A key witness for the Biden administration&#8217;s <a href="https://www.dailywire.com/news/pro-life-demonstrators-found-guilty-face-up-to-11-years-in-federal-prison" target="_blank" rel="noopener">successful prosecution</a> of 10 Christian pro-life activists who took part in a peaceful protest at a <a href="https://www.dailywire.com/topic/tennessee" target="_blank" rel="noopener">Tennessee</a> abortion facility is scheduled to be sentenced on Wednesday for her part in the protest.
Caroline Davis, who took a plea deal with the Justice Department in exchange for her testimony against her one time fellow activists, is <a href="https://dw-wp-production.imgix.net/2024/04/0512-Order.pdf" target="_blank" rel="noopener">expected</a> to be sentenced by Middle District of Tennessee Federal Judge Aleta Trauger at the Fred Thompson federal courthouse in Nashville on Wednesday. At one point, Davis <a href="https://www.justice.gov/usao-mdtn/pr/eleven-charged-face-act-violations-stemming-2021-blockade-mount-juliet-reproductive" target="_blank" rel="noopener">faced</a> felony charges and over 10 years in prison and hundreds of thousands in fines for her role in a peaceful pro-life protest at the Carafem abortion facility in Mt Juliet, Tennessee on March 5, 2021.
The March 2021 protest involved a group of demonstrators gathered on the second floor of an office building in the hallway outside Carafem in Mt. Juliet. The group, including Davis, prayed, sang hymns, and urged women showing up to the clinic to not get abortions. Several sat in front of doors to the facility and against the walls of the hallway.
In October, Davis <a href="https://storage.courtlistener.com/recap/gov.uscourts.tnmd.92089/gov.uscourts.tnmd.92089.326.0.pdf" target="_blank" rel="noopener">pled guilty</a> to misdemeanor charges related to the protest if she agreed to testify. She was a key witness in two federal trials in Nashville, <a href="https://www.dailywire.com/news/pro-life-demonstrators-found-guilty-face-up-to-11-years-in-federal-prison" target="_blank" rel="noopener">including one</a> where six defendants — including Chet Gallagher of Tennessee, Coleman Boyd of Mississippi, Heather Idoni of Michigan, Cal Zastrow of Michigan, Paul Vaughn of Tennessee, and Dennis Green of Virginia — were convicted of violating the FACE Act and civil rights conspiracy over the protest.
The FACE Act is a Clinton-era law that is frequently used against pro-lifers protesting outside of abortion facilities. The six convicted in February face up to 10.5 years in prison and fines of up to $260,000 when sentenced in July.
Davis also testified in a one day bench trial for four others involved in the demonstration earlier this month. Those four — Eva Edl, Eva Zastrow, James Zastrow, and Paul Place — <a href="https://www.dailywire.com/news/four-pro-lifers-face-prison-time-after-being-convicted-in-federal-court" target="_blank" rel="noopener">were convicted</a> of violating the FACE Act and face up to six months in prison and a $10,000 fine upon sentencing in July.
During her testimony in January, Davis <a href="https://www.dailywire.com/news/video-played-at-trial-shows-pro-lifers-targeted-by-doj-singing-hymns-urging-peace-during-protest" target="_blank" rel="noopener">claimed</a> that she had a change of heart about attending the Carafem demonstration. She said her “rational side” was “in the toilet” at the time of her participation. She also said that she changed her mind “over time” and that being indicted by the federal government “terrified” her.

In cross-examination, Davis became repeatedly exasperated with the questions from defense lawyers, especially when asked about how many times she met with the government before the trial. When asked about a previous meeting with the prosecution and about how long it was, she said, “I have a busy life,” and replied “Oh my God” when asked about another meeting with the government. At one point, Trauger told her to just answer the question and not add any commentary to her answers.
No one present at Carafem was arrested for assault or any assault-related charge. Davis said the most violence she saw was when a police officer moved two pro-lifers aside when taking a woman down the hallway to the abortion facility. Davis was also a key witness in a similar Washington, D.C., abortion facility FACE Act trial where she again pled guilty to a misdemeanor charge in exchange for her testimony.
The convictions have prompted calls from Republican lawmakers to repeal the FACE Act, saying that it has been weaponized to target pro-lifers.

