Several prominent Democrats decried the fact that Immigration and Customs Enforcement (ICE) apprehended a number of DACA (Deferred Action For Childhood Arrivals) recipients during the first year of President Donald Trump&#8217;s second term, demanding that they be given a &#8220;path to citizenship&#8221; in spite of data showing the &#8220;vast majority&#8221; of them had criminal histories.
Senate Minority Whip Dick Durbin (D-IL) released a <a href="https://www.kelly.senate.gov/newsroom/press-releases/kelly-durbin-padilla-blast-dhs-for-wrongfully-targeting-and-removing-daca-recipients/">joint statement</a> with Sens. Mark Kelly (D-AZ) and Alex Padilla (D-CA), protesting the arrests and casting doubt on Homeland Security&#8217;s assertion that 92% had criminal histories outside of immigration-related civil violations.

DACA recipients go through strict background checks every time they renew this protection, and the Trump Administration has not hesitated to arrest immigrants with no serious criminal convictions and falsely label them the &#8220;worst of the worst.&#8221; In the face of this Administration’s actions, it is important for Congress to protect young people who know no other home than the United States and continue the critical work to find a pathway to citizenship for them. We won’t accept partial information, and we demand that Secretary Noem provide more information on their basis for arresting and deporting DACA holders immediately.</blockquote>
Department of Homeland Security Secretary Kristi Noem, in her letter to Durbin, explained, &#8220;[DACA] comes with no right or entitlement to remain in the United States indefinitely. Aliens with certain criminal histories will not be considered for DACA. Further, those who violate the terms are also subject to termination and removal.&#8221;
According to <a href="https://www.cbsnews.com/news/daca-recipients-ice-arrested-2025-trump-administration/?ftag=CNM-00-10aab7e&amp;linkId=911656717">data compiled</a> by the federal government and shared in Noem&#8217;s letter to Durbin, immigration agents arrested 261 DACA recipients in the first ten months of 2025 — and 241 (92%) of those arrested had criminal histories apart from civil immigration violations. Just over one-third (86) of those arrested were subsequently deported.
Durbin responded by claiming that the arrests were &#8220;wrongful,&#8221; despite the overwhelming number with criminal histories, and that &#8220;Dreamers&#8221; should be given a path to citizenship.
&#8220;The Trump Administration just admitted to wrongfully arresting 261 DACA recipients. 86 were deported. Dreamers deserve a path to citizenship, not deportation,&#8221; he <a href="https://x.com/SenatorDurbin/status/2027074465197174847">posted</a> on X on Thursday.
DACA was a program implemented by former President Barack Obama&#8217;s administration, and offered work permits and temporary deportation protections for those who either entered the United States illegally or overstayed their visas when they were children. President Trump&#8217;s first-term attempt to terminate DACA altogether was blocked by the Supreme Court in 2020.

A federal judge in North Dakota on Monday stopped the <a href="https://www.dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Biden administration</a> from implementing a new policy that would make certain illegal immigrants eligible for government-backed health care coverage.
U.S. District Judge Daniel Traynor <a href="https://www.bloomberglaw.com/public/desktop/document/KansasStateofetalvUnitedStatesofAmericaetalDocketNo124cv00150DNDA/1?doc_id=X341THOR6K38NURUPN1CEL94VDR" target="_blank" rel="noopener">granted</a> a request to block a new policy from the Centers for Medicare and Medicaid Services (CMS) that would allow individuals given Deferred Action for Childhood Arrival (DACA) status to enroll in Obamacare. Traynor said that Kansas and the 18 Republican attorney generals who sued the Biden administration were likely to succeed and gave them a stay against the policy. 
Traynor said that CMS broke the law earlier this year when it <a href="https://www.dailywire.com/news/slap-in-the-face-biden-blasted-after-giving-certain-illegal-immigrants-access-to-gov-health-care" target="_blank" rel="noopener">changed</a> the definition of people “lawfully present” in the United States to include DACA recipients. Those with DACA status crossed illegally into America as minors with their parents and were shielded from deportation via an executive order from President Barack Obama. 
“The authority granted to CMS by the ACA [Affordable Care Act] is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term ‘lawfully present,’” Traynor wrote. 
“As it currently stands, the ACA does not allow federal healthcare subsidies or coverage for aliens who are unlawfully present in the United States,” he added. 
Traynor also agreed with the Republican attorneys general that the policy would encourage illegal aliens to remain in their states with the draw of health care. 
The decision was praised by Kansas Attorney General Kris Kobach, who led the suit against the policy. 
&#8220;Big win for the rule of law. Congress never intended that illegal aliens should receive Obama care benefits,” he said. “Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws. But we fought back, and defeated the Justice Department.&#8221;

