On Wednesday, Rep. Jim Jordan (R-OH), the chairman of the House Committee on the Judiciary, fired off a letter to the Biden Department of Justice demanding the Office of Professional Responsibility provide critical information about the operations of Special Counsel Jack Smith and his team’s efforts to prosecute Donald Trump.
Smith had charged Trump with trying to subvert the 2020 presidential election in one case and mishandling classified documents in another.
“The information that you have provided only reinforces our concerns that OPR acts more to protect Department prosecutors than to root out prosecutorial misconduct,” Jordan wrote to Jeffrey Ragsdale, the counsel for OPR. “While we appreciate you confirming an open investigation into Jack Smith&#8217;s prosecutors, we are concerned that your refusal to take prompt investigative steps will allow these attorneys to evade internal accountability by leaving the Department.”

Jordan referred to a letter the Committee wrote in May in which they asked for “documents related to OPR&#8217;s investigations into allegations that Special Counsel Jack Smith and his team lied to a federal court, manipulated evidence seized by the Federal Bureau of Investigation (FBI) during its raid of Mar-a-Lago, and improperly pressured a lawyer representing a defendant indicted by Smith.”
The Committee followed up with another letter in August regarding professional misconduct regarding another member of Smith&#8217;s team, J.P. Cooney. After receiving no response, the Committee asked Ragsdale to make himself available to the Committee in September and followed up with another request in October regarding all their requests.
On November 19, Ragsdale told the Committee that OPR had opened an investigation into Smith&#8217;s office in June 2023, but OPR did not conduct an “inquiry” or “investigation” into the allegations because it could “interfer[e] with” and “jeopardize” the prosecution, Jordan wrote.
“As you explained it, the Department&#8217;s policy would keep bad-actor attorneys in place to continue prosecutorial misconduct because of the administrative difficulty and resource constraints involved in switching attorneys,” Jordan wrote. “This excuse not only defies common sense, but it seems to violate the Department&#8217;s mission to ensure that justice is done in every case.”
After Trump was elected, Smith revealed that his team was “making moves to wind down the two criminal cases.&#8221;
“Smith then gave your office permission to investigate the allegations of attorney misconduct by Smith&#8217;s office. You stated that Smith only allowed the investigation to begin because it would now no longer ‘interfere with the Special Counsel&#8217;s investigation and prosecution,’” Jordan noted.
“It is absurd that OPR &#8211; the Department entity charged with upholding ethical conduct &#8211; would only examine allegations of prosecutorial misconduct after the subject of the allegations has approved the inquiry,” he declared.
“Your continued failure to cooperate with our oversight and apparent intention to hide information from the Committee is more evidence that OPR operates to protect Department attorneys from independent accountability,” Jordan asserted. “This letter serves as a formal request to preserve all existing and future records and materials related to OPR&#8217;s investigation into Special Counsel Smith and members of his prosecution team. Your office should construe this preservation notice as an instruction to take all reasonable steps to prevent the destruction or alteration, whether intentionally or negligently, of all documents, communications, and other information, including electronic information and metadata, that are or may be responsive to this congressional inquiry.”

In late November, a judge rejected Texas Attorney General Ken Paxton’s request that Smith preserve his records. In his request, Paxton <a href="https://storage.courtlistener.com/recap/gov.uscourts.txnd.396773/gov.uscourts.txnd.396773.1.0.pdf" target="_blank" rel="noopener">wrote</a> that he “fears that many releasable records &#8230; will never see daylight. That is not because DOJ has any legal reason to withhold them. Rather, Attorney General Paxton has a well-founded belief as set forth herein that Defendants will simply destroy the records. That is how they and/or their predecessors have operated in the recent past. And Jack Smith’s team has conducted itself in multiple ways that suggest it cannot be blindly trusted to preserve, and eventually produce, all of its records.”

