-nicaraguans-venezuelans-2025-03-21/">reported</a>.
Biden opened up the United States to thousands of Venezuelans in 2022 and then to Cubans, Haitians, and Nicaraguans in 2023. After Trump moved to revoke the protected status for these migrants, lawyers representing many of the migrants sued, arguing that Trump&#8217;s &#8220;actions are not only illegal, but shockingly callous.&#8221; Biden&#8217;s parole program also extended to around 240,000 Ukrainians, but the Trump administration has not yet sought to revoke protected status for the Ukrainians fleeing the war.

The Trump administration&#8217;s move to terminate the parole program was paused by a federal judge in Massachusetts in March, and that pause was upheld by an appeals court earlier this month. Solicitor General D. John Sauer argued in a May 8 emergency application to the Supreme Court that DHS Secretary Kristi Noem has “broad discretion over categories of immigration determinations” and has the power to revoke the protected status recognized under Biden&#8217;s parole program, according to the Times.
Sauer <a href="https://www.supremecourt.gov/DocketPDF/24/24A1079/358354/20250508121118618_Kristi_Noem_v_Svitlana_Doe_et_al_%20application_stay.pdf">wrote</a> that the district court upended &#8220;critical immigration policies that are carefully calibrated to deter illegal entry, vitiating core Executive Branch prerogatives, and undoing democratically approved policies that featured heavily in the November election.&#8221;
The Supreme Court&#8217;s Friday decision is its second ruling this month that allows Trump to seek the removal of migrants from the United States as an appeals process plays out. On May 19, the Supreme Court <a href="https://www.dailywire.com/news/scotus-allows-trump-to-end-temporary-protected-status-for-certain-migrants">ruled</a> 8-1 that the Trump administration can remove Temporary Protected Status (TPS) for around 350,000 Venezuelan migrants who were allowed to remain in the United States under the Biden administration.

Nashville’s Democrat mayor released the names of multiple federal law enforcement agents with Immigration and Customs Enforcement (ICE), drawing ire from the Department of Homeland Security (DHS) and Sen. Marsha Blackburn, who say that the mayor is putting law enforcement at risk.
Mayor Freddie O’Connell’s office <a href="https://x.com/KarenAFox17/status/1927828245686194453">released</a> information on interactions between ICE agents and Nashville emergency service personnel, dropping data that included the names of federal law enforcement personnel. O’Connell says their names were released by mistake, but the Department of Homeland Security isn’t convinced.
“They claimed it was a mistake. There’s zero chance it was a mistake and there will be repercussions,” DHS Assistant Secretary Tricia McLaughlin charged in response to the incident. “Our ICE enforcement officers are already facing a 400% increase in assaults against them and he’s essentially handing over intelligence to these criminal gangs so they can target our ICE enforcement officers. It’s wrong. It’s beneath the city of Nashville.”

A Democrat Congressman spent Memorial Day attempting to visit a deported illegal alien with ties to MS-13 who stands accused of beating his wife and trafficking other illegal aliens.
Democrat Rep. Glenn Ivey (D-MD) attempted to visit Kilmar Abrego Garcia, an illegal alien with ties to MS-13 who was deported to his home country of El Salvador, on a day reserved for honoring America’s fallen soldiers.
Ivey even referred to Abrego Garcia, who was erroneously dubbed a “Maryland man” by much of the media despite being an illegal alien, as “my constituent” in a post on X. “Today, I was denied access to seeing my constituent, Mr. Kilmar Abrego Garcia,” the Maryland Democrat wrote in the post. “Let his lawyer and I check on him.”