The other states that were part of the suit included Ohio, Idaho,  Nebraska,  South  Carolina, Alabama, Virginia, Tennessee, Indiana, Missouri, Montana, North Dakota, South Dakota, Iowa, New Hampshire, Kentucky, Texas, Florida, and Arkansas. They argued that the rule from the Biden administration was arbitrary and capricious, and would incentivize illegal immigration. 
In response to the ruling, CMS <a href="https://thehill.com/policy/healthcare/5031527-federal-court-blocks-aca-coverage-for-dreamers/" target="_blank" rel="noopener">said</a> that it was reviewing the decision but could not comment further. 
The rule change was opposed by President-elect Donald Trump, with campaign spokesperson Karoline Leavitt decrying it in May as &#8220;unfair and unsustainable.&#8221; 
“Joe Biden‘s handouts for illegal immigrants are especially devastating to Black Americans, Hispanic Americans, and union workers who are forced to watch their jobs and public resources stolen by people who illegally entered our country,” Leavitt, Trump&#8217;s incoming press secretary, said at the time.
Last month, another judge struck down a parole program from the Biden administration that would have granted legal status to hundreds of thousands of illegal immigrants.

But then Obama pointed out that, after 12 years, many of the minors who had been protected under his DACA order had since grown up and were still at risk of being deported because Congress had never taken the necessary steps to make his temporary action permanent.

Four Republican senators are pressing the Biden administration for answers over <a href="https://www.dailywire.com/news/slap-in-the-face-biden-blasted-after-giving-certain-illegal-immigrants-access-to-gov-health-care" target="_blank" rel="noopener">its announcement</a> that it would make some immigrants who entered the U.S. illegally eligible for government-backed health care coverage.
In a <a href="https://www.blackburn.senate.gov/services/files/017C5FB5-7DB1-4197-AB41-BEE951E25AB4" target="_blank" rel="noopener">letter</a> to Health and Human Services Secretary Xavier Becerra on Wednesday, Sens. Marsha Blackburn (TN), Kevin Cramer (ND), Mike Lee (UT), and J.D. Vance (OH) demanded that Becerra provide more details about a plan announced on Friday to allow immigrants with Deferred Action for Childhood Arrival (DACA) status to enroll in Obamacare. The Biden administration estimated that the coverage could impact around 100,000 DACA recipients. 
“At a time when our nation has endured record numbers of illegal immigrants crossing the southern border, this announcement sends a clear message: fixing the manufactured border crisis is the last thing that the Biden administration wants to do,” the Republicans wrote. “In Biden’s economy, inflation is on the rise while job growth is slowing down. Unemployment is at a two-year high, and foreign born workers are flooding the workforce.”
“When America’s borders are open and our citizens’ wallets are hurting, the last thing this administration should be doing is providing free health care coverage to immigrants,” the letter added. “The American people deserve answers on such a disastrous policy.”
The decision was made possible by a Biden administration rule changing the definition of “lawfully present” to include DACA recipients, who were given special status after their parents brought them to the United States as children illegally. The rule will go into effect just before the presidential election, as DACA recipients will be able to register for coverage on November 1.
The Senators asked Becerra to provide the legal justification for expanding Obamacare eligibility without congressional authorization and for the Biden administration to estimate the expansion&#8217;s cost. Additionally, the Republicans asked if coverage would only apply to DACA recipients or include their family members.

In September last year, a federal judge in Texas <a href="https://www.dailywire.com/news/judge-rules-daca-is-illegal-says-biden-admin-cannot-usurp-congressional-power" target="_blank" rel="noopener">ruled</a> that the DACA program was unconstitutional because the executive branch had to “usurp” congressional authority to enact the policy.
“While sympathetic to the predicament of DACA recipients and their families, this court has expressed concerns about the legality of the program for some time. The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, decided not to pass DACA-like legislation,” Judge Andrew Hanen wrote. 
The case is currently being reviewed at the appeals court level and could eventually reach the Supreme Court.