President Joe Biden has largely given up on criminally prosecuting illegal immigrants for crossing the border, with the number of prosecutions of serious immigration offenses lower during every year of the Biden administration than any year of the Trump or Obama administrations, a Daily Wire analysis of newly-released data shows.
The prosecutions have screeched to a virtual halt under Biden. In 2018, the Department of Justice charged 84,000 people with illegal entry, a misdemeanor. The total number charged with this misdemeanor during the entire three-year period from 2021 to 2023 was 11,000, according to a Daily Wire analysis of <a href="https://www.justice.gov/usao/resources/PICReport">Department Of Justice data</a> — only 4% of the old rate.
Illegals who re-enter the country after they have already been deported once are committing a felony. In 2019, the DOJ charged 27,000 people with that crime. In 2023, the number was about half that, at 14,000. This comes as the number of illegal crossings has skyrocketed, making the decrease even more striking.
The apparent decision to rely on, at best, civil deportation proceedings instead of bringing criminal charges — particularly in more egregious cases such as those who re-enter the country after already having been deported — contradicts Biden’s claim that he needs new authorities from Congress in order to secure the border.
Criminal cases against illegal immigrants essentially ceased in April 2020 when courts closed due to the coronavirus pandemic. In March 2020, 4,000 illegals were charged with entry and 2,000 with felony reentry; by April those numbers were only 671 and 960. Criminal cases for illegal entry remained essentially nonexistent during the coronavirus-lockdown period of the rest of 2020, at 13 cases in December, while felony illegal reentry charges were at half their earlier levels.
Joe Biden took office in January 2021, and the coronavirus pandemic receded. Yet criminal enforcement of immigration laws never returned.
In December 2023, the most recent month with data, a mere 708 people were charged with illegal entry and 1,236 with felony reentry. Compare that to December 2018, when those numbers were nearly 7,000 and 2,000, respectively.
The peak of criminal enforcement during the Trump administration came in June 2018, when the numbers were 9,500 and 2,237. Border apprehensions <a href="https://www.nbcnews.com/news/us-news/number-migrants-trying-cross-border-down-18-june-n889176">decreased</a>, which the administration argued showed that its efforts were working as a deterrent. By comparison, the current record-low prosecution of illegal border crossing comes as crossings are at all-time highs.

The change is not simply an expected difference between Republican and Democrat administrations. Rather, Biden has taken a more lenient posture towards illegals than Barack Obama, the Democrat president for whom he served as vice president.
Though detailed data only goes back to 2019, the Executive Office of US Attorneys released <a href="https://www.justice.gov/usao/resources/annual-statistical-reports">annual statistics</a> last month that make it possible to track a longer period. That data shows cases prosecuted by the Department of Justice pursuant to a referral by the Department of Homeland Security, though it doesn’t include most misdemeanor illegal-entry charges. They show that the number of illegals charged with serious immigration crimes in each year of the Biden administration was lower than any year since at least 2009.
Neither the Department of Homeland Security nor the Department of Justice responded to requests for comment.
In 2011, the Obama administration brought 37,000 serious cases referred by DHS — almost twice as many as Biden did last year. But after he won re-election to a second term, he lowered that number every year, ending at 27,000 in 2016.
The Trump administration took a few years to get back to the levels of Obama’s first term, reaching 36,607 cases in 2019 but never actually surpassing Obama’s peak, according to the DOJ data covering serious immigration crimes.
But it “smashed records” when it came to misdemeanor charges for illegal first-time entry. Although the criminal charge is less serious, it captures a significantly larger number of people.
“In FY 2018, more than 68,400 defendants were charged with misdemeanor illegal entry. This is the highest number of such defendants charged since EOUSA started to track this category and an almost 86 percent increase from the previous year. This total is also more than 4 percent higher than the previous record of over 65,500 defendants set in FY 2013,” the Trump administration said in a <a href="https://www.justice.gov/opa/pr/justice-department-smashes-records-violent-crime-gun-crime-illegal-immigration-prosecutions">2018 press release</a>.
Gene Hamilton, who served in the DOJ during the Trump administration and now works as general counsel for America First Legal, which is helmed by Trump immigration czar Stephen Miller, told The Daily Wire that crossing the border illegally is a crime, prosecutable in criminal court, but the Biden administration has chosen to treat it like a “traffic ticket,” causing word to get out in Latin America that there is little reason not to try to come to the United States.
“Given the number of illegal aliens crossing the border, you should be seeing all-time records for prosecutions for crossing the border illegally, but you&#8217;re not,” Hamilton said. “They have removed a deterrent. The ultimate thing that matters to people is whether they make it into the country and are released and they call home and tell their family. If people know they could be criminally prosecuted, it acts as a deterrent and reduces the number of people who come in the first place.”
Debate about immigration has rarely discussed the criminal figures, instead focusing on the number of civil deportation proceedings, which in the Biden administration have stacked up into a record backlog. But criminal charges, with the prospect of punishment instead of merely turning them away, can be filed for illegal entry, illegal reentry, alien smuggling, and immigration fraud.
While the Trump administration sought to create a deterrent by emphasizing prosecutions of misdemeanor, first-time border crossings, Biden has departed from historical norms by rarely prosecuting even those who commit felony re-entry—recidivist criminals who have shown that a gentle approach did not work.
In a report on fiscal year 2022 data, the <a href="https://www.ussc.gov/sites/default/files/pdf/research-and-publications/quick-facts/Illegal_Reentry_FY22.pdf">United States Sentencing Commission</a> said that illegal reentry prosecutions had decreased by 34% since 2018. It said that 97.6% of illegal reentry offenders were men, their average age was 39, and many had extensive criminal histories. It said 99.3% of convicts are sentenced to prison, for an average of 13 months.

Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> agreed to “look into” questions from Republican lawmakers about the Biden administration’s application of the FACE Act during a congressional appropriations hearing on Tuesday. 
Garland told Rep. Andrew Clyde (R-GA) during a budget request hearing for the Justice Department that he would hand over data on the DOJ’s prosecution FACE Act charges if that information existed. Republican lawmakers have argued that the FACE Act, a Clinton-era law that criminalizes the use of force or threats of force that prevent someone from accessing an abortion facility, has been weaponized against pro-life activists. 
“My colleague, Congressman Chip Roy, has twice requested a copy of the Freedom of Access to Entrance of Clinics Act prosecution data,&#8221; Clyde said. &#8220;He first asked for it in October 2022 and then again two months ago on February 16. He has yet to receive this data. My question to you is when will this data be provided by the Department of Justice?”
Garland replied that he would be “very happy to look into this,” but added that he was unfamiliar with the specific request. He said the DOJ would provide the data if it “exists.”

Roy, alongside Sen. Mike Lee (R-UT), have repeatedly pushed for the FACE Act to be repealed. Lee has noted that the FACE Act, which supposed to be used to protect churches and pregnancy centers as well, appears to only be used to target pro-life activists and not pro-abortion activists. 
“Both AG Garland and Assistant AG Clarke have now agreed to release FACE Act data,” Roy’s press office said Tuesday. “Will the DOJ finally stop stonewalling this information? Or are they afraid it will expose just how much the FACE Act has been weaponized against Americans?”

House Oversight Chairman <a href="https://www.dailywire.com/topic/james-comer" target="_blank" rel="noopener">James Comer</a> (R-KY) and Judiciary Chairman <a href="https://www.dailywire.com/topic/jim-jordan" target="_blank" rel="noopener">Jim Jordan</a> (R-OH) sent a letter to Garland on Monday saying he had 10 more days to fully comply with their February subpoenas or face contempt of Congress proceedings.
&#8220;Your response to the subpoenas remains inadequate, suggesting that you are withholding records for partisan purposes and to avoid political embarrassment for President Biden,&#8221; the pair wrote, according to a <a href="https://dailycaller.com/2024/04/16/jim-jordan-james-comer-robert-hur-transcript-joe-biden/" target="_blank" rel="noopener">copy of the letter obtained</a> by The Daily Caller.
The lawmakers said they will have &#8220;no choice but to invoke contempt of Congress proceedings&#8221; unless they are given the audio recordings of Hur&#8217;s interview with Biden and of the special counsel&#8217;s interview with Biden&#8217;s ghostwriter, Mark Zwonitzer.
&#8220;To avoid this, the Committees expect you to produce all responsive materials no later than 12:00 p.m. on April 25, 2024,&#8221; Comer and Jordan added.
The two chairmen had previously set an April 8 deadline, warning their committees would &#8220;consider taking further action, such as the invocation of contempt of Congress proceedings&#8221; without full compliance.
Assistant Attorney General Carlos Uriarte <a href="https://www.dailywire.com/news/garland-risks-contempt-of-congress-as-doj-spurns-house-gop-demand-for-biden-audio" target="_blank" rel="noopener">sent</a> a letter to the lawmakers on April 8, saying a transcript for the two-day interview with Biden already provided to them should be sufficient. A transcript of Hur&#8217;s interview with Zwonitzer was also given.
The Department of Justice is &#8220;concerned&#8221; about the demands &#8220;that is cumulative of information we already gave you&#8221; and they indicate lawmakers want it for &#8220;political purposes&#8221; rather than &#8220;legitimate oversight or investigatory functions,&#8221; Uriarte said.

Hur&#8217;s report, which was released in February, criticized Biden&#8217;s retention of classified records while out of office, yet the prosecutor declined to recommend charges.
The report described Biden as a &#8220;sympathetic, well-meaning, elderly man with a poor memory&#8221; whom a jury likely would not convict &#8220;of a serious felony that requires a mental state of willfulness.&#8221;
Hur also found that Zwonitzer deleted recordings of conversations he had with Biden upon learning about the documents inquiry.
However, the ghostwriter provided &#8220;plausible, innocent reasons&#8221; for his actions during the interview and Hur said he ultimately determined the evidence would not suffice for a conviction on obstruction of justice.
Biden and the White House have pushed back against Hur&#8217;s characterizations in his report, but Garland insisted that it would have been <a href="https://www.dailywire.com/news/garland-says-censoring-hurs-biden-docs-report-would-have-been-absurd" target="_blank" rel="noopener">&#8220;absurd&#8221;</a> for someone in his position to have edited or censored the special counsel&#8217;s explanation.
During testimony on Tuesday, Garland <a href="https://twitter.com/cspan/status/1780261901768831242" target="_blank" rel="noopener">acknowledged</a> his agency sent correspondence &#8220;explaining our position with respect to the recordings&#8221; and noted the &#8220;longstanding practice&#8221; of keeping witness records confidential to not &#8220;chill&#8221; future investigations.

