Earlier this month, the U.S. Supreme Court <a href="https://www.supremecourt.gov/orders/courtorders/011325zor_5425.pdf">declined</a> to hear a challenge to New York’s “Taylor Law,” which gives unions monopoly bargaining privileges in the public sector. At best, the Court missed an opportunity to protect the First Amendment; at worst, the Court endorsed Marxism.
We are Jewish academics who have been forced to accept the “exclusive representation” of unions that we consider anti-Semitic. One of us, a professor at the City University of New York, <a href="https://www.nrtw.org/goldstein/">brought the eponymous challenge</a>, Goldstein v. Professional Staff Congress/CUNY. The other, a graduate of the Massachusetts Institute of Technology, similarly <a href="https://www.nrtw.org/news/jewish-mit-students-eeoc-03212024/">filed federal charges</a> against the MIT Graduate Student Union. Both unions engage in the anti-Israel “Boycott, Divestment and Sanctions” movement (BDS), which we vehemently oppose.
At CUNY, the faculty union in 2021 <a href="https://2022.psc-cuny.org/sites/default/files/Final_Resolution_in_Support_of_the_Palestinian_People.pdf">condemned Israel</a> “dating back to its establishment as a settler colonial state in 1948.” At MIT, the graduate student union in 2024 <a href="https://mitgsu.org/resolutions/ceasefire">called for</a> “an immediate and permanent ceasefire in Gaza,” without mentioning Hamas or the hostages they still hold. The resolutions compare Israel to apartheid South Africa — ironic, given that the unions treat objectors like us as second-class citizens without voting privileges.
One need not share our opposition to BDS to see that these unions cannot represent us at the bargaining table. Yet that is exactly what is happening. Had the Supreme Court taken up Goldstein, the Justices could have struck down the Taylor Law on the grounds that it violates employees’ freedom of speech and association. Instead, the Court let stand the Second Circuit&#8217;s <a href="https://www.fairnesscenter.org/wp-content/uploads/2024/03/Second-Circuit-Goldstein-v.-PSC-Decision.pdf">ruling</a> that “Designating PSC as Plaintiffs’ exclusive bargaining representative does not impermissibly burden Plaintiffs’ ability to speak with, associate with, or not associate with whom they please, including CUNY and PSC.” In other words, it is permissible to subordinate individual rights to collective interests — classic Marxism.
The Supreme Court knew this when it declined to take the case. An <a href="https://www.supremecourt.gov/DocketPDF/24/24-71/323009/20240821101037349_240806a%20AC%20Brief%20for%20efiling.pdf">amicus brief</a> supporting the petitioners, filed by the Upper Midwest Law Center and the Manhattan Institute, cites the MIT Graduate Student Union as an example of the problem: “Jewish students are being compelled to associate with and implicitly endorse these views despite their most sincere religious beliefs, so they filed discrimination charges with the EEOC.”
The outcome of those charges was that religious students at private universities could divert their union dues to charity, but they would still be subject to exclusive representation. Public employees, including CUNY professors, already have the right to opt out of union dues under Janus v. AFSCME, but they too remain subject to exclusive representation by a union they abhor. While the Supreme Court <a href="https://www.supremecourt.gov/opinions/17pdf/16-1466_2b3j.pdf" target="_blank" rel="noopener">recognized</a> in Janus that “Designating a union as the employees’ exclusive representative substantially restricts the rights of individual employees,” the validity of exclusive representation was not squarely before the Court — until Goldstein, which the Justices declined to hear.
The result has been predictable. Ten days after the Court denied the petition, the CUNY faculty union adopted a <a href="https://psc-cuny.org/wp-content/uploads/2025/01/PSC-and-NYCERS-Israeli-Investments-Divestment-Resolution-1-23-25.pdf">resolution</a> “expressing its support for complete disinvestment from Israel,” further resolving to “divest its own funds from any investment vehicle that includes in its portfolio stocks and bonds of Israeli companies and Israeli government bonds.” In response, a Jewish civil rights organization <a href="https://x.com/_SAFECAMPUS/status/1884323681675141318">filed a complaint</a> with the New York State Division of Human Rights, arguing that the union “has abandoned their sacrosanct Duty of Fair Representation.” Under Janus, “That duty is a necessary concomitant of the authority that a union seeks when it chooses to serve as the exclusive representative of all the employees in a unit.”
There is another way. New York and other states could amend their labor laws to give employees the right to opt out of union representation. Unions could thus continue to engage in BDS, but not on behalf of those who oppose it. Additionally, the states could adopt laws that give private employees the right to work without paying compulsory dues to unions that they oppose. Twenty-six states already have such a law, which Congress could extend to all fifty states by passing the National Right to Work Act.
The Soviet Union put up a physical wall to keep people in; New York’s labor law puts up a legal one. If unions are as good as they claim to be, they should not need to compel representation or financial support. To borrow a phrase: Governor Hochul, tear down this wall!