President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a> announced on Friday that he would make certain illegal immigrants eligible for government-backed health care coverage, prompting criticism from Republicans who said it was a “slap in the face” to American citizens. 
Biden said that illegal immigrants in the United States who had received Deferred Action for Childhood Arrival (DACA) status because they had been taken into the country with their parents, would be able to now enroll in Obamacare. In a statement, Biden said that the illegal immigrants might be eligible for financial assistance to give them coverage. 
“While President Biden continues to call on Congress to provide a pathway to citizenship to Dreamers and others, he is committed to protecting and preserving DACA and providing Dreamers with the opportunities and support they need to succeed, including access to affordable, quality health care coverage,” Biden <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2024/05/03/fact-sheet-biden-harris-administration-expands-health-coverage-to-daca-recipients/" target="_blank" rel="noopener">said</a>. 
The decision was made possible by a Biden admin rule changing the definition of “lawfully present” to include DACA recipients for Obamacare and will go into effect just before the presidential election as DACA recipients will be able to register for coverage on November 1. 
“Thanks to the Biden-Harris Administration’s actions, today’s final rule will remove the prohibition on DACA recipients’ eligibility for Affordable Care Act coverage for the first time, and is projected to help more than 100,000 young people gain health insurance,” the president added. 
The decision prompted harsh criticism from conservatives, including former President Donald Trump.

Last summer, Republicans in both the House and Senate <a href="https://tiffany.house.gov/media/editorials-letters-and-articles/gop-lawmakers-urge-biden-admin-not-fund-healthcare-illegal" target="_blank" rel="noopener">urged</a> Biden to not finalize the rule.
On Friday, Senator J.D. Vance (R-OH) said that Biden should be focusing on getting the border under control and reducing inflation instead of giving benefits to illegal immigrants. 
“There’s an unprecedented crisis at our southern border, we&#8217;ve got major conflicts around the world, and families all across Ohio are getting crushed by inflation,&#8221; he said. &#8220;Joe Biden&#8217;s response to all this is to give your hard-earned money away to illegal immigrants in the form of taxpayer-funded healthcare. A federal judge in <a href="https://www.dailywire.com/topic/texas" target="_blank" rel="noopener">Texas</a> ruled against the Deferred Action for Childhood Arrivals (<a href="https://www.dailywire.com/topic/deferred-action-for-childhood-arrivals-daca" target="_blank" rel="noopener">DACA</a>) program on Wednesday, saying that the policy, which prevents people who were brought illegally into the U.S. as children from being deported, was unconstitutional. 
In his <a href="https://storage.courtlistener.com/recap/gov.uscourts.txsd.1501682/gov.uscourts.txsd.1501682.728.0_3.pdf" target="_blank" rel="noopener">40-page opinion</a> for the Southern District of Texas, federal Judge Andrew Hanen ruled that the executive branch cannot “usurp&#8221; congressional authority. More than half a million illegal immigrants have been shielded from deportation because of the Obama-era rule, which was later adopted and amended by the Biden administration. 
“While sympathetic to the predicament of DACA recipients and their families, this court has expressed concerns about the legality of the program for some time. The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, decided not to pass DACA-like legislation,” Hanen wrote.
“Congress’ alleged failure to pass, or, stated differently, its decision not to enact legislation, does not empower the Executive Branch to ‘legislate’ on its own — especially when that ‘legislation’ is contrary to actual existing legislation. The Executive Branch cannot usurp the power bestowed on Congress — even to fill a void,” the judge added. 
Hanen’s ruling came after nine states, including Texas, Alabama, Arkansas, Louisiana, Nebraska, South Carolina, West Virginia, Kansas, and Mississippi, sued to stop DACA, saying that it was unlawfully implemented by both the Obama and Biden administrations. When announcing the complaint in December, Texas Attorney General Ken Paxton <a href="https://texasattorneygeneral.gov/news/releases/paxton-leads-coalition-defeat-daca-after-biden-administration-attempts-salvage-illegal-immigration" target="_blank" rel="noopener">said</a> that the Biden administration was attempting to implement “mass amnesty” through executive authority. 
The federal government, New Jersey, and the Mexican American Legal Defense and Education Fund (MALDEF) have argued for DACA. 
The court order adds that the decision does not require the Department of Homeland Security or the Justice Department to “take any immigration, deportation, or criminal action against any DACA recipient, applicant, or any other individual that would otherwise not be taken.”