“I’m the Congressman who represents Kilmar,” Ivey said in a video. “I came all the way down from the United States,” he went on to say before complaining that he was unable to visit with the Salvadoran citizen.
Abrego Garcia was deported to El Salvador, where he remains imprisoned in the country’s Terrorism Confinement Center, a prison for members of violent gangs that have plagued the Central American nation. Multiple courts found that Abrego Garcia is connected to MS-13, a vicious gang that the Trump administration designated as a foreign terror organization.
Abrego Garcia also stands accused of beating his wife. Abrego Garcia’s wife even filed a request for a <a href="https://www.dailywire.com/news/deported-illegal-immigrant-who-dems-have-championed-accused-of-beating-wife-court-docs">protective order</a> against him, claiming that he bragged that he could kill her and get away with it. The wife of the illegal alien claims that Abrego Garcia “told my ex-mother-in-law that even if he kills me no one can do anything to him.”

“Me and my kids are afraid now. He kicked me, pushed me, slapped me in the face and threatened me,” she said, according to the legal document.
Abrego Garcia is also suspected of trafficking other illegal aliens into the United States. Body-camera <a href="https://www.dailywire.com/news/police-suspected-maryland-man-of-getting-paid-to-traffic-illegals-body-cam-footage-shows?author=Spencer+Lindquist&amp;category=News&amp;elementPosition=16&amp;row=0&amp;rowType=Vertical+List&amp;title=Police+Suspected+%E2%80%98Maryland+Man%E2%80%99+Of+%E2%80%98Getting+Paid%E2%80%99+To+Traffic+Illegals%2C+Body+Cam+Footage+Shows">footage</a> from the Tennessee Highway Patrol reveals that one law enforcement agent suspected Abrego Garcia of trafficking illegal aliens after he pulled him over.
“He’s getting paid to haul these people, probably to Maryland, I would say,” an officer says on the footage after speaking with Abrego Garcia, who was driving a car full of men who claimed not to speak English or have driver&#8217;s licenses.
Ivey is only the latest Democrat to fly to El Salvador in hopes of visiting the illegal alien. Sen. Chris Van Hollen (D-MD), who similarly claimed that Abrego Garcia is a “constituent” of his, <a href="https://www.dailywire.com/news/dem-senator-van-hollen-did-not-ask-deported-illegal-immigrant-ms-13">visited</a> the illegal alien last month. The Democrat did not, however, ask the man if he had any connections to MS-13.
Three more Congressman &#8212; Rep. Maxwell Frost (D-FL), Robert Garcia (D-CA), and Yassamin Ansari (D-AZ) &#8212; traveled to the Central American country, but were <a href="https://thehill.com/homenews/5259931-house-democrats-denied-meeting-abrego-garcia-demand-daily-proof-of-life/">denied a meeting</a> with Abrego Garcia. They instead met with the United States Ambassador to El Salvador and called on him to advocate for the illegal alien’s release.
Salvadoran President Nayib Bukele confirmed that he will not return Abrego Garcia to the United States during a <a href="https://www.dailywire.com/news/trump-officials-bukele-tear-into-cnn-reporter-who-asked-if-illegal-alien-will-be-returned-to-u-s">meeting</a> with President Donald Trump and administration officials in the Oval Office last month, which came on the heels of a Supreme Court order for the administration to &#8220;facilitate&#8221; the return of Abrego Garcia to the United States.
“The question is preposterous, how can I smuggle a terrorist into the United States?” Bukele said in response to a journalist who asked if he would facilitate the man’s return to the United States. “I’m not very fond of releasing terrorists into our country … we just turned the murder capital of the world into the safest country in the western hemisphere and you want us to go back?” Bukele went on to say. “That’s not going to happen.”

Topline: As new details continue to emerge regarding the White House cover-up of former President Biden’s decline while in office, the legacy media is facing new pressure for its role in the scandal.
The slow drip of stories on Biden’s decline has turned into a waterfall. On Tuesday, the authors of the new bombshell book &#8220;Original Sin&#8221; – CNN’s Jake Tapper and Axios’ Alex Thompson – revealed the existence of what they called a “politburo” of longtime advisors who were, if not making the decisions for President Biden, heavily influencing his decisions: Mike Donilon, Steve Burschetti, Ron Klain and Bruce Reed.

