Michigan&#8217;s leftist Attorney General Dana Nessel filed a <a href="https://www.michigan.gov/ag/-/media/Project/Websites/AG/releases/2026/January/Michigan-Energy-Affordability-Complaint.pdf?rev=5fe0d3cf29174f30a7f4853ef1eb0c22&amp;hash=3242B297D226DCDD835DF7D328490E32">lawsuit</a> on behalf of Michigan residents on Friday, arguing that multiple oil companies violated antitrust laws and conspired to harm the renewable energy and electric vehicle markets.
The lawsuit <a href="https://www.michigan.gov/ag/news/press-releases/2026/01/23/attorney-general-nessel-files-lawsuit-against-fossil-fuel-defendants">alleges</a> that BP, Chevron, ExxonMobil, Shell, and the oil industry association, the American Petroleum Institute, acted &#8220;as a cartel&#8221; to go after renewable energy sources and &#8220;restrain the emergence of electric vehicles.&#8221; The alleged conspiracy has caused Michigan residents to &#8220;suffer artificially high home and transportation energy costs,&#8221; according to Nessel.
&#8220;Specifically, by suppressing innovation and investment in renewable energy, EVs, and EV infrastructure, Defendants have artificially reduced the output of electricity as a substitute for gasoline and other energy sources,&#8221; the lawsuit states. &#8220;This restraint not only eliminated competitive pressure that would have lowered prices, but also deprived Michigan consumers of meaningful choice, forcing them to buy primary and transportation energy products at supracompetitive prices and with additional costs in the form of negative externalities.&#8221;
Critics of the EV push have argued the opposite of what Michigan claims in the lawsuit, saying that in recent years, the federal government and some state governments have artificially propped up the EV market in an attempt to encourage Americans to give up gas-powered vehicles.
American automakers, such as Michigan-based Ford and General Motors, have recently <a href="https://www.dailywire.com/news/ford-delays-production-of-new-electric-vehicles-by-years-as-consumers-sour-on-evs">dialed back</a> their investments in EV production due to <a href="https://www.dailywire.com/news/gms-ev-struggles-trigger-mass-layoffs-in-three-states">low demand</a> and high manufacturing costs. Last year, the EV market took a hit when President Donald Trump ended the Biden-era EV tax credit, which encouraged Americans to buy alternatives to gas- and diesel-fueled vehicles.
Nessel&#8217;s lawsuit accuses the oil companies of violating the Sherman Antitrust Act, the Clayton Antitrust Act, and the Michigan Antitrust Reform Act, which prohibit monopolies and anti-competitive practices. The state of Michigan is demanding a jury trial.
&#8220;Michigan is facing an energy affordability crisis as our home energy costs skyrocket and consumers are left without affordable options for transportation. Chevron counsel Theodore J. Boutrous Jr. said that courts have dismissed similar lawsuits in multiple states, adding that Michigan&#8217;s lawsuit &#8220;ignores the fact that Michigan is highly dependent on oil and gas to support the state’s automakers and workers,” The Detroit Free Press <a href="https://www.freep.com/story/money/business/michigan/2026/01/23/michigan-attorney-general-dana-nessel-lawsuit-conspiracy-oil-companies/88298387007/">reported</a>.
Ryan Meyers, general counsel for the American Petroleum Institute, added, &#8220;These baseless lawsuits are a coordinated campaign against an industry that powers everyday life, drives America’s economy, and is actively reducing emissions. Michigan Democratic Attorney General Dana Nessel dropped all charges against seven University of Michigan students on Monday, a twist that shocked defense attorneys after Nessel had pushed for felony charges against the anti-Israel protesters.
The seven students faced misdemeanor charges of trespassing and felony charges of resisting and obstructing police stemming from an anti-Israel protest on Michigan&#8217;s campus last year, The Detroit Free Press <a href="https://www.freep.com/story/news/local/michigan/2025/05/05/michigan-attorney-general-dana-nessel-drops-all-charges-university-michigan-diag-protesters/83452242007/" target="_blank" rel="noopener">reported</a>. The courtroom, which was packed with people supporting the anti-Israel students, erupted in cheers and chants of &#8220;Free Palestine&#8221; when it was announced that the charges had been dropped.
Last September, Nessel pushed for the felony charges against the students, which could have put them behind bars for up to two years if they had been convicted. The attorney general alleged that the protesters used &#8220;physical force to counter&#8221; police officers who were attempting to clear them out of the area.