The GOP-led House Judiciary Committee sued Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> on Monday, requesting that a judge order the audio of President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>’s interview with Special Counsel Robert Hur be released. 
Earlier this year, the Biden administration asserted executive privilege to block release of the audio of the two-day interview in which Hur pressed the president over his handling of classified documents. The <a href="https://judiciary.house.gov/sites/evo-subsites/republicans-judiciary.house.gov/files/evo-media-document/Audio%20subpoena%20as-filed%20complaint.pdf?_gl=1*hemqeb*_ga*MTQ5OTU4ODcxNS4xNzE5NDk1MzEz*_ga_1818ZEQW81*MTcxOTg1OTIzMi4xLjEuMTcxOTg1OTIzNC4wLjAuMA.." target="_blank" rel="noopener">lawsuit</a> from the Judiciary Committee says Biden&#8217;s assertion of executive privilege is “frivolous” and the audio of the interviews is important for lawmaker’s inquiry into the Justice Department’s handling of the Biden documents investigation. 
“The Committee thus needs those recordings to assess the Special Counsel’s characterization of the President, which he and White House lawyers have forcefully disputed, and ultimate recommendation that President Biden should not be prosecuted,” the suit says.
Hur recommended no charges for Biden despite the fact he found Biden improperly retained classified documents while out of office, noting his team found that Biden struggled to remember the dates his son died or when he was vice president. 
A jury would view Biden, who is now 81, as “a sympathetic, well-meaning, elderly man with a poor memory,&#8221; Hur&#8217;s report <a href="https://www.dailywire.com/news/special-counsel-biden-has-significantly-limited-memory-didnt-remember-when-he-was-vp-or-when-son-died" target="_blank" rel="noopener">concluded</a>.
The House Judiciary Committee suit asks the U.S. District Court for the District of Columbia to overrule the assertion of executive privilege and make Garland produce the tapes. House lawmakers say the audio will provide important verbal and nonverbal context missing from the transcripts of the interview that have been made available.

&#8220;That verbal and nonverbal context is quite important here because the Special Counsel relied on the way that President Biden presented himself during their interview — ’as a sympathetic, well-meaning, elderly man with a poor memory’ — when ultimately recommending that President Biden should not be prosecuted for unlawfully retaining and disclosing classified information,&#8221; the suit says.
&#8220;The audio recordings, not the cold transcripts, are the best available evidence of how President Biden presented himself during the interview,” the suit adds.

The ghostwriter of President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden&#8217;s</a> memoir told federal investigators that he deleted audio recordings of his interview with Biden after learning that a special counsel was appointed by the U.S. Department of Justice to launch a criminal investigation into Biden&#8217;s handling of classified information.
Axios <a href="https://www.axios.com/2024/06/14/biden-ghostwriter-deleted-recordings-special-counsel-documents" target="_blank" rel="noopener">reported</a> that writer Mark Zwonitzer told federal authorities that he deleted the recordings after Special Counsel Robert Hur was appointed to investigate Biden because he feared the recordings getting out into the public domain.
&#8220;I was very concerned about the possibility of being hacked,&#8221; he claimed, according to a partial transcript of his interview with investigators. &#8220;I was very concerned about the possibility of this audio spread all over the place.&#8221;
He said that he saved the transcripts of what Biden allegedly said and that deleting audio recordings was &#8220;something &#8230; I do as a &#8230; rule anyway.&#8221;
The Wall Journal <a href="https://www.wsj.com/politics/policy/merrick-garland-special-counsel-justice-department-under-fire-4608467b" target="_blank" rel="noopener">reported</a> earlier this month that Attorney General Merrick Garland was stunned when he learned about Biden&#8217;s conduct during the interview, that the then-vice president admitted on a recording to having classified material in his house and was discussing that material with someone who was not authorized to receive it.
According to the transcript, investigators said to Zwonitzer that the average outside observer is going to look at what he did and conclude that his actions were spurred by wanting to protect Biden from investigators.
&#8220;And I assume — and it&#8217;s okay, I just need the truth on this one, but there&#8217;s some truth in that, that was what was going on,&#8221; investigators said. &#8220;That was part of your motivation, at least something you were aware of when you did this?&#8221;&#8221;
Zwonitzer responded: &#8220;I&#8217;m not going to say how much of the percentage it was of my motivation. I was aware that there was an investigation.&#8221;