We’ve also learned that during the 2024 campaign, Biden’s team spent millions of dollars organizing a staged town hall event, with hand-picked attendees asking friendly, pre-written questions. The plan was for clips of that orchestrated event to be used in TV ads. But according to reporting in the new book, the 90-minute event was a disaster, with Biden unable to string together coherent answers. As one staffer put it, “the man could not speak.” It was so bad that the campaign never aired any footage, blaming poor lighting instead of the president’s mental capabilities. That story and countless others have drawn outrage from folks asking just how many people were involved in concealing Biden’s cognitive decline.
Much of that outrage has been directed at the former president’s inner circle, but people are also asking questions about the media’s role. For years, many of the country’s most prominent outlets and news anchors parroted White House talking points that President Biden was totally fit for office and locked in behind closed doors. For example, just to pick a name out of the hat, in a 2020 interview with Lara Trump, Tapper himself was <a href="https://x.com/LaraLeaTrump/status/1806420367415914571">so incensed</a> by claims that then-candidate Biden was showing signs of cognitive decline that he ended the interview early. Tapper has since admitted that conservatives were right all along for questioning Biden’s mental fitness.
But plenty of people don’t buy the excuse that the legacy media were totally in the dark about Biden’s mental and physical decline and believe journalists are only changing their tune now because they’re trying to save their credibility.

Daily Wire White House Correspondent Mary Margaret Olohan spoke with Homan on Wednesday.  He made a case for why ICE needs more money to continue to secure the border, increase deportations, and clean up sanctuary cities.
“We&#8217;ve made a lot of progress on the border, but we want to keep it permanent,” Homan told The Daily Wire. “We need the money, not just for the border, but interior enforcement operations… ICE is in the hole right now. They got about 50,000 people in beds. We&#8217;re funded for 34,000. Ice is already in the hole, so if we want to continue this massive deportation operation, we need more money.”
Homan said that if Congress authorizes the spending, ICE will prioritize getting more teams on the streets and more bed space for detainees, as well as more frequent flights to remove illegal aliens from the United States more quickly.
“There&#8217;s no downside on a secure border and there&#8217;s no downside in less trafficking of women and children. There&#8217;s no downside in less fentanyl, there&#8217;s no downside in less people on terrorist watch list coming across, there&#8217;s no downside in taking billions of dollars away from the cartels. There&#8217;s no downside in removing public safety threats and national security threats from this country. We should all be on the same page. So step up, get this done. Give us the money we need so we can keep President Trump&#8217;s promise to American people alive.”

Topline:  The U.S. Supreme Court has sided with a Maine Republican after Democrats punished her for drawing attention to controversial transgender policies in the state.
Maine state Rep. Laurel Libby was censured by Democrats back in February in a party-line vote over a post she published on Facebook that highlighted a male athlete winning a state championship in the girls’ high school pole vault competition. In Maine, males who identify as transgender are allowed to participate in female sports – which, according to all polling, is not a policy supported by the American people, even in a liberal state like Maine.
“The Democrat majority in the Maine House voted to censure me and at the same time to strip my constituents of their voice and their vote,” Libby told The Daily Wire. “Following that, the censure vote is when Speaker Ryan Fecto declared that until I apologize, I would not be allowed to speak or vote on the floor.”
Libby refused to take down her Facebook post and would not apologize. For that, she’s been stripped of her right to vote and speak on the House floor for months. Libby told The Daily Wire she knew &#8220;immediately&#8221; that she had to take legal action to challenge her punishment. She lost at the district and appeals court levels, before she appealed to the Supreme Court in April. The court sided with Libby and ruled 7-2 that she can vote while her legal battle is playing out. There were only two dissents, from liberal justices Ketanji Brown Jackson and Sonia Sotomayor. 
The Trump administration is still fighting the state’s Democratic Gov. Janet Mills over her decision to defy President Donald Trump&#8217;s executive order barring males from girls&#8217; spaces and sports. The feds have frozen federal funding for the state, and last month, Attorney General Pam Bondi <a href="https://www.dailywire.com/news/bondi-unleashes-on-maine-announces-new-lawsuit-against-state-for-violating-title-ix">announced a civil lawsuit</a> against Maine’s Department of Education.