Nessel, who is Jewish, was pressured to recuse herself from the case last month as critics alleged that she was biased against Muslims. Nessel said that a letter from the Jewish Federation of Greater Ann Arbor defending her amid the accusations influenced her decision to drop the charges. The Democratic attorney general claimed that the letter — which said that Nessel &#8220;has a strong history of uplifting those in both the Muslim and Arab American communities&#8221; — was inappropriate.
&#8220;We have learned that a public statement in support of my office from a local nonprofit has been directly communicated to the court,&#8221; Nessel said. &#8220;The impropriety of this action has led us to the difficult decision to drop these charges.&#8221;
The defendants, Oliver Kozler, Samantha Lewis, Henry MacKeen-Shapiro, Michael Mueller, Asad Siddiqui, Avi Tachna-Fram, and Rhiannon Willow, were also surprised by the decision and will now walk away from the charges in this case. Lewis, who said she faces charges in a separate case over another protest, mocked the attorney general, saying that &#8220;the possibility of recusal was going to be so embarrassing for Nessel that she just couldn&#8217;t bear it.&#8221;
&#8220;And so while all of us, and that includes all of you, refused to cower, she did. And that just goes to show that the bullies and badges and the top pig are just cowards,&#8221; Lewis told a group of her supporters.
The University of Michigan called in police to <a href="https://www.nbcnews.com/news/us-news/police-break-palestinian-camp-university-michigan-rcna153229" target="_blank" rel="noopener">break up</a> an anti-Israel encampment on its campus last May as university leadership faced calls to push back on antisemitism at the school. Michigan Democrats are pushing multiple pieces of controversial legislation before they lose their hold on the Michigan House of Representatives at the end of the year. Two Democrats and the entire House Republican conference, however, skipped the state legislature&#8217;s sessions on Wednesday, hamstringing Democrats&#8217; last-minute efforts.
Far-Left Democrats in the House have been pushing for a vote on a bill to allow illegal immigrants to obtain driver’s licenses, and a police reform bill that would limit law enforcement&#8217;s use of no-knock warrants. But Republicans, joined by Democratic Rep. Karen Whitsett, want the House to focus on fixing the roads, protecting restaurant workers&#8217; tips, and fixing issues with a paid sick leave law.
Michigan House Republicans walked out of the legislative session last week, slamming Democrats for ignoring legislation on road improvements, minimum wage, and paid sick leave bills that Republican members argue are more pressing issues. Democrats currently have a trifecta in the state, controlling the state House, Senate, and governor&#8217;s mansion.
The Michigan Republicans did not return for sessions on Wednesday and do not plan to return on Thursday, which is listed as the final day on the voting calendar until the state House flips back to Republican control in 2025. Whitsett also did not attend Wednesday&#8217;s session, meaning Democrats lacked the votes to pass any bills.
&#8220;I’m staying home for my constituents,&#8221; Whitsett said, according to <a href="https://www.detroitnews.com/story/news/politics/2024/12/17/whitsett-karen-house-majority-dems-quorum/77060859007/" target="_blank" rel="noopener">The Detroit News</a>. &#8220;We’re not going to be voting on garbage bills that do nothing for our community and have a negative impact.”
Restaurant workers and bartenders have voiced <a href="https://www.wxyz.com/news/servers-bartenders-pack-michigan-capitol-to-save-the-tipping-system" target="_blank" rel="noopener">concerns</a> about a minimum wage law that is set to take effect in February that they say will decrease the money they make from tips. Business owners, meanwhile, are concerned about a new law on required sick leave for nearly all employees. Some business owners <a href="https://www.bridgemi.com/business-watch/businesses-fear-worst-michigans-new-sick-time-law-will-lawmakers-act" target="_blank" rel="noopener">say</a> it will hurt their efforts to run a punctual and effective operation while also hurting employees who already have sick leave benefits. Unless the state legislature acts, the new minimum wage and paid sick time laws will take effect in two months. Michigan House Speaker-elect Matt Hall told The Daily Wire that Republicans also want to vote on a plan to fix the roads that won&#8217;t raise any taxes.
&#8220;The things these Democrats are working on are radical and out of touch with the people of Michigan or unimportant in most cases,&#8221; Hall told The Daily Wire in a phone interview. &#8220;We want to spend our time here focusing on the issues that matter most to the working people of Michigan.&#8221;
Hall added that if Democrats refuse to vote on the roads bill, or minimum wage or sick leave laws, then the House should adjourn. He said that Republicans will pick these issues up when they take over the Michigan House next month.

