Former Subway Spokesman Convicted On Child Porn Charges Says Judge Was Biased Because She Had Teenage Daughters

Former Subway spokesman Jared Fogle, who was sentenced in November 2015 to more than 15 years on child porn and sex charges, is now arguing that his sentence should be reduced because U.S. District Judge Tanya Walton Pratt, who presided over his case, had teenage daughters.

Fogle had pled guilty to one count each of traveling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography. The sentence that arose from the plea deal that was struck was longer than either the defense or the prosecution had suggested, according to the Indy Star, which also reported that Pratt has only one daughter, who was 19 in 2010.

Fogle claims Pratt having teenage daughters gave her “objective bias, and subjective bias,” according to a motion he filed Tuesday. The motion stated, “It is the opinion of a ‘reasonable party’ that Judge Tanya Walton Pratt has demonstrated she is prejudicially biased to the Defendant Jared S. Fogle, and should in facts and law, recuse herself from these proceedings.”

Fogle admitted he had paid for sex with girls as young as 16 and received child pornography produced by Russell Taylor, the former executive director of The Jared Foundation. Fogle created that foundation to raise awareness and money to fight childhood obesity.

Fox News reported in 2015:

Prosecutors said in a sentencing memorandum filed last week that Fogle received photos or videos from Taylor of eight of those 12 youths, and that some of those images were of girls as young as 12. Fogle could have stopped Taylor from victimizing some of minors, prosecutors have said, but he instead encouraged Taylor to produce additional child pornography. … Court documents detailing the charges against the 38-year-old father of two say that Fogle had sex at New York City hotels with two girls under age 18 -- one of whom was 16 at the time -- and paid them for that sex. Fogle agreed to pay a total of $1.4 million to his 14 victims, with each getting $100,000.

Fogle became a spokesman for Subway after reducing his weight over 200 pounds, partly by consuming Subway sandwiches.
