On October 7, 2023, the world watched in horror as Hamas terrorists invaded Israel and slaughtered 1,200 innocent men, women, and children. Hundreds of victims, including babies <a href="https://apnews.com/article/israel-hamas-hostages-gaza-kfir-bibas-birthday-490c428ef168655c9028dd612a15a35a" target="_blank" rel="noopener">as young as nine months old</a>, were taken hostage and <a href="https://www.cnn.com/2024/06/12/middleeast/andrey-kozlov-family-israel-hamas-gaza-intl/index.html" target="_blank" rel="noopener">subjected to abuse</a> and <a href="https://nypost.com/2024/07/12/world-news/rescued-hostage-details-physical-and-psychological-abuse-by-hamas/" target="_blank" rel="noopener">torture</a> at the hands of their captors.
It should have been a time for unity—to stand with our Jewish brothers and sisters against terrorism and hate. Instead, a lack of leadership allowed violence and anti-Semitic demonstrations to take hold over the nation. This was most evident at colleges and universities, where Jewish students were harassed and <a href="https://www.help.senate.gov/ranking/newsroom/press/ranking-member-cassidy-on-ongoing-antisemitic-attacks-harassment-of-jewish-students-on-college-campuses-renews-call-for-action" target="_blank" rel="noopener">physically attacked</a>. 
University officials failed to protect their students, let alone condemn these hateful acts. Some are refusing to take action against the violent demonstrators who overtook their campuses. According to <a href="https://edworkforce.house.gov/uploadedfiles/8.8.24_columbia_discipline_stats.png" target="_blank" rel="noopener">public documents</a>, Columbia University has not disciplined 18 of the 22 students who were arrested for occupying Hamilton Hall. 

Failed leadership on anti-Semitism is not only occurring at colleges and universities, but within the Biden-Harris administration.
Under Title VI of the Civil Rights Act, the Department of Education (DeptEd) must hold universities accountable for failing to address discrimination against students on campuses. Since October 7, the Biden-Harris administration has refused to penalize universities for violating Title VI and failing to address harassment and attacks against their Jewish students. In fact, there are 162 cases involving religious discrimination at colleges that have yet to be resolved by DeptEd.
It is the Senate’s obligation to examine the failures of universities and the Biden-Harris administration to protect Jewish students from discrimination. As the ranking member of the Senate Health, Education, Labor, and Pensions (HELP) Committee, I have <a href="https://www.help.senate.gov/ranking/newsroom/press/ranking-member-cassidy-reacts-to-resignation-of-columbia-university-president-renews-call-for-help-hearing-to-address-antisemitism" target="_blank" rel="noopener">repeatedly called on</a> HELP Chair Bernie Sanders (I-VT) to hold a bipartisan hearing on this issue. <a href="https://jewishinsider.com/2024/07/jacky-rosen-james-lankford-senate-roundtable-campus-antisemitism/" target="_blank" rel="noopener">Other Democrat senators</a> have called for a hearing in the Committee. Unfortunately, Chair Sanders has refused.
There are also bills before the HELP Committee to address anti-Semitism and discrimination against students. I am currently leading the Protecting Students on Campus Act, bipartisan legislation that ensures students know how to file civil rights complaints if they experience discrimination on college campuses. There is also the Antisemitism Awareness Act, which passed the House of Representatives last May by an overwhelming margin of 320 – 91.
These bills can make a difference, but Democrat leadership in the Senate has refused to consider them.
To be clear, the Senate has had plenty of time. For months, the Senate Majority Leader has wasted valuable floor time calling political show votes, and ramming through radical, hyper-partisan Biden-Harris nominees. If Democrat leaders wanted to address anti-Semitism, they could have done it.
This lack of action should not surprise anyone. The Democrat Party has spent months trying to appease and pander to Hamas sympathizers in fear that they will not vote for the party ticket in November. Instead of condemning the anti-Semitic demonstrations at the Democrat Party convention, President Biden <a href="https://www.foxnews.com/politics/biden-says-dnc-anti-israel-agitators-have-point-rips-trump-not-worthy-oval-office" target="_blank" rel="noopener">said these protestors</a> “have a point.” A protest where the <a href="https://www.foxnews.com/us/hamas-flag-spotted-anti-israel-rally-near-dnc-chicago-braces-possible-unrest" target="_blank" rel="noopener">Hamas flag is proudly flown</a> and demonstrators unapologetically support the terror attacks on October 7 should receive nothing but outrage and condemnation. Democrats’ legitimization of anti-Semitism in its ranks endangers Jewish students who continue to experience threats on their campuses.
The lack of leadership from the Senate Majority is unacceptable. Anti-Semitism on college campuses is not last year’s problem, it is happening now. Currently, police and federal law enforcement <a href="https://www.nbcnews.com/news/investigations/five-jewish-college-students-report-assaulted-last-month-rcna171727">are probing a second anti-Semitic assault</a> at the University of Pittsburgh. At the University of Michigan, at least <a href="https://www.freep.com/story/news/local/michigan/2024/09/24/jewish-student-attacks-ann-arbor-university-of-michigan-campus-police/75347531007/" target="_blank" rel="noopener">three Jewish students have been attacked</a>, including two outside of a Jewish fraternity house.
Jewish students and their families need real assurance that their schools and the Department of Education will protect them from discrimination and harm. Senate Republicans from top to bottom are committed to this. Senate Democrat leadership should be as well.
The Senate has five legislative weeks left this calendar year. We should use this time to pass the Protecting Students on Campus Act and address the rampant anti-Semitism on our campuses. The time for action is now.