At the City University of New York (CUNY), where anti-Israel agitators <a href="https://nypost.com/2024/05/14/us-news/anti-israel-student-protesters-take-over-cuny-graduate-center/" target="_blank" rel="noopener">took over</a> the school’s Graduate Center Library in May, university police say they are too understaffed to protect Jewish students this fall.
“The university is going into this under fire – they have no idea what’s going to happen. There’s no preparation,” a CUNY officer <a href="https://nypost.com/2024/08/15/us-news/cuny-cops-fear-schools-unprepared-for-looming-onslaught-of-anti-israel-protests/" target="_blank" rel="noopener">told</a> the New York Post, adding, “There have been no meetings about any of this. Ever since the encampment ended, everyone went on vacation. There’s no ‘Let’s prepare for September.’”
“It’s going to be bad. Our numbers just aren’t there,” an officer acknowledged. “If there’s a spontaneous protest that we don’t have any knowledge of, we’re going to be outnumbered – just by the sheer number of students enrolled, we’re outnumbered. There’s no retention anymore with our police,” the officer <a href="https://nypost.com/2024/08/15/us-news/cuny-cops-fear-schools-unprepared-for-looming-onslaught-of-anti-israel-protests/">said</a>. “Our academy class used to be 100-to-150. We’ve got five now – five in the academy class. That’s how bad it got.”

“[The] pay is so low for these guys and they’re paying millions for contractors to be here with no training, no background,” he continued.  “They’re not concerned about the students and the staff. They’re worried about their image and making sure the students express their freedom of speech.”
As CUNY professor Jeffrey Lax noted in <a href="https://nypost.com/2023/04/06/how-cuny-became-americas-most-anti-semitic-university/" target="_blank" rel="noopener">the New York Post</a> in April 2023, six months before the Hamas massacre of more than 1200 people in Israel, CUNY has a recent history of anti-Semitism. In May, a branch of CUNY, Brooklyn’s Kingsborough Community College, <a href="https://www.jpost.com/diaspora/antisemitism/article-801361">canceled an event</a> marking Israel’s Memorial Day, citing security concerns.
“Sadly, we expect anti-Israel activity will re-emerge at some colleges and universities as the fall semester begins,” the American Jewish Committee told <a href="https://www.campusreform.org/article/jewish-leaders-anticipate-return-anti-semitic-anti-israel-college-protests/26104">Cam</a><a href="https://www.campusreform.org/article/jewish-leaders-anticipate-return-anti-semitic-anti-israel-college-protests/26104" target="_blank" rel="noopener">pus Reform</a>. “This semester, the response needs to be different.”
Julia Jassey, CEO of Jewish on Campus, added, “We haven’t seen much from universities yet. We haven’t seen many that are proactive. We had hoped that heading into the school year that universities would be better prepared than last year.”

It would be easier for everyone involved if progressive social activists in higher education would just come out and be honest that they hate Jews and would rather see us killed off once and for all.
News broke the night of February 4 that the public City University of New York (CUNY) planned to host a <a href="https://twitter.com/JonathanHaroun1/status/1754300986045124959/photo/1" target="_blank" rel="noopener">seminar</a> later this month that was originally titled “Globalize the Intifada: Mapping Struggles for Palestine between the Streets and our Classrooms.” For the sake of optics, the <a href="https://twitter.com/JonathanHaroun1/status/1754300986045124959" target="_blank" rel="noopener">incendiary prefix</a> appeared to have been dropped before CUNY outright canceled the event.