The Department of Homeland Security (DHS) on Wednesday spotlighted the criminal records of eight illegal aliens who were deported to South Sudan as it gears up for a fight with a judge who could order them to be returned to the United States.
Immigration and Customs Enforcement (ICE) explained that the illegal aliens’ countries of origin were unwilling to take them back.
“We conducted a deportation flight from Texas to remove some of the most barbaric, violent individuals illegally in the United States,” <a href="https://www.youtube.com/watch?v=_zg1o9hJES0">said</a> Tricia McLaughlin, the Assistant Secretary of Public Affairs for the agency. “No country on earth wanted to accept them because their crimes are so uniquely monstrous and barbaric,” McLaughlin added before explaining that South Sudan was “willing to accept custody” of the illegal alien criminals.
However, U.S. District Judge Brian Murphy of Massachusetts has <a href="https://www.foxnews.com/politics/federal-judge-orders-trump-administration-track-deported-immigrants-south-sudan">ordered</a> the Trump administration to maintain custody of the deported illegals “to ensure the practical feasibility of return if the Court finds that such removals were unlawful.”
“A local judge in Massachusetts is trying to force the United States to bring back these uniquely barbaric monsters who present a clear and present threat to the safety of American people,” McLaughlin charged before calling it “absurd” that the judge would attempt to “dictate the foreign policy and national security of the United States of America.”
The plane landed in the nearby country of Djibouti on Wednesday, the New York Times <a href="https://www.nytimes.com/2025/05/21/us/south-sudan-deportation.html">reported</a>. The eight men on the deportation flight were convicted of a range of crimes, including murder, kidnapping, robbery, and sexual assault, according to DHS.

DHS <a href="https://www.foxnews.com/politics/dhs-exposes-crimes-migrants-deported-south-sudan-judge-threatens-order-return">identified</a> one of the men as Enrique Arias-Hierro, a Cuban national arrested by ICE in May and convicted of homicide, armed robbery, false impersonation of an official, kidnapping, and strong-arm robbery. He was joined by another Cuban national named Jose Manuel Rodriguez-Quinones, who has been convicted of first-degree murder with a weapon, battery and larceny, and trafficking and possessing cocaine.
Another deported was Tuan Thanh Phan of Vietnam, who was convicted of first-degree murder and second-degree assault. Laotian national Thongxay Nilakout, who was also convicted of first-degree murder, was also on the flight to South Sudan, as was Mexican national Jesus Munoz-Gutierrez, who had been convicted of second-degree murder.
There’s also a pair of convicted Burmese sex offenders: Kyaw Mya of Burma, a criminal convicted of “lascivious acts with a child-victim less than 12 years of age,” and Nyo Myint, who was convicted of “first-degree sexual assault involving a victim mentally and physically incapable of resisting” as well as aggravated assault.
Only one of the eight men sent to South Sudan is originally from the African nation. Dian Peter Domach, who was captured by ICE in May, was found in “possession of burglar’s tools and possession of defaced firearm,” and convicted of  “robbery and possession of a firearm.”
The potential legal battle would mark the latest ruling from the judiciary to prevent the Trump administration’s deportation of criminal illegal aliens. United States District Judge James Boasberg, whose wife donated to Democratic candidates and opened a Washington, D.C.-area abortion clinic, <a href="https://www.dailywire.com/news/meet-the-obama-appointed-judge-trying-to-stop-trump-from-deporting-criminal-illegals">hindered</a> the administration’s efforts to deport illegal aliens who are suspected gang members to El Salvador.