He claimed that no one connected to the president reached out to him.
Hur decided not to prosecute Zwonitzer because they believed that he &#8220;offered plausible, innocent reasons for why he deleted the recordings.&#8221;
&#8220;Zwonitzer willingly provided significant cooperation to the investigation without seeking or receiving any protections or assurances,&#8221; Hur added. &#8220;He was forthright in describing his conduct and working with investigators to obtain all relevant evidence in his possession.&#8221;
One of the reasons Hur declined to prosecute Biden was the president&#8217;s mental fitness, or lack thereof.
“Mr. Biden’s memory was significantly limited, both during his recorded interviews with the ghostwriter in 2017 [with whom he shared classified materials], and in his interview with our office in 2023,” the report said in its executive summary. “We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.”
Prosecutors said that based on the way that Biden presents, jurors will “want to identify reasonable doubt” and that it would be “difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness.”

Steven Cheung, Trump&#8217;s re-election campaign spokesman, reacted to Smith&#8217;s request for a gag order in the classified documents case by claiming that prosecutors were trying to meddle in the 2024 election.
&#8220;Hacks and Thugs are obsessed with trying to deprive President Trump and all American voters of their First Amendment rights,&#8221; Cheung <a href="https://www.cnn.com/2024/05/24/politics/trump-gag-order-trump-classified-documents/index.html" target="_blank" rel="noopener">said</a>. &#8220;Repeated attempts to silence President Trump during the presidential campaign are blatant attempts to interfere in the election.&#8221;
Trump has maintained his innocence in all of the charges he faces, including in a separate 2020 election interference case in Georgia. Just one of the four cases — the criminal matter in Manhattan — has gone to trial so far.

Judges have implemented gag orders against Trump in a <a href="https://www.dailywire.com/news/appeals-court-denies-trumps-gag-order-challenge" target="_blank" rel="noopener">New York hush-money case</a> and Smith&#8217;s <a href="https://www.politico.com/news/2023/12/08/trump-gag-order-jan-6-case-00130874" target="_blank" rel="noopener">2020 election interference case</a> against the former president.
Trump has maintained his innocence in all of the charges he faces, including in a separate 2020 election interference case in Georgia.
Just one of the four cases — the criminal matter in Manhattan — has gone to trial so far.

Rep. Eric Swalwell (D-CA) used up his time during a Tuesday hearing on Capitol Hill to lay out a case against former President Donald Trump — and then appeared to get frustrated when the witness, Special Counsel <a href="https://www.dailywire.com/topic/robert-hur" target="_blank" rel="noopener">Robert Hur</a>, refused to help him do it.
Hur testified Tuesday on his investigation into President Joe Biden and his handling of the classified documents that were found in his possession — but instead of asking him about that, Swalwell behaved as though it was another Trump impeachment hearing and asked Hur to condemn the former president.

Swalwell began by addressing Hur&#8217;s personal history, saying that he had been &#8220;moved&#8221; by Hur&#8217;s parents&#8217; &#8220;immigrant story&#8221; — and within seconds, he had pivoted to attacking Trump, claiming that the former president would put an end to immigration if he had a second chance in the White House.
&#8220;It&#8217;s the story of America. It&#8217;s a story that the guy who appointed you would end if he was put in charge again,&#8221; Swalwell said, making no distinction between legal and illegal immigration, and adding that Republicans across the board were behind Trump on that issue.
Swalwell pivoted again, asking Hur whether he wanted his report on the Biden investigation &#8220;to be received with credibility&#8221; — and then immediately implied that in order for his report to be credible, Hur would have to disavow Trump.
&#8220;Since you were appointed, he was impeached for leveraging 350 U.S. — $350 million U.S. taxpayer dollars over Ukraine to get dirt on President Biden,&#8221; Swalwell said. &#8220;He was then impeached a second time for inciting an insurrection. He was charged for possessing classified documents and obstructing justice. He was charged for paying for the silence of a porn star. He was charged in Georgia for his role in January 6th. He was charged in the District of Columbia for his role in January 6th. He owes $400 million to the state of New York for defrauding the state through his taxes. And he has been judged a rapist.&#8221;

