A <a href="https://www.dailywire.com/topic/crime">criminal</a> case against actor <a href="https://www.dailywire.com/topic/alec-baldwin">Alec Baldwin</a> related to the fatal shooting on the set of his movie &#8220;Rust&#8221; ended Monday when a prosecutor dropped her appeal of the case&#8217;s dismissal.
Special Prosecutor Kari Morrissey withdrew the appeal, per <a href="https://www.reuters.com/legal/alec-baldwin-manslaughter-case-dropped-by-new-mexico-prosecutor-2024-12-24/">Reuters</a>, effectively ending the criminal proceedings that have been ongoing since the incident occurred in 2021 in <a href="https://www.dailywire.com/topic/new-mexico">New Mexico</a>.
The decision was made after the state attorney general’s office said that it “did not intend to exhaustively pursue the appeal on behalf of the prosecution,” Morrissey said.
Baldwin was accused of involuntary manslaughter in October 2021. Cinematographer Halyna Hutchins was killed when a gun Baldwin was holding discharged on set, but the actor has maintained all along that he never pulled the trigger. The prosecution argued last July that Baldwin was reckless and criminally negligent for firing the gun, while the defense maintained that as an actor, their client was not responsible for gun safety on set.
Judge Mary Marlowe Sommer dismissed the case on the third day of the trial after learning that the prosecution did not reveal a cache of bullets to the defense, per <a href="https://variety.com/2024/film/news/alec-baldwin-manslaughter-appeal-dropped-1236258765/">Variety</a>, and that this evidence was potentially crucial. But Morrissey later appealed that decision, saying the bullets were irrelevant to the case. 
Baldwin&#8217;s lawyers Luke Nikas and Alex Spiro made a statement on this most recent development, saying: “Today’s decision to dismiss the appeal is the final vindication of what Alec Baldwin and his attorneys have said from the beginning — this was an unspeakable tragedy but Alec Baldwin committed no crime. The rule of law remains intact in New Mexico.”
The film’s armorer Hannah Gutierrez-Reed, who was accused of loading the gun, was convicted of involuntary manslaughter in March. She appealed her conviction after the charges against Baldwin were dismissed, but her appeal was denied.
Rust’s safety coordinator David Halls pleaded no contest to negligent use of a firearm. He was sentenced to six months of unsupervised parole.
Baldwin previously settled a civil lawsuit filed by loved ones of Hutchins in 2022. &#8220;I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin),&#8221; the cinematographer&#8217;s husband Matthew said in a statement at the time.
&#8220;All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work,” the widower said.
Meanwhile, Hutchins’ mother Olga Solovey <a href="https://www.dailywire.com/news/mother-of-cinematographer-killed-on-set-boycotts-rust-premiere-says-alec-baldwin-will-profit">boycotted</a> the premiere of the movie in Poland last month, saying she sees the film’s release as an opportunity for Baldwin to “unjustly profit” from her daughter’s death.

“Rust” is premiering at the International Film Festival of the Art of Cinematography Camerimage in Torun, Poland, three years after Hutchins was shot and killed. Hutchins’ mother, Olga Solovey, released a statement saying she sees the film’s release as an opportunity for Baldwin to “unjustly profit” from her daughter’s death, the <a href="https://apnews.com/article/poland-film-premiere-rust-baldwin-7479e578096359df46251c262e4f9d3d">Associated Press reported</a>.
“It was always my hope to meet my daughter in Poland to watch her work come alive on screen,&#8221; Solovey began in the statement, referencing the fact that director Joel Souza, who was wounded when the revolver Baldwin held fired, was slated to introduce the film at the festival.
“Unfortunately, that was ripped away from me when Alec Baldwin discharged his gun and killed my daughter,&#8221; the statement continued. “Alec Baldwin continues to increase my pain with his refusal to apologize to me and his refusal to take responsibility for her death. Instead, he seeks to unjustly profit from his killing of my daughter.”
“That is the reason why I refuse to attend the festival for the promotion of Rust, especially now when there is still no justice for my daughter,&#8221; Solovey said.

In December 2021, Baldwin told George Stephanopoulos in an interview on ABC News that “I didn’t pull the trigger” of the prop gun that fired and killed Hutchins. Baldwin further denied responsibility for Hutchins&#8217; death.
“I feel that someone is responsible for what happened and I can’t say who that is, but I know it’s not me,” Baldwin told the host. “I might have killed myself if I thought I was responsible, and I don’t say that lightly.”

