A California judge dismissed the case against pro-life investigator David Daleiden over undercover videos he released over a decade ago, showing Planned Parenthood executives discussing the sale of aborted baby body parts. 
Judge Brian Ferrall of the Superior Court of San Francisco approved the dismissal on Wednesday following an agreement between Daleiden and the state of California. The decision comes after state officials <a href="https://www.dailywire.com/news/california-finally-drops-prosecution-of-journo-who-exposed-planned-parenthood-with-damning-videos">agreed last year</a> to end the prosecution against Daleiden, but pro-abortion activists attempted to intervene and block the deal. 
“As promised, the final charge has been DISMISSED and the case completely expunged — after a couple months&#8217; administrative delay, and a truly bizarre last-minute ‘April Fool&#8217;s’ attempt by [Planned Parenthood] and [the National Abortion Federation] to overturn the State&#8217;s agreement,” Daleiden <a href="https://x.com/daviddaleiden/status/2039499385256751230">posted</a> on X. 
Court records show that groups like the Feminist Majority Foundation and the National Abortion Federation filed motions seeking to block the dismissal. 
The case against Daleiden was <a href="https://www.dailywire.com/news/kamala-harris-made-a-damning-planned-parenthood-video-disappear-now-its-public">launched</a> in 2016 by then-California Attorney General Kamala Harris, who would go on to become vice president during the Biden administration. It was over the videos released in 2015 by the Center for Medical Progress, a pro-life organization founded by Daleiden. The recordings showed Planned Parenthood officials discussing the sale of fetal tissue and organs. 
After the footage was released, California authorities raided Daleiden’s home and seized materials, claiming the videos were illegally recorded. The legal battle has stretched on for nearly a decade. 
In January 2025, the Center for Medical Progress said California prosecutors had agreed to end the case against Daleiden and fellow investigator Sandra Merritt. 
“The agreement — a negotiated settlement with zero punishment — is in exchange for a new ‘no contest’ plea by Daleiden and Merritt on a single video recording charge. It involves no jail time, no fines, no admission of wrongdoing, and no probation,” the Center for Medical Progress said at the time. 
According to the group, the no-contest plea would be entered as a misdemeanor and later converted to a not guilty plea before being dismissed and expunged.
The dismissal drew praise from Daleiden&#8217;s supporters, including Assistant Attorney General for Civil Rights at the Justice Department, Harmeet Dhillon, who had previously represented him.

On Tuesday, pro-life journalist <a href="https://www.dailywire.com/news/california-finally-drops-prosecution-of-journo-who-exposed-planned-parenthood-with-damning-videos" target="_blank" rel="noopener">David Daleiden</a> gave his first interview since California stopped prosecuting him to <a href="https://www.dailywire.com/show/the-michael-knowles-show" target="_blank" rel="noopener">Daily Wire host Michael Knowles</a>.
Daleiden, the president of the Center for Medical Progress, was initially prosecuted nine years ago along with fellow journalist Sandra Merritt over undercover videos showing Planned Parenthood officials discussing the sale of aborted baby parts and organs, which is illegal. The prosecution was sparked by then-California Attorney General Kamala Harris, who was <a href="https://nypost.com/2024/08/02/us-news/kamala-harris-accused-of-weaponizing-calif-ags-office-against-activist/" target="_blank" rel="noopener">accused</a> of weaponizing her office to bolster a “mega-sponsor” in Planned Parenthood.
Knowles, who&#8217;s been friends with Daleiden for years, recapped the case for his audience by underscoring how explosive the journalists&#8217; undercover videos were, and how corrupt the prosecution was from start to finish.
&#8220;He&#8217;s been prosecuted, because he had the temerity to film Planned Parenthood executives admitting their crimes on camera,&#8221; Knowles said on &#8220;The Michael Knowles Show.&#8221; These officials admitted &#8220;on camera that they violated the law by selling baby body parts to the highest bidder.&#8221;
&#8220;So what happened? Did the authorities prosecute the abortionists who were selling human body parts of little babies?&#8221; Knowles continued. &#8220;No, of course not. They prosecuted David, because he spilled the beans on this major crime.&#8221;
Daleiden told Knowles that it was Harris who chose to &#8220;go after the whistleblowers&#8221; instead of investigating the &#8220;taxpayer-funded abortion mega clinics across her state that were caught on camera selling aborted baby body parts from criminal late-term abortions.&#8221;
The journalist called the prosecution &#8220;unprecedented,&#8221; and noted that no other journalists have ever been prosecuted under the California video recording law.
Daleiden also pushed back against what Attorney General Rob Bonta&#8217;s office has said about the case. In a press release Tuesday, the office celebrated the plea deal as a win for &#8220;reproductive health clinics and providers.&#8221;
In court, however, Daleiden said the government agreed to have the entire case &#8220;dismissed and expunged&#8221; with &#8220;no admission of wrongdoing&#8221; from the journalists. &#8220;The AG&#8217;s office basically stated on the record in court yesterday that they&#8217;re dropping the case, they&#8217;re just doing it in slow motion — so it&#8217;s sort of a fig leaf for them,&#8221; he explained.
Knowles asked Daleiden if he thought President Donald Trump&#8217;s 2024 victory and actions in office over the last week played into the state dropping the case.
&#8220;I think it probably changes everything,&#8221; Daleiden said. The promotion of Harris to the highest office in the land, had she won, would have incentivized more of the same behavior, he added.
Daleiden also stated that there&#8217;s more work to be done, namely making sure the federal government stops funding Planned Parenthood. &#8220;That&#8217;s the next thing that we should see happen,&#8221; he said. &#8220;We need to stop propping up the nearly <a href="https://www.blackburn.senate.gov/2023/12/news/new-report-reveals-nearly-2-billion-funneled-to-big-abortion-providers#:~:text=WASHINGTON%2C%20D.C.%20–%20A%20new%20U.S.,abortion%2Don%2Ddemand%20agenda.">$2 billion</a> taxpayer funded illegal Planned Parenthood late-term abortion businesses.&#8221;