A 29-year-old man who firebombed a <a href="https://www.dailywire.com/topic/wisconsin" target="_blank" rel="noopener">Wisconsin</a> pro-life group’s headquarters in May 2022 was sentenced to nearly eight years in prison this week after he was arrested last year. 
Hridindu Roychowdhury was <a href="https://www.justice.gov/opa/pr/wisconsin-man-sentenced-prison-2022-firebombing-madison-building" target="_blank" rel="noopener">sentenced</a> to 7.5 years in prison on Wednesday after he pled guilty in December 2023 to throwing two Molotov cocktails through the windows of a Wisconsin Family Action building in Madison. The attack came just a week after an early draft of a Supreme Court majority opinion leaked that indicated Roe v. Wade would be struck down. The phrase “If abortions aren’t safe then you aren’t either,” was also graffitied outside the building.

Federal Judge William William Conley, an Obama appointee, who sentenced Roychowdhury, could have given him up to 20 years in prison. Roychowdhury <a href="https://www.dailywire.com/news/suspect-nabbed-in-firebombing-of-pro-life-clinic-after-dobbs-leak" target="_blank" rel="noopener">was arrested</a> in Boston as he was attempting to fly out of the country. 
“Roychowdhury’s arson was an act of domestic terrorism,” said U.S. Attorney Timothy O’Shea for the Western District of Wisconsin. “Domestic terrorism is cowardly and profoundly undemocratic. It is not speech; it is not an exchange of ideas; instead, it is an attempt to harm or frighten one’s fellow citizens, thus driving Americans apart and weakening the fabric of our democratic society.”
Members of Wisconsin Family Action <a href="https://wifamilyaction.org/wisconsin-family-actions-statement-regarding-sentencing-of-individual-who-firebombed-its-office/" target="_blank" rel="noopener">were</a> disappointed with the sentence after recommending that Roychowdhury get 15 years for the attack. 
“We are disappointed,” said the group&#8217;s president emeritus Julaine Appling. “The court missed an opportunity to strengthen the protection of constitutional rights like free speech and free exercise, rights that have themselves been under assault in recent years. The defendant’s act of domestic terrorism to threaten our people, our families and friends, our neighbors, and our greater pro-life community is unconscionable. Ultimately, the defendant — and others who attacked pro-life groups they disagree with — attacked our civil society and the constitutional rights foundational to it.”

Wisconsin Family Action President Christine File said that the sentence “lacks proportionality” for the crime. 
“It is notable that nearly 60 people filled the courtroom to support this person who committed a violent, unprovoked, and hate-filled crime,” she said. “Will the society-of-tomorrow support terrorism intended to silence people with whom we disagree? But perhaps most concerning, in the two years since the attack the defendant did not at any point express remorse to the people he targeted and harmed — until the judge asked him.”

A group of 16 Republican attorneys general told Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> on Wednesday that he was sowing “distrust” in the American electoral system with his comments criticizing state election integrity laws.
Led by Indiana AG Todd Rokita and West Virginia AG Patrick Morrisey, the Republican officials sent a <a href="https://content.govdelivery.com/attachments/INAG/2024/04/10/file_attachments/2843216/FINAL%20Garland%20Election%20Letter.pdf" target="_blank" rel="noopener">letter</a> to Garland over <a href="https://www.justice.gov/opa/speech/attorney-general-merrick-b-garland-deliver-remarks-bloody-sunday-tabernacle-baptist" target="_blank" rel="noopener">comments</a> he made in Alabama discussing the Justice Department&#8217;s efforts to challenge Red state laws related to voter identification requirements and safeguards on vote-by-mail initiatives.
“The Biden administration is weaponizing the U.S. Department of Justice against the states,” Rokita said in a statement. “These actions pose a direct threat to democracy, election integrity and the rule of law. We will stand up and defend our rightful authority within the framework of American federalism.”
The letter was referring to a speech Garland gave at the Tabernacle Baptist Church in Selma on March 3. At the church, Garland said the DOJ was “challenging efforts by states and jurisdictions to implement discriminatory, burdensome, and unnecessary restrictions on access to the ballot, including those related to mail-in-voting, the use of drop boxes, and voter ID requirements.”
According to the Republicans, these comments threatened the principles of federalism and the separation of powers, as well as the rule of law. Joining Indiana and West Virginia were the attorneys general of Alaska, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Missouri, Montana, Nebraska, New Hampshire, South Carolina, Texas, and Utah.