CUNY was right to <a href="https://www.campusreform.org/article/update-cuny-cancels-globalize-the-intifada-panel-at-anti-racism-conference-not-a-podium-for-protest/24795">cancel</a> the event because no matter the language used, the seminar’s original “Global Intifada” title betrays the murderous spirit lurking beneath the event’s surface.
Intifada refers to the organized and indiscriminate killing of Jewish civilians through terrorism. Palestinian terrorists launched the <a href="https://www.history.com/this-day-in-history/intifada-begins-on-gaza-strip" target="_blank" rel="noopener">First Intifada</a> in 1987 and the <a href="http://news.bbc.co.uk/2/hi/middle_east/7381378.stm" target="_blank" rel="noopener">Second Intifada</a> in 2000. Both used bombings to kill innocent Jewish civilians.
Murder has no place in higher education. Like Mike Myers’ “Coffee Talk” bit on <a href="https://www.youtube.com/watch?v=58grYzCcfHI" target="_blank" rel="noopener">SNL</a>, I can only say that Intifada is neither educational nor a higher ideal. The would-be panelists and attendees do not express sophistication, intellectualism, or empathy when they invoke murder. Instead, they only appeal to the worst elements of human emotions and hatred.
The CUNY seminar operates in an axis of Jew-hatred holding together anti-Semitic social justice crusades both on and off college campuses. The event description accordingly states that it will “bring together organizers at Lehman College and the Bronx, and across CUNY and New York City, to highlight how students, workers, and our communities can act in solidarity to achieve justice in Palestine.” For social justice progressives, killing isn’t murder when it’s solidarity. 
Make no mistake. These people want Intifada everywhere. But they refuse to sacrifice their respectability and thus cloak their complicity with murder in the deceptively polite aura of scholarly discussions.
As a country, we cannot expect to defeat Jew-hatred as long as a critical mass of the public and academia buys into this deception and duplicity. Last fall, America got a glimpse into the true nature of the far-Left’s anti-Semitism from the other side of the country. 
On Oct. 10, University of California, Davis, Professor <a href="https://www.campusreform.org/article/update-uc-davis-prof-still-employed-after-threatening-jewish-journalists-with-death-home-invasion-kidnapping/24222" target="_blank" rel="noopener">Jemma Decristo</a> appeared to tweet murder and kidnapping threats against Jewish journalists, implying like-minded progressive academics and activists would carry out the acts: “one group of ppl we have easy access to in the US is all these zionist journalists who spread propaganda &amp; misinformation &#8230; they have houses w addresses, kids in school &#8230; they can fear their bosses, but they should fear us more”

If you want to know what political desires motivate the CUNY seminar, imagine if Decristo’s threats actually happened. Mob massacres that eliminate Jews are the end-point of Intifadas and Jewish students are already the target of physical attacks on campus.
Last semester, university officials did not lift a finger to stop Jews from being <a href="https://www.campusreform.org/article/4-times-jewish-students-were-attacked-on-campuses-in-2023/24482" target="_blank" rel="noopener">attacked</a> at Harvard University, Cooper Union, Tulane University, and Columbia University.
That’s why I filed 21 Title VI complaints against American universities – these colleges have failed in their duty to respond to campus antisemitism and Jew hatred. These events and rhetoric are neither benign nor examples of political speech that deserve protection. They are calls for violence.
So far, these complaints have resulted in seven opened investigations: Brown University, Temple University, Arizona State University, Northwestern University, Binghamton University, University of Wisconsin, and Indiana University Bloomington.
I feel encouraged by these investigations, but they will not stop Jew-hatred in this country as long as the public remains gullible to higher education’s lies and distortions. It is possible to rail against Israeli foreign policy without invoking murder &#8211; secular liberals in Tel Aviv do it all the time &#8211; but progressive academics and activists hardly seem interested in doing so. They relish in genocidal designs. 
The pro-Hamas invocation <a href="https://www.campusreform.org/article/stanford-refuses-to-condemn-pro-hamas-banners-instead-vows-to-help-students-find-proper-place-to-hang-them/24123" target="_blank" rel="noopener">“by any means necessary”</a> that sprung up last fall from professors and students persists four months after October 7 as the slogan “<a href="https://twitter.com/HenMazzig/status/1753902546609938880" target="_blank" rel="noopener">You Don’t Get to Choose How We Resist</a>.” On campus and off, today and last fall, these chants endorse murder and rape against civilians. They envisage the genocidal promise of “From the River to the Sea.”