&#8220;Article IV of the Michigan Constitution defines the role of the Legislature and how it is to be constituted. The chief purposes of the Legislature are to enact new laws and amend or repeal existing laws,&#8221; Nessel wrote on Facebook. &#8220;MCL 750.478: When any duty is or shall be enjoined by law upon any public officer, or upon any person holding any public trust or employment, every willful neglect to perform such duty, where no special provision shall have been made for the punishment of such delinquency, constitutes a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $1,000.00.&#8221;
Michigan House rules allow for the Speaker to call on the sergeant-at-arms to bring absent lawmakers to the session, but Democratic Speaker Joe Tate has so far declined to use that authority. House Speaker Pro Tem Laurie Pohutsky said she is encouraging Tate to dispatch the sergeant-at-arms.
&#8220;And I am not the only one,&#8221; Pohutsky said. &#8220;He is the Speaker of the House. That is his decision to make.&#8221;
Later on Wednesday, Whitsett said that she plans to be in attendance on Thursday since some of her bills will be taken up for a vote, Gongwer News <a href="https://x.com/ElenaDurnbaugh/status/1869505856381026506" target="_blank" rel="noopener">reported</a>.

Lawmakers are scheduled to come back for a session at noon on Thursday with a House Democratic Caucus spokesman telling reporters, &#8220;The agenda for today is the agenda for tomorrow,&#8221; according to <a href="https://x.com/JordynHermani/status/1869470853475528956" target="_blank" rel="noopener">Bridge Michigan</a>. In the state Senate, Democrats need 20 votes to pass any legislation, but Santana&#8217;s absence puts their count at 19. Similarly, in the state House, Democrats need 56 votes, but they only have 55 with Whitsett skipping the session.
House Republicans gathered for a press conference at a Lansing-area restaurant on Wednesday morning, where Speaker-elect Hall continued his calls for Democrats to take action with Republicans to save restaurant workers&#8217; tipping system. He also slammed AG Nessel over her comments.
&#8220;We&#8217;re not going to be bullied and intimidated by this attorney general,&#8221; Hall said. &#8220;And she has no business as a member of the executive branch telling us in the legislative branch what to do. Look, I&#8217;m an attorney too, so I hope she knows about the separation of powers, but we&#8217;re not going to be bullied by her.&#8221;
&#8220;She knows that oversight is coming and accountability to her department and scrutiny of her budget,&#8221; he added. &#8220;And we&#8217;re going to get her office under control.&#8221;

Michigan Attorney General Dana Nessel (D) slammed Rep. Rashida Tlaib (D-MI) this week for attacking her faith by suggesting she could not be fair in prosecuting far-Left pro-Hamas activists who were criminally charged for their activities at the University of Michigan in Ann Arbor.
Nessel&#8217;s remarks during a Monday interview on CNN came after her office charged 11 individuals with a variety of crimes, including attempted ethnic intimidation, assaulting or obstructing a police officer, and more.
Tlaib responded by claiming that Nessel, who is Jewish, charged the students because she was biased in favor of Israel. “It seems that the attorney general decided, if the issue was Palestine, she was going to treat it differently, and that alone speaks volumes about possible biases within the agency she runs,” Tlaib claimed.
CNN&#8217;s Jake Tapper said that Tlaib did not accept an interview request on his show and refused to answer follow-up questions about her remarks.

And, you know, Rashida is a lawyer. She had every opportunity to call me to ask to see the evidence in this case, but she didn&#8217;t do that.&#8221;
Nessel said that Tlaib &#8220;is well known for making inflammatory and incendiary remarks that are anti-Semitic in nature. So this isn&#8217;t the first time that we would have heard these words out of her mouth.&#8221;

A Synagogue board president with deep connections to <a href="https://www.dailywire.com/topic/michigan" target="_blank" rel="noopener">Michigan</a> Democrats was found stabbed to death outside of her home in Detroit Saturday morning.
Samantha Woll, 40, who previously worked for Congresswoman Elissa Slotkin (D-MI) and Democrat Attorney General Dana Nessel, was the president of Isaac Agree Downtown Detroit Synagogue, a position she has held since last year, The Detroit Free Press <a href="https://www.freep.com/story/news/local/michigan/detroit/2023/10/21/samantha-woll-dead-isaac-agree-downtown-detroit-synagogue-president/71271616007/">reported</a>. She was found on the ground outside her home with multiple stab wounds at around 6:30 a.m. Saturday and pronounced dead at the scene.
“I am shocked, saddened and horrified to learn of Sam’s brutal murder,” Nessel said in a statement. “Sam was as kind a person as I’ve ever known. She was driven by her sincere love of her community, state and country. Sam truly used her faith and activism to create a better place for everyone.”