“By using the DOJ against the states, you continue to sow the seeds of distrust among the American electorate,” the officials said. “The DOJ has no authority to dictate to the states in matters that concern their sovereign right to ensure safe, secure, and free elections. Although we do not know exactly the strategy the DOJ intends to take with its numerous election attorneys, we intend to vigorously defend our election laws. We will not allow intimidation and fear mongering to supersede the will of the people.”
The Republicans argued that the DOJ’s criticism of voter ID laws didn’t make sense because people were required to provide IDs for voting, driving a car, purchasing alcohol, or boarding an airplane. The letter also pointed to a bipartisan report that came out in 2005 that found that absentee voting could open up the door for fraud, saying that Garland’s criticism of state laws tightening up scrutiny of mail-in-voting was unfounded. 
As the DOJ plans to challenge state election laws ahead of the 2024 election, the RNC has filed several suits to make Democratic secretaries of state in Michigan and Nevada clean up their voter rolls and enforce voter ID laws.

The Department of Justice (DOJ) reportedly acknowledged finding &#8220;inconsistencies&#8221; in how Fulton County District Attorney <a href="https://www.dailywire.com/news/fulton-county-prosecutors-have-another-recording-of-trump-pressuring-georgia-house-speaker-to-overturn-election-report" target="_blank" rel="noopener">Fani Willis</a>, who is leading a 2020 election interference case against former President <a href="https://www.dailywire.com/topic/donald-trump">Donald Trump</a> and his allies, has managed federal grant funds.
According to <a href="https://freebeacon.com/biden-administration/justice-department-uncovers-inconsistencies-in-fani-williss-use-of-federal-grant-funds/" target="_blank" rel="noopener">The Washington Free Beacon</a>, the DOJ provided the response after the news outlet produced statements showing contradictory assertions concerning awards Willis may have made under the $488,000 federal grant for a Center for Youth Empowerment and Gang Prevention in Atlanta that never opened.
&#8220;During our review of the award to respond to this inquiry, we have noticed some inconsistencies in what Fulton County has reported to [the Federal Subaward Reporting System] and we are working with them to update their reporting accordingly,&#8221; a DOJ spokesperson told The Free Beacon on Friday.
The report said the Free Beacon&#8217;s inquiry focused on subaward payments Willis may have made to the Alabama-based Offender Alumni Association. Although the DOJ initially said the group was not listed as a subgrantee, the agency conceded it made an &#8220;error&#8221; after the Free Beacon reported it had records from Fulton County showing Willis&#8217; office transferred $88,900 to the association.
Toni Barnett, a director at the Offender Alumni Association, reportedly said she had &#8220;no idea&#8221; why the county was reporting making the payments to her group in 2022 and 2023. The Free Beacon noted that Willis&#8217; office did not return a request for comment.
Last month, House Judiciary Chairman <a href="https://www.dailywire.com/topic/jim-jordan" target="_blank" rel="noopener">Jim Jordan</a> (R-OH) warned Willis could face contempt of Congress proceedings if she did not fully comply with a subpoena for records that was issued in February after the Free Beacon <a href="https://www.dailywire.com/news/report-unveils-audio-of-staffer-warning-georgia-prosecutor-of-federal-money-being-misspent-ahead-of-firing" target="_blank" rel="noopener">published</a> audio of an employee telling Willis about the potential misuse of federal funds weeks before the worker was fired. A judge allowed Willis to press forward with her 2020 election case in March after her special prosecutor, Nathan Wade, <a href="https://www.dailywire.com/news/nathan-wade-steps-down-as-special-prosecutor-in-trump-georgia-case-following-judges-ruling" target="_blank" rel="noopener">resigned</a> amid concerns about a romantic relationship between the two. The other option was for Willis herself to step down. The Department of Justice (DOJ) has chosen to rebuff <a href="https://www.dailywire.com/topic/house-republicans" target="_blank" rel="noopener">House Republicans</a> seeking audio of special counsel Robert Hur&#8217;s interviews with President <a href="https://www.dailywire.com/topic/joe-biden" target="_blank" rel="noopener">Joe Biden</a> for a classified documents investigation despite a threat to hold Attorney General <a href="https://www.dailywire.com/topic/merrick-garland" target="_blank" rel="noopener">Merrick Garland</a> in contempt of Congress for defying their subpoenas.