California on Monday agreed to finally end the prosecution of Center for Medical Progress journalists David Daleiden and Sandra Merritt, who released videos of Planned Parenthood officials discussing the sale of aborted baby parts and organs, which is illegal.
The controversial prosecution of Daleiden and Merritt was sparked by then-California Attorney General Kamala Harris, who was <a href="https://nypost.com/2024/08/02/us-news/kamala-harris-accused-of-weaponizing-calif-ags-office-against-activist/" target="_blank" rel="noopener">accused</a> of weaponizing her office to bolster a &#8220;mega-sponsor&#8221; in Planned Parenthood. The journalists were formally charged under Harris&#8217; successor with 15 felony counts for videotaping “confidential” communications.
&#8220;The agreement—a negotiated settlement with zero punishment—is in exchange for a new &#8216;no contest&#8217; plea by Daleiden and Merritt on a single video recording charge. It involves no jail time, no fines, no admission of wrongdoing, and no probation,&#8221; a <a href="https://www.centerformedicalprogress.org/2025/01/breaking-state-of-california-agrees-to-end-unprecedented-prosecution-of-cmps-undercover-video-reporting/">press release</a> from CMP says. &#8220;The new &#8216;no contest&#8217; plea—which cannot be used adversely—will be entered into judgment as a misdemeanor in 6 to 12 months, and then converted to a &#8216;not guilty&#8217; plea, dismissed, and expunged.&#8221;
A <a href="https://oag.ca.gov/news/press-releases/attorney-general-bonta-secures-felony-conviction-david-daleiden-and-sandra">press release</a> from California Attorney General Rob Bonta seemed to celebrate the plea deal.  The AG&#8217;s office said that Daleiden and Merritt were convicted &#8220;for criminally recording confidential communications with women’s healthcare providers.&#8221;
&#8220;Previously, in 2017, the California Department of Justice <a title="https://oag.ca.gov/news/press-releases/attorney-general-xavier-becerra-announces-charges-filed-against-david-robert" href="https://oag.ca.gov/news/press-releases/attorney-general-xavier-becerra-announces-charges-filed-against-david-robert">announced</a> the filing of an arrest warrant against Daleiden and Merritt,&#8221; the press release said. &#8220;[T]hey each pleaded no contest to, and were found guilty of, one felony count of California Penal Code Section 632(a) (unlawful recording of confidential communication).&#8221;
“While the Trump Administration is issuing pardons to individuals convicted of harming reproductive health clinics and providers, my office is securing criminal convictions to ensure that Californians can exercise their constitutional rights to reproductive healthcare,” Bonta said. “We will not hesitate to continue taking action against those who threaten access to abortion care — whether by recording confidential conversations or other means.”
Daleiden, who&#8217;s the president of CMP, called the end of the prosecution a &#8220;huge victory.&#8221;
“After enduring nine years of weaponized political prosecution, putting an end to the lawfare launched by Kamala Harris is a huge victory for my investigative reporting and for the public’s right to know the truth about Planned Parenthood’s sale of aborted baby body parts,&#8221; Daleiden said.
&#8220;Now we all must get to work to protect families and infants from the criminal abortion-industrial complex,” he added. “Taking the San Francisco case off the board allows me to focus fully on CMP’s mission to report on the injustices of taxpayer-funded experiments on aborted babies and continue to expand our groundbreaking investigative reporting.”
CMP noted that the undercover videos involved in the case sparked a massive <a href="https://www.latimes.com/local/lanow/la-me-fetal-tissue-20171209-story.html" target="_blank" rel="noopener">$7.8 million settlement</a> from two bioscience companies that admitted to illegally selling aborted fetuses from Planned Parenthood in Southern California. Their footage was also the subject of a &#8220;settlement with <a href="https://www.azcentral.com/story/news/local/phoenix/2017/01/24/arizona-ends-investigation-into-abortion-doctor-fetal-tissue-collections/96998988/">disgorgement</a> of profits from the sale of aborted fetal organs in Arizona, and the <a href="https://www.texasattorneygeneral.gov/news/releases/ag-paxton-fifth-circuit-upholds-decision-defund-planned-parenthood">disqualification</a> of Planned Parenthood from state and federal funding in Texas for violations of medical standards and ethics documented on the undercover footage—where Planned Parenthood <a href="https://www.reuters.com/legal/planned-parenthood-must-face-trial-over-texas-medicaid-fraud-claims-2023-10-24/">now</a> faces a nearly $2 billion federal False Claims Act case from the disqualification.&#8221;