The Supreme Court on Friday ruled 7-2 against the Trump administration&#8217;s attempt to swiftly deport Venezuelan gang members under the Alien Enemies Act, requiring officials to provide more than 24 hours for detainees to challenge their removal.
&#8220;Under these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster,&#8221; the majority wrote.
The unsigned <a href="https://www.supremecourt.gov/opinions/24pdf/24a1007_g2bh.pdf">decision</a> clarified that the Court was only ruling on the notice requirement and not whether the Trump administration can use the Alien Enemies Act itself.
&#8220;To be clear, we decide today only that the detainees are entitled to more notice than was given on April 18,&#8221; the Court stated in its ruling, NBC News <a href="https://www.nbcnews.com/politics/supreme-court/supreme-court-trump-administration-venezuelans-alien-enemies-act-rcna202094">reported</a>.
The Alien Enemies Act, enacted in 1798, allows the president to apprehend and deport citizens of a hostile nation during wartime or invasion.
Administration officials argued that Venezuela&#8217;s government has used Tren de Aragua as a proxy force, effectively weaponizing the gang to destabilize the United States through criminal activity and drug trafficking.
Conservative Justices Samuel Alito and Clarence Thomas dissented, with Alito writing there were no grounds for the Court to intervene &#8220;at such an early stage of the litigation.&#8221;
&#8220;The Court&#8217;s failure to defer to the Executive Branch in immigration matters in which national security is at stake represents an extraordinary departure from our precedents,&#8221; Alito wrote.
The Court did acknowledge it was &#8220;far removed from the circumstances on the ground&#8221; and was not best positioned to determine the exact deportation process that should be followed.
The case has been sent back to an appeals court to establish appropriate due process procedures for the detainees in yet another legal impediment to Trump’s immigration agenda.
President Trump on Friday accused the high court of &#8220;being played by the radical left,&#8221; who only succeed through &#8220;intimidation of the court.&#8221;

“Today’s ruling effectively extends the temporary freeze that the justices put on Alien Enemies Act removals from the Northern District of Texas back on April 19,” <a href="https://www.cnn.com/2025/05/16/politics/supreme-court-alien-enemies-act">said</a> Steve Vladeck, CNN Supreme Court analyst and professor at Georgetown Law.
“Because lower courts have blocked use of the act in every other district in which the president has sought to invoke it, that means it’s effectively pausing all removals under the act until the 5th Circuit – and, presumably, the Supreme Court itself – conclusively resolves whether they’re legal and how much process is due if so.”

The Trump administration ended Temporary Protected Status (TPS) for all Afghan refugees on Monday, paving the way for the deportation of tens of thousands of Afghans living in the United States.
Homeland Security Secretary Kristi Noem <a href="https://www.uscis.gov/newsroom/news-releases/dhs-terminating-temporary-protected-status-for-afghanistan#:~:text=WASHINGTON%20%E2%80%93%20Secretary%20of%20Homeland%20Security,effective%20on%20July%2012%2C%202025." target="_blank" rel="noopener">said</a> that improving conditions in Afghanistan have made it possible for the refugees to return home. The Biden administration brought in around 76,000 Afghans following the U.S. military&#8217;s disastrous withdrawal from the country in 2021 under the orders of President Joe Biden. Most of the Afghan refugees were <a href="https://www.cbsnews.com/news/afghan-evacuees-resettled-us-texas-california-virginia/" target="_blank" rel="noopener">resettled</a> in Texas, California, and Virginia.
&#8220;This administration is returning TPS to its original temporary intent,&#8221; Noem said. &#8220;We’ve reviewed the conditions in Afghanistan with our interagency partners, and they do not meet the requirements for a TPS designation. Afghanistan has had an improved security situation, and its stabilizing economy no longer prevent them from returning to their home country.&#8221;
Following the Trump administration&#8217;s move, deportation protections for Afghans will expire in 60 days, which is the minimum time allowed by law after the notice is filed.
Between 2010 and 2022, the Afghan population in the United States skyrocketed from 54,000 to 195,000. It&#8217;s unclear how many of those nearly 200,000 Afghans received legal permanent residency or citizenship in the United States. In 2006, the United States <a href="https://www.migrationpolicy.org/article/afghan-immigrants-united-states-2022#:~:text=In%20the%20past%20decade%2C%20the,top%20country%20for%20Afghan%20migrants." target="_blank" rel="noopener">started</a> the Special Immigrant Visa (SIV) program, which sought to help Afghan and Iraqi translators who helped the U.S. military receive their green cards. The federal government expanded the SIV program in 2009 to apply to any Afghan national who was employed by the U.S. government.
The U.S. withdrawal from Afghanistan in August of 2021 created another crisis for Afghan nationals who sought to quickly flee the country. Immediately after the United States evacuated Afghanistan, the country came under the control of the Taliban, which imposed harsh laws targeting Christians, certain Muslims, and those who were friendly toward the United States. The Taliban also took away any semblance of women&#8217;s rights, severely restricting how women dress and act in public.
Noem&#8217;s reasoning for ending TPS for Afghans cited Chinese tourism returning to the country and reduced warfare. Some remain <a href="https://www.foxnews.com/opinion/president-trump-protect-christian-afghan-refugees-who-fled-here-escape-martyrdom" target="_blank" rel="noopener">concerned</a>, however, that religious minorities who are forced to return to Afghanistan will face persecution or even martyrdom.
Afghanistan also continues to face widespread food insecurity, but Noem wrote in her <a href="https://public-inspection.federalregister.gov/2025-08201.pdf" target="_blank" rel="noopener">analysis</a>, &#8220;Though humanitarian need remains prevalent, the number of those in need of assistance has declined to 23.7 million this year, a decrease from the more than 29 million Afghan nationals in need reported the previous year.&#8221;