On Thursday, New Mexico Judge Mary Marlowe Sommer filed her judgment that the prosecutors&#8217; arguments have already been presented and said they provided nothing new that would warrant reconsidering her prior decision to dismiss the charges against Baldwin, the <a href="https://apnews.com/article/alec-baldwin-rust-shooting-halyna-hutchins-051dfa2cb09a3cbd355aee9ad6ed19c4">Associated Press</a> reported.
“Because the state’s amended motion raises arguments previously made, and arguments that the state elected not to raise earlier, the court does not find the amended motion well taken,” the judge wrote, adding that the request was also untimely (outside the time frame for appeal).
Earlier this year, Baldwin was charged with involuntary manslaughter. He faced up to 18 months in prison, as previously <a href="https://www.dailywire.com/news/alec-baldwin-indicted-on-charge-of-involuntary-manslaughter-in-rust-shooting">reported</a>. The charges stem from an incident on the New Mexico film set of Baldwin’s movie “Rust,” on October 21, 2021, when Baldwin began filming a scene and the gun he was holding fired a live round that killed cinematographer Halyna Hutchins and injured the film’s director, Joel Souza. Baldwin repeatedly maintained that there was “no trigger pull.”
Following the decision Thursday, the special prosecutor in the case, Kari Morrissey, told the AP she would be appealing the latest ruling, disagreeing with the judge.

Two special prosecutors, Morrissey and Jason Lewis, presented their case to the grand jury after receiving further analysis about the gun used, <a href="https://variety.com/2024/biz/news/alec-baldwin-manslaughter-rust-shooting-again-1235875855/">Variety</a> noted.
Baldwin’s attorneys, Luke Nikas and Alex Spiro, released a statement at the time that said, “We look forward to our day in court.”
In January 2023, the Santa Fe County District Attorney’s Office charged Baldwin with two counts of involuntary manslaughter following Hutchins&#8217; death. The charges were dismissed without prejudice in April after the actor’s legal team claimed the gun had been modified in some way which caused it to malfunction, the <a href="https://apnews.com/article/alec-baldwin-rust-set-shooting-charge-59e437602146168ced27fd8e03acb636?taid=65aacd8c30e2620001dd1747&amp;utm_campaign=TrueAnthem&amp;utm_medium=AP&amp;utm_source=Twitter">Associated Press</a> noted.
Prosecutors made clear at the time, “This decision does not absolve Mr. Baldwin of criminal culpability and charges may be refiled.”
In April, the film’s weapons supervisor, 26-year-old <a href="https://www.dailywire.com/news/woman-involved-in-alec-baldwin-rust-shooting-sentenced">Hannah Gutierrez-Reed</a>, was sentenced to 18 months in prison after she was found guilty of involuntary manslaughter in the fatal shooting of Hutchins. In September, Sommer rejected Gutierrez-Reed&#8217;s request to dismiss her conviction or have a new trial following the dismissal of charges against Baldwin, the AP noted.

Speaking recently to <a href="https://www.vanityfair.com/hollywood/story/rust-filmmaker-joel-souza-finally-speaks-about-the-fatal-shooting">Vanity Fair</a>, Souza talked about the fatal shooting, returning to the film set, and finishing the film Hutchins was shooting, making it clear the fatal scene she had shot has vanished “in its entirety.”
“Gone. Not just that, but also a few things leading up to it,” Souza said. “Everything needed to be entirely reconceived there. There were a few things that came before that now wouldn’t make story sense. So we just sort of eliminated it and came up with something entirely different.”
“I’m not going back to that,” he added. “I’m glad you asked. I don’t want anyone who ever does see this to be waiting for that. No one ever pushed to keep anything like that.”

“It&#8217;s bizarre to have been shot,&#8221; Souza continued. &#8220;And then, who was holding the gun? That&#8217;s bizarre. I had this weird thought, like, God, I remember watching &#8216;The Hunt for Red October&#8217; in the movie theater when I was a kid. It&#8217;s like your older self whispers to your younger self, &#8216;Hey, that guy…someday…&#8217; Life can take you down some very bizarre roads.”
But Souza said he was not grateful to have survived after Hutchins died.
&#8220;When I tell someone it ruined me, I don&#8217;t mean in the sense that people might generally think,” Souza said. “I don&#8217;t mean that it put my career in ruins. I mean, internally, the person I was just went away. That stopped.&#8221;
&#8220;I remember specifically going to sleep that night and hoping I didn&#8217;t wake up the next morning. I hoped I would just bleed out overnight because I didn&#8217;t want to be around anymore,” he added. &#8220;It was a very difficult moment. I remember just thinking, &#8216;Maybe I&#8217;ll just sort of bleed to death — that would suit me just fine.'&#8221;
He also talked about returning to the film set and finishing the film Hutchins was shooting, making it clear the fatal scene she had shot has vanished “in its entirety.&#8221;
“Gone. Not just that, but also a few things leading up to it,” Souza said. “Everything needed to be entirely reconceived there. There were a few things that came before that now wouldn’t make story sense. So we just sort of eliminated it and came up with something entirely different.&#8221;
“I’m not going back to that,” he added. “I’m glad you asked. I don’t want anyone who ever does see this to be waiting for that. No one ever pushed to keep anything like that.”