California Finally Drops Prosecution Of Journalist Who Exposed Planned Parenthood With Damning Video

It was a spring day in 2016 when 11 heavily-armed men pulled up to pro-life activist <a href="https://www.dailywire.com/topic/david-daleiden" target="_blank" rel="noopener">David Daleiden&#8217;s</a> southern California home.
Daleiden’s crime? Exposing Planned Parenthood officials discussing the sale of body parts and organs of aborted babies.
The person going after him? California Attorney General <a href="https://www.dailywire.com/topic/kamala-harris" target="_blank" rel="noopener">Kamala Harris</a>. 
At the behest of Planned Parenthood, on April 5, 2016, Harris ordered a raid on Daleiden’s apartment to seize undercover footage shot by his organization, the Center For Medical Progress. Harris&#8217;s office charged Daleiden with violating video privacy laws.
During the raid, Daleiden told The Daily Wire that a “dystopian kind of clown car” from the California Department of Justice showed up to his apartment in Orange County. To raid his apartment—which he says was only large enough to fit five people at a time—the 11-man team came armed with rifles and a canine unit in a white, windowless van.
“There were five big guys traipsing around inside the apartment looking behind statues of the Virgin Mary and rooting through my investigative files,” Daleiden said in an interview this week. “It was the most bizarre thing, watching them flip through, and thumb through printed out pages that I had of different companies&#8217; invoices for aborted baby parts from Planned Parenthood. They set the invoices aside and they didn’t seize those.”
They did take about half of the undercover footage Daleiden and his team had obtained of Planned Parenthood officials. A federal judge in San Francisco then placed an injunction on Daleiden from publishing the footage. Some of that footage has begun to <a href="https://www.dailywire.com/news/kamala-harris-made-a-damning-planned-parenthood-video-disappear-now-its-public?topStoryPosition=3" target="_blank" rel="noopener">trickle out</a> in recent months, thanks to the work of Rep. Marjorie Taylor Greene (R-GA), whose office obtained the videos through congressional subpoena. 
Daleiden said the raid lasted about four hours and was a “harrowing experience.” 
“Imagine the state police showing up at your doorstep and just ransacking your belongings,” he said. “They overturned everything and made a huge mess.”
He said the agents were like “hurricane Kamala tearing through your living space.”
Daleiden said that the investigators who took his footage and began investigating him didn’t even watch the footage they were taking. 
“Under Kamala Harris’s leadership, they did this full on, SWAT team-style raid to seize the undercover tapes because they had all this damning stuff about Planned Parenthood on them,” he said. “But then once they got the tapes, they didn’t actually watch them, they just tried to validate a list that Planned Parenthood had given them of people that they could identify and use to bring these completely unprecedented charges against me under the California Video Recording Law.”