The fate of DACA will likely be determined by the Supreme Court, which <a href="https://www.pbs.org/newshour/politics/federal-judge-declares-daca-illegal-again-issue-likely-to-be-decided-by-supreme-court#:~:text=In%202016%2C%20the%20Supreme%20Court,it%20to%20stay%20in%20place." target="_blank" rel="noopener">previously ruled</a> 5-4 in 2020 that the Trump administration could not end the program. 
The Biden administration said it was disappointed by the decision, adding that it would push Congress to pass DACA-style legislation. 
“During this Administration, hundreds of thousands of DACA recipients have been able to live and work lawfully in our country without fear of deportation,” a <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2023/09/13/statement-from-press-secretary-karine-jean-pierre-on-district-courts-ruling-on-daca/" target="_blank" rel="noopener">statement</a> from the White House said. “We are committed to protecting all the Dreamers who have throughout their lives enriched our communities and our country, and we continue to call on Congress to provide permanent protection to the hundreds of thousands of Dreamers in the United States.”

Governor <a href="https://www.dailywire.com/topic/j-b-pritzker" target="_blank" rel="noopener">J.B. Pritzker</a> (D-IL)  signed a bill on Friday that will allow foreign nationals in the state to become police officers. 
The bill, which was opposed by some police groups, including the Fraternal Order of Police, was one of 130 bills Pritzker <a href="https://www.thecentersquare.com/illinois/article_de81cd74-2d90-11ee-a038-8341950255f1.html#:~:text=(The%20Center%20Square)%20–%20More,the%20state%27s%20criminal%20justice%20system." target="_blank" rel="noopener">signed</a> on Friday. Effective immediately, foreign nationals will now be able to become police officers in the state. 
The law, HB3751, <a href="https://legiscan.com/IL/text/HB3751/2023" target="_blank" rel="noopener">says</a> that foreign nationals who “are legally authorized under federal law to work in the United States” or any foreign national who “is an individual against whom immigration action has been deferred by the U.S. Citizenship and Immigration Services under the federal Deferred Action for Childhood Arrivals (DACA) process” can apply to become a police officer in the state. 
The Fraternal Order of Police (FOP) condemned the bill earlier this year after it passed in the state House. 
“What message does this legislation send when it allows people who do not have legal status to become the enforcers of our laws?&#8221; the group said in a <a href="https://newschannel20.com/news/local/illinois-bill-would-allow-noncitizens-to-become-police#:~:text=(KHQA)%20%E2%80%94%20A%20bill%20sent,officer%20or%20a%20sheriff%27s%20deputy." target="_blank" rel="noopener">statement</a>. &#8220;This is a potential crisis of confidence in law enforcement at a time when our officers need all the public confidence they can get.”
During debate on the bill, Illinois state Sen. Chapin Rose (R) said it would be a “fundamental breach” of democracy to allow non-citizens to arrest American citizens. 
“It’s just a fundamentally bad idea,” Rose <a href="https://www.youtube.com/watch?v=pQbE9-TUxas" target="_blank" rel="noopener">said</a> in May. “I don’t care where this individual is from. Australia — they should not be able to arrest a United States citizen on United States soil.” 
Illinois has been facing <a href="https://wgntv.com/news/chicagocrime/officer-shortage-a-cause-of-concern-for-interim-cpd-boss-amid-crime-spike/" target="_blank" rel="noopener">shortages</a> of police officers as the <a href="https://www.dailywire.com/news/illinois-criminal-justice-system-reform-law-criticized-by-police" target="_blank" rel="noopener">state</a> and major metro areas like Chicago have pursued policies largely opposed by police.

Another bill <a href="https://newschannel20.com/news/local/pritzker-signs-law-to-stop-deceptive-practices-at-crisis-pregnancy-centers-sparks-pro-life-backlash" target="_blank" rel="noopener">signed</a> this week targets crisis pregnancy centers. The law will now allow Illinois’ attorney general to investigate a case of alleged consumer fraud against crisis pregnancy centers accused of deceptive practices. The law is largely taking aim at pro-life centers that suggest <a href="https://www.liveaction.org/news/research-really-shows-abortions-physical-risks/" target="_blank" rel="noopener">an association</a> between abortion and breast cancer or infertility. 
Right to Life Executive Director Mary Kate Zander said that the measure was “politically motivated” and “totally unsubstantiated.”
The Thomas More Society, a conservative law firm that fights in defense of religious liberty and free speech, filed a suit against the law on Thursday.