Woll was <a href="https://www.thejewishnews.com/archives/36-under-36-samantha-sam-woll/article_63566926-8412-5f09-8543-3be9ea314b7d.html">recognized</a> by the Detroit Jewish News in 2017 for being “instrumental in the founding of the Muslim-Jewish Forum of Detroit — a grassroots collective of young adults of both faiths who gather in partnership to learn, celebrate and build community together.”
Police are investigating and have yet to determine a motive and have not taken anyone into custody. Authorities said they found a trail of blood leading from Woll’s body back to her home where they believe the crime occurred, according to the Detroit Free Press. The synagogue president&#8217;s stabbing comes amid a rise in anti-Semitic threats and harassment across the U.S. in the days following Hamas&#8217; October 7 terrorist attack on Israel.
Detroit Mayor Mike Duggan said he had just spent time with Woll weeks ago at the “dedication of the newly renovated Downtown Synagogue” and called her one of the city’s “great young leaders.”

“Gretchen Whitmer implemented the most draconian and extreme lockdowns in the country throughout the pandemic,” Dixon told Bridge Michigan.
“She destroyed our small business community … and forced hard working Michiganders to follow her intrusive orders that picked winners and losers. That is her economic legacy,” the GOP candidate added.

The company was one of the only pollsters that <a href="https://www.influencewatch.org/organization/trafalgar-group/" target="_blank" rel="noopener">correctly predicted</a> former President Donald Trump’s victory in the state in 2016.
The latest poll of 1,075 Michiganders conducted between September 24 &#8211; 28 also showed Democrats leading in the two other statewide races. Democratic Secretary of State Jocelyn Benson leads GOP candidate Kristina Karamo 50% to 45%, while Democratic Attorney General <a href="https://www.dailywire.com/topic/dana-nessel" target="_blank" rel="noopener">Dana Nessel</a> is ahead of Republican attorney Matthew DePerno 48% to 45%.
Dixon is set to hold a rally with Trump in Warren, Michigan, Saturday night. <a href="https://www.dailywire.com/topic/michigan">Michigan</a>’s highest court ruled Thursday that the state’s civil rights protections preventing discrimination on the basis of sex also apply to sexual orientation and <a href="https://www.dailywire.com/topic/gender-identity">gender identity</a>.
In a 5-2 decision, Michigan’s Supreme Court ruled in favor of a same-sex couple and a transgender person, arguing that their civil rights were violated by businesses refusing them service, WOOD TV <a href="https://www.woodtv.com/news/michigan/michigan-supreme-court-says-anti-bias-law-protects-lgbtq/">reported</a>. The ruling is being heralded as a major victory for the LGBTQ community, but many are concerned about its implications for religious liberty.
“Discrimination on the basis of sexual orientation necessarily constitutes discrimination because of sex,” the majority opinion, written by Republican-nominated Justice Beth Clement, <a href="https://drive.google.com/file/d/1JbhtiOlZlS_ImF5k546gNLzE8O5KtuZk/view">stated</a>. “Accordingly, the denial of ‘the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of a place of public accommodation or public service’ on the basis of sexual orientation constitutes discrimination ‘because of . . . sex.’”
Four Democrat-nominated justices joined Clement in the opinion that targets small businesses in the state that are not already subject to federal workplace laws.
In a dissent, Justice David Viviano expressed concern for religious liberty protections, <a href="https://www.bridgemi.com/michigan-government/michigan-supreme-court-lgbt-discrimination-barred-under-existing-law">according</a> to Bridge Michigan. “This departs from the normal principle that courts will first consider whether an interpretation raises grave constitutional doubts before adopting that interpretation,” he wrote.
The case appeared before the Supreme Court after the Michigan Civil Rights Commission <a href="https://www.mlive.com/news/2018/07/commission_disregards_attorney.html">authorized</a> the Department of Civil Rights to investigate complaints of discrimination on the basis of sexual orientation and gender identity in 2018. Two businesses, Rouch World and UpRooted Electrolysis, sued in response to complaints filed against them, relying on their religious beliefs as the reason they do not serve gay and transgender people. The lawsuit also argued that the Civil Rights Commission did not have the authority to bypass the legislature and interpret Michigan civil rights law differently from how it was laid out in 1976, since the law does not mention sexual orientation or gender identity.
Rouch World refused to host a same-sex wedding, and laser removal company UpRooted Electrolysis did not give service to a transgender person identifying as a woman who wanted hair removed. The court ultimately ruled against the two companies&#8217; arguments in the landmark decision.
Michigan Democrat Governor <a href="https://www.dailywire.com/topic/gretchen-whitmer">Gretchen Whitmer</a> applauded the high court&#8217;s decision, saying it is a historical moment for her state. “For too long, LGBTQ+ Michiganders had been left out of our state’s civil rights protections,” Whitmer <a href="https://twitter.com/GovWhitmer/status/1552785248529915904">tweeted</a>. “For years, I have fought to bring our LGBTQ+ community under the protection of the Elliott-Larsen Civil Rights Act. Today, I am proud that history has been made.”
Michigan Attorney General Dana Nessel, also a Democrat, personally appeared before the court during arguments in March and urged the justices to rule in favor of the LGTBQ community.
&#8220;Michiganders deserve to live in a state that recognizes the value of diversity &amp; rejects the notion that our own civil rights law could be used as a tool of discrimination,&#8221; Nessel, who is Michigan&#8217;s first openly gay politician elected to statewide office, <a href="https://twitter.com/dananessel/status/1552762342361948161">wrote</a> following the court&#8217;s decision Thursday. &#8220;This ruling is a victory for the LGBTQ+ community, for all MI residents, &amp; one that’s long overdue.&#8221;