Daleiden and fellow investigator Sandra Merritt were <a href="https://www.centerformedicalprogress.org/cmp/support-our-legal-defense/" target="_blank" rel="noopener">later charged</a> with 15 felony charges of videotaping “confidential” communications by Harris&#8217;s successor—and future HHS Secretary—Xavier Becerra. Litigation is still ongoing in that case, though about half of the charges have been dismissed. 
“It’s a total weaponization of government,” Daleiden said. “As California attorney general, Kamala Harris weaponized the power of her office to cover up barbaric criminal activity on the part of Planned Parenthood. And she did so by invoking a never-before-used California video recording law that has never been applied to undercover news gathering.”
Daleiden said that Harris should be asked if she ever watched the videos his team had taken, or knew what was on the videos before ordering them to be seized. 
“So Kamala Harris weaponized her office and weaponized the law in a completely unprecedented way to try to discriminate against free speech that her powerful political backers disagreed with and that they wanted to suppress because the evidence was so damning for them,” Daleiden said.
Harris ordered the raid just two weeks after she met with Planned Parenthood officials, and after the organization had specifically requested the computers used for the undercover videos to be seized. Now the presumptive Democratic nominee for president, Harris has long maintained close ties with Planned Parenthood. She has made promoting abortion a central point of her campaign.

‘Hurricane Kamala’: Activist Remembers ‘Harrowing’ Raid Ordered By Harris Over Planned Parenthood Videos

Never before seen footage showing a <a href="https://www.dailywire.com/topic/planned-parenthood">Planned Parenthood</a> employee appearing to discuss the sale of aborted babies’ body parts was released Tuesday, years after now-Vice President <a href="https://www.dailywire.com/topic/kamala-harris">Kamala Harris</a> seized the footage as Attorney General of California.
The five-minute video shows a conversation between a person identified as Dr. Stacy De-Lin, Planned Parenthood New York City Medical Director for Abortion Services, and an undercover reporter with the Center for Medical Progress (CMP). During their conversation, De-Lin seems to acknowledge that Planned Parenthood would sell the livers of aborted babies.
In one clip, De-Lin is told by a CMP investigator that she “could pay you $1,000, up to $1,500 for a liver.”
“Yeah, that’s great,” De-Lin responds. “I think a financial incentive from you guys like, to the people we have to get this approved from, will be very happy about it,” <a href="https://www.youtube.com/watch?v=_1kDkgS1vpg">according</a> to the video shared by CMP.

The full videos show why they did, Daleiden says.
“You can see just from the first video why Planned Parenthood tried so hard to cover this up for eight years,” Daleiden told The Daily Wire on Wednesday. “They spent years and millions of taxpayer dollars trying to make sure that the admissions on these undercover tapes never see the light of day.”
A federal judge in 2016 blocked CMP from sharing the full confiscated video for eight years. Rep. Marjorie Taylor Greene (R-GA) obtained the video through a subpoena earlier this year. Her office began <a href="https://www.dailywire.com/news/pull-off-a-leg-or-two-footage-shows-reported-planned-parenthood-employee-discussing-brutal-abortion-practices">publishing</a> clips of the videos earlier this year, and <a href="https://greene.house.gov/news/documentsingle.aspx?DocumentID=801">released</a> the full footage on Tuesday.
In the video, De-Lin appears to admit that Planned Parenthood New York City engaged in illegal abortions, saying that they will do “fully intact” dilation and evacuation abortions, which fall in the category of partial-birth abortions.
“We certainly do intact D&amp;Es,” De-Lin says, after the undercover investigator said she would pay more for intact unborn babies.
According to Daleiden, the full video is “too incriminating to explain away.”
“There’s really no way that they can spin this stuff anymore. There’s no way that they can explain away admissions that are this stark and this obvious from their own top level leadership,” Daleiden said.
“And that’s why they went, eight years ago, to such incredible lengths to ask Kamala Harris when she was Attorney General of California to use the powers of her office to raid my home, try to seize all the original copies of the undercover footage, and prevent it from continuing to be published,&#8221; Daleiden continued. 
De-Lin, who now works at Planned Parenthood Hudson Peconic, did not respond to a phone call or email asking for comment on the videos. Planned Parenthood also did not return a request for comment.
Daleiden said that he expects lawmakers to release more previously blocked CMP videos in the coming weeks.
Harris has made abortion a key part of her 2024 campaign, attacking former President Donald Trump over the overturning of Roe v. Wade. 
She has long been backed by Planned Parenthood and other pro-abortion groups, <a href="https://www.catholicnewsagency.com/news/46103/kamala-harris-and-her-pro-abortion-donor-base">raking</a> in tens of thousands of dollars in donations from the pro-abortion lobby throughout her career.
In 2020, Planned Parenthood Action released an ad campaign calling Harris “OUR Reproductive Health Champion.” That year, Planned Parenthood Votes published an article entitled &#8220;Nine Reasons to Love Kamala Harris.&#8221;