The Trump administration is &#8220;actively&#8221; considering suspending habeas corpus as it seeks to continue its mass deportation efforts that are being hindered by federal judges.
White House Deputy Chief of Staff Stephen Miller said on Friday that the Constitution makes it &#8220;clear&#8221; that the writ of habeas corpus, which allows a person to petition a court to review the legality of their detention, can be &#8220;suspended in a time of invasion.&#8221;
“So, it’s an option we’re actively looking at,&#8221; Miller said, adding that &#8220;it depends on whether the courts do the right thing or not.”
Multiple federal judges have stopped Trump from carrying out his deportation agenda by blocking the administration&#8217;s use of the Alien Enemies Act. The Trump administration was using the 1798 Alien Enemies Act to quickly deport Venezuelan illegal immigrants that it said were violent criminals and gang members. The president <a href="https://truthsocial.com/@realDonaldTrump/posts/114466868060900843" target="_blank" rel="noopener">blasted</a> &#8220;activist judges&#8221; on Wednesday, calling on them to allow the deportation of &#8220;murderers, and other criminals who have come into our Country illegally, WITHOUT DELAY!!!
&#8220;Our Court System is not letting me do the job I was Elected to do,&#8221; Trump added.
Miller also argued on Friday that the Immigration and Nationality Act, which was passed by Congress in 1965, strips the judicial branch&#8217;s jurisdiction &#8220;from overruling a presidential determination or a secretarial determination on TPS [temporary protected status].&#8221;
&#8220;So when Secretary [Kristi] Noem terminated TPS for the illegals that Biden flew into the country, when the courts stepped in, they were violating explicit language that Congress had enacted. &#8230; So the courts aren’t just at war with the executive branch, the courts are at war — these radical, rogue judges — with the legislative branch as well. So all of that will inform the choices the president ultimately makes,&#8221; Miller said.

If the White House attempts to suspend habeas corpus by arguing that the United States is being invaded, the move would likely be challenged, creating another battle between the courts and the president. Habeas corpus has been <a href="https://constitutioncenter.org/the-constitution/articles/article-i/clauses/763" target="_blank" rel="noopener">suspended</a> four times throughout U.S. history. The first time was during the Civil War, and then again during Reconstruction while the federal government was going after the Ku Klux Klan. It was also suspended in the Philippines in 1905 during an insurrection and in Hawaii after the attack on Pearl Harbor in 1941.
Trump rebuffed an order from Judge James Boasberg on March 15 after the judge said the administration must return deportation flights carrying Venezuelans to El Salvador. The deportation fight eventually made its way up to the Supreme Court, which blocked Trump from deporting suspected Tren de Aragua gang members under the Alien Enemies Act &#8220;until further order of this Court.&#8221;