Assistant Attorney General Carlos Uriarte wrote in a <a href="https://punchbowl.news/2024-04-08-out-jordan-comer-re-sco-hur/" target="_blank" rel="noopener">letter</a> sent to House Oversight Chairman <a href="https://www.dailywire.com/topic/james-comer" target="_blank" rel="noopener">James Comer</a> (R-KY) and Judiciary Chairman <a href="https://www.dailywire.com/topic/jim-jordan" target="_blank" rel="noopener">Jim Jordan</a> (R-OH) on Monday — which was the deadline the congressional leaders set for the materials — that a transcript for the two-day interview that was already provided to them should be sufficient.
&#8220;The Department is concerned that the Committees&#8217; particular focus on continuing to demand information that is cumulative of information we already gave you — what the President and Mr. Hur&#8217;s team said in the interview — indicates that the Committees&#8217; interests may not be in receiving information in service of legitimate oversight or investigatory functions, but to serve political purposes that should have no role in the treatment of law enforcement files,&#8221; Uriarte said.
Comer and Jordan <a href="https://judiciary.house.gov/sites/evo-subsites/republicans-judiciary.house.gov/files/evo-media-document/2024-03-25%20JDJ%20JC%20to%20DOJ%20re%20Hur%20subpoena%20and%20contempt.pdf" target="_blank" rel="noopener">wrote</a> to Garland two weeks ago, saying they received redacted transcripts of Hur&#8217;s interview with Biden on March 12, just hours before the special counsel testified before the House. The chairmen again demanded audio recordings of Hur&#8217;s interview with Biden, which they had stressed as a priority, and audio recordings of the special counsel&#8217;s interview with Biden&#8217;s ghostwriter, Mark Zwonitzer, in compliance with subpoenas from February.
If Garland failed to provide the materials by April 8, the committees &#8220;will consider taking further action, such as the invocation of contempt of Congress proceedings,&#8221; they warned.
The committees have &#8220;already received the extraordinary accommodation of the transcripts, which gives you the information you say you need,&#8221; Uriarte claimed. &#8220;To go further by producing the audio files would compound the likelihood that future prosecutors will be unable to secure this level of cooperation. They might have a harder time obtaining consent to an interview at all. It is clearly not in the public interest to render such cooperation with prosecutors and investigators less likely in the future.&#8221;
Uriarte said his letter &#8220;supplements&#8221; previous responses to the panels and noted a transcript of Hur&#8217;s interview with Zwonitzer was enclosed as &#8220;further accommodation.&#8221; He argued that the information provided &#8220;does appear&#8221; to resolve the concerns raised by Comer and Jordan related to legislative oversight of the DOJ and the impeachment inquiry against Biden.
In a sign that the clash over materials from Hur&#8217;s investigation into Biden&#8217;s handling of classified records is not yet over, Comer released a statement that said Oversight and Judiciary Committees will &#8220;soon&#8221; respond to DOJ while seeking &#8220;needed&#8221; information.
&#8220;The Biden Administration does not get to determine what Congress needs and does not need for its oversight of the executive branch,&#8221; Comer <a href="https://twitter.com/RepJamesComer/status/1777448098308001999" target="_blank" rel="noopener">said</a>. &#8220;The American people deserve to hear the actual audio of President Biden’s answers to Special Counsel Hur.&#8221;
Seeming to anticipate an escalation, Uriarte pleaded how it is &#8220;not too late for the Committees to choose a different path, to take on offramp towards the &#8216;spirit of dynamic compromise&#8217; that the Constitution requires of us both.&#8221;
Hur&#8217;s report, which was released in February, criticized Biden&#8217;s retention of classified records while out of office, yet the prosecutor declined to recommend charges. The report described Biden as a &#8220;sympathetic, well-meaning, elderly man with a poor memory&#8221; whom a jury likely would not convict &#8220;of a serious felony that requires a mental state of willfulness.&#8221;