Swalwell then turned to Hur, saying, &#8220;You want to be perceived as credible, so I want to first see if you will pledge to not accept an appointment from Trump if he is elected again as president.&#8221;
&#8220;Congressman, I am not here to testify about what will happen —&#8221; Hur pushed back, but Swalwell did not allow him to finish.
&#8220;Seems like an easy answer,&#8221; he interrupted. &#8220;Considering I just laid out —&#8221;
&#8220;I&#8217;m here to talk about this report and the work that went into it,&#8221; Hur stated.
Swalwell tried one more time to get a condemnation from Hur: &#8220;You don&#8217;t want to be associated with that guy again, do you?&#8221;

During a Capitol Hill hearing on Tuesday, Robert Hur got into a contentious back-and-forth with Rep. <a href="https://www.dailywire.com/topic/adam-schiff" target="_blank" rel="noopener">Adam Schiff</a> (D-CA) over how his special counsel report on President Joe Biden&#8217;s handling of classified documents while out of office dealt with the thorny issue of the commander-in-chief&#8217;s<a href="https://www.dailywire.com/news/released-transcripts-show-biden-lied-about-key-detail-in-documents-probe" target="_blank" rel="noopener"> foggy memory</a>.
Schiff charged that Hur must have known he was injecting his &#8220;personal, prejudicial, subjective opinion&#8221; into the <a href="https://www.justice.gov/storage/report-from-special-counsel-robert-k-hur-february-2024.pdf" target="_blank" rel="noopener">report</a> — which described Biden as a &#8220;sympathetic, well-meaning, elderly man with a poor memory&#8221; whom a jury likely would not convict &#8220;of a serious felony that requires a mental state of willfulness&#8221; — that political rivals could seize upon in an election season.
When Schiff tried to pivot to the criminal documents case against former President Donald Trump, Hur brought the conversation back to what the California Democrat had just said about the investigation into Biden and lobbed his own accusation at the congressman.

&#8220;What you are suggesting is that I needed to provide a different version of my report that would be fit for public release. That is nowhere in the rules. I was to prepare a confidential report that was comprehensive and thorough,&#8221; Hur said.
Schiff said the rules demanded that Hur not &#8220;gratuitously do things to prejudice the subject of an investigation when you are declining to prosecute,&#8221; particularly with language &#8220;that you know will be useful in a political campaign.&#8221;
&#8220;You understood exactly what you were doing,&#8221; Schiff said, adding later, &#8220;That was a political choice. It was the wrong choice.&#8221;
In reply, Hur said, &#8220;What you are suggesting is that I shape, sanitize, omit portions of my reasoning and explanation to the attorney general for political reasons — &#8221;
Schiff interjected and declared, &#8220;No, I suggested that you not shape your political report for political reasons, which is what you did.&#8221;
With Schiff&#8217;s time expiring, Hur was allowed to get in one final response: &#8220;That did not happen.&#8221;

But it was ultimately Garland&#8217;s call on how much of the report to release to the public in accordance with legal requirements and Department of Justice policy, Hur added.

Schiff, who is running for Senate, served as the top Democrat on the House Intelligence Committee for several years, including as its chairman. But he was <a href="https://www.dailywire.com/news/mccarthy-formally-kicks-schiff-and-swalwell-from-house-intel-integrity-matters-more" target="_blank" rel="noopener">kicked off</a> the panel last year by then-Speaker Kevin McCarthy (R-CA), who had accused Schiff of being a repeat liar, particularly with investigations related to Trump.
The GOP-led House later voted to <a href="https://www.dailywire.com/news/house-votes-to-censure-adam-schiff" target="_blank" rel="noopener">censure</a> Schiff over allegations that he abused his access to sensitive information and misled the American people about Trump’s ties to Russia and more. The congressman rejected the censure resolution as a “sham” and said he would wear the rebuke as a “badge of honor.”
Over the weekend, Schiff said that he hopes the U.S. intelligence community will <a href="https://www.dailywire.com/news/schiff-hopes-intel-officials-dumb-down-trump-briefings" target="_blank" rel="noopener">&#8220;dumb down&#8221;</a> briefings for Trump if he secures the GOP nomination ahead of a possible 2020 rematch against Biden in November&#8217;s election.