At the Tuesday hearing, called “Investigating the Black Market of Baby Organ Harvesting,” Center for Medical Progress (CMP) President David Daleiden told lawmakers that videos obtained by his organization showed Planned Parenthood revealing that it had a “financial incentive” to sell the body parts of aborted babies and discussing their brutal abortion practices.
“These video clips from the subpoenaed congressional footage are just a small part of incredibly disturbing and incriminating undercover conversations that prove Planned Parenthood sells baby parts,” Daleiden <a href="https://www.centerformedicalprogress.org/2024/03/new-videos-planned-parenthood-seeks-1500-per-fetal-liver-financial-incentive-docs-can-pull-off-a-leg-or-two-to-hide-partial-birth-abortions/" target="_blank" rel="noopener">said</a>. “Planned Parenthood and their allies tried to cover up this footage for eight years because of the brutal facts it reveals about their taxpayer-funded business to kill and sell vulnerable infants.”

The clips played on Tuesday before the lawmakers were recorded years ago, but were previously unable to be released due to court order.
In one clip played during the testimony, a woman identified by CMP as Planned Parenthood New York City’s Medical Director for Abortion Services Dr. Stacy De-Lin is told by a Center for Medical Progress investigator that she “could pay you $1,000, up to $1,500 for a liver.”
De-Lin responded by saying, “Yeah, that’s great,” and, “I think a financial incentive from you guys like, to the people we have to get this approved from, will be very happy about it,” according to the video shared by CMP.

CMP said that another one of the videos showed then-Planned Parenthood Gulf Coast’s Chief Medical Officer Dr. Ann Schutt-Aine discussing ways to get around federal law banning partial birth abortions.

“If I’m seeing that I’m in fear that it’s about to come to the umbilicus [navel], I might ask for a second set of forceps to hold the body at the cervix and pull off a leg or two, so it’s not PBA [partial-birth abortion],” Schutt-Aine said, according to the CMP video.

In a different video featuring one of Schutt-Aine’s colleagues, an individual identified by CMP as Planned Parenthood employee Tram Nguyen says that sometimes an arm is ripped off the unborn baby during an abortion. “[O]ther days it’s [the fetus is] like more intact where it’s like maybe only like an arm that’s disarticulated,” she said, the CMP video shows.
Another video showed Planned Parenthood trainer Dr. Uta Landy reading from quotes about people who had been trained to do abortions, according to CMP.
“My coping mechanism is to focus on the baby/fetus. Reverence for something that was once alive and now it’s not,” one person said. Another said, “An eyeball just fell down into my lap, and that is gross,” prompting laughter from the abortionists in the audience.

New legislation introduced by Republican Florida Rep. Scott Franklin zeroes in on allegations that abortion providers are profiting from the sale of fetal remains.
The Prohibiting Abortion Industry’s Lucrative Loopholes Act, first obtained by The Daily Wire, prohibits payments, reimbursements, gifts, or compensation of fetal tissue by closing the “valuable consideration” loophole in current law and punishing violators with fines or up to ten years in prison.
&#8220;Abortion providers should never be allowed to profit off the death of innocent victims,&#8221; Franklin told The Daily Wire. &#8220;The fact that they can exploit a loophole in the law to do so is a terrible congressional oversight that should have been addressed years ago.&#8221;
Though Congress outlawed the for-profit sale of fetal remains in 1993, organizations like the Planned Parenthood Federation of America have <a href="https://www.wsj.com/articles/planned-parenthood-stops-taking-reimbursements-for-fetal-tissue-1444744800">publicly</a> acknowledged payments for fetal tissue but explain them away by claiming they were only reimbursed for costs.
Planned Parenthood has subsequently said it would no longer accept even reimbursement for fetal remains when Center for Medical Progress (CMP) President David Daleiden, a pro-life activist, secretly recorded and published videos of Planned Parenthood employees in 2013 and 2014 <a href="https://dailycaller.com/2018/08/17/planned-parenthood-video-abortions/">purportedly discussing</a> the sale of fetal body parts.
Though Planned Parenthood sued both Daleiden and the CMP in March 2016, saying the videos were deceptively edited, the footage has had a lasting impact on pro-life legislation and rhetoric and prompted scrutiny of Planned Parenthood by authorities and lawmakers.