Eli Lilly gave $500,000 to four different organizations that provide college scholarships to illegal immigrants in Indiana who are covered by the Deferred Action for Childhood Arrivals (DACA).
The pharmaceutical company, which is based in Indianapolis, Indiana, <a href="https://investor.lilly.com/news-releases/news-release-details/lilly-provides-500000-grants-support-equitable-access-education">stated</a> that the donation seeks to “remove barriers and create more equitable, affordable post-high school education opportunities for Indiana&#8217;s growing immigrant population.”
“Lilly strongly supports the rights of immigrants, including a pathway to citizenship in the United States for Dreamers,” as well as “sensible immigration reforms that cultivate and support a diverse and skilled workforce,” the press release noted.
One of the organizations that received funding from Eli Lilly was the Indiana Undocumented Youth Alliance, whose <a href="https://www.iuya.org/">mission</a> is to “empower young immigrants to achieve higher education and engage in the community to demand more just and humane policies that affect undocumented families.”
The organization provides <a href="https://www.iuya.org/scholarship/">scholarships</a> to those who are in the United States illegally, listing undocumented status as a requirement for receiving a scholarship. Their site stipulates “The scholarship is only available to undocumented students with or without Deferred Action for Childhood Arrivals (DACA) or Temporary Protected Status.”
The organization also <a href="https://www.iuya.org/about-us/">seeks</a> to “influence the design of public policy at the local, state and federal levels to radically improve the status of undocumented individuals.”
Eli Lilly also provided financial support to the Indiana Latino Institute, a nonprofit organization that <a href="https://indianalatinoinstitute.org/">works</a> to “advance Latino educational attainment and workforce preparedness statewide through advocacy, leadership development, and culturally responsive programming.”
The organization <a href="https://indianalatinoinstitute.org/advocacy/">describes</a> itself as the “convener of Latino networks and organizations statewide,” which is “positioned to be the leader in all policy relevant to the issues impacting Latino communities throughout Indiana.”
The Indiana Latino Institute also has a <a href="https://indianalatinoinstitute.formstack.com/forms/ili_scholarship">scholarship program</a>, which gives preference to “Latino students residing in Indiana who are first generation college students,” though it does not require recipients to be in the country illegally.
The <a href="https://sadcoindy.org/#scholarship-open">Society and Friends of Colombia</a> also received financial support from Eli Lilly. The organization “focuses on Latino education advancement, Latino youth enrichment, serving as health resource partners, and promoting the cultural values of Latinos in Indiana.” The pharmaceutical giant also listed <a href="https://www.laplazaindy.org/scholarship-fund/">La Plaza</a>, another nonprofit organization, as a grant recipient.
Eli Lilly did not respond to a request for comment.

