The Daily Wire Lifetime All Access Membership Terms and Conditions

What these terms cover

These are the terms and conditions (“Terms”) governing Member (as defined hereafter) access to The Daily Wire, LLC’s (“The Daily Wire” or “Daily Wire”) Lifetime All Access Membership Subscription (each a “Lifetime Membership Subscription”). These Terms are in addition to the standard website Terms of Use which can be viewed at https://www.dailywire.com/terms and https://www.bentkey.com/terms/ and the respective Privacy Policies incorporated therein (collectively the “Standard Terms of Use”) and which also govern a Member’s access to the Lifetime Membership Subscription.

If an individual purchases or otherwise is granted access to a Lifetime Membership Subscription, such individual affirms that they have read, agreed to, and shall comply with these Terms and Daily Wire’s Standard Terms of Use as applicable. For the purposes of these Terms a “Member” is the natural person for whom the access to the Lifetime Membership Subscription service has been purchased. For the avoidance of doubt, entities are not eligible to purchase Lifetime Membership Subscriptions, and such Lifetime Membership Subscriptions may only be purchased for the use of natural persons.

Scope of the Lifetime Membership Subscription

Once a purchase of the Lifetime Membership Subscription has been made, the Member’s Lifetime Membership Subscription will last until the earlier of:

1. the end of the natural lifetime of the Member who purchased the Lifetime Membership Subscription, or in the case of a gift purchase, the end of the natural lifetime of the Member identified in the subscription for whom the Lifetime Membership Subscription was purchased;
2. The Daily Wire or its successor ceases to commercially offer the Lifetime Membership Subscription;
3. The Daily Wire, or a portion of The Daily Wire’s offerings or affiliated businesses which is otherwise incorporated into the Lifetime Membership Subscription (including, without limitation, any services pertaining to Bentkey Adventures, LLC), is acquired or sold to another entity, or ceases to do business, either in whole or in part; or
4. a Member’s individual Lifetime Membership Subscription is terminated by The Daily Wire for violation of these Terms or the Standard Terms of Use.

The Daily Wire makes no representations or warranties as to the expected lifetime of the Lifetime Membership Subscription service and may cancel or discontinue the Lifetime Membership Subscription service at any time.

Included offerings

The Lifetime Membership Subscription includes The Daily Wire “All Access” membership plan as it is represented at https://www.dailywire.com/subscription-levels and such offerings as are represented in the Lifetime Membership Subscription welcome package and does not include any other services currently offered or which may be offered in the future.

The Daily Wire may introduce additional services or membership tiers from time to time, which may be excluded from an existing Lifetime Membership Subscription and only be accessible to the Member subject to an additional fee. For the avoidance of doubt, should a Member choose to upgrade an existing subscription plan (an “Existing Subscription”) to a Lifetime Membership Subscription Plan, no discount or credit pertaining to the Existing Subscription shall be offered, however any future recurring payments pertaining to the Existing Subscription shall be cancelled thereafter.

Refunds

The Lifetime Membership Subscription, once purchased, is nonrefundable, regardless of use or lack of use by Member and no credits or refunds will be issued, subject to applicable law.

Transferability and account sharing

With the exception of gift purchases made with the intent to assign to another as evidenced at the time of purchase, the Lifetime Membership Subscription may not be bequeathed, gifted, assigned, or otherwise transferred to any other person or entity after purchase nor may a Member provide any other person or entity access to a Member’s subscription, either directly or indirectly. Allowing others to gain unauthorized access to The Daily Wire subscription services is a breach of the Standard Terms of Use and may result in cancellation of the services.

Termination / Cancellation

The Daily Wire or its successor may terminate a Member’s Lifetime Membership Subscription, and any and all other subscriptions, at any time for violating the Standard Terms of Use or these Terms. Subject to applicable law, in the event The Daily Wire is acquired or sold to another entity, The Daily Wire or its successor has the right to terminate the Lifetime Membership Subscription access with a thirty (30)-day notice via email to the Members.

If The Daily Wire terminates a Member account because of a violation of the Standard Terms of Use or these Terms, The Daily Wire will not refund any portion of the membership fee, subject to applicable law. If a Member account shows no activity for a period of twelve (12) months, The Daily Wire may consider that account dormant and may remove online access to the account, subject to applicable law. Activity is defined as a login or other access to The Daily Wire site. A Member may cancel their Lifetime Membership Subscription by providing The Daily Wire with notice of their intent to do so; however, cancellation of a Lifetime Membership Subscription will not result in a credit or refund.

If a Member’s Lifetime Membership Subscription ends only because The Daily Wire or its successor are no longer providing the Lifetime Membership Subscription plan and The Daily Wire or its successor is still otherwise in business and is providing an alternative membership plan or service that The Daily Wire or its successor deems (in its sole discretion) to be a reasonable alternative to the Lifetime Membership Subscription, The Daily Wire or its successor may convert the Member’s Lifetime Membership Subscription to the alternative membership plan.