The special counsel also found that Zwonitzer deleted recordings of conversations he had with Biden upon learning about the documents inquiry, but the ghostwriter provided &#8220;plausible, innocent reasons&#8221; for his actions and other materials. Ultimately, Hur said he determined the evidence would not suffice for a conviction on obstruction of justice.
Biden and the White House have pushed back against Hur&#8217;s characterizations in his report, but Garland insisted that it would have been <a href="https://www.dailywire.com/news/garland-says-censoring-hurs-biden-docs-report-would-have-been-absurd" target="_blank" rel="noopener">&#8220;absurd&#8221;</a> for someone in his position to have edited or censored the special counsel&#8217;s explanation.

The Department of Justice has requested prison time for the woman who found first daughter Ashley Biden’s diary in a Florida home several years ago.
Aimee Harris, 42, <a href="https://www.dailywire.com/news/two-plead-guilty-in-theft-of-biden-daughters-diary-which-contained-disturbing-entries" target="_blank" rel="noopener">pleaded guilty</a> in August 2022 to selling that diary to Project Veritas for $40,000 ahead of the 2020 election. Veritas didn’t publish the diary and instead turned it over to authorities.
Harris’ sentencing has been delayed for years, and now the U.S. Attorney’s Office for the Southern District of New York is asking for four to 10 months in prison, the New York Post <a href="https://nypost.com/2024/04/03/us-news/doj-demands-prison-time-for-ashley-biden-diary-thief/?utm_source=twitter&amp;utm_medium=social&amp;utm_campaign=nypost" target="_blank" rel="noopener">reported</a>. The DOJ had previously requested six months of home confinement followed by three years of probation.
Harris has sought to move her sentencing date 12 times, prosecutors have said, which led them to request a harsher sentence.
“The defendant’s sentence must also account for the manner in which she has abused the administration of justice throughout the pendency of this court proceeding,” U.S. Attorney Damian Williams said in <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysd.585345/gov.uscourts.nysd.585345.99.0.pdf" target="_blank" rel="noopener">a recent filing</a>.
“The defendant has repeatedly and consistently engaged in tactics to improperly delay this proceeding, including by misleading the Court with false information to justify belated and unmerited requests for adjournments, refusing to appear when directed, and failing to comply with court orders to disclose or produce certain information,” Williams added.
“Through this pattern of behavior, the defendant has shown a complete disregard for the Court’s orders and for the orderly administration of this judicial proceeding,” Williams wrote.
Harris found the diary while temporarily living at a home in Delray, Florida, where then-candidate Joe Biden’s daughter Ashley previously lived. Ashley left the diary, tax records, a digital storage drive containing family photos, a cell phone, and more on the property, with plans to return to pick up those items.
Harris took the diary and recruited Robert Kurlander to help her sell it to Project Veritas. While Project Veritas never published the diary, sections of it did later leak online. Project Veritas employees had their homes raided due to the diary, which attorneys for the American Civil Liberties Union and other First Amendment proponents argued <a href="https://www.dailywire.com/news/aclu-lawyers-pen-letter-in-defense-of-first-amendment-over-project-veritas-ashley-biden-diary-case" target="_blank" rel="noopener">was unconstitutional</a>.

Williams argued in his most recent sentencing request that a “sentence involving no period of incarceration would be wholly insufficient to reflect the gravity of the defendant’s conduct, including her apparent belief that she is above the law and that she need not comply with this Court’s orders.&#8221;
Williams also said that if Harris doesn’t appear for her sentencing on April 9, he would seek to add an obstruction of justice charge to her indictment.
Kurlander, who also pleaded guilty, will be sentenced on April 12.

Republican lawmakers slammed the <a href="https://www.dailywire.com/topic/biden-administration" target="_blank" rel="noopener">Biden administration</a> on Wednesday over a “weaponized” <a href="https://www.dailywire.com/topic/department-of-justice" target="_blank" rel="noopener">Justice Department</a> after four more Christian pro-lifers face prison time after they were <a href="https://www.dailywire.com/news/four-pro-lifers-face-prison-time-after-being-convicted-in-federal-court" target="_blank" rel="noopener">convicted</a> of FACE-Act related charges on Tuesday.
The four, Eva Edl, Eva Zastrow, James Zastrow, and Paul Place, face up to six months in prison and a $10,000 fine after they were found guilty of violating the FACE Act by Middle District of Tennessee Magistrate Judge Chip Frensly. Critics say that the FACE Act, a Clinton-era law that criminalizes the use of force or threats of force that prevent someone from accessing an abortion facility, has been used to target pro-lifers.
In the aftermath of the convictions, some lawmakers again renewed calls for repeal of the FACE Act, saying that it had been weaponized.
“Biden&#8217;s DOJ is weaponized against pro-life demonstrators,” Rep Andy Biggs (R-AZ) said, commenting on the Tuesday trial. “This is not acceptable. Congress must repeal the FACE Act.”

Edl, Place, and the Zastrows (brother and sister) were charged by the DOJ after they participated in a sit-in at the Carafem abortion facility in Mt Juliet, Tennessee, on March 5, 2021. On that day, a group of demonstrators gathered on the second floor of an office building in the hallway outside Carafem. The group prayed, sang hymns, and urged women showing up to the clinic to not get abortions.
Photos were displayed at the trial showing the four sitting in front of the door to Carafem, but the defendants&#8217; lawyers argued that the DOJ never proved they had actually blocked anyone from entering or actually inhibited the activities of the staff of the facility.

Responding to the news of the convictions on Tuesday, Rep. Barry Moore (R-AL) blasted the Biden administration for its targeting of pro-life activists.