Michigan Attorney General Dana Nessel said she will refuse to enforce a Michigan law banning abortions. She then attacked Republicans, claiming the pro-life position would put women&#8217;s lives at risk.
In an interview with Chuck Todd on &#8220;<a href="https://www.nbc.com/meet-the-press/video/full-michigan-ag-women-are-going-to-die-if-roe-is-overturned/551301983">Meet the Press</a>&#8221; Sunday, Nessel said she would not enforce a 1931 Michigan law outlawing abortions in almost all cases, claiming that reinstating the law would lead to doctors not giving women medical care after a miscarriage for fear of being prosecuted, and would put women&#8217;s lives in danger.
&#8220;As attorney general, I have statewide jurisdiction,&#8221; Nessel began. &#8220;And I ran on a platform of understanding that likely during the course of my term, Roe v. Wade would be overturned. And this incredibly draconian and strict 1931 law would criminalize abortion in this state with virtually no exceptions – no exception for rape, for incest, no exception for medical emergencies. And understanding that the lives of our 2.2 million women who are of childbearing age in this state, their lives would be at risk. I refuse to enforce this draconian law that will endanger their lives and put in jeopardy the health, safety and welfare of the lives of each and every woman in the state of Michigan.&#8221;
Nessel told Todd that the law does not make exceptions for medical emergencies, but <a href="https://www.politico.com/news/2022/04/07/whitmer-sues-abortion-law-governors-00023649">Politico</a> reported in April: &#8220;The Michigan law bans abortion at any stage of pregnancy, with an exception for the health of a woman but not for cases of rape or incest.&#8221; [emphasis added]
Todd then asked about a particular provision in the law banning the sale of abortifacient drugs. Nessel claimed that the law would not only punish abortion and abortion medication providers, but also the women who get them: &#8220;we&#8217;re talking about not just throwing providers and anybody who works with a provider, under aiding and abetting theories, in prison, but also women themselves, who procured abortion through abortion medication,&#8221; she said.
Todd continued by asking whether the law would ban medical care for women who miscarry. &#8220;Does this [law] mean a doctor cannot perform the procedure that&#8217;s necessary, essentially, when you&#8217;ve identified a miscarriage? It seems to me that some OBGYNs are going to think they are committing a crime if they essentially just do what most doctors would do right there, which is [Dilation and Curettage].&#8221; 
Nessel responded, claiming that because the Dilation and Curettage procedure is the same process for both miscarried and aborted fetuses, doctors will &#8220;be so afraid&#8221; of being investigated and prosecuted that the law will have a chilling effect on medical care. &#8220;[It] will have a chilling effect, and you won&#8217;t have basic medical health care that is required for women not to have extreme health problems or even die,&#8221; Nessel claimed. &#8220;Doctors simply are not going to perform those procedures anymore because they don&#8217;t want to go to prison for it.&#8221;
Todd concluded the interview by pointing out that Governor Gretchen Whitmer filed a <a href="https://www.dailywire.com/news/whitmer-files-lawsuit-challenging-1931-pro-life-law">lawsuit</a> in April challenging the law in the state Supreme Court, as did Planned Parenthood, and abortion activists in the state have organized a <a href="https://abcnews.go.com/Health/wireStory/ballot-drive-protect-abortion-rights-launched-michigan-82135201">petition</a> to put an amendment to the state constitution codifying abortion rights on the ballot in 2022. &#8220;What is the, what is the safest way to protect abortion rights in Michigan right now, of those three paths?&#8221; Todd asked.
&#8220;Well, firstly, I think each and every eligible voter in the state should be signing on to the you know, Reproductive Rights for All petition, and then coming to the polls and voting on it in November and voting for every pro-choice Democrat up and down the ticket, whether it&#8217;s for federal office or for state office,&#8221; Nessel replied. She also expressed her belief that the court would rule in favor of abortion. 
She then attacked Republicans, again claiming that the pro-life position would put women&#8217;s lives at risk: &#8220;the radical and extremist position of the Republicans in our state and all around the country completely contradicts what the public wants, and it really does place the lives of women in jeopardy,&#8221; Nessel said. &#8220;Let&#8217;s be clear: women in my state, and in states all over America are going to die because of this position.&#8221;