One basic rule of survival is that, when a clearly deranged individual is ranting and raving in public, you shouldn&#8217;t engage with them. Generally speaking, there&#8217;s no benefit to doing so. You can&#8217;t persuade them not to be delusional, as much as you might like to. You can only make things worse.
Unfortunately, every now and then, despite your best efforts, sometimes this strategy doesn&#8217;t work out. We&#8217;ve all been there. You&#8217;re trying to mind your own business, and then out of nowhere, you catch a stranger&#8217;s eye. And then they might start talking about you. They might verbalize their unhinged delusions about who you are, or what you do for a living. And in those cases, sometimes, it can be impossible to resist saying a word or two in response. You know it won&#8217;t help anything, you know you probably shouldn&#8217;t do it, but it&#8217;s human nature to respond when someone — even a lunatic — is talking about you.
Last night I found myself in a situation just like this, when the &#8220;Kamala HQ&#8221; account — the official account of the Kamala Harris campaign — posted a message in response to a segment from <a href="https://www.dailywire.com/episode/ep-1449-how-the-fbi-is-willing-to-risk-your-safety-to-get-kamala-elected-member-exclusive" target="_blank" rel="noopener">my show yesterday</a>. This is the same account that even CNN <a href="https://www.cnn.com/2024/09/14/politics/fact-check-harris-campaign-social-media/index.html" target="_blank" rel="noopener">reports</a> is guilty of &#8220;repeatedly deceiving&#8221; people with obviously false posts. It&#8217;s the same account that Tim Pool is <a href="https://www.newsweek.com/tim-pool-kamala-harris-defamation-lawsuit-west-virginia-project-2025-1955775" target="_blank" rel="noopener">suing</a> because they wildly misrepresented something he said on his show. They&#8217;re pathological, delusional liars in every sense. And last night, totally unprovoked, they came after me.
Here&#8217;s what <a href="https://x.com/KamalaHQ/status/1838745780657537431" target="_blank" rel="noopener">they wrote</a>, in response to my show yesterday: &#8220;Top Trump operative, echoing Project 2025: Not only should the Department of Education be abolished, but the entire public school system should be abolished.&#8221;
Before I play the clip that they embedded in that tweet, I have to say a few things. First of all, it&#8217;d be news to the Trump campaign that I&#8217;m one of their &#8220;operatives.&#8221; I don&#8217;t work for the Trump campaign. I don&#8217;t coordinate with the Trump campaign. During the primary I supported Ron DeSantis. So in no sense am I a Trump campaign &#8220;operative.&#8221; At the same time, I have to admit that this particular lie is a little flattering. If they’re going to falsely label me a &#8220;Trump operative,&#8221; I’m glad they’ve promoted me to a &#8220;top operative&#8221; instead of a regular one, at least. I&#8217;m not some rank-and-file Trump operative over here. I&#8217;m the cream of the crop, in the eyes of the Kamala Harris campaign. It’s nice to finally be getting some damned respect around here, I have to say.
In any event, here&#8217;s the footage they embedded in their tweet, to demonstrate that I&#8217;m a &#8220;top Trump operative&#8221; who is &#8220;echoing Project 2025.&#8221; I&#8217;m responding here to a clip from a recent Trump rally, where he says the education system is failing in this country. Like everything else that this &#8220;Kamala HQ&#8221; account has uploaded in the past few weeks, this post backfired almost immediately. Pretty much every reply was along the lines of: &#8220;Yep, the public school system and the Department of Education are terrible and should be abolished.&#8221; The goal of the Kamala Harris campaign is to portray this as an inherently extreme position — as if the existence of the Department of Education is an inevitable fact of life in this country — but it&#8217;s not. For most of this country&#8217;s history, up until 1979, we haven&#8217;t had a Department of Education at all.

Actually, to be more precise, Andrew Johnson also <a href="https://www.politico.com/agenda/story/2015/09/department-of-education-history-000235/" target="_blank" rel="noopener">launched</a> a Department of Education back in 1867. It had just four employees — the commissioner and three clerks. And it had a very limited mandate. It was supposed to collect statistics on &#8220;the condition and progress of education in the United States&#8221; and then publish that information. But even with that limited mandate, politicians at the time thought the Department of Education had too much power. They didn&#8217;t see any reason for the department to exist at all. As Politico <a href="https://www.politico.com/agenda/story/2015/09/department-of-education-history-000235/" target="_blank" rel="noopener">reported</a>, &#8220;Many in Congress &#8230; saw its existence as an unconstitutional power grab and worried that its data-gathering authority gave Washington a new and dangerous kind of leverage.&#8221;
Andrew Rogers, a Democrat from New Jersey, put it this way: &#8220;I am content .. to leave this matter of education where our fathers left it, where the history of our country left it, to the schools systems of the different towns, cities and states.&#8221;
Ultimately, the first Department of Education lasted just a year before Congress realized it was a horrible idea and abolished it. Instead of having a bloated and unnecessary federal bureaucracy spending tens of billions of dollars every year, education mostly remained a local concern from 1868 to 1979. And all told, we did pretty well as a country in that period. In fact, during that time frame, we went from horses to cars to planes to rocket ships flying to the moon. It was a period of human advancement never seen before. And we did it all without the Department of Education, if you can imagine.
Then, in 1979, after this period of uninterrupted prosperity and innovation, Jimmy Carter revived the federal Department of Education. And by that point, we didn&#8217;t have a lot of politicians in Washington anymore who wanted to limit their own power. Instead they wanted to expand it, at all costs. So the D.O.E. has stuck around, to disastrous results.
As the New York Sun <a href="https://www.discovery.org/education/2023/07/11/our-public-school-system-is-set-up-to-fail-and-its-succeeding/">reported last year</a>:
<blockquote>The recent report by the National Assessment of Educational Progress, sometimes referred to as the nation’s report card, is a devastating assessment of the condition of our nation’s schools. In short, there has been virtually no educational progress with our nation’s children in more than 30 years – and urban districts are the worst performers. &#8230; Virtually every major city shows declining proficiency for their students, even as school spending continues to increase.</blockquote>
Yes, you read that correctly. There has been virtually no educational progress in this country&#8217;s educational system in more than 30 years. The Department of Education has been around this entire time, and it hasn&#8217;t done anything to improve education. They&#8217;ve hired a bunch of LGBTQ overseers to police &#8220;misgendering&#8221; in kindergarten, but when it comes to education, it&#8217;s been a debacle.
Instead, in major school districts all over the country, corruption has flourished. Again from the Sun:
<blockquote>The report ranked the Detroit Public Schools as the worst performing of all 26 large city districts, with just 5 percent of their eighth-grade students rated proficient in reading and only 3 percent in math. What is surprising is the Detroit Public Schools Community District rated 99 percent of Detroit’s teachers as &#8216;highly effective&#8217; or &#8216;effective,&#8217; the two highest ratings given to teachers. An added conundrum is that Detroit public high schools received an &#8216;F&#8217; on student proficiency and yet received an &#8216;A&#8217; on graduation rates.</blockquote>
In other words, students are doing terribly — worse than they&#8217;ve done in decades. And yet the teachers are rating themselves highly. They&#8217;re graduating all of these students who can&#8217;t read, write, or do arithmetic. And despite all of this, <a href="https://www.bridgemi.com/talent-education/trump-wants-abolish-department-education-michigan-ready">billions of dollars</a> from the federal government flow into Michigan schools every year. The Department of Education isn&#8217;t just tolerating failure. It&#8217;s enabling it.
To be clear, the source for these claims isn&#8217;t Project 2025. It&#8217;s not me, either. The source for these claims is the Department of Education itself. The &#8220;National Assessment of Educational Progress,&#8221; or the nation&#8217;s report card, is both overseen and administered by the National Center for Education Statistics. And the National Center for Education Statistics is <a href="https://nces.ed.gov/nationsreportcard/about/">embedded within</a> the U.S. Department of Education. The Department of Education itself is saying that it&#8217;s doing a terrible job. They&#8217;re acknowledging that public schools are failing, too, which is why homeschooling is now more popular than ever.
How bad are things going in public schools, exactly? In 2023 The New York Times <a href="https://www.nytimes.com/2023/06/21/us/naep-test-results-education.html" target="_blank" rel="noopener">reported</a>: &#8220;The math and reading performance of 13-year-olds in the United States has hit the lowest level in decades.&#8221; Again, their source is the Department of Education and the exam from the National Report Card. And there are reasons to believe these numbers from the national report card because:
<blockquote>Scores on the exam do not result in any rewards or punishments for students, teachers or schools, making them especially useful for research purposes, since there are fewer incentives to cheat or teach to the test.</blockquote>
If there were punishments for underperforming schools, then we can assume that a lot of teachers would give their students the answers. But apparently they&#8217;re not clever enough to do that — at least not yet. So the corruption and the incompetence are laid bare.
Out of curiosity, I just pulled up the homepage for the National Report Card. The <a href="https://www.nationsreportcard.gov/" target="_blank" rel="noopener">very first thing </a>on the website is a chart entitled, &#8220;Student Performance Across Subjects.&#8221; It shows &#8220;Changes in average scores and scores at selected percentiles, by subject and grade.&#8221; Here&#8217;s what it looks like:

As you can see, every single arrow except one is down — meaning there&#8217;s been a &#8220;Significant decrease compared to last assessment year,&#8221; according to the website. Average scores in math and reading are down for grades 4 through 8, in every percentile. The only exception is the 90th percentile in reading among 4th graders. That experienced &#8220;no significant difference&#8221; year-over-year. Not a single category improved.

I could go on and on about the various metrics that show our public school system, and the Department of Education, are both failing. Every single statistic like this is clear evidence that we need to scrap the system and start over. But the failures actually go even deeper than test scores and academic proficiency.
All the way back in 2004, the Department of Education released a comprehensive report <a href="https://www.dailywire.com/news/the-public-school-system-is-covering-up-a-massive-sex-abuse-scandal" target="_blank" rel="noopener">showing</a> that 10% of students in public schools nationwide, in grades K-12, were subjected to &#8220;sexual misconduct&#8221; by a school employee. That&#8217;s millions of children. It&#8217;s the kind of report you&#8217;d expect would lead to annual, if not monthly, follow-ups by the Department of Education. But as far as I can tell, they haven&#8217;t followed up at all with another comprehensive assessment. And as I discussed earlier this year, that&#8217;s not because sexual abuse in public schools has gone away. If anything, there are clear <a href="https://www.dailywire.com/news/the-public-school-system-is-covering-up-a-massive-sex-abuse-scandal" target="_blank" rel="noopener">indications</a> it&#8217;s become substantially more common — and that public schools are covering it up.
Put it all together, and it&#8217;s evident that the education system is catastrophically failing to do the single thing it is supposed to do, which is to equip each new generation with the knowledge and intellectual tools they need to be productive and happy human beings. The failure of the education system should be considered a major scandal — perhaps the greatest scandal facing the country today. The problem is that the Democrats don’t consider failure to be failure. They want the education system to churn out shallow, obedient serfs. And it is indeed succeeding in doing that.
All that said, I&#8217;d be remiss if I didn&#8217;t acknowledge that one thing the Kamala HQ account tweeted out is, in fact, accurate. It&#8217;s true that I am, indeed, a proponent of Project 2025. They got me there. We can&#8217;t let them know about <a href="http://project2025.com/" target="_blank" rel="noopener">project2025.com</a>. But everyone else — everyone on our side who wants access to our secret blueprint — can go over to that URL anytime they want. Read it. Internalize it. 
And then, when the Department of Education is abolished and children can once again read, write, and do arithmetic in this country, we must never speak about our sinister Project 2025 plan ever again.