These are the same tactics that Russian tsars used in the 1800s to execute their pogroms that killed hundreds of thousands of Jews. In a 2023 graduation speech, <a href="https://www.campusreform.org/article/bill-proposes-funding-cuts-after-anti-semitic-cuny-law-graduation-speech/23387" target="_blank" rel="noopener">CUNY Law student Fatima Mohammed</a> indulged in anti-Semitic tropes that maliciously link Jews to murder and global finance. It was this combination of stereotypes that fueled the pogroms and Holocaust.
No wonder Jewish students feel unwelcome in higher education. Every time they step on campus, they teleport back to a time and place when it was permissible – and popular – to persecute and kill Jews.
Jews are not safe in higher education, but history shows us that we are safer when we fully understand the threats against us. The Holocaust <a href="https://www.adl.org/resources/backgrounder/nazi-germany-and-anti-jewish-policy" target="_blank" rel="noopener">developed</a> so gradually over the 1930s and early 1940s in Germany and Austria, that many Jewish contemporaries remained complacently in denial about the threat until it was too late.
That’s why we are better off if anti-Semites who indulge in murderous rhetoric and fantasies would just admit their deepest desires.

The City University of New York (<a href="https://www.dailywire.com/topic/city-university-of-new-york-cuny">CUNY</a>) removed an article on its website about a Hunter College graduate because she had worked on <a href="https://www.dailywire.com/topic/johnny-depp">Johnny Depp’s</a> legal team in his defamation lawsuit against his ex-wife Amber Heard.
Yarelyn Mena graduated from Hunter College, part of New York’s public college system, in 2015 and is an associate attorney at Brown Rudnick LLP. At 29, she was also the younger lawyer on Depp’s legal team.
“I worked with the team on the opening and the closing and was the master of the facts of all the evidence,” Mena said in the now-deleted article. “If someone needed pictures or text messages, I would look them up and assist everyone as we went along.”
But because she worked in defense of a man who had been accused of domestic violence, CUNY removed the article celebrating one of its graduates. A <a href="https://www1.cuny.edu/mu/cunyverse/2022/08/03/this-cuny-grad-was-the-youngest-lawyer-to-serve-on-johnny-depps-legal-team/">link</a> to the article now includes the following statement:
<blockquote>We appreciate everyone who shared their concerns about an article in our newsletter featuring a recent CUNY graduate who worked on Johnny Depp’s legal team. We understand the strong negative emotions this article elicited and apologize for publishing the item. We have removed it from our CUNYverse blog. The article was not meant to convey support for Mr. Depp, implicitly or otherwise, or to call into question any allegations that were made by Amber Heard. Domestic violence is a serious issue in our society and we regret any pain this article may have caused.</blockquote>
Brooklyn College professor K.C. Johnson noted the school’s removal on Twitter, explaining that Mena is the daughter of two immigrants from the Dominican Republic. Johnson also explained that the deleted article contained advice for students “who might want a future in law, but was removed, it seems, because of protests about the CUNY grad&#8217;s client.”

CUNY’s removal of the article and statement is all the more curious because Depp won his defamation case against Heard and showed evidence that he was the victim of domestic violence at the hands of his ex-wife. As The Daily Wire reported in June, Depp was awarded a total of $15 million in monetary damages, while Heard was awarded $2 million for her countersuit. The counterclaim that Heard won related to a statement from one of Depp’s attorneys, not Depp himself. Following the award, the judge noted that Virginia law caps punitive damages at $350,000, meaning Depp was awarded $10.35 million for a total of $8 million after removing Heard’s damages.

Corey Robin, an anti-conservative political science professor at Brooklyn College and the Graduate Center of the City University of New York (CUNY), released his most recent rant against all things American this week, emphasizing that he &#8220;hate[s] America.&#8221;
&#8220;This is the real problem with hoppy craft beer in America: like everything else in this country, it&#8217;s too much,&#8221; Robin wrote in an excerpt posted to Twitter. Robin, a professor known for his regular rants against the American &#8220;<a href="http://www.salon.com/2015/06/21/the_racist_disease_we_never_discuss_dylann_roof_over_policing_and_the_real_story_about_safety_in_america/">racist disease</a>&#8221;, complained that unlike countries such as Germany and Italy, the United States is too extravagant- presumably because of its &#8220;supremacist&#8221; mentality.

On other occasions, Robin demonstrated a strong distaste for Zionism, capitalism, and a slew of Republican public figures such as Sarah Palin and Glenn Beck.
In July 2014, Robin was <a href="http://www.tabletmag.com/scroll/180812/24-arrested-in-protest-against-israels-gaza-campaign">arrested</a> for clashing with police at an anti-Israel rally in Midtown, New York. When asked whether that was his first time in jail, Robin <a href="https://twitter.com/CoreyRobin/status/494326343627051008">responded</a> that he was arrested before but never &#8220;for Palestine.&#8221;
Just earlier this week, Robin contended Zionist &#8216;racism&#8217; was far worse than Jim Crow laws.