The Public Health Service Act currently <a href="https://www.hhs.gov/ohrp/regulations-and-policy/guidance/public-law-103-43/index.html#:~:text=498B.,the%20transfer%20affects%20interstate%20commerce.">states</a> that &#8220;it shall be unlawful for any person to knowingly acquire, receive, or otherwise transfer any human fetal tissue for valuable consideration if the transfer affects interstate commerce.&#8221;
The act also states that it is unlawful for anyone to &#8220;solicit or knowingly acquire, receive, or accept a donation of human fetal tissue for the purpose of transplantation of such tissue into another person&#8221; if the &#8220;person who solicits or knowingly acquires, receives, or accepts the donation has provided valuable consideration for the costs associated with such abortion.&#8221;
Franklin&#8217;s legislation proposes redefining &#8220;valuable consideration&#8221; to include &#8220;any payment made or debt incurred,&#8221; &#8220;any gift, honorarium, or recognition of value bestowed,&#8221; &#8220;any price, charge, or fee which is waived, forgiven, reduced, or indefinitely delayed,&#8221; &#8220;any loan or debt which is canceled or otherwise forgiven,&#8221; &#8220;the transfer of any item from one person to another or provision of any service or granting of any opportunity for which a charge is customarily made, without charge or for a reduced charge,&#8221; &#8220;and any payments associated with the transportation, implantation, processing, preservation, quality control, or storage of human fetal tissue.’’
The legislation is supported by the pro-life Susan B. Anthony List and co-sponsored by a slew of Republicans, including Ralph Norman of South Carolina, Lauren Boebert of Colorado, Jeff Duncan of South Carolina, Alex Mooney of West Virginia, Ben Cline of Virginia, Brian Mast of Florida, Jim Banks of Indiana, Jody Nice of Georgia, and Andy Biggs of Arizona.
In December 2016, then-Senate Judiciary Committee Chairman Chuck Grassley referred multiple Planned Parenthood affiliates and companies to the FBI and the Department of Justice for investigation and possible prosecution.
“I don’t take lightly making a criminal referral,&#8221; Grassley said at the time. &#8220;But, the seeming disregard for the law by these entities has been fueled by decades of utter failure by the Justice Department to enforce it.&#8221;
&#8220;And, unless there is a renewed commitment by everyone involved against commercializing the trade in aborted fetal body parts for profit, then the problem is likely to continue,&#8221; he added.

GOP Targets Loophole Allegedly Allowing Abortion Providers To Profit From Sale Of Fetal Remains

Republican Sen. Tom Cotton (R-AR) tweeted Monday that he and others are pledging to refuse to confirm Democratic presidential nominee Joe Biden&#8217;s pick to helm the Health and Human Services administration, Xavier Becerra, over concerns he&#8217;ll use the office to target abortion opponents, similar to the way he targeted pro-life crisis pregnancy centers in California.
Biden announced Becerra&#8217;s new role Monday morning, defying expectations that he would appoint the former Congressman and current California Attorney General to a role within the Department of Justice.
Democrats, and particularly progressives, applauded the choice, noting that Becerra was an advocate for universal health coverage while in Congress and is recently on the record as a supporter for a Medicare-for-All-style health care system, though Joe Biden refused to make such a plan part of his campaign for president, citing a need, instead, for overhauling and refining parts of the Affordable Care Act.
Republicans, though, were quick to point out that Becerra signals a willingness on the part of a Biden administration to target abortion opponents directly. As attorney general, Becerra tried to force pro-life crisis pregnancy centers, which provide free prenatal care to expectant mothers but do not offer abortions, to provide potential patients with information about where they could obtain a free or low-cost abortion.
Cotton tweeted his pledge on Monday, saying, flatly that he would be &#8220;voting no, and Becerra should be rejected by the Senate.&#8221;
&#8220;Xavier Becerra spent his career attacking pro-life Americans and tried to force crisis pregnancy centers to advertise abortions,&#8221; Cotton wrote. &#8220;He&#8217;s been a disaster in California and he is unqualified to lead HHS. I’ll be voting no, and Becerra should be rejected by the Senate.&#8221;
The resulting legal case, National Institute of Family and Life Advocates v. Becerra, made it all the way to the Supreme Court, where Becerra lost. The Supreme Court approved a preliminary injunction against the law, titled the &#8220;Reproductive FACT Act,&#8221; noting that requiring pro-life pregnancy centers to inform patients about abortion likely violated their First Amendment rights to both free speech and to free exercise.
At the time, <a href="https://www.politico.com/story/2018/06/26/supreme-court-crisis-pregnancy-centers-673183">Politico notes</a>, Becerra pledged to continue targeting abortion opponents.
&#8220;California Attorney General Xavier Becerra called the decision &#8216;unfortunate&#8217; and said the state will continue working to &#8216;ensure that Californians receive accurate information&#8217; about their health options. His office did not indicate how the state would respond,&#8221; the outlet noted. “&#8217;When it comes to making their health decisions, all California women — regardless of their economic background or zip code — deserve access to critical and non-biased information to make their own informed decisions,'&#8221; Becerra said.&#8221;
Pro-life group Susan B. Anthony List also pointed out that Becerra continued prosecuting David Daleidin, a journalist who exposed Planned Parenthood&#8217;s alleged involvement in &#8220;baby parts trafficking.&#8221;