Senators J.D. Vance (R-OH) and Josh Hawley (R-MO) sent a letter to the U.S. Department of Health and Human Services Secretary Xavier Becerra, blasting the Biden administration’s plan to allow illegal immigrants access to government-provided healthcare.
The two were joined in the letter by several other Republican Congressmen and blasted the Biden administration’s plan to expand Medicaid, the Children’s Health Insurance Program (CHIP), and Obamacare market access to illegal immigrants enrolled in the Deferred Action for Childhood Arrivals (DACA) program.
The <a href="https://www.vance.senate.gov/wp-content/uploads/2023/07/DACA-Healthcare-Letter-Final.pdf">letter</a> comes months after President Biden <a href="https://apnews.com/article/biden-daca-affordable-care-act-obamacare-health-5e8777aea489484c90dbcf184cad6310?utm_source=homepage&amp;utm_medium=TopNews&amp;utm_campaign=position_01">announced</a> that illegal immigrants who are enrolled in DACA would be able to access the government-funded programs.
“By providing health insurance to DACA recipients, this policy further burdens programs intended to serve U.S. citizens and simultaneously encourages more aliens to enter our country illegally in the hopes of receiving similar protection and services,” the letter from the Republican lawmakers reads. 
Another portion states “Given that more than 25 million Americans are uninsured, we find it unimaginable that the government would prioritize providing illegal aliens with health insurance coverage.”
As of 2020, it was <a href="https://usafacts.org/articles/how-many-daca-recipients-are-there-united-states/">projected</a> that there were over 643,000 DACA recipients living in the United States.
The letter goes on to condemn the Biden administration’s handling of the border crisis, asserting “This approach appears to align with the open-borders agenda advanced by your colleague, Secretary Alejandro Mayorkas, with hundreds of thousands of aliens apprehended trying to enter our country illegally every month.”
It was also signed by 14 Congressional Republicans: Rep. Josh Brecheen (R-OK), Paul Gosar (R-AZ), Bob Good (R-VA), Matt Rosendale (R-MT), Eli Crane (R-AZ), Andy Biggs (R-AZ), Lauren Boebert (R-CO), Ken Buck (R-CO), Brian Babin (R-TX), Jeff Duncan (R-SC), Tom Tiffany (R-WI), Marjorie Taylor Greene (R-GA), Glenn Grothman (R-WI), and Tom McClintock (R-CA).
The letter points out that President Obama <a href="https://www.breitbart.com/politics/2023/04/13/flashback-obama-promised-obamacare-would-not-apply-to-illegal-aliens/">promised</a> that Obamacare wouldn’t offer healthcare coverage to illegal immigrants, also noting that the DACA program was ruled <a href="https://www.npr.org/2022/10/05/1127107147/an-appeals-court-rules-against-daca-but-the-program-continues-for-now">illegal</a> in October 2022 by the U.S. Court of Appeals for the Fifth Circuit, though it remains in use for those who were enrolled before the court’s decision.
Meanwhile, a <a href="https://homeland.house.gov/media/2023/06/CHSPreliminaryReportFINAL.pdf">recent report</a> from Republicans on the House Homeland Security Committee found illegal immigrants are putting strain on the American medical system, leaving hospitals to deal with <a href="https://www.dailywire.com/news/illegal-immigration-costs-hospitals-billions-in-unpaid-bills-house-gop-report-finds">billions of dollars</a> in unpaid medical bills.

The <a href="https://www.dailywire.com/topic/department-of-homeland-security" target="_blank" rel="noopener">Department of Homeland Security</a> has officially codified the <a href="https://www.dailywire.com/topic/deferred-action-for-childhood-arrivals-daca" target="_blank" rel="noopener">Deferred Action for Childhood Arrivals</a> (DACA) policy into federal regulation, nearly 10 years after it was established.
In a press release Wednesday, DHS Secretary Alejandro Mayorkas <a href="https://www.dhs.gov/news/2022/08/24/dhs-issues-regulation-preserve-and-fortify-daca" target="_blank" rel="noopener">announced</a> that the department had established a final rule placing <a href="https://www.dailywire.com/topic/deferred-action-for-childhood-arrivals-daca" target="_blank" rel="noopener">DACA</a> into the federal register. The rule codifies the policies instituted by the Obama administration in a 2012 policy memorandum from then-DHS Secretary Janet Napolitano. The rule has been maintained in some form by the Obama, Trump, and Biden administrations.
“Today, we are taking another step to do everything in our power to preserve and fortify DACA, an extraordinary program that has transformed the lives of so many Dreamers,” Mayorkas said in the Department&#8217;s press release Wednesday. “Thanks to DACA, we have been enriched by young people who contribute so much to our communities and our country. Yet, we need Congress to pass legislation that provides an enduring solution for the young Dreamers who have known no country other than the United States as their own.”
“DACA has transformed the lives of its recipients and has made us better and stronger as a nation,” U.S. Citizenship and Immigration Services Director Ur M. Jaddou added. “USCIS is proud to play an important role in implementing the DACA final rule and is committed to ensuring DACA recipients can continue to remain a vital part of their communities and contribute to this country that is their home.”
The DACA regulation applies to certain eligible individuals who illegally immigrated to the U.S. when they were children, deferring their deportation and allowing them the opportunity to receive a renewable two-year work visa. The regulation maintains the existing threshold criteria to qualify for DACA, as well as the existing process for DACA recipients to seek work authorization; it also “[a]ffirms the longstanding policy that DACA is not a form of lawful status but that DACA recipients, like other deferred action recipients, are considered &#8216;lawfully present&#8217; for certain purposes.”
“Since its inception in 2012, DACA has allowed over 800,000 young people to remain in the only country many of them have ever known, with their families,” DHS said in its press release. “Across the country, DACA recipients are doctors and nurses, working to ensure the health and safety of Americans; they are teachers, striving to give back to younger generations; they are members of our military serving to protect our country; they are our neighbors, friends, and family.”
The final rule goes into effect on October 31. However, it cannot fully go into effect because of an outstanding legal challenge in the Southern District of Texas.
Judge Andrew S. Hanen issued an injunction in July 2021, arguing that the Obama administration overstepped its authority and failed to follow legal requirements in creating the policy. The judge thus ruled that DACA was unlawful, as <a href="https://www.dailywire.com/news/federal-judge-in-texas-rules-daca-unlawful-says-obama-exceeded-authority-when-creating-it" target="_blank" rel="noopener">The Daily Wire</a> reported at the time.
“D.H.S. failed to engage in the statutorily mandated process, so DACA never gained status as a legally binding policy that could impose duties or obligations,” Hanen wrote in his ruling. The Fifth Circuit Court of Appeals held a hearing in July, and is expected to issue a ruling on the case later this year, <a href="https://www.cbsnews.com/news/immigration-daca-biden-federal-regulation-dreamers/" target="_blank" rel="noopener">CBS News</a> reported Wednesday, adding that the Court is expected to uphold the lower court ruling.
Until the outstanding legal challenges are settled, DHS is prohibited from granting initial DACA requests and work authorizations under the final rule. But because the injunction has been stayed in part, the Department can grant DACA renewals under it.