Kamala HQ Attacked Me For Telling The Truth About Public Education

Two college students sued the Biden-Harris administration on Wednesday, saying that the <a href="https://www.dailywire.com/topic/department-of-education" target="_blank" rel="noopener">Department of Education</a> is illegally denying them eligibility for a scholarship program because they are white. 
The lawsuit was filed by the Wisconsin Institute for Law and Liberty (WILL). WILL filed the suit on behalf of University of Wisconsin-Madison student Benjamin Rothove, University of North Dakota student Avery Durfee, and the Young America&#8217;s Foundation. The suit says that the Education Department&#8217;s $60 million Ronald E. McNair Postbaccalaureate <a href="https://www2.ed.gov/programs/triomcnair/index.html?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=" target="_blank" rel="noopener">Achievement Program</a> violates the equal protection rights of white, Asian, Jewish, and Arab students. According to the program’s stipulations, applicants must be from a group “underrepresented” in graduate education, or else be a low-income, first-generation college student. 
The suit, filed in the U.S. District Court for the District of North Dakota, asks a judge to block the Biden admin from enforcing any race-based eligibility requirements and to inform all applicable institutions that such qualifications are unconstitutional. According to a <a href="https://dw-wp-production.imgix.net/2024/08/Complaint-McNair-v14-FINAL-Aug-27.pdf" target="_blank" rel="noopener">copy</a> of the suit shared with The Daily Wire, both Rothove and Durfee received emails from their colleges telling them they couldn’t apply for the McNair scholarship because they were white.
“We want this case to set the precedent that when a student is in college there can’t be any differing treatment of the student based on race. There can’t be any privileges given or advantages or benefits at all,” WILL deputy counsel Dan Lennington told The Daily Wire on Wednesday. “We think this is a very broad attack on the Biden-Harris administration’s plan to push DEI into our colleges even further.”

The McNair program provides thousands of dollars in stipends to recipients and helps match students with internships, mentoring programs, and research opportunities.
While certain low-income white and Asian students could get the McNair scholarship, no such barriers exist for black and Hispanic students. The <a href="https://www.ecfr.gov/current/title-34/subtitle-B/chapter-VI/part-647/subpart-A/section-647.7" target="_blank" rel="noopener">federal definition</a> of an underrepresented group for graduate programs includes black, Hispanic, American Indian, Alaskan Native, Native Hawaiians, and Native American Pacific Islanders. 
Lennington said that the Biden-Harris administration was effectively telling students who aren&#8217;t black or Hispanic they were not needed or wanted in graduate education. 
“I’ve worked unbelievably hard throughout my undergraduate career and have wanted to go to graduate school my entire life,” Durfee said in a statement shared with The Daily Wire. “Being told that I didn’t qualify for the McNair program because I’m white seemed completely wrong. This sends the wrong message to young Americans everywhere.”
Young America&#8217;s Foundation President and former Wisconsin governor Scott Walker said his group was proud to be involved in the legal challenge.

“Denying a student the chance to compete for a scholarship based on their skin color is not only discriminatory but also demeaning and unconstitutional,” he said. “At YAF, we proudly defend our students&#8217; right to be judged on their merit and abilities, not on race.”
Lennington told The Daily Wire that there were dozens of race-based programs embedded in the federal government that must be challenged in light of the Supreme Court’s decision to overturn affirmative action.
“We are going to sue over [the programs] one at a time,” he said. “We are going have to dismantle it brick by brick.”

A Kentucky court issued a preliminary injunction on the Biden administration’s rewrite of <a href="https://www.dailywire.com/topic/title-ix" target="_blank" rel="noopener">Title IX</a>, putting a temporary stop to it in six states, Kentucky, Tennessee, Virginia, Ohio, West Virginia, and Indiana.
In the district court <a href="https://www.tn.gov/content/dam/tn/attorneygeneral/documents/pr/2024/pr24-50-memo.pdf">conclusion</a> it said the U.S. Department of Education will be restrained from “implementing, enacting, enforcing, or taking any action in any manner to enforce” the new regulations in those six states, <a href="https://www.outkick.com/sports/kentucky-court-stops-joe-biden-title-ix-rules-virginia">Outkick</a> noted. Biden&#8217;s recent rewrite of Title IX includes protection for transgender-identifying people — a policy that was originally enacted in 1972 to protect women and girls.
Tennessee Attorney General Jonathan Skrmetti released a <a href="https://www.tn.gov/attorneygeneral/news/2024/6/17/pr24-50.html">statement</a> about the decision, calling it a “big win.”
“This is a big win for the Constitution and the people of Tennessee,” the statement read. “We fought hard to protect our constitutional separation of powers, which ensures that the people through their elected representatives are the only authority that can make new laws.”

“If the rule we stopped had been allowed to go into effect on August 1 as scheduled, Tennessee schools and universities would have to let boys into girls’ locker rooms and other private spaces,” the statement added. “If the rule went into effect, our schools would have to punish teachers and students who declined to use someone’s preferred pronouns.”
“These are profound changes to the law that the American people never agreed to,” the statement concluded. “This rule was a huge overreach by federal bureaucrats, and the Court was right to stop it.”
Virginia Attorney General Jason Miyares took to <a href="https://x.com/JasonMiyaresVA/status/1802708125746659838">X</a> on Monday, celebrating the injunction on what he called the “unlawful” move by the Biden administration.
“I’m pleased to announce that a court has stopped the Biden Administration&#8217;s unlawful Title IX regulations from going into effect in Virginia,” Miyares wrote. 
“The Biden Administration’s latest power grab would jeopardize half a century of landmark protections for women, violate the First Amendment, and ignore the clear text of the Title IX law passed by Congress,” he added. “The rule should have never been issued in the first place.”
Virginia Republican Governor Glenn <a href="https://x.com/GovernorVA/status/1802716948280586264">Youngkin</a> praised Miyares for leading the charge.
“Virginians saw the rewriting of Title IX for what it was — an attempt to leverage federal tax dollars to impose a harmful agenda on parents and families,” Youngkin wrote. “I applaud<a href="https://x.com/JasonMiyaresVA"> [JasonMiyaresVA</a>] for leading the charge and confronting the Biden administration’s obvious executive overreach.”
Former collegiate swimmer and outspoken activist for female sports Riley Gaines posted about the court’s conclusion and <a href="https://x.com/Riley_Gaines_/status/1802712193646928210">wrote</a>, “Great news! Biden&#8217;s illegal rewrite of Title IX won&#8217;t go into effect in TN, KY, VA, WV, OH, &amp; IN.&#8221;
“A federal court granted an injunction for the Title IX lawsuit filed by mentioned states,” Gaines added. “This is a huge win. The gender ideology house of cards is falling fast.”
The Biden administration’s provision “clarifies that sex discrimination includes discrimination based on sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity.”
The revision will force any K-12 school or higher education institution receiving federal funding to allow boys who identify as girls to use girls’ bathrooms, locker rooms, and housing accommodations, while allowing girls who identify as boys to use boys’ facilities.