Michigan Attorney General Dana Nessel (D) said Tuesday that there is “absolutely” enough evidence to charge a group of Republicans with election fraud for falsely claiming to be the state’s electors during the last presidential election.
Nessel has yet to pursue charges against the 16 Republicans, instead referring the investigation to federal prosecutors for jurisdictional reasons, she said according to <a href="https://www.detroitnews.com/story/news/politics/2022/01/18/dana-nessel-evidence-gop-electors-attorney-general-charges-prosecutors/6564921001/">The Detroit News</a>. Nessel did not rule out pursuing charges against the Republicans in the future.
“Seemingly there’s a conspiracy that occurred between multiple states. So if what your ultimate goal is, is not just to prosecute these 16 individuals, but to find out who put them up to this, is this part of a bigger conspiracy at play in order to undermine the legitimate results of the 2020 presidential election, not just in Michigan but nationally? &#8230; It creates jurisdictional issues,” Nessel said during a press conference, according to the <a href="https://www.freep.com/story/news/politics/2022/01/18/nessel-gop-electors-crimes-lansing-michigan/6563387001/">Detroit Free Press</a>.
“I feel confident we have enough evidence to charge if we decide to pursue that. Again, I want to make it clear, I haven&#8217;t ruled it out. But for all the reasons I stated, I think that it’s a better idea for the feds to pursue this,” she said.
The Michigan Republican Party slammed Nessel after the press briefing, accusing the Democrat of “playing political games.”
“Dana Nessel is playing political games with people’s lives and livelihoods for the sake of scoring political points ahead of an election,” GOP spokesman Gustavo Portela said in a statement.
On December 14, 2020, a group of 16 Democratic presidential electors met in the state Capitol to certify themselves as Michigan’s electors to cast votes in the 2020 presidential election. At the same time, a group of Republicans, including Michigan Republican Party Co-Chairwoman Meshawn Maddock and Republican National Committeewoman for Michigan Kathy Berden, met at the Michigan GOP’s headquarters to sign a certificate declaring themselves to be Michigan’s electors.
President Joe Biden beat former President Donald Trump in Michigan to win the state’s 16 electoral votes. Biden won the state with roughly 150,000 votes more than Trump.
The group of Republicans sent their certificate claiming to be “duly elected and qualified electors” to the National Archives. Republicans in several other states, such as Arizona and Pennsylvania, also signed up alternate groups up electors as Republicans voiced concerns over election security and a number of election law changes adopted across some states because of the COVID-19 pandemic.
Republicans in Washington pushed for an emergency audit of the elections in states with competing slates of electors. As <a href="https://www.dailywire.com/news/ted-cruz-other-gop-senators-sign-letter-announcing-intent-to-vote-against-electors-from-disputed-states-until-election-audit-is-conducted">The Daily Wire</a> reported at the time:

Ted Cruz (R-TX) and 10 other GOP senators have <a href="https://www.cruz.senate.gov/?p=press_release&amp;id=5541">signed a letter</a> announcing they will vote “to reject the electors from disputed states as not ‘regularly given’ and ‘lawfully certified’” until a 10-day emergency audit can be conducted in those states.
“We do not take this action lightly. We are acting not to thwart the democratic process, but rather to protect it,” Cruz wrote in the letter, which was released Saturday.
The letter states that the 2020 election “featured unprecedented allegations of voter fraud, violations and lax enforcement of election law, and other voting irregularities,” which exceed previous elections and must be investigated fully.</blockquote>
The Senate certified the election for President Joe Biden early in the morning on January 7 after a riot in the Capitol building by pro-Trump protesters.