A 35-year-old man has been charged with attempting to shoot up a <a href="https://www.dailywire.com/topic/virginia" target="_blank" rel="noopener">Virginia</a> church after he allegedly posted threatening messages about the church online and showed up to the church on Sunday with a semi-automatic handgun and two loaded magazines.
Rui Jiang was <a href="https://www.justice.gov/opa/pr/virginia-man-charged-attempted-church-shooting" target="_blank" rel="noopener">charged</a> by the Department of Justice on Thursday with attempted obstruction of free exercise of religious beliefs, use and carry of a firearm during a crime of violence, and making threats. Jiang was arrested on September 24, 2023, outside of the Park Valley Church in Haymarket, Virginia, allegedly carrying a handgun and two loaded magazines after a member of the church had alerted authorities about concerning social media posts threatening violence he had reportedly made.
Police searched Jiang’s apartment and say they found five copies of a letter indicating that men in the church would be targeted in the shooting. “To the families of those men about to be slain – I am sorry for what I have done and about to do. May your tears not be cried in vain, but to celebrate how your loved ones had lived,” the letter said.
The letter indicated that Jiang was angry about not being able to get into a romantic relationship. He <a href="https://www.justice.gov/usao-edva/pr/falls-church-man-charged-online-posts-threatening-haymarket-church" target="_blank" rel="noopener">was</a> previously charged in February over the alleged threats.
An <a href="https://i.ntd.com/assets/uploads/2024/03/id982809-Jiang-previous-indictment.pdf" target="_blank" rel="noopener">affidavit</a> in support of his arrest from an FBI agent who investigated the case included several of the social media posts that raised concerns and illustrated anger toward God and the church. The FBI spoke with police who had been alerted about the troubling social media posts.
“The officer observed multiple pictures posted to the account, including one burning a Bible in a frying pan on top of a stove, one with a Bible placed on the bathroom floor, and threatening messages against a church and the government,” the FBI agent wrote in her affidavit. “There were also pictures of a silhouette target with bullet holes in it with the hashtag ‘Fk God,’ as well as pictures from inside a white vehicle parked in a church parking lot at night.”
One post read: “Welcome to Park Valley church, attended by many top secret gov clearance holders in the area. From this day forward, you will know that this is how you will repaid me. Blood will be on your hands.”
The post with the picture of the Bible on the bathroom floor tagged Park Valley Church and was captioned, “Put the Bible on the floor next to the bathroom. Now everytime I take a piss, I have to step on it. #fk God.”

According to the affidavit, Jiang denied that he had showed up to the church on Sunday to carry out an attack during an interview with police.

Jiang could face life in prison if convicted. The FBI and the Prince William County, Virginia, and Fairfax County, Virginia, Police Departments were all involved in investigating the case.

The Biden administration is reportedly considering expanding noncitizens’ access to green cards, which confer legal permanent residence in the U.S.
White House and Department of Homeland Security (DHS) officials are looking into expanding the “cancellation of removal” program. Officials are working on actions the president could take, possibly this summer, to blunt criticism of President Joe Biden’s immigration policies, according to <a href="https://www.politico.com/news/2024/03/25/what-happened-to-bidens-executive-actions-on-the-border-00148717" target="_blank" rel="noopener">POLITICO</a>.
Immigrants undergoing deportation proceedings in immigration court can <a href="https://www.law.cornell.edu/wex/cancellation_of_removal" target="_blank" rel="noopener">apply</a> for “cancellation of removal.” If eligible, applicants may be given a green card and lawful permanent residence in the U.S.
The cancellation process is <a href="https://www.justice.gov/eoir/page/file/1596141/dl?inline" target="_blank" rel="noopener">limited</a> to 4,000 people each year, and the applicant must be undergoing deportation proceedings to apply. To qualify, the applicant must have lived in the U.S. for at least 10 years, be of “good moral character,” not have been convicted of disqualifying crimes, and have a family member who is a U.S. citizen or lawful permanent resident who would “suffer exceptional and extremely unusual hardship” if the applicant is deported.
The program is only defensive, meaning that immigrants cannot apply until they officially enter into deportation proceedings in an immigration court. It’s unclear how the Biden administration may intend to broaden out the process.
A group of Democratic lawmakers last year pressed the Biden administration to consider expanding the cancellation of removal process. Sens. Catherine Cortez Masto of Nevada, Dick Durbin of Illinois, Ben Ray Lujan of New Mexico, Bob Menendez of New Jersey, and Alex Padilla of California <a href="https://www.uscis.gov/sites/default/files/document/foia/CancellationofRemoval-SenatorCortezMasto.pdf" target="_blank" rel="noopener">wrote</a> to officials at DHS and the Department of Justice in May 2023, pushing them to make cancellation of removal proceedings “more accessible.”
The letter urges a reform of the program that would allow immigrants to apply for a review of their case outside of deportation proceedings. If the applicant is found to be a good candidate for the program and a green card, officials would then start deportation proceedings to allow the immigrant to officially apply for cancellation of removal.

“It is estimated that 1.2 million undocumented individuals are married to a U.S. citizen or lawful permanent resident, and about 4.1 million U.S. citizen children have undocumented parents,” the senators wrote. “Establishing a new process for cancellation of removal could have a significant positive impact on many of those individuals and help deliver on the administration’s commitment to immigrant families who deserve to stay together and live and work in the communities they call home.”
Ur Jaddou, the director of the U.S. Citizenship and Immigration Services at DHS, responded to the letter in July 2023.
“DHS will consider your recommendation to establish a new process and will examine pre-existing policy and process options that may be available to noncitizens who may be eligible for cancellation of removal, but who are not in removal proceedings,” Jaddou wrote.