Illegal immigrants who self-deport will receive a $1,000 stipend under a plan that the Trump administration says will protect law enforcement and save American tax dollars, the Department of Homeland Security announced on Monday.
Along with giving illegal immigrants a $1,000 stipend, Fox News <a href="https://www.foxnews.com/politics/dhs-unleashes-possible-money-saving-measure-illegal-aliens-self-deport" target="_blank" rel="noopener">reported</a> that the Trump administration would also pay for the cost of airfare. The total cost for the stipend and airfare would be around $4,500 on average, a significant reduction from the estimated $17,000 it costs the federal government to detain and deport an illegal immigrant, according to DHS, which added that illegal immigrants would not receive the stipend until it was verified that they had left the United States.

The CBP Home App, initially launched as the CBP One App under the first Trump administration to help with truck inspections at the border, was repurposed by the Biden administration to help migrants claim asylum in the United States. Under the new Trump administration, the app is being used mainly to help illegal immigrants return to their home countries as President Donald Trump focuses on his deportation operation.
According to Fox News, DHS acknowledged the concerns of some critics who argue that the $1,000 stipends reward those who illegally entered the country. The DHS, however, argued that the initiative&#8217;s cost-cutting function and the overall goal of mass deportations are justifiable reasons to pay illegal immigrants to leave the United States.
Last month, the department said it would <a href="https://www.dailywire.com/news/trump-admin-to-fine-illegal-aliens-nearly-1k-a-day-for-refusing-to-self-deport" target="_blank" rel="noopener">fine illegal immigrants</a> nearly $1,000 a day if they remain in the United States beyond their removal date. The fines would also be retroactive, stretching back up to five years and hitting some illegal immigrants with more than $1 million in fines. Trump wants Customs and Border Protection to administer the penalties and seize the property of those who cannot pay.
At the end of March, the Trump administration said it had <a href="https://nypost.com/2025/03/31/us-news/ice-arrested-113k-deported-over-100k-since-trumps-return-as-prez-maintains-promise-to-boot-illegal-migrants-alleged-gangbangers-sources/" target="_blank" rel="noopener">deported</a> more than 100,000 illegal immigrants since Trump was sworn in on January 20. The administration has said it is focused on going after illegal immigrants who are accused of being violent gang members, sending them to a notorious prison in El Salvador. Trump has been celebrating his action on deportations, <a href="https://www.axios.com/2025/04/28/trump-posters-white-house-arrested-immigrants" target="_blank" rel="noopener">placing</a> mug shots of arrested illegal immigrants along the White House driveway last week.

Trump Admin To Pay Illegal Immigrants To Self-Deport, Says It Will Save 70% ‘For U.S. Taxpayers’