President Joe Biden exhibited a series of memory lapses during his five-hour interview with Special Counsel Robert Hur, prompting White House lawyers to rescue him when he could not recall when he served as vice president, when his son Beau died of cancer, when former President Donald Trump was elected, or what a fax machine was.
A <a href="https://www.nbcnews.com/politics/joe-biden/full-text-robert-hur-biden-classified-documents-interview-pdf-rcna142956" target="_blank" rel="noopener">full transcript</a> of the interview—during which Hur pressed Biden about his handling of classified documents found in his possession—was released Tuesday ahead of Hur&#8217;s testimony on Capitol Hill. It appeared to support part of the reasoning behind Hur&#8217;s decision not to prosecute. Hur said when he first released his report that he believed a jury would find Biden to simply be too old and forgetful.
At one point during the interview, Biden struggled to recall the term &#8220;fax machine&#8221; as he described the layout of his library — and one of the White House lawyers bailed him out.
Later in the interview, he brought up the topic of his son Beau Biden, who died of cancer in 2015 — but he struggled to recall the date that it happened even though he appeared to be aware that it was the reason he had not run for president while he was the outgoing vice president.

Special counsel Robert Hur will tell lawmakers on Tuesday that his assessment of President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a>’s memory during his classified documents probe was “accurate and fair,” according to a copy of his prepared testimony for the House Judiciary Committee.
Hur’s testimony will come after transcripts of his interview with Biden were released showing that <a href="https://www.dailywire.com/news/released-transcripts-show-biden-lied-about-key-detail-in-documents-probe" target="_blank" rel="noopener">the president lied</a> about a key detail of the investigation into whether he mishandled classified documents. In February, Hur released a report saying that Biden willfully retained classified documents, but should not be charged because a jury would likely see him as an aging man with a poor memory. 
&#8220;My assessment in the report about the relevance of the President’s memory was necessary and accurate and fair,&#8221; Hur wrote in a copy of his testimony <a href="https://www.foxnews.com/live-news/special-counsel-robert-hur-testimony-joe-biden-classified-documents" target="_blank" rel="noopener">obtained</a> by Fox News. &#8220;Most importantly, what I wrote is what I believe the evidence shows, and what I expect jurors would perceive and believe. I did not sanitize my explanation. Nor did I disparage the President unfairly. I explained to the Attorney General my decision and the reasons for it. That’s what I was required to do.&#8221;
&#8220;I analyzed the evidence as prosecutors routinely do: by assessing its strengths and weaknesses, including by anticipating the ways in which the President’s defense lawyers might poke holes in the government’s case if there were a trial and seek to persuade jurors that the government could not prove his guilt beyond a reasonable doubt,&#8221; Hur wrote. 
Hur added that it was necessary to evaluate Biden’s memory to determine whether Biden had purposely kept classified documents in his possession after leaving the vice presidency. 
&#8220;There has been a lot of attention paid to language in the report about the President’s memory, so let me say a few words about that,” he is expected to say. “My task was to determine whether the President retained or disclosed national defense information &#8216;willfully&#8217;—meaning, knowingly and with the intent to do something the law forbids. I could not make that determination without assessing the President’s state of mind.&#8221;
One of the key details included in Hur’s report was that Biden did not remember the year his son Beau died. Biden said that he was taken aback by a question about his son, claiming that it was Hur who brought up the death. 
“There’s even a reference that I don’t remember when my son died,” Biden said in February. “How in the hell dare he raise that? Frankly, when I was asked the question, I thought to myself: It wasn’t any of their damn business.”