The appointment does seem in line with a potential Biden administration&#8217;s approach to pro-lifers and others who have a religious objection to promoting or providing abortion or contraception. Biden has promised to reinstate the Affordable Care Act&#8217;s contraception mandate, <a href="https://www.catholicnewsagency.com/news/biden-says-catholic-nuns-inspire-him-to-run-plans-to-sue-little-sisters-of-the-poor-12427">Catholic News Agency reports</a>, removing freedom of conscious protections that exempt religious employers from violating religious beliefs preventing them from providing birth control free of charge to employees.
&#8220;Shortly after the Supreme Court ruled in favor of the Little Sisters of the Poor in Little Sisters of the Poor v. Pennsylvania on July 8, Biden said he was &#8216;disappointed&#8217; by the decision and promised to reinstate Obama-era policies requiring the sisters to ensure access to birth control in violation of their religious beliefs,&#8221; CNA reported.
“If I am elected I will restore the Obama-Biden policy that existed before the [Supreme Court’s 2014] Hobby Lobby ruling: providing an exemption for houses of worship and an accommodation for nonprofit organizations with religious missions,” Biden said in July.

The jury in the “Baby Body Parts” trial of activist and journalist David Daleiden has delivered a blow to undercover journalism, declaring that secret filming is now illegal and can leave journalists open to massive damages.
Planned Parenthood was awarded almost $2 million for the filming after alleging activist journalist David Daleiden secretly recorded executives negotiating to sell baby body parts.
Peter Breen, a lawyer for Mr. Daleiden, said the judgement is a direct threat to undercover journalism in California and across the country.
“Undercover Journalism now comes with a $2 million price tag,” he said.
Mr. Breen blamed Judge William Orrick&#8217;s directions to the jury for the verdict.
“The judge should have told them that Mr. Daleiden&#8217;s filming was protected by the First Amendment. Instead, he told them the First Amendment is no defense, which is outrageous and not the law. When you have a series of unfair rulings, you can’t expect a fair verdict,” Breen said.
Judge Orrick <a href="https://www.dailywire.com/news/judge-in-planned-parenthood-trial-orders-guilty-verdict-against-journalist">told the jury</a> in advance of their verdict that he has decided to find Daleiden guilty of trespass during his undercover journalism. Daleiden previously lost an attempt to have Judge Orrick removed from the case, alleging he was biased against the defendants.
Planned Parenthood sued Daleiden and his colleagues after they released secretly recorded videos of Planned Parenthood executives haggling over the sale and price of baby body parts from abortions in their facilities. Planned Parenthood made a series of claims – stating they had caused damages because of their invasion of privacy with the undercover filming, fraud because they set up a false buying company, and RICO conspiracy because a number of people worked together in the project. RICO charges are more normally associated with criminal mafia cases. The jury found for Planned Parenthood in all their claims.
Daleiden and his colleagues Sandra Merritt, Albin Rhomberg, Adrian Lopez and Troy Newman, denied all the charges.
Planned Parenthood originally sought $20 million in damages against Daleiden and his colleagues. Daleiden recorded Planned Parenthood executives stating they changed abortion techniques to ensure better and more profitable body parts were retrieved for sale. His attorneys argue that the recordings took place in public places, such as restaurants and hotels, where participants have no reasonable expectation of privacy.
Planned Parenthood did not sue Daleiden for defamation or slander and the organization’s lawyers did not state that the videos were inaccurate or exaggerated. They instead claimed that they were filmed as a result of trespassing and other illegal methods. The organization is also claiming Daleiden and his colleagues are guilty of fraud for setting up a fake company and identifications to open business conversations with Planned Parenthood executives.
The defendants argued that they were involved in journalism and revealing criminal activity.

