WALSH: The Jussie Smollett Case Shows What Privilege In America Really Looks Like

I'm old enough to remember when the Left was afraid that a biased third party would intervene in an investigation and shut down the judicial process in spite of the existence of overwhelming evidence. That never happened in the Mueller probe, as liberals insisted it would. However it did just happen in the Jussie Smollett case.

 

All charges against the hate crime hoaxer have now been dropped, and his record is being expunged, even though prosecutors say it's "not an exoneration" and they "stand behind the charges." The mayor is furious and the police chief stridently maintains that the evidence is rock solid and there is no honest reason to let Smollett walk. Indeed, the state's attorney can't articulate a coherent reason for making the decision they made. This is the best they could offer:

“After reviewing all of the facts and circumstances of the case, including Mr. Smollett’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case.”

Notice what isn't said here. They aren't disputing the evidence. They aren't suggesting that Smollett might be innocent. Rather, they're maintaining that Smollett's prior community service, and the few thousand dollars he paid in bond, is enough to resolve the matter.

 

The real motivations behind this outrageous change of course are clear as day. Kim Foxx, the state's attorney who initially recused herself from the investigation due to her association with the family, seems to have ultimately decided to step in. Text messages between Foxx and Smollett's allies shed some light into how this particular sausage was made. Smollett and Foxx's ties to the Obamas obviously played a role as well. In a word, this is corruption. Barely making an effort to hide itself.

 

You'll see cowards in the media try and obscure the point by talking about how "confusing" this case is, and lamenting that "we'll never know what really happened." We do know what happened. Jussie Smollett staged a hate crime and exploited racial strife for his own gain. We know this for a fact because even his lawyers admit that the two Nigerian-born brothers are the ones who committed the attack. In order to entertain the idea that he is innocent, you must entertain the possibility that Smollett was randomly assaulted by his racist, Trump-loving Nigerian-born friends, who screamed "This is MAGA country" during the attack. You must also believe that Smollett didn't recognize his own friends as they were in the process of kicking his butt, and that he sincerely came to the conclusion that his friends were actually cornfed white boys. But nobody believes that because it is impossible to believe.

Nonetheless, liberals are celebrating this miscarriage of justice, which forever precludes them from pretending to be outraged about "wealth disparity" and "the rich." Smollett used both his wealth and stature to escape the rightful consequences of his actions. If that isn't privilege, then there is no such thing as privilege.

There are certain things that will confer privilege in America — real privilege, get-out-of-jail-free privilege. Money confers privilege, no matter your race. Fame confers privilege. Identity can certainly confer privilege, but you need to have a trendier one than straight, white, male. The correct political leanings will also translate to privilege. Smollett had every box checked. He obviously assumed that would get him off the hook. And he was right.