The special prosecutor who charged actor <a href="https://www.dailywire.com/topic/alec-baldwin" target="_blank" rel="noopener">Alec Baldwin</a> with involuntary manslaughter said the judge in the case “improperly” dismissed the charges.
Kari Morrissey argued in a July 31 filing made public on Monday that Judge Mary Marlowe Sommer used flawed reasoning in order to get the charges dismissed against Baldwin, Deadline <a href="https://deadline.com/2024/08/alec-baldwin-case-dismissed-improperly-prosecutor-claims-1236032139/">reported</a>.
The charges stem from an incident on the set of Baldwin’s film “Rust,” on October 21, 2021, when Baldwin began filming a scene and the gun he was holding fired a live round that killed cinematographer Halyna Hutchins and injured the film’s director, Joel Souza.
The armorer in charge of weapons on set, Hannah Gutierrez Reed, was previously sentenced to 18 months in prison for her role in Hutchins’ death.
Gutierrez Reed filed an expedited motion last month asking for a new trial after Baldwin’s case was dismissed due to prosecutors withholding evidence from the defense.
Special prosecutor Morrissey also argued in his filing that Guetierrez Reed should not get a new trial.
“Based on the Court’s off-record statement, it was apparent that the Court was intending to dismiss the case,” Morrissey wrote. “Although the Court’s final order has not yet been filed, undersigned counsel contends that the Court misunderstood the testimony on July 12, 2024, and improperly dismissed the case against Mr. Baldwin.”
“If the Court were to decide that the dismissal of the case against Mr. Baldwin was proper there is one HUGE difference – in the Gutierrez case the State was not in possession of the Teske ammunition prior to trial (although arguably Mr. Bowles was), in the Baldwin case the State was in possession of the Teske ammunition,” the prosecution filing stated, referring to the Colt .45 rounds that suddenly appeared thanks to ex-Arizona cop Troy Teske, who was a friend of Gutierrez Reed’s father, himself a Hollywood gun coach. “[Guttierez Reed’s attorney Jason] Bowles is comparing apples and oranges and trying to make a square peg fit in a round hole.”

“The late discovery of this evidence has impacted the fundamental fairness of the proceedings,” Sommer ruled. “There is no way for the court to right this wrong. The sanction of dismissal is the only warranted remedy.”

The woman convicted in the death of ‘Rust’ cinematographer Halyna Hutchins is asking for a new trial after actor Alec Baldwin’s involuntary manslaughter case was dismissed last week.
Hannah Gutierrez Reed, who was the armorer on the set responsible for the safety of firearms, filed an expedited motion on Tuesday with the request, Fox News <a href="https://www.foxnews.com/entertainment/convicted-rust-armorer-asks-new-trial-after-alec-baldwins-involuntary-manslaughter-case-dismissed" target="_blank" rel="noopener">reported</a>. She is currently serving an 18-month sentence for her role in Hutchins&#8217; death.
Gutierrez Reed’s attorneys noted that &#8220;Baldwin&#8217;s trial exposes extreme misconduct,&#8221; adding that &#8220;Special Prosecutor Kari Morrissey lies to this court under oath.&#8221;

Court documents showed that assistant director David Halls yelled “cold gun” to indicate that the prop weapon did not contain live rounds. Halls handed Baldwin one of three prop guns that had been set up by an armorer, unaware that the prop gun contained a live round, according to an affidavit for a search warrant, ABC News <a href="https://abcnews.go.com/Entertainment/search-warrant-details-source-live-bullet-fatal-rust/story?id=81478157">reported</a> in 2021.

Santa Fe Judge Mary Marlowe Sommer dismissed the involuntary manslaughter case against actor Alec Baldwin on Friday after ruling the prosecutors hid evidence from Baldwin&#8217;s defense team.
The ruling came on the third day of the trial in New Mexico&#8217;s First Judicial District Court after Baldwin attorney Luke Nikas accused prosecutors of deliberately withholding bullets that were turned over to investigators earlier this year.