Journalists Who Exposed Planned Parenthood’s ‘Baby Body Parts’ Trade Found Guilty

The judge in the “Baby Body Parts” trial of activist and journalist David Daleiden has ordered the jury find him guilty of trespassing at Planned Parenthood conferences and clinics — before the jury retired to consider a verdict.
Planned Parenthood is suing Daleiden and his colleagues after they released secretly recorded videos of executives haggling over the sale and price of baby body parts from abortions in their facilities.
Daleiden is contesting all the charges. However, Judge William Orrick told the jury that he has decided to find Daleiden guilty of trespass during his undercover journalism. Daleiden previously lost an attempt to have Judge Orrick removed from the case, alleging he was biased against the defendants.
Thejudge stated that the jury must find that Daleiden and others “trespassed at the 2014 Forum in Miami, Florida; at the 2015 MeDC meeting in Orlando, Florida; and the 2015 National Conference in Washington, D.C.”
“I have already determined that these defendants trespassed at each of these locations. Because I determined that these defendants trespassed, the law assumes that Planned Parenthood has been harmed and is entitled to an award of nominal damages such as one dollar for each trespass,” he told the jury as the trial comes to a conclusion.
The judge said he had also determined that Daleiden and his colleagues trespassed at the Planned Parenthood Rocky Mountain Center in Colorado and a Planned Parenthood Center in Texas.
The judge said the jury must accept his rulings and only decide if Planned Parenthood suffered damage from the trespass and what damages they should be awarded.
Planned Parenthood originally sought $20 million in damages for trespassing, fraud, and RICO conspiracy against Daleiden and his colleagues. However, Judge Orrick reduced potential damages to $600,000.
Daleiden recorded Planned Parenthood executives stating they changed abortion techniques to ensure better and more profitable body parts were retrieved for sale. His attorneys argue that the recordings took place in public places, such as restaurants and hotels, where participants have no expectation of privacy.

Addressing the jury at the close of the trial, Peter Breen, counsel for Daleiden and his colleagues, said the case is “about the steps it took for private citizen investigators to cut through a curtain of silence and concealment.”
“They didn&#8217;t do it for profit or for personal gain.  They did it for the paramount public purpose of letting Americans know and law enforcers investigate whether and to what extent our laws may have been violated. And they are not just any laws, but these are laws relating to homicide against born human beings, laws against the selling of body parts and organs of aborted human fetuses, and the laws against changing medical procedures without knowledge and consent to obtain more valuable fetal parts,” he told the jury.
He referred to Planned Parenthood lawyers stating that the case is about “protecting the brand.”
“But what is it, that hurt the brand? The very words spoken by Planned Parenthood personnel on those videos is what hurt the brand,” Breen contended.
Breen argued that at no point during the trial did Planned Parenthood dispute the accuracy of the secretly recorded videos.
“Now, Planned Parenthood could have tried to dispute this issue, but when push came to shove here at trial, a place where you need hard evidence to back up your claims, they had nothing. This is what so outraged the public. The true words of Planned Parenthood&#8217;s top abortion doctors and other personnel,” he told the jury.
He added that it was not a case of fraud or racketeering but rather one about the freedom of the press.
“This is a case of undercover journalism. And we, the people, need that information. You need that information. You may not like seeing that information. It may be difficult or whatever. But we don&#8217;t want to stop the flow of information.”
Also addressing the jury was Charles Limandri, another lawyer for Daleiden and his colleagues, who said the evidence they heard showed “people, obviously, making huge profits selling and buying fetal tissue, which is not legal.”
“Different people understanding they have different views about using undercover techniques where you have to misrepresent your identity and misrepresent why you&#8217;re there.  But if you&#8217;re doing it to save human lives and to stop the type of atrocities that we&#8217;re talking about here, it&#8217;s fully justifiable,” he added.
He said the charges were an attempt by Planned Parenthood to “conceal criminal activity.”
“And they even want you to use a threat of punitive damages to stop them — stop anybody from ever being able to show — do that again. And they want to destroy these defendants, financially.”
The jury has retired to consider its verdict.