In a major blow to the Biden administration&#8217;s new Title IX guidelines forcing public schools to allow trans-identifying males in girls&#8217; bathrooms and sports, a federal judge on Thursday blocked the rules in four states.
U.S. District Judge Terry Doughty, a Trump appointee, issued a preliminary <a href="https://storage.courtlistener.com/recap/gov.uscourts.lawd.205659/gov.uscourts.lawd.205659.53.0.pdf" target="_blank" rel="noopener">injunction</a> against the rules, calling them an &#8220;abuse of power&#8221; by federal agencies and a &#8220;threat to democracy.&#8221;
The injunction blocks the rules in Louisiana, Mississippi, Montana, and Idaho. Louisiana sued the administration in April, and the other three states joined the suit.
&#8220;Title IX was written and intended to protect biological women from discrimination,&#8221; Doughty wrote. &#8220;Such purpose makes it difficult to sincerely argue that, at the time of enactment, &#8216;discrimination on the basis of sex&#8217; included gender identity, sex stereotypes, sexual orientation, or sex characteristics. Enacting the changes in the Final Rule would subvert the original purpose of Title IX: protecting biological females from discrimination.&#8221;
Since the rules were announced, <a href="https://apnews.com/article/title-ix-transgender-sports-campus-sexual-assault-77f524b4ed8fcc2aecd5e863b0442bf4" target="_blank" rel="noopener">more</a> than 20 states have joined lawsuits against the administration over its new Title IX rules, which <a href="https://apnews.com/article/title-ix-transgender-bathroom-bans-645b5564ce227a9efe2c05f883609ae8" target="_blank" rel="noopener">appear to conflict</a> with laws in several states restricting trans-identifying male students from playing on girls’ teams or using girls’ facilities.
In April, the Education Department unveiled the new Title IX regulations, which prohibit schools from enforcing blanket bans on trans-identifying males in girls’ sports. The rules are set to take effect in August.
<a href="https://www2.ed.gov/about/offices/list/ocr/docs/tix_dis.html">Title IX</a> is the 1972 federal civil rights law prohibiting sex-based discrimination at schools receiving federal funding.
The Biden administration’s new regulations will <a href="https://www.dailywire.com/news/more-states-file-flurry-of-lawsuits-against-biden-admin-over-transgender-title-ix-rules#">apply</a> to all public K-12 schools, colleges, and universities that receive federal funding, excluding the four states where the rules have been blocked.
The <a href="https://www.ed.gov/news/press-releases/fact-sheet-us-department-educations-proposed-change-its-title-ix-regulations-students-eligibility-athletic-teams">new rules</a> state that schools that receive federal funding may not ban biological males in girls’ sports wholesale, but they may exclude them on a case-by-case basis.
“Sex-related criteria” at schools that would limit or ban a trans-identifying student from playing on the team of their preferred gender must meet two standards. First, the criteria must be related to an “important educational objective,” and second, the criteria must also “minimize harms” to the trans-identified student.

Preventing sports-related injuries would be an example of an “important educational objective,” the department noted.
High school girls have been injured playing with trans-identifying males. Last year in North Carolina, a female high school volleyball player <a href="https://www.nationalreview.com/news/female-high-school-volleyball-athlete-suffers-serious-head-injury-after-transgender-player-throws-abnormally-fast-ball/" target="_blank" rel="noopener">suffered</a> severe trauma to her head and neck after a trans-identifying male player spiked a volleyball that hit her head.
Another example of an “important educational objective” would be “fairness in competition.”
Female athletes at high schools and colleges in several states have spoken out against competing against biological males.
After Thursday&#8217;s ruling, the Education Department said it is reviewing the judge’s order.
“The Department stands by the final Title IX regulations released in April 2024, and we will continue to fight for every student,” the department <a href="https://apnews.com/article/title-ix-transgender-sports-campus-sexual-assault-77f524b4ed8fcc2aecd5e863b0442bf4" target="_blank" rel="noopener">said</a>.

A 15-year-old girl from Bridgeport, West Virginia, is suing the Department of Education, claiming there were a series of incidents in which a boy who competed against her and other girls in track and field events made rape threats against her.
According to the girl’s <a href="https://adfmedialegalfiles.blob.core.windows.net/files/TennesseeDeclarationOfAC.pdf" target="_blank" rel="noopener">statement</a>, she is currently a ninth-grade student at Bridgeport High School (BHS) who competes in discus, shot put, and the 4 x 100 relay. In sixth through eighth grade, she attended Bridgeport Middle School (BMS), where in seventh grade (the 2021–22 school year), she competed in the 100-meter dash, pole vault, shot put, and discus, and sometimes competed in the 200-meter dash and relay events.
“To my surprise, another BMS student named B.P.J. joined the girls’ track and field team,” she noted. “B.P.J. is almost two years younger than me, and one year behind me in school. Because I know B.P.J.’s older brother from school, I knew at the beginning of the 2021–22 school year that B.P.J. is a male who identifies as a girl.”
She recalled that initially, she was better than the boy in shot put and discus, but by the end of seventh grade, he threw about the same distance in shot put: around 18–20 feet. “In discus, I typically beat B.P.J.: I threw around 40 feet while B.P.J. threw closer to 30 feet. But in the last meet of the 2021–22 season, B.P.J. suddenly threw almost 20 feet farther: 49’ 7”,” she stated.
“By the next school year (2022–23), I could tell that B.P.J. had grown a lot. B.P.J. got taller and threw farther. B.P.J. got a deeper and more masculine voice,” she wrote. In March 2023, B.P.J. finished ahead of the girl at the Connect Bridgeport Invitational in shot put and in discus. In April, B.P.J. beat her at the Pioneer MS Invitational in discus. Later in April, B.P.J. beat her at the Bobcat MS meet in shot put and discus.
“B.P.J.’s athletic records show that B.P.J. beat over 50 different female athletes in the 2021–22 school year, displacing several of the female athletes more than once. These records show that B.P.J. beat over 100 different female athletes in the 2022–23 school year, displacing them almost 300 times. I also lost to B.P.J. on four separate occasions that school year,” the lawsuit states.