The 66-year-old actor appeared in the New Mexico courtroom for the start of jury selection to find people who will determine the actor’s verdict after he pleaded not guilty to the charge, according <a href="https://pagesix.com/2024/07/09/entertainment/alec-baldwins-trial-begins-with-jury-selection/" target="_blank" rel="noopener">to the Associated Press</a> (AP).
As noted by the news outlet, the trial is being held roughly 18 miles from the set of the western film “Rust,” at Bonanza Creek Ranch, where a gun Baldwin was holding discharged a bullet and hit Hutchins during rehearsals.
Baldwin has <a href="https://www.dailywire.com/news/alec-baldwins-attorneys-try-getting-rust-involuntary-manslaughter-case-dismissed-due-to-gun-destruction-claim" target="_blank" rel="noopener">maintained</a> that there was “no trigger pull.”
The AP report said dozens of possible jurors will be brought into the courtroom to be questioned. However, cameras in court for the rest of the proceedings will be turned off to protect their privacy. The trial is expected to last nine days.

The defense can dismiss up to five jurors without a reason under state law while the prosecution gets three, the outlet noted.
Judge Marlowe Sommer said on Monday that she was not “worried about being able to pick a jury in one day” because of the Hollywood star, and that she thought they would be able to “pick a jury by the afternoon.”
However, special prosecutor Kari Morrissey suggested that with Baldwin’s “group of defense attorneys, that’s not gonna happen,” per AP.
Baldwin attorney Alex Spiro replied, “I’ve never not picked a jury in one day. I can’t imagine that this would be the first time.”
On Monday, Judge Sommer also gave the defense a win when she ruled in a pre-trial hearing that Baldwin’s <a href="https://pagesix.com/2022/10/05/alec-baldwin-settles-with-halyna-hutchins-family/">role as a co-producer on “Rust”</a> is not relevant to the trial, something prosecutors had hoped to use as proof of Baldwin’s “total disregard or indifference for the safety of others” under the involuntary manslaughter law, AP&#8217;s report said.
Prosecutors also scored a victory when Sommer decided to exclude a summary of findings from a state investigation that placed most of the blame on the “Rust” film’s assistant director, the outlet noted.
In April, the film’s weapons supervisor, 26-year-old <a href="https://www.dailywire.com/news/woman-involved-in-alec-baldwin-rust-shooting-sentenced">Hannah Gutierrez-Reed</a>, was sentenced to 18 months in prison after she was found guilty of involuntary manslaughter in the fatal shooting of Hutchins.

During a virtual court hearing on Monday, attorneys for the 66-year-old actor argued that when the FBI took a mallet to the revolver that Baldwin held when it discharged on the set of &#8220;Rust,&#8221; it destroyed the defense&#8217;s case that the gun could have fired due to mechanical issues, <a href="https://www.cbsnews.com/news/alec-baldwin-halyna-hutchins-rust-shooting-trial-fbi-damaged-gun-destroyed-evidence/">CBS News</a> reported.
Baldwin’s attorney John Bash said the government “understood that this was potentially exculpatory evidence and they destroyed it anyway. It&#8217;s outrageous and it requires dismissal.&#8221;

Prosecutors responded that the gun being damaged was “unfortunate” and argued that the defense can still make its case using other evidence that’s available, adding that the gun was not destroyed, just broken into three pieces.

“A review of the evidence in this case leads one to conclude that the exculpatory value of this firearm, in the condition it was in on Oct. 21, 2021, is extremely low,&#8221; she added, noting in an interview on that day with investigators from the Occupational Safety and Health Administration, &#8220;Baldwin himself told OSHA investigators that the gun had no mechanical defects&#8221; and said he had already been using it for some time.
“The only problem was that it was &#8230; there was a live bullet in the gun. Those were his words,&#8221; the prosecutor added. &#8220;That could not put law enforcement on notice that this gun had, if you believe their theory, some potential mechanical defects when he was interviewed by law enforcement on Oct. 21, 2021.&#8221;
New Mexico Judge Mary Marlowe Sommer said she would make a ruling on the motion to dismiss on Friday and said, &#8220;Do not think that that means stop working for trial.&#8221;
Baldwin currently awaits trial after being charged with involuntary manslaughter in Hutchins’ death and pleading <a href="https://www.dailywire.com/news/alec-baldwin-enters-plea-in-rust-shooting-case">not guilty</a> to the charge, as previously reported.