President Donald Trump called for Michigan Attorney General Dana Nessel to be sanctioned after she announced that Michigan would be pursuing sanctions against attorneys that intentionally misrepresented claims of voter fraud.
Trump posted a tweet on Saturday hitting back at Nessel after her announcement earlier last week. Trump has pushed dozens of unsuccessful legal challenges to the election results across a handful of battleground states, and he has not yet conceded the election to Democratic presidential candidate Joe Biden.
“These lawyers are true patriots who are fighting for the truth and, obviously, getting very close. AG should be sanctioned. Fight on!” Trump tweeted.

The president’s post prompted responses from Nessel.
“A patriot is a person who vigorously defends their country against its enemies and detractors. History will reveal which you were.  I wish you loved your country half as much as you love yourself. Also, time to stop obsessing about those women from Michigan. You’re not our type,” Nessel <a href="https://twitter.com/dananessel/status/1343200383624208385">tweeted</a> on Sunday morning.
“Can’t a random state AG from the Midwest sleep in on a Sunday morning without waking up to find that the President of the United States has mean-tweeted about you overnight (again)? The answer is ‘yes’ come January 20th,” she <a href="https://twitter.com/dananessel/status/1343206270963228672">added</a> later.
Nessel announced on Tuesday that she, along with Michigan Secretary of State Jocelyn Benson, would be pushing for sanctions against lawyers who made “intentional misrepresentations” of alleged instances of voter fraud in lawsuits over the election. One of the lawyers in Nessel’s crosshairs is Trump ally Sidney Powell.
“Some of these cases where we know for a fact there were intentional misrepresentations made — the kind of misrepresentation that there is no question of fact that these were inaccurate statements that were presented to the court — yes, myself and also Secretary Benson, will be filing complaints to the attorney grievance commission,” Nessel <a href="https://www.detroitnews.com/story/news/local/michigan/2020/12/22/nessel-seek-sanctions-against-lawyers-challenging-election-results/4009929001/">said</a>.
Nessel and Benson also intend to file complaints against lawyers who brought election lawsuits in other states, as well. Michigan has yet to file complaints against any attorneys, but Nessel says that she intends to begin filing complaints after all the legal challenges over the election are concluded.
“I think we need to go back to a time where you can trust an attorney is making an accurate and truthful representation to the court because if they don&#8217;t, then they won&#8217;t be able to practice law anymore,” Nessel said.
Nessel has sought to punish Republicans for questioning the result of the election in Michigan, or for even meeting with Trump to discuss Michigan’s election outcome. In November, <a href="https://www.dailywire.com/news/michigan-ag-considering-whether-gop-officials-discussing-vote-with-trump-could-be-criminally-charged">Nessel reportedly explored</a> whether she could bring criminal charges against GOP state lawmakers who met with the president and attempted to block the certification of electors for Biden.
George Washington University Law School professor Jonathan Turley said that Nessel’s push for retribution was an “abusive use” of the law.
“When <a href="http://www.cnn.com/2005/ALLPOLITICS/01/06/electoral.vote.1718/">Democrats like Sen. Barbara Boxer (D., Cal.) challenged the certification of Ohio’s electoral votes in 2004</a>, no one suggested criminal investigations. Nessel is threatening state legislators that, if they meet to discuss such objections, they might be targets of criminal investigations. That would seem an effort to use the criminal code for the purposes of intimidation or coercion,” Turley said.

Responding to President Trump wishing attendees at a Georgia rally a &#8220;Merry Christmas&#8221; and reminding them he had stated years ago that Americans would again use the phrase proudly despite those who would “try to take that word out of the vocabulary,” Michigan Democrat Attorney General Dana Nessel issued a tweet (later deleted) in which she claimed her son had been “devastated” when an employee at a store wished them a &#8220;Merry Christmas.&#8221;
Nessel tweeted that after her son asked her if they were the only Americans who didn’t celebrate Christmas, she told him, “No, and we are just as American as everyone else.” She then insinuated that President Trump was unaware of such diversity by adding, “Glad <a href="https://twitter.com/JoeBiden?ref_src=twsrc%5Etfw">@JoeBiden</a> knows that.”
Nessel wrote, &#8220;I remember the first time I was at a store with my son and an employee said &#8216;Merry Christmas&#8217; to us. My son looked devastated as asked &#8216;Are we the only people who don’t celebrate Christmas?&#8217; I answered &#8216;No, and we are just as American as everyone else.&#8217; Glad <a href="https://twitter.com/JoeBiden?ref_src=twsrc%5Etfw">@JoeBiden</a> knows that.&#8221;