“B.P.J. made several offensive and inappropriate sexual comments to me,” she recalled. “At first, it did not occur often, and I tried my best to ignore it. But during my final year of middle school, B.P.J. made inappropriate sexual comments a lot more often; it increased throughout that year; and the comments became much more aggressive, vile, and disturbing. Sometimes B.P.J.’s comments were just annoying, like commenting that I have a ‘nice butt.’ But other times, I felt really embarrassed, and I didn’t want to repeat the gross things B.P.J. said to me. During the end of that year, about two to three times per week, B.P.J. would look at me and say ‘suck my d***.’ There were usually other girls around who heard this. I heard B.P.J. say the same thing to my other teammates, too.”
“B.P.J. made other more explicit sexual statements that felt threatening to me,” she continued. “At times, B.P.J. told me quietly &#8216;I&#8217;m gonna stick my d*** into your p****.’ And B.P.J. sometimes added ‘and in your a**’ as well. &#8230; B.P.J. made these vulgar comments towards me in the locker room, on the track, and in the throwing pit for discus and shotput.”
“Most of the time, B.P.J. made these sexual comments at girls’ track practice. Our team walked from Bridgeport Middle School to the High School for track practice, where we would train on the high school track,” she stated. “B.P.J. often popped up beside me as we walked and said these things. Other times, B.P.J. made comments as our team was sitting in the endzone waiting for coaches to get practice going. At least one time, it happened in the girls’ locker room.”
“I reported B.P.J.’s sexual comments to my coach and middle school administrators. Initially, the administrators told me that they were investigating, but we never heard back, and nothing changed. From what I saw, B.P.J. got very little or no punishment for saying things that no other student would get away with,” she concluded.
“I also worry about the little 6th grade girls who are on the same team as B.P.J. right now,” she wrote. “If I were in 6th grade and had to deal with sexual comments from a biological male two years older than me who was changing in the same locker room as me, I wouldn’t even play sports. It wouldn’t be worth it. My younger sister will be a freshman in high school when B.P.J is a senior. She is a good athlete, but she is very shy, and I can’t imagine how she would feel if B.P.J. said those sexual comments to her while they were competing in sports or changing in the locker room. I do not want that to happen.”
Rachel Rouleau of the Alliance Defending Freedom, which is representing the girl, stated:

It means young girls will be forced to undress in front of boys in gym class, girls will share bedrooms with boys on overnight school trips, teachers and students will have to refrain from speaking truthfully about gender identity, and girls will lose their right to fair competition in sports. Our client A.C. has already suffered the humiliation and indignity of being harassed by a male student in the locker room and on her sports team. No one else should have to go through that. But the administration continues to ignore biological reality, science, and common sense. This court deserves to hear from those most severely impacted by the administration’s attempt to rewrite Title IX.

The Government Accountability Office said on Friday that the federal government is on an “unsustainable fiscal path,” and that it could not determine whether the federal government’s consolidated financial statements are reliable. 
Accounting problems with the Defense Department, Education Department, and other agencies have all contributed to the financial problems, according to the GAO. The office was unable to properly evaluate the financial reliability of the federal government as the national debt continues to balloon and deficit spending remains high. 
“Congress and the Administration need reliable and complete financial information, within each agency and across the government as a whole, to govern effectively and efficiently,” <a href="https://www.gao.gov/press-release/gao-unable-provide-opinion-u.s.-governments-financial-statements#:~:text=%E2%80%9CAlso%2C%20the%20federal%20government%20continues,any%20challenges%20that%20may%20occur.%E2%80%9D" target="_blank" rel="noopener">said</a> Gene Dodaro, the comptroller general of the United States and head of the GAO.
“Also, the federal government continues to operate on an unsustainable fiscal path, jeopardizing the country’s long-term position to face domestic and international challenges. The creation of a long-term fiscal plan is needed to strengthen our readiness to confront any challenges that may occur,” Dodaro added. 
According to GAO, the Defense Department is partially at fault due to “financial management problems,” while the Education Department was plagued by data problems for estimating costs of its loan programs. Additionally, problems remain with the Small Business Administration’s COVID-era relief programs and several government agencies made over $236 billion in “improper payments.”

The Pentagon, which has $3.8 trillion in assets alongside $4 trillion in liabilities, <a href="https://www.defensenews.com/pentagon/2023/11/16/pentagon-fails-sixth-audit-with-number-of-passing-grades-stagnant/?utm_campaign=dfn-ebb&amp;utm_medium=email&amp;utm_source=sailthr">only had</a> seven of 30 sub-audits rated clean by auditors.

On Thursday, the GAO released a <a href="https://www.gao.gov/products/gao-24-106987" target="_blank" rel="noopener">report</a> on the nation&#8217;s fiscal health that highlighted the federal government’s massive deficit spending. The report urged Congress to come up with a plan to address the spending and fiscal path of the United States. 
The report found that debt would reach 200% of the GDP by 2050 unless changes were made to revenue and spending policies. It also said that funding for Social Security and Medicare was expected to be depleted within ten years unless financing gaps were addressed. 
The United States’ debt now <a href="https://www.dailywire.com/news/greatest-threat-to-americas-national-security-national-debt-hits-34-trillion-for-first-time" target="_blank" rel="noopener">exceeds $34 trillion</a>, a marker it crossed in January just months after hitting $33 trillion.