President Trump blasted the courts early Saturday after a federal judge blocked his administration from using the 1798 Alien Enemies Act to deport Venezuelan gang members.
&#8220;Can it be so that Judges aren&#8217;t allowing the USA to Deport Criminals, including Murderers, out of our Country and back to where they came from?&#8221; Trump <a href="https://truthsocial.com/@realDonaldTrump/posts/114442321106427795">wrote</a> on Truth Social.
&#8220;If this is so, our Country, as we know it, is finished! Americans will have to get used to a very different, crime filled, LIFE. This is not what our Founders had in mind!!!&#8221; he added.
The ruling came from U.S. District Judge Fernando Rodriguez Jr., who determined Thursday that the 18th-century law can only be used when an &#8220;organized, armed force&#8221; threatens the United States, a standard he did not apply to multinational South American gangs.
Rodriguez rejected the administration&#8217;s argument that the law could target alleged members of the Tren de Aragua gang in his 36-page decision.
“The Proclamation makes no reference to and in no manner suggests that a threat exists of an organized, armed group of individuals entering the United States at the direction of Venezuela to conquer the country or assume control over a portion of the nation,” the judge wrote.
“Thus, the Proclamation’s language cannot be read as describing conduct that falls within the meaning of ‘invasion’ for purposes of the AEA,” he added.
The Alien Enemies Act, part of the four Alien and Sedition Acts signed by President John Adams in 1798, has rarely been invoked in modern times. Trump&#8217;s proclamation <a href="https://www.whitehouse.gov/presidential-actions/2025/03/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua/">activating</a> the centuries-old law in March represented a significant shift in immigration enforcement strategy, specifically targeting what the administration describes as transnational criminal organizations.
The administration deported more than 100 men to a high-security prison in El Salvador using the AEA, citing their tattoos and other evidence as proof of gang affiliation.
Continuing Trump&#8217;s aggressive immigration agenda, the administration has <a href="https://thehill.com/homenews/administration/5280834-donald-trump-judge-alien-enemies-act-ruling/">asked</a> the Supreme Court to end deportation protections for over 600,000 Venezuelans currently covered under Temporary Protected Status, per the Hill.
The case was brought by several Venezuelan nationals who claimed they were wrongfully targeted for deportation. Their attorneys argued that tattoos alone were insufficient evidence of gang affiliation and that many individuals were denied the opportunity to contest the allegations against them.
White House officials confirmed that the Justice Department plans to appeal Rodriguez&#8217;s ruling while exploring other legal options to continue the deportation of individuals they identify as gang members. The administration has maintained that aggressive immigration enforcement remains central to its public safety agenda.

U.S. District Court Judge Fernando Rodriguez Jr. ruled on Thursday that President Donald Trump and his administration could not use the Alien Enemies Act to uphold the deportations of Venezuelan nationals to El Salvador.
<a href="https://storage.courtlistener.com/recap/gov.uscourts.txsd.2000771/gov.uscourts.txsd.2000771.58.0_1.pdf" target="_blank" rel="noopener">Rodriguez</a> stated that the Act — first enacted in 1798 — did not apply unless the United States was facing an &#8220;armed, organized attack,&#8221; and argued that the influx of illegal alien gang members and terrorists did not meet that particular qualification.
&#8220;The Proclamation exceeds the scope of the statute and, as a result, is unlawful. [Administration officials] do not possess the lawful authority under the AEA, and based on the Proclamation, to detain Venezuelan aliens, transfer them within the United States, or remove them from the country,&#8221; he wrote in his decision.
The Trump administration argued that Venezuelan prison gang Tren de Aragua, a &#8220;designated Foreign Terrorist Organization[,] . . . is perpetrating, attempting, and threatening an invasion or predatory incursion against the territory of the United States,&#8221; and based on that, &#8220;all Venezuelan citizens 14 years of age or older who are members of TdA, are within the United States, and are not actually naturalized or lawful permanent residents of the United States are liable to be apprehended, restrained, secured, and removed as Alien Enemies.&#8221;
Rodriguez disagreed, however, but he did leave room for recourse: he also noted in his ruling that once the court determined the definition of &#8220;invasion&#8221; or &#8220;incursion,&#8221; the administration would be free to present any evidence they believed showed such and &#8220;invasion&#8221; or &#8220;incursion&#8221; had, in fact, occurred.
<blockquote>Some issues that Petitioners raise present a political question beyond judicial review. Once a court defines the parameters of what conduct constitutes an &#8220;invasion&#8221; or &#8220;predatory incursion&#8221; for purposes of the AEA, the court leaves to the Executive Branch the determination of whether such conduct has been perpetrated, attempted, or threatened. For example, a court may decide that one aspect of &#8220;invasion&#8221; and &#8220;predatory incursion&#8221; requires physical entry into the United States.
In other words, a court may conclude that no invasion or predatory incursion has occurred or has been threatened if the alleged conduct does not involve the entry of individuals into the country. The court having determined the meaning of these terms, it is left to the Executive Branch to determine whether a foreign nation or government has threatened or perpetrated activity that includes such an entry. As to this decision, the court may not delve into whether the Executive Branch possesses sufficient support for its conclusion, or whether the court agrees with the Executive Branch’s determinations.</blockquote>