The release of the transcripts came just ahead of Hur’s testimony before the House, where he will be questioned by lawmakers about his investigation into Biden. 
Former President Donald Trump, who is facing charges over his handling of classified documents, <a href="https://truthsocial.com/@realDonaldTrump/posts/112082714657611985" target="_blank" rel="noopener">said</a> on Truth Social Tuesday morning that Biden had more documents in his possession than him and that Biden had no authority to keep the documents because he wasn’t president. 
“Big day in Congress for the Biden Documents Hoax. He had many times more documents, including classified documents, than I, or any other president, had. He had them all over the place, with ZERO supervision or security. He does NOT come under the Presidential Records Act, I DO,” Trump said. “He had many docs in CHINATOWN, and they were moved all over the place, and heavily used. My boxes were moved by GSA, were secure, most carried clothing, shoes, sporting equipment, kitchen “stuff,” newspapers, pictures, magazines, awards, etc. The DOJ gave Biden, and virtually every other person and President, a free pass. Me, I’m still fighting!!! MAGA”

Hur’s February report concluded that Biden willfully retained classified documents but recommended no criminal charges in part because it said that Biden had a faulty memory and would appear as a sympathetic old man to a jury. One of the key details included in the report was that Biden did not remember the year his son Beau died. Biden said that he was taken aback by a question about his son, claiming that it was Hur who brought up the death. 
&#8220;There&#8217;s even a reference that I don&#8217;t remember when my son died,&#8221; Biden said in February. &#8220;How in the hell dare he raise that? Frankly, when I was asked the question, I thought to myself: It wasn&#8217;t any of their damn business.&#8221;

Elsewhere in the transcripts, Biden said &#8220;I&#8217;m a young man, so it&#8217;s not a problem,” when asked by Hur to discuss previous events as accurately as possible.

Biden also made a comment about how he hoped investigators had not found “any risqué pictures of my wife in a bathing suit,” adding, &#8220;She&#8217;s beautiful.”
Biden also told interviewers that he did not mean to keep any classified documents. 
&#8220;I had no purpose for them, and I think it would be inappropriate for me to keep clearly classified documents,&#8221; he said, before saying that it was his staff who packed his belongings from the White House. &#8220;I don&#8217;t want to hold them responsible or get them in trouble, but I believe they were the ones who were packing up &#8230; and were deciding, you know, where, where things were going, to the best of my knowledge,&#8221; he said. 
Biden also discussed moving boxes, which were full of classified documents, out of the way in his garage to park his car. He said he did not know what was in the boxes. 
&#8220;I remember moving boxes, literally physically moving them, with help, one side to the other so I could get the Corvette in that garage on the left,&#8221; Biden said. Other portions of the transcript show Biden talking about his Corvette and &#8220;making car sounds.&#8221;

Hur concluded last week in his criminal investigation into Biden’s handling of classified material that Biden “willfully retained and disclosed classified materials,” but that no criminal charges were warranted because prosecutors believe they would not win a conviction against Biden since he will present himself to a jury as “a sympathetic, well-meaning, elderly man with a poor memory.”
Biden later decided to hold a press conference, and during the event, he ended up <a href="https://www.dailywire.com/news/biden-explodes-during-press-conference-on-his-mental-fitness-makes-several-mental-mistakes">exploding</a> at reporters who pointed out voters’ concerns about his age and declared that he was the most qualified person in America to be president. He also mixed up the presidents of Egypt and Mexico, forgot the name of the church where his deceased son got the rosary that he wears every day, and forgot key details from the special counsel’s report.
Cruz responded to the latest developments on Biden&#8217;s fitness for office during his &#8220;Verdict&#8221; podcast with co-host Ben Ferguson by saying that the Department of Justice &#8220;accidentally told the truth&#8221; about Biden&#8217;s mental fitness and now the Biden administration was being forced to deal with &#8220;a political emergency.&#8221;
&#8220;Biden responded by holding a press conference in which his meandering, rambling answers confirmed everything said in the Special Counsel report, including that one point of the elements of the report that demonstrated why his memory was so failing is it said he could not remember when his son had died,&#8221; Cruz said. &#8220;And when Biden is defending that, he points to some rosary beads that he wore, that were given to him and said &#8216;were given to me by, were given to me by&#8230;&#8217; and then he can&#8217;t remember, can&#8217;t remember what the details are about the rosary beads.