The Department of Justice announced last week that 26-year-old Coyoami Miguel-Ruiz had been sentenced to 28 years in prison after being found guilty of using social media to entice minors into performing sexual acts and producing pornography in exchange for money. In a statement given to The Daily Wire, Immigration and Customs Enforcement confirmed that Miguel-Ruiz had first come to the United States as an illegal alien in the late 1990s and was granted deferred action for childhood arrivals (DACA) status sometime thereafter.
In a press release last Friday, the DOJ <a href="https://www.justice.gov/usao-wdnc/pr/asheville-man-sentenced-28-years-child-pornography-charges">announced</a> that Miguel-Ruiz had been residing in Asheville, North Carolina, and had &#8220;used Snapchat and other messaging apps popular with teenagers to contact at least 15 minor females in the Asheville area for the purpose of inducing the minors to produce sexually explicit images and engage in sex acts with him in exchange for money.&#8221;
In the spring of 2020, &#8220;[Asheville Police Department] officers arrested Miguel and seized numerous electronic devices. A forensic analysis of the devices revealed that Miguel possessed dozens of videos and images of teenage girls engaging in sexually explicit conduct. Some of the videos also depicted Miguel engaging in sex acts with the minors,&#8221; the release noted. &#8220;As Miguel previously admitted in court, the defendant used the mobile payment service Cash App to pay the underage victims for the child pornography and sex acts.&#8221;
After being arrested, Miguel-Ruiz&#8217;s DACA status was terminated. DACA was created by President Barack Obama to protect children who were brought to the U.S. illegally by their parents prior to their 16th birthday from deportation.
ICE confirmed to The Daily Wire that upon completion of jail time, the federal agency will seek to begin the process of deportation:
<blockquote>&#8220;Coyoami Miguel-Ruiz, a 26-year-old undocumented migrant from Mexico, illegally entered the United States on Jan. 6, 1996, and was subsequently granted deferred action for childhood arrivals (DACA). On May 12, 2020, Miguel-Ruiz was arrested on child exploitation charges and his DACA status was terminated.&#8221;
&#8220;U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) lodged a detainer on Miguel-Ruiz with the Buncombe County Jail in Asheville, North Carolina, Oct. 14, 2020, following the termination of his DACA status.&#8221;
&#8220;On Dec. 16, Miguel-Ruiz was convicted and <a href="https://www.justice.gov/usao-wdnc/pr/asheville-man-sentenced-28-years-child-pornography-charges" target="_blank" rel="noopener" data-saferedirecturl="https://www.google.com/url?q=https://www.justice.gov/usao-wdnc/pr/asheville-man-sentenced-28-years-child-pornography-charges&amp;source=gmail&amp;ust=1640194134582000&amp;usg=AOvVaw2n_84_5lrX8ljoI_xK-fqV">sentenced</a> for possession of child pornography and using a minor to engage in sexually explicit conduct for the purpose of producing a visual depiction of such conduct in the Western District of North Carolina. Upon his release from prison, ICE will seek to take custody of Miguel-Ruiz and place him in immigration removal proceedings.&#8221;</blockquote>
A spokesman for the APD told The Daily Wire that Miguel-Ruiz&#8217;s case represents &#8220;how serious this type of crime is and how determined our detectives are in investigating it. Simply put, pornography involving juveniles and the solicitation for such heinous behavior is something Chief [David] Zack and APD officers take very seriously. And we are also appreciative of the other agencies who assisted to bring about this outcome.&#8221;
The DOJ press release notes that if Miguel-Ruiz is &#8220;not deported or later returns&#8221; to the U.S., he be will be ordered to serve a lifetime of supervised release and to register as a sex offender.