A parental rights organization has filed a civil rights complaint against a <a href="https://www.dailywire.com/topic/minnesota" target="_blank" rel="noopener">Minnesota</a> high school because the school has a student council exclusively for “Indigenous” students.
The complaint against the Minneapolis-area school, filed by Parents Defending Education with the Department of Education’s Office of Civil Rights, <a href="https://defendinged.org/complaints/ocr-complaint-burnsville-high-school/">alleges</a> that Burnsville High School is violating federal civil rights laws through a student council that is only open to American Indian/Alaska Native students.
“PDE makes this complaint as an interested third-party organization with members who are parents of school children throughout the country. PDE and its members oppose discrimination on the basis of race, national origin, and political indoctrination in America’s schools. Burnsville High School is offering programming to affinity groups that is not open to all students,” a copy of the complaint obtained by The Daily Wire <a href="https://dw-wp-production.imgix.net/2024/02/OCR-_Burnsville-High-School.pdf">says</a>.
The club is <a href="https://bhs.isd191.org/activities/affinity-groups" target="_blank" rel="noopener">listed</a> on the school’s website alongside other clubs like the Black Student Union, the Muslim Student Association, and the Gender Sexuality Alliance.
“Unlike the other six affinity groups identified in the exhibits, the Indigenous Student Council (ISC) is the only group that explicitly states it is not open to the entire student body,” the complaint says. “Accordingly, we ask that the Department promptly investigate the allegations in this complaint, act swiftly to remedy unlawful policies and practices, and order appropriate relief.”
The complaint claims that the club violates the Equal Protection clause of the 14th Amendment and Title VI of the Civil Rights Act, which says federal funding cannot go toward racially discriminatory programming.
The Daily Wire reached out to the high school for further clarification on the nature of the council and response to the complaint.

Caroline Moore, the vice president of Parents Defending Education, said the student council was “unabashedly unconstitutional.”
“Burnsville High School has two student councils,” Moore told The Daily Wire. “One that everyone can participate in, and another that only allows Native American students. If students cannot coexist in something as simple serving as leaders for their graduation class, where does this madness end?”
“If Minneapolis and its suburbs are any indication of where race relations in this country are going, I want no part of it. This is unabashedly unconstitutional and the DOE should conduct a thorough investigation of racial discrimination in this district immediately,” she added.
Schools across the country have faced backlash from parents who want teachers to focus on academic achievement as opposed to focusing on racial and sexual identity.

Minnesota High School Has Separate ‘Student Council’ For ‘Indigenous’ Students

A math and science school in <a href="https://www.dailywire.com/topic/illinois" target="_blank" rel="noopener">Illinois</a> runs an annual race-based retreat open only to black and &#8220;Latinx&#8221; students, according to a civil rights complaint filed to the Department of Education on Wednesday by a parent&#8217;s rights group.
Parents Defending Education filed the complaint against the Illinois Math and Science Academy with the Education Department&#8217;s Office of Civil Rights over racially focused programs at the school centering around the Brotherhood Sister Circle (BHSC), a club that appears to only be open for black and Latino students. The so-called &#8220;affinity&#8221; club has an annual retreat only open for students who are black or “Latinx,” according to a complaint shared with The Daily Wire. 
“PDE and its members oppose discrimination on the basis of race and political indoctrination in America’s schools,” the complaint <a href="https://defendinged.org/wp-content/uploads/2024/02/OCR_Illinois-Mathematics-and-Science-Academy_Redacted.pdf" target="_blank" rel="noopener">says</a>. “Illinois Mathematics and Science Academy is offering affinity group programming to some that is not offered to all. Admittance into the Brotherhood Sister Circle affinity group is solely based on individual’s race and sex. Specifically, the group is open only to ‘Black’ and ‘Latinx’ individuals and certain events are further divided based on the individual’s sex.”
The complaint comes as <a href="https://www.dailywire.com/news/inside-black-lives-matter-spirit-week-at-the-wokest-elementary-school-in-d-c" target="_blank" rel="noopener">schools across the country</a> have faced scrutiny over emphasizing racial and sexual identity as opposed to education. A <a href="https://www.dailywire.com/news/more-than-30-illinois-public-schools-have-no-students-proficient-in-math-or-reading-report" target="_blank" rel="noopener">report last year</a> showed that there were 53 schools in Illinois where there were zero students proficient in math.
&#8220;The Illinois Mathematics and Science Academy magnet school gives preferential treatment to students solely based on race and sex,” Caroline Moore, vice president of PDE, told The Daily Wire. “The Brotherhood and Sisterhood Circle affinity group has a hard and fast rule that specifically forbids white male students.&#8221;

The information on the affinity club and the retreat put on by the Illinois Math and Science Academy, an advanced public school in Aurora catering to about 650 students in grades 10-12, was obtained by PDE through public information requests. 
The school defended its program, saying it believes &#8220;in creating opportunities for students to celebrate their culture and discuss issues that reflect their identities.&#8221;
&#8220;We are happy to address any questions with the Office for Civil Rights should they wish to inquire further about our student club activities,&#8221; the school&#8217;s public affairs officer Tami Armstrong told The Daily Wire.
The complaint says that the school is violating the Equal Protection Clause of the 14th Amendment and Title VI of the Civil Rights Act, which says federal funding cannot go toward racially discriminatory programming.
According to the school, the <a href="https://digitalcommons.imsa.edu/dei_bhsc/4/" target="_blank" rel="noopener">program</a> is intended to give “black and Latinx students an opportunity to celebrate and enhance their strengths, creativity, intelligence, promote networking, community involvement, financial literacy, resources, and academic success.”
The club has a retreat every year, put on with the help of the school&#8217;s Coordinator of Diversity, Equity, and Inclusion, that is for “Black and Latinx students to engage in meaningful conversations, fun activities, and meet alumni,” according to a flier for the retreat referenced in the complaint. Alumni who are black and Latino are also encouraged to register for the retreat.

In emails preparing for the retreat, school staff requested the contact information of black and Latino students while another requested that only a black or &#8220;Latinx&#8221; photographer be allowed to work the event. 
“I would ask for Black/Latinx photographers so that pictures can be taken throughout the day,” the school’s DEI director requested in an email in March 2022 before the retreat.

PDE&#8217;s Moore said the request reveals &#8220;deep-seated hate&#8221; from organizers.
&#8220;The group even prohibited a white male yearbook staff member from taking their annual affinity group photograph,&#8221; Moore said. &#8220;This shows deep-seated hate towards a specific demographic and cannot be tolerated.&#8221;
At the retreat one year, there were breakout sessions focused on “men of color” and “women of color.” Another session was on &#8220;Black and Latinx Emotional Social Well-being in a Radicalized Society.&#8221; 
“By intentionally separating students based on the basis of skin color and gender for educational programming, this unlawful practice perpetuates and condones discrimination in one of the state’s leading STEM institutions. This will have a long-term impact on the institution, as well as the individuals who inhabit it,” the complaint says.