In August, Nessel reportedly compared President Trump to Adolf Hitler, prompting the chairman of the Michigan Republican Party to denounce her, as <a href="https://www.dailywire.com/news/makes-me-sick-to-my-stomach-michigan-gop-blasts-attorney-general-nessels-comparison-of-trump-to-hitler">The Daily Wire</a> reported:

Michigan AG Slams People Wishing ‘Merry Christmas’ After Trump Warning

Michigan Attorney General Dana Nessel, a Democrat, is reportedly exploring whether Michigan legislators who oppose certification of the Michigan election results or speak with President Donald Trump regarding the issue could be criminally charged.
“Michigan’s attorney general is exploring whether officials there risk committing crimes if they bend to President Trump’s wishes in seeking to block the certification of Joe Biden’s victory in their state, according to two people familiar with the review,” <a href="https://www.washingtonpost.com/politics/michigan-attorney-general-canvassing-board-lawmakers/2020/11/20/87d19ce6-2b65-11eb-8fa2-06e7cbb145c0_story.html">The Washington Post</a> reported, adding, “The attorney general is conferring with election law experts on whether officials may have violated any state laws prohibiting them from engaging in bribery, perjury and conspiracy, according to people familiar with the deliberations who spoke on the condition of anonymity to discuss a sensitive matter.”
George Washington University Law School professor Jonathan Turley <a href="https://jonathanturley.org/2020/11/21/michigan-legislators-face-calls-for-possible-criminal-charges-after-meeting-with-president-trump-on-certification/">noted</a>, “When <a href="http://www.cnn.com/2005/ALLPOLITICS/01/06/electoral.vote.1718/">Democrats like Sen. Barbara Boxer (D., Cal.) challenged the certification of Ohio’s electoral votes in 2004</a>, no one suggested criminal investigations. Nessel is threatening state legislators that, if they meet to discuss such objections, they might be targets of criminal investigations. That would seem an effort to use the criminal code for the purposes of intimidation or coercion.”

“This is the kind of idiocy percolating on the left even as they accuse Republicans of destroying democracy by allowing legal challenges to pay out. In reality, nothing is going to happen here, but suggesting this is bad enough,” <a href="https://redstate.com/bonchie/2020/11/21/michigan-ag-suggests-charging-n283267">RedState</a> wrote. “Trump has no bribed anyone from Michigan, nor are any state officials who met with Trump guilty of engaged in such activity. That the chief ‘law enforcement’ official in the state would explore such nonsense shows how politically compromised she is.”
“Imagine if this was U.S. Attorney General Bill Barr threatening Democratic legislators with possible criminal investigation for challenging Trump votes,” Turley conjectured. “The media would be apoplectic. Yet, when used against Republicans, major publications and politicians are celebrated for the use of the criminal code for such politically motivated threats.”
On November 11, Nessel claimed that the Trump campaign’s multiple lawsuits in the state of Michigan vis-à-vis purported election fraud were based on racist assumptions about black people.
Nessel said, &#8220;Really the themes that we see, that persist, are this: Black people are corrupt, Black people are incompetent and Black people can’t be trusted. That’s the narrative that is continually espoused by the Trump campaign and their allies in these lawsuits,” according to <a href="https://www.freep.com/story/news/politics/elections/2020/11/11/nessel-trump-lawsuits-black-people-corrupt/6251384002/">The Detroit Free Press</a>.
Nessel said that the lawsuits centered on Detroit, which has a majority black population, rather than Oakland and Kent counties, whose majorities are white. She claimed that Trump’s claims of election misconduct were &#8220;demonstrably false.&#8221;
Nessel accused the Trump campaign of &#8220;forum shopping,” i.e. looking for courts disposed toward their point of view. “The federal lawsuit, filed in the Western District of the state, focuses primarily on allegations involving Detroit. Lansing, the seat of government, is located in the Western District of the state,” The Detroit Free Press noted.
Nessel said, &#8220;In my view, this is really a brazen case of forum shopping,” adding, “I will add that forum shopping and judge shopping are my least two favorite shopping seasons.&#8221; She said that if she attempted a similar action &#8220;this baseless and this frivolous, I would be sanctioned and I would likely be looking at a loss of licensure.&#8221;