26-Year-Old DACA Recipient Sentenced To 28 Years In Prison Over Child Pornography Charges

On Thursday, speaking to DACA recipients and Dreamers, Vice President Kamala Harris told them, “This your home. … We recognize you for the Americans that you are.” She invoked the claim that the issue of illegal immigration was about “self-determination,” adding that critics of the idea of welcoming illegal immigrants had a “limited ability to understand who you are.”
“The &#8216;dreamers&#8217; are those who were brought to the U.S. illegally by their parents when they were children. Currently there are approximately 650,000 people in the U.S. being protected by DACA,” <a href="https://www.dailymail.co.uk/news/article-9815807/This-home-Harris-hosts-DACA-recipients-Texas-federal-court-rules-program-unlawful.html">The Daily Mail</a> pointed out.
Harris began by saying, “The topic of our conversation is the topic of who are we as a country and the future of our country. … Many arrived in their home country, the United States, before they could walk or talk. Many have been living recently in these years a life of uncertainty, even though this is the only home they have ever known. And they deserve a pathway to citizenship. They deserve a pathway to citizenship. And so I want to make clear to the Dreamers who are here and those who are watching from home: This is your home. This your home. And we see you and you are not alone.”
“The president and I, needless to say, and I hope many of you saw his townhall yesterday, we are unequivocal, that we recognize you for the Americans that you are,” Harris preached. “And that we recognize that you deserve all the rights that come with American citizenship. And so we will be tireless in fighting for a pathway to citizenship.”
Harris then referred to the ruling last week byfederal judge Andrew Hanen in Texas that deemed the Deferred Action for Childhood Arrivals (DACA) illegal and ordered the Biden administration to terminate giving new applications.
Harris continued, “Now we are having this conversation after the recent federal court ruling, but I want to make something clear: it will not immediately affect current DACA recipients. Also, it will put hundreds of thousands of young immigrants in jeopardy. … But our administration is taking action, so through the United States Department of Justice we have announced our intention to appeal the decision and that is in process. And the Department of Homeland Security has announced that it will propose a new rule concerning DACA, which is very important because it’s about the enforcement piece.”
Harris turned to the “<a href="https://www.congress.gov/bill/117th-congress/house-bill/6">American Dream and Promise Act</a>,” which would “provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants,” and the “<a href="https://thecounter.org/farm-workforce-modernization-act-citizenship/">Farm Workers Protection and Modernization Act</a>,” which would permit people who have done  agricultural labor or services without authorization to work in the U.S. to immediately apply for temporary legal status.
Harris stated, “We need Congress to finally create a pathway to citizenship. I spoke with Senator (Dick) Durbin last night about this very topic and we stand in solidarity on this issue, which is we will not give up in this fight.”
Then she got up on her soapbox, pontificating: “And let me make a final point: This is about what is morally right. This is a reflection of who we say we are as a country. And at it’s core I do believe this issue is also about self-determination.”
“Self-determination,” she repeated, wagging her finger in the air. “Because this is about saying we reward and should reward if we honor self-determination, the ambitions, the aspirations of our young people. This is about saying that we want to ensure that all people have the ability to determine their own future, in particular when they are living a life that is about contributing to their community.”
She mocked critics of the Biden administration’s perspective: “And also this is about saying that all people deserve to have the ability to make choices about their lives, unencumbered by other people’s limited ability to understand who you are.”
She concluded, “So these are the things that are at stake at this moment, and we will not give up and I certainly will not give up in making sure that we stand with our Dreamers and that we do everything we can to create a pathway toward citizenship.”