The powerful board of Penn&#8217;s Wharton business school is calling on <a href="https://www.dailywire.com/topic/university-of-pennsylvania" target="_blank" rel="noopener">University of Pennsylvania</a> President Liz Magill to resign over disturbing remarks that she made this week while testifying before Congress.
Magill did not <a href="https://www.dailywire.com/news/watch-top-university-presidents-balk-when-asked-if-genocidal-chants-against-jews-violate-codes-of-conduct" target="_blank" rel="noopener">say</a> during her testimony before the Committee on Education &amp; the Workforce that calling for the genocide of Jews would violate the school&#8217;s code of conduct on bullying and harassment unless &#8220;the speech turns into conduct.&#8221;
&#8220;&#8216;Conduct’ meaning committing the act of genocide?&#8221; Rep. Elise Stefanik (R-NY) fired back. &#8220;The speech is not harassment? This is unacceptable.&#8221;
University of Pennsylvania’s Board of Trustees held an “emergency meeting” on Thursday to address the continued fallout from Magill&#8217;s disastrous remarks.
The Wharton Board of Advisors &#8220;has been, and remains, deeply concerned about the dangerous and toxic culture on our campus that has been led by a select group of students and faculty and has been permitted by University leadership,&#8221; the Board said in a letter to Magill. &#8220;As confirmed in your congressional testimony yesterday, the leadership of the University does not share the values of our Board. Nor does it appear to understand the urgency to address the safety of our students on campus and the ongoing reputational damage to the University by the University’s policies and actions.&#8221;
&#8220;As a result of the University leadership&#8217;s stated beliefs and collective failure to act, our Board respectfully suggests to you and the Board of Trustees that the University requires new leadership with immediate effect,&#8221; the letter later added.

In a move that could pit women’s advocates and transgender activists against each other, the Education Department has opened an investigation into an alleged incident involving a trans-identifying student exposing his male genitalia to freshman girls.
The Department’s Office for Civil Rights (OCR), which investigates schools for potential violations of the anti-sex discrimination statute Title IX, said Wednesday that it would look into the incident, which occurred in March. The investigation comes as a response to a complaint filed by the Wisconsin Institute for Law &amp; Liberty (WILL).
In <a href="https://will-law.org/wp-content/uploads/2023/11/OCR-Opening-Investigation-SPASD66.pdf" target="_blank" rel="noopener">its response</a> to WILL’s complaint OCR says that it will investigate “Whether the [Sun Prairie Area School] District responded to a report of sexual harassment consistent with the requirements of Title IX.”
An investigation does not mean that OCR will determine the school district acted inappropriately when a student reported that a biologically male student identifying as a female entered the girls’ locker room and showered naked next to four freshman girls and exposed his male genitalia to them.
While Title IX in recent years has been used to adjudicate allegations of sexual assault and harassment, the Biden administration has signaled it would use the statute to punish schools for not adhering to the administration&#8217;s transgender ideology.
The incident occurred on March 3, The Daily Wire previously <a href="https://www.dailywire.com/news/18-year-old-male-identifying-as-female-enters-high-school-girls-locker-showers-naked-next-to-14-year-old-students-conservative-org-alleges" target="_blank" rel="noopener">reported</a>, at Sun Prairie East High School in Wisconsin. When the four freshman girls entered the lockers, they found a senior male student, believed to be 18 years old at the time, in the room that contained the lockers and benches. The girls said the student wasn’t in the class with them, but proceeded to the shower area even though they were uncomfortable. They were aware that the student identified as transgender and had used girls’ bathrooms previously.

The girls showered with their bathing suits on, which was common practice. Just when they started to shower, the transgender student fully undressed and entered the shower next to one of the girls. The student was initially facing the wall but then turned toward the four girls, exposing his male genitalia to all four freshmen.
The girls didn’t know what to do and didn’t immediately report the incident, but after one girl told another student what happened, that student said they should report it. Three days after the incident in the shower, the uninvolved student reported it to student services. The incident should have been reported under Title IX, but Associate Principal Heidi Walter didn’t report the incident to the Title IX coordinator, and instead asked for the names of the students involved, according to WILL.
On March 10, the student who reported the incident had gained permission to provide the students’ names and was ready to do so, but Walter said that the girls could approach her if they wanted. She later admitted, according to WILL, that she should have “dug deeper” into the issue.
The four girls should have been provided supportive measures under Title IX, but instead, the school focused on the transgender student, WILL said. EHS’ principal did, however, apologize to a parent in an email by saying the incident “should not have happened” and vowing to “continue to work to ensure no one has a similar experience,” though she didn’t outline any steps the school would take.
WILL said that the Sun Prairie Area School District dismissed the rights and concerns of the freshmen girls while assuring parents that the issue had been resolved. The district also pointed to its “Restroom and Locker Room Accessibility Guidance,” which may not have even been in effect. The guidance, according to WILL, suggests that if a transgender student “makes any request regarding the use of locker rooms,” the school will evaluate the request. The policy says nothing about students who don’t make requests, if permission is required, or who makes the determination on the student’s request.
The school district’s policy says that a “student who is transgender, nonbinary, or gender expansive will be permitted to access the men’s/women’s segregated restrooms in accordance with the student’s gender identity that the student regularly asserts at school and in other social environments.”
It further states that any “Student who has a need or desire for increased privacy, regardless of the underlying reason, may be provided with access to a single-access restroom where such a facility is reasonably available, but no student shall be required to use such a restroom because of the student’s transgender, nonbinary, or gender expansive status.”
The school district has also released a statement saying it stands by “LGBTQIA+ students and staff,” taking “seriously our responsibility to provide safe, nondiscriminatory, and inclusive environments for people of all orientations and identities as they reflect our diverse community around us.”
The statement also says that “all children will be safe and loved in our schools,” which WILL argued has not been upheld in this case.
